Clarity needed on jurisdiction New dialogue to start to repair R34 was the custodian. The municipality agrees that the R34 Road belongs to the province, but according to the Municipal Finance Management Act (MFMA) the municipality cannot maintain (at own cost) any infrastructure which does not belong to them, and which is not in their area of jurisdiction. They can be contracted to maintain the road, but may not spend municipal funds on the maintenace thereof. Tsoaeli says between 2007 and 2009, after the street lights along the R34 were vandalised, the Matjhabeng Municipality replaced the stolen street light infrastructure. “This caused the municipality to receive a disclaimer audit opinion from the auditor general,” says Tsoaeli. “Not only did we receive a bad audit, but the lives of municipal security staff patrolling the R34 by foot were in danger. “Officials and security personnel were shot at while they were busy with refurbishment work along this route,” he says. According to legislation the municipality has an obligation to provide streetlights in the Mathjabeng Municipal area, but

The R34 Road (the Riebeeckstad Road), belongs to the provincial government and remains their asset and responsibility to maintain. The acting municipal manager, Thabiso Tsoaeli, says the Provincial Administration (Roads Department) designed the streetlight installation and shortly after the installation in 2000, the project was unofficially handed over to the Welkom Municipality for maintenance. Tsoaeli says this was done without any official service level agreement being in place. Vista reported on 10 May that the R34, beter known as the “Road of Death”, is the responsibility of the Matjhabeng Municipality. This was the general agreement in a meeting with the Matjhabeng Ratepayers Association, Sanral and the provincial government. Bodies recovered from shaft A total of 24 bodies have been recovered from the Eland Mine in Welkom since an explosion at the shaft on Thursday (11/05). The first 11 bodies were recovered on Monday (15/05). On Tuesday a further 13 bodies were brought to the surface. The decommissioned mine shaft is known to be used by zama-zamas to illegally access gold underground. The recovered bodies were badly burned. According to Capt. Stephen Thakeng, communications officer for the Welkom police cluster, some of the bodies had name tags attached to them for identification purposes. This method is used by illegal miners in the Goldfields to identify the bodies of their “colleagues” who perish in unsafe conditions underground. The incident is being investigated. This is not the first incident involving zama-zamas at this mine. During one of the incidents in 2009, some 100 illegal miners died in an underground fire. this legislation also stipulates that the municipality cannot maintain any infrastructure which does not belong to them, or which is not in their jurisdiction. Furthermore, the Occupational Health and Safety Act stipulates that the municipality cannot allow any employee to work outside their area of jurisdiction. To allow this, the municipality can legally be held responsible for third-party claims. Tsoaeli says the Matjhabeng Municipality recently completed designs on the refurbishment of the streetlight infrastructure through the 6,9 km from the Tempest and Koppie Alleen Road circle on this stretch of road. “The cost is estimated at R15 million. The municipality cannot spend this money on infrastructure outside their jurisdiction.” In the recent past the municipality engaged with Sanral and the provincial Department of Roads and Transport on this matter, but this did not yield much results, says Tsoaeli “The various parties are currently in a new process to revive engagements for the matter to be resolved,” he says.
