POST BREXIT LIVING IN SPAIN FOR BRITISH EX PATS - EASY ??

it may well be that there are few implications and the British continue to live, work, run businesses or retire in Spain, just as they have done for decades – long before the European Union was even thought of. There are, after all, hundreds of thousands of British people already living in Spain, and thousands of Spanish people living in the UK and very few governments want to make life harder for their own citizens. There is, however, uncertainty about the future for anyone considering such a life-changing project as moving to Spain or buying a home here, regardless of the reality that the very worst scenario is that British Ex Pats will be treated in the same way Americans or Australians are treated by the Spanish system. Most of the fear has been caused by the level of political dishonesty and irresponsible media coverage over 3 years since the UK referendum. Whilst Britain want to remain the best of friends, with Spain, as they have been for so long, the EU do not want the UK to leave for fear of an exodus by at least 4 other European countries and the collapse of the Euro currency, so there is still uncertainty about how this farce will turn out. We hope to help you plot your way through a possible post-Brexit scenario, to ensure you are confident in fulfilling that dream of creating the wonderful lifestyle so many Brits have enjoyed before you. For anyone spending less than about half the year in Spain, Brexit should make little or no difference. No visa will be required and your normal travel insurance will cover healthcare. For those planning to spend longer, while Brexit will undoubtedly add to the paperwork, there are many ways for the non-EU citizens to enjoy living permanently in Spain. Many Americans, Australians, New Zealanders and Africans live here today. Some are not working but live on investment or retirement income from abroad others are working for local companies or run their own companies, working freelance, or running tourist businesses. Will the British have a special status, or will we have the same rules as the other non-EU nations? We don’t know, so in a most extreme scenario, the British will have no more & NO LESS right to live and work in Spain than the citizens of any other non-EU country, such as the USA or Australia. We don’t believe Brexit will be as “hard” as this, but if you can work within these rules to live in Spain, when negotiations are complete and we know the reality it will probably be even easier to live there. These then, are the rules for non-EU nationals such as Australians and Americans when it comes to the key matters of visas, property ownership and healthcare. VISAS & PROPERTY How long can I stay without getting a visa? Spain is within the “Schengen Area”, a group of the 26 European countries that allows free movement between each other. Non-EU passport holders from a list of around 60 countries can stay in the Schengen area, including Spain, for up to 90 days within a 180 day period without getting a visa. The countries on include countries like the USA, Australia,

Japan, Monaco and Hong Kong, and it is likely that British people would have these rights too, as an absolute minimum. The 90 days in each 180 can be spread over as many visits as you like, allowing you to spend nearly half the year in Spain if divided up throughout the year. Each country within the Schengen area imposes the broad set of rules but with important technical differences, for example how the 90 days per 180 may be divided throughout the year & where you can spend the rest of your time. Can I live in Spain without a visa if I don’t work or buy a property? If you are staying for more than 90 days in any 180 days you will need to obtain a visa. The most common type is a long stay visa (visado nacional). There are three types of visa for staying in Spain: • Residence: This visa allows the holder to live in Spain without working or performing any professional activities. • Work and residence: This visa allows the holder to work while living in Spain. • Student: This visa allows the holder to live in Spain while studying, researching or participating in an internship New fast-track visa (Golden Visa) This is for non-EU investors, entrepreneurs, highly qualified professionals and researchers who Spain wishes to tempt to the country by offering them preferential treatment, such as automatic residence for the whole family with no minimum stay, and free travel throughout the Schengen visa region. There are conditions to fulfil for each category of the visado nacional, for example, investors could spend at least €500,000 on a Spanish property (the so-called “golden visa”). You will need to present to the immigration authorities paperwork such as: • Proof that your main place of residence remains outside Spain (for example, a bank statement) • Certificate showing you have no criminal record • Medical certificate showing you don’t have a communicable disease • Medical insurance with a minimum coverage of US$50,000 for emergencies and repatriation • Marriage certificate & birth certificates for children. • Enrolment in a school for the children. • Proof of accommodation in Spain • Processing fee of around €100. Restriction on foreigners buying a residential property in Spain? There is no restriction on you buying a home in Spain and there are no limits on where. You are still perfectly entitled to use your home for up to 90 days in any 180 and are free to rent it out, subject to local Spanish rental laws which vary from region to region. What sort of employment visas does Spain offer and how do I get one? The employer draws up a work contract, which goes to the Spanish Ministry of Labour and if approved by them, goes to the Immigration department which instructs the consulate to issue the visa. If the applicant wishes to bring a family to Spain he or she must follow the procedure for an “accompanying family member” at the same time European Blue Card: Intended to be the European equivalent of the USA’s Green Card, the Blue Card is an EU-wide work permit that allows highly-skilled people to work in the EU. Germany has issued 35,000 Blue Cards so far, while Spain lags behind.

Could I take Spanish citizenship? There are two routes to Spanish citizenship: Naturalisation – you need to have lived in Spain for ten years continuously to be eligible, have integrated into Spanish life, including speaking Spanish. If you can prove you have been an asset to Spain it should help your application. A one-year residence period is sufficient for someone born in Spain or born outside Spain with a Spanish mother or father, or anyone married to a Spanish citizen (even if the marriage has been dissolved). In all cases, the period of residence in Spain must have been immediately before the application. Marriage to a Spanish citizen doesn’t entitle you to a work permit, although an application for one is usually granted and expedited. To apply for Spanish nationality you require your birth certificate, marriage certificate (if applicable), and your parents’ birth and marriage certificates, all of which must be officially translated into Spanish. You also require a certificate of good conduct from the police, a statement from two Spanish citizens supporting your application, and you must show that you’re a good citizen and integrated into Spanish society. Most people find it necessary to employ a lawyer to handle the paperwork involved. Marriage: You need to have been married to a Spanish person for one year and have been living in Spain for one year. You also need to have a good knowledge of Spanish. Could I stay in Spain as a student? With students in the UK graduating with debts of up to £50,000, studying at a European university has been increasingly popular, since the fees are generally much cheaper. Spanish universities are widely recognised not to be the best part of the education system, with Barcelona Universitat, the highest ranking at 141 on the world scale On the other hand, tuition fees for overseas students are only around €1,000. They have around 3% foreign students, many of them already from outside the EU, and they will accept British A levels in place of the bachillerato which is normally required to gain entry. That offers the tantalising prospect of being able to study in Spain for two years as a mature student, relatively cheaply, and then gain citizenship relatively easily. You might even get cheaper health coverage via a student mutua. Can I live in Spain without working (e.g. retirement)? Generally, yes, on a long-stay visa. You will need to prove you can live there without working, by showing your income from abroad is sufficient and after five years of uninterrupted residing in Spain, you can apply for permanent residency. Do I have to declare an income in Spain if I’m not paid there? When you have stayed in Spain for six months and one day, you are eligible to pay tax in Spain. If not, you don’t. Double tax arrangements are not a European Union rule but a reciprocal arrangement between Spain and the UK so should not be affected by Brexit. Can I live in Spain but commute to Britain to work during the week? You can spend up to 90 days in Spain per six months without many questions being asked and without a visa. That gives you every weekend and some good long holidays too! You could also stay in Spain on a long stay visa, which would give you more time there, but you would have to show that you have sufficient income to live in Spain without earning an income. That will be difficult if you are in fact nipping back and forth to work. Can I live in Spain and “work from home” for a UK employer? Staying in Spain for more than 90 days requires you to prove that you do not need to work, and you may have to have that notarised. One possibility might be to structure your employment in the UK so that you are paid via a company or other financial entity. Can I be a freelancer/self-employed in Spain? One of the reasons so many ambitious Spanish people moved to London in recent years was because it is easier to start a business in the UK than in Spain, where the bureaucratic process is long with few “breaks” for new businesses. Recently though, the Spanish government has attempted to make it easier to start a business. There is also a newly launched “Entrepreneur visa” that is designed to encourage start ups (and tempt them away from the United States and other countries). There are several visa options for entrepreneurs and investors, including golden visas for people simply “investing” in their own house. Investor Residency Visas One may obtain a residency visa on investing in any of the following asset classes: 1 – Investing at least €2million in Spanish Treasury bonds 2 – Investing at least €1million in shares of publicly trading Spanish companies or non-traded ones 3 – Depositing at least €1m In a Spanish bank 4 – Buying Spanish real estate of at least €500,000

5 – A ‘major’ business investment which fulfils at least one of the following three conditions: • Meaningful job creation • Significant socioeconomic impact in the region • Technological or scientific impact Can I start a business there employing myself and other people? Yes, you could start a new company or be selfemployed, buy a company, create a joint venture, open a Spanish branch of your existing company, or a representative office. Is there a language requirement for visas/ sponsorship? Yes, for many visas there is a requirement to speak Spanish. So how easy is it? The languages that are the most similar to English are Western European languages and include Spanish, French, Portuguese, Italian. Spanish is the fourth most spoken language in the world (behind Chinese, Hindi, and English) Spanish only differs from English in word formation and pronunciation. English speakers learning Spanish will be using the same alphabet (apart from a few letters) and the straightforward Spanish pronunciation system: words are pronounced exactly as they are written. Grammatically speaking, Spanish actually has fewer irregularities than other languages. Will there be British estate agents in Spain? We are assuming that existing businesses will be allowed to continue, and may be able to employ British staff, so it is most likely that many will stay. Can I take my dog to Spain? As a rabies-free country, the UK is likely to be regarded as a “third country” that is given the same access to the EU pet passport scheme as EU nations.This applies to dogs, cats and ferrets. HEALTH How good is Spanish state healthcare? According to the OECD Better Life Index, of the 34 OECD countries Spain comes above midtable for health outcomes, two places above the UK. Life expectancy is higher than the majority of OECD countries, at 85.5 for women and 80 for men (compared to 83 and 79 respectively in the UK). Two out of three Spanish people said they were in good health, compared to three out of four in the UK. What do I need to do, as a non-EU person, to access state healthcare in Spain? If staying in Spain for less than 90 days, standard tourist health insurance should suffice. On most of the visas that allow you to work in Spain it is compulsory to take out comprehensive health insurance. For Americans, for example, this includes minimum coverage of US$50,000 for emergencies and repatriation, and it may well do for the British as well. Of course, the UK being within easy reach from Spain, for anything but the worst intensive care cases it would be relatively easy to return to the UK, even if it requires an ambulance. In Spain doctors’ visits, hospital stays and tests are free for EU citizens, but there are charges for prescriptions (depending on your income), dental and eye care. Many Spaniards also have a mutua, a private health insurance allowing them to use both the private and public health services. Non EU citizens are required to have private healthcare cover but it is also possible to “pay into” the state health system for medical cover under the national health service. What happens if I have anemergency and am not insured? You will be treated by the Spanish health service just as well as any Spanish person and then billed afterwards. What will I pay for private health insurance? For trips of under 90 days that do not require a visa standard travel insurance will suffice. This will come with the usual excesses and exemptions as per your shorter holiday, generally at around £20-50 per year, excluding adventure sports. If you need to visit the GP, for example, you will normally be better paying the €25-50 charge out of your own pocket, and will face an excess of at least £100 for more serious issues. Generally in Europe an insurance company will charge €200-300 for an individual in his 50s, €500 per month for a family of four or €800 per month for a retired couple. As the market for healthcare provision for Brits left out of free healthcare grows that is likely to come down, and new products are likely to come onto the market. If you have a chronic condition, however, such as diabetes or high blood pressure, you can expect to pay considerably more. In Barcelona the average cost of a short doctor’s visit is €52 but this varies around the country.

Benalmadena Pueblo was founded during the Muslim invasion of the Iberian Peninsula in the eighth century. It was originally named Ben-Al-Madina by the Arabs, which when translated means "children of the mines". This was because ochre and iron ore were once mined locally. Today, the Pueblo has become a beautiful village of whitewashed houses, adorned by brightly coloured flowers. The municipality of Benalmadena, which includes Arroyo de la Miel, Benalmadena Costa and Torremuelle, is governed by the town hall in the Pueblo. There are many places of interest in and around the Pueblo. Plaza Espana in the centre of the village, is a typical Andalucian square. This is where you will find a fountain with a statue of La Nina, who has become the symbol of Benalmadena. Around the perimeter of the square there are some lovely restaurants surrounded by orange trees.

Fuengirola Port & Sporting Marina Fuengirola port is a hive of activity all year round and it offers a full range of facilities to the public. It is also a very popular area for outdoor café culture and has excellent terrace restaurants incorporating bars offering an interesting night life. The port is located mid way along Fuengirola promenade just down from Fuengirola Bus and Train station. The other side of the port is a sports and leisure marina, with over 225 berths (lengths ranging from eight to 20 metres). LEGAL ADVICE COLUMN Spanish Residency Increased interest in obtaining Spanish nationality since referendum result A growing number of British residents on the Costa del Sol want to prepare for Spanish Nationality Parnell Academy is running a course designed specifically for those who want to pass the test of Spanish nationality, supported by the growing association “Brexpats in Spain”. Since the outcome of the referendum, whether or not to obtain Spanish nationality has been one of the key questions formulated by British residents on the Costa del Sol, one of the largest British communities in Spain. The interest generated in obtaining Spanish nationality has led to this pioneering academy to offer a specially designed course in this area. In the centre of La Cala de Mijas, one of the three towns of this municipality of 84,000 inhabitants where the largest number of foreign residents on the Costa del Sol (10,000 are British) is located Parnell Academy. Richard Parnell, one of the founders with his daughter Natasha and Anne Hernandez, 63, president of Brexpats in Spain, an association which now has 1,900 members and hopes to extend to other European countries, including France, which have shown interest in the initiative. Brexpats was established in 2017, and the group membership quickly spread throughout Spain to Barcelona, Mallorca and Alicante. This type of specific course to pass the exam to obtain Spanish nationality has no precedent in Spain. The Brexit effect has led to an intense and growing demand on the Costa del Sol in those interested in learning the necessary steps to obtain Spanish nationality. All decisions are made by the Little Dictators in Brussels. If only that were true, then we wouldn’t have 27 countries plus Switzerland and Scandinavia scrambling to figure out what to do with their British expats. As the United Kingdom moves inexorably toward a no-deal Brexit, an increasing number of countries across the European Union are assuring British expats that life will go on as normal. Well, at least for a few months. But concerns about their citizens in the UK have countries from Portugal to Poland making clear they’ll allow Brits to stay only if there is reciprocity and their citizens get settled status in Britain. For example, Spanish authorities are saying British expats will have the same rights in Spain post-Brexit as long as the UK extends residency rights to Spaniards already living in the UK. This comes after the European Commission asked – but decided not to order – member states to grant temporary residence permits to British nationals so they’ll have time to apply for long-term residency status. Germany and Italy already notified their British expats at the end of 2018. If you’re an American in the Netherlands, for example, you’re registered with the local government and have specific rights under the Dutch American Friendship Treat. But a no-deal Brexit would push British citizens into a neither-nor purgatory where they would have neither EU citizenship status nor a separate post-Brexit immigration status. And in some countries such as France and Spain, Brits never have had to register as permanent residents, which introduces another layer of anxiety. Until they get their long-term residence status as third-country nationals, they’ll won’t be able to leave their host country, then return as anything but tourists. Spain’s cabinet approved legislation for an estimated 400,000 Brits living in Spain remain in place if the UK leaves the EU without a deal. And under a reciprocity agreement, 150,000 Spanish citizens would remain in the UK. Spanish Prime Minister Pedro Sanchez said in December that Brexit won’t change the status of British citizens in Spain, as long as the UK extends reciprocity to his citizens. Under the plan, Britons living in Spain will have to apply for a foreigner identity card before 31 December 2020 to prove their legal residency status. NEW YORK TIMES ARTICLE When Natalia Yavorska and her husband first considered buying a holiday retreat somewhere warmer than their Ukrainian homeland, they were drawn to the Canary Islands. A vacation to the Spanish archipelago in 2012 left them eyeing land on the southwest coast of the island of Tenerife, and while the initial attractions were the golf courses and ocean views, the deal was sealed by a special extra that came with their purchase. “The fact that we could get a Spanish residence visa from buying real estate was very important, and that made it an easy decision,” said Ms. Yavorska, a 60-year-old former banker from a town near Kiev. That “golden visa” carried the right to eventually apply for a Spanish, and therefore European Union, passport, the kind of bonus that is luring a growing number of investors to high-end real estate. Once seen as a slightly shady practice, the business of dangling visas and citizenship in front of wealthy investors has become a more common, and in some cases hugely successful, marketing strategy. Ms. Yavorska and her husband, Alexander Yavorski, who own a pharmaceutical import business in Ukraine, were worried about political stability at home and saw the right to live in the European Union as “a type of insurance.”“Something can always happen between Russia and Ukraine, so if you have the chance to have a visa or a second passport sitting in your drawer, you would be stupid not to take it,” she said. If you are interested in setting up a company in Spain, you must first be aware of the different possibilities to enter the Spanish business market. If you are starting a business in Spain, you can set up as a new company,as an acquisition, as a joint venture, as a Spanish branch, as a representative office, as a selfemployed person, Self-employed workers in Spain

Self-employed workers in Spain are commonly known as “autonomos”. Their registration process has to be made with the Spanish tax authority and the Social Security in Spain. Most autonomos have to present quarterly IVA – or value added tax (VAT) – returns and an annual income tax return (I.R.P.F.). Other declarations are frequently applicable on a quarterly and annual basis, according to circumstances. Sole traders and partnerships in Spain If you’re starting up a business in Spain, the easiest and cheapest way of doing so is to set up as an unincorporated company. You can do this as a sole trader (empresa individual) or partnership (sociedad civil). With these arrangements, there are no minimum investment requirements and you won’t need to go through many of the formalities needed for setting up a limited company. The business owner(s) is classified as an autonomo responsible for their personal tax return. However, there is no legal distinction between your business assets and your personal assets. If the business gets into debt, the business owners are personally liable. Sole traders and partnerships are more suitable for smaller businesses that won’t have a large annual turnover or employ many staff. If you’re starting up a business in Spain alone, you can also choose to set up as a freelance professional (profesionales autonomos) instead of a sole trader. If a few of you are setting up as a partnership and and you want to limit the amount of personal liability and give the business a more formal structure, you can set up as a limited partnership (sociedad comanditaria) instead of a general one. Limited companies in Spain With regard to limited companies, several types exist but the commonest form is the sociedad limitada or S.L. Though it is important in protecting the owner(s) from personal liability in the event of bankruptcy, its incorporation does mean a number of additional tax, accounting and mercantile obligations. S.A is the equivalent of the PLC (Public Company) and not usually required for new businesses. An SL has to present an annual corporation tax return and statutory accounts. They will have to file their IVA, and several other periodic declarations are usually applicable. Here we will consider how to set up a new limited company. You will find information and guidance regarding the steps and the public offices you must visit to fulfil the different forms and all the red tape in order to get your sociedad limitada set up by yourself. 1. NIE – foreigner’s tax identification number Before you can start the process of setting up a business in Spain, all resident and non-resident foreigners with financial affairs in Spain must have a foreigner’s tax identification number or NIE. The NIE is essential for any fiscal transactions in Spain, for example, to incorporate a company. If you are a Spanish national, you will have a NIF rather than a NIE number. Applications for a NIE can be made at a processing office for foreign citizens (Oficina de Extranjeros) at a national Spanish police station (comisaría). You can find a list of local offices here. 2. Register the company name with the RMC (Registro Mercantil Central) The first step in setting up your SL will be to obtain a certificate (called a no-name coincidence certificate) from The Mercantile Registry to verify that the company name you want to use is not already taken, so you can choose it for your new company. You can do this by yourself through the RMC website. This step takes about three days before you receive the answer from the RMC by courier.

3. CIF – company tax identification number Next you have to apply for your C.I.F (certificado de identificacion fiscal) which is your company tax number. You need to complete the tax form 036, which can be done online or hard copy delivered to your local tax office. You can find information about the form along with form downloads and links to completing online at the Spanish Tax Agency (Agencia Tributaria) website. If you make the application in person at your local tax office, bring the original and a photocopy of your NIE (numero identificacion extranjero). 4. Open a business bank account Once you have obtained the tax code and the certificate of noname coincidence (see point one), you will need to open a business account with a Spanish bank and make a deposit of €3,006 – which is the minimum authorised share capital for a SL. Evidence of payment can be obtained in the form of a bank certificate which will need to be provided to a notary or lawyer showing the act of incorporation of the company. If you don’t have a Spanish bank account, find out how to open a bank account in Spain. These funds can also be shown as money invested previously into the business such as a vehicle or computer bought for the business, it need not be cash. 5. Deed of incorporation You will now need to apply for the deed of incorporation to establish your company. This is the official document that states they key details of the company (name, address, details of director, board members, shareholders, etc.). You can arrange a local notary appointment to sign the deed of incorporation. You can find the nearest one in your area at www.notariado.org. This step lasts about one to three days depending on the notary. You must supply the notary with original documents and photocopies of: tax form 036,your certificate from Registro Mercantil, NIE, andthe evidence of payment in the bank. 6. Register the company: With the original deed of incorporation obtained from the notary, you should then go to the Local Government Tax Authority to register the deed. The deed will be stamped certifying this fact. This step should not take longer than two hours. Do not forget to take with you your original documentation and photocopy of the deed and your NIE. You will then need to take the stamped deed to the Registro Mercantil where it will be registered in the Spanish Register of limited companies. It should take around 15 days for the deed to be registered and original documents returned. Finally, you will need to return to the tax office to obtain the permanent Corporate Tax Identification Number (CIF) after the completion of the incorporation process. Newly incorporated companies must use the 036 form used to request a tax identification number, to describe their business activity, and disclose other business details. Do not forget to take along the original and photocopy of the deed and NIE. 7. Register for social security The last step of the registration process as the company’s director is for social security and occupational accident insurance purposes. You will have to comply with certain procedural formalities at the local office of the Ministry of Employment, Migration and Social Security (Seguridad Social). There are different options for registration. Usually the company director will be registered as autonomo and will make monthly payments, which are currently set at between 26.5% and 29.8% of the contribution basis. To register for social security when starting a business in Spain, you will need to take along your deed of incorporation, NIE, CIF and form TA 0521 (which can be obtained from your local social security office). Details of local social security offices in Spain can be found here. This guide only covers the basics of starting a business in Spain and there are many legal issues as well as further issues (such as setting up accounting procedures, obtaining necessary business or trading licenses and notifying regional authorities) that will need to be considered. It is recommended that you obtain help from a professional such as a lawyer or an economist, or an administrator (known in Spain as a gestor), to guide you through the processes, when starting a business in Spain, especially if you do not speak and read Spanish well as mistakes will be costly and could incur fines or court actions as your business grows.

For those buying or selling in Spain, transaction costs are moderate, at around 10-15% of the property value. For those considering a shorter stay, renting could be a more suitable option if you factor in Spain’s high levels of capital gains tax, which could offset any benefits of buying in the short-term. Are foreigners allowed to buy property in Spain? Yes. There are no restrictions on buying property in Spain, whether it’s commercial, residential or land. In fact, Spain encourages investment by foreigners, both resident and non-resident. You will require a financial number which can acquire by visiting a police station with your passport. This is no longer a one day job and can take weeks to get an appointment just to present documents to the Policia. Allow 6 weeks or pay your lawyer to do it on your behalf. Buy a property, get a visa Spain currently offers a ‘golden visa’ program for property owners. This is a form of investor’s visa. If you invest more than €500,000 in Spanish property, buying one or more properties, you will normally then be automatically eligible for a residency visa. However, many of these focus on holiday homes, so you may prefer to use a Spanish site, such as the ones listed below. As you don’t need to be resident to purchase a property, it is possible to buy a home before you arrive and move in directly. However, this naturally comes with certain risks and we strongly recommend that you view the property you are considering and don’t cut corners on the process, even if this means spending some weeks in a hotel when you arrive.

Advantages / disadvantages of using an agent As estate agents are typically paid by the seller, there’s a strong advantage to using them for buyers. Estate agents can often provide detailed information about the region or city you’re considering, and many are bilingual and accustomed to dealing with overseas buyers. However, regulation is relatively low and unscrupulous estate agents do exist, so be wary of anyone who asks for payments upfront or suggests cutting corners. Always remember that you can choose your own notary, mortgage provider and so forth – you do not need to use a service suggested by the agent. Illegal properties For a long time, Spain has been popular with overseas buyers looking for holiday homes. On occasion, the large numbers of inexperienced foreign buyers have provided an opportunity for unscrupulous developers and estate agents to sell properties which are not legitimate. In some cases, planning permission has not been acquired before building, and properties are eventually torn down by the local government. In others, the quality of the property has not been up to scratch or as indicated, resulting in costly repairs. The British Foreign Office has issued notices warning expat buyers to be cautious and not take unnecessary risks. They recommend, at minimum checking: The credentials of any lawyers or estate agents used; the land registry (Registro de la Propriedad); that appropriate planning permission has been obtained; No outstanding debts attached to the property, such as a mortgage; structurally sound (surveyor /rchitect can do this). Most of this information can be provided by the land registry and accessed by making a request by email, phone, fax or in person. Buying off plan or a new-build home The worst property scams in Spain, as elsewhere, have involved properties bought before they were completed or, sometimes, even started. While malicious intent is rare, caution is advised when buying a property which does not yet exist. At minimum you should: Check the company exists and is officially registered; check online at www.registradores.org (Spanish only). Ensure that the project is registered with the land registry. Check that planning permission has been granted by enquiring at the local city hall. Never sign a contract you don’t understand. Ensure that any translation is done by an independent party. Demand proof that any sums paid (e.g. a deposit) are being held or spent appropriately. Get proof that you’ll get a refund of your money if the property is not built. As a non-resident, you may also buy land and have a property built yourself. In this case, good legal advice is even more important as you will need to ensure that contracts with builders are appropriate and watertight. Debts transfer with property In Spain, any mortgage or debt tied to a property is transferred to the new owner when the property is sold. It’s thus critically important to ensure that there are no debts attached to the property when it is sold, or that if there are, they are covered by the terms of the contract. Buying a Spanish property The process of buying a property in Spain usually runs as follows. First, the buyer makes an offer, usually through the seller’s estate agent. If this is accepted, then the buyer and seller sign a preliminary contract (contrato privado de compravento) and the buyer pays a deposit, typically 10% of the purchase price. (Do not pay a temporary holding deposit unless you are going to buy the property as you cannot get those funds back unless there is a legal reason not not complete the purchase) The buyer then arranges any mortgage they require, although they should have already discussed their needs with the mortgage provider. The contract of sale (escritura de compravento) is usually signed in

Legal requirements The services of a notary are not legally required to complete the sale, but it is advisable and required by many mortgages. The seller is responsible for hidden defects in the property, even if they are not aware of them. However, in practice gaining restitution for such defects can be difficult and costly. Paying the costs and taxes associated with buying a home can be completed by the buyer or their agent. It is the buyer’s responsibility, however, to ensure taxes are paid. The buyer is also responsible for registering the property. The notary may provide this service for a fee, and/or may notify the registry office that the sale has taken place, without completing full registration. Funding purchase: deposits and mortgages Following the 2008 crash, Spanish banks were reformed with significant IMF involvement. This reduced the number of lenders in operation, and significantly increased the regulation and oversight of the industry. As a result, many banks began to lend less and mortgage rates and terms became less favourable. Mortgage lenders will not complete on a mortgage agreement until you own a property. For this reason, it’s important to include a clause in the contract allowing you to exit the agreement if you cannot acquire a mortgage. Fees and charges Costs are primarily paid by the buyer, and vary from region to region. Many are negotiable – there are no fixed fees for lawyers or estate agents. Costs paid by the buyer include: Property transfer tax 6–10% (existing properties) / VAT (or IVA) at 10% (new properties); Notary costs, title deed tax and land registration fee 1–2.5%; Legal fees 1–2% (including VAT). The estate agent’s fees are usually paid by the seller, and this is typically their only cost. Estate agents usually charge a percentage, typically around 3% of the final sale price. Capital gains tax Capital gains tax is paid on the profit of selling your home, i.e. the difference between the listed purchase price and the listed sale price, and the level in Spain currently varies between 19% & 23% First €6,000 – 19% €6,000 – €50,000 – 21% €50,000+ – 23% Thus if you pay €200,000 for a property and sell it for €350,000 you will pay capital gains tax on €150,000. Due to the tiered system this would add up to €33,260 euros. You may be able to claim a reduction on the capital gains tax to account for inflation; or if you are purchasing another property in Spain; or if you are over 65 and have lived in the property as your main residence for more than three years. Otherwise, unlike in other countries, capital gains tax applies no matter how long you’ve lived in the property. Your residential status does not affect the application of capital gains tax either, as capital gains tax should be paid in Spain for property owned in Spain even if you are no longer a resident. Choosing a reliable lawyer Any lawyer practising in Spain should be registered with the local bar association (Colegio de Abogados). They will have a registration number that you can ask for and then verify with the bar association. Naturally, registration does not guarantee honesty or competence, but it is a good minimum standard to insist on. Finding a translator Many governments provide lists of lawyers and translators who speak both Spanish and another language. GUIDE TO RENTING A HOME IN SPAIN If you’re looking into renting in Spain, find out where and how to rent a Spanish property and what quirks to expect from the Spanish property market. Although property prices in Spain fell significantly in the years following the financial crash, the effect was not felt as strongly in Spain’s rental market. Buying or renting in Spain Renting a property in Spain is a good way to get to know the country and decide which area you would like to live in, and renting for a few years before buying is generally a sound course, particularly in the current market. Find a property in Spain As with other countries, the most common way to find a house or apartment to rent in Spain is an estate agent (inmobiliarias), online property portals, newspaper adverts or word of mouth. In addition to the Spanish property portals listed below, you may find properties listed on real estate websites based in other countries, particularly the UK and Germany. However, these will often be targeted at tourists and may therefore be more expensive. If you find a property through an estate agent, it’s important to know that they are usually paid by the landlord. However, if you specifically ask an agent to find you a property, you can expect to pay for this service, either a fixed fee or a percentage of the monthly rent. This will typically be between €250 up to a month’s rent. Online property portals: ? As a result, properties vary in quality and the descriptions vary in accuracy. Property portals that offer languages other than Spanish sometimes use automatic computer translations, so be sure to confirm that the key features exist when you view the property. As in many European countries, Spanish properties are typically advertised with a monthly rent and a living space in square metres. The advert should also indicate whether the property is furnished or not. However, as there are no clear standards for this, unfurnished properties may be completely bare, have no kitchen appliances, or include a few pieces of furniture left by the landlord. Likewise, furnished properties can be either comprehensive, including kitchen items, or very basic – so if you view the property while the previous tenant is still in residence, make sure you’re very clear about which pieces of furniture are staying. One option is to email the estate agent to confirm this, getting the answer in writing. All properties on long-term lets are required to have an energy efficiency certificate. This will often help you spot houses that will be expensive to heat or which are older, as new properties will typically have a good energy rating. Applying for a property in Spain Expect to apply to an estate agent for a property and to put down the equivalent of one month’s rent when you do. This is usually rolled into your deposit when the contract and moving in are complete.

You will typically be asked to provide: ? Evidence of employment or ability to pay rent ? Tax identification number (if you are working) ? Passport or ID ? Personal references. ? Deposits when renting a Spanish home your

landlord will almost certainly ask for a deposit of one month’s rent before you move in Spanish tenants have the reputation of being bad payers in general, so many Spanish landlords lack trust and may ask for additional guarantees. Here are some examples of what the landlord can ask for: One or more additional payments of rent A bank guarantee. This is an alternative deposit that the bank pays on behalf of the tenant to the landlord in the case of non-payment of the rental instalments A written guarantee from the employer, a kind of certificate in which the employer guarantees the payment of the rent to the landlord if the tenant stops paying Paying the rent in Spain If you fail to pay your rent by the seventh day of the month, the landlord can claim the rent in legal proceedings. If the amount overdue is less than €2,000, the landlord can go to court to claim it without needing a lawyer. These are short proceedings that take a couple of weeks, after which a legal deed is obtained to execute the claim (executor title). With this title, the landlord can easily claim the overdue payments, but not evict. To evict, a different and complex procedure is required in the courts. Cost of renting a home in Spain Deposits in Spain should be held by a third party, which then allows for mediation if there’s a dispute at the end of the tenancy. In addition to the rent, you will be expected to pay for utilities and minor repairs due to wear and tear. This should be made clear in the contract. Utilities for a two bedroom apartment in Spain are typically around €50–150 per month, depending on energy efficiency, usage and type of utilities. On top of this, there may be annual or monthly fees for maintenance of communal areas and local charges, such as garbage collection. Tenancy agreements in Spain In Spain, a tenancy agreement (contrato de arrendamiento) is valid whether verbal or written. Verbal contracts are generally a bad idea, particularly if you don’t speak the language fluently. Instead, insist on having everything in writing so you ensure you fully understand what you’re signing. To break a contract, the lessee must give at least 30 days’ notice before the end date. As standard, a tenant with a long-term contract (more than one year) has the right to renew annually for three years, unless the landlord states after one year that they intend to occupy the property personally on a given date – two months’ notice must then be given to the tenant. The landlord is permitted to increase the rent if improvements are made, as long as the increase meets certain standards and is less than 20% overall. Typically, a contract will be for 12 months, renewed annually, and if you give notice to quit during this period, you will have to pay rent until the end of the contract. The tenant can terminate the rental contract: after six months, respecting a notice period of 30 days, regardless of the duration of the contract If a clause has been inserted in the rental contract stating that the tenant can terminate the contract at any moment, even before six months are up. GUIDE TO BUYING & RUNNING A BUSINESS Becoming ‘autonomo’ (Self Employed) in Spain and tips on how you can sort out your taxes as a self-employed worker in Spain. Before starting a business in Spain, think carefully about the implications from a compliance point of view. As setting up a limited company here is timeconsuming and expensive, many people start their business as a self-employed person and set up a limited or SL company once the business is established, so If you decide to become selfemployed, this is what you should expect: Facts about being autonomo in Spain As an autonomo in Spain you will have to pay your social security of around €240 each month. This will allow you to enjoy Spanish national healthcare system and a pension when you retire. You do not need any professional help with registration or reporting responsibilities, but as you will find when talking to any local ex-pats that have gone through the process, dealing with local tax offices, town hall offices, licensing departments and the myriad departments you will become accustomed to waiting in line to meet, you will be well advised to enlist the services of a “gestor” (Advisor) or accountant who can help register you with the hacienda (tax office) to help with compliance and do the quarterly and annual accounts, especially if you do not speak Spanish. Beware of the smiling face of the British ex-pat “Advisor” or English speaking “Gestor” introduced by your agent or the business vendor as the huge opportunity to earn high commissions and undisclosed fees here is too tempting for some to remain honest when faced with inexperienced, over excited people with heads full of dreams and bags full of money. Do your homework well, ask many local business owners who they use, for how long and what experience they had enjoyed. Do this before you invest a single penny in your business as who you appoint to help you through the first few years will determine your chance of success more than almost any other factor. If you are invoicing a company as an autonomo you may have to include Impuesto sobre la Renta de las Personas Físicas (IRPF) of 15%. This means the company you invoice retains the 15% of the tax on your behalf and pays it at the end of the year. You will have to pay the remaining 5%. As an autonomo in Spain you pay tax and your VAT every quarter. Each quarter you may be required to pay 20% tax on your income (after expenses have been taken into account). Registration Before you start trading, it is essential that you register with the tax office to inform them that you will be commencing a business activity. This is because any expenses incurred prior to registration will not be tax allowable and as registering with the tax office is a legal requirement, failure to do so can result in a fine. Registration is done via a census return which informs the tax office of the following: ? Name, address and identification number ? Date of commencement of trade ? Description of business activity ? Whether your activity is subject to VAT ? The type of profit calculation and taxation system applicable to your trade (some trades fall within business modules that are taxed at fixed rates regardless of volume of business) ? Whether you are obliged to present quarterly returns on your profits to date ? Whether you have business premises, and the address details if so ? Whether you will be importing or exporting and

wish to be registered on the EU traders list You must also register with the social security office upon commencement of trade as a selfemployed individual and start paying your monthly national insurance contributions. Do your research! Many of the frustrations arising when starting in business in Spain are due to a lack of awareness regarding the local compliance system. Make sure you have understood all the aspects that are relevant to your particular trade before you start to minimise problems. If you have any doubts, be sure to consult a professional as this will greatly contribute to your chances of success. Accounting records As an individual, you are not obliged to maintain records which include a balance sheet. Your minimum obligation is to maintain records of all your sales and business expenses; in a way that meets the required standards. Of course, even though you are not obliged to maintain a balance sheet, you may benefit from it as it will help you manage your business more effectively. Withholding tax on your sales In some instances, your clients will be obliged to withhold some of your fees to be paid over to the tax office on your behalf as income tax. For example: The standard rate of withholding tax in Spain for professional sole traders is 15%, however, during your first two years you may opt for 7% retention instead. Our advice is that if your profit margins are high and you are have difficulties setting money aside to pay your taxes, it is better to suffer a 15% retention as any balancing payments due will inevitably be lower. Quarterly obligations As any other business you will need to report to the tax office on a quarterly basis by filing the relevant returns. In addition to the general obligations that apply to all businesses, you may be obliged to file a return disclosing your accumulated profits for the current year. Income tax payments on account Generally, when a profit has been made, you will need to pay the tax office 20% of these reported profits as a payment on account of your personal income tax. This may come as a surprise if you were used to making payments on account in your home country only twice a year. However, you may appreciate the benefits of this system as you are less likely to face large tax bills on an annual basis. Year end Once the year has come to an end, you will have to file a personal income tax return. This return will combine all of your sources of income, including your business profits, and all of the tax reliefs you are entitled to as any other resident individual. When your final tax liability for the year has been ascertained through this process, you will either have to make a balancing payment or request a tax refund. A balancing payment will arise if your tax liability is greater than any payments on account already made through the system noted above. Bear in mind that the maximum payment on account suffered will have amounted to 20% of your business profits, and that the higher earners in Spain are taxed up to 43%. A refund may be requested if the withholding tax suffered exceeded your liability once other reliefs, such as mortgage costs, have decreased your taxable base leading to an effective rate of tax below 20%.

Here, we explain the main things you should consider before applying for a mortgage in Spain. Should you buy property in Spain? In the last couple of years, the property market in Spain has finally picked up after a long slump following the financial crash. In November 2018, house prices increased by 5.6%, and it’s been predicted that the market will remain buoyant in 2019 through to 2020, but there may be a slight stagnation in the middle of 2020. Spanish mortgage lenders offer an array of mortgage products specifically designed for foreign and expat

on the mortgage type. The good news is that it may be possible to borrow significantly more of the property’s value – up to 100% in some cases – when buying a bank’s repossessed property in Spain. Some banks might only be willing to provide a mortgage to foreign buyers for their own listings. In this case, your options for getting a mortgage may be tied to a particular property. In some cases, the mortgage you get may be based on the bank assessor’s valuation of the property rather than the price you’re paying for it. Thus, if an assessor valued your property at €125,000, you could traditionally borrow up to €87,500, even if your purchase price was only €100,000. Spanish mortgage calculators Most Spanish mortgages are variable rates linked to the yearly Euribor (European inter-bank offered rate) plus a margin. For example, with Euribor at -0.37% at the start of 2019, and variable-rate mortgage rates ranging from 1.8–3%, you could theoretically pay just 1.43%. Many lenders also offer fixed-rate mortgages, which range from 2.4–3%, depending on the loan term.

Cost of getting a Spanish mortgage If using a Spanish mortgage lender, you should allow up to 10-15% of the total purchase amount for various transaction costs. Thus, if your property is valued at €120,000 and you can borrow 70% of this amount, you will need to have a €36,000 down payment plus up to €1,760 in savings. Typical closing costs include transfer and stamp taxes (explained below), the bank’s arrangement fee and opening fee, a notary fee and registry fee, and a bank assessor’s fee. This number is similar to a US Social Security number or a British National Insurance number. You cannot purchase property or get a mortgage in Spain without an NIE. If you’re in Spain, you can start the NIE application process at any local police station. Outside of Spain, the best way to apply for an NIE is to contact your local Spanish consulate. When applying for an NIE, you will need the following documents: A completed EX-15 form Supporting document(s) to show why you need an NIE Copy of your passport pages and original passport Two passport-sized photos €9–€12 fee to submit tax form 790 How to apply for Spanish mortgages

Most of the larger Spanish banks offer mortgages to non-residents, most notably Banco Santander Central Hispano, Banco Bilbao Vizcaya Argentaria (BBVA) and CaixaBank. You can also secure a mortgage through an international bank such as Chase or IMS. When applying for a mortgage for Spanish property, the best advice is to start early and shop around. While the official mortgage process can only start after a sales agreement has been reached, it is both possible and advisable to start developing your mortgage concurrent with your real estate shopping. There are many financial products available for nonresidents, and the terms of any specific product may place limits on which properties you can qualify to purchase. Documents to apply for a Spanish mortgage Whether you go through a Spanish or an international mortgage lender, you will need – at a minimum – the following items: ? NIE number ? 12 Simple Ways to cut the cost of your new Kitchen How much does a new kitchen cost? Can you cut back your budget but still create the kitchen of your dreams? Sure you can with our expert tips... And, it’s important to remember that wanting the best value for your money doesn’t mean opting for cheap alternatives that you’ll be unhappy with in the long run. It simply means making sure every penny of your budget goes towards a kitchen you’ll be happy with. Use this advice to spend your kitchen budget wisely and make your new kitchen cost match your expectations. How much does a new kitchen cost? A new kitchen cost can be as low as €3,000 upwards; for that, you'll need to shop smartly at a DIY store or Ikea for good quality units. This won't, however, include the cost of kitchen worktops, which will be upwards of €100,or appliances and fitting which is going to add a couple thousand to even the tightest budget. 1. Reuse materials to cut a new kitchen's cost ‘Most kitchen renovations start with the old kitchen going in a skip, but if you want to keep new kitchen costs to a minimum, think about what’s saveable,’ says experienced renovator Jason Orme.‘In many cases the carcasses can be reused and, with a bit of work and new doors, will look as good as new. Worktops – particularly if they are solid granite or quartz – can be recut, saving you hundreds of Euros. ’If you have too few units, you may be able to buy more, or opt to use them on just one wall. Alternatively, consider using old units if you are planning a utility room. 2. Reduce wastage to reduce new kitchen costs Just because your old kitchen is no longer to your taste, doesn’t mean it is scrap. If you’re not reusing existing materials such as floorboards, doors, radiators and units, they can be sold. Try Ebay, Gumtree or contact your local reclamation yard.Reducing wastage will also reduce costs for skip hire and disposal. Bear in mind, too, that you can dispose of waste at your local council tip for free, whereas tradespeople will have to pay. 3. Pick expensive fittings selectively to cut new kitchen costs If you can’t afford to fit out your whole kitchen with bespoke units, consider commissioning just a central feature, such as a statement kitchen island, and make up the rest of the kitchen using standard, basic-quality units to cut new kitchen costs. For instance, retaining part of the existing walls or introducing a steel or concrete column can shorten spans and reduce the size and cost of the steel beams required. And it’s better value to add a square-shaped extension with a simple pitched roof, instead of adding complicated curves. 6. Choose end-of-line kitchens to cut new kitchen costs No one will ever know if your kitchen once stood in a showroom and you paid a bargain ex-display price. If you’re extending, there may even be scope to design your space to suit an ex-display kitchen – and if you’re not, then the company will usually be able to add/remove a few units to make the kitchen work in your space. End-of-line appliances, sourced online via specialist distributors, can also be real bargains. 7. Avoid moving utility (Electricity, Gas & Wateer) meters and services Unless it is an essential to radically alter the orientation or usability of a kitchen, try to keep the sink, dishwasher and cooker in the same position if costs are an issue. That way, you’ll be minimising the amount of additional electrical, gas and plumbing work that is needed to realise the new design – and save hundreds of pounds into the process. And, if you can, avoid having to move your gas and electricity meters, as they cost €1,000-€1,300 each to relocate. 8. Shop smarter to cut new kitchen costs It can be all too tempting to fall in love with a beautiful showroom kitchen without checking that it offers the best value for money. The more you can plan ahead, the more chance you’ll have to shop around. The cost of kitchen units, worktops, doors, taps, sinks and cooker hoods varies wildly and if you can wait for sales and spend time researching prices you can save €1,000s on the total cost. Consider shopping with online-only retailers, which don’t have the same overheads as companies with showrooms and can therefore keep costs down, but always check reviews and ask to see samples of everything before you order. Or, go for a ready-to-paint kitchen and paint the kitchen cabinets yourself to save money. Alternatively, if your kitchen carcasses are sound, shop around for door-only options. 9. Fit the kitchen yourself Installation of the kitchen itself can be a key contributor to cost – typically installers estimate €50 per 60cm element, plus extras, meaning a typical kitchen can easily cost €1,500 to €2,000 to install. You can cut this cost by installing the units and doors yourself from flatpack, which any medium-skill DIYer should be able to manage. It’s also relatively easy to tile walls using online tutorials as a guide. But always leave worktops, electrical and plumbing elements to professionals. 10. Upgrade a cheap kitchen carcass A recent trend in the world of kitchens, and definitely one that helps make a new kitchen cost less is upscaling cheap kitchen carcasses from places like Ikea to give them a more expensive, bespoke look. Companies like Plykea and Husk make doors, drawers, worktops and more to fit Ikea's kitchen cabinets, but will give a kitchen more of a handmade look. It's really easy too. Simply design your dream scheme using the handy Ikea Kitchen Planner Tool, then send to your upscaling company of choice with your pick of doors, drawer fronts, cover panel facades and worktops, and they will do the rest. All the fronts arrive complete with pre-drilled holes, and fixing holes that make them as easy to assemble as the rest of your flat-pack kitchen. 11. Mix vintage freestanding furniture with a new fitted kitchen So you've had you heart set on a built in, bespoke pantry cupboard or a gorgeous (but way too pricey) Welsh dresser – instead of blowing half your budget on one piece, cut the costs of your new kitchen by buying them second hand. You'll find some gorgeous, cheaper, pieces on places like eBay, Etsy, even Facebook Marketplace has some gems. Plus, we love the look of a few unique, freestanding pieces mixed into a new kitchen; it works particularly well if you are after that rustic, farmhouse kitchen look. 12. Choose who to work with wisely Finding the right companies and tradespeople to work with could save you thousands, with even the same kitchen varying in cost from different builders. Most kitchens come in set styles – for instance, Shaker or handleless units – so, once you’ve chosen the look you want, get quotes from at least three different kitchen companies or fitters to ensure you're getting the best deal. Remember, the cheapest may not be the best if not all of your requirements are met. Follow the same process with plumbers, electricians, tilers and, if needed, installers, to ensure best value for money. Always ask for references from past clients and, if possible, visit homes where they have completed similar work. COSTA DEL SOL HOUSING BOOM Malaga is the fifth “most important” real estate market in Spain, situated in privileged positions both in terms of the purchase and sale of homes and in the signing of mortgages.

The large developments in towns such as Estepona, Fuengirola and Mijas are, in part, pushed by “the braking” of new projects in Marbella, after the suspension of the General Urban Development Plan (PGOU) by the Supreme Court. Who or who leads the projects? They are driven by myriad promoters and foreign funds, also by local companies with their own funds or associated with other investors. The Costa del Sol is attractive to many different investors due to infrastructure, communications and renewed stability in recent years as the local and regional authorities have battled to put the management and legal problems behind them. Banks are once again supporting development, albeit prudently, with more liquidity for promotors and also funds for purchasers to facilitate completions. For the first time in seven years financial institutions are open to financing promotions provided that the land is owned by the promoter and there is a good volume of pre-sales. Many international clients have become very interested in buying on the Costa del Sol, especially from northern and eastern Europe, reducing the reliance on buyers from the UK and Spain. The Scandinavians (Swedes, Finns and Norwegians) have taken the lead and are leading the purchases of houses on the coast of Malaga, and they are interested in both new construction and resales thus feeding investment to both ends of the spectrum which can only be good for agents and vendors by adding to the urgency for all purchasers to commit to the investment decision through Fear Of Missing Out (FOMO).

And it is estimated that, in the short term, the good figures will continue throughout 2019 and 2020 with “sustained growth”. This is how forceful the experts’ forecast is, but we are going to break down all the details of this statement; some aspects will have to be taken into account. More than 200 new construction projects on the Costa del Sol and around 11,000 new homes for sale shows real confidence in the growth of our Real Estate market in the aftermath of the devastating global crash in both property and financial markets.
