LEGAL MATTERS CORNER MIRIAM MC GILLICUDDY ANSWERS YOUR LEGAL QUERIES
Seamus parks his car on his neighbour’s property and uses his neighbour’s property for turning his car to get the car out from that property. His neighbour Gerry is wondering if this goes on long term does Seamus develop any rights in relation to his property. If this right were to develop it would be as an easement or right for a certain purpose over the property of another. Easements are the right of a landowner to do something on part of their neighbour’s property or to prevent their neighbour from doing something on a part of their property. It is passed on to a new owner in due course. While there are no decided cases on the right to part in Ireland it has been recognised in several English and Welsh cases. In other words that the right of a person to park a car if it is going on for sufficient period e.g., twenty years ongoing and uninterrupted could develop as an easement. However, this right to park does not preclude the owner of the land from using that land e.g., to park his own car or use the land for other purposes. Therefore, landowners need to be vigilant to persons using their property for activities such as the parking of cars. In addition to this could an easement be developed in relation to turning one’s vehicle on another’s land. Again, English courts have found that a person turning their car for sufficiently long period in another person’s land could be an easement. We have yet to see whether the Irish courts would decide similarly. Other easements that may develop through long user include rights of way, rights to light, rights to structural support from an adjoining building, rights to water, rights to drainage, and rights to eavesdrop (which means literally to have water dropping/dripping from one’s eaves onto another’s property and not to listen in uninvited to a private conversation). On the other hand, it would appear in Irish Law that one can never develop a right to a view or the right to protection from wind and rain from another structure on an adjoining person’s property. Kristian Bezuidenhout is one of today’s most notable and exciting keyboard artists, equally at home on the fortepiano, harpsichord, and modern piano. Kristian is an Artistic Director of the Freiburger Barockorchester and Principal Guest Director with the English Concert. He is a regular guest with leading
international ensembles and has guest-directed (from the keyboard) the Orchestra of the Eighteenth Century, and the Irish Chamber Orchestra. Meadowlands host Reflexology Conference Meadowlands Hotel hosted the Irish Reflexology Institute Conference celebrating 28 years. Summer visitors up at Kerry Airport Kerry Airport is reporting a 15% increase in passenger numbers for the main summer months from May to September 2023 compared to the same period in 2022.
Combined inbound and outbound passenger figures on all Ryanair routes were up by nearly 27,000 for the five-month period with sun routes to Faro and Alicante still operating until the end of October and start of November respectively. Kerry Airport CEO John Mulhern said, “Kerry Airport is very pleased with how the 2023 Summer season (May to Sept) has performed with a 15% increase in passenger numbers. The continuing support of our Ryanair destinations and the introduction of a new seasonal Chalair service to Brittany, France contributed to the positive figures. We are well on the way to exceeding the passenger numbers for 2022 which finished at 356,141 and represented a 96.3% recovery from the preCovid highs of 2019.”
Kerry FC ‘s last home game sees them earn a valuable point! Kerry FC wrapped up their home season at Mounthawk Park with a special Munster Derby against Waterford FC, marking a historic first season in the Airtricity League of Ireland First Division. The home team had yet to secure a league win at home this season, making this game crucial. Manager Billy Dennehy fielded an attacking lineup, with Daniel Okwute, Martin Coughlan, and Rob Vasiu returning to the starting eleven. Unfortunately, Cian Barrett was absent due to
an injury sustained in the previous match against Wexford. In their last encounter, Waterford had comfortably won 3-0, with goals from Connor Parsons, Roland Idowu, and Ronan Coughlan. Kerry was determined to reverse their luck this time. The first half began with early drama as Martin Coughlan received a yellow card and committed another foul. Fortunately, he wasn’t sent off. Daniel Okwute had an early opportunity but was denied. The
game then slowed down until the fifty-fourth minute when Kerry’s captain Leo Gaxha scored, seizing an opportunity created by Paul Martin’s clearance block. Waterford equalized in the sixty-second minute through a controversial free-kick awarded against Martin Coughlan. Ronan Coughlan headed home from a Shane Griffin delivery, leveling the score. Waterford had chances to take the lead, but Kerry’s Lee Axworthy put on a remarkable
performance, making crucial saves. The match ended in a 1-1 draw, concluding Kerry’s home season positively. While they couldn’t secure a home league win, the team displayed a fantastic overall performance. Exam credit due to Minister Foley says Billy!
Junior Cycle exam results were issued by the State Examinations Commission (SEC) on Wednesday to 70,727 candidates nationwide, including 2,148 (1,095 female/1,053 male) from Kerry. Junior Cycle exam results in Kerry were superb and on par with the very high standard of last year. The number of candidates who sat for the Junior Cycle exam this year was about 3,592 up on the 2022 figure of 67,135. This is the first time ever that a junior cycle exam has exceeded 70,000, indicative of population growth.
Six grade descriptors - Distinction, Higher Merit, Merit, Achieved, Partially Achieved, Not Graded - are now used in the reformed Junior Cycle programme, replacing the old A, B, C, D, E, F and NG grades. English, Irish and Mathematics are examined at both higher and ordinary levels while all other subjects are examined at common level. Irish is examined at two strands

with T1 aimed at native speakers and T2 aimed at non-native speakers.
The Junior Cycle exam results were issued very late last year on 23rd November, so well done to the SEC for getting the results out five weeks earlier this year. It’s wonderful also that students, are once again getting state exam experience at the end of the junior cycle. Great credit is due to Minister for Education, Norma Foley for overseeing a seamless transition from the old Junior Certificate exam to the reformed Junior Cycle programme. When you combine this achievement with the reforms that are currently in train at Leaving Cert level, Minister Foley has emerged as a very progressive Minister for Education. The icing on the cake of Minister Foley’s outstanding stewardship will surely be the publication of the 2024 state exam
results along the pre covid timeline for the convenience of Leaving Cert and Junior Cycle students. The reporting process at Junior Cycle culminates in the awarding of the Junior Cycle Profile of Achievement (JCPA) to students. The JCPA confirms the level of achievement in learning, under five descriptors – exceptional, above expectations, in line with expectations, yet to meet expectations and not reported, across all areas of learning including Classroom-Based Assessments (CBA), Short Courses, Priority Learning Units and other areas of learning, as well as the SEC exam results. Most schools will now give those moving on to 5th year a few days to finalize their subject grouping for Senior Cycle. Consider your Leaving Cert subject choice very carefully. 2024 A ‘step change’ in planning for the future
Ministers, Paschal Donohoe and Michael McGrathʼs Budget has been made against a backdrop of global uncertainty, both economic and geopolitical. While inflation has resulted in a deterioration in living standards in the last year, these are expected to improve in the next 12 months, with incomes growing faster than the rate of inflation The Budget focuses on tax cuts, reductions in childcare costs, increases in social welfare payments, targeted mortgage interest relief, reductions in college fees and three €150 energy credits. In summary, this years Budget is about striking the right balance between support for the economy while not unduly adding to inflation.
