Washington D.C. ablaze with whistleblower talk AND IT’S NOT WHAT YOU THINK Analysis by Patrick McCallister

Probably one of the most sensitive words in Washington D.C. these days is “whistleblower.” But that was all the talk at the House Visitors Center’s room 210 on Tuesday, Oct. 29. The House Committee on Veterans’ Affairs’, Subcommittee on Oversight and Investigations had a hearing about whistleblowers. Titles of such hearings are always more explanatory than artistic. This one was “Protecting Whistleblowers and Promoting Accountability: Is VA Doing its Job?” The question mark at the end left little doubt subcommittee members were already thinking the answer was “no” when they called the hearing. There were only two panelists. One was Navy veteran and doctor of nursing practice Dr. Tamara Bonzanto, assistant secretary for accountability and whistleblower protection at the Department of Veteran Affairs. The other was Michael Missal, the inspector general at the veterans department.

Office of Accountability and Whistleblower Protection Trying to follow developments in the VA’s Office of Accountability and Whistleblower Protection, OAWP, since its creation in October of 2017 is headache inducing. There have been a few congressional hearings, all of them negative, and there have been big changes at the OAWP, including the appointment of Bonzanto late last year to head the office. Last month the Office of the Inspector General issued a report about OAWP that used the words “fail,” “failed” and “failure” more than 50 times. That report generated some bipartisanism on the subcommittee. That is, the chairman and ranking members agreed the report perturbed them. “The (inspector general’s)

findings in this report right here are stark and damning,” Rep. Chris Pappas, chairman, said. “Describing a failure by VA to perform basic mission in investigating allegations and protecting whistleblowers.” The New Hampshire Democrat could have accidently been reading the ranking member’s notes. Rep. Jack Bergman, a Michigan Republican, wasn’t there to comfort OAWP’s leader. “This (Office of the Inspector General) report leaves no doubt that OAWP misinterpreted its statutory mandate. conducted unsound and biased investigations on multiple occasions, and failed to establish safeguards to protect whistleblowers from retaliation,” Bergman said in his opening statements.

note all agree that she inherited a mess created in the first year of OAWP’s existence. It’s also important to note that Missal said the IG’s report covered a lot of the time before she’d taken the helm. In her opening she fessed up to problems at her office and their real-world effects. “The deficiencies in OAWP have had a substantial impact on whistleblowers and VA employees who disclose wrongdoing,” she said. The office is specifically set up to give VA employees the opportunity to report wrongdoing among VA executives and senior managers. Of the department’s about 350,000 employees, around 550 neatly fit that description. Bonzanto said when she took over last year there were nearly 600 whistleblower complaints backlogged. She said that was because the average investigation time was more than 200 days and the work shoddy. Presumably many of those

cases named the same executives and senior managers. Investigations are necessarily blocked from public view. Since taking the office Bonzanto said she’s made one referral to the Secretary of Veteran Affairs, Robert Wilkie, for disciplinary action stemming from whistleblower reports and investigations. Other investigations that made it to her desk, about 40, she kicked back to investigators for additional work. Bonzanto gave the subcommittee lengthy explanations about steps she’s taken to improve the quality and speed of the investigations, which included outsourced investigation training to OAWP staff, who, it turns out, mostly have human-resources backgrounds. Letter to the EDITOR Corps of Engineers dragging their feet on waterways report To the Editor: As of this week, it’s been a year since we authorized the EAA southern storage reservoir. The law included a requirement for the Corps to submit a report to Congress 90 days later and that report still hasn’t been finished. This delay by the Army Corps is unacceptable and blatantly disregards Congressional directives.

Brian Mast The South Florida Water Management District and the State of Florida have accelerated completion of their responsibilities surrounding the planning and design of this critical project, and it’s well-past time for the Army Corps

to do the same. Senator Marco Rubio and I are working hard to urge the Corps to expedite this critical infrastructure project, cut through red tape and finally get this project under way. Our communities have waited long enough - it’s time to get this done! In case you missed it, here are a few other things that happened this week: I joined the Ocean Conservatory to discuss our ongoing fight to preserve our coastlines and protect our waterways. I urged the Foreign Affairs Committee to get to work on an Authorized Use of Force defining our objectives in Syria. I’m a veteran, but I’m not fit to shine the boots of those who gave their lives in combat, whether making the ultimate sacrifice or coming home forever changed. I served during the Cold War, having grown up “ducking and covering” under my school desk once a month. In peacetime, there was always the threat of war, but I didn’t have to put my life on the line. It took a long time to realize that all veterans signed on the dotted line — the “blank check up to, and including, my life” — are allowed to reflect on the fact that whether they were in the line of fire or not, they served. Shifting materiel from place to place. Feeding the servicemembers. Caring for their health. In my case, telling their stories so that they weren’t forgotten. When I think of veterans, I think of the families, friends and loved ones who sweated tears and blood for their veteran, cared for them, agonized over them, kept the

home together under impossible odds. So, I’m thankful Veterans Day is still observed, with grace and reverence. And it made me wonder, how Veterans Day came to be.

The most hideous conflict The “War to end all wars” was beyond belief. Even today, there are no words to describe it. Our doughboys came into it fairly late, but they experienced what their British and French allies did — non-stop artillery barrages on a scale of minor atomic bombs blasting them day and night. They huddled in the mud, their ears destroyed, everything around them disintegrating and flying through the air. Shrapnel ripping through them. When the barrages took a break, there were rats, lice, trench foot, gangrene, rotten food to eat. Then, they were asked to “go over the top” to attack the enemy, right into murderous machine gun fire. The shooting lasted right up to the time allotted for ending hostilities. Afterward, an eerie silence fell

Actors, producers reflect on iconic battle they are portraying in film to be released Nov. 8 David Vergun

In the early hours of June 4, 1942, four Japanese aircraft carriers led the attack on the U.S. base on Midway Island just six months after their attack on Pearl Harbor, Hawaii. Unbeknownst to the Japanese, American cryptographers had cracked the enemy’s communication code and were aware of the date and approximate location of the attack beforehand. U.S. carriers quickly moved in, sinking four Japanese aircraft carriers. One U.S. carrier was lost. The victory stopped the advance of the Japanese in the Pacific Ocean and marked a major defeat for the empire.

Movie to Mark Pivotal Battle On Nov. 8 — right before Veterans Day — Hollywood Pplans to release the movie,

“Midway.” It was directed by Roland Emmerich, who previously directed “Independence Day,” “The Patriot,” “White House Down” and other films. A screening took place with service members on Ford Island in Honolulu. That’s the location of Battleship Row, which sustained some of the worst damage during the attack on Pearl Harbor. Actor Luke Kleintank plays Navy Lt. Clarence Earle Dickinson Jr., a scout pilot and executive officer of Scouting Squadron 6 aboard the aircraft carrier USS Enterprise. Dickinson was part of the squadron that first sighted the Japanese fleet near Midway, June 4, 1942. Actor Ed Skrein plays Navy Lt. Richard “Dick” Best, who led a dive bomber squadron that sank one Japanese aircraft carrier and potentially damaged another in the battle. Actor Patrick Wilson plays Navy Lt. Cmdr. Edwin Layton, the intelligence officer who

discovered the plan to attack Midway by decoding Japanese messages.

How ‘Midway’ Was Made The battle scenes for the movie were actually shot in a large hangar in Montreal, Canada, said Skrein. Inside the hangar were models that were 80 percent of the size of the aircraft carrier USS Enterprise — only one-third of the carrier was made into a model because that’s what would fit into the hanger. Dozens of planes also made into models that were 80 percent of their actual size. Skrein said the set included giant wind and rain machines to simulate the weather. The machines even make it rain sideways, which he said made it a challenge not to be blown overboard. Skrein said the rest of the movie was shot in and around Ford Island. Wilson said a good deal of

computer-generated imagery and visual effects went into the movie to make it more affordable. For instance, the sinking of the battleship USS Arizona was computer-generated imagery. The producer and director wanted to make “Midway” as detailed and historically accurate as possible, but it’s not a documentary, so it was made to be as dramatic and exciting as possible, said Wilson.

Getting Into Their Roles Wilson and Kleintank said they learned a lot about their characters from the books that were written by them. Layton wrote “And I Was There: Pearl Harbor and Midway — Breaking the Secrets,” and Dickinson wrote “The Flying Guns: Cockpit Record of a Naval Pilot From Pearl Harbor Through Midway.”

Rep. Michael Waltz is a Green Beret serving in the National Guard as he serves in Congress, too. Even a man like him has heroes. One is Oviedo’s son Sgt. 1st Class Alwyn C. “Al” Cashe. “Sgt. Cashe is a bit of a legend in Army circles,” Waltz told Veteran Voice. Waltz and two other representatives are asking the Department of Defense to reconsider Cashe’s Silver Star. They believe it should be a Medal of Honor. Those representatives are Central Florida’s Stephanie Murphy and Texas’ Dan Crenshaw.

Sgt. 1st Class Alwyn C. Cashe In 2005 Cashe was a veteran of the Gulf War, the Bosnian War and a prior tour in Operation Iraqi Freedom. On Oct. 17 that year, he was on patrol as a gunner in a Bradley Armored Fighting Vehicle. An IED hit the vehicle. What’s uncertain is whether the IED was pressure triggered, or remotely ignited. What’s certain is the vehicle’s fuel cell ignited and exploded. As the patrol came under enemy small-arms fire, flames and fuel burst everywhere and rushed through the Bradley. Cashe, remarkably, was for the most part unhurt and free to escape the flames and hide from enemy fire. His uniform had diesel fuel on it — he needed to get away from the flames. Still, Cashe opted instead of getting to safety alone to get and take the driver with him. That’d been heroism in itself. Cashe wasn’t done. There were seven more in the vehicle — six soldiers and an interpreter. Cashe rushed back to the burning Bradley.

The hatch burst open. One inside the inferno managed to get that far. Cashe rushed into the flames and thrust his hand inside the open hatch for the next soldier to grab. Although aflame himself and under fire, Cashe repeated the exercise and pulled soldier after soldier out. The Bradley behind Cashe’s engaged the enemy as he rescued the soldiers in his. His heroism wasn’t done. Although he had serious burns over 80 percent of his body, the sergeant refused medical treatment until all others were cared for first. Sadly, three later died despite Cashe’s sacrifices. The injured were transported to Brooks Army Medical Center, San Antonio, Texas. That’s where Cashe died on Nov. 8.

He received the Silver Star. Still, the Seminole County man would never again fish in Lake Jesup, or swim at Wekiwa Springs. Or go boating on the St. Johns River. Or any of the many things he surely did before joining the Army in 1988. But, just as he is a “legend in Army circles,” Cashe is a legend around his old stomping grounds.

district when the longstanding facility was renamed. That was 2014. He was on hand at the renaming ceremony to unveil the plaque with Cashe’s mother, Ruby May Cashe. The Republican Mica wanted Cashe to receive the Medal of Honor. So did then Rep. Corrine Brown, a Democrat whose district included parts of Volusia just north of Cashe’s hometown. Mica lost his seat to challenger Stephanie Murphy in the 2016 election. She won reelection in 2018 when Republican Waltz won the seat just north of hers. Now those two with help from Rep. Dan Crenshaw — a Navy SEAL — are continuing the congressional push for the

appearance at the hearing — he’s not on the subcommittee — to ask Bonzanto questions. He wasn’t impressed with the answers. The company hired to do the investigations training, all evidence suggests, did a poor job. “Let me get this straight,” Takano said to Bonzanto. “You’re not able to do your job, because you’re concerned about the quality of your office’s work. You have many staff that have been assigned to perform investigations that they have no experience conducting. You tried to get your staff quickly trained, but the contractor you

paid simply pulled from Wikipedia and other online sources instead of developing useful, detailed training materials.” Other Democrats and Republicans on the subcommittee were more empathetic to Bonzanto, although it was clear all wanted problems with implementing the Accountability and Whistleblower Protection Act of 2017 fixed yesterday.

Why does it matter? The origins of the 2017 law can be found in the VA wait time scandal that rocked the veterans community in 2014 and cost then veterans affairs secretary Eric Shinseki his job. Congress enacted some whistleblower protections and executive accountability provisions

Armistice Day At the 11th hour, on the 11th day of November, 1918, armistice was declared. The troops who died were buried in honor in France. Those who lived went home. To many, it was almost as if such mind-numbing devastation had never happened. The veterans thought differently, though it took them some time to find their voice. In November 1919, President Wilson declared that Nov. 11 would be set aside as commemorating Armistice Day, with the idea that communities would stop business at 11 a.m. and perhaps conduct services and parades. It wasn’t until 1926 that Congress got around to declaring Nov. 11 to be a legal holiday, having been approved by 27 states. This was due to unrelenting lobbying by veterans’ groups determined to get recognition for their comrades. In May of 1938, Congress approved an act that made Armistice Day a federal holiday. But it wasn’t until 1954, after the Korean War and all its sacrifices, that President Dwight Eisenhower redesignated Armistice Day to Veterans Day.

A federal appeals court struck down parts of that law after Phoenix VA Medical Center director Sharon Helman challenged her 2015 termination. The 2017 law was supposed to resolve the issues leading to that judicial decision. President Donald Trump signed the VA Accountability and Whistleblower Protection Act of 2017 on June 23, that year and touted it as a success in the 2018 State of the Union Address. “Last year, the Congress passed, and I signed, the landmark VA Accountability Act,” he said in that speech. “Since its passage, my administration has already removed more than 1,500 VA employees who failed to give our veterans the care they deserve — and we are

But all that comes with designating an official holiday muddied up the works. Who gets what day off? When do flags fly? Should businesses close? Those were some of the issues delaying the official start.

Uniform Holiday Bill According to va.gov: “The Uniform Holiday Bill (Public Law 90-363 (82 Stat. 250)) was signed on June 28, 1968, and was intended to ensure three-day weekends for Federal employees by celebrating four national holidays on Mondays: Washington’s Birthday, Memorial Day, Veterans Day, and Columbus Day. It was thought that these extended weekends would encourage travel, recreational and cultural activities and stimulate greater industrial and commercial production. Many states did not agree with this decision and continued to celebrate the holidays on their original dates. “The first Veterans Day under the new law was observed with much confusion on October 25, 1971. It was quite apparent that the commemoration of this day was a matter of historic and patriotic significance to a great number of our citizens, and so on September 20th, 1975, President Gerald R. Ford signed Public Law 94-97 (89 Stat. 479), which returned the annual observance of Veterans Day to its original date of November 11, be-

Bonzanto assured the subcommittee she knows that fact well. “As a veteran and a nurse, I also know the impact whistleblowers have on an organization when they bring information forward that can really change the operations of the organization,” she said. Bonzanto added, “I know — I’m equally as frustrated I couldn’t put recommendations (for disciplinary actions) forward, more than one, but that just shows we need to improve.”

Serving then, serving now Veterans had done the job of making the government do what it had been elected for. Countless American Legion posts, chapters of Marines, Veterans of Foreign Wars, AMVETS, hundreds of thousands of veterans. All of which leads us to today. Throughout the Veteran Voice readership, and throughout our country, Veterans Day will always be one of our keystones. The veterans of Iraq and Afghanistan, who have had to serve in hell no less than the original World War I troops, are as honored as they. Today, their families, and communities, are more tied into them, and deserving of the same honor. Hundreds of thousands of patriots have never forgotten their loved ones who died, or their loved ones who came home broken, or those that are still serving in Hell. Just do an internet search on “helping our troops” to find out the many, many ways our troops are being helped. It will brighten your day, and maybe even spur you to give in your own small way. At the least, just remember them on Veterans Day.

DoD to consider Cashe for the nation’s highest military honor for valor.

War on Terrorism and the Medal of Honor There was a seemingly low number of awards of the Medal of Honor stemming from actions done in support of operations Enduring and Iraqi Freedom. From 2001 to 2010 only seven had been awarded the nation’s highest military valor honor. That low number caught the attention of members of Congress who spoke out about it. From 2010 to 2015, an additional 10 were recommended for and received the Medal of Honor for actions done in support of operations in Afghanistan and Iraq. In 2016 then Secretary of Defense Ash Carter ordered reviews of about 1,400 who’d received the Distinguished Service Cross, Navy Cross, Air Force Cross and Silver Star since Sept. 11, 2001. The review is supposed to wrap up at the end of this year. The Congressional Medal of Honor Society lists 23 recipients of the recognition for valor from military operations since 2001. Of those 17 are from the war in Afghanistan. Six from Iraq. Something else is striking and deserves mention when talking about Cashe. None of the war on terrorism Medal of Honor recipients are black. That’s not a historic first. A 1993 study found seven black World War II veterans who’d likely been wrongly denied the Medal of Honor. President Bill Clinton presented those medals in 1997. Before then there were no black Medal of Honor recipients from World War II.

In 2002 Congress directed the military to review thousands of military records to see if there was evidence past generations of service members were possibly denied the Medal of Honor due to racial prejudices. Because of that review, in 2014 President Barack Obama presented 24 Army veterans from World War II, the Korean War and the Vietnam War the Medal of Honor. One was Fort Pierce’s Sgt. Ardie R. Copas for whom the Florida Cabinet named an under-construction state veterans nursing home in Port St. Lucie. He received the recognition posthumously. Anoth-

er was Sgt. 1st Class Melvin Morris, who lives in Brevard County. About 3,500 have received the Medal of Honor since it was first awarded in 1863. About 100 of the recipients are black. Of those, 25 are from the Civil War and another eight from peacetime heroism before the 20th century. Six blacks received the Medal of Honor for actions done during the Spanish-American War, 1898.

of Defense Mark Esper on Oct. 17, the 13th anniversary of Cashe’s heroic actions asking him to ensure reconsideration of the Silver Star. “(Cashe) was relatively unharmed, but his uniform was soaked in diesel fuel,” Waltz told Veteran Voice. He continued, “To run back into a fire repeatedly—” Waltz audibly inhaled. “It was truly above and beyond the call of duty,” he continued. The congressman added, “I’ve seen this type of heroism first hand. My heroes wear camouflage not capes.”

‘Healing Our Heroes’ Vero Beach church to host 3 days of healing, praise over Veteran’s Day weekend ST. PAUL’S CHURCH, VERO BEACH

Fulfilling its commitment to honor and serve local veterans throughout the community, St. Paul’s Church, Vero Beach, will host “Healing Our Heroes,” a healing conference led by the Rev. Nigel Mumford. The three-day event is being held in collaboration with the Military Mom’s Prayer Group from Friday, Nov. 8 to Sunday, Nov. 10. Senior Pastor of St. Paul’s Church, the Rev. Jonathan G. Robbins said, “Our love of veterans is steadfast. We have been called by the Lord to offer healing to our heroes throughout Indian River County and surrounding communities, especially those who are suffering from Post-Traumatic Stress.” The event kicks off on Friday with a barbecue and bluegrass music from 5 to 7:30 p.m. At 7:30, attendees will be introduced to the Reverend Mumford, the Conference Facilitator. Mumford, born in England, is a six-year veteran of Her Majesty’s Royal Marine Commandos. Since then, he served in a healing ministry for over 28 years. He

visited Pearl Harbor Aviation Museum on Ford Island, where they got to sit inside an SBD Dauntless, a scout plane and dive bomber used at Midway. They also got to see Japanese Mitsubishi A6M Zero fighters at the museum. Also, a dialect coach helped Skrein exchange his British accent for a New Jersey accent, which Best already had.

A Moving Experience Wilson said most people probably haven’t heard of the Battle of Midway. “We were happy to honor these guys who sacrificed so much.” In particular, Wilson said the movie shows the importance of those who support the frontline warfighters, such as naval intelligence personnel, who deserve a lot of credit for the battle’s success.

State Sen. Gayle Harrell presented a bill to permanently fund the Florida Veterans Support Line. That was at the last meeting of the Florida Senate Committee on Military and Veterans Affairs and Space. “What this bill does is build on a pilot that we did several years ago,” Harrell told her fellow committee members. “In 2014 we passed a bill that established the (Florida Veterans Support Line).” The committee unanimously approved passing the bill to its next step — the Children, Families and Elder Affairs committee. At press time that committee hasn’t scheduled it for a hearing. Harrell represents Martin and St. Lucie counties. Sen. Tom Wright, who represents parts of Volusia and Brevard counties and is the chairman of the state senate’s veterans affairs committee, co-sponsored the bill.

Senate Bill 104 If the bill — which doesn’t yet have a companion in the House — passes the Florida Legislature during the 2020 session, and the governor signs it, SB104 will require that the Florida Department of Veteran Affairs create a program “to provide veterans and their families…behavioral health care referral services primarily for mental health and substance abuse.”

That would be by the state veterans department contracting with “a nonprofit entity that has statewide phone capacity to serve veterans and is accredited by the Council on Accreditation and fully accredited by the Alliance of Information and Referral Services.” That contracting agency would, in turn, enter into agreements with Florida 211 Network participants. There are 13 in the state. As Harrell mentioned, all this has been done starting in 2014. The primary change in the bill is making it permanent. And cash. Harrell’s bill appropriates an annual recurring cost of $2 million from the state’s general revenue to fund the Florida Veterans Support Line.

Florida Veterans Support Line The Crisis Center of Tampa Bay has run the Florida Veterans Support Line, 1-844-MyFLVet, for about five years. However, it started as a statewide service, then became regional to the Tampa Bay area, then went temporarily statewide again last year with grants from the federal Department of Veteran Affairs and others. The Florida Veterans Support Line is essentially 211 for veterans. The difference that makes a difference, supporters say, is at its core the support line has veterans knowledgeable about veterans programs answering veterans’ calls. “We’ve had a very successful model over the years,” Harrell said.

She said part of the bill also established follow up after veterans’ calls. That is calling the veterans back to ensure they’ve acted on referrals.

Bill’s reception About a dozen members of the public showed up at the meeting to support the bill. Almost all waived their public-comment time in support of the bill. Dan Hendrickson, president of the Tallahassee Veterans Legal Collaborative, opted to speak. “At our clinic (legal) last week, a veteran came in with two legal problems,” Hendrickson told the committee. As collaborative members worked with the veteran, he expressed suicidal ideation and general depression. Hendrickson said he was sure the veteran spoke candidly, because he felt that he was in a supportive place. Collaborative workers were able to keep the veteran at the office as they sought other services for him. Hendrickson said the collaborative has called the veteran to make sure he’s getting in other services. “It’s really important about the follow up Sen. Harrell talked about,” Hendrickson said.
