pring is here, and there is excitement for new opportunities at the Lake County Bar Association. The COVID mitigations have been steadily rescinded over the

last few months, and there are in-person appearances aplenty at the courthouse. The 2022 Gridiron served as the bookend to the pandemic shutdown for the legal community, and there is optimism that our association will be able to move forward toward the new normal schedule of events for the remainder of the year. It will be good to get back to in-person professional and social events. A common refrain from attorneys and judges over the last two years is that aside from the loss of social interaction, the pandemic has served as an obstacle to the learning and development of attorneys, especially younger attorneys. As many have noted, court appearances aren’t just important for the administration of justice in our legal system. They are important places

where the education and development of legal professionals is ongoing. Attorneys are able to see how more experienced practitioners approach complex legal issues, and how judges run their status calls and contested hearings. They are able to observe the missteps of other lawyers, and how to avoid those mistakes. They observe direct and cross examination, presentation of exhibits and other important aspects of trial advocacy. Attorneys learn the “value of a case” from seeing matters with similarly situated parties, legal theories and facts decided by the trier of fact; theycan return to their own clients more confident of the expert legal advice that they are providing. The benefits of in-person legal proceedings aren’t confined to those in the courtroom, either.

BY JOSEPH FUSZ PRESIDENT Long before my first deposition at Salvi, Schostok & Pritchard, Michael Schostok sat me down and gave me some advice. He said, “if you want to learn how to be better at asking questions, read transcripts and take depositions. If you want to be better at doing depositions, go and watch depositions. Watch the attorneys, watch the clients. See what works, and what works for you.” Learning these valuable litigation skills isn’t the same experience over Zoom, when the parties could be states away. Let’s admit it: there’s just something about being “in the room where it happens,” to quote Hamilton. But another important facet of in-person legal proceedings is the development of relationships with other attorneys. Many of the interactions in our profession are argumen-


tative and contentious; that is the nature of an adversarial legal system. However, they do not have to be unprofessional, replete with animosity and enmity. Relationships and goodwill often were established between attorneys through informal conversations while waiting for matters to be called, or while judges were off the bench dealing with pretrial conferences or other cases. These relationships could be relied upon in future litigation, followed up on at the next bar association event or professional gathering, developed into life-long friendships, or just a familiar face to sit by at the next CLE. Remote proceedings have been of tremendous value to the legal profession and the people served by the justice system over the course of the pandem-

ic; surely the effects of the shutdown would have been further complicated had they not been implemented over the last two years. However, while remote options may never fully go away as an option, one would be hard-pressed to not recognize the value that in-person interaction has to our chosen profession. Hopefully all legal professionals can work together to find the appropriate balance as we move forward toward the “new normal” for the Lake County legal system. April will have a plethora of opportunities to learn and to engage with your friends in the Lake County Bar Association. The Criminal Law Committee will host attorney Donna A. Rotunno to speak to the LCBA on Tuesday, April 12. She will be discussing, among other

matters, her legal representation of former film producer and convicted sex offender Harvey Weinstein. Additionally, the Liberty Bell Awards Luncheon will take place on Tuesday, April 19 at Waukegan City Hall, our first in-person lunch in years. And the annual Family Law Seminar will be on April 28 and 29 via Zoom. The seminar features a number of outstanding presentations by judges, attorneys, and other professionals, along with a social reception at 28 Mile Distillery in Highwood. So please come out to events in April, reconnect with old colleagues or make new friends, and participate in a committee or CLE. We have much to be grateful for this spring, and as Galileo noted, many colleagues to learn from. Thank you.

The Lake County Bar Association Community Outreach and Diversity Committee hosted its annual LCBA Committee Competition Food Drive on March 10th. Proceeds from the drive will go to support the efforts of the Northern Illinois Food Bank. Seven LCBA committees participated collecting over 300 food items and contributing $2,013 to help fight hunger in the community. Molly Speckman from the Northern Illinois Food Bank said the donations contributed by LCBA members will have an impact valued at over $16,000. The event included an indoor picnic and social so members could enjoy a little LCBA fellowship while supporting a worthwhile cause. The event concluded with an appreciation raffle. Congratulations to Marjorie Sher, Deb Goldberg and Bob Ackley who all took home gift cards. A special thank you to Anderson Law for sponsoring the event. Division Updates

A

s I begin to write this column, it is notable that it is the two-year anniversary of the day that Covid caused the courthouse to shut down. By now, we are all too familiar with the way in which our personal and professional lives have been forever altered. We have experienced many difficult days, but I truly believe that brighter days are ahead. The Circuit has begun to devise our strategy for resuming “normal” operations. To that end, I have asked the presiding judges of each division to submit a plan establishing guidelines for in-person proceedings. Because each division has different operational needs, there will not be one single set of rules. Our focus will

be on establishing a balance for proceedings which should be held in-person and those that can reasonably be conducted remotely. I expect to have something concrete to share in the not-too-distant-future. In recognition of the fact that there have been, and will be, changes in operations, I have asked the presiding judge of each division to author a short “report” on their division’s courtroom activity. This month the focus is on the Family Division. The following was authored by Presiding Judge Michael G. Nerheim. Despite several recent changes, things are going well in the family division. In February we lost two of our most seasoned jurists

Chief Judge’s Page in Judges Christensen and Lombardo. While their departure is certainly a big loss, we welcome Judges Slavin and Seneczko, who have both hit the ground running. Judge Fisz has taken over the C102 call from Judge Christensen and Judge Slavin has taken over for Judge Lombardo in C105. Judge Bruno is keeping incredibly busy as our backup and Judge Seneczko has taken the prove-up and child support call. Judge O’Malley remains in one of the most difficult assignments in the building, the family SRL call. Our Judicial Assistant, Kasia has been a great support to the division as she continues to gain comfort in her new role. All of the judges in the division remain active with the LCBA and various community organizations. Currently, we are working internally, with input from

BY CHIEF JUDGE MARK L. LEVITT the bar, to come up with a “re-opening” plan that balances the need to be back in person with the convenience and access to justice that remote court has provided. As presiding judge, I regularly meet with the judges in our division, our Judicial Assistant, and representatives from the LCBA’s family law committee. We are fortunate to have such an active and engaged bar. Judge Bruno was recently selected by the Illinois Judges Association to moderate a panel discussion on Justice Breyer on March 29. Finally, kudos to all the judges in the division who volunteered to read to local schoolchildren as part of the IJA’s Paging It Forward initiative. I look forward to sharing something each month from the divisions and partners in the 19th. I hope that you will find it useful and informative.

There has been a discussion of doing a joint 50/50 raffle with the LCBA and LCBF. There was also a discussion of a raffle for four prizes which could include other items such as sports tickets. 5. GRANT AWARDS PROCESS: The LCBF Board needs to determine how to distribute our Shakespeare fundraising event and our funds from the dues checkoff collection. Some of the suggestions include Teen Court, Casa and A Safe Place. Motion made by Amy Lonergan and seconded by Rick Lesser to have Greg Weider reach out to charities that align with our by-laws and secure interest for these donors. Motion carried. B. BUILDING: 1. PREVIOUS CABO CONDO WINNER: Motion was made by Rick Lesser and seconded by Skip Tonigan to grant the previous winner, Jessica Weiner, the use of the Condo in Cabo as it was not used due to the Covid epidemic. Motion carried with Kristie Fingerhut abstaining. B. CY PRES AWARDKROLL SETTLEMENT ADMINISTRATION: The LCBF has been contacted by the Kroll Settlement Administrator that we need to return $3,960.22 to them. Motion to return these funds was made Amy Lonergan and seconded by Joe McHugh. Motion carried. VI. ADJOURNMENT: Motion to Adjourn was made by Amy Lonergan and seconded by Shyama Parikh. February 18, 2022 CONSENT AGENDA • Minutes • New Members A motion was made and seconded to approve the consent agenda. The motion was unanimously approved. DISCUSSION ITEMS • Treasurer’s Report The past month has been a positive month for financials and revenue. Revenue is coming into the Bar Association from the Grid Iron and the Family Law Seminar. Based on the upcoming schedule of events, there should be positive revenue flow over the next few months. OLD BUSINESS: Finance Committee Update: Discussion was had concerning moving forward with getting bids from accounting firms. Bylaws Committee: Jeff O’Kelley lead a discussion concerning the Bylaw Committee submitting the changes as a policy

or a bylaw amendment. First, Attendance Policy: There was a motion made and seconded to have a change in the bylaws concerning the attendance policy of board members. The motion passed by a majority: a proposed change will be made at the March meeting. Second, Minutes Requirement for Committees: There was a motion made and seconded concerning striking the bylaw requirement that mandates minutes be submitted for committee meetings. The motion passed by a majority: a proposed change will be made at the March meeting. Third, policy amending political affiliated events: there was no motion passed to amend the policy. Fourth, policy for member participation in meetings: There was a motion made and seconded, passed by a majority, to adopt a change in the member participation policy. Fifth,

policy to have members be requested to speak at committees and seminars: A motion was made and seconded, passed by a majority, to require Bar Members to be asked if they want to present at seminars or committee meetings prior to asking nonmembers. Grid Iron: Discussion was had concerning the Covid requirements for the show. Tickets are still on sale for the show. There was also an update on how the show preparations have been going. NEW BUSINESS: Megan Brady Fee Waiver Discussion was had concerning a reduction in the fee required for Megan Brady’s Family Law Seminar inclusion. There was a motion made and seconded for a 50% reduction in that fee. Harvey Weinstein Case CLE: Discussion was had concerning a CLE

opportunity that would be put on through the Criminal Law Committee. Meeting Concluded 1:14.
