U

nhappy Kuils River homeowners have no choice in the matter of their sidewalks being dug up for fibre lines. Vumatel is about to roll out a fibre cable network in Kuils River, to the delight of many, but the dismay of some who have their reservations. One such resident, David Virgin, begs the question of whether he can refuse Vumatel the right to dig up the pavement in front of his house, which he beautified and main-

tains himself. Virgin fears that his pavement will not be rebuilt to its original state after the trenches have been dug. “Due to the water shortage problem I do not have a decent garden anymore, so to make my pavement in front of my property look more attractive I recently had a supplier lay down new stones and paving items on my pavement. As I stay on a corner plot, Vumatel can really make a big mess of my pavement and we will also be driving through mud to get to our house as winter is not too far off,” he says.

Mayco member for Area North, Suzette Little, last week confirmed that Virgin and other unhappy residents are obliged to permit the trenches to be dug, as it is on public land. “According to national legislation, namely the Electronic Communications Act (ECA), the City of Cape Town and the resident as a private individual cannot refuse fibre optic service providers like Vumatel to operate in any of our road reserves,” says Little. Vumatel is one of about 14 very active telecommunication service providers currently

working in the City to provide fibre communication infrastructure to residents and businesses. Little says the provision of such infrastructure is regulated by the ECA, which as stated above is national legislation and has to be adhered to. “The ECA makes it clear that service providers like Vumatel or any other provider registered with Icasa – and there are more than 400 registered – do have the right to install telecommunication services in a public road reserve and even on private land,” she says.
