uying a brand-new home offers you an opportunity to customize it to your liking. It can be a dream come true and an investment for the future – but don’t forget, it’s also legal transaction. The term “get it in writing” has never been more important in the case of the new-home purchase, since such a document outlines everything your home will have in it, on it and around it. Otherwise known as the Agreement of Purchase and Sale, the contract spells out the terms and conditions between you and your builder. Without it, if there is a misunderstanding or disagreement, it’s impossible to prove what was agreed upon. Since building a home is much more complicated than a resale transaction where the unit and/or property likely already exists, there is

no set Agreement of Purchase and Sale or standard contract for buying a new home. In some provinces, builders may have standard contracts prepared by the local home builders’ association or their new-home warranty program. Builders often prepare their own agreements, so contracts can vary from one builder/ developer to another and from province to province. Before you sign a contract, review it carefully with the builder and ask questions to make sure you fully understand what it contains. Your next step is to then take it to a real estate lawyer and have it reviewed. Once it is signed, it becomes a legal document and an agreed-upon contract, so seeking the services of an experienced real estate lawyer is an important step toward ensuring that your dream home becomes a reality.

hen buying a new home, many people’s vision involves an expansive property in an excellent location and at a great price – within easy reach of all the amenities you need and where you work. If you’re lucky, you’re able to achieve all of this right off the bat. More likely, as prices rise and selection is increasingly determined by availability and affordability, you may have to compromise. Instead of a detached home in your number one neighbourhood, you find yourself looking at a semi. If a townhome is not quite within reach in your first area of choice, you may be considering a condo. This is the exercise more and more homebuyers are going through these

days. Want a bigger property, move further out of the city. That used to be the fairly simple process. Now, complicated by issues such as transit and commuting times, the choices may not be so easy. In some areas, rising land acquisition costs are expected to make many buyers’ number two lowrise choice – townhomes – more expensive. Where to from there? A condo? That may not be a suitable alternative, if you have or are planning a family. The good news is that builders are responding to such challenges by increasing their offerings in home type, and in the case of condos, unit sizes. Plenty of homebuying options are out there, and if you do thorough research, you’ll unearth the opportunities.

Canada’s hottest real estate market? CALGARY HANGS ON TO TOP SPOT

Canada’s strong housing performance has been well documented – and the envy of many countries. But would you be able to guess the hottest real estate market in the country? You might be surprised. According to the latest House Price Survey from Royal LePage, Canada’s hottest real estate market is not Toronto or Vancouver, as some might expect. It’s Calgary. Nationally, the average price of a home in Canada rose between 4.4 per cent and 6.1 per cent year-over-year in the third quarter of 2014. During this period, the average price of a standard two-storey home rose 5.5 per cent to $441,714, while detached bungalows increased 6.1 per cent to $405,101. Condominiums on average showed slightly lower year-over-year gains, posting a 4.4 per cent increase to $257,377. “In the seven years since the Canadian housing market began its recovery from the worldwide recession, home price growth has been robust, often greater than the long-term average of approximately five per cent,” says Phil Soper, president and chief executive of Royal LePage. “We are now experiencing a natural slowing in the rate of year-over-year price appreciation, with real estate markets moderating in most parts of the country, a transition to what our agents refer to as a ‘Goldilocks market,’ one that is neither too hot, nor too cold. To be clear, we expect home prices to continue to grow in the months ahead, but at a slower rate than we have seen in recent years.”

SUMMARIES OF SELECT CANADIAN REAL ESTATE MARKETS: Calgary: The housing market continues to be among the strongest in the country.

Demand was strong across all housing types. The average price for standard condominiums surged 11.8 per cent year-over-year to $294,156, and detached bungalows increased 10.8 per cent to $515,844. Standard two-storey home prices were consistent with this trend, increasing 9.2 per cent to $499,811. Edmonton: Also saw strong price appreciation across all housing types. Detached bungalow prices showed the strongest gain, increasing 6.0 per cent year-over-year to $357,240. Standard two-storey home prices rose 5.3 per cent to $379,463, while standard condominiums climbed a healthy 5.8 per cent to $232,340. Toronto: Low levels of inventory combined with an unseasonably active August market contributed to significant price increases across all major housing types. Standard condominium prices saw the greatest increase, rising 8.0 per cent yearover-year to $383,039. Detached bungalows rose 7.2 per cent to $618,088, while prices for standard two-storey homes increased 7.6 per cent to $733,317. Vancouver: Price increases remained strong in the third quarter. Detached bungalows saw the largest increase, climbing 6.1 per cent to $1.13 million. Standard two-storey homes also experienced strong growth, rising 5.6 per cent to $1.22 million. Standard condominium prices cooled slightly by 0.2 per cent to $502,869. Ottawa: The slower winter and spring seasons left the market with a surplus of inventory in the third quarter, holding prices relatively flat in the region. Detached bungalow and standard two-storey home prices each increased by 1.2 per cent year-over-year, to $403,091 and $406,264, respectively. Standard condominium prices declined slightly, dropping 0.3 per cent to $258,132. Montreal: The average price of detached bungalows increased 2.6 per cent year-over-year to $296,857. In the same quarter, standard two-storey homes and condominiums remained relatively flat, rising 0.2 per cent to $403,714 and 0.5 per cent to $241,000, respectively.

Calgary: The housing market continues to be among the strongest in the country. Demand was strong across all housing types.

GENESIS TO ACQUIRE $52.5 MILLION OF LAND

for a new master-planned community in rapidly growing Southeast Calgary Genesis Land Development Corp. has announced it has entered in to a purchase and sale agreement for the acquisition of approximately 350 acres of land located in southeast Calgary along the Bow River. The property also overlooks the Bow River Valley, with views of the Rocky

Mountains and is just two kilometres south of the recently opened, $1.3-billion Calgary South Health Campus/Regional Hospital (see map). The land will be developed into a residential community, with construction forecast to begin in 2021. Once completed, the community is expected to include nearly 2,100 homes, parkland and supporting community commercial development. The land is currently zoned Future Urban Development within

This $52.5-million acquisition, the first mid-term land purchase in seven years, continues the Genesis strategy of focusing its portfolio on residential lands within the Calgary Metropolitan Area, and is expected to provide a long-term supply of single-family and multi-family homesites. The company will pay for the acquisition from its general cash resources, with $12.5 million due on closing (scheduled for Jan. 6, 2015), and the remainder paid over five years. President and CEO Bruce Rudichuk commented, “We are very excited about our future in the Calgary Metropolitan Area and developing this extraordinary land, which will enable Genesis to create a unique and desirable master-planned community. The site’s location and varied topography will assist us in creating diverse neigbourhoods, ranging from family-friendly and affordable communities to intimate benchland enclaves with river views.” He continued, “It has all of the essential characteristics we are seeking – and will encompass a large scale community with multiple product categories in a rapidly growing area within the city of Calgary. The

development time frame will support the planned growth of both our land development and homebuilding businesses and allow us to once again show the marketplace the kind of communities Genesis is capable of creating.” Genesis Chair, Stephen J. Griggs, stated “This acquisition demonstrates the consistent execution of our strategic plan and balances the company’s portfolio between lands that generate strong cash flow in the short term, and lands which sustain cash flow over the longer term. We anticipate, as part of our balanced approach toward the uses of capital, that Genesis will pay for this investment from cash flow, allowing us to continue to have a conservative capital structure. Sometimes the best colour scheme is no colour at all! What do you love most about entertaining? J: I love to treat people. I love having guests come over and serving them the best food I can make, putting on the best party I can. I want people to leave having had a really great time. That makes me really happy.

How can you use existing decor to make a party hosted at home comfortable and stylish? J: Using your kitchen island as a serving station or buffet

Tell us about your partnership with LG J: LG approached me about six months ago to be the ambassador

for its new Door-in-Door refrigerator. Given my love of design, food and entertaining, it seemed like the perfect fit. The refrigerator is amazing for entertaining – it can act as a beverage centre, where guests can help themselves!

When it comes to kitchen essentials, what is your favourite item? J: For a bit of luxury, I would say a wine fridge. I pretty much

bought my house because it came with one. I also think a great big kitchen island is so important for everyday cooking, as well as entertaining.

Describe your dream kitchen J: All white with some gritty elements, such as exposed beam, an

industrial chandelier, large windows and open shelving. Oh, and a few French baguettes in a basket on the counter!

If you could cook with anyone, who would it be? J: My grandmother, she is my muse. We cook together all the time, and she is so inspiring.

You love to entertain and throw beautiful, inspiring parties. What are your top entertaining tips? 1. Making food ahead of time – it is a huge sanity saver. 2. Use rental companies for tables, chairs, glassware, utensils and linens – it is a lot less expensive than people realize.

3. Being present in the moment. I can spend so much time

preparing and hosting the party, that sometimes I forget to enjoy it. Do your hosting, and then be resolved to enjoy yourself, too!

Where do you look for inspiration when planning a party? J: My cousin Tori’s blog, fraichenutrition.com – she’s a dietitian and an incredible cook, she inspires me with her euro-rustic approach to food, which I love. And, in terms of decor, I look to Monika Hibbs. She has beautiful style.

What are the top entertaining trends this season? J: For decor, an all-white palette is still big this year, but mixed with

rustic elements and metals, such as serving food on an antique cutting board. And for food, the mini trend (think one-bite apps) is still going strong!

You are known for your fabulous sense of style. How do you like to dress when you entertain? J: When I throw parties, I usually pick a theme and get everyone to dress accordingly – which makes for great, fun photos.

Chilled Caprese Tomato Bites This ideal finger food is a no-cook, little-prep, handmade crowd pleaser created by Jillian Harris and inspired by the LG Door-inDoor Refrigerator. The tomato gives a farm-fresh feel, while the creamed mozzarella adds a rich taste.

Ingredients 1 pint cherry tomatoes, halved 3 tbsp. heavy whipping cream 1/2 pound fresh mozzarella cheese, sliced 6 fresh basil leaves 1 garlic clove, minced

Directions Scoop out and discard pulp of cherry tomatoes. Invert tomatoes onto paper towels to drain and insert skewer. In a food processor, combine the cream, mozzarella cheese, basil and garlic; cover and process until blended. Cut a small hole in the corner of a pastry or heavy-duty resealable plastic bag. Fill with cheese mixture.

Protecting exterior plumbing pipes Âť by MICHAEL NYIKES Q: Considering how cold it is in Alberta during the winter, are plumbing pipes allowed to be installed in exterior walls?

A: Great question, and timely, too, because Albertans will see the temperatures regularly dipping below zero pretty soon. In accordance with the 2010 National Plumbing Code of Canada (2010 NPC), piping in exterior walls shall be protected from frost. Unfortunately, the methods of protection are not specifically described in the 2010 NPC, and as we know, the climatic conditions vary greatly in Alberta during the winter. To provide guidance on this topic, Alberta Municipal Affairs released Standata P-07-06-NPC 10 (Rev 2) in November 2012, indicating that methods of protection as described in the previous Alberta Plumbing and Private Sewage Codes were suitable on the basis of past performance and shall be established on the basis of local experience. It was determined that no part of a plumbing system, except a dry vent that is adequately insulated from freezing, shall be located in an exterior wall. Adequately insulated means that piping shall be located on the warm side of the insulation and vapour barrier in an enclosed space on the inside of the exterior wall. This means a separate two-by-four or two-by-six wall (depending on piping sizes) must be built inside the insulated exterior wall, and the plumbing would need to be located inside this additional wall. In essence,

this adds an entire wall of insulation between the cold outside temperatures and the pipes, safeguarding the pipes from freezing during the winter. It is important to note this will affect the design of some spaces (such as a laundry room), because this additional wall will decrease the interior footprint by four to six inches of floor space. energy consumption and heating costs With cold weather approaching, Canadian homeowners will soon be looking for ways to reduce home energy consumption and heating costs. With memories of last winter – one of the harshest in recent history – still fresh, many Canadians are taking a more proactive approach to prevent the condensation, drafts and cold floors that are dead giveaways you’re paying too much to heat your home. And yes, these warning signs surface even in new homes. “An under-performing building envelope is the main reason why the average Canadian spends unnecessary money on heating costs,” says Jay Nordenstrom, executive director of NAIMA Canada, an association of insulation manufacturers. “A robust building envelope means homeowners decrease their energy needs. This lowers monthly heating bills, along with the associated greenhouse gas emissions, and enhances comfort during catastrophic winter weather.” Just what is a “building envelope”? It’s a term to describe the building components that separate the indoors from the outdoors. A home with a modern building envelope – well insulated, properly sealed and well ventilated – can provide shelter during the most brutal weather conditions. It also provides insurance in the event your furnace is disabled by a power outage. Paying a premium for a house with increased wall and attic insulation, for example, can provide month-over-month payback by lowering energy consumption and heating costs. These savings vary, however, and are determined by the R-value of your home’s insulation. Higher R-values mean greater insulating power. New homes offer the best opportunity to ensure a high-performance building envelope, and NAIMA suggests home builders not trade off improvements to the building envelope in favour of mechanical systems. Renovating a home is another opportunity to improve the building envelope. The most beneficial upgrades include installing appropriate amounts of insulation and weather sealing where drafts and air leakages are occurring, NAIMA says. Many of these can be done as do-it-yourself projects. Across Canada, grants and rebates are available from the federal and provincial governments and local utilities, especially for energy-saving renovations.

Have you bought, or are considering buying, a new home and want to build a fence, shed or deck or otherwise spruce up your residence? Here’s why you might want to check your property boundary first. A recent analysis conducted by Krcmar Surveyors Ltd. showed that about 49 per cent of residential properties in the Greater Toronto Area, for example, have boundary discrepancies with significant potential to cause disputes between neighbours. Horror stories of feuding neighbours, litigation nightmares and tens of thousands of dollars in legal costs are not just the stuff of Hollywood movies – it really does happen. And yes, even with new homes. Sometimes, it’s just difficult to tell where one property ends and another begins. “It’s not as easy as one would think, in a muddy construction zone with no fences and rudimentary driveways, curbs and roads to delineate land parcels,” says Sasa Krcmar, executive director of Krcmar Surveyors Ltd., whose company has helped launch protectyourboundaries.ca, a site designed to help homeowners prevent and resolve property boundary issues. Although legal iron bars are set to mark out each lot prior to construction, they often get knocked out, moved or buried during the building phase. “Many homeowners naturally, and incorrectly, assume that the wooden stakes that dot the perimeter of their property represent the boundary, and use them as a guide to start planting a

hedge or put up a fence,” Krcmar told New Home Guide. “However, these wooden stakes are generally used for site grading. And while they are likely located near the property line, they can’t be relied upon to determine the legal boundary.” Here, then, are a few tips for new-home owners to avoid property boundary issues. GET THE SURVEYORS REAL PROPERTY REPORT:

Your property boundary will be recorded in the Surveyors Real Property Report (SRPR) that is performed after the foundation walls are poured (approximately a foot above grade) and the soil is backfilled around the home. The SRPR is your official documentation of your building location and the property boundary lines. Builders typically provide this plan when you close the deal. Be sure you receive a copy and keep it in a safe place for future reference. MARK THE FOUR BOUNDARY CORNERS OF YOUR PROPERTY: Ask the builder to have the surveyor mark the

four boundary corners of your property with iron survey bars as a condition of closing. Even if the builder charges a nominal fee for this service, it is a cost-effective practice that will allow you to add structures and landscaping with confidence and peace of mind in years to come. PROTECT THE IRON SURVEY BARS THAT DEFINE YOUR PROPERTY: Protect the iron survey bars that define

the corners of the property. They are legal monuments that provide the most important evidence of your property boundaries. Don’t remove or move them, or allow others to. BE A GOOD NEIGHBOUR: Be a good neighbour, while at the same time ensuring that your neighbours don’t establish a pattern of using part of your property for their routine activities. AND, IF ALL ELSE FAILS: Visit protectyourboundaries.ca, where, for a cost that varies depending on the surveyor (usually $200 to $300), homeowners can find their exact property boundaries.

With the arrival of shorter days and winter weather most Calgarians are starting to spend more time indoors out of the cold. As the temperature drops and the snow flies, people typically go into the cocooning mood and may spend as much as 90 per cent of their time indoors over the winter months – most of which will be in their own homes. Because of this, the “health” of the home becomes more important to homeowners, especially those with allergies, young children and elderly family members. Poor indoor air quality inside your home can impact the well-being of all who live there. It can range from a general sense of feeling tired or under the weather to contributing to, or perhaps even triggering, allergies and asthma issues. Off-gassing from building materials, paint, finishes and new furniture, excessive moisture that can cause a buildup of mould and mildew, and improper ventilation and incomplete combustion in heating systems can all have an impact on the quality of air inside your home. Without even realizing it normal everyday activities that occur inside the home such as cooking, showering, washing dishes, cleaning and doing the laundry can create moisture and hamper indoor air quality. Further, off-gassing from the use of household cleaners and sprays, dust and even emissions from equipment used in a home office can contribute to unhealthy air. Starting from the construction and design process, new home builders in the Calgary region are addressing the indoor environment. Good indoor air quality begins with solid construction that prevents air leakage and moisture penetration that eliminates dampness and cold spots. New processes that are used today not only increase comfort, but also prevent mould growth. To help prevent condensation, exterior walls are well insulated with air barriers, vapour retarders and caulking, and energy-efficient windows are expertly installed. As well, mechanical ventilation is included in every new home, using exhaust fans to get rid of stale or excess moist air that is often generated inside the home as a result of daily routines during the course of the day. Many new homes come with a heat recovery ventilator, which continuously brings in fresh, filtered air from the outside, while eliminating the stale air. These energy-efficient heating and cooling systems operate cleanly and safely, drawing air directly from the outside and venting exhaust gasses separately to avoid any risk of noxious fumes inside the home. Building codes today are designed to protect the homeowners and help conserve energy, making today’s homes healthier and more sustainable, as well as safer for those living in them. In addition, many builders are using environmentally-friendly building materials to reduce the amount of pollutants or contaminants introduced into the home during its construction. These include non-solvent-based glues and grouts, water-based paints, formaldehyde-free cabinetry and pre-finished hardwood flooring. Besides the materials, many products are selected and installed by local builders because they have a positive long-term effect on the quality of air inside your new home. For instance, going with a hard-surface flooring material or selecting cabinets and countertops that can be easily cleaned with mild, non-toxic solutions are among the ways to help promote a cleaner environment.

When you sit down with a mortgage broker or bank to talk about your mortgage financing options, one of the products they may offer you is a collateral mortgage. Collateral mortgages are a readvanceable mortgage product, meaning it comes with the option to borrow more money as your property value increases, without having to refinance your mortgage. In theory, this should be a fantastic product for mortgage holders. Normally, if you wanted to borrow equity from your home partway through your mortgage term, you’d have to refinance your mortgage – and pay a hefty penalty to do so. As well, whenever you refinance, you have to pay a real estate lawyer to oversee the transaction. Hello, legal fees – and more costs that need to come out of your pocket. Unfortunately, the grass isn’t always greener on the other side, and a collateral mortgage might not always be as great as it sounds. Why? Well, for starters, on paper, having a collateral mortgage can make it look like you have more debt than you actually do. Collateral mortgages are registered with a collateral charge, meaning lenders register the home as being worth slightly more than it is (up to 125 per cent more, in fact). They do this so that when the value of your home does go up you’re able to borrow up to 80 per cent of the increased value – not the original amount it was valued at when you first bought it. The downside to this is the collateral charge could make it look like you have more debt than you really do. If, sometime throughout your mortgage, you wanted to secure secondary financing for other things, a lender would have to review your credit history and would see this larger amount registered under your name. Depending on your financial situation at the time, this may be reason enough for them to decline your application for more financing. The second and final reason collateral mortgages aren’t always as great as they sound is that you can’t transfer them to another lender – not even when your mortgage term is up. See, collateral loan agreements aren’t registered with your land title or registry office. Instead, they’re registered under the Personal Property Security Act (PPSA) of Canada. For that reason, it may contain terms that other lenders don’t

So, if you ever decided you wanted to switch lenders, you would need to hire a real estate lawyer (and pay those legal fees) to get you out of your agreement. Now, I’m still not saying you should just steer clear of these products. If you think you’ll need to borrow equity in the future, and plan to keep your mortgage with the same lender, a collateral mortgage would be a great product for you! But for those who favour flexibility: do all your research, before simply signing on the dotted line.

OPEN MORTGAGE: Allows borrowers to repay all or part of the total amount of their mortgage at any time without penalty. Because of flexibility, this is ideal for borrowers who plan to sell their homes in the near future or who want to switch from a short-term mortgage at high interest rates to a longer term when mortgage interest rates fall. CLOSED MORTGAGE: Usually has the lowest interest rate available but lacks the flexible features of other mortgage options. A good choice for those who want the security of knowing their monthly payment is fixed for a longer term. Prepayment options are available but they are subject to conditions. PORTABLE MORTGAGE: Flexibility if borrowers move. Borrowers can take the mortgage to their new home or can transfer it (usually with the consent of the lender) to the purchaser of their old home. This is an attractive option if the rate on the existing mortgage is lower than current rates.
