aving to pay R5130 out of her pocket for vehicle repairs to her car after an overhead line snapped and burnt before landing on her car is not something that Marina Wilson of Parow East expected or is happy about. “I park my car daily in front of my workplace on the corner of Jones and Mathee streets in Parow East and it was the second time that the cable snapped and burnt. The first time it happened was on 7 June and now
on 4 September. I phoned the City of Cape Town to lodge a complaint and their answer was that they can’t be liable for the damage to my car,” says Wilson. Siyabulela Mamkeli, Mayco member for Area Central, confirmed that a public liability claim was received from Marina Wilson earlier this month. “The unanimous decision was taken to repudiate Mrs Wilson’s claim on the basis that the incident was not reasonably foreseeable. The City cannot be held liable for the damages which Mrs Wilson suffered, as no negligence could be im-
puted against the City,” he said. In this case, the electricity department claimed that the overhead line burnt out due to wear and tear, which, according to them, is not reasonably foreseeable. Wilson was not happy with this answer, because she feels that the City should do regular inspections to prevent overhead lines in the city from burning out due to wear and tear. She is adamant that the City must pay for the scratches and chip marks to the body of her car. Some of the scratches could be polished out, but the chip marks have to be re-
moved by a panel beater. “Following the repudiation of the claim, Mrs Wilson provided additional information regarding a similar incident that occurred weeks prior to the incident at hand, which prompted a review of the matter. The electricity department advised that the second incident to which Mrs Wilson was referring, related to a different overhead line and that the two incidents were in fact not similar in nature. Therefore we advised Mrs Wilson that the repudiation of her claim must stand,” Mamkeli added. V To page 2.
