Sustainable construction and the generation of clean energies are key elements to achieving (or achieving an approach to) the objectives established in the UN’s 2030 Agenda for Sustainable Development. However, within the last decade, some sectors of public and private real estate investment have set their sights on a sustainable building system with a worldwide presence. This is the LEED certification, established in 1993 by the US Green Building Council (USGBC). In an interview with Vallarta Real Estate Guide, Mexican architect Milo Aguilar explained some points about what this process implies.

SOC | Pacífica Financial Conference Held SOC | Pacífica, the local branch of master broker SOC Asesores, brought together executives from Mexico’s main banking institutions during the first edition of the SOC | Pacífica Financial Conference, held at Puerto Vallarta’s Westin Resort & Spa. The objective was to inform professionals and real estate investors about the different credit opportunities offered by each of these organizations.

Representatives of banks such as HSBC, Banorte, Scotiabank, Banregio and Santander described the characteristics of their mortgage products, including housing and land acquisition, construction, remodeling, liquidity, payment of liabilities, substitution and SME loans. The event was held with the support of local organizations such as the Colegio de Arquitectos de la Costa Norte A.C. (Organization of Architects of the North Coast), the Colegio de Ingenieros Civiles de la Costa de Jalisco A.C. (Organization of Civil Engineers of the Jalisco Coast) and the Asociación de Profesionales Inmobiliarios de Vallarta A.C. (Vallarta Association of Real Estate Professionals).

“Not all customers are for all banks, nor are all banks for all customers. The intention of this conference is to make known the mortgage alternatives on the market, so the main players in the sector can close sales and real estate projects satisfactorily and avoid being canceled due to lack of resources. For the first time, we are bringing together the four core areas of housing commercialization: those who sell the land, those who design, those who build and those who offer the financial products,” said Alma Cortés, SOC | Pacífica operations director and general coordinator of the conference.

El objetivo fue informar a los profesionales e inversionistas inmobiliarios acerca de las diferentes oportunidades crediticias que ofrecen cada uno de estos organismos.

La intención de este congreso es dar a conocer las alternativas de créditos hipotecarios disponibles en el mercado para que los principales actores del sector puedan cerrar ventas y proyectos inmobiliarios satisfactoriamente y evitar que se cancelen por falta de recursos.

Mandarina Presents Model Units

Mandarina comprises 655 acres and is the most ambitious real estate project in the Vallarta · Nayarit region in recent years.

During a tour of the construction zone, Ricardo Santa Cruz, CEO of RSC Development (the company responsible for marketing the complex), showed the first two model units of Mandarina, the ultra-luxury development currently being built by RLH Properties in El Monteón, a Riviera Nayarit town just 45 minutes north of Puerto Vallarta.

Mandarina comprises 655 acres and is the most ambitious real estate project in the region in recent years. Once completed, it will include the One&Only Mandarina and Rosewood Mandarina hotels, the One&Only Private Homes and Rosewood Residences communities, as well as the world-class equestrian complex Mandarina Polo and Equestrian Club.

While One&Only Private Homes will be composed of 55 residences, a total of 65 homes will make up Rosewood Residences. Each of these extraordinary villas will be designed independently, according to their location, to prioritize privacy and views of the ocean. Prices will range between four and twelve million dollars.

The One&Only hotel (108 rooms) is expected to open during the first quarter of 2020, and the Rosewood hotel (130 rooms) will do so by 2021.

Durante un recorrido por la zona de construcción, Ricardo Santa Cruz, CEO de RSC Development (compañía encargada de la comercialización del complejo), mostró las primeras dos unidades modelo de Mandarina, el desarrollo de ultralujo que actualmente está siendo construido por RLH Properties en El Monteón, poblado perteneciente a la Riviera Nayarit, a tan solo 45 minutos hacia el norte de Puerto Vallarta.

Mandarina se erige sobre 265 hectáreas y se trata del proyecto inmobiliario más ambicioso que se ha presentado en la región durante los últimos años. Una vez concluido, abarcará los hoteles One&Only Mandarina y Rosewood Mandarina, las comunidades residenciales One&Only Private Homes y Rosewood Residences, así como el complejo ecuestre de clase mundial Mandarina Polo and Equestrian Club.

Mientras que One&Only Private Homes estará compuesto de 55 residencias, un total de 65 residencias conformarán Rosewood Residences. Cada una de estas extraordinarias villas estarán diseñadas de manera independiente acorde con su ubicación para priorizar la privacidad y las vistas hacia el océano.

Su costo oscilará entre los cuatro y doce millones de dólares.

Por otro lado, se espera que durante el primer trimestre del 2020 se inaugure el hotel One&Only (108 habitaciones) y para el 2021 lo haga el hotel Rosewood (130 habitaciones).

Condo CR1275 Opens Model Unit

Condo CR1275 houses 15 units: two studios, 12 one-bedroom apartments and a two-bedroom penthouse overlooking the ocean.

The Condo CR1275 development recently inaugurated its model unit, which is now available to receive parties interested in acquiring a property near Puerto Vallarta’s El Centro. The condo is located at 1275 Costa Rica, in the 5 de Diciembre neighborhood, so it offers a panoramic view of Banderas Bay and quick access to Playa Camarones (which has Blue Flag certification) and other important tourist sites, such as the Malecón and the Romantic Zone.

The complex has two modules of four levels each, oriented to the coast and the mountains, respectively. In total, it houses 15 units: two studios, 12 one-bedroom apartments and a two-bedroom penthouse overlooking the ocean with a private terrace and a small pool.

All units include appliances, inverter-type air conditioners and ceiling fans. The project is 90 percent finished and is forecast to be completed in December 2018.

Its amenities include lobby, gym, elevator, rooftop with pool, grill area, lounge area and sundeck.

It is a recovered and optimized building, the design and remodeling handled by Laboratorio de Arquitectura Mexicana (LAM) (Mexican Architecture Laboratory), an office with extensive experience in condominium projects and with a sustainable approach. The development is commercially represented by real estate agency Timothy Real Estate Group, with discounts and financing options available.

El desarrollo Condo CR1275 inauguró recientemente su unidad modelo, la cual ya está disponible para recibir a interesados en adquirir una propiedad cerca de El Centro de Puerto Vallarta. El condominio está ubicado en calle Costa Rica 1275, en la colonia 5 de Diciembre, por lo que ofrece una vista panorámica hacia la Bahía de Banderas y acceso rápido a Playa Camarones (que cuenta con certificación Blue Flag) y otros sitios turísticos importantes como El Malecón y la Zona Romántica.

El complejo cuenta con dos módulos de cuatro niveles cada uno, orientados a la costa y a la montaña, respectivamente. En total alberga 15 unidades: dos estudios, 12 departamentos de una recámara y un penthouse de dos recámaras con vista hacia el océano y terraza privada con una piscina pequeña. Todas las unidades incluyen electrodomésticos, aire acondicionado tipo inverter y ventiladores de techo. El proyecto presenta un avance del 90 % y se pronostica que estará terminado en diciembre 2018.

Sus amenidades incluyen lobby, gimnasio, elevador, rooftop con piscina, área grill, zona de camastros y asoleadero. Se trata de un edificio recuperado y optimizado, cuyo diseño y remodelación está a cargo del Laboratorio de Arquitectura Mexicana (LAM), un despacho con amplia experiencia en proyectos condominales y con enfoque sostenible. Construction of AVIDA Residences Begins

AVIDA Residences has attracted attention for seeking LEED certification, aimed at sustainable buildings and endorsed by the US Green Building Council.

After completing demolition work on the property that housed the iconic Cine Bahía, construction formally began on AVIDA Residences, a development located on the corner of Insurgentes and Francisco I. Madero streets in Puerto Vallarta’s Romantic Zone. It is one of the newest projects in this area, and once completed, it will house 94 apartments, comprising two-bedroom units, one-bedroom super units, studios and lofts.

The condominium has attracted attention for seeking LEED certification (Leadership in Energy and Environmental Design), aimed at sustainable buildings and endorsed by the US Green Building Council (USGBC), in addition to complying with ADA standards, which reflect optimal spaces for people with special needs.

Its amenities include underground parking, lobby with central patio, gourmet market consisting of some of the best restaurants in the city, two-floor fitness center, two elevators, reading room, game room, business center, terrace with semi-Olympic pool, jacuzzi, BBQ area, bar, lounge with a fire pit, hammocks and water mirror.

Applegate Realtors is in charge of marketing AVIDA Residences, while the builder is GOVACASA (the company behind residential communities such as Punta Cala, Loft 256 and Loft 268).

Architect Milo Aguilar explained some points about LEED certification. Currently, he works with Sumac (a company based in Chicago, Illinois), where he offers consulting to architectural projects in Mexico that want to obtain this distinction.

Sustainable construction and the generation of clean energies are key elements to achieving (or achieving an approach to) the objectives established in the UN’s 2030 Agenda for Sustainable Development. Although in Mexico it is an issue that is increasingly on the minds of architects, energy companies, construction firms, urban planners and political figures; advances in this matter seem small glimmers against the opaque and complex panorama of the creation of the cities of tomorrow.

It is valid for five years, is renewable, and applies both to new and existing buildings, regardless of their type. They can be condominiums, houses, residential complexes, hospitals, schools, commercial buildings, industrial buildings and more.”

LEED certification encompasses the following main areas: sustainable site, location and transportation, efficiency in water consumption, energy and atmosphere; materials and resources, innovation in design and environmental quality in interiors. Aguilar explains that projects can reach four different levels of certification, depending on the number of credits or points they attain (in accordance with specific sustainable construction criteria): basic LEED certification (40 to 49 credits), Silver (50 to 59), Gold (60 to 79) and Platinum (80 or more).

In Puerto Vallarta, the AVIDA Residences development (currently under construction in the Romantic Zone) is in the process of obtaining LEED certification. This has been officially announced by the representatives of the property and its marketing materials.

This fact could be the breakthrough that triggers a trend at the local level. In other Mexican cities, such as Mexico City and Guadalajara, competitiveness in the market has caused more and more buildings to seek accreditation. In addition, local developers could attest to the benefits of sustainable development (such as reducing expenses for services and an improving quality of life for those who inhabit the property).

Complexes in Mexico that hold this certification include the HSBC Tower, Torre Reforma and the Antiguo Palacio Virreinal, in Mexico City; Universidad del Arte, in Puebla; and Central Park, in Guadalajara.

Process to Obtain LEED Certification Most of the developers and investors who want to be accredited with LEED in Mexico confer with specialized consulting companies, which accompany them in each of the stages. The whole process is done through the Internet and in English. According to Aguilar, the platform the US Green Building Council has created for sending documents and reports is very efficient.

The process begins with registration. Once the design of the project has been analyzed and evaluated, the documentation is sent for review (which takes approximately one month). The process continues with the preparation of reports on the different construction stages and processes; this allows verification that the requirements for the selected certification credits are being met. Finally, when the complex is finished, the documents are sent for a general construction review. When it is confirmed that everything is in order, the certification that allows announcing the project worldwide on the USGBC website is granted. It is important to note that there is a maximum period of three years to provide all the required documents.

De acuerdo con Aguilar, la plataforma que ha creado el Consejo de la Construcción Ecológica de Estados Unidos para el envío de documentos y reportes es muy eficiente.

El proceso inicia con el registro. Una vez analizado y evaluado el diseño del proyecto, se envía la documentación a revisión (que tarda aproximadamente un mes en ser acreditada).

Posteriormente, se continúa con la elaboración de reportes de diferentes etapas y procesos de la construcción; lo que permite validar que se están cumpliendo los requisitos para los créditos seleccionados de la certificación. Finalmente, cuando el complejo está terminado, se envían los documentos para una revisión general de construcción. Cuando se confirma que todo está en orden, se otorga la certificación que permite anunciar el proyecto a nivel mundial en la página web de USGBC. Es importante señalar que se cuenta con un período máximo de tres años para proporcionar todos los documentos requeridos.

“For those of us who offer this type of consultancy, it is very important to be involved from the design phase of the building. From my experience, I can say that obtaining LEED certification is affected when the project is not well defined and/or many changes are made on the fly. For this reason, I suggest that architects, investors and developers inform themselves about the requirements of this system and work together from the beginning to develop a project in accordance with these guidelines. If at the beginning of construction, 90 percent of the plan is defined, I am convinced that this will mean that not more than expected will be spent and that the entire development of the project will be fluid and successful.”

Aguilar concluded by emphasizing the role architects play in motivating their clients to use sustainable development systems. He also stressed the importance of training in this area, since knowledge is the strongest tool to promote this type of property and move toward models that have less impact on the environment.

“Para quienes ofrecemos este tipo de consultoría, es muy importante entrar desde la parte del diseño del edificio. “When imported in this way, the car will be able to circulate in Mexican territory permanently. The car’s year, model and weight must be taken into account, since they determine the amount of taxes due and whether it can be accepted for entry into the country. In addition, you can only import vehicles with a model year eight or nine years prior to the year of import.

For example, for 2018 only model years 2009/2010 or earlier can be imported.”

“Cuando se importa de esta manera, implica que el auto podrá circular en el territorio mexicano de forma permanente. Se debe tomar en cuenta el año, modelo y peso, pues influye en el monto de impuestos a pagar y en la aceptación o no del ingreso al país. Además, únicamente se pueden importar vehículos cuyo año/modelo sea ocho o nueve años anteriores al año de importación.

Por ejemplo, si en este año se hace el trámite, solamente pueden importarse autos cuyo modelo sea 2009/2010 o anterior”.

PROCESS Noting that any person with the economic capacity can carry out the process, Cortés says that the first step is to hire a customs broker, a person authorized by SAT (Tax Administration Service), who will be responsible for the permanent importation of the vehicle. “Once an appointment is scheduled with the broker, he must be given the title of the car, the owner’s official ID and proof of a Mexican address. The broker is given the car’s license plates and is in charge of canceling them in the system.”

In the second step, still in US territory, the customs broker will verify that the car complies with the required p hy si c al-m e chani c al conditions and environmental protections, that it is 38

PROCEDIMIENTO Además de indicar que cualquier persona que tenga la capacidad económica es apta para realizar el proceso, Javier Cortés menciona que el primer paso es acudir con un agente aduanal (persona autorizada por el Servicio de Administración Tributaria), quien se encargará de la importación definitiva del vehículo: “Una vez que se agende una cita con el agente, se le debe entregar el título de propiedad del auto, una identificación oficial y un comprobante de domicilio mexicano. Se le entregan las placas del auto y él se encarga de darlas de baja en el sistema”.

“The third step, with the paid pedimento in hand, is presenting the vehicle at the Mexican customs module, so it can be checked one more time. If everything is fine, they will affix a hologram sticker indicating that the car has been legally authorized to be in the country.”

Eso significa que la autoridad ya ha dado el visto bueno para que la unidad se pueda internar legalmente en el país”.

When leaving the customs premises, the car owner has two options for getting the car to their destination: drive it from the border or send it on a trailer called the Madrina. “If they choose the Madrina, all they need to do is contract the service, agree with the provider on the date of arrival in the destination city and pay. On the other hand, if they decide to drive, they must get a federal road permit, good for only 72 hours. That means you only have three days to get to your destination. The disadvantage of this permit is that it can only be given once.”

Al salir del recinto, el propietario del automóvil que recién comienza a internarse en el país, tiene dos opciones para llegar a su ciudad destino: conducir desde la frontera o mandar la unidad a bordo de un tráiler llamado Madrina. “Si eligen la Madrina, es únicamente contratar el servicio, ponerse de acuerdo con el proveedor en la fecha de llegada a la ciudad destino y pagar. En cambio, si la decisión es conducir, se debe tramitar un permiso federal de camino que únicamente es de 72 horas. Eso significa que solamente tienes tres días para llegar a tu ciudad destino. La desventaja de este permiso es que solamente se puede tramitar una única ocasión”.

When asked whether it is worth going through this whole process or whether it is better to buy a car in Mexico, Cortés replied that in addition to taking into account the economic and sentimental value of the vehicle, other general issues would have to be analyzed, such as whether it meets a specific need (cars with adaptations to transport people with special abilities) or entails other benefits both personal and for the community.

Al preguntarle si aún resulta conveniente hacer todo este proceso o si es mejor comprar un auto en México, Javier Cortés respondió que además de tener en cuenta el valor económico y sentimental del vehículo, se tendrían que analizar otras cuestiones generales como si cumple con una necesidad específica (autos con adecuaciones para transportar personas con capacidades especiales) o conlleva otros beneficios tanto personales como para la comunidad.

Attorney Reynaldo Álvarez explains the importance of the privacy notice and offers some suggestions to safeguard clients’ personal information in the real estate sector.

El abogado Reynaldo Álvarez explica la importancia del aviso de privacidad y ofrece algunas sugerencias para resguardar la información personal de los clientes en el sector inmobiliario.

The privacy notice is a document that can be written, digital or audio. It tells the client the information that will be requested, the objective, the way in which it will be used and with whom it could be or will be shared.

One of the pillars of the relationship between real estate agent and client is trust.

In fact, some industry professionals say that this aspect is the most fundamental and the one on which a successful transaction turns, because the client’s assets and confidential information are in the hands of the agent. Therefore, it is very important to safeguard said data and establish an environment of security and certainty during the purchase-sale process.

Reynaldo Álvarez, director of the firm Álvarez & Asociados Abogados, offered us some recommendations real estate professionals can follow to protect the personal data of their clients and generate a bond of trust. A specialist on the subject, Álvarez advises Puerto Vallarta real estate companies about this and other legal matters. In addition, he is a member and 40

“Definitely, and by the nature of their work, real estate professionals have access to a large amount of a client’s personal data, such as name, age, address, marital status, nationality and banking information or situation, among others. Some personal information is considered to be ‘sensitive,’ because unauthorized use can damage or put at risk the person’s physical or financial integrity, hence, the importance of putting it to good use and protecting it.”

de Particulares (Federal Law on Protection of Personal Data Held by Private Parties), which came into effect in 2010. Its provisions apply to all people and companies that collect or process personal data in the exercise of their activities. Therefore, real estate companies and real estate professionals who work independently are obligated to comply. The body that monitors compliance with this law is the Instituto Nacional de Transparencia, Acceso a la Información y Protección de Datos Personales (INAI) (National Institute of Transparency, Access to Information and Protection of Personal Data).

Thus, a real estate company can collect clients’ personal information for its use, disclosure or storage (indicating the purposes for which it will be used and with the prior consent of the owner). The most important point to act on under this guideline is having a privacy notice.

“The privacy notice is a document that can be written, digital or audio. It tells the client—the holder of the personal data—the information that will be requested, the objective, the way in which it will be used and with whom it could be or will be shared. It also specifies who is responsible for taking care of the client’s personal data, which generally is the legal representative of the company or owner. It is very important that companies or people dedicated to the real estate business have a privacy notice, show it to their clients and make sure they sign it before collecting that information.

Otherwise, a company that makes unauthorized use of it may incur a fine ranging from $8,836 to $14,137,600 pesos, depending on the intent, the damage caused and the size of the company.”

El punto más importante para actuar bajo este lineamiento es contar con un aviso de privacidad.

“El aviso de privacidad es un documento que puede ser escrito, digital o sonoro. Este le indica al cliente —titular de los datos personales— la información que se le solicitará, el objetivo, la manera en que se utilizará y con quién o quiénes se podría o se va a compartir. También se especifica quién es el responsable de cuidar los datos personales del cliente y generalmente esto recae en el representante legal de la empresa o propietario. Es muy importante que las empresas o personas dedicadas al negocio inmobiliario cuenten con un aviso de privacidad, lo muestren a sus clientes y se aseguren de que lo firmen antes de recabar esos datos. De lo contrario, la empresa que haga uso no autorizado de los mismos, puede ser acreedora de una multa que va de los $8 mil 836 pesos a $14 millones 137 mil 600 pesos, dependiendo del dolo, el daño causado y el tamaño de la empresa”.

In addition to the Ley Federal de Protección de Datos Personales en Posesión de Particulares, other correlated regulations related to the real estate industry include the Código Fiscal de la Federación (Fiscal Code of the Federation), the Ley de Extinción de Dominio (Law of Extinction of Domain), the Ley Condominal (Condominium Law) and the Ley Federal para la Prevención e Identificación de Operaciones con Recursos de Procedencia Ilícita (Federal Law for the Prevention and Identification of Operations with Resources of Illicit Origin), so receiving professional advice to gain full knowledge of the implications and how they are interconnected is recommended.

Muchas personas no leen las condiciones que este tipo de aplicaciones establecen para poder usarlas, inclusive algunas veces solo están disponibles en otro idioma, lo que dificulta su pleno entendimiento”.

Comenzó su experiencia profesional en la promoción de artes escénicas en el Departamento de Cultura de la Universidad de Guadalajara en 2013. Su amor por su ciudad natal lo trajo de vuelta a Puerto Vallarta, en donde reside permanentemente y se desempeña como Asistente Editorial en Vallarta Lifestyles Media Group. Amante de la comida mexicana y entusiasta de las redes sociales, continúa su interés en las artes escénicas como miembro de Dionisio, un grupo de teatro local.
