Sylvia Pinkchester was looking at her boundary hedge between herself and her neighbour which was getting a bit on the straggly side and was harbouring multiple brambles. It was also spreading out into herself and her neighbour’s property. She is wondering what to do about it. The presumption in law is that each owner of property with a shared boundary owns his or her own longitudinal section of the boundary with the owner on the other side as tenants in common so neither owner can unilaterally pull it down or prevent the other owner from enjoying rights over it. So Sylvia cannot go at the hedge without the consent of the other shared owner. If she does she could be liable in trespass and nuisance at the very least and if she hit a pipe or caused damage to the neighbouring property -negligence. Communication obviously is key, and one person’s meat is another person’s poison, and the neighbour might treasure the advancing greenery, so it is important to be diplomatic and see how the neighbour views the hedge and try and get them to agree to a neater green hedge and share the costs. This is Sylvia’s challenge and hopefully with a reasonable neighbour she will be able to make progress. If she cannot get agreement and meets a stone wall! she can make an application to the district court for a works order under Section 45 of the Land and Conveyancing Law Reform Act 2009. This is an application to court to get a court permission for the works to be carried out and offers protection for Sylvia from actions in trespass, nuisance, property damage and criminal damage but the works order obtained must be strictly adhered to as departure from it could leave Sylvia open to legal action. This application to court must be on notice to the adjoining landowner so that they make representations to the court. The Judge has a wide discretion in relation to the works order he might make, and it could include gardening work in relation to the hedge bearing in mind damage and inconvenience to the adjoining landowner. The Judge can also set terms and conditions in relation to the works e.g., timing, professional advice, insurance, provision of detailed schedule of works etc. He may also set out provisions for covering the costs of the works and the costs of any damage to the adjoining property as well as contribution payable by adjoining landowner. As you can imagine the above could be significant cost and trouble so Sylvia might decide bearing in mind all the above to simply trim back her side and weed as long as she does not do any detrimental damage to the hedge. Approval confirmed for 61 new social homes in Milltown Minister for Education and Kerry T.D Norma Foley has received confirmation that approval in principle has been given for the purchase of 61 new homes in Kerry for social housing. The Department of Housing, Local Government and Heritage has granted approval in principle to Kerry County Council for a turnkey development of 61 social homes at Springfield Drive, Ballyyoughtragh North, Milltown, Co. Kerry. The homes are a mix of three and four beds. Minister Foley said: “I would like to thank my Cabinet colleague Minister
for Housing Darragh O’Brien for confirming that approval in principle has been awarded for this significant acquisition of 61 new homes for social housing in Kerry. “Housing is a key priority for Government and these much needed social housing units will help provide homes for those in Kerry that might need them most. “I would also like to thank Kerry County Council for their ongoing hard work during these challenging times and their commitment to providing housing to all local communities across the county.”
Foley welcomes €27 million in payments for Kerry farmers Minister for Education and Kerry T.D, Norma Foley, has welcomed this weeks announcement that
advance payments under the 2023 Basic Income Support for Sustainability (BISS) and Complementary Redistributive Income Support for Sustainability (CRISS) have commenced. 6,273 payments to farmers in Kerry have commenced, with a total value of over €27 million. Minister Foley said: “I am delighted to welcome that today my Cabinet colleague, Minister for Agriculture, Food and The Marine, Charlie McConalogue has announced that advance payments under the BISS & CRISS worth over €27 million to more than 6,000 farmers here in Kerry have commenced. I know just how crucial these payments are for family farm income and how important they are to businesses in Kerry, bringing a welcome boost in cashflow to the rural economy.” The BISS & CRISS advance payments are commencing today at a rate of 70%.

Mass celebrated at God’s Acre, Ballybeggan next Wednesday
The main burial ground for those who died in Tralee Workhouse (now Áras an Chontae) during The Famine was the small cemetery that was opened in 1846 in the north-east corner of the site; it’s still possible to visit it. In September of ‘Black ‘47’, as the dreaded Gort Mór raged among our people and as deaths and burials increased, the Poor Law Commissioners ordered that the authorities in every workhouse in the country were to bury their dead paupers in separate locations at a distance from Tigh na mBocht! It has long been the belief in Tralee that it was then that God’s Acre in Ballybeggan was opened as the Workhouse Cemetery. For over 160 years, people have been regularly visiting that very special little burial ground and devoutly praying for the souls of the departed; they pray especially for those ‘known only to God.’ That wonderful tradition continues! On Wednesday next, 8th November, at 3pm, the annual Mass for the Holy Souls will be celebrated in God’s Acre, Ballybeggan, Tralee, by a priest from the Parish of St John the Baptist. Everybody is invited to come along and pray for their own dead as well as for those who have nobody to pray for them. ‘It is a holy and wholesome thought to pray for the dead that they may be loosed from sins’ (Maccabees). This year’s event is being organised by God’s Acre Committee 2023 which is led by Dawn Uí Chonchubhair (cathaoirleach), John Mason (leaschathaoirleach), Eddie Ó Murchú (rúnaí), Sinéad Uí Allmharáin (cisteoir). READ ABOUT SOPHIE’S JOURNEY WITH US Hi my name is Sophie. I was a student in the National Learning Network for five years. Before I came to the National Learning Network I was in mainstream school in Killarney where I was bullied and found it very difficult to get on with other people and make friends. I found the work very difficult because of my condition which made it harder to learn for me. My Guidance counsellor recommended the National Learning Network Tralee for me. I started searching about the National Learning Network and found that this was the place for me because it has small class sizes, no leaving cert points needed, students learn at their own pace and students are supported all the time. I began with directions which is a QQI Level 3 course. I completed this course for 3 years. I completed modules like personal and interpersonal skills, self-advocacy, career preparation, work experience, and computers just to name a few. This course helped me to explore various careers. I learned so much during this course such as budgeting and independence. Because of this course and thanks to the instructors, I was the first student in the course to live independently and still am for 9 years. I experienced various work experiences on this course such as retail and working in schools and even got to sample other courses too. After directions, I went on to Sporting Chance which is a QQI Level 5 in Sports, Recreation and Exercise. I knew this course was for me as I am mad into sports and fitness. During Sporting Chance, I gained various qualifications such as Gym Instructor, Personal Training, Sports Massage, Kickstart level 1, Assistant Swim Teachers level 1, and lifeguard. I also got to complete various work experiences in gyms. This course gave me the opportunity to go further and pursue my career in MTU Kerry where I have completed a Level 7 and currently finishing a Level 8 in Coaching and Sports Performance. The National Learning Network changed my life so much. It made me feel inclusive where I was able to get on with everyone. I felt I was listened to and really supported by the staff. I didn’t feel under pressure to learn because classes were small, and it was easier to learn at my own pace. It gave me the opportunity to go further with my education which allowed me to go to MTU Kerry and pursue my education further as well as gain confidence and support while living independently. My future involves going back to MTU Kerry to complete my master’s and open my own business as a personal trainer. This wouldn’t have been possible without the help of the National Learning Network which I like to call a second home.

Can Cryotherapy save my 5 a side soccer career? They say you know you are getting older when it takes you longer to recover from the event than the length of the event itself ! Well here I am , born in ‘65 ( work it out for yourself ...I won’t admit it ! ) and like to think I enjoy being active ..whether it’s walking with herself ( Colette!) , Cycling ..( did the Greenway last Sunday , fantastic ) , Swimming ...love the Sea Swimming ...or even the odd game of golf ( played recently again after a 13 year break ! ). And dare I admit it , I play soccer twice a week , every Tuesday ( 5 a side indoor in Cuman Iosef ) and Wednesday ( 7 a side in the Complex Astro pitch) ...oh why are the 2 games back to back ...n0 recovery there ! And therein lies the problem , ( well apart from Father time !) ..I’ve been playing now ever since I arrived in Tralee from Galway in 1989 ...wow ..I’m now 35 years playing ...and still enjoying it ,, albeit at maybe a slower pace ...! Goalie was my main position but enjoy outfield too ! And injuries could be counted on one hand TG ..Quads, Hamstring , Calf pulls mainly ..and yes an MCL injury to my knee in 2022 (that took a good while to come back from ) ...So how am I going to continue playing ? , ( If every week , my body could be screaming at me to stop ...or at least go down to 1 day a week ) But as Barney Mc Kenna , the Banjo player in the Dubliners , replied when asked , “ when are you going to retire ? “ ...he retorted , while continuing to strumm ...” too late to stop now !” The question nags me every week ...its very social , great group of lads , enjoyable and competitive enough to keep you running after the ball ! Well maybe the answer is right in
front of me ..a secret treatment that was once only enjoyed by the rich, famous, well heeled and connected ...and of course ...by the Kerry footballers! ( ask Barry John Keane ) ! You see, there is a business family in town that have invested heavily in state of the art technology to run their empire , mainly the Tanning Studio , but as I only found out this year when I started working with Mario and Illona through The Tralee Advertiser , they also have installed a ‘Top of the Range ‘ Cryotherapy Chamber in the premises, The Sun Factory Tanning Salon in Rock St (opposite Supervalu ). They also operate FroYo land ( Ice Cream Bar etc ) but thats another story . So last Monday on Marios invitation , I went along to my 3pm appointment for my inaugural session in the Cryo Chamber ...not knowing what to expect from a visit to a chamber that goes down to minus -160 degrees .. it was ‘.created ‘ in 1978 in Japan ,designed to heal certain injuries ) ...and the session lasts approximately 3 minutes ( if you can handle it ! .most can ) with Mario in attendance supervising the whole time ...You see , the way Cryotherapy works, and the secret behind Cryotherapy is that it speeds up recovery of the body whether from injuries or just Father time taking its toll on the body ...Initially as the cold temperature hits you , your brain will trigger a rush of adrenaline and endorphins into your bloodstream, skin temperature will drop to around zero degrees, but your core temperature will remain at approx 37 degrees ..after the session you will feel a tingling sensation over your skin surface ( yes , I did! ) which has an energetic euphoric effect ( yes ..felt that too !) as oxygenated
blood pumps around your body , helping to reduce inflammation . Effectively your capillaries expand to 4 times their normal size , which enables your white blood cells to start the healing process which speeds up the recovery by 50% over the natural process . Other benefits that have been documented from Cryotherapy include pain relief ,reduced inflammation , increased energy , enhanced mental well-being as well as skin rejuvenation . Thats the simple explanation ! How did I feel afterwards? Well I did get tingling in my toes ( I was supposed to put the supplied socks on going in ,,,but too busy chatting to Mario and taking snaps ! ) and Yes , initially I will say that I felt ‘ better ‘ on Monday evening and the body was more relaxed and not as stiff /sore in the lead up to my 8pm game on Tuesday ..and as I write this late Tuesday night , the body maybe isn’t talking to me as much ...but time will tell..its not a magic bullet..initially ..as Mario reckons 1 session a week to feel the ongoing benefits of Cryo and if you are recovering from injury , 2 sessions a week should have a pronounced effect on your recovery

By the way Meet Dan Hickey! , an Ardfert man who I met on Monday in with Mario...you see Dan is a sprightly 80 year old and as he says himself . “ I suffer a lot from swollen and Inflamed knees and my legs “ ...This was impacting on Dans ability to walk , but is now a regular visitor to the Cryotherapy Chamber ( about twice a week ) and he swears by it ...the relief it has given him has been ‘lifechanging ‘ and walking isn’t the issue it used to be ...Hows that for a recommendation ! This marks the first time since 2019 that KCYMS secured a win against the Warriors. Key Moments: The Warriors trailed at the end of all four quarters, with a critical period in the second quarter when KCYMS scored 14 unanswered points. The game was marred by a midgame injury to Daniel Jokubaitis, who could be doubtful for the upcoming National Cup clash with Sligo. KCYMS’s Lovre Tvrdic opened the scoring with a three-pointer, countered within seconds by the Warriors’ Ryan Leonard. A heated personal battle between Rap Buivydas and KCYMS’s RJ Kelly added intensity to the contest. The hosts inched ahead with impressive plays by Kendall Jacks and RJ Kelly. The event, held on Saturday, saw a great turnout under brilliant sunshine. The positive feedback from visiting coaches and mentors highlighted the seamless organization. Under 10 Boys Shine in Tournament: The U10 boys participated in the John Lynch Memorial Tournament at Connolly Park.
