Partner tax issues

Susan and David have lived together for 10 years. They never got married as no interest in going down that road. They have three children. They own their own home in which they reside and a holiday home and have money invested for the children’s education which is held in their joint names about €60,000 as well as ongoing savings for a rainy day in joint names about €20,000. They want to make wills leaving everything to each other and providing for their infant children.

Where property is in joint names it goes to the other person by survivorship so the will when it is made will just copperfasten this. However if Susan and David have other property or money in their sole names then the will leaving everything to the other party will allow for the property to devolve to the other. The main issue for Susan and David is capital acquisitions tax whereby the property is in joint names and if one party dies the other party is inheriting half the family home, holiday home and savings. The tax threshold where they are cohabiting partners is €16,250 so anything they receive on the others death above that is taxed at 33% which would leave Susan or David with a significant tax bill. Their children have large tax thresholds of €335,000 each but property would have to be held in trust for them until they are 18 or older. Also, the savings for the children could be set up in trust accounts so it is not taxable in Susan or David’s name if they die prematurely. There is a tax exemption for partners like Susan and David who live in their own home and have no other home whereby if either one of them died there would be an exemption from CAT to enable them to keep the home, but this does not apply here due to the existence of the holiday home.

It means that there is a significant tax problem for Susan and David in inheriting from each other and they will have to seriously contemplate marriage to alleviate the tax implications if either of them dies. One other method of providing for each other is to take out life policies on each other’s lives. So, Susan would take out a life policy on David’s life and pay all the premiums and if David died, she would obtain that money free of CAT and vice versa for David he could take out a life policy on Susan’s life and if she dies would obtain the proceeds free of CAT. This could be a way of providing for the tax bill referred to above if the parties resolutely did not want to get married.

Corcoran’s Furniture & Carpets Ltd. Celebrate Their 25th Anniversary In Style

Corcoran’s Furniture & Carpets Ltd. celebrated their 25th anniversary at their Killarney store on Friday, July 26. This milestone marks a quartercentury in business for Corcoran’s, which operates five stores in Cahersiveen, Killarney, Tralee Manor West, Tralee Outlet, and Newcastle West.

The festivities began with speeches from key figures, including founder and owner Kieran Corcoran, Financial Controller Shane O’Callaghan, Elaine Buckley from Autism Assistance Dogs Ireland (AADI), CEO of Tralee Chamber Alliance Colette O’Connor, and Killarney Chamber co-president Johnny McGuire.

AADI, Corcoran’s chosen Charity of the Year, was represented by Áine and Darragh Caddigan and their assistance dog, Buzz. They participated in a recent charity walk organized by Corcoran’s, which raised €12,387 for AADI. The anniversary celebration featured an afternoon of canapés, desserts, and beverages enjoyed by the public, Corcoran’s team, and their families. Radio Kerry broadcasted live from the event, with Brendan Fuller hosting The Afternoon Show from the Corcoran’s Killarney car park. Fuller conducted interviews with Kieran Corcoran, Helen Murphy (Daily-divadiary), Shane O’Callaghan, PJ Sugrue (Corcoran’s longest-term employee from Cahersiveen), and

Elaine Buckley (AADI).

Attendees received gift bags filled with Corcoran’s vouchers and goodies. Highlights included a zumba session led by Michelle Salute from Zumba Fitness and children’s face painting by Marzena Jegouzu, creating a day filled with celebration, laughter, and fun.

In honor of the 25th anniversary, Radio Kerry gave away €2,500 worth of Corcoran’s vouchers. The grand prize, a ‘Win A Home Makeover’ worth €1,500, was awarded live on the show to Marie Sheehan from Kilcummin, Killarney. Speaking at the event, Kieran Corcoran expressed his gratitude: “We are thrilled to celebrate our 25th anniversary. It’s hard to believe we opened our first store in Cahersiveen 25 years ago. Our goal has always been to provide topquality furniture, carpets, and service to our valued customers. I want to thank our dedicated team and loyal customers. We look forward to many more years of continued service.”

Colette O’Connor, CEO of Tralee Chamber Alliance, praised Corcoran’s: “Congratulations on reaching this fantastic milestone. Your journey from South Kerry in 1999 to your current presence in Kerry and Limerick is a testament to hard work and determination. Corcoran’s commitment to the community, providing employment,

and delivering top-quality service is commendable.”

Corcoran’s will continue their anniversary celebrations at the Cahersiveen store on Friday, August 16, with additional events planned throughout the year. These events will be publicized on Corcoran’s

Minister Foley welcomes expansion of Hot School Meals programme to a further 12 Kerry schools.

Minister for Education and Kerry

TD Norma Foley has welcomed the expansion of the Hot School Meals programme to a further 12 Kerry schools.

The scheme was first set up in 2019 with a pilot of 30 schools but has now expanded to almost 2,200 primary schools.

Around 69 primary schools in Kerry are currently operating the Hot School Meals programme and this is now being extended to a further 12 primary schools in the county.

Minister Foley said: “The Hot School Meals Programme has been a tremendous success and it is fantastic that it has now been expanded to another 12 primary schools in Kerry.

We now have almost 2,200 primary schools on the programme and all remaining schools can apply

to join for the next school year in September.

The programme is known to facilitate better education outcomes and I know that today’s announcement will be welcomed by many parents and families.”

The latest expansion of the Hot School Meals programme brings the total number of primary school children now eligible for it every day to 345,000. There are 8,984 children in Co. Kerry currently benefitting from free hot school meals and the addition of 12 more schools to the programme will increase this even further.

The Department of Social Protection provides the funding to schools for the School Meals Programme, and it is the responsibility of schools to choose their supplier in an open, fair and transparent manner in

accordance with national legislation and EU directives on procurement.

The Department of Social Protection has this year contacted all of the remaining Primary Schools who have not yet joined the Hot School Meals scheme asking them to submit expressions of interest in

commencing the provision of Hot School Meals. Heather Humphreys, the Minister for Social Protection, has said that the responses will be reviewed with the aim of including more schools subject to available funding in Budget 2025.

Tidy Towns Awards Entries Extension

Dear all,

We hope this newsletter finds you well. We are writing to inform you of an important update regarding the application process for businesses who wish to enter this year’s Tralee Tidy Towns Awards. After a hiatus, the awards are back this October!

Late one Friday in Dublin, a policeman spotted a man driving very erratically. He pulled the man over and asked him if he had been drinking that evening.

‘’Aye, so I have. ‘Tis Friday, you know, so me and the lads stopped by the pub where I had six or seven pints. And then there was something called ‘Happy Hour’ and they served these mar-gar-itos which are quite good. I had four or five o’ those. Then I had to drive me friend Mike home and o’ course I had to go in for a couple of Guinness -- couldn’t be rude, ye know. Then I stopped on the way home to get another bottle for later...’’ And the man fumbled around in his coat until he located his bottle of whiskey, which he held up for inspection. The officer sighed, and said, ‘’Sir, I’m afraid I’ll need you to step out of the car and take a breathalyzer test.’’

‘’Why? Don’t ye believe me?’’
