Mhlambi ordered that the default judgements against the residents be rescinded and that Amohela pay the costs of the applications, which include costs for travelling and preparation. This order means that there is no order evicting tenants. Vista reliably learnt that judgement has resulted in the imminent shutdown of the managing agency Amohelang. This has been fuelled by a notice addressed to tenants issued by the Matjhabeng Local Municipality to take over administration of the multi-million rand low-cost government housing estate situated at Harmony’s Masimong Mine, about 10 km outside Welkom. “Kindly note that the Matjhabeng Municipality is the owner of the Masimong 4 complex. We are currently facing challenges with the administrator running the complex that was managed byAmohela Property. We are therefore requesting 24 hours to secure the complex to avoid vandalism and illegal tenants that might occur during the challenges that we are currently facing with Amohela Property,” reads the notice issued on 9 March – four days after the (to them) unfavourable court ruling. The housing estate in question was built to accommodate people who do not qualify for bonds and state RDP houses.
THE long-standing controversial eviction case between tenants at the Masimong 4 Estate in Welkom and the managing agency Amohela Management Property is far from over. It will again be heard in the Welkom Magistrate’s Court on 7 April following completion of another hearing on 3 March. Other hearings were held in August last year. About 60 tenants are involved in the eviction case. It unfolded in mid 2014, when affected tenants filed an urgent interdict opposing eviction by the agency Amohela Property Management and the Matjhabeng Local Municipality. Through local law firm MB Mogotsi Attorneys, eviction orders were obtained against nine tenants, allegedly for defaulting on rental payments. The affected tenants filed for an urgent interdict through Peyper Attorneys from Bloemfontein, opposing the evictions. The matter involving the nine tenants and the agency has been pending since. Affected tenants scored the first victory in the bitter battle against eviction when judgement was passed in their favour in the Welkom Magistrate’s Court.
