LEGAL MATTERS CORNER MIRIAM MC GILLICUDDY ANSWERS YOUR LEGAL QUERIES Eamonn’s short-lived marriage has come to an end as he and his wife could not live together and the marriage only last 6 months. He is wondering what are his options to sort out their property and finances. They have no children. He owns the family home and has inherited property. In a situation where a married couple are separating there are a number of options. But initially Eamonn would have to look at whether in fact he has grounds to apply for a nullity rather than a divorce as it was such a short-lived marriage. If he has to wait for a divorce he has to wait three years effectively. Nullity could be looked at as an immediate option but the grounds are very strict. Firstly both parties cannot agree a nullity one party takes the case and the other either contests it or does nothing but the court will not grant a nullity where they believe both parties are colluding to get a nullity. There are two types of nullity. 1. Where the marriage is void from day one on e.g. lack of legal formalities or incapacity on the part of one or both of the parties to enter the marriage e.g. under 18 or within the list of relationships that cannot marry. Other grounds for a void marriage would be lack of a Valid Consent to the marriage due to Duress ( being forced into the marriage) , Mistake ( as to who or what you were marrying), Mental Incapacity, Absence of adequate knowledge of “circumstance of substance”. E.g. thinking you were marrying one person
and it turned out to be someone different.The parties to the marriage or a third party e.g. family member due to inherit without the marriage could apply to have the marriage declared void. 2. Voidable - This relates to something that arose after the marriage that renders it voidable e.g. Impotence (nonconsummation of the marriage.). Lack of Capacity to enter into and sustain a normal life-long functional marital relationship. Mental Illness, Sexual Orientation ( i.e. not sexually attracted to the sex of one’s spouse) . Emotional Immaturity. It must be stressed that marriage is a contract and nullity is a relief whereby one is applying to nullify the contract so strong grounds need to be shown to a court often requiring psychiatric and other strong evidence before a judge will grant a nullity. The big advantage to this type of application is that it is as if the marriage never existed and may allow someone to move on more quickly and also mean that a nullified spouse has limited if no legal rights to property. State nullity is separate to a church annulment which can be obtained through the roman catholic institutions. The church annulment is required if one wants to get married again in the Roman Catholic church. Pope Francis made these church annulments free of charge and introduced reforms to speed up the process of church annulment. ‘Curtain Call’.... ’Unputdownable and Heartwarming‘ Chris Shortt from The Tralee Advertiser caught up with Mark Leen this week , author of Tralee’s favourite son D.J. Curtain’s new official biography. Well, it must undoubtedly be the most talked-about book “not to hit our bookstores.” D.J. Curtin’s new tell-all official biography ‘Curtain Call ‘ is a warts and all book that is going down a storm among readers that have already gotten their hands on a copy from its author Mark Leen. We caught up with Mark earlier this week and began by asking, why isn’t the book in book shops?

I mean obviously, the birth of his children tops everything, I’m just talking professional now.

IT Tralee secure nearly €9 million in Funding Institute of Technology Tralee has welcomed the recent announcement by the Minister for Further and Higher Education, Research, Innovation and Science, Simon Harris, T.D. that it has been successful in its application for Reimagining Engineering Education in Ireland (REEdI) under the Human Capital Initiative Pillar 3, Innovation and Agility. REEdI - Rethinking Engineering Education in Ireland (REEdI) will transform the way we deliver undergraduate engineering education in Ireland. The project is truly innovative, drawing on international best practice in the field of engineering
education which will enable a student centred, project centric and technologically innovative approach to course provision, equipping graduates with the skills and knowledge required to ensure they are capable of navigating the future challenges and disruptive technologies faced by the manufacturing sector in Ireland. Head of School of STEM at IT Tralee Professor Joseph Walsh welcomed the announcement “REEdI will draw on the strong research links in manufacturing engineering research through the IMaR Research Centre and the SFI Confirm Smart Manufacturing and Lero Software Development Centres
to embed the technologies and learnings into undergraduate programmes. In addition, Master of Engineering placements will be facilitated through these cutting edge research centres, producing manufacturing engineering graduates of the highest international calibre. The REEdI approach is to be positively disruptive and transformative, with a vision to set the agenda for engineering education nationally.” President of IT Tralee Dr Brendan O’Donnell said ”This project will place IT Tralee, soon to join with CIT to become Munster Technological University, at the forefront of international undergraduate

Car Rental Council Ireland seeks Kerry TDs help to reduce Motor Insurance! Over the weekend, members of the Car Rental Council issued a joint letter to Kerry TDs calling for the urgent implementation of reform to drive down insurance costs in Ireland. The letter, seeks immediate Government action to resolve the insurance crisis affecting households and businesses across the country. The letter is signed by the Managing Directors of Budget, Enterprise Holdings, Europcar, Hertz, Avis and Sixt; as well as Eoghan O’Mara Walsh, CEO of the Irish Tourism Industry Confederation. Minister Norma Foley Welcomes €10 million to support disability service users.
Minister for Education and Kerry TD Norma Foley this week welcomes the approval of grant funding totalling €10 million drawn down from the National Action Plan on COVID-19 to increase the level of day service provision and to provide intensive support packages for children and young people with complex/high support needs.€10m has been made available and is broken down into two categories: • €7.5m is being used to increase disability day services by one day a week for over 14,000 adults. • €2.5m will provide an additional 210 intensive support packages to help children and young people with complex/high support needs remain living with their families. The funding announced will be crucially important in supporting people with disabilities in the coming months. Kerry voted top staycation location
A recent poll shows Kerry came out top in preferred staycation destinations.The survey was carried out by Limerick survey platform, SensorPro, In this latest survey of the respondents, 15% had travelled to the Kingdom, making it the number one staycation destination.The majority of these visitors stayed two nights, while 40% were away for three or more nights; 85% rated their experience good, and 83% said it was value for money.JUst over half of survey respondents didn’t take a staycation, citing fear of COVID, planning an autumn break, or financial constraints. Chris Byrne of SensorPro says Kerry was the number one location in both the summer and their latest surveys.

HEALTHY RECIPES for 2020
Cold weather,Warm Soup!
Parsnips and apples are bang in season right now and go so well together. Here is one way to warm the cockles of your heart .... its a great big warm bowl of soup!!
PARSNIP AND APPLE SOUP
Serves 4 hearty bowls or 6 normal ones INGREDIENTS • • • • • • • • •
25g/1oz butter 1 tbsp oil 2 medium onion chopped 600g/1lb 5oz parsnip, cut into 2cm/1in pieces 2 garlic cloves, crushed 600g/1lb 5oz apples peeled, quartered and cut into chunks 1 litre/1¾ pints vegetable stock 150ml/5fl oz milk flaked sea salt and freshly ground pepper
METHOD Melt the butter and oil in a large saucepan. Gently fry the onions and parsnips for 15 minutes, or until the onions are softened. Add the garlic and apples and cook for a further two minutes, stirring regularly. Pour over the stock and bring to the boil. Reduce the heat to a simmer and cook for about 20 minutes, or until the parsnips are very soft. Remove from the heat and season with salt and freshly ground black pepper. Blend the mixture in a food processor until smooth. Stir in the milk, adding a little extra if required. Season to taste with salt and freshly ground black pepper. You can add a touch of curry powder at the start too

FITNESS!
Hello my strong friends Hope you’re having a great week. This week I want to talk about something important. I know every week I talk about how it’s great to be fit and healthy with regards to your physical body... And it is, in a perfect world. But this week I’m going to focus on another aspect of your health that it’s important to take care of, your mental health and being happy in yourself. The next time you find yourself scrutinising something that you think is “wrong” with your body. Maybe focus on the person and soul inside your body, other than aesthetics. Being a size 6 or 16 doesn’t determine who you are as a person and how healthy you are. Like everyone, I’m not happy 24/7. I have struggled with body issues, image issues and everything in between. I have finished school only to come out of two separate college courses, because I wasn’t happy in either of them. It took a lot to get to where I am now. Stay positive, a positive mindset always helps. When you are stuck in something in life that makes you that unhappy, be it a job, living situation, college course, or relationship, it is always best to take a step back and put you and your mental health first. Because if you don’t, trust me, nobody else is going to do it for you. Talk about it. It doesn’t matter to who, just let someone else know how you’re feeling. You never know they might have the perfect solution, or at least they might make you feel a bit better. Exercise, even if it’s just going for a walk. It helps clear your head and overall you’ll feel better. If you are upset about anything, don’t try hide it or play it down because of someone else’s opinions. It’s your life and if something is upsetting you, it’s ok to be upset. Once you know ways in which you can cheer yourself up again.
It’s your life, make a conscious decision to be the happiest, most positive person you can be.
For any of you out there feeling overwhelmed because you don’t know what to do with your life or you can’t pick a college course or you’re confused as to what to do by a situation, remember, no one has all the answers. Not even the most intelligent successful person you know. Everyone just takes it one day at a time. So don’t feel anxious or pressured into doing anything if you feel it’s not for you.
Life is too short to have a miserable time because you’re ‘being good’ or ‘watching your calories’. It’s all about balance, you can count calories and ‘be good’ on a night in!

St John of God to Terminate Services Arrangement with HSE Saint John of God Community Services has recently announced with deep regret it has served a notice of termination of its Service Arrangement with the Health Services Executive and its intention to transfer responsibility for the operation of its services directly to the HSE over the next 12 months. St John of God Community Services clg will cease its involvement in the provision of these services by 1 October 2021. The formal letter of notice was sent to the Health Services Executive on Wednesday 30 September. St John of God Community Services currently provides intellectual disability and mental health services to over 8,000 children, adolescents and adults and employs 3000 staff and volunteers in 300 locations across counties Dublin, Kildare, Kerry, Wicklow, Meath and Louth. Over 2,500 of those impacted are in receipt of day, residential and respite services for people with a disability. The Order of St John of God has been providing these services for almost a century. The Chief Executive of St John of God Community Services, Clare Dempsey,
said they have been communicating over the past 2 days with the children and adults supported by the services, their families and staff members, retirees and volunteers to inform them of the very sad decision that had to be taken due to a protracted and unresolved systemic underfunding crisis that had undermined the organisation for over a decade. “ In separate letters to service users and their families and to staff members, volunteers and retirees, the Service said it would do everything in its power to manage the smooth transfer of service over the 12-month period and that its priority would be to ensure the least possible disruption in particular to its service users, their families and staff. There will be no immediate changes in respect of the services as they are currently provided. An early urgent meeting has been sought with the HSE, to begin putting the appropriate transitional arrangements and plans in place for the next 12 months. Notice has also been served on the Health Information and Quality Authority.

The ‘10-minute’ town idea that could revolutionise Tralee The initiative aims to have all services accessible within a short walk or cycle from home A ‘10 Minute Town’ concept is being considered for Tralee after a report identified crucial areas for improvement in the town.A report commissioned by the Southern Regional Assembly focused on three key regional towns - Carlow, Ennis and Tralee to form part of an action plan to improve overall access for people living in these towns.The 10 Minute Town Concept seeks to have all community facilities and services accessible within a 10-minute walk or cycle from homes or are accessible by public transport services connecting people to larger scaled settlements. The report highlights the disconnect between developments in the towns and access to public services and amenities, which it says, “has led to poor connectivity between these residential areas
and community facilities”. Ken Tobin, CE Tralee Chamber of Commerce, said improvements - like those identified in the report - are needed in Tralee.“Tralee has been earmarked for a 30% population increase and if we act now, develop a Strategic Growth Plan for the town and follow key recommendations in this report, we will meet these targets, be able to attract new jobs and make Tralee a more sustainable place to live,” he added. It recommends specific changes to improve the use of bus, bicycle and walking access to the town.”In these times it’s vital that we give people as many options as possible to access the town; in particular it’s of concern to us that students attending IT Tralee don’t really have an option to cycle safely from the college campus to the town centre nor are there sufficient secure bicycle parking locations in the
town centre,” says Ken .The report also identifies some key measures that will ensure the Tralee-Fenit Greenway will provide “greater benefit” to the people who live in Tralee “As we move through the pandemic crisis it will be critical that investment and efforts are committed to increasing the public and sustainable transport offering for Tralee.“We would also
strongly support the trialling of a bike loan scheme for the growing, but geographically isolated, student population in Tralee.”The key objective is to map and identify infrastructural requirements to support making Tralee a 10-minute town within the region.

A new photography competition has been launched this week to celebrate and promote cycling in the Kingdom. Kerry Recreation & Sports Partnership and Kerry County Council are inviting people to take part in the ‘Where, in Kerry, will your bike take you?’ photography competition and are asking everyone to submit images of where they are travelling or visiting on their bikes around the county. Recent months have seen a significant increase in interest and participation in cycling with many people discovering and rediscovering their localities and well-known
or lesser-known attractions and hidden gems around the county. This has been coupled with an increase in the profile of cycling as a healthy and fun mode of transport and physical activity. To coincide with National Bike Week, the competitions invites images under the following categories: ‘Family Cycles,’ and ‘Showcasing hidden gems in Kerry.’ Participants should be mindful of COVID-19 restrictions and adhere to all public health guidelines. Saving €5,000 a year on a vehicle is a core reason Mullingar-based security firm Key Guard recently bought 10 new electric Renault Zoe vans. If that was repeated around the country we wouldn’t be long making EVs the dominant force the Government wants them to be.The company, established in 2013 by Paul Ennis (pictured) and Ray Moore, employs 160 people at its HQ and patrol bases around the country. With its fleet vehicles each covering up to 150,000km a year, management reckoned that switching its patrol fleet to electric would mean €5,000 saved per vehicle. They bought the vans from Tullamore Motors Renault. So far, the company has bought 10 Zoe Commercials, two Zoe passenger cars and two Renault Kangoo ZE vans. A new charging infrastructure at all its bases, and staff training, means they are investing a total of €450,000 in the switch. The Zoe commercial has a claimed range of up to 395km and costs from €29,190 including Vat and after a €3,800 grant for business buyers. * THE latest Toyota Land Cruiser arrives next month. There’s a more powerful 2.8 litre 204hp diesel engine. Stop & Start technology is said to lower fuel consumption to 7.4l/100 km and emissions to 195g/km. There is also an upgraded multimedia system. EUROPEAN AUTOMAKERS URGE NEGOTIATORS TO SECURE BREXIT DEAL
Politicians on both sides of Brexit negotiations must “pull out all the stops” to secure an ambitious free trade deal, or risk accumulated losses that will run to €110bn (£101bn) by 2025.The call comes as the end of the transition period looms, with just 15 weeks left to secure a trade deal between the European Union and the UK, and punitive World Trade Organisation (WTO) terms applying if no agreement is reached by 31 December.WTO terms would apply a 10 per cent tariff on cars and up to 22 per cent on commercial vehicles, both paid by importers. Industry leaders warn that these costs would “almost certainly” be passed on to consumers. A total of 23 trade bodies from across EU countries, including the UK’s Society of Motor Manufacturers and Traders (SMMT), and the continent-wide European Automobile Manufacturers Association (ACEA), are urging ministers, civil servants and diplomats to pull together in negotiations, or risk “severe repercussions” to European automotive companies, in an industry that supports one in 15 jobs, and 14.6 million livelihoods, across the EU and UK.Mike Hawes, chief executive of the SMMT, warned the impact analysis paints “a bleak picture of the devastation that would follow a ‘no deal’ Brexit.” Hawes said tariffs and trade barriers would “compound the damage already dealt by a global pandemic and recession, putting businesses and livelihoods at risk,” adding: “Our industries are deeply integrated so we urge all parties to recognise the needs of this vital provider of jobs and economic prosperity, and pull out every single stop to secure an ambitious free trade deal now, before it is too late.” Eric-Mark Huitema, director general of the ACEA, said the “stakes are high” for automakers, and that a No Deal Brexit, combined with Coronavirus impacts, would be a “double whammy” for an “already reeling” sector Friday 9th October 2020

DISAPPOINTING AFTER ALL THE HARD WORK DONE BY CLUBS: While it is understandable on one hand that the Government has moved the whole country to Level 3 of the Covid plan on the other hand it could be argued, and this is something that is supported by the WHO and other experts, lockdowns should be more targeted and counties who are doing well should not be included. However this is not a political column so from a sporting point of view it is very disappointing from the clubs point of view that all the local games are cancelled. Clubs and venues in all sports have done a great job over the past few months with regards to hand sanitisation stations etc. And while there has been a small number of cases in clubs these were all handled under the various protocols and thankfully many of those tested came back negative. I know people will point at what happened after finals around the country which have mostly been GAA but only because of the way their calendar worked out. Credit must be given to all the clubs in Kerry who won titles recently and there have been no issues with celebrations afterwards. There was lots of coverage from Blackpool in Cork returning to their club after winning their County Hurling title for the first time in 18 years. And yes there were big crowds but it was all in the open air which we are continuously told is much safer than being inside. We all saw the few seconds on social media but I wonder how long the crowd were there or did they disperse once the team had walked past. Whatever was the story I don’t believe it is right to target these clubs as being the reason Covid numbers are up and we have moved to Phase 3. However hopefully this three week break from all local action will have the desired affect and that the fact that training can continue, under protocols, will mean the loss of games won’t have any effect on the mental health of the players. ELITE GAMES GOING AHEAD: It still looks like the final games in the GAA National Leagues and the Championships will go ahead but more likely now behind closed doors – which is the scenario than no one wanted. Ahead of that from a soccer point of view the Elite games will continue – also behind closed doors. Kerry’s 4 teams in the Underage National Leagues are in Phase 2 action with the 15’s and 17’s in action this week. The 15’s welcome Wexford to Mounthawk Park on Saturday and will then play Limerick at the same venue on Wednesday the 14th. On Saturday the 17th they go to Waterford and finish this Phase , where only the top team in each of the 4 Groups makes the semi-finals, away to Cobh Ramblers on Sunday May 25th. The 17’s will be looking to get carry their form from their their 4-0 win over Limerick into their away game with Carlow/Kilkenny at Derdimus Park on Saturday at 2pm. On Sunday week, October 18th they are at home to Limerick. The 13’s and 19’s are free this weekend. The 13’s will begin their Shield Phase on Sunday 18th with a trip to Wexford. Waterford are the other team in their 3 team Group where again only the top team progresses. The 19’s would love a game this weekend to follow on from their best performance of the season where they defeated Galway 3-1 to open Phase 2 of the League. UCD beat Cobh Ramblers, who Kerry play next went down 2-1 away to UCD. If Kerry can win away at Cobh it could set up what in essence would be an National ¼ final when they travel to UCD with the top team in to the Last 4. Billy Dennehy guided the 17’s to two National finals last season so along with his assistant James Sugrue they have the experience and the squad to hopefully On the Girls front the Gaynor Competition is also an Elite competition so unless something changes from the time this is being written their 15’s Gaynor Bowl semifinal in Georgie O’Callaghan Park against the MGL side will go ahead. The Gaynor finals are set for the last two weekends of October with the 13’s Girls already into their Bowl semi-final. OTHER SPORTS ALSO AFFECTED: From an outdoor point of view rugby will be in the same position as soccer and football with games bar the elite fixtures being cancelled. This comes at the wrong time for the sport as its season has just gotten underway but in saying that if it only lasts for three weeks they will be able to make that up. It will also be very disappointing for the ladies of the Kerry RFC team who enjoyed a great debut in the Energia Munster Community Series defeating Ballincolling 24-5. We are great sports fans in Kerry and while we will all support out clubs when someone pulls on the Green and Gold we will all support them and this will be the case with this team. Kerry played with the strong wind in the first half and led 14-5 and then while up front were doing their job the defence was repelling anything the Cork side could throw at them. All 22 players who were in action did very well with the scores coming from Laoise O’Driscoll who got a try and three penalties and Meabh McElligott who went over for two tries. They were supposed to play UL Bohemians who have a number of Kerry players in their ranks in Listowel this Sunday but it remains to be seen if that will go ahead. first game and would be amongst the favourites in this competition. SATURDAY AND SUNDAY AT THE TRACK: Greyhound racing continues this weekend with racing on Saturday and Sunday night. On the first night there is a 12 race programme starting at 7.42pm featuring the final of the KGSCC A3 525 yards where there is a winner’s prize of e3500. On Sunday night there is a 10 race programme starting at 6.38pm. WINTER SWIMMING SERIES GOES AHEAD WITH RESTRICTIONS: The Tralee Bay Swimming club have announced that their Winter Swimming Turkey Series will still go ahead but there cannot be a group swim as was normal from 11am on Sundays. Swimmers are asked to spread out and pick a time that suits them. The no wetsuits rule still applies. In another change this year swimmers will not sign in but bring their names on a piece of paper and put this into the name bucket provided along with the e2 which gets you a ticket for the raffle for some lovely treats just in time for Christmas . This week the Tralee Bay Swimming club presented the proceeds of the Across the Bay Challenge to the Fenit RNLI Lifeboats. And while numbers were restricted due to the Covid pandemic e1520 was raised. This is a great credit to the swimmers, those who volunteered to make sure everything went safely and to those who donated. HANNAFIN DOWN TO SECOND IN PORSCHE CUP: Along with the Kerry Motor Sports News social media site we have been following the exploits of Lorcan Hanafin in the Porsche Carerra Cup GB. Lorcan has a number of relative in the Ballinorig area of Tralee. He has been in a season long battle with Mathew Graham who has taken the lead following the two races at Silverstone. Hanafin was fourth in the first race with his rival fifth but in the second race Mathews took the second spot on the podium while Hanafin had to settle for 5th. CLUB’S NEWS: Things could be different in the club notes from next week but we will deal with that from next week. However we will continue to provide a platform for all clubs to get their notes out to your members in our publication. AUSTIN STACKS NEWS: The u6’s welcomed Na Gaeil while the u8’s and u10’s continued their Bracker Regan and John Galvin Cups on Thursday night. The u12’s played Laune Rangers and were due to have a final set of challenges this weekend. The u14’s and u16’s are due to

TRALEE TOWN BOARD: The Tralee Town Board has expressed its deep sadness at the death of Micheal Kerins who was their President for many years. PRO Timmy Lynch said that Micheal’s made a huge contribution to the Board. “He was always very positive and encouraging and had a deep knowledge of football that he was always willing to share. We were all delighted to see him at our AGM before the Covid lockdown where his contributions were as apt as ever. He said that he felt football in Kerry was coming on well and that the Town Board was going in the right direction and was his beloved Kerins O’Rahillys. We extend our sympathies to his extended family”. PARNELLS NEWS: The club joined with all those who expressed their sadness at the death of Micheal Kerins who is the father of club President Rory. He had a huge passion for hurling as well as football and was immensely proud for him last year as he led the parade before their first senior game. The minors put up a very strong performance before going down in the County Championship semi-final. The Saturday Street League was due to get underway this weekend but this will now be postponed. The u16 camogie side had qualified for their County Shield Final due for this weekend. They put in a great effort in their victory over Cillard in tough weather conditions. The u12 camogie side were very unlucky to go down by just 1 point in their Division A Shield Final with the game finishing 2-01 to 2-02 to Causeway. The Amber side lost out to Sliabh Luachra in Spa Killarney in another game played in very harsh conditions. The u8’s had their last session and were presented with their certificates. The coaches were delighted with their progress and thanked all the parents for their cooperation. In u13 hurling it finished Ballyheigue 2-04 to 1-01. The u10’s enjoyed their win over Lixnaw while the u14’s and u16’s Street Leagues on the IT astroturf got inderway last weekend by will now be postponed. NA GAEIL RELAUNCH LOTTO: The Na Gaeil Lotto has re-launched following its COVID break with the draws taking place in the Clubhouse on Tuesday nights. The opening jackpot is e4,300 and those who have repeated entry tickets won’t lose out as these will be extended by 30 weeks.
