LEGAL MATTERS CORNER MIRIAM MC GILLICUDDY ANSWERS YOUR LEGAL QUERIES
Nuala’s granddaughter Anne age 25 years has lived with Nuala aged 80 years since she was very young and is likely to continue living with Nuala until she dies. Nuala would like to leave the family home worth €300,000 to Anne but is worried there may be significant tax on this.
Looking at the tax thresholds available from Grandparent to grandchild this is quite low at €32,500 unless a situation applies whereby the grandchild is stepping into the shoes of the deceased parent. Therefore, it is better where possible for Grandparents to gift/will to their children with a €335,000 threshold and they in turn can gift/will to their children with a €335,000 tax threshold. It is a cascade effect as it were. Therefore, on a straight gift/inheritance from Nuala to Anne she could end up paying tax of €88,275.
However, in this case the home is Anne’s only home and where she resides so the Dwelling house exemption may apply to her and the only decision to be made is whether Nuala will gift or will the property to Anne.
What is the dwelling house exemption: This is an exemption from any gift/inheritance tax that applies in particular circumstances where a dwelling house is received as a gift or an inheritance:
Firstly in the case of an inheritance:
1. The person inheriting must have no interest at all or any
nature in any other residential property at the date of the inheritance in Ireland or abroad.
2. The beneficiary occupies the property as their only and main residence for 3 year prior to the date of the inheritance.
3. The Donor must have occupied the property as their only or main residence at the date of death. Absence for physical or mental health reasons will not affect this.
Secondly in the case of a gift:
1. The property does not necessarily have to be a principal private residence.
2. The recipient must be a dependent relative i.e. incapacitated to the extent that they are unable to maintain themselves or else relative over 65 years.
3. Relatives include brothers, sisters, uncles, aunts, nieces, nephews, spouses or civil partners of the disponer.
There will be clawback on the relief where it is sold or otherwise transferred within 6 years ( unless replacement) or it ceases to be occupied by the successor as their only or main residence unless scenario of going into a home or working abroad or 65 years or older. In the light of the above it looks like Nuala will have to will the property to Anne which is a bit insecure for Anne meantime. Otherwise, she may have to look at a transfer during Nuala’s lifetime and bite the bullet on the tax payment.

Susan Crean's Dental Team Win Colgate National Award
Susan Crean Dental and Facial Aesthetics has been announced as the Colgate Caring Dental Team of the Year 2022.
Dr Crean and her team were recognised for assisting a patient in battling a severe dental phobia which manifested after a bad experience as a child. The Patient said their fear developed as a young child
“I had a fear of the dentist for many years following traumatic visits to a cold and unfriendly dentist. I am still haunted by the sound of the 'drill' echoing through the corridor as I waited nervously in the waiting room. During the Covid-19 lockdown, however, I developed a Temporomandibular Joint Disorder which affected my jaw joints and surrounding muscles and ligaments disorder that left me with excruciating and chronic pain in my right jaw. I tried every alternative route other than going to see a dentist; I went to a Chiropractor, a Physiotherapist and my Doctor. Exercises and painkillers were prescribed but they only worked
temporarily. My mental health was also suffering as the fear of potentially having to see a dentist had escalated.”
“When I finally had the courage to make an appointment with Dr Crean, little did I realise it would change my life forever.”
“A mixture of emotions went through my head as I arrived at Dr Susan's for my first visit. I was very nervous but also relieved that I was finally conquering my fear. From the moment I set foot inside the surgery door, I had the most amazing experience. The first person to greet me was the most pleasant Dental Nurse, Daniel. He completely relaxed me with his warm and caring manner. I will be forever grateful to him. The next big step was meeting Dr Susan. She was very kind, and I knew instantly that I was being treated by someone at the very top of her profession.
“I am happy to say my dental phobia is improving greatly with every visit as I have complete trust in Dr Susan and her amazing team.”
The 4-person judging panel noted
the extreme lengths that Dr Crean and her team went to in order to allay the fears of their patient.
The annual Colgate Caring Dentist of the Year awards recognise dentists that have provided dental treatment and care over and above the call of duty, often with transformative effects, as nominated by patients and members of the public.Hosted by the Irish Dental Association and title sponsor Colgate, this year saw almost 1,000 nominations received from
dental patients and their families all over the country. There are six award categories, including the overall Colgate Caring Dentist of the Year, Dental Team of the Year, and winners from each of the four provinces, as well as a Dublin winner. The winners were announced at a gala awards ceremony that took place at the Intercontinental Hotel, Burlington Road, Dublin on Saturday night.
Warriors playoff hopes hit with third home defeat of the season
Garvey’s Tralee Warriors hopes of making the Super League playoffs were dealt another blow on Saturday night at the Sports Complex with their third home defeat of the season, this time to Emporium Cork Basketball, by 95-85 . The Warriors now face a daunting challenge to make the top four playoff places in the South Conference. .The Warriors continued to chase the game early in the fourth & Jackson and Jokubaitis cut the gap back to 10 but with the Warriors in team fouls Emporium Cork hit 7 from 10 from the free throw line to consolidate their lead. Another quality cameo from James Fernane with two cracking three late on was a highlight for the Warriors as they surrendered another priceless three League points by 95-85 in the end. Next up for the Warriors is an even tougher home tie against the South Conference leaders University of Galway Maree as the challenge to make the playoffs continues in earnest. Tip off at the Tralee Sports Complex next Saturday night is at 7.30pm.

Exhibition of Light at Tralee Library
Great excitement in Tralee Art Group as we announce our upcoming "Light" Exhibition at Kerry County Library, Tralee, on Thirsday, Dec 1st –Wednesday, 14th, 2022. Comprising a wonderful selection of pieces in a variety of media, it is a very fitting theme after the darkness of Covid & lockdowns. During that awful period, Tralee Art Group kept moving forward using technology to keep in touch with one another and went online with our exhibitions which received great reaction from the public. With new members adding to the diversity of the group, there is a great feeling of renewal as we all connect through artwork. Come along to our opening @6.30pm Thursday Dec 1st and see this beautiful exhibition. You might even find some local, original art as Christmas gifts for friends and loved ones! If you can't make it for the opening, the exhibition continues until Wednesday, Dec 14th. Looking forward to seeing you there.
"The Postman & Doggie Woggie" ...a joy to read!
"Bought this as a gift for a two very special little girls a few days back, opened it up today while having dinner, and couldnt put it down til I'd read it all, even though its a children's book.
I love it as its so beautifully written by tralee native Mark Leen, its wonderful illustrations depict familiar local scenes and views and also comes with a cd .
It's a tale about the relationship between a dog and his master, and also a breif look at the loving Irish mother/son relationship, the pure simplicity and joy of a life well lived is its moral which all kids should learn.
What's even better is that Connie was a real person , a postman in my home town of Tralee in the Kingdom of Kerry, he delivered to many places including O Rahilly's Villas where my Grandparent's lived.
Its a little sad in but is a good lesson on the importance of kindness to animals. There's a beautiful poem in it that moved me to tears having lost our family dog Buster a few months ago.
Congratulations
Mark on a wonderful peice of work best of luck at the launch on the 3rd of December ." .Mary Griffin

Author Don and Shaws launch children's book “The Lion, The Witch and The Dry-Robe”
Author Don Briggs and national retailer Shaws Department Stores have this week announced the launch of a new children’s book in aid of Children’s Health Foundation. “The Lion, The Witch and The DryRobe” is an insightful collection of short stories in verse form aimed at children but with interesting twists which will equally entertain their parents. “ .Don began supporting Children’s Health Foundation Temple Street following the serious illness of his eight-month-old grandson Flynn in 2016 who suffered with multiple viral respiratory infections and spent five days in intensive care on a ventilator with a blood transfusion and specialist physiotherapy treatment.According to Don “It was a scary time but, thankfully, with the superb level of care provided by the doctors and nurses in Temple Street, Flynn pulled through and has prospered since”.
Shaws Department Stores have supported Children’s Health Foundation Crumlin since 2019,
setting an initial target of €30,000 to support sick children attending Children’s Health Ireland at Crumlin. Not long after the partnership began, the Covid-19 pandemic saw all Shaws’ stores closed for 20 weeks, which had a severe effect on the ability of the Shaws team members to raise funds. Once re-opened, Shaws staff across the country kicked their fundraising initiatives into high-gear, holding numerous staff-led charity events including bakes sales, head shaves, coffee mornings, and even abseiling 150 feet from the top of Croke Park’s iconic Hogan Stand. As a result, Shaws have well surpassed the €30,000 target and raised over €100,000 to support the sick children and families in Children’s Health Ireland at Crumlin. “The Lion, The Witch and The Dry-Robe” is available to purchase for €10 exclusively at Shaws Department Stores nationwide and online at www.shaws.ie .
Conrad Digan, Chief Executive of
Shaws Department Stores said: “Our team are delighted to be supporting the Children’s Health Foundation again by giving all our customers the opportunity to buy this enthralling children’s book which will provide vital funds in helping so many sick children. All the profits go directly to the Children’s Health Foundation.”Denise Fitzgerald,
Chief Executive of Children’s Health Foundation said: “At Children’s Health Foundation, we are extremely grateful that two of our long-term supporters, Don Briggs and Shaws Department Stores, are coming together to raise vital, life-saving funds for sick children this Christmas.

Kerry Public Reminded To Be ‘Winter Ready’ This Winter
Statutory and public bodies in Kerry are urging members of the public to be prepared for the winter months and to be ‘Winter Ready.’
The HSE, Kerry County Council and An Garda Síochána are encouraging households to make preparations for adverse weather and to ensure that neighbours reach out to older or vulnerable households at this time to ensure that they are prepared for any potential winter weather.
The local organisations are drawing the attention of the public to the winterready.ie website which has useful tips and information for members of the public, including advice on how to avoid trips and falls, and how to make sure your home and family are prepared for winter.
The HSE Department of Public Health for the region is encouraging the public to protect the health service this winter by taking up both the flu and COVID-19 vaccines when they are offered. Walk-in clinics are available for anyone who hasn’t received the full course of COVID-19 vaccines, and certain groups are now being offered booster vaccines. The flu vaccine is also available at the moment free of
charge to certain groups, including healthcare workers, those aged over 65, and children aged between 2 and 17.
Local statutory bodies will be promoting important messages over the coming weeks around issues
like road safety, preparing the home, health and wellbeing, advice for older people, and details of important emergency contacts.

€10 million Fund to support parish halls and community centres with energy bills
Minister for Education and Kerry T.D, Norma Foley this week welcomes the announcement of a new €10 million fund which will support local community & voluntary groups with their energy bills.
The Community Support Fund will provide grants to a wide and diverse range of local community groups to assist with their running costs.
Funding will be available to support Parish Halls, Community Centres, Local Development Associations, Social Clubs, ICA Groups, Senior Citizen Groups, Men’s Sheds, Women’s Sheds and much more.
The new scheme has been devised to support groups with their energy costs who may not have been deemed eligible under previous Government schemes.
These include groups that operate
from parish halls and who need support with running costs such as energy or insurance bills.
Groups can also use the funding to carry out small upgrade works and to purchase equipment to support their activities such as laptops and printers, lawnmowers, training equipment, etc.
Welcoming the funding allocation of €312,671 for Kerry, Minister Foley said: “This initiative forms part of a range of measures being undertaken by Government to support the community and voluntary sector across Kerry. These grants will help so many community organisations, clubs, men’s and women’s sheds, youth centres and parish halls, to continue to provide their valuable services to the people in their areas.”

Fenit and Maharees Clean Coasts groups brings home Ocean Hero Award
This week Clean Coasts hosted the Ocean Hero Awards Ceremony and Ocean Talks at Number 6 Kildare Street, in Dublin, to celebrate and thank the groups, individuals, communities, and businesses who, throughout the year, have done outstanding work to protect their local coastline and environment. This year, Clean Coasts has chosen 7 dedicated categories with a total of 28 groups, organisations and individuals shortlisted for the title of Ocean Hero within each category.
In County Kerry, Fenit Coast Conservation were nominated for the Local Action Award and Maharees Conservation Association CLG were nominated both in the
Beach Clean Award category and the Special Achievement Award which is a celebration of an individual or group who have achieved something spectacular this year, . The group has been carrying out a series of marram grass planting events in their area to stabilise the sand dunes damaged by Atlantic storms and have been raising awareness and educating the public on the importance on sand dunes and why they need to be protected. During the ceremony, the work of Fenit Coast Conservation has also been showcased. This group strives to raise awareness of the value and vulnerabilities of the coastline and encourages best practices that will leave this
precious natural environment intact for future generations. In addition to raising awareness about issues related to marine litter and relevant solution, this year the Clean Coasts programme put a particular focus on biodiversity, and this was reflected in the Ocean Talks.Speakers included Martha Farrell from Maharees Conservation Association as well as Timothy Butter from Seasearch, Dave Wall from National Biodiversity Centre, Proinsias O’Tuama from East Cork Biodiversity Network, Mícheál Callaghan from Community Wetlands Forum and Malcolm Noonan, Minister of State, was the keynote speaker of the event.
Capital investment in Kerry ETB & MTU
Minister for Education and Kerry T.D Norma Foley, welcomes the announcement that the green light has been given to milestone capital projects for Munster Technological University (MTU) and Kerry Education and Training Board’s College of the Future in Killarney. MTU has been given the go-ahead to proceed to the next phase for the Kerry Campus Learner Centre under the Technological Sector Strategic Projects (TSSPF) Fund.
This proposal envisages the facilitation of full consolidation on the Tralee North Campus which will serve 2,000 to 3,000 students.
In addition, Kerry Education and Training Board has received approval to proceed to the next stage in developing a College of The Future
(COTF) in Killarney. The project proposed involves overhauling an existing factory site, including the existing on-site buildings and transforming it into a state-of-the-art campus. The intention is to transform the existing site it into a state-of-theart campus to develop a Centre of Excellence in Hospitality Training, a Centre of Excellence for Renewable Energy and Sustainable Green Technologies and a Regional Centre of Excellence for Lifelong Learning. Minister Foley said: “These are two significant developments furthering the development of education in County Kerry. I want to thank my Cabinet colleague Minister Harris who has engaged with me in securing these projects and also
acknowledge the vision and input of both Kerry ETB and the MTU. By advancing these ambitious projects we will ensure that the technological and further education and training sectors in Kerry have
access to state of the art facilities that will drive economic growth and social development, expand digital teaching and learning facilities and create and expand key centres of excellence.”

Let There be Light!
By Georgie Downes
Here at Tralee Chamber Alliance, we just love the glow of twinkling lights. It brings out the festive cheer in all of us. So, we are delighted and excited to announce that there are only two sleeps to go before the town is transformed into a magical winter wonderland. Mayor Mike Sheehy will do the honours, flicking the switch on the Christmas Lights in The Square on Saturday 26th November at 5pm. When you look up and see strings of little diamonds stretching across from roof to roof, you know the Yuletide season has officially begun.
If you fancy a little warm-up act to the main event, be in The Square for 2.30pm to
enjoy a buzzy set of Festive Jazz with Dave Rath followed by the unmissable Oliver Hurley School of Musical Theatre’s Senior Choir singing a heart-warming selection of traditional Christmas carols at 3.30pm.
At 4 o clock, there’s Santa Claus, the Show, a short theatrical piece to delight and entertain the children and then at 4.30pm, it’s Disco Time for the kids with DJ Brian Hurley ably assisted by some well-known animated characters. And, because he loves Kerry so much, the main man himself will be sledging in from the North Pole to make an appearance. Ho, ho, ho, Santa Claus!
Speaking of the main man,
are all taking bookings to see him this year but places are filling up fast so don’t delay: Kelleher’s Hardware, Gally’s

AUSTIN STACKS
ANNUAL
CHURCH GATE
COLLECTION: Thanks to everybody who contributed so generously to our Annual Church Gate Collection last week-end, despite the inclement weather. And a special thanks to Ger O’Shea, the co-proprietor of The New Yorkers Diner whose contribution of €50 was by far the biggest single contribution of the week-end. Ger and his family are residents in the heart of the Rock. Thanks Ger again for that splendid donation.
SCÓR: Brian Caball informs us that Marcas Ó Laoire from Gneeveguilla won the All Ireland Scór Competition in Singing in Castlebar last weekend singing a song (The Hills Around Listowel) made famous by the former Kerry Footballer, Gary MacMahon.
There was shock and sadness in Rock Street and elsewhere on last Friday evening when news broke of the untimely passing of Dolores O’Connor, wife of Aidan and co-proprietor of The Greyhound Bar. Sincere sympathy to Aidan and to all the O’Connor Family at this sad time.
ST PATS GAA CLUB
Healthy Club Event
We had fantastic representation from St Pats GAA club, community and beyond for our finale 5K run on Saturday Morning last. The St Pats Healthy Clubs committee was delighted to run this 10-week Couch to 5K initiative with the expert help of Michelle Greaney. Thank you for your time and encouragement Michelle! Thanks so much to Tralee Park Run for welcoming us to this fantastic free event. The rain didn’t stop the running enthusiasm but unfortunately curtailed the saturated runners going for well- earned treats afterwards! We looked forward to our Healthy clubs Operation Transformation walking series in January. All welcome!
Rosary at Rath
Please be aware that this year Rosary at Rath will take place at 3pm on Tuesday Afternoons not Tuesday Nights when it normally took place.
RAHILLYS REPORTS
Senior Munster Club Championship Semi Final Fixture.
Kerins O Rahillys v Eire Og Ennis
Sunday November 27th 1pm in Austin Stacks Park.
The senior team enter this fixture on the back of some good form, having recently won the Club Championship. We will be hoping to advance, but will need to perform well to overcome the Clare champions, who themselves are playing with great confidence having conquered the Waterford champions in the last round.
Tickets for the game must be purchased online. There will be no cash accepted at the gates on the day.
Remembering Marie!
Hard to believe that it’s been two years…
Everyone who had the privilege of knowing Marie Nix was heartbroken when she passed away on November 20th, 2020 and so many of us still are.
Marie was one of a kind. We all still have wonderful memories of Marie over the years with the juveniles and in particular the U8/10 girls. As a passionate “Blue” Marie played a huge role in getting so many girls playing in Strand Road to levels we have never seen before. We now have girls teams from U6s up to seniors.
Marie has two Co. Championship medals with Stacks but John converted her from the black and amber over to the Blues . Marie became a full on “Blue” and was fully immersed in our club. We all remember the Christmas Fair in the club a few years ago. Marie was in the foyer greeting everyone with her warm smile and friendly presence as they entered. Marie had the foyer beautifully decorated and there was a fantastic atmosphere in the clubhouse that day.
In April 2019, our U10 Girls were invited to a blitz in Croke Park. Marie met us there and enjoyed watching the girls play on the hallowed turf.
Despite Marie’s illness she always came to watch Stephen and Katie’s games, a proud Mom! An avid supporter, Marie came to most club games even when her own children weren’t playing.
It is because of Marie's influence that our U16, U17 and U18 Ladies are the wonderful players and team that they are today. She was a coaching Mom who truly brought out the best in each one, inspired confidence and so many have gone on to play at a higher level.

We could write forever about Marie, her wonderful ways, her kindness, her positive attitude always, her great nature and the fun we all had!
We are especially thinking of John, Stephen, Katie, Marie’s Dad Anthony, her brothers Ger and John, the extended Nix and Slattery families and Marie’s friends at this time.
It isn’t too many people you get to know in life like Marie. We all have so many great memories . We will treasure these forever. We are so lucky to have known Marie. You truly are missed .
U12 GIRLS
We were looking for the coolest place to have fun for our end of year… And so decided on a way to also bring on the festive season….Ice skating in Fota followed by a trip to Mahon Point for a little retail therapy - Sunday, December 11th
U14 KERRY TRIALS
Pat Healy Park, Ballyrickard was a hive of activity last Saturday on a bitterly cold day for trials. Well done to the Kerry U14 management for their great organisation and congrats to Frank Mcloughlin on his appointment.
AWARDS NIGHT
With medals to be presented from 2021 and 2022 it has been decided by our ladies committee that this will be done for ALL age groups on the one night. This is logical for all involved. We are looking forward to a lovely evening.
TRALEE DYNAMOS AFC
U-16 National Cup Rd 3 Dynamos 3 – 0 Pike Rovers. What turned out to be a very physical game, our football won out on the day with some outstanding passages of play throughout.
Munster Junior Cup Dynamos 1 – 2 Killarney Celtic AET. We bowed out of this season’s competition with a 2-1 loss to the Killarney side last Sunday. Played in difficult conditions, Dynamos showed a marked improvement on our previous outing against Celtic. The second half was a close fought encounter and the game went to extra time where Celtic scored the winner from close range close to the death. A much improved performance from Dynamos.
Dynamos Senior B We continued our winning ways with a 3-1 victory over Ballymac last Sunday morning.
