COSTA DEL SOL SET TO BE EUROPEAN WINNER IN 2020 MALAGA will receive the baton as European Capital of Sport on December 10 at a gala to be held in Brussels. Current holder Budapest will hand over the honours to the Costa del Sol city in the European Parliament, while before that on December 3 the Cervantes Theatre in Malaga will host another gala presented by actor Salva Reina celebrating the up coming year of sporting events. Just a few of the awards and recognition in store for the area.
January 31st 2020 may well see the UK leave the European Union, or it may not, but the uncertainty over future rights and status for British People living in Spain is driving many to register on the Padrón in local town halls, especially in Mijas.
Obviously whilst not increasing the number of potential buyers for local properties, these people are showing their future commitment to a life in Spain regardless of Britains future within the EU. This in itself is a great sign that British ex-patriots throughout Europe are going to succeed where their political elite have failed over the past 3 years by simply adapting to new rules and negotiating mutually beneficial living arrangements within their host country. Thankfully Spain is its own country
with only light adoption of the cross border EU regulations and thus has never really made it seamless to live here as other European countries have done so very little may change post Brexit. The Spanish Government has made a real effort to ensure that rights and status are protected for both British in Spain and the thousands of Spanish nationals living in the UK. Hopefully once the exit is completed we will stop having to advise whether Continental Quilts will still function post Brexit.

The liveliest neighbourhood in town If you want to know the true idiosyncrasy of Torremolinos, La Carihuela is the ideal place – an old seafaring neighbourhood to the west, specifically in the south-west of the town. A pleasant and relaxing experience next to the sea. The inhabitants of La Carihuela originally lived off the fruits of the sea: the tasty fish and shellfish offered by the Mediterranean at this extreme of Malaga Bay. However, the growth in tourism from the 1950s onwards opened new possibilities, chiefly with restaurants and chiringuitos (beach restaurants) where locals and tourists enjoy the fishing catch. Today the area has been modernised but it retains a large part of its original essence, with traditional shops and narrow lanes evocative of the traditional street layout so typical of Andalusia.
The beach of Playamar In the urban municipality of Torremolinos, is 18 km from the city center, and is located between Los Alamos beach and Bajondillo beach. The also called Retiro beach, is dark sand and moderate waves, and has an area of ? 1,000 meters in length and 50 meters in average width. This beach is ideal for water sports such as windsurfing, sailing or scuba diving. We can also play volleyball in the nets that are installed in the arena. In summer season we can find kiosks, hammock rental services and nautical equipment such as pedal boats. In addition, in the hot months we can enjoy the shows that are organized there. The beaches of Torremolinos stand out for their animation during the day and night, this is what happens thanks to its beach clubs.

It is a residential area with its own local train station, Montemar Alto. Parque de La Batería (Battery Park) is great for the family. There are several bus stops serving the large part of the resident population concentrated here. On Thursdays there is a very popular street market, and it is an area with typical shops and long-established bars. There is a fountain bringing water from the springs and which people use for their water supplies. In short, a neighbourhood which preserves the essence of the village that was Torremolinos.

It was originally named Ben-Al-Madina by the Arabs, which when translated means "children of the mines". This was because ochre and iron ore were once mined locally. Today, the Pueblo has become a beautiful village of whitewashed houses, adorned by brightly coloured flowers. The municipality of Benalmadena, which includes Arroyo de la Miel, Benalmadena Costa and Torremuelle, is governed by the town hall in the Pueblo. There are many places of interest in and around the Pueblo. Plaza Espana in the centre of the village, is a typical Andalucian square. This is where you will find a fountain with a statue of La Nina, who has become the symbol of Benalmadena. Around the perimeter of the square there are some lovely restaurants surrounded by orange trees.

One of the most popular neighbourhoods in town The most lasting heritage in Los Boliches is the tradition of the fishing folk who have lived there through the generations. Still today, fishermen catch wonderful fresh fish which is served in the typical beach bars and restaurants. Between the main street and the sea there are lovely little narrow streets buzzing with the lively Andalucian atmosphere and with wonderful local seafood and fresh fish dishes to choose from. Although very much a popular beach resort area, Los Boliches also has a reassuring sense of permanence. It is home to well integrated year round residents – Spanish and foreign alike – many of whom originally came at one time for a holiday and could find no reason to leave. As well as some of the best bars and restaurants to choose from, Los Boliches also boasts some of the finest beaches in Fuengirola. The beach of Carvajal Carvajal is Fuengirola's most easterly district which overlaps into Benalmadena. It is mostly known for the Carvajal beach and public promenade which runs the entire length of the district. Carvajal is really a narrow strip of coastline strip of coastline where the steep hills come down to the coast. It is essentially on the sea side of the railway line and mostly on the sea side of the coast road. The road used to be the very busy main N-340 coast road before the motorway was completed in the early 1990's. Nowadays the traffic is local traffic and planter area and roundabouts have be added. Whereas Torreblanca next door has been developed on the hillside above the railway line, Carvajal has remained largely reminiscent of the Spanish fishing village it always has been with many lively bars, restaurants and hotels bringing the area into modern times. Fuengirola Port & Sporting Marina Fuengirola port is a hive of activity all year round and it offers a full range of facilities to the public. It is also a very popular area for outdoor café culture and has excellent terrace restaurants incorporating bars offering an interesting night life. The port is located mid way along Fuengirola promenade just down from Fuengirola Bus and Train station. The other side of the port is a sports and leisure marina, with over 225 berths (lengths ranging from eight to 20 metres). The facilities are all you would expect from a 21st century marina, with all modern conveniences at each berth. On dry dock there is a crane facility on hand for boats up to 6 tonnes and a lift service for those up to 35 tonnes.From the busy, modern marina area there are many companies offering pleasure trips, boat charters, fishing trips (including excellent tuna fishing), speed boat hire and Dolphin watching trips.

Las Lagunas ( The Lagoons) There are some residents, mostly foreign, that after having lived in the area for decades still cannot tell you where Fuengirola starts and Las Lagunas ends, On the one hand, who really cares as both are amazing, and on the other the advantage is being so close to all the action and facilities but enjoying almost total peace and a more normal Spanish village life. It is a rare and wonderful combination. House prices are cheap considering the distance to the beach and the balance between new developments and much more traditional property is almost unique and idyllic. Returns for pure investment are less than the seafront of Fuengirola and other Mijas villages but as a place to live - it has everything you could want - in whatever situation you find yourself From Fuengirola to Marbella and so much more ... Mijas Costa is a 12 kilometre coastal stretch of modern (post 1960) tourist orientated development including the popular La Cala de Mijas (Mijas cove) and Sitio de Calahonda (a large residential estate) within the municipal district of Mijas. Mijas Costa is located between Fuengirola and Marbella, being at least 10km away from the village of Mijas and having to pass through Fuengirola to get between one and another leads to some confusion. Tourists who are not intersted in municipal affairs see Mijas Pueblo and the districts of Mijas Costa as different places. Mijas municipal district is comprised of three very different areas, Mijas Pueblo (the village), Mijas Costa (the coastal strip) and Las Lagunas (a modern residential and comercial area). LEGAL ADVICE COLUMN Spanish Residency Increased interest in obtaining Spanish nationality since referendum result A growing number of British residents on the Costa del Sol want to prepare for Spanish Nationality Parnell Academy is running a course designed specifically for those who want to pass the test of Spanish nationality, supported by the growing association “Brexpats in Spain”. Since the outcome of the referendum, whether or not to obtain Spanish nationality has been one of the key questions formulated by British residents on the Costa del Sol, one of the largest British communities in Spain. The interest generated in obtaining Spanish nationality has led to this pioneering academy to offer a specially designed course in this area. In the centre of La Cala de Mijas, one of the three towns of this municipality of 84,000 inhabitants where the largest number of foreign residents on the Costa del Sol (10,000 are British) is located Parnell Academy. Richard Parnell, one of the founders with his daughter Natasha and Anne Hernandez, 63, president of Brexpats in Spain, an association which now has 1,900 members and hopes to extend to other European countries, including France, which have shown interest in the initiative. Brexpats was established in 2017, and the group membership quickly spread throughout Spain to Barcelona, Mallorca and Alicante. This type of specific course to pass the exam to obtain Spanish nationality has no precedent in Spain. The Brexit effect has led to an intense and growing demand on the Costa del Sol in those interested in learning the necessary steps to obtain Spanish nationality. Parnell predicts that an average profile, is British about 60 years old with residence in Mijas, Fuengirola and Marbella, without having any prior knowledge of speaking Spanish To meet this objective, the student should devote two hours a week for classes, plus another extra lesson in Spanish culture with knowledge of geography, history and politics. "Of course, also you have to study at home and find ways to relate to the Spanish," one of the great problems of the Brits, according to the founder of the academy is that at developments such as Riviera del Sol and Calahonda the British can run smoothly in their everyday life without speaking a single syllable of Spanish. The monthly price of the academy is around 50 euros. There is also the possibility of having private lessons at 20 euros per hour. The learning method is based on modules. The beginner level lasts nine months and then progresses through the next levels "We not only want them to converse in Spanish, but that they know how to write well. It is essential that the British integrate in all ways. We must seek to interact with local people, "Parnell says. The academy also offers English classes for Spanish people and has capacity to accommodate over 120 students one morning. One of the motivating factors to seek Spanish nationality is the concern over health cover. British pensioners use Social Security, but when the UK no longer belongs to Europe, everything will be more complicated. Medical insurers will not accept older people and a very small percentage of the population will be able to afford the expenditure of paying privately hundred percent. The Association has been holding meetings and presentations aimed at discussing the implications of Brexit. The result was a surprise for everyone. We know almost nothing and there is no turning back. We must respect the decision of the referendum, "said Hernandez. The agreements for and against Brexit are heated, but one fact that cannot be argued against is that the real losers will be the retired British ex-pat living in Spain without residency as health insurance will be expensive, often prohibitively and may force many to return to the UK as age hits us all and insurance costs grow.

More EU countries guarantee British expats post-Brexit grace periods To hear the Brexiteers tell it, countries in the European Union have no autonomy. All decisions are made by the Little Dictators in Brussels. If only that were true, then we wouldn’t have 27 countries plus Switzerland and Scandinavia scrambling to figure out what to do with their British expats. As the United Kingdom moves inexorably toward a no-deal Brexit, an increasing number of countries across the European Union are assuring British expats that life will go on as normal. Well, at least for a few months. But concerns about their citizens in the UK have countries from Portugal to Poland making clear they’ll allow Brits to stay only if there is reciprocity and their citizens get settled status in Britain. For example, Spanish authorities are saying British expats will have the same rights in Spain post-Brexit as long as the UK extends residency rights to Spaniards already living in the UK. This comes after the European Commission asked – but decided not to order – member states to grant temporary residence permits to British nationals so they’ll have time to apply for long-term residency status. Germany and Italy already notified their British expats at the end of 2018. If you’re an American in the Netherlands, for example, you’re registered with the local government and have specific rights under the Dutch American Friendship Treat. But a no-deal Brexit would push British citizens into a neither-nor purgatory where they would have neither EU citizenship status nor a separate post-Brexit immigration status. And in some countries such as France and Spain, Brits never have had to register as permanent residents, which introduces another layer of anxiety. Until they get their long-term residence status as third-country nationals, they’ll won’t be able to leave their host country, then return as anything but tourists. What a lot of people – especially British politicians – don’t seem to understand is that no-deal means no transition time to implement new treaties.No-deal would not be the end of negotations, it would the beginning of another round of more,– and more intense – negotations to repair all the ruptures caused by Brexit So while British expats will be able to remain where they are living in Italy, the Netherlands and other countries, they will lose the right to move – or even travel unless they have long-term residence permits – within the Schengen Area until the UK can draw up separate reciprocal long-stay residence agreements. Bottom line: Wherever they are living now, British citizens should apply for a long-term residence permit sooner rather than later. Because they can take awhile to get and unless they have one, it may be harder for them to reenter their country of residence should they, say, return to the United Kingdom for a visit. Brits have till 31 December 2020 to apply for a foreigner identity card. Did you hear that huge sigh of relief on 1 March? That was the sound of 300,000-plus expats getting word Spanish officials have finally come out with a definitive no-Brexit policy: Everyone gets to stay in Spain, the EU country that’s home to the most British citizens. Spain’s cabinet approved legislation for an estimated 400,000 Brits living in Spain remain in place if the UK leaves the EU without a deal. And under a reciprocity agreement, 150,000 Spanish citizens would remain in the UK. Spanish Prime Minister Pedro Sanchez said in December that Brexit won’t change the status of British citizens in Spain, as long as the UK extends reciprocity to his citizens. Under the plan, Britons living in Spain will have to apply for a foreigner identity card before 31 December 2020 to prove their legal residency status. The process would be “nearly automatic” for those UK nationals who already have permanent residency, according to media reports. Now, here’s the tricky part: If there’s a no-deal Brexit, a Spanish contingency regulation provides a 21-month period starting from the withdrawal date (whenever that is) for the British nationals and family members to switch to third-country residence permits from EU rules. There are a few uncertainties because the actual number of Brits in Spain is closer to 1 million, many of whom have homes there where they live only part of the year. That said, Brits in Spain hold a strong hand, injecting about 1.32 billion euros each year just into the economy of Alicante, where more than 25 percent of them live, according to Forbes. Also, don’t forget that Spain is one of the Golden Visa countries. The New York Times has new post about how you can buy a house in Spain and get a passport in the bargain. NEW YORK TIMES ARTICLE When Natalia Yavorska and her husband first considered buying a holiday retreat somewhere warmer than their Ukrainian homeland, they were drawn to the Canary Islands. A vacation to the Spanish archipelago in 2012 left them eyeing land on the southwest coast of the island of Tenerife, and while the initial attractions were the golf courses and ocean views, the deal was sealed by a special extra that came with their purchase. “The fact that we could get a Spanish residence visa from buying real estate was very important, and that made it an easy decision,” said Ms. Yavorska, a 60-year-old former banker from a town near Kiev. That “golden visa” carried the right to eventually apply for a Spanish, and therefore European Union, passport, the kind of bonus that is luring a growing number of investors to high-end real estate. Once seen as a slightly shady practice, the business of dangling visas and citizenship in front of wealthy investors has become a more common, and in some cases hugely successful, marketing strategy. Ms. Yavorska and her husband, Alexander Yavorski, who own a pharmaceutical import business in Ukraine, were worried about political stability at home and saw the right to live in the European Union as “a type of insurance.”“Something can always happen between Russia and Ukraine, so if you have the chance to have a visa or a second passport sitting in your drawer, you would be stupid not to take it,” she said. So far, at least 14 countries have programs that offer visas or passports to foreigners who buy real estate, according to research by Henley & Partners, a British-based law firm that specializes in helping people looking such programs, and Montenegro will soon become the 15th, and the British overseas territory of Anguilla is planning to follow suit. Many more countries, including the United States and 20 of the 28 European Union members, are offering residence visas, which can often lead to passports, to foreigners willing to invest in non-property business ventures. These countries believe the investments will bolster their economies. Other countries, led by small Caribbean island nations and Vanuatu, in the South Pacific, are happy to simply sell a passport for as little as $100,000. Analysts say that offers of passports and residency have become a big business, attracting an estimated $20 billion a year in investment.That approach is transforming the upper end of real estate markets and reshaping the finances of some of the smaller countries, pumping billions of dollars into economies that are desperate for the funds. At the same time, the practice is raising fears in the European Parliament and the Organization for Economic Cooperation and Development, which works to promote economic growth worldwide. They worry that the programs could assist money laundering, tax evasion and the free movement of criminals and terrorists, as well as allow wealthy Russians, Iranians and Syrians to skirt economic sanctions. There are eight countries — five small Caribbean states, Turkey and, in the European Union, Cyprus and Malta — that will hand over passports to property buyers, who are generally required to spend little, if any, time within their borders. In December, Brazil joined Dubai, which is part of the United Arab Emirates, and six European nations — Cyprus, Greece, Latvia, Malta, Portugal and Spain — in extending residence visas to property buyers, although the rules vary greatly for converting those visas into passports. Portugal requires a waiting period of five years, during which the applicant needs to spend just one week a year in the country. Spain and Latvia insist on a 10-year wait. The Latvians and Greeks require difficult language tests and several years of actually living in the country, and the Latvians insist that applicants learn the national anthem. Dubai almost never grants United Arab Emirates citizenship to foreigners.The picky passport shopper needs to consider price, each country’s tax system and the speed of its bureaucracy: Dominica is the fastest to hand over a passport, and Turkey the slowest among nations that go straight to a passport. Passport shoppers also need to consider how much time a nation requires them to spend within its borders, and how many other countries will grant them visa-free access with their new passports. Grenada, for instance, offers passports that have visa-free access to both China and Russia. Wealthy Chinese are by far the biggest buyers of both visas and passports, followed by Russians, experts say. There is also growing interest among French citizens eager to avoid high income taxes and Britons desperate to maintain their European Union membership when or if their country leaves the bloc. “I think there will be a huge amount of activity once we know what is actually happening with Brexit,” said Penny Mosgrove, the chief executive of the upmarket real estate agency Quintessentially Estates. Americans are interested, too. In the five years to April 2018, 4,327 United States citizens received golden visas in Spain alone.

For those buying or selling in Spain, transaction costs are moderate, at around 10-15% of the property value. For those considering a shorter stay, renting could be a more suitable option if you factor in Spain’s high levels of capital gains tax, which could offset any benefits of buying in the short-term. Are foreigners allowed to buy property in Spain? Yes. There are no restrictions on buying property in Spain, whether it’s commercial, residential or land. In fact, Spain encourages investment by foreigners, both resident and non-resident. You will require a financial number which can acquire by visiting a police station with your passport. This is no longer a one day job and can take weeks to get an appointment just to present documents to the Policia. Allow 6 weeks or pay your lawyer to do it on your behalf. Buy a property, get a visa Spain currently offers a ‘golden visa’ program for property owners. This is a form of investor’s visa. If you invest more than €500,000 in Spanish property, buying one or more properties, you will normally then be automatically eligible for a residency visa. This is not a work permit, but it will allow you to live in the country. It’s primarily aimed at retired people and holiday home buyers. Buying a home in Spain: The Search As it is easy for foreigners to buy property in Spain, there are websites and estate agents catering to almost every language and nationality. Many British real estate websites also list Spanish properties, with some online portals listing thousands of options. However, many of these focus on holiday homes, so you may prefer to use a Spanish site, such as the ones listed below. As you don’t need to be resident to purchase a property, it is possible to buy a home before you arrive and move in directly. However, this naturally comes with certain risks and we strongly recommend that you view the property you are considering and don’t cut corners on the process, even if this means spending some weeks in a hotel when you arrive.
Advantages / disadvantages of using an agent As estate agents are typically paid by the seller, there’s a strong advantage to using them for buyers. Estate agents can often provide detailed information about the region or city you’re considering, and many are bilingual and accustomed to dealing with overseas buyers. However, regulation is relatively low and unscrupulous estate agents do exist, so be wary of anyone who asks for payments upfront or suggests cutting corners. Always remember that you can choose your own notary, mortgage provider and so forth – you do not need to use a service suggested by the agent. Illegal properties For a long time, Spain has been popular with overseas buyers looking for holiday homes. On occasion, the large numbers of inexperienced foreign buyers have provided an opportunity for unscrupulous developers and estate agents to sell properties which are not legitimate. In some cases, planning permission has not been acquired before building, and properties are eventually torn down by the local government. In others, the quality of the property has not been up to scratch or as indicated, resulting in costly repairs. The British Foreign Office has issued notices warning expat buyers to be cautious and not take unnecessary risks. They recommend, at minimum checking: The credentials of any lawyers or estate agents used; the land registry (Registro de la Propriedad); that appropriate planning permission has been obtained; No outstanding debts attached to the property, such as a mortgage; structurally sound (surveyor /rchitect can do this). Most of this information can be provided by the land registry and accessed by making a request by email, phone, fax or in person. You can find the appropriate land registry office by vising the national website: www.registradores.org (Spanish only). Buying off plan or a new-build home The worst property scams in Spain, as elsewhere, have involved properties bought before they were completed or, sometimes, even started. While malicious intent is rare, caution is advised when buying a property which does not yet exist. At minimum you should: Check the company exists and is officially registered; check online at www.registradores.org (Spanish only). Ensure that the project is registered with the land registry. Check that planning permission has been granted by enquiring at the local city hall. Never sign a contract you don’t understand. Ensure that any translation is done by an independent party. Demand proof that any sums paid (e.g. a deposit) are being held or spent appropriately. Get proof that you’ll get a refund of your money if the property is not built. As a non-resident, you may also buy land and have a property built yourself. In this case, good legal advice is even more important as you will need to ensure that contracts with builders are appropriate and watertight. Debts transfer with property In Spain, any mortgage or debt tied to a property is transferred to the new owner when the property is sold. It’s thus critically important to ensure that there are no debts attached to the property when it is sold, or that if there are, they are covered by the terms of the contract. Debts may include: Mortgage; Payments due to Community associations; Property tax (impuesto sobre bienes inmuebles). Buying a Spanish property The process of buying a property in Spain usually runs as follows. First, the buyer makes an offer, usually through the seller’s estate agent. If this is accepted, then the buyer and seller sign a preliminary contract (contrato privado de compravento) and the buyer pays a deposit, typically 10% of the purchase price. (Do not pay a temporary holding deposit unless you are going to buy the property as you cannot get those funds back unless there is a legal reason not not complete the purchase) The buyer then arranges any mortgage they require, although they should have already discussed their needs with the mortgage provider. The contract of sale (escritura de compravento) is usually signed in

Legal requirements The services of a notary are not legally required to complete the sale, but it is advisable and required by many mortgages. The seller is responsible for hidden defects in the property, even if they are not aware of them. However, in practice gaining restitution for such defects can be difficult and costly. Paying the costs and taxes associated with buying a home can be completed by the buyer or their agent. It is the buyer’s responsibility, however, to ensure taxes are paid. The buyer is also responsible for registering the property. The notary may provide this service for a fee, and/or may notify the registry office that the sale has taken place, without completing full registration. Funding purchase: deposits and mortgages Following the 2008 crash, Spanish banks were reformed with significant IMF involvement. This reduced the number of lenders in operation, and significantly increased the regulation and oversight of the industry. As a result, many banks began to lend less and mortgage rates and terms became less favourable. Mortgage lenders will not complete on a mortgage agreement until you own a property. For this reason, it’s important to include a clause in the contract allowing you to exit the agreement if you cannot acquire a mortgage. Fees and charges Costs are primarily paid by the buyer, and vary from region to region. Many are negotiable – there are no fixed fees for lawyers or estate agents. Costs paid by the buyer include: Property transfer tax 6–10% (existing properties) / VAT (or IVA) at 10% (new properties); Notary costs, title deed tax and land registration fee 1–2.5%; Legal fees 1–2% (including VAT). The estate agent’s fees are usually paid by the seller, and this is typically their only cost. Estate agents usually charge a percentage, typically around 3% of the final sale price. Capital gains tax Capital gains tax is paid on the profit of selling your home, i.e. the difference between the listed purchase price and the listed sale price, and the level in Spain currently varies between 19% & 23% First €6,000 – 19% €6,000 – €50,000 – 21% €50,000+ – 23% Thus if you pay €200,000 for a property and sell it for €350,000 you will pay capital gains tax on €150,000. Due to the tiered system this would add up to €33,260 euros. You may be able to claim a reduction on the capital gains tax to account for inflation; or if you are purchasing another property in Spain; or if you are over 65 and have lived in the property as your main residence for more than three years. Otherwise, unlike in other countries, capital gains tax applies no matter how long you’ve lived in the property. Your residential status does not affect the application of capital gains tax either, as capital gains tax should be paid in Spain for property owned in Spain even if you are no longer a resident. Choosing a reliable lawyer Any lawyer practising in Spain should be registered with the local bar association (Colegio de Abogados). They will have a registration number that you can ask for and then verify with the bar association. Naturally, registration does not guarantee honesty or competence, but it is a good minimum standard to insist on. You can find a list of all the bar associations at the national website for Spanish lawyers, Abogacía Española. Finding a translator Many governments provide lists of lawyers and translators who speak both Spanish and another language. The British Embassy’s list of English speaking lawyers and translators is a useful resource.

Should I use an agent / broker? There are no restrictions on foreign buyers purchasing property in Spain, but it’s important to be aware of the specifics of Spanish mortgages before buying your own property. Here, we explain the main things you should consider before applying for a mortgage in Spain. Should you buy property in Spain? In the last couple of years, the property market in Spain has finally picked up after a long slump following the financial crash. In November 2018, house prices increased by 5.6%, and it’s been predicted that the market will remain buoyant in 2019 through to 2020, but there may be a slight stagnation in the middle of 2020. Spanish mortgage lenders offer an array of mortgage products specifically designed for foreign and expat
on the mortgage type. The good news is that it may be possible to borrow significantly more of the property’s value – up to 100% in some cases – when buying a bank’s repossessed property in Spain. Some banks might only be willing to provide a mortgage to foreign buyers for their own listings. In this case, your options for getting a mortgage may be tied to a particular property. In some cases, the mortgage you get may be based on the bank assessor’s valuation of the property rather than the price you’re paying for it. Thus, if an assessor valued your property at €125,000, you could traditionally borrow up to €87,500, even if your purchase price was only €100,000. Spanish mortgage calculators Most Spanish mortgages are variable rates linked to the yearly Euribor (European inter-bank offered rate) plus a margin. For example, with Euribor at -0.37% at the start of 2019, and variable-rate mortgage rates ranging from 1.8–3%, you could theoretically pay just 1.43%. Many lenders also offer fixed-rate mortgages, which range from 2.4–3%, depending on the loan term.
Cost of getting a Spanish mortgage If using a Spanish mortgage lender, you should allow up to 10-15% of the total purchase amount for various transaction costs. Thus, if your property is valued at €120,000 and you can borrow 70% of this amount, you will need to have a €36,000 down payment plus up to €1,760 in savings. Typical closing costs include transfer and stamp taxes (explained below), the bank’s arrangement fee and opening fee, a notary fee and registry fee, and a bank assessor’s fee. Property transfers in Spain are done through public deeds of purchase, which must be certified by a notary. Before applying for a Spanish mortgage Before applying for a Spanish mortgage, you will need a Número de Identificación de Extranjeros (NIE) – an identification number for foreigners. This number is similar to a US Social Security number or a British National Insurance number. You cannot purchase property or get a mortgage in Spain without an NIE. If you’re in Spain, you can start the NIE application process at any local police station. Outside of Spain, the best way to apply for an NIE is to contact your local Spanish consulate. When applying for an NIE, you will need the following documents: A completed EX-15 form Supporting document(s) to show why you need an NIE Copy of your passport pages and original passport Two passport-sized photos €9–€12 fee to submit tax form 790 How to apply for Spanish mortgages
Most of the larger Spanish banks offer mortgages to non-residents, most notably Banco Santander Central Hispano, Banco Bilbao Vizcaya Argentaria (BBVA) and CaixaBank. You can also secure a mortgage through an international bank such as Chase or IMS. When applying for a mortgage for Spanish property, the best advice is to start early and shop around. While the official mortgage process can only start after a sales agreement has been reached, it is both possible and advisable to start developing your mortgage concurrent with your real estate shopping. There are many financial products available for nonresidents, and the terms of any specific product may place limits on which properties you can qualify to purchase. Documents to apply for a Spanish mortgage Whether you go through a Spanish or an international mortgage lender, you will need – at a minimum – the following items: ? NIE number ? Proof of employment or income ? A pre-agreement with the seller ? Proof that the property tax is paid to date ? Details of your current debts and mortgages ? Copies of ALL your existing property deeds ? Records of your current assets ? Any prenuptial agreements (if applicable).

The large developments in towns such as Estepona, Fuengirola and Mijas are, in part, pushed by “the braking” of new projects in Marbella, after the suspension of the General Urban Development Plan (PGOU) by the Supreme Court. Who or who leads the projects? They are driven by myriad promoters and foreign funds, also by local companies with their own funds or associated with other investors. The Costa del Sol is attractive to many different investors due to infrastructure, communications and renewed stability in recent years as the local and regional authorities have battled to put the management and legal problems behind them. Banks are once again supporting development, albeit prudently, with more liquidity for promotors and also funds for purchasers to facilitate completions. For the first time in seven years financial institutions are open to financing promotions provided that the land is owned by the promoter and there is a good volume of pre-sales. Many international clients have become very interested in buying on the Costa del Sol, especially from northern and eastern Europe, reducing the reliance on buyers from the UK and Spain. The Scandinavians (Swedes, Finns and Norwegians) have taken the lead and are leading the purchases of houses on the coast of Malaga, and they are interested in both new construction and resales thus feeding investment to both ends of the spectrum which can only be good for agents and vendors by adding to the urgency for all purchasers to commit to the investment decision through Fear Of Missing Out (FOMO).
And it is estimated that, in the short term, the good figures will continue throughout 2019 and 2020 with “sustained growth”. This is how forceful the experts’ forecast is, but we are going to break down all the details of this statement; some aspects will have to be taken into account. More than 200 new construction projects on the Costa del Sol and around 11,000 new homes for sale shows real confidence in the growth of our Real Estate market in the aftermath of the devastating global crash in both property and financial markets. Malaga, Marbella, Fuengirola, Mijas, Estepona and Benalmádena lead the way in number of recently completed transactions throughout the Andalusian coast. This confidence is also reflected in the large number of residential projects that are being developed in the Malaga coastal market which will be delivered in the coming years, bringing both jobs and investment to the whole area. They are also reactivating works that had been paralyzed after the crisis, as is the case of a promotion of 150 homes in Mijas and another 80 in Fuengirola.
