A NEW YEAR IS THE PERFECT TIME FOR A NEW HOME Whoosh. That’s the sound 2018 made as it zoomed by and dissolved into another year of blurred memories. I don’t know about you, but time seems to be moving faster than ever these days, in spite of efforts to ‘live in the moment.’ On the bright side, with every new year comes new dreams, potential and possibilities, including finding a new home. It doesn’t matter if you are a first-time buyer, you’re looking for a bigger home for your growing family, or your kids have moved out and you’d like to downsize. The Ottawa new-home market is filled with so many choices and options, it’s easy to make this the year you find your perfect new home. For readers who are downsizing or looking to buy an ‘age-in-place-property’, in this issue of NextHome + Condo Guide, columnist Marnie Bennett addresses some of the things you may want to think about when looking for a home where you can live and age gracefully, or downsize if that’s what you prefer. WHAT HAPPENS IF IT GOES WRONG?

You are finally ready to purchase a home, you have picked out the shade of blue you want to paint your living room, you have picked out the matching curtains, and the new 50-inch television is ready to be delivered the day after closing. The home of your dreams is at your fingertips. What can go wrong? First of all, before you even start shopping for a new home, go to your bank, trust company or other financial institution and see what amount of a mortgage you can qualify for. Do not put an offer on a home of any kind without a mortgage pre-qualification so you know how much money you will have available between your resources and the bank. It is a tragedy waiting to happen if you sign an unconditional offer, give your hard earned money to your builder or real estate agent and later find out you didn’t qualify for the mortgage in the first place. An Agreement of Purchase and Sale for the purchase of land is a contract. Once it has been signed, it is unconditional and binds both of the parties to do the things that they are obligated to do under that contract. If either party does not perform their part of the bargain, they can be liable to the other party for either specific performance or damages. Firstly, if a purchaser defaults, he/she will likely lose the deposit. The vendor will then have the option

of suing to force closing of the deal and to make the purchaser pay all legal fees related thereto (specific performance), or sue for any damages the vendor might suffer before he resells the house (things like interest, changes, price differential, etc.) and legal fees. If the vendor defaults, you have the same kind of rights to force the closing or receive damages plus you can tie the property up with a lien until all is resolved. What if circumstances change? Say you lose your job, get a divorce, or worse, someone dies in between the period of signing the offer and closing the deal? For new-home contracts, many vendors will try to help if you approach them and explain the circumstances. Remember they have no obligation under the law to help you. It would be a gesture of goodwill or compassion only. In this circumstance, the best thing to do is to discuss the matter with your lawyer. Your lawyer will calmly explain the options to help mitigate and/or reduce potential loss. A great real estate agent (like my son Jonathan Schwarz at Revolution Realty) will move

heaven and earth to find you a buyer to take over your deal. Usually this is the best solution. The moral of the story is to make sure you have financing or that the offer is conditional for a few days on both financing and being reviewed by a lawyer. Be prepared for adversity and have a back-up plan if it happens. It is critical you get the right advice and only a lawyer can provide legal advice – that is the law. When you select a lawyer, find one who cares about you and wants a long-term relationship. Questions or comments? EVERYONE HAS THE RIGHT TO AN ACCESSIBLE NEW-HOME WARRANTY PROGRAM

If you have a disability and buy a new home, you may ask your builder to install devices or features that will make your home more accessible. But what if your disability creates challenges in communicating with your builder or in completing the forms to make a warranty claim? Under the Accessibility for Ontarians with Disabilities Act, 2005 or AODA, businesses are required to comply with the Accessible Customer Service Standard. At Tarion, this means we are committed to ensuring that we deliver services that are integrated, accessible and respect the dignity and independence of each individual. What this looks like on a day-today basis depends upon the needs of our customers. I’ve heard numerous stories of how our staff have put our commitment to accessibility into action. For instance, by bringing a sign language interpreter to a conciliation for someone who was hearing impaired or by offering assistance with filling out warranty forms for someone with vision loss. When it comes to making our services accessible, there is no ‘one size fits all’ approach. and accessibility issues can present themselves in many different forms and we rely on our customers to let us know what their needs are, so we can work together to determine how best to accommodate them. We understand that not all disabilities will be visible and that helping our customers can mean ensuring they feel comfortable in particular situations. In one case, for example, we had a homeowner who wanted a warranty services representative doing an inspection at their home to wear gloves in order to avoid physical contact with their possessions. If you are a homeowner with a disability, you have the same warranty rights as any other homeowner and are entitled to whatever assistance you require to understand and activate those rights. At Tarion, we not only hold ourselves to a high standard

when it comes to accessibility, but we expect the same from our contractors. So, if a contractor is acting on our behalf, you should expect the same level of accommodation. To that end, we provide training materials for our contractors and require them to sign a form confirming their compliance with our accessibility policy. Most builders are happy to widen doors and hallways, substitute lever door handles and add sleek-looking handrails in bathtubs and showers. You’ll also want to weigh the benefits of living in an adult lifestyle community versus a more diverse neighbourhood. Some Baby Boomers thrive in a community of peers who share similar interests. Others prefer to be surrounded by families of all ages, in neighbourhoods where Halloween brings dozens of miniature princesses and superheroes to the door. For a small percentage of downsizers, an in-law suite is the answer. When grown children have a larger home and are able

You may be familiar with the term ‘aging in place’, which refers to the appealing idea of staying in one’s own home as one gets older, as opposed to entering a retirement home. While our futures don’t always unfold the way we’d planned, I do encourage my downsizing clients to consider homes that are the most likely to gracefully accommodate them in their senior years. For instance, a flight of stairs may not present a problem to an able-bodied couple in their 60s. A decade later, they may be wishing they’d chosen differently. Highrise and lowrise condominiums with elevator service are by far the most popular housing choice among my clients who move to the city after retirement. Freedom from upkeep is a huge selling feature, while safety and recreational amenities also play key roles. But there are certainly other options out there. Many of my Baby Boomer clients love to garden, play outside with grandchildren and entertain friends outdoors. They’re simply not prepared to sacrifice a private lot. Some communities offer condo ownership of semi- or fully detached bungalows, taking the burden of yard maintenance and snow removal from your shoulders. Freehold owners may hire yard

ICE AND SNOW DAMAGE YOUR HOME? With winter comfortably upon us, most Canadians are in, or will be in the midst of snow and sub-zero cold. Freezing temperatures can wreak havoc on a house and cause pipes to freeze and ice damming. Generally, water is the most common cause of damage in a home and accounts for 50 per cent of home insurance claims costs. Most home insurance policies cover accidental damage resulting from a burst water pipe, a leaking dishwasher or an overflowing bathtub. A recent Desjardins national online survey conducted in March 2018 polled 3,020 people over the age of 18. Fifty per cent of those surveyed said they didn’t know what type of water damage they were covered for. Yet when asked if their home was ever damaged by water, 26 per cent said yes and almost half (43 per cent) said they didn’t know how to prevent water damage to their home. INCREASE IN CLAIMS

With more frequent and severe weather incidents like heavy rain, lightning storms, hail, freezingthawing cycles and flooding, there has been an increase in the number of water-related insurance claims across the country. When asked if they feel weather severity has increased in frequency in the last 10 years, 75 per cent of respondents said they believe that’s true, with 58 per cent indicating they are worried about climate change impacting their personal safety or the safety of their property. 16  NextHome+CondoGuide  |  Jan. 5–19, 2019

TECH SOLUTIONS CAN MITIGATE DAMAGE

The main problems associated with damage caused by snow and ice occur when it builds up in places like the roof, around an in-ground pool or when it creates ice dams. Some of the proactive things to do to prevent this damage are: Digging out an above-ground pool before it collapses under the weight of snow; clearing snow off the roof after a heavy snowstorm so it doesn’t cave in; breaking up ice dams on the roof to keep water from seeping into the walls. “As one of Canada’s leading property and casualty insurers, we understand the level of stress people can experience because of water damage,” says Alain Hade, vice-president, marketing and member client experience at Desjardins Insurance. “Lost or damaged valuables

and family treasures cannot be replaced. This is why we focus on innovation to prevent and reduce the frequency and severity of claims.” Two tech options available from Desjardins are: Alert, a prevention program that comes with a free water and freeze detector and, if the unexpected happens, like a burst pipe or leaking toilet, clients get an alert on their smart phone and can act fast to limit the damage. Radar sends an alert when there is a risk of severe weather like high winds, an ice storm or a tornado within 500 metres of your specific addresses. Clients are alerted by push notification via SMS or email as a heads-up that can help them protect their property. These programs give clients prevention and awareness tools to help limit the damage caused by water and freezing.

OTTAWA HOME PRICES EXPECTED TO RISE IN 2019

The housing market in Ottawa is looking pretty good for the new year. According to the Re/Max 2019 Housing Market Outlook, the estimated average residential sale price next year will rise four per cent, compared to the projected national average increase of 1.7 per cent. Ottawa’s seller’s market was dominated by young families and couples in 2018, and first-time buyers are expected to dominate the market in 2019. Rising interest rates and the stress test were significant factors to Ottawa’s housing market, and this is forecast to continue in the new year. The current three months of inventory is expected to remain stable going forward. and tearing it down to make way for a new build. Retirees and downsizers are driving the demand for condos, with two bedroom condos being the most popular purchase. Home prices rose 6.6 per cent year-over-year in Ottawa (led by a 7.3 per cent increase in two-storey single-family home prices) Most housing markets across the country stabilized in 2018. However, there continues to be some exceptions to the 2018 average sales price gains, particularly in areas outside of the main city centres. With Canadians starting to feel the pinch of higher interest rates as they move forward with their home-buying plans into 2019, it is anticipated that the market will continue to stabilize. A recent survey revealed 31

per cent of Canadians said higher interest rates have not affected their ability to get an affordable mortgage thus far. However, this is expected to change next year. A separate survey of Re/Max brokers and agents found 83 per cent predict rising interest rates will make it more difficult for Canadians to purchase a home in 2019. “Due to the stress test and increasing interest rates, we are seeing more buyers in traditionally affordable regions in Ontario unable to enter the market,” says Christopher Alexander, executive vice-president and regional director, Re/Max of OntarioAtlantic Canada. “This is particularly true for firsttime buyers and single Millennials, as evident in cities like Brampton, Kingston and Durham.”

MAKE-DO MONTH GAIL VAZ-OXLADE

If there’s any month when you’re most likely to wonder if all the bills will get paid, it’s usually January. After the feverish rush of the holidays and all the unexpected expenses that popped up, no doubt things will be a little tight. Add the extra cost of heating and the jump in “fresh” food prices and you’ll be looking for ways to trim back. Enter Make-Do Month. This is the month when you stretch everything a little farther so you spend a lot less. If you get invited to a party, you don’t rush out and buy something new, you get creative and shop your closet. And if you need a little something different, you shop a friend’s closet. Or hold a clothing exchange. What you don’t do is spend money. When the weather is warm, it’s easy to do lots of free things. When it’s cold, entertainment gets more expensive. Sure there’s that great movie you’d love to take the family to for a night out of the house. For a family of four, you’re probably looking at $100 or more with popcorn and drinks, never mind parking. Recycle a movie you already own or do a movie swap with friends, add some homemade popcorn and a 12-pack of pop and you can probably do it for $10. Now that’s making do. January is also a good month to experiment with a new routine as you make do. If you’re used to buying coffee every day, brew your own at home or work and save big-time. for lunch, pack one from home for four out of every five days and not only will you drop those holiday pounds, you’ll be able to pay off that holiday debt. But what if you have family or friends whose birthday falls in January. You’ll have to buy something. No, you don’t. You can give something of yourself instead of something purchased. Make their favourite cookies, offer to cook them a meal or a bunch of meals for the freezer for those extra busy workdays, or create a coupon for three nights of free babysitting. Maybe you’re a computer genius and can offer to do maintenance or repairs. Perhaps you’re a mechanic and can offer a tune-up. Substitute your energy for spending money. After the buzz of the holidays you’ll no doubt be happy to stay home for the first couple of weeks. Then you may start feeling itchy. You’ve got to get out. You can feel the walls closing in. Time to hit that great new restaurant that

just opened up, or head out to the clubs. Wait a minute. This is MakeDo Month. Call up a couple of friends and throw a pot-luck games night instead. See if you can do it at their house this time. Start a tradition of once a month games or poker nights and rotate from one friend’s home to another. No one says you can’t have fun in Make-Do Month. You just can’t spend gobs of money. Make-Do Month is a conscious decision to stretch every dollar as far as it’ll go. Try it and see if just by becoming conscious, you’ll save money. I’ll bet you’ll be pleasantly surprised.
