Workers’ compensation is not mandatory Q. I was hurt in an accident at work. I spoke with my boss about being compensated for my medical expenses and lost time. He said he didn’t have workers’ compensation. Doesn’t every employer have to have workers’ compensation? Can I sue to collect? A. Let me begin by briefly explaining how workers’ compensation works. Workers’ compensation is a form of insurance providing wage replacement and medical benefits to employees injured in the course of employment. Basically, workers’ compensation allows an employee to recover regardless of how the accident occurred or who was at fault. There is no requirement you show the employer was negligent. The amount of compensation, however, is limited and is determined by a schedule of payments. The trade-off is that in exchange for this “no fault� recovery, the employee must give up the right to sue his or her employer for the tort of negligence. Although workers’ compensation usually benefits both employers and employees, in Texas, it is not mandatory. If your employer does not have worker’s compensation, you have the right to sue to recover your lost wages and medical expenses. To recover, however, you must show more than simply the fact you were injured in a workplace accident. To successfully sue your employer you must show the accident was caused by the employer’s negligence---that is not acting as a reasonable employer would. For example, if your accident was caused by a defective machine that your employer knew was broken and did not fix, you would be able to show the employer was negligent and recover damages. On the other hand, if you simply fell over a machine and were not injured due any fault on the part of the employer, you would have no legal basis to sue your employer. Q. Someone who owes me money just died. Am I out of luck? Do his children have to pay? A. When someone dies, his or her children are not liable unless the child had agreed to pay the debt. You may not, however, be out of luck. After a person dies, his or her estate is responsible for the debts. You should file a claim with the executor or administrator of the estate. If there are any assets in the estate, they can be used to pay the money you are owed. Q. My father’s will left me $25,000. What else am I entitled to? My brothers and sisters received much more than I did.

A. Basically, a will determines how property is divided after death. All you are entitled to is what is specified in the will. If the will leaves you a sum of money that is what you are entitled to. severe hurricane the size of Katrina, called Cyclone Phailin, hit the eastern coastal state of Odisha, India, with winds over 125 mph on the night of Oct. 12. The State government had evacuated over 800,000 people along coastal Odisha to safer zones before Phailin struck, minimizing human casualties. The hurricane, however, caused severe damage to four districts - Ganjam, Khurdha, Puri and Jagatshingpur. In Ganjam, the worst affected district, 30 villages are submerged under water and 12 casualties were reported by 5 p.m. India time on Oct 13. Sewa International is working with partner NGO Utkal Bipanna Sahayata Samiti (UBSS) and has set up eight relief centers at Berhampur, Gopalpur and Chatrapur providing shelter to over 2,000 cyclone victims.

The post cyclone ood situation is grave in four more districts - Mayurbhanj, Balasore, Bhadrak and Jajpur of North Odisha. Mayurbhanj is experiencing this kind of ood after 1973. At least 35 people have died here. People have lost much property as they couldn’t take away their clothes and valuables due to the unexpected situation. Volunteers from Sewa International and its partner organization UBSS are already on high alert and are reaching out to trapped people with dry foods. UBSS is providing all possible support to the affected areas. Health services teams are being formed to visit different places. Emergency relief medical teams will visit the sites as required. ASHINGTON, October 15, 2013 (AFP) - The US Supreme Court will hear an affirmative action case Tuesday to determine whether state referendums can ban race and sex as factors in university admissions. In 2006, the US state of Michigan voted on a measure to disallow affirmative action in college admissions. The high court will now weigh in on whether the ban is constitutional, taking into account the US constitution’s equal protection guarantees. The case comes on the heels of a high court decision just over three months ago concerning affirmative action at the University of Texas. In that case, the justices elected not to rule on the constitutionality of using race and ethnicity in admission, instructing a lower court to take another look at the matter. The decision left unchanged the principle of “affirmative action,” an enduring legacy of the 1960s civil rights movement originally meant to give

African-Americans a leg up in applying for jobs and education to counter decades of racism. On Tuesday, the top court will consider an appeal by Michigan Attorney General Bill Schuette, who wants the justices to uphold “Proposition 2,” adopted in 2006 but struck down by an appeals court. The proposition, which became a constitutional amendment, prohibits Michigan’s public universities, colleges, and school districts from “discriminating against, or granting preferential treatment for any individual or group on the basis of race, sex, color, ethnicity, or national origin.”

The biggest impact would likely occur in California, he said, because Michigan’s law was modeled on a similar one in California, voted on in 1996, which banned race, sex or ethnicity quotas in education and Californian government jobs. “Schuette therefore still has enormous potential to affect the extent to which affirmative action is actually used,” Soucek wrote ahead of the proceedings. Michigan is backed by Arizona, Alabama, Georgia, Oklahoma and Virginia in its push against affirmative action. The plaintiffs, meanwhile, have the support of several other states -- including California.

But a coalition of groups backing affirmative action along with 17 former students argue the reform violates the US Constitution -- specifically its provision on equal rights.

Justice Elena Kagan, a progressive and former solicitor general, has recused herself from the case due to a conflict of interest linked to her previous professional functions.

Brian Soucek, acting professor at the University of California, Davis School of Law, said repercussions from the court’s decision will be felt well beyond Michigan’s universities.

This means the remaining eight justices on the prestigious panel -- three progressives and five conservatives -will take up the matter. Their ruling is not expected before next year.

Hodges talked about the great partnership between HCC and the Alief Independent School District. “This is just the beginning,” Hodges said. “Your support for skills develop-

ment for Alief students is so important; it’s about creating access and opportunity for them and their families. With Alief ISD and HCC working together, we are going to get students into the workforce by the time they graduate high school. H.D. Brian Burks, service director for the International Management District also addressed the audience, stating that the Alief Career Center represents an opportunity for many of the underserved young people in the neighborhood who want to go to trade school, but do not have access close to home. Steps To Choose Right Hospital Go Long Way by Sudhir Mathuria hen you’re sick, you may go to the closest hospital or the hospital where your doctor practices. But which hospital is the best for your individual needs? Research now shows that some hospitals do a better job taking care of patients with certain conditions than other hospitals. When you have a life-threatening emergency, always go to the nearest hospital. However, if you’re planning to have surgery, or if you have a condition like heart disease and know you may need hospital care in the future, learn about your hospital choices. Understanding your choices will help you have a more informed discussion with your doctor or other health care provider. Make the most of your appointments with your doctor or other health care provider to learn about your condition and health care needs: Before your appointment, make a list of things you want to talk about (such as recent symptoms, drug side effects, or other general health questions). Bring this list to your appointment. Bring any prescription drugs, over-the-counter drugs, vitamins, and supplements to your appointment and review them with your doctor or provider. During your appointment, take notes. Then, take a moment to repeat back to the doctor or provider what you were told. Ask any questions you may have. Consider bringing along a trusted family member or friend. Ask if there’s any written information about your condition that you can take with you. Call the office if you have questions when you get home. Talk to your doctor/health care provider about the following: Find out which hospitals they work with. Ask which hospitals they think give the best care for your condition (for example, have

enough staffing, coordinate care, promote medication safety, and prevent infection). Ask how well these hospitals check and improve their quality of care. Based on your condition, ask your doctor/health care provider questions such as: Which hospitals have the best experience with your condition? Should you consider a specialty hospital, teaching hospital (usually part of a university), community hospital, or one that does research or has clinical trials related to your condition? If you need a surgeon or other type of specialist, what is his or her experience and success treating your condition? Who will be responsible for your overall care while you’re in the hospital? Will you need care after leaving the hospital and, if so, what kind of care? Who will arrange this care? Are there any alternatives to hospital care? ASHINGTON (ANI) - A new study has suggested that lifestyle advice for people suffering from diabetes should not be different from that given to the general public, although those having diabetes may benefit more from the same advice. In this new study, Dr Diewertje Sluik, Department of Epidemiology, German Institute of Human Nutrition PotsdamRehbruecke, Nuthetal, Germany, and colleagues investigated whether the associations between lifestyle factors and mortality risk differ between individuals with and without diabetes.

Mortality was 62 percent higher in people with diabetes compared with those without.

Unsurprisingly, the researchers found that overall mortality was 62 percent higher in people with diabetes compared with those without. Intake of fruit, vegetables, nuts, seeds, pasta, poultry and vegetable oil was related to a lower mortality risk, and intake of butter and margarine was related to an increased mortality risk. While the strength of the association was different in those with diabetes versus those without, the associations were in the same direction in each case. No differences between people with and without diabetes were detected for the other lifestyle factors including adiposity, alcohol consumption, physical activity, and smoking. The new research has been published in Diabetologia.

Overall, contacts surveyed for the report remained cautiously optimistic about the economic outlook, “although many also noted an increase in uncertainty due largely to the federal government shutdown and debt ceiling debate,” the report said. The Fed’s “modest to moderate” characterization of growth

was the same as the prior Beige Book, released in early September. But of the Fed’s 12 districts, “growth slowed some” in four of them: Philadelphia, Richmond, Chicago and Kansas City. The report, a collection of anecdotal information across the country, will provide input to the October 29-30 monetary policy meeting of the Federal Open Market Committee. It came as Congress scrambled to resolve a budget and debt ceiling impasse that threatened to drive the country to default on its obligations.

Since the appraised values of properties have increased by four percent over the last year, maintaining last year’s tax rate is effectively a tax increase on Houstonians. “At a time when Houston’s economy is rebounding, our city leaders must look for more opportunities to incentivize business growth and economic investment in Houston. Instead Ms. Parker asked City Council to maintain a tax rate that effectively increases the tax burden on citizens,” said mayoral candidate Ben Hall. “By implementing forward thinking policies, we can reduce the tax burden on individuals, drive additional economic investment, and increase tax revenue for the city. A two cent property

tax rate decrease is a necessary first step in that direction.” The city would receive $102 million in additional tax revenue as a result of this tax increase. For each penny of this tax, the city receives approximately $17 million in additional revenue. Therefore, by reducing the tax rate by 2 cents, the taxpayers would save $34 million dollars while the city will still continue to receive $68 million in revenue. More importantly, this tax burden decrease would exponentially drive new business and additional tax revenue by incentivizing additional investment in Houston. “Reducing the tax rate is the type of forward thinking reform Houston needs but Ms. Parker has failed to advocate for even this simple change that would ensure Houston’s long term economic growth,” continued Hall. “We must reduce the regulatory and tax burdens on Houstonians in order to promote and sustain economic growth, not continuously drive up costs and drive out business.”

EW DELHI - Police have named one of India’s leading industrialists as a suspect in a high-profile corruption inquiry into the alleged illegal allocation of coal blocks. Kumar Mangalam Birla, chairman of conglomerate Aditya Birla Group, was accused of criminal conspiracy along with the government’s former coal secretary P.C. Parekh, a federal police agency said. India’s national auditor last year alleged that the coal ministry had given away billions of dollars in windfall gains to 100 private and some state-run firms -- sparking a police probe into whether kickbacks were paid in exchange. The Central Bureau of Investigation (CBI) filed a first information report (FIR) on Tuesday claiming that Hindalco, a subsidiary of Aditya Birla Group, took coal allotments meant only for confirming the agreement, which has to be approved by both the Senate and the Republican-controlled House. US borrowing authority is on track to expire at midnight, and without an agreement the United States runs the risk of a default with potentially devastating consequences.

achin Tendulkar may have been a constant at the crease for nearly a quarter of a century but the game of cricket underwent a revolution in that time, with India now established as the dominant power. When 16-year-old Tendulkar strode out to bat against Pakistan in November 1989, the West Indies were the world’s number one side, South Africa was still a sporting pariah and Twenty20 cricket was unheard of. Meanwhile concepts such as Duckworth-Lewis, powerplays and snicko had yet to trouble the game’s governing body -then ensconced in the old-world splendour of Lord’s in London before moving in 2005 to newly-built offices in Dubai. But while Dubai plays host to the International Cricket Council, observers say there is little doubt that Tendulkar’s India now exercises the real levers of power and its board is not afraid to flex its financial muscle. According to Lawrence Booth, editor of the cricketers’ almanack Wisden, India -- a cricket-mad nation which is home to more than a billion people -- is now the undisputed superpower of a game previously dominated by England. “Cricket should never be sniffy about the fact that the world’s second-most populous country regards it as their national sport,” Booth told AFP. “And the less well-off national cricket boards are utterly reliant on hosting Indian tours to top up their coffers, almost

exclusively through the vast TV deals they can broker with Asian channels.” Booth dates the eastwards shift of power to the 1996 World Cup, the second time that the 50-over tournament was staged on the subcontinent. But it was India’s unexpected victory in the inaugural World Twenty20 in South Africa in 2007 that really ushered in a sea-change, leading to the launch of the Indian Premier League a year later. The Board of Control for Cricket in India (BCCI) ironically was cool on Twenty20 in its infancy, fearing matches that lasted for only 40 overs would generate far less television advertising revenue than the 100 overs a day format. But since its launch, the IPL has drawn the world’s top players who turn out for city-based franchises owned by business moguls and Bollywood actors. Some players have earned in excess of a million dollars for the six-week tournament, leading stars such as the West Indies’ Chris Gayle to snub their national teams when their tours clashed with the Indian league. “I wonder to what extent the BCCI takes seriously its position at the forefront of the global game. Do they care about global cricket, or merely Indian cricket?” said Booth. But Amrit Mathur, former manager of the Indian national team who is now chief executive of the IPL’s Delhi Daredevils, insisted changes on and off the field during Tendulkar’s era had transformed things for the better.

Tendulkar himself has appeared lukewarm about T20. While he turns out for the Mumbai Indians, he made a solitary appearance for the national side in 2006 before making himself unavailable. He has been similarly cool towards another major development of the last few years -- the introduction of the decision review system (DRS) which allows teams to appeal umpires’ rulings through television replays. The Indian team refuses to allow DRS in its matches, a rejection widely attributed to Tendulkar’s opposition. Mathur points out however that Tendulkar has been one of the main beneficiaries of the advances in cricket, particularly on the commercial front.
