MIRIAM MC GILLICUDDY ANSWERS YOUR LEGAL QUERIES
Sharon owns an apartment in an apartment block in a provincial town. The block was developed about 10 years ago and she is a member of the owner’s management company (OMC).
She has never attended an annual general meeting of the management company but has always paid her annual service charges, but she is wondering how the management company works. The running of the company seems to be operated by paid agents rather than the owners themselves.
The above scenario has become more common for apartments and even for houses in estates where a management company may operate. In the apartment situation usually the owner of the apartment holds it under a long lease e.g. 500-999 years and the owner’s management company OMC owns the apartment development.
The OMC is usually a company limited by guarantee. The apartment owners are responsible for the maintenance and repair of their individual apartments, but the structure and common areas are managed and maintained by the OMC. On occasions until matters are investigated it may not be initially clear who is responsible.
Leaks from one apartment to another may constitute an owner issue but the OMC may get involved to make sure it is sorted asap with minimal loss to all parties. On the other hand, a leak from the roof into an owners apartment may be an OMC issue solely if the roof
is their responsibility. Annual service charges are levied to pay for the common services e.g. refuse, insurance, electricity fire alarm systems and agents fees. There should also be an annual amount which is put into a sinking fund which is for building and common area investment. The owners of the apartments have a share each in the OMC and right to attend the AGM and right to vote usually one owner one vote. At the AGM directors are voted in for the following year and the fees for the service charges and sinking fund are set for the year. The lease to the owner sets out what they can and cannot do in their apartment and may have restrictions for example on what can be hung over balconies or attached to the apartment and in relation to not creating a danger or a nuisance on the property. Many OMC also have house rules to adequately manage behavior in the apartments to ensure less conflict between the occupants. Many of these apartments are occupied by tenants who do not have a vote and who are dependent on their landlord to take an interest in what is happening in the OMC. This may not always be the case. The landlord can appoint the tenant to use his vote by proxy.

Q; What’s the Perfect indoor plant for children’s rooms that are non toxic for both children and animals.
Naomi says ....
Peperomia Santorini this is an easy to grow plant that is Suitable for small spaces and has a lovely texture to the leaf and a lovely shape to the plant. Requires regular watering every two weeks.
The second plant is pilea inv. moon valley. This is called the friendship plant. Again stunning textures and shapes in the leaf which gives visual appeal to children. Lastly the chamaedorea elegans. This palm has a tropical look to it and is very easy to grow.
For the older children in the house they can enjoy a full range of cacti and succulents.
These plants have a low water requirement and are ideal for small spaces in the bedroom.
We often think that we cannot have plants in the bedroom but it is totally safe and two of the following actually release oxygen throughout the night.
First one is the peace lily. (Spathiphyllum) this is a very easy to grow plant and can go in indirect light.
The second is the snake plant. (Sansevieria) this is the easiest plants commonly named the mother in laws tongue. Grows literally anywhere with very little watering required.
Also , just arrived in stock for all those kids that are interested in the carnivorous plants... Dionaea muscipula the Venus fly trap. These plants are amazing. Giving off a scent to attract those pesky flies and snap shut. This is how the plant feeds itself... Naomi

Overnight Cheesecake
Ingredients
• 2 Weetabix
• 2 tbsp fat-free natural yogurt
• 160g no-added-sugar, fat-free vanilla yogurt
• 50g fresh strawberries, chopped
• 1 level tsp Sweet Freedom Choc Shot
Method
Put the Weetabix in a bowl and crush them with your hands or a fork. Add the natural yogurt and mix together. Spoon the mixture into the base of a ramekin or dessert glass and press it down firmly. Pour the vanilla yogurt evenly over the top. Cover and chill overnight.
Next morning, top with the strawberries, then drizzle over the Choc Shot – and dig in!

Kerry’s CAO applicants secure a large number of college offers in Round One
GOOD NEWS!
The excellent results achieved last week by Kerry’s 1,713 traditional Leaving Cert candidates saw them sweep the board in CAO Round One of college offers, which were released at 2pm on Wednesday, 28th August. After a few tense days of expectant waiting, there was joy unconfined when a large majority of Kerry’s CAO applicants received a college offer. On a pro rata population basis, Kerry’s CAO applicants will be close to the top of the class in securing college places. A final CAO application figure of 83,543 - 2,362 from Kerry - meant keen competition across many courses. However, the generous supply of college places that are on offer this year has helped to stabilise the points.It’s very evident that the provision of more college places around the country will help to reduce points requirements and to ease the pressure on young people.School leavers continue to rush to college in unprecedented numbers. The steady flow also of mature and non-traditional applications is a very healthy development as everybody deserves a second chance. A quota of places was reserved by CAO for the 7,365 mature applicants and the 12,055 applicants from the Post Leaving Cert (PLC) sector. Norma congratulates Students on receiving their Leaving Certificate results
Minister for Education Norma Foley has congratulated the 60,839 candidates across Ireland receiving their Leaving Certificate examination results last weekend
The State Examinations Commission (SEC) made the Leaving Certificate 2024 results available to students who sat this year’s Leaving Certificate Established, Leaving Certificate Applied and Leaving Certificate Vocational Programme examinations.
Minister Foley has reminded all students of the wide range of wellbeing and career supports available to assist them as they receive results and begin to look ahead to future education and career options they may wish to
explore.
Minister Foley also welcomed the confirmation from the State Examinations Commission this year that it intends to issue the results of any Leaving Certificate appeals on Friday, 27th September, in time for the final round of CAO offers as normal, and also that it intends to issue Junior Cycle results on Wednesday, 9th October– a week earlier than they issued in 2023. This will provide clarity to those students and their families and I would also like to wish them well.”
The National Parents and Students Leaving Cert Helpline 1800 265 165 will operate from Friday 23 August until Saturday 31 August, from 10am
to 5pm each day, except for Sunday 25 August when it will be closed and Saturday 31 September when it will be open from 10am to 2pm.

Due to an EU regulatory change regarding certain security screening equipment, the following LAGS rules will come into effect at Kerry Airport from September 1st 2024
1. Only LAGS in containers of 100ml or less can be brought through security – these can stay inside your cabin bag and there are no restrictions on the number of containers or type of LAG (provided they are not dangerous goods) – they do not have to be in a plastic bag.
2. We will accept LAGS in containers over 100ml but these must fall into the category of baby foods/milk, medicines or special dietary requirements – these must be presented at the screening point outside of your cabin bag but do not have to be in a plastic bag – they will be subject to additional screening after they have passed through the x-ray equipment.
3. All other LAGS in containers over 100ml, aside from point 2 above, will be rejected and you will be asked to surrender them at the screening point for disposal.
If you have LAGS that fall into the category of point 3 above, then please ensure they are packed into your hold baggage or else do not bring them. It’s important to note that the screening equipment itself, which is of a high quality, is not in question and also that the European Commission are not acting on any new threat information, but rather they are responding as a precautionary measure to a temporary technical issue that has been identified. We expect to resume allowing all LAGS to remain inside cabin baggage at some stage in 2025.

Golf Classic
A huge thank you to everyone who supported our Annual Golf Classic in Beaufort on August 23rd. Special thanks to sponsors, volunteers, and the Beaufort Golf Club team. Senior Ladies
Killarney Legion 0-16, John Mitchels 2-08. Despite a strong start, we narrowly lost in the County Championship opener. We face Kilcummin at home on Monday at 7:15 pm.
Minor Team
We play North Kerry in the County Championship quarter-final on Monday at 7 pm in Moyvane. Congrats to Gearoid White on making the 2024 Electric Ireland Minor Team of the Year. Academy

U7 Hurling
A fantastic evening of hurling took place in Caherslee last Wednesday at the county U7 blitz. Parnells had two teams showcasing their skills. With 16 teams and over 40 matches played, the future of Kerry hurling looks bright!
U11 Hurling
Well done to our U11s for an excellent game against St. Brendan’s in Caherslee last Tuesday. The skill and intensity from both sides were top-notch. Thanks to Donnacha Buttimer for refereeing.
U12 Hurling
Our U12 boys had a great morning at the North Kerry blitz in Ardfert last Saturday, playing strong games against Kilmoyley, Causeway, and St. Brendan’s. Kerry Camogie

The Lee Strand Football U14 Tournament is on September 14th. Trials were held recently, and preparations are in full swing.

Training continued on Wednesday and Sunday. All players should attend. Congrats to our U15 boys selected for the minor panel.

Our ladies faced Laune Rangers in a tough match. Despite trailing at halftime, our team showed great determination in the second half, securing a 2-11 to 2-8 victory.

Our U11 boys participated in the Jerry Foley U11 Memorial Blitz. Great effort by the team, and thanks to Firies for organizing the event.

The U12 girls had strong performances in recent matches against Southern Gaels and Corca Dhuibhne. They will play Laune Rangers at home on Thursday, 5th September, at 7 pm. Academy

After our exit from the intermediate championship, our focus shifts to the senior county championship starting on September 14th/15th. We’ll compete with St Brendans, including teams like Austin Stacks and John Mitchels. St Brendans face South Kerry in the opening round on September 15th at 4 pm in Austin Stack Park.
Juvenile Academy:
Training continued on a windy Sunday in Ballyrickard. Great turnout despite the weather. Best wishes to all returning to school.

had a fine victory over the Eoghan Rua (Ó Súilleabháin) team last week....3-11 to 2-6....in blustery conditions. Cross winds made play quite challenging for the players but, despite the unpleasantness of the elements, the spectators were treated to a very entertaining encounter. Mechanical Automation and Maintenance Fitter (MAMF)
Fitter apprentices are trained in the use of machines and processes involving integration of computer, electronic and programming control systems, along with servicing and assembly of machines.
Metal Fabricator
Metal Fabricators are trained in the fabrication and joining technologies of components for large steel structures including MMA, MIG and MAG welding.

Liebherr Container Cranes in partnership with Munster Technological University(MTU), offer an enhanced apprentice programme. In addition to their craft qualifications, apprentices complete a Level 6 Higher Certificate in Engineering in MTU Tralee. This gives qualified apprentices the opportunity to continue to an Honours Degree in Engineering (level 8).
