ilver Oaks residents were completely surprised when bulldozers pulled up – all systems go – to start moving land at a planned development in Langverwacht; this while residents are still awaiting the outcome of the appeal they lodged against this development. Concerned resident Moveen Adams says it makes no sense for this development to go ahead without the necessary sewerage infrastructure in place. “In a letter we received from the City’s Transport and Urban Development Authority (TDA), it says all measures (referring to infrastructure) must be seen to, and all of these needs must be met, before any type of building will be approved. “According to my knowledge, nothing
has been done to upgrade or solve the huge sewerage problem we are sitting with and yet, to my dismay, I have people clearing the area behind my house to start building their flats and I was never even notified of this,” says Adams. “I have voiced my concerns and disgust with regard to the City Of Cape Town just ignoring our cries for trying to live a normal tranquil life. “They have ignored us on all routes we have tried to take. I am sitting in my once quiet home, listening to my dogs barking and bulldozers and diggers going at it the whole day. This is such a bad and sad time for us in Silver Oaks and surrounding area. What is happening?”

firms that on 13 June, the MPT approved the application for the consolidation and rezoning of the land, and that the appeals were submitted to serve before the appeals authority – being the executive mayor, Patricia de Lille – for her consideration. In the meantime, says Adams, “We did not receive any form of communication at all, before the bulldozers and diggers pulled in. Why are they doing this without informing the people concerned and affected by this? “The fight is long not over. We will not be ignored. We also have rights,” he says. Only on 18 November, weeks after the bulldozers pulled up, did the TDA inform residents that the appeals process had not yet been concluded. Brett Herron, Mayco member for the TDA, explains that the work currently be-
ing done at the site was approved in terms of a demolition permit dated 2 October, and this approval holds no bearing on the decision that is to be made regarding the development. “In general, separate processes are followed for demolition applications and development applications, even if they are for the same property. Each application follows its own due process and is evaluated on its merits,” he says. Therefore, should the owner of the land commence with actual development prior to the conclusion of the appeals process, he would be in contravention of the Municipal Planning Bylaw. As to what would happen to the already overturned land in terms of dust control, in case the residents should win their appeal, the City could not provide an answer at the time of going to print.
