EDGEMEAD: CYCLIST ALLEGEDLY ATTACKED BY DOGS, CLAIMS DAMAGES OF R43 000

fter an alleged dog attack on a cyclist at around 08:00 on Friday 18 August, two residents are now facing legal claims for damages in excess of R43 000. On top of this, the one resident involved, Caine Stadler, says their family was traumatised by the eventual impoundment of their dog for five days, and by the “harassment” from Law Enforcement (LE). The second resident involved, Eric Robinson, who managed to prevent his dog from being impounded, received a fine of R2500. The incident happened when three residents, with five dogs among them, were on the open field bordering Meerendal and Rustendal roads in Edgemead. This is apparently a regular hangout for resident dog owners. Stadler was out with his two Rhodesian ridgebacks – one elderly and the other a boisterous 15 month old. He says a few neighbours meet every morning on the field with their dogs and it was the first time in a while he had taken the younger dog, Hunter, out to the field, as he is growing large and is a little excitable. Stadler claims that Hunter was the only dog on a leash, but as it was a new collar the dog kept pulling out of it. He says he took the collar off to adjust it when Hunter ran towards the other dogs, just as a man on a bicycle rounded the corner. He says one of the dogs barked and Hunter chased after the cyclist, around the corner. Stadler claims that Hunter returned about 30 seconds later. A few minutes later the cyclist returned and approached the dog owners. The man was pointing at his calf, and his long cycling pants were torn, says Stadler, adding that none of the owners could see any serious injuries.
“It looked like a little bit of a nip.” Stadler told the man, Dele Agagu, who lives nearby, that nobody had seen what had happened, but if it was his dog involved, he would be willing to replace Agagu’s pants and pay for a tetanus injection if needed. Stadler told Agagu he would visit him at home to provide full details and went there two days later. Agagu was not home so Stadler left his details with Agagu’s brother. On Wednesday 23 August Stadler and Robinson each received notices from an attorney for Agagu, claiming damages totalling R43 205.68. Stadler claims that when two LE officers came to his house, he asked them whether he could get his attorney involved, as nobody had actually witnessed an attack and he felt it was all allegations. The officer allegedly told him he did not need a statement or reply from Stadler; they would be contacting Stadler again once they received the case docket. They said he might receive a fine or the dog might be seized. Stadler says there were several initial visits from LE, but the officers were being “cryptic”. He would not allow LE on his property and kept telling them he needed something in writing, Stadler says. His wife, Debbie, says they also received a note from the SPCA to arrange a time for an inspector to come and check the living conditions of the dogs. Elani Steenkamp, a trainee inspector from the SPCA, confirmed to TygerBurger that she visited the Stadlers, saying “the dogs were fine and have a wonderful living environment. They are well looked after and not aggressive”. Steenkamp says she reported as such to the complainant (Agagu). V To page 7.
