LEGAL MATTERS CORNER MIRIAM MC GILLICUDDY ANSWERS YOUR LEGAL QUERIES

Gabriel was married when he was very young and is now in a new relationship. He is wondering how he could go about getting a divorce. Divorce in Ireland was made easier by the recent amendment to the Constitution which allows the Oireachtas our law-making body a lot more freedom in relation to effecting Divorce laws. The new law of 2018 amends the old act to allow that people can apply for their divorce ( giving them the right to remarry) once they are two out of three years separated. Moreover, the old requirement for living separate and apart in separate houses has been replace by a more reasonable requirement that the two years separation can occur if the parties were living separate and apart in the one house. Contentious issues can still arise in a Divorce case if there is property either money in bank accounts, land or houses or a pension and one party is seeking a share of that property which may be in the sole name of one party or in joint names. If the Divorce is contested this usually involves hiring solicitors and barristers and can work out as a costly exercise. Significant costs can be saved by both parties going to mediation where they seek to resolve the differences between them in relation to the family property with the help of a mediator. We have a state funded mediation service and are lucky enough to have a mediation office in Tralee in Maine Street. All the parties must do is put their name down on the mediation waiting list 0667186100 and they will be given an appointment in due course. In Gabriel’s case above there were no assets of the marriage and Gabriel has not accumulated any other property so it is likely that his former spouse will hopefully agree to a consent divorce. This involves a solicitor drawing up a consent that is signed by both parties with each being independently advised by their own solicitor and then application is made to court for a consent divorce. Only a Judge in the Circuit or High Court can grant a divorce in Ireland, and they must be satisfied that the parties are living separate and apart for two out of three years marriage, that there is proper provision for all the parties’ involved (spouses and children) and that there is no chance of reconciliation and they can then give the order for divorce. Divorce orders in Ireland even if the parties have no property or children will always include a provision that neither party can sue out of each other’s estate after their death and clearly, they will no longer have succession rights against each other. If the parties have pensions. pension orders need to be obtained that neither party has an interest in the other’s pension or if interests in pensions are to be retained this can be ordered as well. Law quip: The word divorce comes from a Latin word divortium or divortere, but this not only means to separate but also to divert so it does include the concept of turning away to a different path. Milltown Trad Festival- Féile Lughnasadh Programme Finalised! Fruit ripening and fields of grain turning gold can mean only one thing- Féile Lughnasadh is almost upon us! The free, family-friendly, four-day festival in Milltown will begin on July 28th, bringing a spectacular line up to the stage, including Sharon Shannon, Jiggly, The Rising and much more. The festival marks Lughnasadh, the ancient Celtic celebration of the beginning of the harvest and the god Lugh, provider and protector. This festival will bring the local community and the county together to celebrate our music and culture over the four days. Lugh will be honoured at the opening parade, where local kids will be in costume as the Celtic god Lugh and the goddess, Tailtiu, both providers of good harvests. And it won’t be just the

concerts as there will be street entertainment, kids’ events, open music sessions in local bars as well as the festival club in the Community Hall and the outdoor céili on Sunday afternoon. Organizer Owen O’Shea says this could be Milltown’s best festival ever. “We’ve brought the best in trad to the streets of Milltown over the years and this year’s line-up is up there with the best of them”. Vincent Prendergast said, “this is a festival not to be missed. It’s for all the family, the performers are the best in the business and it’s totally free.” Louise O'Shea added, "there's something for everyone, with the parade, the food and crafts fair on the Sunday, the street entertainment competition, the music sessions and céili, there's just so much happening and it's all free and

open-air." If you would like to help, you can come along to a fundraising quiz in Killorglin Golf Club on Friday, July 15th at

8pm for a fun night out and while supporting the festival. See you there!

Newly Refurbished Killorglin Playground Opened By Council Cathaoirleach

The new Cathaoirleach of Kerry County Council, Cllr John Francis Flynn, cut the ribbon last weekend to declare the recently refurbished playground in Killorglin officially opened. The amenity was closed for several weeks to facilitate a €50,000 enhancement which included the installation of new equipment to make the playground more inclusive for all users. ‘The original playground was opened in September 2006 and has served a generation of children well but it was felt that additional equipment was necessary to make the playground more inclusive for

our young citizens,’ said Cllr Flynn. The playground now contains additional accessible equipment including a trampoline, a level access roundabout and low-level combination units which give a more inclusive play experience for all children. The new extension cost almost €50,000 and was jointly funded by the Government’s CLÁR Programme and Kerry County Council. The Cathaoirleach added that the playground is a hugely popular amenity for the people of Killorglin and the wider midKerry area and he thanked the contractor KOMPAN and the

staff of Kerry County Council for progressing the project which had been delayed by the pandemic. Killorglin Playground is one of 43 playgrounds throughout

Celebrate with Pride! By Georgie Downes

THE KINGDOME PRIDE FESTIVAL hits the streets of Kerry this weekend so chalk it down if you’re looking for family fun, lots of colour and truck-loads of positivity. This is the second outing for the three-day festival, brought to you by Kingdom Pride in Kerry (KPINK), and this year’s events are set to entertain and delight in equal measures. Activities include sea swims, a beach clean, beach workout, a quiz night, drag night, and an afternoon in the park. There will also be a display of LGBT+ books in all Kerry Libraries during the week. Plus, why not enter their competition, running throughout July, entitled “Show your Pride” by sharing an image of a rainbow flag on Instagram @ thekingdompride and be in with a chance to win amazing prizes including a hotel stay and a sauna experience. Chairperson of the Kingdom Pride Festival, Morgan Queeney said “As someone who grew up in Kerry, where I had no visible peers or

people I could truly identify with, it was a very lonely place. Feeling connected to a community is so important. Before, there were no groups available for young LGBT people in the county, and members of the older LGBT generation often felt compelled to comply with societal norms which caused a lot of emotional angst and pain. Thankfully, that is changing and going forward, there will always be a noticeable LGBT presence in Kerry where everyone in our community feels like they belong.” The festival runs from Friday July 15th to the 17th with numerous events taking place around the county. Full details, including information and links for ticketed events, are available across social media via Instagram and FaceBook (Kingdom Pride in Kerry). KPINK has a panel of community supports that include the Listowel Family Resource Centre; ScEEN In Kerry; Jigsaw Kerry; Trans

Kerry Support Group; Kerry Diocesan Youth Service (KDYS); BLM Kerry; Tralee International Resource Centre

(T.I.R.C.); CYPSC Kerry; LINC Out Kerry; Gay Project; and Kerry Adolescent Youth Counselling.

Concert with a difference at St Johns, Ashe St Kerry native Brighid Daly is performing a unique concert of Song and Music entitled "Memories Well" this coming Sunday at St. John's Church, Ashe Street at 8pm

This show is a sharing from her own treasury of songs, celebrating not only the joy and enrichment singers and songwriters have played in her life, but also paying tribute to those who initiated her into her love of music, most notably her parents and teachers who shared their passion for our heritage, history and love of story and song as a people.

"I’m deeply aware of the important role music plays in the lives of all human beings as a form of medicine in itself. We are heartened and encouraged and emboldened by its ability to go straight to the heart. My ability to use singing and my love of the stories these songs capture has been one of the most powerful tools in my possession as a method self nourishing and self healing on my own life’s journey" says Brighid Brighid's music has also been influenced by her travels and training as a psychotherapist and an educator in the area

of personal development and self-awareness for the past twenty five years. Combining an eclectic selection of songs of ancient Ireland, from the days of the Civil War, African chant and American folk and gospel, Brighid will be accompanied by the remarkable multi instrumentalist and incredibly gifted musician Nick Moloney so this is definitely a concert not to be missed. Tickets are priced at €25 and can be reserved by texting 089 4855029 or at the door on the night

Meet Máirtín, Kerry's Young Curator This summer Siamsa Tíre announces its Young Curator as Máirtín Ó Cathasaigh, as part of a nationwide Young Curator programme. Máirtín is a singer, musician and actor from Lispole. He has been a member of the National Folk Theatre and the Community Cast of Siamsa Tíre for many years and is now a student in NUI, Cork now keen to bring his artistic flair and youthful enthusiasm to Siamsa Tíre's Autumn programme. Based on a concept developed and implemented at Backstage Theatre in 2020, the Nasc Young Curators programme extended nationally in 2021 with the Lasta Youth Festival. This eight-venue network initiative aimed at giving young people a voice in the work programmed for young audiences. The programme once again offers more opportunities for young artists like Máirtín

to experience industry and network events, and gain valuable experience as a young person curating events for young people. Each of the curators gets to engage with theatre professionals and benefit from mentoring and collaboration. "The team at Siamsa Tíre is delighted to be working with Máirtín in support our our youth programming and we are already excited by his new ideas which we look forward to announcing soon," said Joanne Barry, Repertory Director at Siamsa Tíre. Máirtín will work alongside established artists at Siamsa Tíre to curate a number of events to the end of this year. As an accomplished musician and an artist rooted in the folk tradition, an idea he would like to explore is an 'open session' for young musicians, singers

and dancers. There are few places where young people can 'gather together' to play music, so the hope is that these sessions will happen in Teach Siamsa na Carraige, Teach Siamsa Finuge and also at Siamsa Tíre on Culture

IT’S ONLY A JOKE MY WIFE JUST GOT OUT 3 MEN ARE OF THE BATH AND WAS STRANDED WRAPPED IN A TOWEL ON AN ISLAND. men are stranded on an island WHEN SHE HEARD A KNOCK 3and they find a genie bottle. They decide that She went down to the door in her towel. She opened it to our neighbour, Bob. Bob looks at her, and quickly says, “Look this might be weird but ill give you €800 if you drop the towel right now. She proceeds to drop the towel, exposing herself to Bob. Bob hands here the 800 euros and walks away. My wife comes upstairs. I asked her, Hey, who was at the door? “Oh, just our neighbor Bob.” She says. I say, “Oh damn, where’d he go? Does he have the €800 he owes me?”

She holds her phone to her ear, and with a loud voice says: “Honey, you won’t believe it, but your husband is having lunch with his girlfriend at so-and-so restaurant” Half the diners instantly get up and rush to the exit..

THE TOILET BRUSH

A man walks into a store looking for a toilet brush. The store owner shows him a variety of brushes at various pricepoints. The man thinks for a little while, then buys the cheapest one. The next day the man is back at the store. “Were you unhappy with your purchase?” asks the shopkeeper. “We have other models that might work better.” The man agrees and buys a little more expensive one. The next day the man is back yet again. The shopkeeper, visually puzzled on how a toilet brush can be such a big deal, asks “What’s the matter, didn’t like the new one either?” “Well” replies the man. “To be honest it was pretty effective. But I gotta say, I prefer toilet paper!”

each person gets one wish. The first man says “I wish I was back home.” then disappeared. The second man says “I wish I was off this island!” and he was gone. The third man say “I wish my friends were back.”

WASHINGTON D.C. WAS IN COMPLETE GRIDLOCK...

As I stewed in traffic wondering what was causing it, a guy comes up and knocks on my window. “What’s it all about?” I ask. “You haven’t heard? President Trump has been kidnapped. It’s all over the news! The ransom note says we either deliver a billion dollars or they are going to cover him with gas and burn him alive. I’m out here taking up a collection to help.” “Oh, God.” I said. “Of course I’m willing to help. Anything. How much have you got so far?” “About six gallons.” He said.

A STRANGER WAS SEATED NEXT TO LITTLE JOHNNY ON THE PLANE

When the stranger turned to the Little Johnny and said, “Let’s talk. I’ve heard that flights will go quicker if you strike up a conversation with your fellow passenger.” Little Johnny, who had just opened his book, closed it slowly, and said to the stranger, “What would you like to discuss?” “Oh, I don’t know,” said the stranger. “How about nuclear power?” “OK,” said Little Johnny. “That could be an interesting topic, but let me ask you a question first. A horse, a cow, and a deer all eat grass. The same stuff. Yet a deer excretes little pellets, while a cow turns out a flat patty, and a horse produces clumps of dried grass. Why do you suppose that is?” “What? I have no idea” said the stranger. “Well, then,” said Little Johnny, “How is it that you feel qualified to discuss nuclear power when you don’t know squat?”

Final result: St. Pats Blennerville: 2-11; Austin Stack Club ‘C’: 0-10. B’é George O'Donnell (John Mitchel Club) an réiteoir. Adrienne McLoughlin was on hand with her camera.

THE TEAM AT THE CLINIC ARE HERE TO ANSWER YOUR QUESTIONS ON COSMETIC AND HAIR RESTORATION ISSUES. My son is going on holidays in September with his buddies. He is suffering with bad acne on his face, chest and back. Would a treatment make any difference at this late stage? Lillian. Hi Lillian, Acne is one of the most common skin conditions. Aside from the physical effects of acne, the condition can also have an impact on emotional and psychological well-being. AC dual is a treatment for acne available here in the CHRC at the Bon Secours Hospital Tralee. The treatment utilises intense pulsed light technology to deliver direct bursts of blue and red light onto targeted areas of the skin. Both the blue and red light have acne fighting capabilities. The blue light targets and eliminates the bacteria causing acne, while the longer wavelength of the red light reduces inflammation on the targeted area. Smart pulse technology embedded in the applicator ensures precise and consistent energy delivery that is maintained throughout the course of treatment. The real time cooling feature detects the applicator temperature to maintain safety and comfort. The skin feels and looks healthier with a significantly clearer complexion. There is no downtime and the treatment is quick and comfortable usually around 30 minutes. Say goodbye to any acne related inflammation that can be so sore to the touch and the bacteria that leads to breakouts is also eliminated. A course of 8-10 treatments is recommended and can be done twice weekly once 4 days are left in between each treatment, so he will have time to complete the course before his holidays.

TALKING SPORT WITH THE TRALEE ADVERTISER

with “The Voice” Pat Harnett

FAI NATIONAl P.R.O. OF THE YEAR KERRY STILL ON THE MARCH IN JULY: I know I am mixing sport and political metaphors but in terms of the Kerry teams it is apt. First through on Saturday were the Kerry senior ladies who defeated Armagh in a cracker where they had to dig deep on a number of occasions. In the end they book their place in the TG4 LGFA Championships semi-final winning 4-12 to 2-14 score line. With the sides level a Louise Ni Mhuircheartaigh penalty gave Kerry some breathing space and she added the insurance point late on. It was a day of surprise in the Ladies Championship as Donegal knocked Dublin out 3-07 to 1-07 and the other heavy hitter to fall was Cork who were beaten 2-13 to 0-17 by Mayo. The results means that this weekend in Croke Park Kerry will face Mayo and Donegal take on Meath. And what a game we then had on Sunday when the old foes went at it once again. The GAA football championship has once again been saved from being totally unforgettable by Kerry and Dublin. This time it was Kerry who took it with a super Seanie O’Shea free erasing the 2011 hurt from the Stephen Cluxton All Ireland winner. However once the euphoria of the win wore off in mid-week you can be sure Jack and the management had plenty to say from the video review of the game. It will bring on this team hugely and banishes the talk that they cannot win tight games and that Kerry cannot beat Dublin. Kerry certainly have lots to work on but that is the perfect way to approach the next two weeks and they certainly will not want any compliancy to creep in. It will be a great time and hopefully the Green and Gold will now be flying high in every corner of the county. Media outlets will be happy as the run into an All Ireland is an exciting time but also a lucrative one special features etc. Could it be the Year of the 4 K’s? Kilkenny footballers have done their job, the hurlers take on Limerick this Sunday in what should be another cracker, fingers crossed for the Kerry Ladies and then all eyes will turn to the football final. HAWKEYE CROSS EYED: In a time where technology is becoming more and more important in big games those in the Associations that run these competitions will be contacting their suppliers to make sure everything is ok after the Hawkeye debacle. A point that it ruled out was later ruled to be a good score in the Derry versus Galway game meaning the score was 4 points each and not 4 points to 3. The good thing was the issue was sorted at half time and thankfully it didn’t happen in the last minute of a game where a point either way could have been vital. However the wider question is when did Hawkeye go cross-eyed and were any other scores wrong given the Nil outcome? Hawkeye was not turned on in the Kerry

24

Friday 15th July 2022

Dublin game so all calls were made by the 8 officials (4 umpires, the referee and his linespersons and fourth official). The GAA will need to do some explaining of what the problem was before Hawkeye gains back the confidence of players, managers and supporters. SIX LEFT IN THE KERRY SENIOR HURLING CHAMPIONSHIP: No team has ever won an easy Garvey’s Senior Hurling Championship and this year won’t be any different. All the attention will now be on Austin Stack Park this Saturday when first up at 4pm Ballyduff will take on Abbeydorney followed at 6pm by Causeway against Ballyheigue in the quarter finals. Kilmoyley and Crotta O’Neills are awaiting the winners in the semi-finals. AUSTIN STACKS NEWS: The seniors defeated Spa by just 1 point 1-10 to 1-09. With three teams finishing level the boys will play Dingle this weekend with Dr Crokes getting the Bye into the final. The B’s had already been relegated to Division 5 so their 4-14 to 2-14 win over Beale in the final game didn’t make any difference. The C’s lost 2-18 to 1-07. There was no winner of the Lotto from the numbers drawn 9,11,17 and 32 with the next jackpot being e2750. In the underage section the All Stars continue to enjoy their weekly sessions and train at 10am in Connolly Park this Sunday morning. The Academy is back after their break for the Kerry game and the u9’s will take on Mitchels at 11am this Sunday. Some of the players are into the next round of the Community Games as part of the Oakpark/St Brendan’s/Listellick team. The u11’s are training for their next Go Games while the 13’s are in training for their next games. The minor had a good challenge against Dingle ahead of their Championship game against Kenmare at Spa. BALLYMAC NEWS: The senior team went down 2-16 to 1-11 away to the Legion in their final County League game but had already secured their Division 1 status. There was no joy for the players on the St Kieran’s u21 side who lost their Acorn Life u21 football Championship semifinal to East Kerry. All the Academy sides enjoyed another great session and are out again this week. The u9’s played Ardfert over 3 7-a-side games. They have Dr Crokes and Spa to play. The senior Ladies played Na Gaeil in preparation for their Donal Curtin Division 3 semi-final when they take on Listowel on July 21st. The 14’s went down to a strong Mitchels team but are looking ahead to the County B final. The club was delighted to see two of its keepers in the Kerry jersey – Robyn White for the Ladies B side who played Cork and Kerry Hennessy who captained the Kerry 17’s in the National Development Blitz in Abbotstown.

KERINS O’RAHILLYS NEWS: The club, as part of the ‘One Good Club’ initiative, is hosting a Family Fun Day this Sunday, July 17th. The fun starts at 2.30pm at the Strand Road pitch and there will be lots of activities for all the family including Solo Speed Tests, Well Throwing, Novelty Races, Crossbar Challenge and Penalty Shoot-Out. There will also be live music and face painting. The u10 girls take part in the North Kerry Fun Blitz this Sunday while the u12 Girls are looking forward to their trip to Croke Park on July 31st. In a date for your Diary the Sandra Keane Tournament will take place on Saturday July 23rd at the John Mitchels Sports Complex in memory of a much missed member of the club. The u17 Girls Championship will run from August to October while the seniors are waiting for a date for their North Kerry League game against St Pats/Churchill. Spaces are going quickly for the Summer Camp that runs from August 2nd to 5th with booking details available from the club. Lotto: There was no winner of the Lotto from the numbers drawn – 15, 16, 20 and 30. ST PAT’S NEWS: There was no Academy due to the Kerry game but they will all be back in action this Sunday. The 13’s are combining with Kerins O’Rahillys to take part in the Central League. The 17’s St Pats/Rahillys combination are in semi-final action against Skellig Rangers/Valentia. The club had players on the u21’s St Brendan’s Board team that went down to Kenmare District. The Senior team were winners by the narrowest of margins 3-08 to 2-10 against Renard and will play in Division 4 in 2023. The B’s have their Development League Final this Saturday against Scartaglin in Desmonds at 7pm. PARNELL’S NEWS: The u8 girls played an in-house friendly against the u7 boys. The u9 hurling boys took part in the North Kerry Blitz along with Ardfert, Ballyheigue and hosts Lixnaw. The u10 camogie side welcomed Killarney to Caherslee. The u11’s put in a great display against Abbeydorney. The minor hurlers defeated Kenmare/ Kilgarvan in the County Championship and play St Brendan’s in the semi-final this weekend. In the Junior Camogie League the side enjoyed a win away to Cillard and look forward to their games during the summer. The club thanks Brian Donovan and Jamie Lowham from Garryowen Transport for the set of jerseysw for the u11 hurlers. Best of luck to all those who are taking part in the Summer Camp that runs from this Monday to Thursday. Lotto- there was no winner of the Lotto from the numbers drawn 16,23,24 and 25. The next jackpot will be e1000. ON THE BIKE The Tralee Manor West Cycling Club league is underway with Round 1 suiting the climbers and the top three positions were fought out in a three man sprint. In the end Vincent O’Leary took the win just ahead of Joe Roche and Stevie Griffin. 5 riders receive points each Tuesday night with Shane Fleming finish 4th and earning 2 points and John Roche 5th picking up 1 point. We will have Round 2 details in the next edition. BUSY WEEKEND ON THE LOI FRONT: Last weekend saw defeats at Mounthawk Park for the Kerry 14’s where Szymon Jasinski, son of head coach Adrian, scored this sides first League of Ireland goal from

Call Chris or Colette Tel: 066-7126399 or e-mail : traleeadvertiser@gmail.com

the penalty spot. But it was the visitors Bohemians that took the win. The 17’s,who were a little depleted, lost 4-0 to a clinical Bray Wanderers in a game that was much closer than the final score line. This Saturday the 14’s are at home in their final Cup Group game taking on Carlow/Kilkenny from 2pm. At the same time in their second Tier 2 game the 17’s take on Drogheda. The 19’s are at home on Sunday with Athlone Town the opposition from 2pm. They won their second game in a row and third from 5 in Phase 2 when they defeated Wexford away 3-1 thanks to goals from Sean O’Connell, Venis Jahiri and Daniel Okwute. IN THE RING: The countdown is on for the Tralee Boxing Clubs Summer Camp which will take place over two weeks – from July 18th to the 21st and July 25th to the 28th. Those taking part can learn or improve their skills in a fun and safe environment. At the time of going to print there were still some spaces left and to book contact Lynda on 087 7663406. The club is delighted to announce that the Department of Children, Equality, Disability, Integration and Youth has facilitated the inclusion of a number of Ukrainian refugee children in our Summer Camp this year. A huge thank you is due to all at Kerry County Council for advice and support in achieving this. The clubs AGM took place last night, Thursday July 14th and we will have details in our next edition. IN THE WATER: The 3rd swim in the Tralee Bay Swimming Club’s Summer Series was sponsored by World of Wonder and topping the timing charts was Ger Pierce who was followed home closely by Michelle Hoare, Gavin Quinlivan and Dave Smith. President of the TBSC PJ Costello was again on hand to present the prizes on the night. The Untimed and New to Open Water Swimming groups both enjoyed their night. Don’t forget this Saturday night it’s the Midsummer Disco and BBQ straight after the swim, with showers available to help participants get ready to party!. Tickets are e10 each and can be bought on eventbrite. ANGLERS CATCH THE BIG PRIZE: Well done to brothers Chris and David O’Sullivan who were on the Irish men’s senior angling team that defeated England to clinch the Home Nations trophy. Their cousin Liz McMahon and Rosaleen Murphy was on the Irish Ladies team that finished 4th. All four are members of the Tralee Bay Sea Angling Club. ON THE GREENS: PITCH & PUTT – The u16 County Strokeplay Championships took place on a sun drenched Listowel course with Ajay Barrett from the home club taking the overall win. From a Tralee point of view the Girls competition was dominated by the Moynihan sisters. There was only one between the girls with Ella on 114 just getting the better of Sophie’s 115. The 16’s head to Kildare this weekend for the National Matchplay which take place at the Ryston Club in Newbridge. And the Castleisland Scratch Cups are back on Sunday with the Danny Broderick and Laura Brosnan Cups up for grabs as well as the Intermediate Cup.

THE MIRACLE PRAYER Dear Heart of Jesus in the past I have asked for many favours, this time I ask you this special one (mention favour).
