Congressman seeks to improve VA’s handling of MST Survivor disability exams eyed in bid to push partnership with top research agency Patrick McCallister FOR VETERAN VOICE

Rep. Troy Nehls wants to get the National Academies of Science, Engineering, and Medicine to help the Department of Veterans Affairs. Specifically, he filed H.R. 6064, which if passed by Congress and signed by the president would make the Secretary of Veterans Affairs get the research foundation to study how the VA handles military sexual trauma, or MST, claims. Nehls presented his bill at a March 29 hearing of the House Committee on Veterans Affairs Subcommittee on Disability Assistance and Memorial Affairs. Nehls — a Texas Republican — is the ranking member on the subcommittee. “During a hearing, we heard that applying for disability benefits due to MST can often be stressful and retraumatizing for Veterans,” said Nehls. “I believe improvements are needed to ensure that these Veterans feel comfortable filing a claim including when they receive a disability exam. That is why my bill would require VA to partner with the National Academies of Sciences, Engineering and Medicine to review these exams. This study would help ensure that exams are conducted in a sensitive manner and identify alternatives if the Veteran does not wish to undergo an exam due to experiencing MST.” Nehls was referring to a joint hearing of the Veterans affairs subcommittees on health and disability assistance about the VA’s performance with MST survivors. That was on Nov. 17 last year. At that hearing the Veterans of Foreign Wars and others detailed problems MST survivors encountered when making VA claims. In written testimony
the VFW explained— “It has frequently been reported that Veterans perceive exams conducted by the Veterans Health Administration (VHA) as inadequate and that they more often result in claim denials. While there is some positive feedback on contract exams, complaints include that the exams are very brief (sometimes only fifteen minutes), Veterans feel they were not being heard or believed as a victim of MST by the examiners, and that the examiners do not understand military culture.”
Rep. Troy Nehls In his bill presentation, Nehls said he was disturbed by testimony at the November joint hearing that MST survivors were retraumatized by the claims process. “No Veteran should leave an exam feeling distressed, and we must find better ways for examiners to conduct them,” he told fellow subcommittee members. “I also heard concerns that (Disability Benefits Questionnaires) are inadequate for diagnosing conditions linked to MST. Therefore, the National Academies would also determine whether VA’s ratings schedule and DBQs are up to date for MST related disabilities.” The representative later added, “It is unacceptable that MST survivors don’t trust VA’s claim process. I believe the National Academies have the expertise to provide answers to these questions and solutions where VA is falling short of these Veterans’ needs.” The National Academies, founded in 1863, is not funded by congressional appropriations, but through its National Research Council gets governmental grants and study contracts. It’s also funded by private sources, but doing research for the federal government is by far its greatest revenue source.

and oversight at the Veterans Benefits Administration, in written testimony said the VA opposes the bill. Nehls pressed her on that. “My staff consulted with the National Academies on the language for H.R. 6064,” he said. “The National Academies believed they had the ability and expertise to conduct this study. Especially since it is similar to the report the National Academies completed on traumatic brain injury claims in 2019. Is VA’s testimony trying to tell me that a panel of medical experts does not have the knowledge needed to identify improvements to the way VA diagnoses MST-related conditions?” Ogilvie reiterated the opposition stated in the written testimony. “VA exams require that the examiner, regardless of clinical specialty, is VA trained and certified in VA compensation and pension disability exam process,” she told Nehls. “So, VBA has concerns with any independent reviewer of VA disability exams by clinicians who are not trained and certified to fully understand the intricacies of these examinations. There’s a difference between medical treatment and examinations for disability purposes. So, VA has some concerns with how the National Academies of Sciences — while I’m sure they are very capable of making medical determinations — we’re concerned about how they would make a determination of the adequacy of the tools and protocols used when we’re talking about what’s needed for ratings for disability claims.” The answer didn’t satisfy Nehls. “Fair enough, but during the (Disability Assistance Memorial
Veterans of Foreign Wars/ American Legion Later in the hearing, Nehls asked Tammy Barlet and Mario Marquez, representatives from the VFW and American Legion, about their organizations’ take on H.R. 6064. Bartlet is the deputy director of the national legislative service at the VFW. Marquez is the director of national security at the Legion. “Why does the VFW support H.R. 6064, which would authorize a National Academies’ review of disability exams for conditions related to MST?” Nehls asked Barlet. “It would give us an insight to some of the issues in the process,” she answered. “So, getting that outside looking in view will help not just only process the claims faster, but also make sure it’s clear that the VA is going through with better processes and the training moving forward.” Nehls offered Marquez a chance to answer for the American Legion. “The National Academies for Science, Engineering and Medicine is a premier organization that we trust and frequently rely on for evidence and research that we use in our testimonies,” he said. “They’re involved and have been involved in several VA initiatives and assessments. And specifically presumptive disability processes is one of them. We believe that their experience in outside point of view, while being experts in the field, will provide the MST process a good view that can provide unaffected internal points of view that can be implemented moving forward.”

For succeeding in rising to the challenge and developing environmental models that can help protect the cranes in multiple states, the Nebraska ARNG was awarded the 2022 Secretary of the Army Environmental Award for its Natural Resource Conservation team. “Protecting cranes protects the mission,” said Larry Vrtiska, Nebraska Military Department Environmental Program Manager, citing the formation of the Crane Protection Team with Nebraska ARNG, U.S. Geological Survey and the private Crane Trust, which led planning and modeling efforts to mitigate potential conflicts. “These models not only enable military training but also any other activities on state or federal lands within the migration corridor. This work is validation that conservation and training activities can be compatible.”
U.S. ARMY ENVIRONMENTAL COMMAND
For eons, majestic whooping crane, perhaps the best-known endangered species, have migrated in great flocks from Canada to the Gulf of Mexico and back again. A critical stopover in this migratory pattern is the Platte River in Nebraska. This area also happens to be where the Nebraska Army National Guard conducts critical aviation exercises – vital training needed to ensure readiness. The challenge? Protect the endangered cranes and other migratory species while eliminating the conflicts the training exercises could cause if not timed, managed and planned comprehensively. Along with the sandhill crane, the whooping crane is one of only two crane species native to North America. This crane’s lifespan is estimated to be 22 to 24 years in the wild. After being pushed to the brink of extinction by unregulated hunting and loss of habitat to just 21 wild and two captive whooping cranes by 1941, conservation efforts have led to a limited

into account along the entire migration path through multiple states. This information enabled the Nebraska ARNG to plan its training flight paths and aviation exercises to minimize the likelihood of interaction with migrating birds. “The size and scope of the migration corridor meant that in many instances, mitigation practices were being required to protect cranes, even when the likelihood of contact was exceedingly low,” said Vrtiska. “By developing the predictive model, the team is allowing Nebraska ARNG to assess relative risk for whooping crane encounters with a degree of accuracy never before possible.”
Protecting habitat The Nebraska ARNG also partnered with the Crane Trust to enhance habitat in key sites around 357 acres of trust-owned lands. The Crane Protection Team led efforts to bury 2.7 miles of power lines along the Platte River corridor. Power lines are the No. 1 killer of whooping cranes and other birds, including sandhill cranes, piping plovers and least terns. The team also conducted disking of sandbars on approximately 300 acres, removing vegetation to allow for sandbar mobility and formation. Sandbars provide roosting habitat for whooping cranes and breeding habitat for terns and plovers with natural protection from
predators and human disturbance. The team then removed approximately 57 acres of undesirable woody plant species encroaching on river roosting habitat, particularly invasive cedar, which benefits cranes and grassland nesting birds, migratory waterfowl and Regal Fritillary and Monarch butterflies.
Bringing people into the mix And there’s more under discussion in Nebraska ARNG’s quest to be effective environmental stewards while never losing sight of its mission. “A feasibility study will be completed this year for construction of viewing platforms for people to see the cranes. The platform would include educational displays about the military support of conservation and the NEARNG’s role in improving crane habitat,” said Brice Krohn, Crane Trust president, adding that the Crane Protection Team is looking for other innovative ways to blend conservation and training needs. “One idea is using helicopters to practice forward-looking infrared equipment by conducting deer and bison surveys. The crane team’s relationship with the Crane Trust is opening doors for even more ambitious efforts toward shared conservation goals throughout the state.”

On April 6, 1862, Col. Augustus Mersy, commander of the 9th Illinois Regiment (Volunteer Infantry), did not mince words to his troops as Confederate Soldiers launched a surprise attack at Pittsburg Landing, Tenn. “There’s going to be plenty of fighting today,” he said. “There is no room for cowards.” And fighting there was. More than 1,700 Union Soldiers, and an equal number of Confederate Soldiers, lay killed on the fields around Shiloh Southern Methodist Church, for which the battle was named. The dead included the Confederate Army commander, Albert Sidney Johnston. Maj. Gen. Ulysses S. Grant was quoted as saying: “I saw an open field, in our possession on the second day, over which the Confederates had made repeated charges the day before, so covered with dead that it would have been possible to walk across the clearing, in any direction, stepping on dead bodies, without a foot touching the ground.”
Background The idea was for the Army of the Tennessee, under Grant’s command, would hook up with the Army of the Ohio, commanded by Maj. Gen. Don Carlos Buell, and together push through Confederate defenses into Mississippi, eventually capturing the city of Vicksburg and control of the Mississippi River. Grant had made a name for himself already. He had a bad reputation for drinking among the officers, who never missed a chance to gossip among themselves. But he had achieved victories in February at Fort Henry, Tenn., and Fort Donelson, where he earned the nickname “Unconditional Surrender Grant.” Gen. George McClellan, on the other hand, in charge of the Army of the Potomac in the East, had proved a sad disappointment to President Abraham Lincoln. Time and time again McClellan, though having the superior number of forces, failed to press the advantage in battle. He was demoted from General of the Union Army to the Potomac position. Lincoln, a Western man himself, heard of Grant’s Western victories and educated himself on the general’s capabilities. Officers whispered in Lincoln’s ear that Grant was no good. Lincoln replied simply, “I like him. He fights.”
The Battle Some historians say Grant’s policy of troop encampment led to more casualties than necessary. Grant favored bivouacking rather than digging defensive entrenchments. His was always a view toward the offensive. But the losses were bitter, and taught

Johnston had been killed, leaving the Confederate troops in the charge of Gen. Pierre Gustave Beauregard. Grant himself narrowly avoided death when a Confederate ball struck the scabbard of his sword, breaking it, but he was able to ride to safety, along with two other officers.
Aftermath, and the way ahead By dusk on the 7th, Beauregard, realizing that he had lost the initiative, was low on ammunition and food, and had more than 10,000 of his men killed, wounded, or missing, could go no further. He withdrew beyond Shiloh Church, leaving 5,000 men as a covering force, and massed Confederate batteries at the church and on the ridge south of Shiloh Branch. Confederate forces kept the Union men in position on the Corinth Road until 5 p.m., then began an orderly withdrawal southwest to Corinth, Miss. The exhausted Union Soldiers did not pursue much farther than their original encampments. According to battlefields.org: “The loss of life on both sides at Shiloh — which, ironically, means place of peace in Hebrew — was staggering. But there were other sad consequences of the battle as well. “Johnston’s death was a damaging blow to Confederate morale, particularly for President Jefferson Davis, who held Johnston high in personal and professional esteem. “After the war, Davis wrote, ‘When Sidney Johnston fell, it was the turning point of our fate; for we had no other hand to take up his work in the West.’”

Veterans subcommittee considers deportation prevention Noncitizens who served in armed forces need further consideration, lawmaker says by Patrick McCallister • For Veteran Voice • pmccallister@veteranvoiceweekly.com Rep. Mark Takano, chairman of the House Committee on Veterans Affairs, has two bills in Congress aimed at preventing the deportation of Veterans. They’re H.R. 1182 and H.R. 1183. He presented the bills to the Subcommittee on Disability Assistance and Memorial Affairs at a March 29 legislative hearing. “The Department of Defense stated that between fiscal years 2013, 2018 roughly 44,000 noncitizens served in our armed forces alone,” the California Democrat told the subcommittee. “Many noncitizen Veterans return from deployment and subsequently live with mental conditions related to their service, including post-traumatic stress disorder, PTSD. And this disorder typically triggers issues with substance abuse as a means of escape. “Many Veterans choose a path of substance abuse as a means to cope with the symptoms of their disorder which directly stem from their military service. Other issues such as aggression, anxiety, and thoughts of suicide often plague the Veteran upon separation from service, and can directly land Veterans in legal trouble and on the pathway to deportation.” Immigrant Veterans advocates say the expanded definition of an “aggravated felony” in the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 greatly raises the risk of
deportation for those who commit routine, low-level crimes that are often handled in Veterans treatments courts under other circumstances. Under the 1990s expanded definition, any criminal offense that can result in a one year or longer jail or prison sentence is, in immigration law, an aggravated felony. There are various numbers put forward for how many noncitizen servicemembers and Veterans have been deported. National Public Radio reported that the Government Accountability Office found 92 Veterans were deported in the same 2013 to 2018 timeframe Takano broached in his testimony. However, NPR’s reporting continues, various groups and researchers think the number of deported Veterans in those five years alone is much higher than 92.
American Legion Mario Marquez, director of national security at the American Legion, offered the subcommittee personal testimony about the rigors for noncitizen servicemembers to gain naturalization. “I’d like to begin by stating that I am a retired Marine sergeant major and combat Veteran with over 31 years of service,” said Marquez. “My family and I immigrated from Mexico in 1974 and I was raised to appreciate the opportunities this nation could provide us in the form of
the American Dream. As a result, I felt that as the eldest son it was my duty to take the oath to protect and defend the Constitution of the United States of America against all enemies foreign and domestic.” Marquez talked about being sent to Japan early in his military career. “Discussions about citizenship revolved around the difficulties in applying from an overseas location, so I was advised by many to wait until I returned to the U.S.,” he said. “At the end of that tour, I married my Japanese fiancé and she was granted a humanitarian parole to accompany me. After filing for citizenship in California, faced with an intense deployment schedule and a two-hour drive to the nearest immigration office, I was subjected to cancelled or missed appointments and lost paperwork. The struggle to obtain my citizenship lasted almost three years.” Shortly before deploying to Iraq Marquez got word his wife had missed an appointment and was facing deportation. The humanitarian parole immigration status is temporary. The Marine turned to members of Congress for help. “I immediately contacted my congressman in California, (Rep.) Ed Royce, and then in succession (Rep. Loretta Sanchez), who was able to assist my wife in obtaining her permanent residence,” he said. “I then
headed off to combat shortly thereafter, but I was at peace knowing my wife would be taken care of.” Marquez said noncitizens serving in uniform today have it harder than he did. “Citizenship assistance programs have faded from military bases,” he said. “U.S. Veterans from other nations are serving honorably and discharging as resident alien noncitizens. They come out confused — why did their service not bring them citizenship, let alone expedited citizenship they believed was promised to them? And then in the worst cases they are deported and disconnected from the (Department of Veterans Affairs) benefits that they earned.”
Rep. Raul Ruiz Later in the meeting, Rep. Raul Ruiz, a California Democrat, said the deportation of Veterans is a longstanding issue with the Congressional Hispanic Caucus. He’s the chairman of that caucus in addition to being a member on the Subcommittee on Disability Assistance and Memorial Affairs. “They risk their lives for our country, fought for our country,” he said at the hearing. “They deserve and earned to stay in our country. The seasonally adjusted national unemployment rate for Veterans was 2.4 percent in March, which was down from 3.1 percent in February. That matches the national unemployment rate for Veterans in April of 2019, the decade low. Veterans unemployment has been in the 2 percents eight times since 2012. Five of those times were in ‘19. For the last five months Veterans unemployment has been less than 4 percent. For the last 11 months, it’s been less than 5 percent. The March seasonally adjusted unemployment rate among adult non-Veterans was 3.7 percent, which was down from 3.8 percent in February. The unemployment rate among non-Veterans has been less than 4 percent for four months. It’s been less than 5 percent for seven. Veterans have consistently had overall lower unemployment rates than non-Veterans throughout the SARS-CoV-2/ COVID-19 pandemic and its aftermath. The Bureau of Labor Statistics released the monthly jobs report on April 1. Seasonal adjustment is a statistical tool to even out normal monthly employment fluctuations.
Overall not seasonally adjusted Veterans employment Veterans, all cohorts taken together, had a not seasonally adjusted unemployment rate of 2.4 percent in March, which was down from 3.2 percent in February. The Veterans labor force participation rate increased from 48.6 to 48.7 percent from February to March. The non-Veterans’ labor force participation rate went from 64.7 to 64.9 percent in the same timeframe. The non-Veteran not seasonally adjusted unemployment rate was 3.8 percent.
Veterans employment by cohorts The way the bureau reports employment numbers there are several ways to look at different cohorts of Veterans. For example, women Veterans had a 1.7 percent not seasonally adjusted unemployment rate in March compared to the Veteran men having 2.5 percent. Non-Veteran women had a 3.4 percent not seasonally adjusted unemployment rate in March, which was lower than the 4.1 percent for non-Veteran men. The youngest cohort of Veterans, which the BLS designates as “Gulf War-era II,” had a not seasonally adjusted unemploy-

ment rate of 3 percent, which was down from the prior month, 3.2. Most know this group as “Post 9-11” and most in it are, in demographer parlance, Millennials, although a growing number of Gen-Z, Zoomers, Veterans are in the cohort. The men in this cohort were at 3.2 percent unemployment. The women 1.8 percent. The bureau’s Gulf War-era I Veterans, generally Gen-Xers, had a March unemployment rate at 1.4 percent. The men were at 1.4 percent. The women were at .8. The BLS classes together Vietnam-era to World War II-era Veterans. Obviously, there are likely almost no World War II and few Korean War Veterans in the workplace. This grouping, for employment purposes, is almost all Vietnam-era Veterans, Baby Boomers. The older Veterans, according to BLS, had a 3.6 percent unemployment rate in March. There BLS doesn’t offer employment information for women in this age group. The cohort the bureau identifies as “Veterans of other service periods,” includes disparate years ranging from the 1950s to 1980s. This cohort had a 2.1 percent unemployment rate in March.
Local employment The Florida Department of Economic Opportunity releases the states’ jobs report two weeks after the BLS national report. It doesn’t have Veterans-specific information, or county-level seasonal adjustment. As of February, the not seasonally adjusted unemployment rates in the Veteran Voice coverage area were: Volusia 3.3; Seminole 2.8; Brevard 2.9; Indian River 3.4; St. Lucie 3.5; and Martin 2.6 percent. In February Florida’s not seasonally adjusted unemployment rate was 3.1 percent. The national not seasonally adjusted rate was 4.1 percent. With seasonal adjustment
Florida’s unemployment rate was 3.3 percent.
How unemployment numbers work The national and state unemployment rates are calculated using a variety of methods. Among them are random telephone interviews with people in working ages. In general times, those that are able to work and report not having jobs, but looked for employment in the previous 30 days, are counted as unemployed. Discouraged workers — those who are able to work and want jobs, but have not sought employment in the previous 30 days — are not counted in the unemployment figure. Many call this “shadow unemployment,” and it’s inherently difficult to track due to variations for why people don’t seek jobs.
Bureau of Labor Statistics definitions For its reporting, the Bureau of Labor Statistics uses these definitions. “Veterans served on active duty in the U.S. Armed Forces and were not on active duty at the time of the survey. Non-Veterans never served on active duty in the U.S. Armed Forces. Veterans could have served anywhere in the world during these periods of service: Gulf War era II (September 2001-present), Gulf War era I (August 1990-August 2001), Vietnam era (August 1964-April 1975), Korean War (July 1950-January 1955), World War II (December 1941-December 1946), and other service periods (all other time periods). Veterans who served in more than one wartime period are classified only in the most recent one. Veterans who served during one of the selected wartime periods and another period are classified only in the wartime period.”

have served our country, regardless of immigration status, should not be deported and their cases should be adjudicated within the United States just like citizen Veterans. To address this issue, the CHC has called on administrations for years for years to stop deporting our servicemembers and Veterans. We have also called on the Department of Veterans Affairs to ensure deported Veterans have access to quality medical care.” Ruiz asked Marquez to talk more about the rigors for servicemembers to gain naturalization. “While someone senior has the ability and life experience to potentially tackle those issues and seek advice and maybe afford an immigration attorney, younger servicemembers are distraught, they’re torn apart, they’re in fear,” Marquez answered. “And they’re embarrassed to ask for help, because it’s a personal issue. You want to become a citizen, but you’re fighting so hard to be a good servicemember. But you’re afraid they’re going to label you in the military as a ‘problem child,’ because you need all this time to go work on your personal issues.”
Rep. Troy Nehls The ranking member on the subcommittee — Rep. Troy Nehls — said President Joe Biden is already tackling the issue of deported Veterans with Executive Order 14012. “This Immigrant Military Members and Veterans Initiative is a program that allows noncitizen Veterans who were removed from the U.S. for reasons other than committing aggravated felonies to reapply for citizenship, or return to the U.S.,” he said at the hearing. “So, there
are two bills in here, H.R. 1182 and H.R. 1183, which we don’t really need. It’s redundant. We already have a program in place.” Under E.O. 14012 — Restoring Faith in Our Legal Immigration Systems and Strengthening Integration and Inclusion Efforts for New Americans — the secretaries of Homeland Security and Veterans Affairs launched the Immigrant Military Members and Veterans Initiative. Among other things, the initiative includes creation of the Department of Homeland Security Military Resource Center to help noncitizen servicemembers and immediate family apply for and gain naturalization. The executive order is subject to change or end under future presidential administrations. Nehls is a Texas Republican.
Military Naturalization A press backgrounder at the Citizenship and Immigration Services website explains that the Department of Defense’s Military Accessions Vital to the National Interests program expired in 2017. That year there were 7,110 naturalizations of servicemembers. From 2018 to 2020, there were 4,680, 4,360, and 4,570. That jumped to 8,800 in 2021. “Since 2002, we have naturalized more than 148,000 members of the U.S. military, both at home and abroad,” the website reads. “Naturalization ceremonies have taken place in more than 30 countries from Albania to the United Arab Emirates.” It later adds, “Service members born in the Philippines, Mexico, Jamaica, China, and South Korea — the top five countries of birth among those naturalized — comprised 39% of the naturalizations since FY 2017. The next five countries of birth — Nigeria, Ghana, India, Haiti, and Nepal — comprised an additional 17% of military naturalizations from FY 2017 to FY 2021.”
