The end of one year and the beginning of the next is a natural signpost, a point at which many of us take stock of the recent past and what might lie ahead. As our story on page 44 indicates, 2017 was a year punctuated by numerous major developments in the real estate market. From the National Housing Strategy, to the first interest rate hikes in seven years, to new mortgage rules and foreign buyers’ taxes... And even here at NextHome, where we rebranded and refreshed our publication to address changes in the market and interests of you, the reader. Next year promises to be just as eventful, as we will likely begin to see actions from the just-announced National Housing Strategy. Meanwhile, economic variations across the country will influence regional housing markets – be it those in Alberta in recovery mode, or in Ontario where supply and fast-rising prices are certain to remain top of mind. But, as with anything in life, change also brings opportunity. With the right knowledge, perspective and preparation, prospective homebuyers can still realize their dream of owning a home. BEAUTY & VALUE OF WOOD THIS NATURAL MATERIAL GIVES HOMEBUYERS ANOTHER CHOICE

As builders and developers, we are always striving to provide homebuyers with options, and that includes choices in the building materials that are used in the construction of their new home. For various great reasons, some homebuyers choose wood. For some, it’s an aesthetic choice, as wood has a natural warmth and beauty. Buyers who want to reduce their environmental footprint choose wood because it is a renewable and recyclable resource. Some like that it allows fast, efficient home construction, while others appreciate its strength, the result of advances in wood science. The many advantages of wood were the reasons BILD and its partners advocated for changes to the Ontario Building Code to increase the height standard for wood buildings from four to six storeys. Those amendments came into effect in January 2015. Knowing that some homebuyers prefer wood, our industry has been working to find innovative ways to design, build and market wood construction homes. Small surprise, then, that BILD members were involved in several projects that received accolades at Canadian Wood Council’s 17th annual Ontario Wood WORKS! Awards. Great Gulf was the developer

behind the Centennial Park Residence in Toronto, which received the Environmental Building Award. Because wood was used in construction, 89.5 per cent of the building materials are potentially recyclable. Eighty per cent of the wood products used are certified by the Sustainable Forestry Initiative.

BILD members Branthaven Homes and Kirkor Architects & Planners were the developer and the architect for the Lake House Condominiums in Grimsby,

which received the Midrise Wood Design Award. At six storeys, Lake House is the kind of project that was made possible by the changes to the Building Code. Another midrise builder, Pratt Development, received the Designer/Builder Award. Other BILD members with projects honoured in the Wood WORKS! Awards included Diamond Schmitt Architects and Moses Structural Engineers. Our industry continues to advocate for choice in construction materials. We look forward to seeing taller wood buildings, such as the 12-storey structure George Brown College is planning for its waterfront campus in Toronto. Recently, a committee I was part of helped the Ministry of Natural Resources and Forestry prepare a technical resource that will help members of the industry apply for approval to build wood buildings of more than six storeys. Building wood construction homes is just one way the building and development industry is providing choices to homebuyers.

RECORD OCTOBER FOR CONDO SALES SINGLE-FAMILY INVENTORY REMAINS LOW New construction home sales soared in the GTA in the month of October, primarily driven by sales of multi-family homes, condo apartments in highrise and midrise buildings and stacked townhomes, the Building Industry and Land Development Association (BILD) recently announced. There were 5,377 new homes sold in October, according to Altus Group, BILD’s official source for new-home market intelligence. About 91 per cent of them (4,884 units) were multi-family homes, and only nine per cent (493) were lowrise single-family homes such as detached and semi-detached houses and townhomes. Condo sales for October were 81 per cent above the 10-year average of 2,697, and the highest October yet recorded, while lowrise sales were 64 per cent below the 10-year average of 1,388. As of the end of October, 39,476 new homes were sold in the GTA in 2017, 82 per cent of them condo apartments in highrise and midrise buildings and stacked townhomes. “October data shows that the

new homebuyer is left with very little choice when it comes to purchasing a new home,” says BILD President and CEO Bryan Tuckey. “Provincial intensification policy has our members building more high and midrise dwellings, making housing choices a challenge. The cost of a single-family home is out of reach for many consumers, pushing them to buy a condo over a house. As a result, we are seeing record-breaking condo sales and higher prices this year for new lowrise homes.” While supply of new housing increased again in October and reached 12,500 units, it was still well below what is considered a healthy level. Supply of new housing is typically measured by the number of new homes available for purchase in builders’ inventories at the end of the month. At the end of October, there were 9,308 multi-family homes and 3,192 single-family homes available in the GTA. “Demand for newly-built condominium apartments is being fueled by three key buyer

groups – small investors who have become the de facto providers of new rental housing supply in the GTA; end-user buyers who might prefer a single-family home but are seeking out more affordable options; and the more traditional end users who value the lifestyle and amenities of well-located projects,” says Patricia Arsenault, Altus Group’s executive vicepresident of Research Consulting Services. Prices of available new homes in October increased slightly for both single-family lowrise homes and multi-family homes. The average for available new single-family homes was $1.21 million, up from $1.20 million in September, and 29.8 per cent above last October’s average price of $937,689. The average price for available new detached homes was $1.54 million, and the average for available new townhomes was $995,571. Meanwhile, the average price of available new condos in highrise and midrise buildings and stacked townhomes was $677,456 in October, up from September’s $661,188.

Bryan Tuckey is set to retire as president and CEO of the Building Industry and Land Development Association (BILD) at the end of the year – literally, in the next few weeks. Now, executive director type positions in industry associations are often figurehead roles, hired to be the face of an industry – and sometimes even take the heat – for those really calling the shots behind the scenes. Bryan Tuckey, at least in my opinion, was no such CEO. Already previously retired, Tuckey assumed the role under difficult circumstances, following the sudden 2011 death of thenCEO Stephen Dupuis. Heading up BILD – the voice of the home building, land development and professional renovation industry in the GTA – even at the best of times would be no easy task. It’s only the largest home builders’ association in Canada. Nice walk in the park for a second career, eh? Far from it. Think of what’s happened in Tuckey’s five-year tenure: the GTA continues to attract

an estimated 100,000 new residents every year; Toronto has consistently been among the country’s hottest – and most expensive – housing markets; condos have exploded as the predominant housing type;

At the Toronto Real Estate Board’s Market Year in Review & Outlook 2017 event last January, the man was on fire. He was at his best – direct, passionate and clear. housing supply has reached “crisis proportions,” and therefore contributed to skyrocketing prices. Home builders and developers have taken some criticism for such developments, as the uninitiated would pin the cause of rising prices on the “greed” of the industry. The onus for the truth, based on facts, not emotion, fell to Tuckey. One of his first acts when

taking over at BILD was to devise a long-term communications strategy, not just to combat such misconceptions but to educate the public. Indeed, not only the public, but government and other stakeholders as well. During Tuckey’s five years as CEO, I’ve heard him speak countless times. But at the Toronto Real Estate Board’s Market Year in Review & Outlook 2017 event last January, the man was on fire (see Q&A page 92). He was at his best – direct, passionate and clear. Exactly the kind of voice the industry needs. And therein lies the challenge – and opportunity – to continue the momentum. With Tuckey’s successor to be named mid-month, BILD’s new CEO will have big shoes to fill.

NATIONAL HOUSING STRATEGY BEGINS TO ADDRESS HOUSING NEED IN CANADA by WAYNE KARL

After more than a year of consultations with everyday Canadians, experts, stakeholders, think tanks and provinces and municipalities, the federal government recently unveiled Canada’s first ever National Housing Strategy. Billed as the tool that will help reduce homelessness and improve the availability and quality of housing for Canadians in need, the 10-year, $40-billion plan aims to: • Reduce chronic homelessness

by 50 per cent • Remove more than 530,000 households from housing need • Create four times as many new housing units as built under federal programs from 2005 to 2015 • Repair three times as many existing housing units as repaired under federal programs from 2005 to 2015, and • Protect an additional 385,000 households from losing an affordable place to live.

“Everyone deserves a safe and affordable place to call home,” Prime Minister Justin Trudeau said in announcing the Strategy. INVESTMENT UNDER THE PLAN INCLUDES:

million through a new Federal Community Housing Initiative • $4 billion for a new Canada Housing Benefit launching in 2020 in partnership with provinces and territories, and • $2.2 billion to reduce homelessness “The National Housing Strategy will create a new generation of housing in Canada,” says Jean-Yves Duclos, Minister of Families, Children and Social Development and Minister Responsible for Canada Mortgage and Housing Corporation. “It will promote diverse communities and will build housing that is sustainable, accessible, mixedincome and mixed-use that will be located near transit, work and public services.” Though details on some of the inclusions are still to come, the home building industry is generally positive about the Strategy. “With regards to the Canada Housing Benefit, CHBA has long recommended such a measure to help low-income Canadians participate in the wider housing market,” says Kevin Lee, chief executive officer of CHBA. “The vast majority of Canadians in core housing need have an income problem, not a housing problem. This Benefit can provide them support and choice, rather than tying them to specific housing units.” CHBA had also recommended the introduction of a “portable” housing benefit that would support low-income individuals directly, rather than subsidize buildings. Data released by Statistics Canada recently confirms that more than 836,000 households need income support based on their rent-to-income ratio. This means that more than three-quarters of households designated as in “housing need” live in adequate housing, but can’t afford it. 36  NextHome.ca  |  GTA

CHBA says it was also pleased to see the federal government commit to a new public engagement campaign to encourage inclusive communities. A national “NIMBY to YIMBY” campaign (Not-InMy-Back-Yard to Yes-In-MyBack-Yard) has also been a CHBA recommendation to support the development of complete mixeduse, mixed-income communities. Inclusive communities can promote inclusiveness and greater housing affordability, as well as fairer treatment of newcomers to housing. One area where the Strategy comes up short is the issues of housing supply and affordability. “While the Strategy acknowledges the social value of home ownership, and the key role of market housing in meeting the housing needs of Canadians, it does not address issues of supply and affordability,” according to the Building Industry and Land Development Association (BILD). These issues are top of mind with Canadians, especially younger families and those working hard to achieve a middle-class life. BILD has maintained that a complete National Housing Strategy must address the full “housing continuum” – from

social housing and housing assistance measures, to market rental and ownership housing. “Otherwise, deteriorating affordability will simply increase demand for social housing and other types of assistance.” Real estate expert, author and educator Don Campbell says that while the Strategy sounds promising initially, the proof will be in future legislation. “As with many of the recent provincial and federal government announcements, the reality, versus the marketing, will be hidden in the legislation,” he told NextHome. “The ideas and policies, although based in problem solving, aren’t often implemented towards the stated goal. It is difficult to see how much more ‘affordable’ rent will become, even with the proposed $200 federal rental subsidy, if policies, like those (recently) legislated in Ontario and being discussed in BC, reduce supply right as demographic demand is increasing. “We should all be prepared for a flurry of announcements and headlines over the coming months as more details are brought to the forefront,” Campbell adds. “But, once again, the true story will come out in the piece of legislation.”

GREATER PROTECTION FOR HOMEBUYERS FACING RISING PRICES

A new home or condominium is an investment in your future. Like any other major life decision, however, it also comes with risks. If you’re planning on taking the leap into homeownership in 2018, you can buy with added confidence thanks to some new consumer protection measures that will be coming into force. Under the Ontario New Home Warranties Plan Act (ONHWPA), buyers of new non-condominium freehold homes are eligible for a maximum of $40,000 in deposit protection. In 2018, pending the approval of our proposal, this coverage will increase to 10 per cent of the purchase price up to a maximum coverage of $100,000, with minimum coverage of $60,000. As well, if Bill 166, the Strengthening Protection for Ontario Consumers Act, 2017 passes, the current deposit protection under ONHWPA would be extended to include other payments such as upgrades and extras. As home prices have risen, so have the amounts required for deposits. This change would help bring the deposit protection levels more in line with today’s market. Deposit coverage for condos would remain the same since the law requires that the full deposit be held in trust. If for some 40  NextHome.ca  |  GTA

reason these funds are released improperly from the trust, Tarion would cover up to $20,000. Are you eyeing a condo in a converted warehouse or church? Another upcoming change means your home will now have warranty coverage. Called “residential condominium conversion projects,” these developments turn existing buildings into condos that incorporate some of the building’s more interesting features (for example, large windows, framing, brick walls) into the design. All of the warranties (one-, twoand seven-year) included in the Ontario New Home Warranties Plan Act will apply to these condos with one exception: any pre-existing elements – which, for example, might include a foundation or exterior cladding – would not have the one-year warranty regarding workmanship and materials. Once the new regulations are in force, builders of condo conversion projects and vendors

who wish to sell units in these projects must also be registered with Tarion. The changes to deposit protection and coverage of condo conversion projects would affect new homes with a purchase agreement signed on or after Jan. 1, 2018. While we cannot eliminate all the risks involved in buying a home, these changes would provide added protection if something goes wrong. ONTARIO TAKES ACTION ON HOUSING AFFORDABILITY

Ontario decided to take action on housing affordability in 2017 by introducing the Ontario Fair Housing Plan. Sixteen measures were designed to help bring stability to real estate, including: the 15-per-cent NonResident Speculation Tax in the GGH; expanding rent control to protect tenants from drastic rent increases; identifying provincially owned land to be used for new affordable housing; and a $125-million, five-year program for the construction of new purpose-built rental apartment buildings by rebating a portion of Development Charges.

CANADA DEEMED MOST EXPENSIVE HOUSING MARKET

Canada is the most unaffordable real estate market in North America, according to a study by Points2 Homes. The affordability ratio was calculated to measure affordability (the median home sale price divided by the median annual family income) in 50 of the most populous cities in Canada, the U.S. and Mexico. The higher this ratio is, the more time it takes to pay off your house, and the wider the affordability gap. The study found that Canada is North America’s most expensive market, with Vancouver topping the list, and out-ranking pricey U.S. markets such as Manhattan and San Francisco. Other Canadian markets on the list were Toronto (number 13), Mississauga (14), Montreal (31) and Calgary (32).

VANCOUVER WELCOMES LOCALS-FIRST POLICY

High home prices and low supply continued to push buyers out of Canada’s two most expensive housing markets – Toronto and Vancouver – and into surrounding areas. The first quarter of 2017 witnessed more buyers leaving Toronto’s downtown core, in search of more affordable markets in southern Ontario. Meanwhile, in Vancouver, buyers and those migrating from other provinces are fueling activity in Fraser Valley, Kelowna and Victoria, particularly in the upper-end of the market due to relative affordability in these regions.

10 CANADIANS’ HOUSEHOLD DEBT AT ALL-TIME HIGH

Canadians’ debt levels reached an all-time high in 2017. Statistics Canada reported that credit market debt as a proportion of household disposable income increased to a whopping 167.8 per cent, meaning that for every dollar of household disposable income there was $1.68 in credit market debt.

9 EDMONTON ON THE ROAD TO RECOVERY

It was a year of recovery for Alberta, becoming the fastestgrowing provincial economy, according to the Conference Board of Canada. In Edmonton, GDP was to increase 3.9 per cent for 2017 and another 2.2 per cent in 2018. On Oct. 17, Mayor Gregor Robertson introduced a motion to city council aiming to prioritize new presale homes for Vancouver residents. One day later, the policy was passed. The policy would require new developments to give Vancouver residents the first opportunity to purchase pre-sale homes in Vancouver. While controversial, the proposed policy would be part of the city’s 10-year housing strategy to relieve the affordable housing crisis.

2017 BUDGET FALLS SHORT

Budget 2017 proposed to spend more than $11 billion over 11 years in a variety of initiatives, including renewed federal investments combating and preventing homelessness, making more lands available for affordable housing, and a new $5-billion National Housing Strategy, which would be introduced later in 2017 focusing on critical housing issues and support for vulnerable citizens. However, the budget was criticized after failing to address key market-related issues, such as affordability concerns among first-time buyers.

As of October, the national MLS Home Price Index was up 9.7 per cent year over year, the smallest year-over-year increase since March 2015. The decline in growth largely reflects softening price trends in the Greater Golden Horseshoe, according to CREA.

Following Vancouver’s footsteps, Toronto welcomed a 15-per-cent foreign buyers’ tax in April. Between April 24 and May 26, one month after the tax was introduced, foreign investment had dropped to 4.7 per cent. Between May 27 and Aug. 18, transactions involving foreign buyers dropped to 3.2 per cent.

4 INTEREST RATES INCREASE – TWICE

The Bank of Canada (BoC) raised its benchmark interest rate – for the first time in seven years – in July to 0.75 per cent. In September, the BoC raised the rate again to one per cent. Those with variable-rate mortgages would immediately see an increase. For fixed-rate mortgage holders, they won’t be affected until renewal time.

2 NEW MORTGAGE STRESS TEST

The Office of the Superintendent of Financial Institutions (OSFI) announced that, effective Jan. 1, 2018, all uninsured borrowers – those with a down payment of 20 per cent or more – must undergo a “stress test” and qualify at a new minimum rate, which is the greater of the Bank of Canada’s five-year benchmark rate (currently 4.89 per cent) or 200 basis points higher than their actual rate. The changes will affect the amount buyers can afford; in one example, $706,692 under the old rules, and $559,896 under the new guidelines.

1 NATIONAL HOUSING STRATEGY

After more than a year consulting with Canadians, experts, stakeholders, provinces and municipalities, the federal government unveiled Canada’s first National Housing Strategy in November. Intended to help reduce homelessness and improve the availability and quality of housing for Canadians in need, the 10-year, $40-billion plan aims to: • Reduce chronic homelessness by 50 per cent • Remove more than 530,000 households from housing need • Create four times as many new housing units as built under federal programs from 2005 to 2015 • Repair three times as many existing housing units as repaired under federal programs from 2005 to 2015, and • Protect an additional 385,000 households from losing an affordable place to live.

BEST PRACTICES TO MANAGE CONDO OPERATING COSTS

JEANHY SHIM In the Nov. 25 issue of NextHome, in the debut of my Condo Board column, I wrote about maintenance fees and why they seem to rise uncontrollably. In short, the best thing condo boards can do is actively manage costs on a regular basis, and involve residents in the process. Easier said than done, right? Not necessarily. There are some very achievable best practices that boards can adopt to help manage operating costs: • Establish clear goals from the outset, and review and revisit them annually prior to budget time. Such objectives provide the critical lens through which all spending decisions can then be considered. • Know and understand your operating budget, line item by line item. This will be invaluable knowledge for reviewing the monthly financial statements of the corporation, as well as in preparing the annual budget, which establishes new or increasing maintenance fees. Exactly where, how and why is corporation money being spent? Is this a one-off unexpected expense? Is it part of an on-going expense that is growing? Or is this a new expense that you now need to start budgeting for? • For non-discretionary costs, consider if there are opportunities to manage or control these costs through 56  NextHome.ca  |  GTA

resident education or changing suppliers. And for discretionary costs, are there opportunities to manage or control these costs through changing suppliers, changing the scope of work or service providers or improving resident education?

• Proactively maintain your key building operations systems from the outset, both inside and out, to maximize their lifespan. This will have a positive impact on your reserve fund study and subsequent contributions. • Undertake an energy audit of all major interior and exterior building systems and common elements, and then invest in longterm energy-saving upgrades to generate proven returns within a

reasonable time period. • Recognize and embrace the importance and potential impact of resident education in order to control all costs that can be controlled, no matter how seemingly insignificant. Every dollar saved through reduced or changed consumption habits adds up. • Save your budget surpluses by using them as budget contingencies for subsequent years. Ideally, a budget contingency of three to five per cent of operating costs is good governance practice, particularly for younger condominium corporations. If any surplus remains after creating a contingency, plan for this amount to offset future reserve fund contributions or one-time special projects – not ongoing operational costs. With such practices, condo boards and residents can all do their part to help manage operating costs, for the better of their building and the bottom line. The temperatures have dropped and the time change has made our days shorter – we are entering the (dreaded) winter season! If you’re like me, you want (need!) a cosy place to curl up, stay warm and survive the cold months. If you want to create a spot to enjoy winter from the indoors, a place to pass the hours in comfort, a nook to go to when you need to forget what’s outside, I’ve got tips to help you create such a place. A place you’ll look forward to hibernating in! I simply love fireplaces. I could sit and watch the flames dance all night long – there is such a calming effect to having a fireplace nearby, and all the better when you get added warmth from it. While not every space can accommodate installing a fireplace, every space can accommodate an electric unit. It’s hard to believe the fireplaces I use are so portable and give so much flexibility. They look so real, give off heat, and add ambiance to any room. I used a compact stove in one nook and created a traditional mantel in another area. These, from Dimplex, were ready to go just by plugging them in. When it’s that simple, you can move them to another area for some cosiness (not that you’ll ever want to move it out of your cuddle-up corner!). Just look at how these nooks came together, instantly creating a place you want to be. While a fireplace screams relief from a cold winter’s day or night, you can still create a warm and relaxing

space without one. The cosy factor comes from having what you need surrounding you. Furniture is minimal. You’ll want a comfy place to sit – a big chair, a chaise or something bigger. Are you going to be enjoying this nook on your own or with the family? Choose seating accordingly, and add in a pouf or ottoman to ensure you can put your feet up and relax. A side table is also mandatory. You need to feel snuggly, warm and relaxed, which means having a warm cup of tea or a soothing glass of vino nearby! The accessories you choose are just as important. Faux fur throws and pillows give your space the cuddle factor and can incorporate an outdoor/nature feel. Touchable, cosy fabrics are important. You don’t want to overdo it. If you’re looking for a cosy nook, sometimes less is more. You don’t want to crowd the space, but you can still incorporate some art. Pick what you love, from family photos to inspirational messages. Something that is often overlooked, but I always suggest including, is faux plants. In the winter months we are all deprived of greenery but these zero-maintenance accessories bring the feeling of nature inside. I found some at Bouclair, along with a number of accessories that caught my eye. When you are creating your own cosy space, why not match your pup’s cuddle zone to yours? I have a new line of dog beds that match my throw pillows perfectly. Now both you and your fur-friend can lounge in style on the darkest and dreariest of night. Hidden off the main Queen Street thoroughfare, Crown Flora is a plant lover’s respite from the bustling city vibes

It all began with a Crown mason jar. When Davis Khounnoraj and Adam Mallory opted to start a business together, they could only hope that it would resonate with Torontonians. When the two began hawking teeny tiny mason jar terrariums with the aesthetic whimsy of Amélie and the lines of fine sculpture, word got around quickly. Downtowners cottoned onto the idea of a pint-sized forest in a jar — a speedy and low-commitment way to breathe new life into a room. At it turns out, Crown Flora’s creations were exactly what the nature-deprived condo crowd had been craving. TWO POINTS OF VIEW

own creative journeys before pairing up to make botanical magic and more. Raised in Prince Edward County, Mallory was practically born with a green thumb, his garden-happy family immersing him in the world from day one. Eventually, he graduated into retail, creating floral arrangements for high-end boutiques. Meanwhile, Khounnoraj established himself as a bag and accessories designer, building pieces with leathers and treated textiles to great effect. While Mallory is more of an expressionist, Khounnoraj views things from an architectural standpoint, drawing inspiration from the cityscape’s hard angles over the sinuous lines of nature. What brought them together was the organic means of creating something beautiful.

Parkdalers through and through, it only made sense for them to open their shop in the ‘hood they call home. While they initially inspired urban condo-dwellers with their offerings, customers are now traipsing from across the city to source botanicals for their homes. Cacti, succulents, orchids, tulips and poppies are but some of the plants for which Crown Flora is known. While the shop serves as a spot to grab the perfect echeveria en route to a soirée, it’s also a spot that will help customers add life to their own parties. FINANCING THE HIDDEN TRICKS & FINE PRINT

I cannot believe how certain builders (“Vendors”) try to take advantage of new homebuyers on the issue of mortgages. There is an attempt to squeeze extra money from innocent purchasers through clauses inserted into the Agreement of Purchase and Sale. Here are some things to watch out for: 1 | “The purchaser agrees to apply to a lending institution designated by the Vendor... to assume any existing first mortgage... The first mortgage shall bear interest to be fixed by the lending institution at a rate not to exceed __% and have about __ years to run...” This clause makes sense and allows certainty for both sides. Where the buyer gets potentially damaged is when this clause is combined with clauses 2 or 3 that follow: 2 | “If at any time prior to the completion of the sale, the Vendor determines that it is unable for any reason whatsoever to arrange first mortgage financing for the subject property with a lender of its choice, this Agreement may, at the Vendor’s option, be declared null and void and the deposit money returned to the Purchaser without deduction or interest.” This is scary. First of all, you have a Vendor with no restrictions 68  NextHome.ca  |  GTA

or obligation to be reasonable, and this Vendor will probably react only out of self-interest. Our poor buyer, if terminated, doesn’t even get interest on his deposit and this clause may be applied right up to closing. 3 | “It is agreed and understood that the term of the first mortgage may be varied at the option of the Vendor, by decreasing it by not more than 20 per cent of the total term... In the event the vendor has not received a mortgage commitment... above described, Purchaser agrees to accept such mortgage upon such terms and at such interest rate as the Vendor is able to arrange, provided that the interest rate... shall not exceed the interest rate shown above by __%.” This clause gives the builder the unrestricted option to reduce the term, as an example from five to four years (lowering the cost of money), and increase interest over what you thought you were getting at the beginning. A fairly sneaky builder could get a commitment that builds in a percentage of your mortgage payments as a bonus to the builder. This clause could be used by an unscrupulous builder, to the extreme detriment of an innocent purchaser. 4 | Sometimes a mortgage schedule is buried in the back of the Agreement. I once reviewed one with a clause allowing the builder to terminate if the buyer did not provide him an acceptance letter for financing from an

institution within 10 days of acceptance of the offer. Hmmm, closing in two years but we need to give the letter now? Good luck! And the builder has the right to terminate any time up to closing.

SO, WHAT SHOULD YOU DO?

a) Amend clauses like 2, 3 and 4 if they appear in your offer, or don’t firm up. Request the option to seek your own financing, and get it in writing. b) When you see clauses like 2, 3 and 4, be suspicious – especially if they are buried in fine print, You should wonder whether you can trust a builder who does this.

Make sure the offer is conditional for a few days on both financing and review by your lawyer. It is critical that you get the right advice. Only a lawyer can provide legal advice – that is the law. An income property can be a good way to make money, especially in retirement. However, there are things you need to consider before taking the plunge. Here are the advantages and disadvantages of buying an investment property: ADVANTAGES You can use leverage: If you have

equity in your home, you can use it to help finance the purchase of another property. In a low-interest rate environment, mortgage rates are lower as are the costs of buying an income property. You’ll build up more equity when you earn rental income to pay down the mortgage. In the future, you could use that additional equity to buy another property or properties but you should ensure you can make larger mortgage payments when rates increase. You can earn additional income regularly: As long as you have a

tenant, you’ll earn monthly income on a regular basis. The more investment properties you have, the more you could potentially earn. You don’t often get regular income from other types of investments. You get tax deductions: While you’ll earn rental income, you’ll also be able to deduct any expenses. maintenance and repairs, property taxes and legal fees are just a few of the expenses that are deductible. It’s best to consult with your accountant to find out what costs you can deduct. DISADVANTAGES You may need additional financing: If you want to buy a

multi-unit property and intend to live in it, you’ll need a down payment of between five and 10 per cent, depending on the total number of units in the property. But when you purchase a property you don’t plan to live in, you need a down payment of at least 20 per cent. Also, some lenders won’t recognize 100 per cent of the potential rental income you might expect to earn; some may consider just 50 per cent, while other lenders might consider 80 per cent. So, you could be forced to make a bigger down payment to qualify for a mortgage. You might not always have a tenant: Ideally, you’ll earn enough

rental income to cover your annual costs. However, you’ll still need to make mortgage payments without a tenant. You should be prepared for the worst and have an emergency fund for the times you don’t have a renter. Your property isn’t a liquid investment: If you own stocks or

bonds, you can buy and sell them quite quickly. However, it can take a long time between listing your property for sale and the closing date. This might be a problem if

DEBBIE COSIC Planning for the year ahead, I’ve been discussing the issue of housing supply with builders and developers across the country and analyzing housing data. It’s an exercise we perform regularly – using Statistics Canada data, including housing data from last year’s census, to formulate our strategies. And in looking at 2018, population growth, housing supply and affordability are the issues that stand out most – and not for good reason. Since supply and demand directly affect what housing is available, as well as the cost, these findings are worth discussing. This is especially true in the context of the need for more supply – and why we need to clear the pipeline for more quality housing.

WHERE ARE PEOPLE GOING TO LIVE?

POPULATION EXPLOSION

According to the 2016 census, the GTA population grew by more than 340,000 people in the last five years. To put this in context, that’s roughly the size of metropolitan Victoria in BC. We also found that with each percentage of population growth in Toronto over the last five years, there was an eight-per-cent growth in the cost of housing. With the GTA’s population projected to increase from 6.7 million in 2016 to 9.6 million by 2041 (according to the Ontario Ministry of Finance), without adding additional housing stock, we will see housing prices 76  NextHome.ca  |  GTA

They are more affordable than detached homes and the only thing currently available due to the province’s intensification policies which make buildable land scarce

and highrises necessary. WHY IS AFFORDABLE HOUSING SO DIFFICULT?

The problem is three-fold. We don’t just need more housing, we need municipalities to adopt land-use changes that permit more residential development and a streamlined planning process for the rezoning, site plan approvals and official plan amendments that may be necessary on the developer side. Since the Ontario government’s growth plan has mandated intensification along transit corridors, including the future LRT lines in Vaughan, Toronto and Mississauga, developers and municipalities need to work together more than ever to get new communities built. However, the plan to eliminate the Ontario Municipal Board (OMB) is a move that will not help supply. In fact, it could prove to be a costly mistake – choking off new development proposed by the building industry at a time when population growth, housing supply and affordability should be the focus, not NIMBY-ism. Q+A WITH BRYAN TUCKEY, OUT-GOING PRESIDENT AND CEO OF THE BUILDING INDUSTRY AND LAND DEVELOPMENT ASSOCIATION by WAYNE KARL

NextHome chats with Bryan Tuckey, president and CEO of the Building Industry and Land Development Association (BILD), who is retiring at the end of the year.

NextHome: You’ve been BILD

president since 2012. How would you characterize your five years in office? Bryan Tuckey: I fully believe BILD has been a thought-leader in the industry over the past five years. We have shown leadership in influencing government policy in order to enhance the building and development industry by working with municipal, provincial and federal governments. We’ve done a fantastic job of raising the profile and reputation of the home building and residential land development, and the professional renovation industry in the GTA. 94  NextHome.ca

We’ve also done a great job in developing and implementing new initiatives to help generate membership growth and retention numbers. BILD has successfully managed to take ownership of the three Home Shows, and we have significantly improved them by creating an immersive and interactive experience for the consumer, especially with our Destination Renovation exhibit that allows consumers to speak directly with professional renovators. NH: How has the association

changed in that time?

BT: The actions by the various levels of government are having a greater impact on industry and consumers than ever before. The association’s advocacy and communication efforts on important issues has never been more active. The fact is those in government choose not to listen to the advice of experts. The board has established a more business-like and accountable framework for the governance of the association. The association world is changing rapidly and BILD is keeping up with those changes. BILD’s world changed with the purchase of the three existing Home Shows ... The future of BILD has never been brighter. NH: The key issues facing the

industry – namely, lack of supply, the slow municipal approvals process and the impact on affordability – have only increased in intensity. How much progress is the industry making on these fronts? BT: During my tenure at BILD, I have written regular media columns that have advocated for developable land with proper infrastructure (water, waste water and hydro), to streamline development approvals, reduce excessive red tape, and to update out-of-date zoning bylaws. Recently, the province of Ontario released a 14-point action plan that includes recommendations to better align infrastructure and land use planning. It is also


looking at supporting forwardlooking zoning and providing guidance for municipalities implementing provincial land use policies. I would like to think that BILD has influenced the province’s new action plan. NH: We’ve heard you speak many

times, but you were especially direct at the Toronto Real Estate Board’s Market Year in Review & Outlook 2017 event last January. You said, “Never in my 30 years in the industry have I seen such a disconnect between public policy and a lack of public awareness and understanding,” in referring to the Ontario government’s land-use policy favouring intensification in the Greater Golden Horseshoe, which was resulting in a shortage of housing reaching “crisis levels.” Almost a year later, what has changed?

• Approve all outstanding environmental assessments that relate to critical infrastructure Update zoning bylaws across the GTA to support the implementation of provincial intensification policies • Ensure that zoning bylaws are updated within three years of an Official Plan update Support intensification policies with public education and promotion • Municipalities and the province must show leadership and educate the public about intensification so they understand why their neighbourhoods are changing • Explain that growth is good for residents and businesses in existing neighbourhoods, as well as the overall economy

I often ask the question: What is the public interest case in high housing prices? I have yet found someone with an answer to the question. NH: What’s the one piece of

advice you would leave your successor? BT: One of the first things we

completed when I arrived at BILD was a Communications Strategy. It was a 15- to 20-year plan to change the public’s impression of an industry that builds some of the highest quality homes in the world. So I would advise them to maintain the principles of the strategy and continue to inform and educate the public, with fact-based evidence, of the challenges the GTA faces and the contribution this industry makes. NH: Any parting words for

BT: Provincial land use policies,

like the Growth Plan meant to limit sprawl and encourage urban intensification are, while well intentioned, helping to create our housing crisis. Today, we are seeing frustration, angst and fear among consumers, inflated pricing and undiminished demand for lowrise homes. The very condition the policies were intended to change. The industry has taken direction from policies that have been supported and endorsed by our elected officials; however, government has not done its part in making the process easy. There’s no escaping the reality that the market is experiencing a crisis, and new housing policies are desperately needed. GOVERNMENT NEEDS TO: Streamline the planning approval process and remove red tape by: • Ensuring that local Official Plans are updated • Pre-designate and pre-zone land

Build and fund needed infrastructure • Government must do its fair share by building new infrastructure before people move in to the area • Infrastructure such as transit and water/wastewater are critical pieces that contribute to the health of the economy of an entire community and it is time to look at growth as an investment and not as a cost. NH: What would you have liked

to make more progress on, as you prepare to leave BILD? BT: Making more impact having the public understand the impacts of government policy on the housing market. I don’t know a more regulated industry than the housing sector. Governments are making the rules and the industry has done an exceptional job to transition businesses and build the product type policy dictates. The result has been the highest housing prices in the GTA’s history.

homeownership and become more active. The cause of the high housing prices is public policy. Understand the facts and help the industry advocate for change. We want to build homes people can afford to purchase; especially first-time homeowners. At some point, government will have to say: ‘Our policies are creating outcomes that are not in the public interest’, and listen to those who are experts in building communities – the industry. NH: Any immediate plans after

you leave? World travel? BT: I see considerable travel

in my future. I have a lifetime objective of visiting 100 countries. I just passed 70 ... We have definite plans to visit Peru and the Antarctic. I will be taking a road trip to Calgary in the summer. DEC 9, 2017 - JAN 6, 2018  95
