uying a brand-new home offers you an opportunity to customize it to your liking. It can be a dream come true and an investment for the future – but don’t forget, it’s also legal transaction. The term “get it in writing” has never been more important in the case of the new-home purchase, since such a document outlines everything your home will have in it, on it and around it. Otherwise known as the Agreement of Purchase and Sale, the contract spells out the terms and conditions between you and your builder. Without it, if there is a misunderstanding or disagreement, it’s impossible to prove what was agreed upon. Since building a home is much more complicated than a resale transaction where the unit and/or property likely already exists, there is
no set Agreement of Purchase and Sale or standard contract for buying a new home. In some provinces, builders may have standard contracts prepared by the local home builders’ association or their new-home warranty program. Builders often prepare their own agreements, so contracts can vary from one builder/ developer to another and from province to province. Before you sign a contract, review it carefully with the builder and ask questions to make sure you fully understand what it contains. Your next step is to then take it to a real estate lawyer and have it reviewed. Once it is signed, it becomes a legal document and an agreed-upon contract, so seeking the services of an experienced real estate lawyer is an important step toward ensuring that your dream home becomes a reality.

hen you’re buying a home, particularly your first home, you will need the advice of several professionals: builder, lawyer, mortgage broker or banker, financial advisor and so on. But none of them has the personal stake in the deal that you do. Indeed, it is your transaction, your future and, ultimately, your money. This is why it’s essential to ask questions. Don’t understand something? Ask. Don’t get a satisfactory answer? Ask again.

Alberta Government Introduces Mandatory Home Warranty Protection Owner-builders, who meet certain criteria, are eligible for an exemption from the mandatory coverage and can apply for an owner builder authorization. If it is sold within the warranty period time frame, the owner-builder will be required to provide the remaining warranty to the new home buyer. “It is expected that the new home warranty would cost about $1,700 to $2,000 for an average home, or less than one per cent of the cost of the average house.”
Effective February 1, 2014 all builders are required to provide new home warranty coverage for all new homes built in Alberta. Alberta now has one of the strongest coverage in Canada as mandated under the new Act. Under the Alberta government legislation the New Home Buyer Protection Act, all new detached homes and condominiums would, at minimum, include a warranty for: • One year labour and materials; • Two years for defects in labour and materials related to delivery and distribution systems; • Five years building envelope protection, with a requirement for the warranty provider to offer the consumer the option to purchase additional years of coverage; and, • 10 years coverage for major structural components. “With this new program, Albertans buying new homes will have some of the strongest warranty coverage in the country. This is important, given that a home is the largest purchase most people will ever make,” said Heather Kaszuba, spokesperson for Alberta Municipal Affairs.

The new legislation will expand the current coverage to two years on the various systems, such as electrical and plumbing, ten years on major structural and five years on the building envelope. Building envelope refers to the exterior shell of the home, including the roof and walls. The mandatory warranty will offer a greater protection and comprehensive coverage for home buyers. This extension of time is important as many defects, such as improperly installed windows, vapour barrier, or insulation to name a few, can take some time to appear. Currently about 80% of all new homes only have a one year warranty covering the building envelope, fit and finish, delivery and distribution system and major structural covered for five years. Potential buyers will be able to go onto the registry and see how much warranty is available on the home of their interest. The registry will not cover homes that predate the new mandated warranty legislation. Anyone can go online, type in the address, find out if the home has coverage and what remains. Even if the home has had previous owners the coverage transfers to the new buyer as the warranty resides with the home. The public registry will also show current status and who the warranty provider is so you can find out who to contact to make a claim. The Public Registry will be in place Feb 1st. The Act’s additional warranty coverage for new homes will ease home owner’s minds and make their home owning experience one of enjoyment, not of worry. A monthly maintenance fee ensures maintenance of all the common areas (such as clubhouse, marina, playground, beachfront recreation area and boat launch). The fees also include water, sewage and a full-time on-site manager. There are lawncare and winter snow shoveling services also available. The area surrounding Waters Edge offers a healthy list of amenities. A convenience store and gas station are a few blocks away. Onoway and Alberta Beach offer retail services including grocery and liquor stores, restaurants, gas station, public library, hair salon, dollar store, hotel and golf course. Schools are nearby and the Barrhead and Stony Plain hospitals are only 25 to 30 minutes away. The proximity to Edmonton is a major selling point for The Estates at Waters Edge. A short drive can get you to your lakefront home in no time. Many of the purchasers, however, are not from the Edmonton area. Residents include people from Peace River, Fort McMurray, Whitecourt and Calgary. They have found The Estates at Waters Edge to be the best value and location for Lake Front and Lake View property in Northern Alberta. More than a third of Canadians contributing to RRSPs well ahead of deadlines: BMO Many Canadians got a head start on saving for retirement this year, according to the fourth annual national Registered Retirement Savings Plan (RRSP) study from BMO Financial Group. More than one-third (35 per cent) of Canadians reported that they had already contributed to an RRSP before the March 3, 2014 deadline. This is up five per cent from this time last year.
Additionally, according to the study: » Sixty-four per cent of those who have already made a contribution have contributed at least $2,000 to their RRSP and 40 per cent have put in at least $5,000. »F orty-three per cent of Canadians reported that they will make a contribution to their RRSP by the March 3 deadline. This is down from the 50 per cent who made a contribution last year. » A lmost two-thirds (64 per cent) of Canadians have an RRSP, compared to 67 per cent this time last year. » One-third reported that they usually contribute the maximum amount to their RRSPs. » Last year Canadians contributed an average of $3,544 to their RRSPs. “It’s reassuring to see that many Canadians are being proactive by 48 New home Guide | feb 14 - mar 14, 2014
contributing to their RRSPs well ahead of the deadline. However, according to Statistics Canada the total unused RRSP contribution amount is estimated to exceed $1 trillion by 2018,” says Caroline Dabu, vice-president and head of BMO Wealth Planning Group. “So we encourage everyone to contribute and contribute as early as possible to avoid the difficulties of having to come up with a large lump sum at the last minute.” Dabu adds that using a Continuous Savings Plan (CSP) to make smaller and regular RRSP contributions throughout the year can help alleviate some stress leading up to the deadline. A CSP regularly and automatically withdraws a specific amount of money from an individual’s bank account and invests it directly into his or her RRSP. It eases the cost of investing away from one annual deposit and helps increase savings. RRSP Investing Hurdles The study also examined the reasons why Canadians are not planning to make a contribution to an RRSP this year. These include: » Not having enough money to make a contribution (37 per cent) » Having other expenses which take precedence (33 per cent) » Prioritizing other investments (11 per cent) “It can be difficult to balance all of your financial priorities, whether it is paying down your mortgage, saving for your child’s education or putting money aside for your retirement,” says Dabu. “A financial plan can help you map out all of your financial commitments to help you prioritize. Also, a financial professional can help you understand your options, offer checkpoints to follow your progress, adjust your plan as your circumstances change and work with you to ensure you stay on track for success.”

Saving for retirement outranks reducing debt in 2014 for Canadians: RBC poll
Reversing last year’s rankings, more Canadians are citing saving for retirement as a top financial priority compared to those who are prioritizing paying off debt, according to the 24th Annual RBC RRSP Poll.
More than half (52 per cent) are now focusing on increasing their retirement savings, with 48 per cent placing a priority on debt reduction, compared to 44 per cent and 54 per cent respectively in last year’s poll. This reversal of financial priorities is even more marked among middle-aged Canadians – those 35 to 54 years old – with almost two-thirds (62 per cent versus 52 per cent last year) focusing on saving for retirement ahead of reducing debt (52 per cent versus 56 per cent). 50 New home Guide | feb 14 - mar 14, 2014
“These findings indicate Canadians are more comfortable with how they are managing their debt and this is allowing them to focus more strongly on retirement savings this year,” says Bill Hill, national retirement planning consultant, RBC. “To help ensure those savings will support the retirement they have in mind, we recommend they review their lifestyle and financial goals with a financial advisor as early as possible.” The annual RBC poll also found that RRSP ownership among those aged 35 to 54 has jumped to 68 per cent from last year’s 58 per cent. In addition, one-quarter (26 per cent) of middle-aged Canadians has determined they will need to save, on average, $545,000 for a comfortable retirement. “This is the age group that needs to be planning now for the lifestyle they want to have in retirement,” Hill says. “As Canadians who have already retired know, there is so much more to your retirement years than just the money you think you’ll need. The beginning of each new year is a good time to sit down with a financial advisor to explore all aspects of a successful retirement – you may well find you have more options than you are aware of today.”

It was almost one year ago – March 2013 to be exact – that Target Corp. began opening the fi rst of its approximately 125 stores in Canada. The U.S. retail giant announced in 2011 it was moving north with a $1.8-billion acquisition of up to 200 Zellers store leases, with most of the initial openings coming from renovating existing Zellers locations. While the expansion may not have gone quite as planned, with Canadian consumers not exactly enthralled with Target’s product offerings and pricing strategy, there’s no question the move will continue to have a significant impact on the Canadian retail landscape – particularly as the company builds greenfield outlets in new locations. Now comes news that Wal-Mart plans to spend $500 million completing 35 supercentre projects over the next year. The U.S. retailer says it will spend more than $376 million to build, expand, relocate or remodel stores, as well as invest additional funds on operational improvements. For homeowners and prospective homebuyers, this is all good news – and a very good reason to pay attention. Such major retail developments are a significant influence on land development and housing. When the likes of Target, Walmart, RONA and other major players set up shop, particularly in a new location, it’s a good sign an area could be on the upswing. Like proximity to mass transit, schools and other amenities, being close to shopping is a major attraction for builders and, of course, prospective homebuyers. These features are among the key determining factors to enjoying your home while you live there, as well as for potential resale value in the future. Large retailers and commercial ventures don’t just pop up in the middle of nowhere or in declining neighbourhoods. These companies make careful, long-range and well plannedout decisions in lockstep with municipalities and developers, based on hard data, research and demographic information. This is why major retail expansion is good news: it’s an indicator the economy continues to strengthen; and, for those looking to buy a home, it’s a sign to look out for new or expanding neighbourhoods and solid buying opportunities.

One of the largest expenses we have tends to be the mortgage on our home. Following traditional rules, we are limited to deducting, at best, a small percentage of the interest where we use a home office for business purposes. However, using non-traditional planning, we are able to deduct potentially 100 per cent of the interest costs.
A variety of versions of the plan exist, and vary in aggressiveness and implementation to suit your needs and comfort.
Your tax savings will vary based on where you live in Canada, your income level and the amount of interest you pay. As a quick example, though, with a mortgage of $200,000 at 4.5 per cent, your tax savings could be approximately $3,000 per year. While this may not by itself create financial freedom, imagine receiving these savings year after year – with minimal effort required. Imagine the impact of a higher interest rate or larger mortgage. A popular nickname for describing some of the possible techniques is the “Smith Manouevre,” coined by Frasor Smith. A variety of versions of the plan exist, and vary in aggressiveness and implementation to suit your needs and comfort. With a Supreme Court decision related in part to questions surrounding the appropriateness of interest deduction plans, tax advisors have largely been given the green light to help clients restructure their affairs in an optimal fashion. In its simplest form, these interest deductibility techniques allow homeowners the ability to convert the non-deductible portion of the interest on their mortgage to fully deductible over a period of time. The period is typically several years, however, your financial situation and aggressiveness may dramatically decrease this time.

Tax tips for the homebuyer Tax credits to ease the pain of this big-ticket purchase Buying a home is a big investment and a financial commitment – especially as a first-time homebuyer.
Many first-time homebuyers are generally recovering from the first year of moving into their dream home, and all the associated fees, unanticipated closing costs and expenses to maintain the home.
The Home Buyers’ Plan (HBP) is a program that allows you to withdraw up to $25,000 from your Registered Retirement Savings Plan (RRSP) to buy a qualifying home for yourself or for a related person with a disability
There are a couple of tax credits that homeowners should be aware of when filing their 2013 tax returns. The Home Buyers’ Plan (HBP) is a program that allows you to withdraw up to $25,000 from your Registered Retirement Savings Plan (RRSP) to buy a qualifying home for yourself or for a related person with a disability. RRSPs aren’t just for retirement anymore. This plan lets first-time homebuyers access their retirement savings tax-free, to increase their down payment and decrease their mortgage amount – and interest paid. The HBP withdrawal limit is $25,000 – tax-free – for each you and your spouse, for a combined total of up to $50,000 toward your down payment or other home-purchase related costs. In order to take advantage of this plan, your RRSP contributions must remain in the RRSP for at least 90 days before you can withdraw them under the HBP. Generally, you will be required to repay all the withdrawals to your RRSPs within a period 15 years to avoid paying tax on that sum. You will have to repay an amount to your RRSP each year until your HBP balance is zero. If you do not repay the amount due for a year, that amount will have to be included in your income for that year, and you will be taxed.

Although it is the least glamourous item to buy for the bedroom, it is the most important. A good mattress will make all the difference in getting your beauty sleep each night. “The mattress should last you at least 10 years,” says interior stylist Paul Semkuley. “Especially when you purchase it with the coordinating box spring – as it absorbs up to 50 per cent of the body’s impact.” Semkuley also suggests getting comfy and cosy in store by laying on it like you would normally sleep, to see if the mattress is a right fit. Whether you prefer a mattress that is firm, made of organic material or one that comes with a pillow top for extra comfort, buy the best one you can afford. TIP: Don’t try to save money by using an old foundation or box spring with your new mattress. A mattress paired with its new box spring work together for all around better support, and keeps the mattress in shape longer. FACT: A study conducted in the U.S., Canada, Mexico, UK, Germany and Japan found that a comfortable sleep surface and cosy sheets and bedding were rated the most important romantic elements in all six countries.

time when the only thing an RRSP was used for was saving for retirement, but this is no longer the case. These days, you can use your RRSP as a savings plan for a down payment on a home, among other things. It’s fair to say that the RRSP has become Canadians’ favourite savings account. The problem with RRSPs being all things to all people is that its wider scope, its greater flexibility, its move from a hands-off-don’t-ever-touch-this-money retirement plan to a you-can-use-it-whenever-you-can-justify-it savings account is that the process of identifying your investment strategy has become more complex. Most people say they don’t have enough money to maximize their RRSP and set aside a non-registered emergency fund, which explains the overlap between retirement savings and other types of savings that take place within an RRSP.
The first question to ask yourself when choosing investments for your RRSP is, “When am I going to use this money?” The first question to ask yourself when choosing investments for your RRSP is, “When am I going to use this money?” If you’re using a portion of your RRSP savings as your emergency fund, then keep that portion of the RRSP assets fairly liquid so you can access the money in an emergency. If you’re tapping into your RRSP to buy a home, you’ve got a short- to medium-term investment horizon and must choose investments that suit. So you’ll have to forgo equities in favour of a more-conservative investment portfolio. Since you don’t have the time to wait out the bumps in the road that are part of the equity-investment experience, you have to settle for less return. Being clear on how you plan to use your RRSP dollars is especially important when those dollars are being contributed to a spousal plan or the contributing spouse could find money withdrawn from that plan taxed in his or her hands. taken from a spousal plan within three calendar years of a contribution, that money could be taxable at the hands of the original contributor, defeating the original income-averaging strategy. Make spousal contributions by the end of the calendar year as opposed to in the first 60 days of the new year, since spousal contributions are measured on a calendar-year basis. If you delay your contribution, you’ll end up extending the withdrawal period by another calendar year. Perhaps the toughest part about using your RRSP for myriad purposes is keeping track of which of your RRSP dollars is for what. Here, consolidation may work against you. Instead, consider opening a separate RRSP for each of your purposes and file your statements based on what you’re trying to accomplish. Separate accounts will not only help you stay focused on the purpose for which you are saving, it will allow you to keep your time horizon in perspective. While the money in your RRSP is yours and you decide how to spend it, don’t sacrifice your long-term goals for short-term ones. It’s easy to get focused on a single objective to the exclusion of all others. To be balanced, look at what you want your savings to do for you long-term, medium-term and shortterm. If you’re saving for a home, instead of putting this year’s total RRSP contribution into your “Home Ownership RRSP,” consider dividing it equally between home ownership and retirement. It will take a little longer to get into your dream home, but when you do, you won’t be behind in terms of retirement planning.

One of the most common questions we get is how to transport electronics safely, especially big-screen TVs. During a move, whether it’s across town or across Canada, it is important to give these items special treatment so they arrive in one piece and in good working order. The best advice we have for accomplishing this goal requires some forethought: keeping the original boxes and foam spacers the electronic items came in. That is truly the safest method for moving them. Of course, people rarely keep these boxes, so there are specialty boxes and crates designed specifically to move big-screen TVs safely. People who do their own packing and moving should be aware of how easy it is to damage one of these units. Spending a few dollars extra to purchase or rent one of these special boxes can make all the difference. Another thing to remember is that most of these television sets are mounted on wall brackets, and moving companies are reluctant to disassemble the wall mounts or assemble them at the other end. Usually, if something is going to go wrong, that’s when it will happen – and again, people rarely keep the installation instructions for the brackets. It’s far too chaotic on moving day to try and find instruction manuals. The best plan when preparing for your move is to take the TVs off the walls yourself ahead of time and have them ready to be packaged properly. Here’s a tip for anyone disassembling electronics for a move: Get your digital or phone camera and take photos of the wiring connections on the backs of the TVs, cable boxes, DVD players and the like. When it comes time to reassemble them, it will be much easier to reference how they were set up originally, saving time, stress and frustration.

The same goes for stereos and gaming systems. Many teenagers leave their entire gaming systems hooked up until moving day. It’s up to them to disassemble their systems and hopefully place them into their original packaging. If not, the best thing to do is wrap consoles in anti-static bubble wrap and place them into appropriately sized boxes so they won’t move around during the trip. Paying down debt the top financial priority for Canadians in 2014: CIBC
A new poll from CIBC by Harris/ Decima finds that paying down debt remains the top priority for Canadians in 2014, the fourth year in a row that debt concerns have topped the list in the annual survey. Poll results also show that immediate financial concerns including managing day-to-day spending and paying the bills have become more important to Canadians in recent years at the expense of longer term goals like retirement planning. Over the last four years of this CIBC poll, Canadians identified the following as their top financial priorities:

”For the fourth year in a row, Canadians have told us their top financial priority is paying down their debt as we enter a new year,” says Christina Kramer, executive vice-president, retail distribution and channel strategy, CIBC. “While the intent to reduce debt is clear, we also know that some Canadians are not yet making the progress they want to on reducing their overall debt levels, which speaks to the importance of having a clear action plan in place to reach your goals in 2014.” Poll findings also revealed that less than half (47 per cent) of Canadians surveyed said they had met with an advisor in the last year. As well, out of those surveyed only six per cent named debt management as a topic of a conversation they would have with an advisor. Kramer noted that while

the intention to pay down debt remains strong, it can be challenging if you don’t have a plan in place. “Despite being top of mind for 2014, many Canadians don’t think about sitting down with an advisor and having a conversation about how to reduce their debt,” says Kramer. “Trying to do-it-yourself can work for some people, but most Canadians would benefit from taking a broader view of their finances with an advisor including looking at their debt, and then working out a realistic plan to start repaying that debt over time.” This year’s poll results also show a continued trend towards short term financial goals and issues becoming more important to Canadians, while longer term goals including retirement planning have dropped in the rankings. For example, while retirement planning was named by 13 per cent of Canadians as their top financial priority entering 2011, it is now seven per cent entering 2014. Conversely, “paying the bills” has grown steadily since 2011, and was named by eight per cent of Canadians in this year’s survey as their priority for the year ahead. “Managing cash flow and expenses are immediate issues, but you also can’t put off your retirement planning indefinitely,” says Kramer. “The good news is that if you start early you can take small steps towards building your retirement savings while also focusing on your current financial needs.” Advice on delivering on financial priorities
»T alk to an advisor: Most Canadians don’t think about making debt reduction the topic of a conversation with an advisor, but it can help you make progress on paying down debt by looking at your overall financial picture and putting realistic steps in place to reduce interest costs and accelerate debt repayment. » Recognize that your finances are all connected: Making progress on one aspect of your financial goals can lead to an opportunity to improve in others, meaning you don’t have to focus on just one priority at a time. For example, a reduction in debt can free up funds to go towards retirement savings, or to further accelerate debt reduction. Renewing your mortgage at a lower interest rate can generate an improvement in cash flow that can be used to start making RRSP contributions earlier in life which can grow over time. » Don’t lose sight of the longer term: While it is important to address immediate financial needs such as debt reduction, it is equally important to keep future goals such as retirement in sight. Even small contributions today can make it easier in future years to reach your retirement savings goals. » Stick to your plan: Once you have a plan in place, stick to it. If you fall off track, get back to your plan as soon as possible and keep making progress towards your goal.

Group promotes national approach
to elevating consumer understanding of mortgage risks The Mortgage Broker Regulators’ Council of Canada (MBRCC) is helping consumers across the country gain a better understanding of the risks and responsibilities related to obtaining a residential mortgage. The organization has developed a pamphlet, as well as educational content for its website, to ensure that Canadians in all provinces have access to practical information and important considerations about mortgages.
Know Your Mortgage Risks & Responsibilities, the materials developed by the MBRCC, are part of the organization’s efforts to improve mortgage consumer education. “It is important that borrowers understand the key considerations and implications when agreeing to a mortgage,” says MBRCC Chair Kirk Bacon. “Educating consumers helps them make more informed decisions. This is true regardless of the province they live in.”

The information was developed for use in all MBRCC member provinces. The educational materials and the types of information borrowers received on mortgage risks and responsibilities vary from province to province. “Given the differences, we felt it was an area in need of further collaboration from the provincial mortgage broker regulators,” Bacon adds. The MBRCC developed the pamphlet as a disclosure tool for mortgage brokers to provide to their clients during their initial discussions. It is designed to ensure that borrowers are knowledgeable from the outset, as well as to help stimulate discussions with the broker. “Brokers play a critical role in educating borrowers. Their clients look to them for information and advice. We appreciate their help in getting this information to the public,” says Bacon. The pamphlet introduces readers to mortgage risks and responsibilities and points them to the MBRCC website for further information. The pamphlet is also available on their website for brokers to download and print at their convenience.

Unfortunately not all contractors play by the same rules. Some cut corners to offer lower prices. They promise you a “good deal” as long as nothing is written down and you pay in cash. These cash deals can mean a lot of risk for you. Contractors who don’t do business properly don’t protect you from accidents or their mistakes. If there is a work-related injury or damage to your home, you could face lawsuits and financial loss. You could be responsible for your contractor’s unpaid bills. And you could be stuck with work that is incomplete or badly done. While serious, these risks are easy to avoid. Calculate the combined monthly before-tax income of you and your spouse. Divide by three. This figure is the monthly payment you can afford to make on your home. Take the total price of the home and subtract the amount of money you expect to make as a down payment. This is the money you will have to borrow.

Refer to the chart on the opposite page. Look down the left column and locate the interest rate you expect to pay. Line this up with the amortization period of your choice. (Most firsttime buyers take the 25-year amortization.)

Add to this your estimated monthly heating costs and monthly property taxes. If this figure is equal to or less than one-third of your gross monthly income (calculated in Step 2), you’ll qualify for a mortgage on your dream home.
Multiply this figure by the amount you need to borrow. Divide by 1,000. » Bear in mind that this is a rough estimate. If you have several other large loans already, you may qualify for less. Also, banks and trust companies vary in their policies. The best way to know what you can afford is to go to the lending institution of your choice andget pre-qualified.

Mortgage Types All mortgages are of two basic types: Conventional: The buyer can borrow up to 80% of the purchase price or the value of the property, whichever is less. The buyer has to pay 20% down. A conventional mortgage cannot exceed 80% of the value of the property. Insured or High-Ratio: A buyer can borrow up to 95% of the purchase price or the value of the property, whichever is less. The down payment can be as low as 5%.
Mortgage OPTIONS You can choose any of these mortgage options which fit into the two basic mortgage types. Lenders may even customize these options to suit your needs. Open mortgage: Allows borrowers to repay all or part of the total amount of their mortgage at any time without penalty. Because of flexibility, this is ideal for borrowers who plan to sell their homes in the near future or who want to switch from a short-term mortgage at high interest rates to a longer term when mortgage interest rates fall. Closed mortgage: Usually has the lowest interest rate available but lacks the flexible features of other mortgage options. A good choice for those who want the security of knowing their monthly payment is fixed for a longer term. Prepayment options are available but they are subject to conditions. Portable mortgage: Flexibility if borrowers move. Borrowers can take the mortgage to their new home or can transfer it (usually with the consent of the lender) to the purchaser of their old home. This is an attractive option if the rate on the existing mortgage is lower than current rates.
