or Ashwin Mentoor (32), Tent City has been a home for more than seven years.

He moved here after gangsterism and poverty made life difficult for him in his home town of Atlantis.

Tent City, located adjacent to the Potsdam Road taxi interchange in Table View, is safe and is a place where he can survive, says the unemployed father of 11 children.

“It is comfortable here. Even after they evicted us earlier this year, I still stayed

here,” he says.

More than 33 makeshift tents were removed from the open piece of land in February this year. The area was also cleared of vegetation. Despite Law Enforcement personnel regularly patrolling the area and monitoring the situation, homeless people still set up camp on the field, which is the property of the City of Cape Town’s Transport and Urban Development Authority (TDA).

In February ward 113 councillor, Joy McCarthy, told TygerBurger that the area had become an eyesore, positioned as it is

at the entrance to Table View.

“The vagrants who had taken up residence on this piece of TDA land left the usual mounds of litter visible from the road and hassled the riding school by stealing paddock fencing piles, water for cooking and ablution, as well as attacking the horses and riders,” she said shortly after the eviction by Law Enforcement and Anti-Land Invasion Unit personnel.

In addition, the ever increasing levels of crime and drug dealing taking place also led to the eviction. The overgrown Port Jackson trees were also removed.

The open piece of land and the camp were last week once again the topic of discussion at the subcouncil 3 meeting held in Milnerton.

Here McCarthy told her fellow councillors that she is trying to protect the land, but that this is something that does not come easy.

She indicated that she had been sending email correspondence to the TDA and Brett Herron, but that nothing had been done to solve the problem.

McCarthy suggested that a fence be erected around the area to keep vagrants out.

She said the TDA needs to step up and take responsibility for their land. “Enough is enough,” McCarthy said.

She added that something urgent needs to be done. “It is their land, but my ward.

They need to protect it. It is not fair towards the community.”

McCarthy suggested that the matter be escalated.

“We need to make sure we get some intervention down the line.”

The land, according to information, used to be a national heritage site. McCarthy said the area had served as a recreational stop for grain traders on their way to Malmesbury and families on their way to Atlantis.

Jan Brand, subcouncil manager, said during last week’s meeting that they need to make an appointment with Herron and speak to him one on one.

Nicky Rheeder, councillor for ward 107, also put a motion forward during the meeting in which she explained the need for a homeless shelter in Table View.

Even if they do build a shelter for the homeless, Mentoor says he will only move there if he can share a room with his girlfriend and child who are staying with him in Tent City. “For me it is alright staying here. It is only when it rains – some people’s shelters are not waterproof,” he says.

High school learners at Elkanah House will be hosting their very first South African musical theatre production of District Six next month.

“This really is a special production as our cast is made up of several talented learners who came to Elkanah House through our scholarship programme,” says school spokesperson, Sarah Jacobs.

alking one’s dog or playing fetch on the beach are usually considered to be a relaxing exercise. This, however, does not seem to be the case at Milnerton Beach where two dogs recently came under attack from another dog.

The walk from the Milnerton lighthouse towards Milnerton lagoon has become somewhat unsafe and dangerous for man’s best friend, according to one resident who wishes to remain anonymous.

The Woodbridge Island resident revealed to TygerBurger that two small dogs had died in a space of two weeks after being attacked by an American pit bull terrier.

treet children who beg at the corners of major intersections was one of the main issues discussed at the subcouncil 3 meeting held in Milnerton on Thursday last week.

PR (proportional representation) councillor, Demetrius Dudley, emphasised the importance of urgent intervention.

“I need a telephone number that I can call and expect that there is actually action taken,” he told fellow councillors.

This comes after he recently had a gun pointed at him by a street child begging on the corner of Sable Road, Century City recently.

Dudley explains that a child begging for money approached him while he was stationary at the intersection.

“I asked why he is not in school and he told me that he was suspended. I told him that I am not going to give him any money. He moved to the car behind me and when the driver refused to give him anything he pointed his middle finger at the person.

“I then took out my cellphone to record him and that is when he took his gun out and pointed it at me,” Dudley explains.

He says he believes that some of these children are dangerous.

“Is there any answer to these questions to get them to a place of safety, or back to their parents, because this cannot continue.

“I was told this is not a Law Enforcement issue but a traffic issue as they are at the intersections.”

Traffic Services’ principal inspector, Desré Benadie, says in response that Traffic Services, Law Enforcement and Metro Police do conduct weekly operations to address the issue. “We chase them from the corners, but an hour later they are just back again. We have been doing this for six months, if not longer, on Wednesdays between 11:00 and 13:00.

“We normally issue a notice to the gentleman and lady at the intersection, or a fine if the person has his or her positive identification on them,” Benadie says.

A spokesperson for the City of Cape Town informed TygerBurger that the City’s Department of Social Development and Early

Childhood Development does not have a mandate for street children or minors begging at intersections, but that the Western Cape Department of Social Development is the custodian of all children. “All matters related to street children and minors begging at intersections must be referred to the Western Cape Department of Social Development.”

Sihle Ngobese, spokesperson for the provincial minister of social development, Albert Fritz, told the newspaper that the department does have programmes that aid homeless people and beggars.

“Through our Families Programme, we have a dedicated network of social workers who try to reintegrate the homeless back into their homes and with their families, but also into the community.

“We currently fund about 1391 bed spaces at our homeless shelters which once again are funded by the department.

“Just over R16 million has been allocated towards providing for shelters. The City of Cape Town also funds about R15 million, so it is about R30 million all in all.”

They also work closely with non-profit or-

ganisations that run family reintegration services, as well as Law Enforcement.

He says reintegration is the ultimate aim of getting people off the streets.

Ngobese could not, however, provide details about the number of children begging on the streets.

“There are about 700 street people in the CBD area alone,” Ngobese says. He says there is an excess of about 4800 people in the entire City Metropole estimated to be homeless, according to their street people survey.

The vast majority, about 40% or so, are between the ages of 26 and 35 years.

“People under the age of 18 only make up about 2%,” Ngobese says.

Jan Brand, municipal manager, says children are often not the core problem, but that the issue stems from their homes and parents. He says despite the mayor’s Give Responsibly Campaign, the message of not giving money to the homeless is still not being adhered to by the public. He says people still give street people cash or buy from hawkers selling items next to the road.

T

raffic was briefly disrupted earlier this week when two vehicles, a bakkie and a light motor vehicle, collided on Malibongwe Drive near the N7 off-ramp.

The accident occurred at around 10:30 on Monday morning.

When TygerBurger arrived at the scene, paramedics were busy tending to an injured patient. It is understood that the man sustained neck injuries, but that he was out of any immediate danger.

Jolene Page, spokesperson for Community Medics, says that on arrival two people were found to be in need of medical assistance. “Luckily the injuries were only minor, but both patients were transported to a nearby hospital for further treatment.”

Traffic and Law Enforcement officials were also on the scene to direct traffic.

“Community Medics would like to thank

Life Health Care, Law Enforcement and Western Cape Metro Ambulance Services for their assistance on the scene,” Page says.

The volunteer emergency service was kept busy this past week, having to tend to numerous incidents across the City, including an incident at Table Bay Harbour, as well as two other motor vehicle accidents on Blaauwberg Road and Otto du Plessis Drive in Table View respectively.

Page says the emergency service attended to a total of 80 calls.

The main reasons for these emergency calls were either due to motor vehicle collisions, breathing difficulties, patients who had collapsed due to various reasons, or accidental injuries, while the remainder of the calls were medical or illness related, Page says.

“As colder weather arrives, so does mist and foggy roads, leaving drivers less visible to the vehicles around them,” Page says.

or Velaphi Ntuli, manager of the Koeberg Nuclear Power Plant, waking up at 04:00 and working until 19:00 is considered just another day at the office.

This is how long it takes him each day to attend all the management meetings, read and answer all his emails, do a site inspection, make sure the plant is operating optimally, and take care of his family.

“If I am not here, I am at Megawatt Park in Johannesburg, says Ntuli, originally from Winterveld in the North West Province.

The father of three says his love for the company he works for has not changed in nearly two decades.

“For me, what I love most is the fact that what we do makes an impact on the whole of South Africa – crèches, schools, churches, hospitals and the economy.”

Ntuli completed his studies at the University of Pretoria where he studied Electrical Engineering.

His first job was at the then Spoornet (modern day Transnet) where he worked for almost nine months before joining Koeberg in 2001 as an engineer in training.

In 2004 he completed his Advanced Diploma in Nuclear Physics, after which he joined Koeberg’s nuclear engineer programme. In 2005 he became manager of groups: electrical systems engineering.

Ntuli also became head of the plant engineering group in 2008 where he was charged with looking after the plant’s systems and maintenance and ensuring the efficient operation of the plant.

“In 2013 I travelled to Atlanta in the US to take part in the World Association of Nuclear Operations, or Wano, with which Koeberg is affiliated. I did a peer review, assessing their performance and showing them where they need to improve.

“There I spent about two and a half years before returning,” Ntuli says.

In 2016 he started working at Koeberg again where he was head of engineer groups: nuclear engineering, focusing on design and programming.

“Later that same year I started working in an acting manager position at the plant, and

The key challenges he experiences vary, he says.

One of those challenges is when they experience a shutdown period, or an outage.

“This is when we refuel. The best nuclear plants take about 28 days. We however only manage to do it in about 40 days.

“Our main goal is to improve and to reach 28 days.”

The plant conducts a planned shutdown, or outage, on one of its two reactor units once every 18 months.

Police arrest nine for fraud, dagga Table View Police arrested nine suspects after they were found in possession of items apparently used to defraud others.

Captain Adriana Chandler, police spokesperson, says police members visited a complex in Crawley Road, Parklands on Saturday 21 April, and upon their arrival the occupants at the specific address started to behave suspiciously. Police could smell the odour of dagga lingering in the air and asked to enter the premises.

“During the search, the officers found various paraphernalia used in defrauding unsuspecting victims. The items were confiscated, along with the dagga found at the address,” Chandler says.

She says the nine suspects were arrested and charged with contravention of Section 86 of the Electronic Communications and Transactions Act, possession of an illegal substance and fraud. All nine are foreign nationals and they appeared in the Cape Town Magistrate’s Court on Monday.

Join the Meridian Club on one of their hikes

Theft out of cars a concern

T

heft out of motor vehicles was once again at the top of the police’s list of crimes they had to attend to this past week.

“We are once again urging the community not to leave valuable items in a vehicle; to ensure the doors are locked before walking away and to make sure the alarm is activated,” Captain Adriana Chandler, Table View Police spokesperson, says.

Valuable items are usually left inside the vehicle and removed by criminals by opening an unlocked car door, smashing a window or forcing open the door of an unalarmed car, police say.

“During the week, theft out of motor vehicle was once again identified as a crime of concern,” says Chandler.

Last week police in Table View also managed to make numerous arrests for various other crimes.

On Thursday 19 April, police arrested two suspects in connection with a housebreaking incident that occurred in York Street, Bloubergstrand. The two, a man and a woman, were spotted by patrolling police who

took them back to the scene of the crime where they were positively identified by the homeowner.

On the same day, police also arrested a man believed to have stolen items. The man was spotted carrying a large flat-screen television and DVD player as well as an iron on Marine Drive, Table View.

The 27 year old could not give a valid reason for being in possession of the property and was arrested for being in possession of presumably stolen property, Chandler says.

Table View police also managed to arrest several wanted suspects thanks to the hard work of their tracing team consisting of detectives and visible policing officers under the command of the station commander, Colonel Lindiwe Dyantyi.

“The tracing team’s objective is to trace suspects who have either evaded arrest since the crime was committed or failed to appear in court after arrest.

“The warrants of arrest executed were for theft, crimen injuria, robbery, possession of an illegal substance, housebreaking and house robbery,” Chandler says.

Hiking enthusiasts are invited to join the Meridian Hiking Club on one or more of their hikes this month and next.

The next hike is scheduled for Saturday 28 April at the Silvermine Dam circuit. The hike is about three hours long.

On Tuesday 1 May the club will be hiking up Skeleton’s Gorge, Table Mountain. Par-

ents may bring their children along, the organisers say.

On Saturday 5 May, the club will be travelling to Eagle’s Nest. The hike starts at the Silvermine Dam and follows the Eagle’s Nest route towards Noordhoek Peak.

n an open letter to the City of Cape Town, Sandra Dickson, a Brackenfell resident and the founder of the Stop COCT - Dear Cape Town website, takes the City’s ward councillors to task for their failure to speak out against the draconian draft budget for 2018/19.

In turn, the City has hit back and both Johan van der Merwe, the City’s Mayco member for finance, and Ian Neilson, the City’s executive deputy mayor, have responded to the letter, with their comments published below Dickson’s claims. According to Dickson, who has carefully studied the 1804-page document, this budget reaches right into the home of every single Capetonian to whom municipal services are provided.

Councillors urged to speak up . “This budget, in its current form, adds up to 35% or more of the working class citizen’s municipal bill at a time when the country’s GDP is under 1% and the inflation rate is under 5%. It is just insane to expect the public to foot a multibillion capital expenditure to augment our water supply (over) three years.”

Neilson says this is incorrect. “Some tariff funding is earmarked for augmentation projects, but it also goes toward funding reliable water services – such as infrastructure investment and maintenance. . According to her there was no debate allowed on the budget when it was presented and signed off by council in

March.

Johan van der Merwe says this is because the budget was merely tabled for public participation. “After the public process comes to an end, the final budget will be deliberated/debated on and approved by council at the end of May,” he explains.

The one dissenting councillor to whom Dickson refers is Grant Twigg, chairperson of subcouncil 2, which includes Brackenfell, Kraaifontein and parts of Kuils River. Twigg is also the DA Cape Metro chairperson. In a statement he released on 19 April, Twigg says a robust debate is required on the draft budget. “The budget in its current form is unacceptable and cannot be approved by a

caring DA government. Although the budgeting process implemented by the mayor allowed for nearly no input from councillors in the formulation of the budget, I urge all councillors to amend this proposal,” Twigg states. . Dickson says the period of comment for the public to peruse this budget is hopelessly too short.

The City says this isn’t possible as the budget needs to be finalised before the start of the new financial year. City condemns land invasions We’ve recently seen a spike in attempted land invasions.

While there are exceptions, this surge cannot be divorced from the active instigation of land invasions in the run-up to the national election in 2019. We call on private land owners and the community at large to work with us to guard against land grabs.

In January, anti-land invasion agencies removed some 2400 pegs which are used to illegally demarcate “plots” on open tracts of land.

In the same month 664 illegally erected vacant structures were removed. In the following month, 4928 pegs were removed and 377 illegally built, vacant structures were removed. In March, 9270 pegs were removed and 3843 illegally erected unoccupied structures were dismantled.

The City will continue to take a zero-tolerance approach to attempted land grabs across the Metro.

Invaded land jeopardises emergency and basic service delivery. Many invaded erven are reserved for future housing projects, for industrial development that will promote job creation, or for future roadways.

Those inciting attempted land grabs across the City do so according to their own narrow agendas. They do not care about the plight of our many desperate residents who ultimately have to deal with extreme flood, fire, health and safety risks when settling illegally on land that has not been earmarked for human settlement.

Vulnerable people are often also asked by unscrupulous individuals to pay for “plots” which are in most cases unsuitable for any sort of settlement. Land grabs are

also often followed by demands for the installation of underground and other services which could impede the planned upgrade of informal settlements in other areas. In addition, over the next few years to 2020/21, the City has earmarked more than R850 million for various informal settlement upgrade and incremental development programmes.

Private owners of open tracts must take all reasonable steps to protect their land from being invaded. They must ensure that interdicts are in place if required; that they follow legal procedures to get trespassing orders in place if need be; and take all necessary safeguard measures, such as hiring private protection firms to guard their land 24/7.

I am a single mom with two children. I am unemployed and looking for a job. My husband recently divorced me.

My children and I are staying with my parents.

I am so dismayed to see the increase in rates. Really, food has gone up with the increase in VAT and petrol prices. It never stops.

There is no consideration for the average person in the street and single moms like me. My children have to eat.

They grow out of their clothes so fast, it’s difficult to keep up.

I don’t understand why Eskom has to increase their rates. They are just being greedy.

DA leadership needs to change Recently I wrote [a letter] regarding the poor performance of the Democratic amateurs.

This is not to say that I am against the DA, only that I want them to do well in 2019, which will not happen under the current leadership, which needs to change.

Their latest excuse for the proposed tariff hikes is that because we are using half the water, the municipality is getting half the income.

Well, if only they had done their job and got the desalination offer up and running, they would be enjoying more income as we would be enjoying more water.

Learners register for CAT Olympiad R

egistration for the Applications Olympiad is now open for CAT (Computer Applications Technology) learners across the country.

The benefit of taking part in this Olympiad, according to previous winner James Selby, is “a great opportunity to widen what you can do in CAT”.

“Being able to use computer applications is fast becoming essential for study and work. Applications help learners to make sense of data. They gain insight as they organise data to produce information that leads to useful knowledge and informed insight.

“Making full use of word processing, spreadsheet and database applications is a key skill in today’s diverse world,” says organiser Michael Cameron.

The Applications Olympiad is designed to check skill in using applications from a basic level. It also tests the ability to access data in fresh ways that may not have been taught in the classroom. Cameron says that round one of the 2018 Applications Olympiad is easier than last year. “There are also fewer questions – 20 not 25 – giving more time to work out answers. All learners who are computer literate can benefit as they take part, including those who study CAT or IT. The questions test learners’ skills in making sense of data in different formats: word processing, spreadsheets and databases.”

The first round of the Applications Olympiad runs from 7 to 11 May at any convenient time. It costs nothing for schools to enter. The offline marking remains quick and simple – one-word or one-number answers, either right or wrong. Where learners write the contest online, there is no marking at all for the teacher. Bronze, silver and gold certificates are awarded to the top 50% of learners across the country. The solutions booklet with its varied ways to tackle each question is popular with teachers. “Soon after the contest it is emailed to schools that took part,” says Cameron.

The second round is on Wednesday 6 June. This is also a one-hour contest and it is online only. Those learners who qualify for this round will stand a chance to earn provincial certificates and to be invited to the finals in Cape Town from 26 to 27 June (all expenses paid).

At the finals, medals and cash prizes are awarded to the winners and to their schools. The Applications Olympiad is sponsored by the Institute for IT Professionals of South Africa.

Chris Dry obtains second BTech TARRYN-LEIGH SOLOMONS @tarryns07 Springbok Sevens forward, Chris Dry, has bagged another cap as he graduated with a BTech in Construction Management at the Cape Peninsula University of Technology’s Bellville campus on Thursday 19 April.

In 2015, the star Blitzbok player graduated with a BTech in Quantity Surveying.

Dry, who boasts 63 tournament caps for the Blitzboks, is currently undergoing rehab for a knee ligament injury he sustained at the Cape Town Sevens in December during the quarter-final against Fiji.

He is among more than 2000 graduates who were capped during CPUT’s autumn graduation ceremony on 19 and 20 April.

Dry tells TygerBurger he was unfortunately not able to make it to the

graduation ceremony due to his current rehab schedule in Stellenbosch.

When asked how he was able to manage a successful rugby career and studying, he admits it was challenging to balance the two.

“I was fortunate that the technikon (CPUT) was accommodating in terms of class attendance, information I may have missed out on and examinations. When we were travelling overseas I did a lot of self-studying and communicated with my lecturers via email to keep on par.”

The 30 year old says he felt it was important to have a backup plan in terms of his career.

He has been part of the Sevens squad since 2009.

“I was 21 when I joined the team, but in rugby we need to retire as of 32 years old. Besides rugby, I also have a passion for construction so I’m hoping that after my rugby career I’ll head in that direction.”

Cigarettes ‘too cheap’ City cracks down on reckless taxi drivers In February, the minister of finance proudly announced that excise tax on tobacco products would be increased above the rate of inflation.

Some tobacco control lobbyists erroneously lauded him for this stance, which was essentially true, but only for the tax component of the retail price, according to TAG, the Tobacco, Alcohol and Gambling Advisory, Advocacy and Action Group.

“Increasing only the tax component does not benefit health if it fails to address affordability. The cost to the consumer is important and that has been allowed to remain in the control of the tobacco industry.

“Of all the mechanisms available for tobacco control, tax is the single most important.

Our system must be restructured so that control of the retail selling price (RSP) is in the control of the government,” reads a statement issued by TAG last week.

Prof. Iraj Abedian, well-known economist, CEO of Pan African Investment and Research Services, and member of the TAG Experts Advisory Panel, says: “The tax system must be applied consistently, so as to make tobacco products progressively less affordable.” Tax on a pack of 20 cigarettes increased from R14.33 to R15.52 (8.3%), in addition to the 1% increase in VAT. “However, what really happened is that the tobacco industry has succeeded in mak-

ing cigarettes cheaper, despite being faced with the increase in excise tax and VAT.” Brand A was R36.49 and is now R36.50.

Brand B was R32.49 and is now R32.50. Brand X was R39.99 and is now R40.00. Brand Y was R37.99 and is now R38.00. This pattern applies to all brands surveyed by TAG. Despite the increases in tax and VAT, cigarettes have become cheaper by the current rate of inflation of about 4.4%.

“The result of more affordable cigarettes is that fewer smokers will think about quitting because of cost, and many people, especially the youth, will start smoking because cigarettes are not as expensive as they should be in order to deter them from starting,” he says.

“This is a travesty,” says Peter Ucko, CEO of TAG. “The result is that more people will suffer disease, disability and death. More people will be killed by the tobacco industry products, and the manufacturers and importers know this.”

“Affordability is the key factor and our tax system fails to address this correctly. We challenge the minister of finance and government to change the structure of excise duty on tobacco products so that the products become progressively less and less affordable and then to apply that system consistently every year,” concludes Ucko.

Die app (http://web1.capetown.gov.za/web1/wasterec/map) bevat inligting oor die dienste wat elke herwinningsentiteit bied, die tipes herwinbare afval wat hulle hanteer asook hul kontakbesonderhede, sou ’n inwoner verdere besonderhede of ’n kwotasie verlang en bied sodoende direkte blootstellingsgeleenthede gratis aan herwinningsentiteite.

Die Stad nooi herwinningsentiteite wat verwyderingsdienste, of aflaai- en/of terugkoopsentrums bedryf, om ’n aansoekvorm by die e-posadres hieronder te verkry en in te vul om akkurate inligting en waardevolle dienste aan die publiek te verseker.

Elke herwinningsentiteit sal ook inligting en leiding aangaande Kaapstad se regsvereistes wat betref die akkreditering van herwinningsdiensverskaffers ontvang en slegs geakkrediteerde diensverskaffers sal op die Stad se app vir afvalherwinnaars verskyn.

otorists and commuters complain about the recklessness of taxis on a daily basis. The City of Cape Town’s Traffic Service says it has issued nearly 45 000 fines to taxi operators in just over three months since the beginning of 2018.

As of Monday 9 April, officers had issued 44 937 fines to taxi drivers across the Metropole for a range of contraventions.

The City’s Mayoral Committee member for safety and security and social services, JP Smith, says the majority of the fines (9560) were for moving violations, while 8695 fines were issued for unlicensed drivers. Overloading fines stand at 6143.

“These fines exclude speeding offences, so it really does give one a sense of the level of lawlessness that happens on our roads on a daily basis. The statistics also debunk the perception that our enforcement agencies do not act against taxi operators. We have very limited resources that are stretched to capacity given the demands on them. Furthermore, this does not even represent the enforcement done against other road users, who are by no means innocent, so it certainly provides some perspective on what exactly we are up against,” says Smith.

He adds that the Traffic Service has al-

so impounded 2426 public transport vehicles since July 2017 – an average of 269 a month. Of these, 71% of drivers did not have an operating licence and the rest were operating in contravention of their operating licences.

“Impoundment is a massive logistical exercise for us as the vehicle has to be driven to the pound by a traffic officer and the necessary documentation completed, which is time consuming. When one considers that the vehicle reclaim rate among public transport operators is 98%, it does make impoundment seem like a revolving door as the vehicle is back on the street virtually the same day or the next. We need to hurt errant operators where it hurts and that is permanent impoundment, but currently the law does not allow for this and the City simply enforces the law, we do not make it.”

In spite of the enforcement efforts designed to create a safer city as outlined in the City’s Organisational Development and Transformation Plan, he says many motorists simply refuse to pay their outstanding fines. Currently, the top 100 public transport “warrant dodgers” have amassed more than 2800 outstanding warrants amounting to R3 339 360.

“This is not surprising, but we are working hard to improve our warrant execution rates and holding motorists accountable for their actions. We have seen an increase in the number of people arrested and hopefully, in the medium to longer term, we will start seeing this intervention having an impact on the behaviour of road users.

“I call on operators to be mindful of their passengers’ safety, but also to have consideration for other road users. Nearly a third of the fines issued in the last quarter were for driver fitness. Can one sue a shopping centre after a fall?

n this month’s legal column, Jurgens Tubb of MHI Attorneys answers an interesting question raised by a reader: “Can I sue a shopping centre if I slip and fall?”

According to Tubb, owners of businesses or property are required by law to take reasonable steps to ensure the safety of the general public. “At minimum, owners or managers are required to warn the public of any potential dangers they have caused, are aware of or believe could occur. Therefore, if a shopping centre has not met these requirements and you are injured on its property, you may have a valid claim against it.”

Some examples of preventative measures shopping centres should take include: . demarcating dangerous areas; . removing obstructions from walkways; . lighting an area adequately; . repairing holes and cracks in the pavement; and . putting up railings and/ or barriers.

Would your claim be successful?

The law does not require individuals to watch their every step. It is reasonable to assume that people look around them as they browse the shopping centre. A successful slip-and-fall claim is mainly dependent on proving that the injured person was less negligent than the owner of the premises where they were injured.

Ask yourself the following questions: . Would a reasonable person, such as a property owner, foresee the possibility that the management or administration of their business may expose a person to the risk of slipping and falling? . Could the property owner have done something to prevent the accident that resulted in the claim? For instance, can the occurrence of a slippery floor have been prevented and could it have been mopped up before someone climbed the stairs? . Did the owner take steps to prevent the accident?

Details to collect if you want to institute a claim: . Obtain the details (name, contact number and address) of the person in charge of the premises. . Take photographs of the area where you were injured. . Contact the legal representatives of the business. . Obtain the relevant medical documents as well as the invoices detailing the procedures.

Sy is ook die een by wie mense veilig voel as hulle met diep sake van die lewe te doen kry, of soos die sepieboeties Wade en Tyron haar beskryf: “Sy is die ‘uitkyk-antie’.”

Sy is een van die akteurs van die sepie wat op Saterdag 5 Mei by TygerBurger en Suidooster se Grand Jol in die Grand Arena in GrandWest saam met die publiek oor die dansbaan gaan gly.

Theresa is gebore en getoë in Soutrivier en sy het reeds lank gelede al saam met Cedwyn Joel en Denise Newman opgetree.

“Baie mense is nogal verbaas oor die liefde/vriendskap wat Missus Jay nou in haar herfsjare met die pastoor in die sepie vind, want die persepsie is mos dat net jongmense daarop geregtig is.

“Aan diegene wat nog daardie idee huldig, dat dit onmoontlik is om in jou herfsjare liefde en vriendskap te vind, wil ek sê dis iets seldsaam en spesiaal wat jy moet koester.

“Dis baie selde dat ’n mens op so ’n ouderdom ’n tweede kans op liefde gegun word, wat nog te sê as dit ware liefde is!”

In Suidooster het sy amper gesterf en op ’n vraag oor hoe belangrik dit is dat jy met jou medemens moet saamleef, het sy geantwoord dat die mens moet besef dat die lewe te kort en kosbaar is om in vyandskap met jou medemens te lewe.

Ek wou aanvanklik verpleging gaan studeer het, maar het op die laaste oomblik uitgechicken, en kyk waar is ek nou in my loopbaan,” het Theresa gesê.

Volgens haar was haar jong dae sorgeloos, want almal het met almal gemeng, ongeag kleur.

“Diegene wat vertroud is met Distrik Ses se geskiedenis, sal onthou dat dit presies is hoe die inwoners geleef het – ook in Soutrivier en Woodstock aangrensend aan Distrik Ses. “Almal se hartseer, prestasies, mislukkings en vreugde, was almal in die buurt s’n en was deel van die samehorigheidsgevoel wat destyds in Distrik Ses geheers het.

“My groot droom is dat my gemeenskap in vrede met mekaar moet saamleef.

“As ek nou so gelukkig is om miljoene te wen, sal ek vir elkeen van my kinders ’n huis koop.

“My boodskap aan vandag se jongmense oor die keuses in hul lewe, is dat jy baie versigtig moet wees wie jou vriende is, want daardie keuses kan jou maak of breek,” het sy gesê.

Tjoppie is darem later weer gevang en kamp steeds lekker uit by sy regmatige eienaar.

When one hears the word “rapper”, the image of a somewhat unsophisticated and unrefined individual may spring to mind.

However, rapper and emcee Lee Fortuin from Kuils River defies these notions when he opens his front door with his beloved dog Jessie lurking in the background, wanting to see who the visitor is.

Fortuin, who is known by the stage name Chase Lutron, has been nominated for a Ghoema Music Award in the category Best Afrikaans Hip-hop Song of the Year for his song “Afrikaanse-bet”.

Fortuin started rapping in 1996 when he was still a learner at Sarepta Secondary School, but shares he had started writing music long before then.

He describes his music as political, spiritual, socially conscious, fun, deep, poetic and Afrikaans.

His stage name, Chase Lutron, stems from Greek, with “lutron” being the root word for redemption. “My brother is a theologian, so that’s how I came across the word.

My name means to chase redemption, meaning to be at peace and have nothing missing or broken. Through my music I want to have absolute freedom and no limitations.”

With this being his first Ghoema Music Award nomination, Fourie says it comes not only as a result of his hard work, but the work of his team at Wolf Kraft Productions, his music production company.

After the Ghoema Awards on Sunday 29 April, he says, the hard work continues.

“Besides wanting to put out two albums, I want to become more involved in helping other artists in developing and establishing their sound,” says Fourie. With four artists already making music under the Wolf Kraft banner, he wants to use his skills as an audio engineer and executive producer to make meaningful Afrikaans music.

The song also has a lyric video which is currently playing on kykNET. Fourie has worked with fellow South African artists Hemelbesem and CREAM, and shares he would still like to work with Francois van Coke as well as Karen Zoid. Locally he is inspired by CREAM, Shelbeat, Likwit and Linkris.

For aspiring musicians Fourie’s advice would be to get educated in order to write music. “Stay in school and be disciplined in working towards your goal.”

How businesses are dealing with drought C

ape Town’s premier tourism investment procurement organisation, Wesgro, recently launched a survey to find out more about the challenges facing small business owners in the current drought.

Karl Westvig, CEO of Retail Capital, through which businesses have opportunities to access funding, says there are many small, medium and micro-sized enterprises (SMMEs) that are adapting well to using significantly less water in their daily operations.

Industries such as the hospitality and retail industries, as well as salons, are hardest hit as they rely heavily on water to function.

However, according to Westvig, many SMMEs within these industries are already adapting well to using significantly less water in

their daily operations.

According to a statement, the impact of the drought on business could be huge, and with SMMEs contributing to over 65% of South Africa’s employment and 50% of the country’s GDP, they must survive. Although a lot has been done to cope with the drought, water saving should be a national priority, Westvig says.

He lists hotels such as those in the Protea Group, which have removed plugs from baths and closed pool, steam and sauna facilities to limit water consumption.

Tourist attractions like Cape Point are recycling greywater for flushing toilets and offering only waterless hand sanitiser in place of soap in toilets.

Westvig says: “Some franchise owners and restaurants are now

According to the statement, a top-rated Cape Town restaurant, The Test Kitchen, is following this trend. They have introduced an innovative “Drought Kitchen” menu, which will run as a pop-up at the restaurant from 1 April to the end of May. This means all their dishes will be served in a wooden frame on compostable cardboard that is slipped out between courses.

Guests will be asked to keep the same cutlery for all six courses and the restaurant has done away with tablecloths and cloth napkins. Also, items on the Drought Menu will be prepared using minimal water, and a system of melted ice-bucket

water is already in use to clean their floors.

Salons are also being challenged in a big way. According to the statement, many owners have turned to using bottled water, at additional cost to their business, with some instituting a policy where customers must bring their own water.

Westvig advises SMMEs on the following: . Install aerators on taps. . Provide staff with a central supply of bottled water so they can refill bottles rather than using a new bottle each time. . Recycle water left in bottles after meetings. This water can be used for cleaning purposes or to fill toilet cisterns. . Stock up on water-saving products like hand sanitisers. . Dispense with cloth table-

cloths that need washing and replace them with plastic versions that only require a simple wipedown. . Redirect greywater for use in toilets. . Source mobile toilets that use recycled and not potable water for any events.

“With the drought being of national concern and causing costs and disruptions to business, other provinces can learn from the Western Cape now by putting in bore­holes, stocking up on water-saving products, reducing water usage, and changing plumbing where possible,” urges Westvig.

Plotting the way through disaster Sassa, the City of Cape Town and the provincial Social Development Department met on Friday 20 April to discuss the details of the provision of disaster and social relief to residents struck by emergencies.

Representatives discussed how future assessments for aid and humanitarian relief will be dispensed. Sassa, which took responsibility for this function earlier this year, has been experiencing teething problems with the takeover from the City’s Disaster Risk Management Centre (DRM).

The change came about after Sassa reassessed its policies and pro-

cedures in funding NGOs, according to a City statement.

“There were concerns that the payments to service providers could possibly be classified as irregular expenditure in terms of the Public Finance Management Act and the Sassa supply chain management policies.

“Since the changeover, there have been teething problems which necessitated the meeting, which resolved that it is in the interest of good governance and service delivery for the City, Sassa and the Western Cape Department of Social Development to co-oper-

ate and seek synergy in the arrangements for disaster relief.”

The representatives resolved to arrange further meetings to determine the proper way forward and to ultimately ensure residents receive an improved service.

“The meeting ended on a positive note and it was agreed to explore the use of modern technology to aid the timeous distribution of social/ disaster relief to affected residents,” reads the statement.

he Bala brothers are well known as performing artists in the country, and Capetonians will get to see Loyiso performing live on 5 May in the Grand Arena at GrandWest as part of the Grand Jol of TygerBurger and Suidooster.

“I am from Uitenhage in the Eastern Cape but live with my family in Johannesburg. My brothers are both still very active in the music industry.

Zwai is a music and creative director while Phelo is pursuing his solo career with his second solo album.

We’ve always sung together since we were very young, so sharing the stage with my brothers feels to me like just another special family get-together,” Loyiso says.

He started off in the music industry as part of multi-platinum selling group TKZee Family before going solo in 2000 with his first single, “Mus’ ukukhala”. Since then he has won seven Sama awards as a solo artist.

“Although I would like for my songs to be sung and enjoyed way after I am out of here, creating a sustainable industry for both performers and songwriters is my biggest passion. I would like this to be my legacy in music.

Highlights of performing with famous artists include John Legend, Elton John, Stevie Wonder, Aretha Franklin and Corinne Bailey Rae. “Of all of them I’d say that Stevie Wonder had the most impact on my career. Not many singers in my genre have not been influenced by him musically, whether as a songwriter or as a singer. If I could perform with an international artist, and depending on the genre, I would say William

McDowell. Currently I have been listening non-stop to his gospel songs.

He is the person that I would love to share a stage with, even if I were just singing tenor as part of his backing vocalists. That’s how much I appreciate his music,” Loyiso says.

When he is not singing, he is running his music business. “They say the music business is 20% music and 80% business and that is why I try to be involved in both. Since music, which is also my hobby, takes up most of my working hours, spending quality time with my family is what I do when I’m not working,” he says.

He adds that he doesn’t really have a preference when it comes to music genre. “Mainly because growing up I listened to and studied all types of music. I’ve also released albums in nearly every genre possible from classical to gospel, R&B, swing and more.

Therefore, my favourite genre is always the one that I’m working on at the time. My favourite male singer is Brian McKnight and female Ntokozo Mbambo.

“A lot can and still needs to be done for artists in the South African music industry in order to preserve our industry for future musicians to still make a living out of it. Adjusting the amount of SA music played on our radio stations to favour the SA artist will go a long way to improving the creators in my field.

“One of my biggest concerns is the piracy of selling CDs and DVDs, not only in parking lots or in front of shopping malls. More piracy happens online (by people who can afford to buy albums) than it does in parking lots and at taxi ranks. It is a huge risk to the industry but it also forces us musi-

cians to perfect our performing skills so that we can get more live shows,” he says.

Not every performance is plain sailing. He once fell off the stage, but he simply picked himself up and carried on singing. This is also his attitude to life in general.

“Being a celebrity comes with a price and your fans should always be part of the package, whether or not you want to chat while having something to eat with family. If I choose to go somewhere with the family I make sure it’s private enough for us to enjoy each other. If people end up coming to say hi, we gladly let them through. I must say, though, that I have the best fans in the world who respect my space and my family.

“My Drakensberg Boys’ Choir master, the late Bunny Ashley-Botha, had the most influence on my music career. He taught me so much about music and how to carry myself as a musician that some of his lessons are still relevant to me at this mature stage of my career.

“What the public don’t know about me is that I talk and joke around a lot, so my life is not all about music,” he chuckles.

“My message to young upand-coming artists is: If you are good, they’ll find you. In the interim, get your house in order.”

o many she is known as the local singing sensation Koekie, who brought the public the hits “Outjie met jou lekker boudjie” and “Koekie” – danced to publicly by the likes of Premier Helen Zille, among others – but Abigail James is set on forging a new path both personally and professionally.

As she discusses the way forward with TygerBurger, she reveals she has taken the first few steps into the gospel genre. “It has been tough to turn my life around as a gospel artist because the sup-

port I thought would be there, is not there,” she shares.

James, who started her singing career in 2001 with the group A to Z and her solo career in 2009, says she could have never imagined what a hit she would be as Koekie.

“Everything just unexpectedly blew up and people just grew to love it,” she says.

However, with the success came what she calls her personal and professional struggles. “Just because I am an artist it does not mean that I am living the high life and that I don’t go through tough times,” she says.

James, who grew up in Eerste River and started singing in the

church, says her family were very happy and supportive of her career, despite not being particularly musical themselves.

She says in recent years she has had to face many challenges, including trying to provide for her two children, facing abusive relationships and having no real support system. “It has only been lately that I have been blessed with a good support system. Despite the challenges I keep on my knees, thanking Him (God) for what He has done,” she shares.

James is now focusing on introducing the public to the “new” Abby. “I want people to see my transformation from where I was to

where I now want to be. I don’t know if Koekie will ever die out,” she laughs.

James has already recorded some gospel songs and says the songs are upbeat, in the style of songs she has previously recorded.

James has set her sights on seeing her career bloom, as well as being an inspiration to abused woman and children. “I know firsthand what abuse is and I want to inspire them to release themselves from such a situation because I’ve learnt many hard lessons,” she says.

Table tennis star aims for the top STEHAN SCHOEMAN

ifteen-year-old table tennis ace Keenen Jooste just had his first taste of international competition and this youngster from De Kuilen High School in Kuils River is hungry for more.

Keenan, the second ranked junior in the country, has just returned from the Ivory Coast where he represented South Africa at the 2018 African Junior and Cadet Table Tennis Championships.

The lad from Top Table Tennis Club in Belhar started playing a mere four years ago and already has multiple provincial and national titles behind his name. “Representing my country really is a dream come true. The tournament was a real eye-opener and mindblowing experience competing against some of the best on the continent.

“The skill level of the other countries is insanely good but we are still competitive.

I now know what to expect in the future and although I didn’t win a medal I am hungrier than ever.

“One of the positive things I took out of this experience is the love, dedication and

camaraderie all the players have for one another. I really feel in hindsight that I learned a lot and going forward this experience will help me to develop and become a better player,” says Keenan.

Last month, Keenan travelled to the Seychelles where he competed in a friendly international between the two countries.

“It was so much fun playing against them.

A lot of those kids play on senior level as well and they are very good and competitive. I would say South Africa is overall better than the Seychelles.”

His father and coach, Hennie Jooste, is a very proud and happy man. “I am extremely proud of how far he has come in such a short amount of time. We work five days a week on all aspects of his game. Kelvin Smit also invests a lot of time in Keenan and we are both grateful for his skills and contribution as coach. The sky is the limit and we are working towards bigger dreams,” says Hennie. The focus now shifts to the upcoming South African Table Tennis Championships to be held in Secunda in June where he will represent Cape Town Table Tennis, formerly known as Western Province Table Tennis.

Walkerbay Xtreme brei items nog meer uit vir elke gesinslid Die HI-TEC Walkerbay Xtreme (WBX) wat van Vrydag 27 April tot Maandag 30 April in Hermanus aangebied word, het sy omvattende aanbod van verskillende sportitems nog meer uitgebrei om seker te maak daar is ’n item vir elke lid van die gesin.

Dit sluit ook ’n junior driekampkompetisie en ’n spesiale skattejag vir die jong klomp in. Die HI-TEC “Walk-a-Bay”-skattejag is gemik op kinders jonger as 10. Deelnemers sal ’n skattejagkaart met leidrade kry om ’n roe-

te van ongeveer 1,5 km te volg en meer te leer oor die natuur en die belang van bewaring.

Die junior driekampkompetisie sal bestaan uit 150 m swem, 5 km fietsry en 2 km hardloop. Dit is gemik op kinders tussen die ouderdom van 8 en 13 jaar. Ouer deelnemers kan kies tussen ’n pad- of velddriekampitem.

“Driekamp is een van die sporte in die wêreld wat die vinnigste groei en junior driekampe is ’n belangrike deel van hierdie tendens. Ons wil deelnemers aanmoedig om as

gesin in te skryf en gehalte-gesinstyd in ons asemrowende streek te spandeer terwyl hulle deelneem aan ’n ikoniese, unieke wêreldklas-avontuursportfees,” sê Rick Oosthuyzen, ’n organiseerders van die Walkerbay Xtreme. Naas die skattejag en junior driekamp, het die WBX korter afstande in die bergfiets-uitdaging, ’n kuspadwedloop en ’n oopwaterswemitem ingesluit, en ook ’n straatmyl op die kalender geplaas.

Die bergfietsuitdaging bied drie afstande:

55 km, 27 km en 15 km, wat geskik is vir jong ryers en nuwelinge. Hardlopers kan kies tussen 5,7 km, 12,6 km of 18,1 km in die kuspadwedloop – ’n pretdraf langs Hermanus se kuslyn met ’n uitsig oor die oseaan. Naas die 2,5 km oopwaterswemitem, is daar ook ’n korter afstand van 600 m. Die straatmyl bied spesiale kategoriepryse vir hardlopers jonger as 13 jaar, hardlopers tussen 14 en 18 jaar, en hardlopers 19 jaar en ouer. Besoek www.walkerbayxtreme.com vir inligting.

rmand Ascaray van die Hoërskool D.F. Malan het toutrek, rugby en tennis gelos om op rolbal te fokus en dié jongman was nog nie vir ’n oomblik daaroor spyt nie.

Die vyftienjarige Armand is die TygerBurger se sportster van die maand.

Armand is die ene konsentrasie as hy op die rolbalbaan stap.

Armand se ma, Nadine, wat self ’n kranige speler is, het hom aan rolbal voorgestel en vandag is hulle albei lede van die SAPS-rolbalklub in Pinelands.

“Ek was by die Bellville-Bulldogs-toutrekklub betrokke, waar ek op die SA’s in die 400 kg-afdeling as anker getrek en my SA kleure verwerf het. Ek het dit baie geniet, maar het besluit rolbal is vir my lekker, soveel so dat ek rugby, tennis en toutrek gelos het.

“Ek is in 2015 gevra om in Oudtshoorn tydens die Jeugfees deel te neem, en ek het vierde saam met my spanmaats geëindig.

“Ek het daarvan begin hou en in 2016 is ek gekies vir die Westelike Provinsie se o.19rolbalspan. Ons het ’n bronsmedalje verower by die junior nasionale kampioenskap in Bloemfontein.

“In daardie jaar het ek die Enver Buystweebal-enkelspel gewen, waar ek teen WP-, Boland- en Eden-spelers meegeding het.

“Verlede jaar ná die proewe wat gehou is, is ek weer in die WP se junior span ingesluit.

Dié keer het ek in die o.15-afdeling in Bloemfontein gaan speel tydens die nasionale junior kampioenskap, waar ek ’n goue medalje verower het uit twintig spanne wat deelgeneem het. Dit was vir my ’n baie groot eer

SAREL BURGER Die Hoërskool Stellenberg se o.19A-rugbyspan het die afgelope Saterdag vir die tweede agtereenvolgende week meer as 70 punte in sy wedstryd opgestapel.

Ná die vorige week se slagting van 76-0 (12 drieë) teen die HS Strand, moes ook Parel Vallei dit die afgelope naweek ontgeld.

Die Stellies het andermaal 12 drieë ingeryg om die span van Somerset-Wes met 74-10 te looi. HS Bellville is ook skitterend op dreef, soos blyk uit sy maklike oorwinning van 43-8 oor HS Strand.

Hoewel Durbanville op Riversdal moedig geveg het in sy kragmeting teen Landbouskool Oakdale, moes die Durbies met 21-39 die knie buig voor die tuisspan.

Armand het ook vanjaar reeds die WP se junior meesters-enkelspeltitel verower én die WP juniors se viere-kompetisie, waarvan hy ’n spanlid was. ’n Erg verswakte HTS Bellville is op City Park in Athlone 27-14 geklop deur die gekombineerde span van Khayelitsha en Nyanga.

Maar goeie oorwinnings is wel behaal deur Milnerton (26-14 teen Hottentots-Holland), Melkbosstrand (35-10 t J.G. Meiring) en Table View (24-19 t Edgemead), terwyl naelbyt-oorwinnings deurgetrek is deur President (26-24 t Parow), The Settlers (8-5 t Tygerberg-klub) en Bosmansdam (14-12 t Hamlets-klub).

“Die spel is nie maklik nie. Jy moet geduld hê en jy moet konsentreer op wat jy doen. Jy moet verskillende lyne kan rol met die regte gewig. “Glo my, dit is nie so maklik soos almal dink nie. Daar is afrigting nodig en baie oefening – ten minste een uur per dag. Dit is ’n great sport en beslis nie old mens marbles nie,” sê Armand. Hy wen ’n sonbril van sy keuse by Bosman, McNulty en Du Toit-oogkundiges en Hennie Bosman van Welgemoed se Kyokushin-kan-dojo bederf hom met R1 000 kontant.
