Noise issues.

Charles is 60 years of all and all he wants is a quiet life, but he lives in a terraced house in town and there is a considerable amount of noise generated in his area which he finds disturbing e.g. From traffic. The general noise level has escalated in recent times with a young family moving in next door and noise levels have increased dramatically. One of the family is playing ball against the party wall between them.

Noise pollution is one of the more common neighbourhood issues. There are two aspects to Charles problem.

1. Environmental noise in a local area – this is governed by Environmental Noise Regulations brought in 2006 on foot of an EU directive. This relates to Environmental noise and means unwanted or harmful outdoor sound created by human activities, and includes noise from transport, road traffic, rail traffic, air traffic, and from sites of industrial activity. The local authority are obliged to have an action plan to reduce this ambient noise. They can put conditions in planning permissions to reduce noise both in course of construction and once a development is completed. It has been recognised at EU level that excessive noise can have adverse effects on human health. So he can approach his local authority to highlight the issue and to add weight tune in with the local residents association and do a combined report on the noise

in the area. The Local Authority may take action in relation to matters then to reduce down noise in the area.

2. The neighbourhood noise arising from his neighbours. This is always a delicate issue. Because if approached diplomatically at an early stage it can result in voluntary improvement on the ground. Often by becoming friendly with his neighbours he can drop hints about his concerns and consideration for neighbours will become the family’s priority. Mutual respect for each other can solve many neighbourhood issues. However if it becomes a stalemate and the neighbours are not curtailing their excessive noise Charles does have options e.g. he can contact the guards who act as liaison especially in relation to youth or adult anti-social behaviour. He can make a complaint to the District Court under the Environmental protection act. He should document the times, dates and details of the noise. In order to successfully take a complaint the noise should be so loud, so continuous, so repeated, of such duration or pitch or occurring at such times that it gives you reasonable cause for annoyance. The court will hear both sides and if they are satisfied it is necessary they may make an order that the person or body ( e.g. company) making the noise have to reduce it to a specified level, to limit it in some way for example to specified times, or to stop the noise altogether. This order is enforceable.

Law quip: “Noise pollution is a relative thing. In a city, it’s a jet plane taking off. In a monastery, it’s a pen that scratches”. Robert Orben.

READ LAURE & STEPH'S JOURNEY ON THIS FOCUS COURSE

Laure says:

“Discovering the Focus course at the National Learning Network in Tralee was a transformative moment in my life, thanks to the insightful suggestion of RO Nora. Initially, I hadn't considered it, as I was completing another course and struggling with low confidence, uncertain about my future. However, after meeting Geoff and conversing with Focus course alumni, I decided to take the leap. My first day was nerve-wracking, leading me to arrive late—a rarity for me. I had to muster the courage to enter that classroom, setting the stage for a whirlwind of meeting new faces and preparing for the journey ahead. Looking back, this challenging path stands as one of the best decisions I've ever made, even though it's been about three years since I completed the course.

The Focus course empowered me in numerous ways:

1. Self-Discovery: Before embarking on this journey, I believed I knew myself, but it was during the course that I truly examined who I am and what I desire. I had spent my life conforming to others' expectations, but the course helped me find my voice and establish healthy boundaries.

2. Unique Experiences: The course provided opportunities to explore places I wouldn't have ventured to alone, such as Blackrock Observatory and St. John's Castle.

3. Overcoming Challenges: Even when the world faced a pandemic, the support of the Focus group, both online and offline, helped me navigate the uncertainty. It equipped me with tools to reemerge into a changed world.

While there's much more to share about the Focus course, I encourage you to experience it firsthand. I am living proof that this course can change lives, and I am immensely grateful for the journey and the people who shared it with me. The lessons I learned continue to guide me daily. If you're feeling stuck and aspire to transform your life, I wholeheartedly recommend the Focus course. Approach it with an open mind, give your best, and extend kindness to yourself and others. It's a journey worth taking.

Steph says:

This FOCUS course opened up so many doors for me that i didn't think possible ! It helped me find friends that I will never forget . And equipped me with life skills in so many areas . Yes, the year was challenging , but also fun & relaxed. I am now in full employment and use the skills I learned daily for my mental health"

Mark pays his final respects to singer Roger Whittaker (RIP)

“May the wonderfully talented and beautiful Roger Whittaker rest in peace. I met him when he lived in Ireland and he dedicated a song to me from the stage at the INEC. He was truly a one-off, we won’t see his likes again. He wrote Mammy Blue, I don’t Believe in If Anymore, A New World in the Morning, and so many more.May the 87-year-old legendary whistler, songwriter, and extraordinary singer rest in peace.”...

Construct Fun at Tralee Library!

Kerry Local Creative Youth Partnership (LCYP) presents “Construct Fun!”—a child-led architecture adventure exhibition facilitated by David Fortune for Architecture Kerry.

Located at Tralee Library, the exhibition showcases imaginative castles and towers created by children living at the Johnson Marina Hotel in Tralee. These structures offer a playful response to Ireland’s architectural heritage. Grounded in core building principles and utilizing child-friendly construction methods, “Construct Fun!” transports viewers into vibrant, character-filled spaces that highlight the joy and inspiration of young imaginations.

David Fortune, the artist and facilitator, emphasized the children’s urge to create and explore, resulting in these delightful pieces.

“Architecture Kerry aims to deepen the

great

community’s connection to Kerry’s built environment. Including children who engage with architecture in such a fun way aligns with the Creative Ireland Kerry program,” stated Victoria McCarthy, Conservation Officer at Kerry County Council and Program Manager of Architecture Kerry.

“Construct Fun!” is hosted at Tralee Library from September 28th to October 13th and is open Monday to Saturday. Kerry Library is a supporting partner of the Architecture Kerry Festival and Kerry Local Creative Youth Partnership at Kerry Education and Training Board.

An eve to help Lisa Broderick’s Wish come true at Ballyroe Heights Hotel

Lisa Broderick, a mother of three, life changed forever when she received her second cancer diagnosis with breast cancer in June 2022.

Initially diagnosed with breast cancer in September 2019, Lisa took a year out to recover from surgery and treatment. Lisa went back to work in September 2020 and life resumed as normal. In June 2022 Lisa had an MRI to get the root of her shoulder pain - the results showed cancer in the bone - further testing revealed two tumours in her liver. The cancer was different this time, as there was no cure.

Friends of Lisa’s have come together to fundraise for Lisa’s young family, by arranging an autumn/winter fashion show at Ballyroe Heights

Hotel. Lisa’s WISH is that her children have a good education and for their home to remain theirs.

The Event takes place on Thursday , October 12th. Guests will receive a warm welcome with a drinks and canapés reception from 7pm, live sax music, a Radio Kerry presenter will MC at the event, along with special guests and spot prizes on the night.
