The hot summer of 2022 continues, and I hope everyone has jobsites that are in full swing. As July ended, the Massachusetts Legislature was also very busy wrapping up its 2021-2022 session on July 31. There certainly was no shortage of issues and pro posals on the agenda with the potential to affect our industry and our businesses. As usual, UCANE was right in the middle of things. U CANE’s advocacy efforts are a crucial part of what our Association provides for its members. The end of the session is the culmination of almost two years of activity by UCANE working closely alongside our long time state lobbyist, Mark Molloy from Cascade Strategies, LLC. In addition to our victory last year at the federal level with the passage of a long sought after infrastructure bill, we successfully lobbied for additional funding for water and utility infra structure at the state level through stimulus and surplus funds. We also achieved a victory with the passage of our legislation that successfully updated the Dig Safe Law to include modern technology and help to ensure more consistent marking standards and training. We also suc cessfully opposed overly burdensome bills such as wage theft legislation that, while well-inten tioned, would have unfairly hurt businesses that did nothing wrong. We also filed and supported bills and initiatives promoting water infrastructure and the construction industry. You can read fur ther details about these and other issues in Mark Molloy’s Legislative Update ( page 7 ). While the formal legislative session ended, UCANE’s work is certainly still ongoing. We will continue to meet with elected of ficials and leaders. But what every member can and should do is make their voices heard. 2022 is an election year, so the most important way to do that is to make sure that you cast your vote. The state pri mary will be held on September 6 and the gen eral election on November 8. We know there will be a new Governor in 2023, but all state constitutional of ficers are also on the ballot. Every seat in the State Leg islature is also on the ballot, as is every Con gressperson in the House of Representatives. No matter what of fice you are voting for, make sure you do your due diligence and see where the candidates stand on the issues that will af fect you, your family, and your businesses, particularly the underground utility infrastructure and the construction industry. With the volatility of the economy and the uncertainty around the supply chain and inflation, it is vital that we sup port candidates who prioritize our issues and support our industry.

Massachusetts Legislature Winds Up Formal Sessions
The Massachusetts legislature ended its 2021-2022 formal sessions on August 1. After a marathon final formal session, the Massachusetts House of Representatives and the Massachusetts Senate passed a slew of confer ence committee reports that addressed mental health, sports betting, clean energy, transportation, and improved court system infrastructure. While normally a hectic occasion in the best of times, the end of formal sessions was impacted by the news that the legislature’s tax relief proposal would be sidelined as the impact of Mass. Gen. Laws ch. 62F is studied further. The Massachusetts legislature’s economic development package has long been considered one of the primary jobs creators undertaken by the body each session. This session, the House of Representatives and Senate included a variety of tax relief measures alongside a variety of bonding and policy proposals that would have addressed everything from hospital funding, housing growth, and a myriad of other applications, including water infrastructure funding. Governor Baker’s last-min ute announcement that state revenues would likely trigger the Mass. Gen. Laws ch. 62F tax rebate for taxpayers came as a surprise to many observers on Beacon NotwithstandingHill. the late session drama, both Senate President Karen Spilka and House Speak er Ron Mariano have stated that they will work to advance elements of the economic development legislation either later this session or at the begin ning of the next. For its part, the Massachusetts legislature did put its imprimatur on a wide range of issues nonetheless. The highly public battle over sports betting resulted in legislation that will allow betting on all games except those involving Massachusetts colleges and universities in nontournament settings. A long sought and compre hensive change to the Commonwealth’s mental health laws reached the Governor’s desk. Like wise, the court system’s efforts to advance a $164 million technology bond bill, which would provide for improved recordkeeping and digital access, wasInsuccessful.abitofa quick back-n-forth, the Governor provided amendments to a clean energy bill that the legislature had pushed for ward in the final days. To address the Governor’s concerns, the Massachusetts legislature worked with the Baker-Polito Administration to more fully address the identified areas. If approved, the wide sweeping energy bill will advance the Commonwealth’s efforts to bolster its wind and other renewable energy portfolio.

The legislation, however, has attracted the ire of the natural gas community, which views the current proposal as a retreat from the jobs and benefits associated with the existing natural gas systems. As of this writing, there is no indication whether the Governor will sign the new version of the energy bill now on his desk. The end of the formal legislative session led to a glut of conference committee reports, local home rule petitions, and other legislation landing on the Governor’s desk. The Legis lature’s final ve rsion of th e Tr ansportation Bo nd Bill authorized $11.3 billion for transportation and infrastructure projects, including $400 million for the Massachusetts Bay Transportation Author ity (MBTA) to address ongoing safety concerns identified by th e Fe deral Tr ansit Administration’s Safety Management Inspection and $275 million for the East-West passenger rail project. Other highlights of the bill include: • $3,500,000,000 for projects funded with dis cretionary federal grant funds, including funds from the federal Bipartisan Infrastructure Law. • $2,812,457,157 for projects on the interstate and non-interstate federal highway system. • $1,375,000,000 for sustainable transit system m odernization and rail improvements. • $1,270,000,000 for non-federally aided road way and bridge projects and for the non-par ticipating portion of federally aided projects. • $145,000,000 for multi-modal transportation planning and programming. • Creates a commission to investigate and receive public testimony concerning public entities with the ability to design, permit, construct, operate, and maintain passenger rail service that meets the standards of at least one of the final alterna tives set forth in the East-West Passenger Rail Study Final Report.
• Requires MassDOT, in consultation with the comptroller, to create a website to report on ex penditures from this act and any project receiv ing federal funding from the federal Bipartisan Infrastructure Law.
• Creates a special commission on mobility pric ing to investigate, study, and make recommen dations on the development and deployment of comprehensive and regionally equitable public transportation pricing, roadway pricing, and congestion pricing.

Laws ch. 42, §40A – §40E and 220 CMR 99.00 et. seq., respectively, govern the marking of underground utilities for purposes of protecting against unintended strikes or breaks to utility equipment. While the DPU implemented a series of changes to the Dig-Safe regulations within the past five ye ars, ce rtain are as co uld not be updated due to the existing law. Legislature Passes and Governor Baker Signs Fiscal Year 2023 Budget
• $10 million for the underground storage tank program, which continues to fund the removal of single lined, underground fuel storage tanks.
Specifically, the FY23 budget incorporates an upgraded $39.576 billion base tax revenue forecast, an increase of $2.66 billion above the total FY23 con sensus tax projection set in January. This revenue supports a total of $52.7 billion in gross spending, excluding the Medical Assistance Trust Fund transfer, which reflects approximately 9.3% growth in appro priations over fiscal year 2022 (F Y22). As enacted, the budget anticipates a sizable deposit into the Sta bilization Fund (i.e. “Rainy Day Fund”) of nearly $1.5 billion, which would increase the balance of the Fund from an already historic high of $6.9 billion to $8.4 billion. This would represent a $7.3 billion increase in the balance of the Stabilization Fund since 2015.
• $1.5 million for the Commonwealth’s rate relief assistance program, which is a holdover program that essentially rewards communities or regional water authorities that have undertaken water infrastructure projects. The Governor returned approximately $450,000 worth of appropriations with a veto and 41 outside sec tions with an amendment. The fiscal year 2023 budget represents an increase of $5.1 billion or 10.7 percent over the $47.6 billion annual budget passed for fiscal 2022. According to the State House News Service, it also represents an increase of $14.6 billion or 38.3 percent over the first budget that Baker signed, a $38.1 billion spending plan for fiscal year 2016. The Massachusetts legislature sent a Confer ence Committee report on the fiscal year 2023 (FY23) budget to the Governor in mid-July. The $52.7 billion spending plan that fully funds the contin ued implementation of the Student Opportunity Act, while making record investments in early education and childcare, housing and homeownership, college financial aid, economic and workforce development, behavioral health care, and local aid was then signed by the Governor towards the end of the month. The FY23 budget, which does not rely on one-time revenue sources nor raises any new taxes or fees, saw higher than anticipated appropriations across the board.
The revenue upgrade incorporated into the budget also affords a number of substantial one-time trans fers and reserves in FY23, including: a $266 million reserve to support MBTA safety and workforce initia tives; a $175 million transfer to a new trust fund dedi cated to supporting high-quality early education and child care; a $150 million transfer to the Student Op portunity Act Investment Fund; $100 million for a sup plemental transfer to the Commonwealth’s Pension Liability Fund; and $100 million for a transfer to the State Retiree Benefits Trust Fund. The budget fur ther supports job readiness and efforts to connect students and workers to high-demand career pathways with in creased funding for programs within the Executive Of fice for Labor and Workforce Development (EOLWD). It includes $28.5 million for the YouthWorks Summer Jobs program, $23.9 million in total funding for the Career Technical Initiative, $17 million for the Work force Competitiveness Trust Fund, and $15 million for MassHire one-stop career centers.

T he end of July saw Boston Mayor Michelle Wu announce the appointment of Ms. Kate England as the City’s inaugural Director of Green Infrastructure. Green infrastructure is an approach to stormwater management that pro tects, restores, or mimics the natural water cycle through the use of trees and other vegetation. Green infrastructure also has numerous co-ben efits including increased tree canopy, mitigating urban heat island effect, and increased ecological diversity. According to a press release from the City of Boston, Ms. England will collaborate across City departments and with the Boston Wa ter and Sewer Commission (BWSC) to lead the City’s efforts to plan, build, and maintain green infrastructure as part of the Mayor’s Green New Deal for Boston. Ms. England will be responsible for incorpo rating green infrastructure into the City of Bos ton’s project plans, regulations, and operations. She will be relaunching the Green Infrastructure Working Group that she started while at BWSC to ensure that City departments have a uniform approach to green infrastructure implementation. Through the working group, she will work with engineering and planning teams across City de partments to update standard details and design guidelines to incorporate current green infrastruc ture best practice into the City’s daily operations, including sidewalk reconstruction, street repav ing, development review, street tree planting, and park renovations.
Ms. England has a background in engineer ing and landscape architecture and most recently worked as a statewide planner for the Massachusetts Department of Conservation and Recreation (DCR). While at DCR, she advised staff about green infrastructure best practices, authored green infrastructure policies and procedures, chaired one of DCR’s Climate Action Teams, and helped lead DCR’s statewide Climate Change Vulnerability Assessment. She previously worked as a project coordinator for stormwater infrastructure at BWSC where she established and oversaw the Com mission’s Green Infrastructure Program. While at BWSC, she also helped author green infrastructure curriculum for 5th and 7th grade Boston Public Schools students. The curriculum was piloted in the 2018-2019 school year and is now taught dis trictwide.Ms.England lives in the Stony Brook Reser vation in Hyde Park with her partner Steve and their dogs Piper and Zoey. In her spare time Eng land enjoys caring for her over 90 potted plants, gardening, and playing ultimate fr isbee and field hockey. She holds bachelors degrees from North eastern University in political science and inter national affairs and a master’s in environmental studies from Brown University where, according to a press release from the Mayor’s Of fice, she wrote her master’s thesis on utilizing stormwater utilities to incentivize implementation of green in frastructure.

• General Obligation Bond Bill Signed Into Law. Governor Baker signed into law House Bill 5065, fi nancing the general governmental infrastructure of the Commonwealth (GGBB). The bond bill included funding authorizations for a wide range of govern ment programs, including, but limited to water in frastructure programs addressing lead, water tank storage, sewer lines, and lead line removal. Of note, the Clean Water Trust would receive an additional $84 million of which not less than $20 million will be expended for a lead service line pipe replacement pilot program established within the same legisla tion. The grants to municipalities for the replace ment of lead service line pipes will be focused on environmental justice populations and to provide an adequate supply of safe drinking. • Wage Theft Legislation Not Passed. The Mas sachusetts legislature did not pass legislation re lated to wage theft before the end of formal ses sions. The legislation, which would have imposed vicarious liability to those contractors in privity with one another, as well as authorized work stoppages and third-party lawsuits, has garnered significant attention in recent legislative sessions. The legisla tion, which has been opposed by UCANE and other contractor organizations due to concerns about the impact of broadly applied legal principles and un intended consequences, will likely reappear in the next legislative session.
• July Revenue Collections Total $2.367 Billion. The Massachusetts Department of Revenue (DOR) Commissioner Geoffrey Snyder announced that preliminary revenue collections for July totaled $2.367 billion, $101 million or 4.5% more than the actual collections in July 2021. July 2022 revenue collections were impacted by the recently enacted elective pass-through entity (PTE) excise. After adjusting for PTE excise, July 2022 collections are $92 million or 4.1% above actual collections in July 2021. July is one of the smaller tax collection months because no quarterly estimated payments are due for most individuals and businesses. His torically, roughly 6.7% of annual revenue, on aver age, has been received during July. Final fiscal year 2022 collections of $41.105 billion were up $6.982 billion or 20.5 percent over actual collections in fis cal year 2021 and were $3.438 billion or 9.1 percent more than what was expected to be collected.

Will you please give us some infor mation on your background and tell us how you got started in the con struction business? I was raised in Arlington, MA where I still reside today with my husband Robert and our three children. After attending college at UMass Amherst, I began my first job at State Street Bank. I later concentrated on Marketing and Public Re lations at a couple of large firms in the Boston area. My father William Sr. started W. L. French back in 1972. Myself, my brother Billy, and sister Jessica all grew up around trucks and heavy equipment. You might say the family construction business was in our blood. In 2002 I began working full time at WLF. The timing was right because I was able to take the experience and knowl edge I’d gained outside of the family business, and bring some of that to the company.
I’ve been working at W. L. French now for about 20 years, and my title is Principal and Owner. I am engaged in strategic planning for the future with my partners, and I am active and involved in the day-to-day operations at my company. It is important to me that I am hands-on and always ac cessible to the business and to our employees. My role in the company also includes business devel opment, client relations, and overall relationship man agement. In addition, I work closely with our environ mental and soil management division to establish new business opportunities, automation, and forecasting.

Currently, I am working with the Massachusetts Soil Beneficial Reuse Coalition (MSBRC) to address lack of soil disposal capacity in our State and Region. The MSBRC is a group of industry peers that have recently joined together to address this issue and propose (short and long term) sustainable solutions to help mitigate it. This year our family established the French Family Foundation. I am excited to manage this foundation to support our veterans, industry trades development, and further our volunteerism in community affairs. The hope of this foundation is to have influence in the lives of veterans, our industry, and to continue positively im pacting the communities where we live and work.

Our Soil Management business has us hauling from Bos ton to New York and all throughout New England, operat ing up to 150 trucks daily. French now manages our own unlined landfill in Winchendon, MA and continues to manage two soil reclamation facilities out in Dudley, MA – Dudley Reclamation (along side UCANE member Rampco Construction) and The Fish Road Reclamation Facility. Supply chain issues continue into 2022, and more recently recordbreaking inflation has been a serious concern for the construction industry. Has W.L. French experienced these two problems, and how have you been able to mitigate their impacts to your business? We are still facing significant challenges due to supply chain issues; from parts needed to repair the equipment, to purchasing any and all pieces of equipment or trucks of any size. Record breaking inflation has caused substantial increases to the cost of materials used on our jobs, from pipe prod ucts to concrete, asphalt and curbing. With such a large equipment fleet and with so many trucks on the road every day, the doubling of diesel fuel prices in the past year has hit us hard. Add in the current soil disposal capacity issue previously mentioned, and you have “a perfect storm”. Getting through these tough economic times requires transparency and consistent communica tion between contractors, clients, subs, vendors, etc. Mitigating the impacts to our company requires a team mentality, which is what we have here at WLF. Much like COVID, we need to navigate these uncertainties together, because they affect us all, albeit differently. How long has your com pany been a UCANE mem ber, and why did you de cide to serve on the UCANE Board of Directors? Our company has worked with a lot of contractors over the years and many of them had good things to say about their af filia tion with UCANE. We had always found UCANE contractors to be professional and dependable and our company wanted to be part of that kind of a group. In 2018 we joined as members and UCANE has proven to be an exceptional resource for W. L. French. It has provided us the op portunity to expand and strengthen relationships with industry peers. Personally, it has been an honor for me to be on the Board of Directors and to be able to work alongside some of the very best in the construction business. The sharing of knowl edge and ideas while addressing industry is sues at Board meetings is impressive. “The Occupational Safety and Health Administration is calling on all employers engaged in trenching and excavation activities to act immediately to en sure that required protections are fully in place every single time their employees step down into or work near a trench,” said Assistant Secretary for Occupa tional Health and Safety Doug Parker. “In a matter of seconds, workers can be crushed and buried under thousands of pounds of soil and rocks in an unsafe trench. The alarming increase in the number of work ers needlessly dying and suffering serious injuries in trenching incidents must be stopped.”

Alarming rise in trench-related fatalities spurs US Department of Labor to announce enhanced nationwide enforcement, additional oversight 22 workers have perished in the first half of 2022, a 68 percent increase over all of 2021 WASHINGTON In 2022’s first six months, 22 workers have fallen victim to the deadly hazards pres ent in trenching and excavation work – surpassing 15 in all of 2021 – and prompting the U.S. Department of Labor’s Occupational Safety and Health Adminis tration to launch enhanced enforcement initiatives to protect workers from known industry hazards. To stress the dangers of disregarding federal workplace safety requirements for trenching and excavation work, OSHA enforcement staff will consider every available tool at the agency’s disposal. These actions will place additional emphasis on how agency officials evaluate penalties for trenching and excava tion related incidents, including criminal referrals for federal or state prosecution to hold employers and others accountable when their actions or inactions kill workers or put their lives at risk. In keeping with its National Emphasis Program for excavations, OSHA compliance of ficers will per form more than 1,000 trench inspections nationwide where they may stop by, and inspect, any excavation site during their daily duties.

On June 28, 2022, two workers, aged 20 and 39, suffered fatal injuries in Jarrell, Texas, when the unprotected trench more than 20 feet deep collapsed upon them as they worked. Trench shields, which could have saved their lives, sat unused beside the excavation. Trenching and excavation operations require protective systems and inspections before workers can enter. When employers fail to install trench pro tection systems or properly inspect the trench, work ers are exposed to serious hazards, including risk of being buried under thousands of pounds of soil. By some estimates, a cubic yard of soil can weigh as much as 3,000 pounds, equal to that of a compact car. States that operate their own Occupational Safe ty and Health plan have similar emphasis programs in place, and OSHA also encourages those states to consider additional measures, including criminal re ferrals for federal or state prosecution for trenchingrelatedTrenchingincidents.standards require protective systems on trenches deeper than 5 feet and soil and other materials kept at least 2 feet from the edge of a trench. Additionally, trenches must be inspected by a knowledgeable person, be free of standing water and atmospheric hazards and have a safe means of entering and exiting prior to allowing a worker to enter.“OSHA stands ready to assist any employer who needs help to comply with our trenching and excava tion requirements,” Parker added. “We will conduct outreach programs, including safety summits, in all of our 10 regions to help ensure any employer who wants assistance gets it. 2. As much as possible, avoid interrupting the normal flow of traffic through the work zone and in other areas near the work zone.
3. Guide traffic in a clear and positive manner as it approaches the work zone to avoid confusing the drivers, which can lead to incidents.
4. Inspect the work zone both during the day, and again at night, to make sure that the traffic control measures are effective in bright daylight conditions, as well as low light conditions.

5. Maintain all traffic control devices such as lights, barrels, cones, signs, and barriers so that they are clean, visible, and effective.
According to the Federal Department of Transportation (DOT) a “work zone is an area of a highway with construction, maintenance, or utility work activities. A work zone is typically marked by signs, channelizing devices, barriers, pavement markings, and/or work vehicles.” With more than 600 fatal work zone incidents occurring every year, designing and implementing safe and effective temporary traffic control for work zones does save lives. A temporary traffic control zone is an area of a roadway where the usual driving conditions are changed because of a work zone in the area. The main function of temporary traffic control is to provide for the safe and effective move ment of road users, including drivers, cyclists, and pedestrians, through or around the zones while also protecting workers and equipment in the work zone. Construction, maintenance, and utility work projects must plan for unexpected or unusual situations that their work will create for road users driving nearby.
L et’s review the purpose and main principles of designing temporary traffic control zones to ensure the safety of everyone, including road users and work zone personnel. Approach all ac tivities in work zones involving temporary traffic control by focusing on these seven fundamental principles:1.Develop a plan to make sure that motorists, bicyclists, pedestrians, and workers are safe while the work zone is in place.

Communicate with the public before, during, and after the work is performed to help ensure that their safety, as well as the safety of the work ers, is considered at all times.

The temporary traffic control implemented for work zones should be designed in such a way that minimizes disruption to usual traffic pat terns. General guidance suggests that drivers will only reduce their speeds if they clearly perceive a need to do so. For this reason, reducing the speed limit in the work zone should be avoided, if possible. By following the Manual on Uniform Traffic Con trol Devices (MUTCD) templates you are able to avoid abrupt changes to the usual flow of traffic, including lane narrowing, and dropped lanes, or rapid lane shifts. Drivers will not come across an unusual series of signs, or traffic control devices and will understand what is expected of them since they have seen them before. The protection of the public, motorists, and traffic driving by a jo bsite or wo rk zo ne is th e first priority wh en establishing temporary tr affic co ntrol. By communicating to drivers, the safe way to proceed through or around the work zone, a safer jobsite is created and serious hazards can be prevented. Before any detour is created, all necessary signs should be in place. Signs and devices should be used in a way that get the motorist’s attention and provide easy to understand di rection. When work is suspend ed, signs and devices must be covered or removed and when work is completed, they must be removed from the route. Workers on or near the roadway may face additional hazards if the zone is not adequately de signed for worker safety. An essential step of implementing temporary tr affic co ntrol zo nes is to create a barrier between motorists and the work zone to adequately protect workers.

National Specialty Contractor sets up branch in Putnam, CT ing. He worked as many hours a day as his employer would allow. After seven years Rod and his wife Karen took their experiences, some hard-earned money, and their growing family of seven kids, back to Michigan. In 1988 they estab lished Mersino Dewatering in Davison, Michigan, where they would specialize in construction dewatering. Starting as a small operation with only a handful of employees to call a crew, some of whom were family, the company soon established a reputation in the area for service and perfor mance when it came to dewatering construction sites. Over the next 10 years Mersino Dewatering saw steady and managed growth. Mersino’s dewatering op erations gradually expanded from deep wells to include wellpoint systems, sock-tile dewatering, vacuum educator systems, and water and sewer bypass pumping. By 1998, the company had set up six satellite of fices, had a staff of 50 employees, and was doing business in 20 states.
With pumps and pump performance being such a criti omponent of dewatering and bypass operations, Mersi no soon realized that they needed more control of pump availability, pump parts, and pump design. In 1997, Mersino integrated Global Pump into the business and they began manufacturing world class pumping equipment designed and built based on jobsite experiences and real-world needs. In addition to dewatering pumps, Global Pump de signs and produces pumps for the oil, gas, chemical, and petrochemical industries. In addition, Global Pump pro duces a wide range of heavy-duty, high-efficiency portable pumps, both diesel engine and electric motor driven. Pumps range from 4-inch to 24-inch that are capable of developing over 600 feet of head and flow capacities to 200,000 GPM.
Today Gino Mersino works out of the company’s headquarters in Auburn Hills, Michigan while overseeing 16 branch of fices and 36 0 employees. The following year the Director’s position became available and I once again figured I’d take a shot at it. I was selected for the position and in November of 2011 I was promoted to Director of Public Works! I think I might be the only Director of Public Works in Massachusetts with a Criminal Justice Degree. Please give us a brief description of Westwood regards make-up of the DPW, population, and infrastructure statistics?
I graduated from Northeastern University in 2001 with a degree in Criminal Justice. Upon graduat ing I was offered a seasonal position in the Westwood Public Works Department, and was later hired by the Highway Department. I thoroughly enjoyed the work and started to take note of the daily operations, how things were run, and really tried to gain an understand ing of how the Department functioned. At the same time, I became familiar with operating the equipment and obtained my Hoisting and CDL licenses. I continued my employment throughout the summer and into the fall/winter of 2001. It was at this point when a full-time position became available and I took advantage of the opportunity. I worked as a full-time heavy equipment operator at Westwood Public Works for nine years. In 2010, the former Highway Superin tendent retired and the position was posted. Looking at what I had learned over the past nine years, I fig ured I’d throw my hat in the ring and take a chance. I was promoted that October!
Will you please provide us with some insight into your background, educa tion, and history that led you into your current position?
The DPW Sewer Division operates and maintains 87 miles of sewers and 10 pumping stations, all of which discharge into the MWRA system for treatment at Deer Island. Almost all businesses are on the sewer system and about 75% of residences are as well. We send out about 5,000 sewer bills annually.
In 1986 the towns of Westwood and Dedham merged their water systems and created the Dedham and Westwood Water District, which is responsible for the water infrastructure in both towns. Water is gen erated from 14 deep wells to serve the needs of both towns. In 2005, the district also signed on and tied into to the MWRA water network allowing access to 200,000 gallons per day, if needed.

Westwood’s population is roughly 16,000, and the town covers an area of 11.1 square miles. A ma jority of the zoning is residential with about 80% of the 5,800 homes being single family. But we also have over 500 businesses and some very active commercial areas along Route 1 and in the University Station area. The DPW Highway Division maintains approximately 94 miles of town owned roadways, 30 miles of sidewalks, and an extensive drainage infrastructure. Snow removal is a combination of town vehicles and private contractors.

Westwood currently has a 5-year revolving Capital Plan to address all infrastructure, includ ing equipment and buildings. One of the DPW’s biggest/most pressing issues every year is the funding of our Pavement Management Pro gram. Bridging the gap between what Chapter 90 distributes annu ally and what the Town needs to maintain its current pavement rat ing of 85 is a constant challenge. How does your municipality normally fund infrastructure projects? Does the town utilize the SRF Loan Program through MassDEP for water or sewer infrastructure projects? We utilize a combination of funding mechanisms. We ap ply for State Grants/Programs and Chapter 90 for our road needs. For sewers we would typically look to ward MWRA assistance programs. Occasionally the town will issue road/ equipment bonds to assist with our fleet and pavement maintenance. Funds from the Federal Bi-Partisan Infrastructure Bill and the prior ARPA Bill are now available in Massachusetts at both state and local levels and earmarked for infrastructure. Does Westwood have some projects coming out to bid in 2022 or 2023 that will be utilizing these Federal Infrastructure funds? In a typical year, the Westwood DPW might advertise $3M-$5M in public bids for our infra structure repairs and/or upgrades. In the short term we are currently working with our consulting engi neers to access ARPA funds in order to move several projects forward in FY2023 that would create safer roads and improve congestion. In the longer term, with these once-in-a-generation Federal Funds available from the Infrastructure In vestment and Jobs Act, we are also working to as sess Westwood’s eligibility and to take advantage of these funds in order to get some long-standing projects off th sh at si gnificant savings to th e town. The DPW is also responsible for field maintenance at seven public schools, for cemetery operations and maintenance, for coordinating trash and recycling op erations, and for maintaining our own fleet of trucks and heavy equipment. Needless to say, the Westwood DPW is a very busy department. I’m fortunate to have a hard-working and experienced staff of 30 full-time employees that I can count on to get things done. What do you currently see as the most pressing infrastructure needs for the Town in the next few years, and is there a 5-year Asset Management Plan in place to address those needs?

First championed in 2017 by the National Utility Contrac tor’s Association (NUCA) in a partnership with OSHA, the annual event has seen participation growth each year. This year UCANE member United Rentals was the prime sponsor for the nationwide event. All construction work poses some degree of risk of accidental injury to workers, especially to those with insufficient safety training. Accidents in excava tion and trenching work can often be catastrophic due to the nature of the work. That is why training programs like the 2022 TSSD are so important.

Company Safety Of ficers and Foremen gathered their crews together for “Tool Box Talks,” power-point presentations, or hands-on demonstrations on how to stay alert and be safe when it comes to trenching operations. OSHA area of fices across the country of fered their assistance to local contractors during the week. In Massachusetts, Region 1 OSHA Compliance Spe cialists Peter Barletta and Joe Green offered their valuable services to the excavation industry. Twenty One UCANE contractors participated in this year’s TSSD. During TSSD Week they trained 2,667 construction workers at 318 jobsites across New Eng Albanese Brothers, Inc. land. Their efforts set a new UCANE record for total workers trained and once again established UCANE as the flagship of Contractor Associations across the country when it comes to trench safety training.
UCANE companies that participated in this safety program will receive a formal Certificate from OSHA, suitable for framing, commending their efforts and dedi cation to Trench Safety. In addition, participating em ployees will receive 2022 TSSD hard hat stickers.
Badger Daylighting’s Safety Manager, Adam Crandall, went all-out this year as Badger advanced themselves to the number one position as UCANE’s top trainer. Dorchester based Feeney Brothers Utility Services was a strong contender at the number two position. J. Derenzo Corp. (Brockton) and W.L. French Excavating Corp. round out the top 4.

UCANE's 42nd Annual Golf Outing was once again a full field as our members and guests were welcomed back to Sandy Burr Country Club in Wayland, MA on July 11, 2022. The skies were sunny and the course was in tip-top shape. It was the perfect combination for a great day of golf. The 18-hole course is a challenging par 72 with a 6,400-yard layout designed by legendary golf architect Donald Ross. This year represents the 99th year that Sandy Burr has welcomed amateurs and professionals alike to its beautiful fairways.

In addition to all the great prizes that could be won with a lucky shot, our golfers had the opportunity to meet former New England Patriots player Tully Ban ta-Cain. Tully was an outside Linebacker and Special Teams’ standout with New England from 2003-2006, and a two-time Super Bowl Champion. After spend ing 2007 and 2008 with the San Francisco 49ers, Tully was back with the Pats for the 2009 and 2010 seasons. Since retirement in 2012 Tully has pursued several business ventures while still keeping his hand in the sport he loves. Currently living in California, he was on the coaching staff last year with the 49ers. His current plans include a move back to New England later this summer and he has interviews scheduled for a potential football coaching position at several local colleges. Tully engaged in great conversation with our golfers who not only had an opportunity to challenge Tully's golfing skills, but got to take a group photo with him, as well. After 18 challenging but fun holes of golf, each foursome turned in their scorecard (best-ball match) and returned to the clubhouse lounge where they en joyed a cocktail and some laughs at the Social Hour sponsored by Ferguson Waterworks, HUB International, Liddell Brothers, Inc., and Pat DiCerboNorthwestern Mutual. At 3:30 p.m. it was time to go into the dining room where a first-class New England Lobster Clambake dinner was being served. Headlining the menu were two-pound steamed lobsters complete with clam chowder, garden salad, roasted potatoes, rolls, pulled pork, corn bread, and corn-on-the-cob. Sponsoring the feast was UCANE member E.J. Prescott, Inc. As the hungry golfers enjoyed their lobsters, UCANE Executive Director Jeff Mahoney announced the winners of the best ball format tournament and the closest-to-the-pin. The committee has three meetings remaining before it plans to present its final report to the Barn stable County Board of Regional Commissioners by the end of August. After reviewing the regional challenges outlined by the regional policy plan and regional economic strategy, the committee identified seven as high pri orities: housing, water quality, child care, early edu cation, infrastructure, climate change and economic stability.Narrowing these down further, the commit tee pinpointed wastewater and housing as the top two regional challenges affecting the county, said Mr. Niedzwiecki, who is also CEO of the Cape Cod Chamber of CivilyticsCommerce.Consulting of Watertown, which has been working with the committee throughout the pro cess, will present its comprehensive analysis next week on how the $6 trillion in total ARPA funds has been spent by federal and state governments as well as by counties and towns.

“This means we have lost 3,000 seasonal work ers, and that is not a temporary problem. It is not a COVID-19 problem that is going to be resolved at some point. It is a permanent issue, and it is related to the housing prices on the Cape,” he said.
The Cape’s affordable housing crisis has also “jumped off the page,” Mr. Niedzwiecki said.
“Prior to the pandemic, the median cost of a sin gle-family home on the Cape was $410,000. Now it is $660,000. It is starting to have a significant impact, especially on the workforce, and a really pronounced impact on the seasonal workforce,” he said.
Further analysis is needed to determine what could be done at a regional level to address these challenges, Mr. Niedzwiecki said.

Using J-1 student visas as an example of a sea sonal housing issue, Mr. Niedzwiecki said before the pandemic J-1 students made up 8,000 members of the county’s seasonal workers. Following the pan demic, numbers have not recovered and with recent requirements from sponsors for employers to supply housing, the number of J-1 students coming here for work is decreasing significantly.
