Accused back at work Manager, assistant have not been fired after arrest Refilwe Mochoari THE two Matjhabeng municipal officials accused of allegedly being involved in fraud and corruption of R13 million are back on duty after they were arrested last week. L.B. de Bruyn, a senior budget manager of Matjhabeng, and his personal assistant, Leona Nel, were each released on R20 000 bail last Wednesday after they had appeared in the Welkom Magistrate’s Court on charges of fraud, corruption and contravention of the Municipal Financial Act. They are amongst three others, Benny Malakoane (the then municipal manager of Matjhabeng), MEC for Health, three company directors Hendrik Burger, CEO of Gestetner Maluti, Rudolf Coetze, assistant director of Gestetner Maluti, and Oupa Molete of Pole Ads and a seventh accused, the entity Gestetner Maluti itself. The arrests were in connection with a tender that had been fraudulently awarded to telephone line and printer company Gestetner Maluti as well as lamppost advertising company Pole Ads between 2007 and 2010. At the time of the crime De Bruyn was acting chief financial officer and Malakoane the municipal manager of Matjhabeng. German Ramathebane, municipal manager, confirmed that De Bruyn and Nel were indeed back at work and that he was preparing a report for his principals as there were several internal processes which needed to be followed ahead of any conclusion. “Furthermore, it is important to note the accused have to date not been furnished with an official charge sheet. “According to the Bill of Rights, every accused person has the right to a fair trial, which includes the right to be informed of the charge with sufficient detail to answer it, to be presumed innocent until proven guilty and to a public trial before an ordinary court. “The Hawks have concluded their investigations, which means

But according to Piet Botha, a DA councillor in Matjhabeng, De Bruyn and Nel should have been fired with immediate effect considering the nature of their positions. “De Bruyn is a senior manager of the municipality’s budget, which means he controls the budget and can still commit the crime of stealing money. De Bruyn and Nel are accused of very serious crimes. “It is about time that corruption comes to an end so that the citizens of this municipality can enjoy proper service delivery. “Last week I sent an email to Matiro Mogopodi, who was acting municipal manager, together with Ramathebane. I asked both of them that De Bruyn and Nel be fired with immediate effect. “But I found out on Tuesday that they had not been fired because Premier Ace Magashule had not fired Malakoane from his position as MEC for Health in the province. “The public wants the accused to be fired, but the municipal manager feels it is not necessary,” Botha told Vista. ) What do you have to say about this issue?
