JAyson scHWArz You are finally ready to purchase a home, you have picked out the shade of blue you want to paint your living room, you have picked out the matching curtains, and the new 50-inch television is ready to be delivered the day after closing. The home of your dreams is at your fingertips, what can go wrong? First of all before you even start shopping for a new home, go to your bank, trust company or other financial institution, and see what amount of a mortgage you can qualify for. Do not put an offer on a home of any kind without a mortgage pre-qualification so you know how much money you will have available between your resources and the bank. It is a tragedy waiting to happen if you sign an unconditional offer, give your hard earned money to your builder or real estate agent and later find out you didn’t qualify for the mortgage in the first place. An Agreement of Purchase and Sale for the purchase of land is a contract. Once it has been signed, it is unconditional and binds both of the parties to do the things that they are obligated to do under that contract. If either party does not perform their part of the bargain, they can be liable to the other party for either specific performance or damages. Firstly, if a purchaser defaults he/she will likely lose the deposit. The vendor will then have the option of suing to force 6 NextHome+CondoGuide | Dec. 8, 2018–Jan. 5, 2019
closing of the deal and to make the purchaser pay all legal fees related thereto (specific performance), or sue for any damages the vendor might suffer before he resells the house (things like interest, changes, price differential, etc.) and legal fees. If the vendor defaults as purchaser you have the same kind of rights to force the closing or receive damages plus you can tie the property up with a lien until all is resolved. What if circumstances change? Say you lose your job, get a divorce, or worse, someone dies in between the period of signing the offer and closing the deal? For new-home contracts, many vendors will try to help if you approach them and explain the circumstances. Remember they have no obligation under the law to help you. It would be a gesture of goodwill or compassion only. In this circumstance, the best thing to do is discuss the matter with your lawyer. Your lawyer will calmly explain the options to help mitigate and/or reduce potential loss. A great real estate agent (like my son Jonathan Schwarz at Revolution Realty) will move
heaven and earth to find you a buyer to take over your deal. Usually this is the best solution. The moral of the story is to make sure you have financing or that the offer is conditional for a few days on both financing and review by a lawyer. Be prepared for adversity and have a back-up plan if it happens. It is critical you get the right advice and only a lawyer can provide legal advice – that is the law. When you select a lawyer, find one who cares about you and wants a long-term relationship. Questions or comments? As we wrap up another year of reporting the latest real estate news and events, let’s take a quick look at the year’s top industry stories. Kicking off the new year, the Office of the Superintendent of Financial Institutions’ (OSFI) implemented new mortgage rules. This included a new “stress test” for first-time buyers, who now need to qualify for a mortgage at the Bank of Canada’s current five-year benchmark rate plus two percentage points. Then, in May, the first of three interest rate hikes in the Bank of Canada’s five-year benchmark rate were bestowed upon us in an effort to cool an overheated real estate market, particularly in the GTA. Now that record-low interest rates are no longer making news, keep in mind, a variable interest mortgage rate can still be had for less than 3.95 per cent — a bargain — just ask your grandparents who were paying 18.38 per cent for a five-year conventional mortgage back in 1981. In fact, many Canadians during that time endured tougher affordability problems than we have today, and for many, it was the story of the year. Back to 2018, there’s evidence we remain resilient and undeterred by hurdles such as rising interest rates and tighter qualification standards. According to a Ratehub.ca survey of 2,000 Canadians, 71 per cent of current non-homeowners plan on purchasing a home in the future, and 59 per cent of prospective first-time homebuyers want to make that purchase within the next two years. The good news? Programs such as the RRSP Home Buyers’ Plan still exist, and builders and developers continue to fight for creative ways to build affordable homes — check out this issue for the scoop on this and other stories. Land use policies need re-evaluation

Sometimes, what we thought was a great solution to a problem creates challenges of its own. In 2006, responding to the fast pace of growth in our region, the then government of Ontario issued the Growth Plan for the Greater Golden Horseshoe. Its intention was to manage growth in a way that would support economic prosperity and a high quality of life in our communities, while protecting the environment. These were laudable motivations. However, a recent study jointly authored by BILD and Malone Given Parsons (MGP) shows that the 2006 Growth Plan and its updated version, the 2017 Growth Plan, have had unintended consequences for land use and planning in the region, affecting housing supply and affordability, not to mention the quality of life for residents. An important goal of the Growth Plan was to make development more compact, that is, use less land to accommodate more people and jobs. The 2017 Growth Plan sets out target densities for various types of land—150-400 residents and jobs per hectare in urban growth centres like downtown Toronto or Oshawa, 150-200 residents and jobs per hectare in major transit station areas such as GO stations and subway stations, and 80 residents and jobs per hectare (up from 12 NextHome+CondoGuide | Dec. 8, 2018–Jan. 5, 2019
50 in the 2006 Growth Plan) in areas that are not yet built up but are designated for future development. Most of these are found in the outlying areas of municipalities like Brampton, Vaughan and Pickering. Intensifying near existing infrastructure and transit, as the Growth Plan envisions, makes good sense, but when Malone Given Parsons examined densities that exist today, they found that 70 per cent of the Greater Toronto and Hamilton Area (GTHA) consists of communities with a density of less than 50 people and jobs per hectare. These established neighbourhoods of single-family and semi-detached houses, many near major transit lines, have proven challenging to intensify due to outdated municipal by-laws and community resistance. That pushes densification to downtown cores and to the fringes of the region. Few of these outermost parts of the GTHA are near transit, which means residents must rely on cars to get around, increasing traffic congestion and creating a need for new infrastructure like roads and highways. Meanwhile, we are not maximizing the investment we have already made in infrastructure and transit in our established neighbourhoods. This situation is the opposite of what the Growth Plan was meant to achieve. We can fix these unintended consequences. In our report with MGP, we outline a number of policy adjustments that the provincial government should consider to put people near transit
and infrastructure. These include encouraging gentle densification throughout the established neighbourhoods of the GTHA and returning to the lower density targets set out in the 2006 Growth Plan for land designated for future development. When faced with a complex challenge like managing growth in our dynamic region, it’s smart to evaluate whether solutions we have implemented are truly working and make adjustments. Watch future columns as I continue my look at how we can improve Ontario’s land use policies.

Good news for for condo investors

It was announced in mid-November that new apartment buildings, either condominium or rental, occupied after November 15th, 2018 would no longer be subject to rent control legislation. This is good news for condo investors. Rent control sounds like a good idea. The problem is the government typically sets the maximum amount that a landlord can raise rental rates at a percentage that is typically below the rate that rents are actually growing. Some might ask why this is a problem. Let me explain. The costs for maintaining a building and/or a unit are often going up: labour costs and maintenance for a rental apartment building owner, condo fees and interest rates for a private condo investor. If an owner can’t recover those costs and isn’t being sufficiently compensated for the risks inherent in owning real estate, they’ll often stop doing the needed maintenance, renovations or upgrades, or stop providing the proper service to their tenants. If a landlord knows they can reset the rental rate to the much higher market level when the tenant moves out, they may discriminate when choosing their tenants, electing to go with students or young singles that are more likely to move in a year or two, as opposed to a single mother 14 NextHome+CondoGuide | Dec. 8, 2018–Jan. 5, 2019
or widow looking to put down permanent roots in the community. In the case of condo investors, if they are not getting enough rental income to offset increases in property taxes or mortgage costs, they are likely to sell, lowering the supply of rental housing or alternatively, they may decide to list the unit on Airbnb instead — which causes a whole new set of headaches. Many people don’t care for condo investors, but before they showed up in droves, the GTA condo market was building 10,000 units per year in maximum 20-storey towers, and now the development industry is delivering over 20,000 units in towers as high as 80-storeys. At least half of these units are leased out, significantly adding to the rental stock. In a market where only 1,000 to 2,000 rental apartment units are built every year, investors are directly responsible for most of the new rental supply in the GTA over the last 20 years. For investors to continue to buy condos and add much-needed units to the stock of rentals, they need to expect future price appreciation and future rental growth. Placing a cap on how quickly they can raise rents is a disincentive to purchasing. When a new building is completed and there are hundreds of suites for rent, an investor may need to accept a slightly lower rental rate initially due to competition in the first year, but they want to have to have the option to raise rents 3-4 per cent the next year if the tenant stays to cover the significant
monthly carrying costs. With the average unsold new condominium in the GTA approaching $800,000, investors and end-users are being asked to make a significant investment and take a chance on Toronto’s housing market in the future. They may stop taking that risk if they don’t think they can get the rent they want from their investment units. Rent control has noble intentions, but it reduces rental supply in the long run, and in a market with historically low vacancy rates, we need all the supply we can get.

MAJORITY OF CANADIANS AREN’T LIVING IN THEIR IDEAL HOME
There’s a reason we have the expression “dream home” – it’s not uncommon to dream of your ideal living space and to imagine what it might look like. It’s also becoming more common for Canadians to have to wait until their 50s to get into their ideal home, according to a new survey commissioned by Century 21 Canada. “While you would expect young adults may not be not living in their ideal situations as they work to establish themselves, it was striking that their satisfaction level didn’t improve significantly until people got into their 50s,” says Brian Rushton, executive vicepresident of Century 21 Canada. 20 NextHome+CondoGuide | Dec. 8, 2018–Jan. 5, 2019
The survey of 1,000 Canadian adults living in eight metropolitan centres across the country asked them how close their current living situation is to their ideal. • 41 per cent ranked their situation as close to their ideal • 43 per cent ranked their situation as moderately close to their ideal • 16 per cent ranked their situation as far from their ideal Age
Once age is factored in, the gulf widens considerably, with only a third of those aged 25 to 54 saying they are living in close to their ideal situation while a majority
(56 per cent) of those aged 55+ said they are living in close to their ideal situation. Even in the 45 to 54 age range, about one in five said their living situation is far from their ideal – about the same percentage as young adults. PreFerred FeATUreS oF An ideAL HoMe
Almost half (49 per cent) of those surveyed identified type of home as one of their top two priorities when considering purchasing a new home, while 46 per cent identified location/ neighbourhood as one of their top two considerations. Other factors include:

“This survey tells us that when people buy a home, they are buying a lifestyle,” Rushton says. “What that means varies widely with the individual, but it typically requires deciding what is most important within your budget and what compromises you’ll make to get as close to your own ideal living arrangement as possible.” TYPe oF HoMe
Across all eight metropolitan
areas, 65 per cent of Canadians identified a single-detached home as their ideal, with another 24 per cent identifying an apartment as their ideal. The remaining 11 per cent preferred a semi-detached home or other arrangement (such as a trailer or houseboat). “It was also surprising that while two-thirds of Canadians told us a single-detached home is their ideal, a quarter preferred an apartment, primarily because they value a low-maintenance lifestyle,” Rushton shares. The numbers varied by region, with only 52 per cent of Metro Vancouver residents preferring a
single-detached house compared to 79 per cent in Calgary. Interest in single-detached houses peaks at ages 35 to 44, especially among those with children at home, declining afterwards. Single people and couples without children are more likely to prefer apartments. Those who prefer a singledetached home identified a private and independent lifestyle, a yard, tranquility, space and privacy as their top reasons, while those who prefer apartments identified a hassle-free lifestyle and lower maintenance as their top reasons.

Instead of an all-white kitchen use a mix of materials and colours to add complexity and warmth to your space. It makes the kitchen feel more dynamic and inviting. Add character to your space by choosing details that fit your needs and personality. A really good way to bring in some interest is through hardware and backsplash tile. It’s all about choosing items that will look good in 10 or 15 years, rather than what is trendy. I think returning to the classics is the trend for 2019. Accessories and art are an easy way to add a pop of colour to your space, especially adding plants in cute pots to help warm up the space. An easy and affordable update that anyone can do regardless if they are planning a kitchen reno is changing the hardware.

As we come to the end of 2018 and round the corner to the new year, most of us look back on the things for which we are grateful. For condominium owners in the Greater Toronto Area, there are many. We are fortunate to live in a city and region that continually rank among the world’s finest for livability and quality of life. Our surroundings are safe in comparison with other places around the globe, which is one of the major reasons why so many people choose to immigrate here. We have wonderful postsecondary educational institutions that are the envy of the rest of the world. We have world-class shopping, entertainment and cultural venues. Toronto and the GTA offer great places to live for left-brained techies to right-brain artists and everyone in-between. Condominiums provide a convenient lifestyle within our areas. In addition to being more financially attainable than low-rise housing, new condos are located near transportation hubs and local amenities, making ownership of a gas-guzzling vehicle an option rather than a necessity. In urban areas, condo-dwellers walk a lot more than their suburban neighbours, which is great for their health. exercise, stretch, swim and relax to help them cope with their hectic lifestyles. The time that frees up is priceless, making the monthly maintenance fee worth every penny. While we are on the topic of money, the Toronto Real Estate Board reported that Toronto condo values jumped

A small bathroom doesn’t have to fall short on style or storage. The right vanity can go a long way to meeting both demands. Here are three considerations when shopping for that perfect vanity that satisfies those big ‘small-space’ cravings.

Size matterS. It’s not the size of the bathroom that counts, it’s how you use it, right? Consider the vanity’s height and depth in relation to the room, and how you use the space. Particularly in compact bathrooms, you’ll want to pay close attention to factors such as door swing, location of the toilet and tub, and the general flow of traffic. Along with vanity dimensions come some other technical considerations. Where is the plumbing located? Do you require a single or, double sinks? How will the faucet be mounted? It’s always best to consult with a professional contractor who can advise you on what’s possible in your space, the scope of work and timeline for completion, and the cost.
Out Of Sight, Out Of mind. The type of bathroom you have will dictate which storage system will best meet your needs. A powder room has minimal storage requirements, while an ensuite or a busy family bathroom calls for greater storage, organization and efficiency. For small bathrooms that see a lot of action, consider installing a vanity cabinet which is perfect for tucking away towels, toilet paper, tissue boxes, and perhaps a drawer (or an under-counter caddy!) for each family member to store personal items.
StyleS fOr mileS. Some see a small bathroom as a design challenge. I view it as the perfect opportunity to make a statement. Since the space is limited, the few fixtures you have (including the vanity) need to be high-impact. Select a vanity style that stands out to you, either for its materials, shape, style, or another unique detail that sets it apart.

If you have a disability and buy a new home, you may ask your builder to install devices or features that will make your home more accessible. But what if your disability creates challenges in communicating with your builder or in completing the forms to make a warranty claim? Under the Accessibility for Ontarians with Disabilities Act, 2005 or AODA, businesses are required to comply with the Accessible Customer Service Standard. At Tarion, this means we are committed to ensuring that we deliver services that are integrated, accessible, and respect the dignity and independence of each individual. What this looks like on a day-today basis depends upon the needs of our customers. I’ve heard numerous stories of how our staff have put our commitment to accessibility into action. For instance, by bringing a sign language interpreter to a conciliation for someone who was hearing impaired or by offering assistance with filling out warranty forms for someone with vision loss. When it comes to making our services accessible, there is no ‘one size fits all’ approach. It all starts with getting to know our customers and not making assumptions about what they can or cannot do or what they do or do not need. New home market continues to gaiN momeNtum in october In October, the GTA new home market saw a relatively active month for new condominium apartment and single-family home sales and openings, the Building Industry and Land Development Association (BILD) announced today. There were 2,805 condominium apartments in low, medium and high-rise buildings, stacked townhouses and loft units sold in October, down 44 per cent from October 2017 but only 1 per cent less than the 10-year average, according to Altus Group*, BILD’s official source for new-home market intelligence. Single-family home sales, with 491 detached, linked and semi-detached houses and townhouses (excluding stacked townhouses) sold, were even with last October and down 64 per cent from the 10-year average. With 21 condominium apartment projects and 14 single-family home projects opening in October, remaining inventory increased to 16,283 units, comprised of 10,982 condo apartment units and 5,301 single family units. and give new home buyers more product to choose from, they get excited and motivated about making that choice,” he said. “That’s why we are especially heartened by the new provincial government’s commitment to increasing housing supply through its Housing Supply Action Plan.” The benchmark price for both condo apartments and singlefamily homes decreased slightly in October compared to the previous month. The benchmark price for condo apartments was $775,537, which was still up 14.5 per cent over the last 12 months. The decrease in the benchmark price of condo apartments from September can be accounted for by the smaller benchmark size of units available to purchase. The benchmark price for single-family homes was $1,115,284, down 8.4 per cent over the last 12 months.
