he Bank of Canada’s latest announcement to hold its interest rate target at one per cent does not come as a surprise. The rate has been holding at that level since September 2010, which is good news if you’re in the market for a mortgage. There are many excellent mortgage products available from banks and brokers that will suit your individual needs, and could well be lower than posted bank rates, which are currently hovering around three per cent for a variable rate. With a pre-approval in hand, you’re protected if rates rise; if they go down, you’ll likely get an even lower rate. A pre-approval can be a win-win situation for shoppers, since it means you don’t have to wait to get financing
approval on a home when you put in an offer. This is an especially good tool to have when markets are hot. Removing the “conditional on financing” clause could mean your offer is accepted first since you already have your financing in place. So when will rates rise? It’s anyone’s guess, but most experts agree it’s unlikely there will be any significant movement until mid 2014. However, we can’t assume that will be the case, and you shouldn’t wait too long to get pre-approved for a mortgage. It can take a few days. Many lenders offer online pre-approvals to make the process faster and easier. Start the New Year off right by taking advantage while you still can.
Resolve to plan carefully in 2014 Low rates mean opportunity, but not at any cost

he past year certainly presented some interesting times – simultaneous talk of slowdowns and soft landings in some markets, increases, upticks and value gains in others. Indeed, now more than ever, housing and economic conditions serve as reminders of how local real estate is. What’s going on in one part of the country or province or in a specific property type, may be completely different from another. On the positive side as we head into 2014 are interest rates that are still at or near historic lows, with the next Bank of Canada rate announcement to come Jan. 22. Many experts don’t expect
rates to begin rising until mid-year at least, while cautioning that Canadians should not confuse cheap money – if they qualify – with free money. The BoC continually keeps a close eye on household debt and other signposts for any warnings that we’re taking on more debt than we should. Fixed versus variable rate? Long versus short? Open versus closed? These are among the questions you may be pondering as you prepare for your next steps as a homebuyer. Your best strategy? Meet with your broker or banker to see how you can take advantage of these opportunities, without getting in over your head.

Planning policies must evolve for growth to work » by bryan tuckey The Planning Act lays out ground rules for land-use planning in Ontario by outlining planning processes with the objective of being fair, open, accessible, timely and efficient to all involved.
Bryan Tuckey
is President and CEO of the Building Industry and Land Development Association (BILD) and is a land-use planner who has worked for municipal, regional and provincial governments. He can be found on Twitter (twitter. com/bildgta), Facebook (facebook.com/bildgta) and BILD’s official online blog (bildblogs.ca).
Section 37 of the Act refers to a specific process which allows municipalities to receive community benefits, such as public art, library expansions or road improvements, in exchange for increases in the height or density of what is otherwise permitted by the zoning bylaw. The community benefits depend on what is deemed by the municipality to be a local community need, the nature of the development application, any implementation guidelines or plans adopted by council, and the strategic objectives and policies of the municipality’s Official Plan. Every development is different. But zoning bylaws are rarely kept up to date. Neighbourhoods that would be suitable to have a highrise condo are often zoned for lowrise housing, and that leads to higher Section 37 fees for new-home buyers. According to an Altus Group report in August, the average Section 37 agreement cash contribution for the City of Toronto over the 2012-13 period was found to be $3,485 per unit. That cost comes out of the mortgage of each homebuyer. Section 37 is being discussed in the 80-day public consultation being held by the province until Jan. 10 as the Ontario government looks to improve the Land Use Planning and Appeals system. I continue to write in this space as part of BILD’s contribution to the discussion, and encourage the public to get involved as well. What I would like to highlight with Section 37 is that the zoning framework
14 New home guide GTA | january 11 - 25, 2014
is outdated in most municipalities, which puts its fairness into question. Across the GTA, there are currently 260 cranes working on highrise projects – the most in North America. Most of that work is happening in Toronto, where the bylaws don’t conform with the provincial growth plan called Places to Grow, causing multiple zoning conflicts. The plan stresses intensification of development, more
Questions have been raised over whether Section 37 payments are being used for intended purposes and whether the accountability and reporting measures are in place. density, more height, to help the province accommodate the more than 100,000 people that move to the GTA every year. Questions have been raised over whether Section 37 payments are being used for intended purposes and whether the accountability and reporting measures are in place. Section 37 is a tool not easily understood, and we feel it is becoming the “go-to” solution for a community’s capital woes without understanding when it should actually be applied. It has been used in an inconsistent way. In the report on Section 37 in Toronto, the range of cost per unit was as low as $66 and as high as $11,806. More transparency and accountability need to be established in the process of determining Section 37 contributions. Bylaws need to reflect the planning realities of 2013. Early consultation would help to eliminate surprise additional costs where possible. There is definitely room for improvement, and we want to be at the forefront of any changes.

your home in its completed state will be during your PreDelivery Inspection, or PDI. When you purchase a new home or condominium, your builder is required by Tarion to conduct a PDI with you on or before the day you take possession. The PDI is more than just a first look around, it’s your opportunity to view your home in its entirety, learn about how to properly maintain it and take stock of anything that may be damaged, incomplete, missing or not working properly. You may be excited to show your new home to your friends and family, but this isn’t the time. The PDI is an important part of taking possession of your new home and deserves your full attention. If you are not able to attend yourself, you can ask someone you trust to be there on your behalf. During the inspection, you should carefully examine your home both inside and out. Look for things like chips in bathtubs and sinks, scratches on countertops, damage to floors, walls, cabinetry or other finishings, and doors and windows that are not secure or do not open and close easily. Outside, check things like the quality of brickwork and siding, whether window screens have been installed, and the appearance of the driveway and landscaping. Your builder’s representative is responsible for making notes of any areas of concern on a PDI form. Review the form carefully to make sure it’s complete. This will become the official record of the condition of your home before you moved in. In case of a disagreement between you and your builder over whether any damage occurred before or after you took possession, Tarion will refer to the notes on your PDI form. The builder is required to provide you with a copy of the completed PDI, but you may want to take your own notes as well. Feel free to take pictures of any damaged or incomplete items. If necessary, those photos can be submitted to Tarion at a later date. You should take your time looking over your new home. As a general rule of thumb, a PDI may take about an hour for every 1,000 sq. ft. of home being inspected. We’ve heard from buyers who said the condition of the home made it impossible to accurately assess any defects. Sometimes there is still too much construction dust and debris or even weather factors that prevent you from getting a good look. If this happens, make sure to note the items that could not be inspected on the PDI form.
16 New home guide GTA | january 11 - 25, 2014
Use the PDI as an opportunity to ask questions and learn about how your home functions. Your builder will show you how to operate your home’s systems, like heating, electrical, air conditioning and plumbing and provide you with operating manuals. Buyers sometimes hire a professional home inspector to accompany them during the PDI. While you are welcome to bring along a trusted companion or professional, I encourage buyers to really think about the purpose of the PDI, which is to form a record of the state of your home before you take possession. You might want to consider waiting for the 30-day or year-end warranty period to hire a home inspector. You’ll have much more time to get to know your home and its systems and will have a better indication of any potential problems that your home inspector can look into. If you do hire a home inspector, I recommend you find one who is certified in conducting new construction inspections. The new-home buyer section on tarion.com has a number of resources to help you prepare for your PDI including a PDI checklist and a guide to getting ready for the PDI. You’ll also find the Homeowner Information Package, or HIP, which your builder will provide on or before your inspection date. I always recommend buyers read the HIP before their PDI. Being informed and well prepared is the best way to start your homeownership experience!

Celebrating
Recent Park’s Revitalization
Resurgent community stages The Journey – a new musical chronicling its history
As Toronto’s Regent Park undergoes one of the most ambitious urban renewal projects in Canadian history, its dramatic story is being brought to the stage. The Journey – A Living History of the Regent Park Revitalization, is an 80-minute musical that recently played for two sold out nights at Daniels Spectrum, the community’s new 60,000sq.-ft. cultural hub. Using a powerful combination of spoken word narrative, song, film, still images and dance, The Journey documents Regent Park’s nearly 70-year history and it’s amazing revitalization – from challenged urban neighbourhood to thriving mixed-use community, infused with a newfound sense of hope. The show is not only inspired by the real-life stories of its residents, it is mounted by their collective talents, on stage and off. These include award-winning Regent Park spoken word artists Trevlyn Kay and Britta B. (2013 Toronto International Poetry Slam Champion); Regent Park R&B singer-songwriter Steve Harmony; Regent Park School of Music graduate Charlotte Siegel and Dixon Hall alumnus and pianist Thompson Egbo-Egbo. “I’m blown away by the talent,” says Henry Heillig, musical director and co-founder of the jazz ensemble Manteca. “People will hear a lot from these youngsters. Their energy and creativity is just explosive.” These future stars are backed by two electrifying, world-class performers – award-winning jazz and blues vocalist Jackie Richardson 18 New home guide GTA | january 11 - 25, 2014
(Big Mama, the Willie Mae Thornton Story); and Dora award-winning singer/ actor Sterling Jarvis (The Lion King; We Will Rock You). “Working with the script and narrators over the past four months has been a very moving experience for me,” says Anne-Marie Woods creative director and Harry Jerome Award winner for Entertainer of the Year. “The songs are heartfelt; the poetic monologues will tug at your heart strings; as an audience member you will understand the incredible journey that the community has taken – you will truly become a part of the story.“ In short, The Journey is a theatrical creation about, for and largely by the Regent Park community. “The audience (feels) the emotion, anger and frustration, but also the steadfast determination that finally leads to change. They experience the anxiety and sadness as the wrecking ball demolishes a lifetime of memories and feel the hope and exuberance as a bright new future emerges,” says Mitchell Cohen, president of The Daniels Corporation who wrote the original script and composed the songs for The Journey. “We look forward to The Journey becoming a part of the community’s creative repertoire and be continually remounted by different generations of talent,” adds Cohen. The Daniels Corporation will donate the show’s musical soundtrack to Toronto’s Artscape Foundation, which will use it to raise funds for youth programming such as ARTSPARK at Daniels Spectrum. Through the ARTSPARK program, youth conceive and produce cultural events, exhibitions and projects with guidance from industry mentors. These hands-on educational initiatives provide valuable life lessons in teamwork and expose young people to career paths in the arts.
The soundtrack can be downloaded at giveagiftgetasong.com for a minimum donation of $15.

with issues that arise after a purchase is made. But, if a company takes client relations seriously (as they should) that simply isn’t the case. Client care needs to be an essential part of any company’s culture. It’s pretty simple - without clients, you have no business. New home client care ideally begins the second you step into a sales office. At this point, it pertains to creating a friendly environment, ensuring you are attended to and that you receive the information you require to make an informed purchase decision. You won’t necessarily meet with a Client Care Representative then, but everyone you encounter – from the receptionist, to sales agents, and anyone working on behalf of the builder – should have your best interests at heart, and be available to resolve any issues or queries you may have. Once you’ve purchased your new home or condominium, it is good client care practice to reach out to you to: first, thank you for your purchase; and second, to learn if you have any additional questions. This practice sets the tone for all future communication. Now is usually when a Client Care Representative is assigned as your main point of contact, so you know specifically who to turn to throughout the process. The next client care benchmark occurs during your design appointment, which is when you select the finishes for home and can also choose from available upgrades. Depending on your builder’s organization, it may be someone other than your Client Care Representative who takes you through this. Regardless of who you deal with, the selection of features and finishes is an important part of client care, as during that appointment, your builder representative should help you decide what choices are right for you. Prior to moving in, you’ll undertake a formal inspection of your home. The Pre-Delivery Inspection (PDI) is another essential component of your client care experience. Your builder should provide you with a knowledgeable representative who is informed about all facets of what will be reviewed during this assessment. The representative you deal with should also help you understand fair expectations regarding the delivery of your home. A home is not a manufactured product. It may not be 100 per cent complete at PDI, but there is certainly a level of completion and quality that you should expect. Any company worth its salt realizes that they are responsible not only for acquiring new business, but for retaining and servicing existing clients. The best thing we can do is blow your socks off with a level of service that encourages you to recommend us to family and friends. Everyone you encounter – from the minute you step into a sales office, to the moment we hand you your keys, should provide you with an exceptional level of care that makes you feel welcome and at home.

and functional floor plan, this 1,779 sq. ft. gem of a home is one of the most outstanding models in Fieldgate’s innovative Laneway Collection. Designed with rear-facing double-car garages, these laneway homes maximize space while allowing for breathtaking elevations at the front of the home. The Pichot’s front elevation features large windows and a charming covered porch, creating an impression of classic small town elegance. The Pichot offers the option to include a separate side door entrance as well. The interior of the home is perhaps even more remarkable. The main floor features a large formal room and a spacious gourmet kitchen. Beyond the kitchen is a Great Room, which is linked by a breezeway to the garage at the back of the home. Maximizing on space, the breezeway features both a laundry room and a powder room. Behind the Great Room and adjacent to the breezeway is an intimate courtyard, perfect for backyard barbecues. Upstairs, the master suite boasts a walk-in closet and lavish ensuite, which includes a separate oval soaker tub and shower. Bedrooms two and three offer large closets and convenient proximity to the main upstairs bathroom. The Pichot is priced from the mid $500’s. Throughout all of the GTA, there’s no place quite like the Village of Kleinburg. Perfectly nestled between the east and west branches of the Humber River, Kleinburg offers all the pleasures of small town life just minutes from the big city conveniences of Vaughan and the surrounding area. This is a place where the old and the new are weaved together to create a vibrant tapestry of inspired community living — a place that celebrates arts and culture, a place that celebrates family and friends. Kleinburg’s main street is the perfect setting for a leisurely afternoon stroll past charming boutiques, cafés and restaurants. This is also a community that celebrates our nation’s rich cultural heritage: the village is famously home to The McMichael Canadian Art Collection, an exclusive showcase for Canadian art. For nature lovers, the Kortright Centre for Conservation — renown for its hiking, bird watching and outdoor education programs — is just minutes away, along with Bindertwine Park’s breathtaking walking trails, as is Copper Creek, one of the GTA’s premier golf clubs. The impressive selection of nearby amenities extends well beyond those offered by this quaint Kleinburg setting. Vaughan’s many other charming neighbourhoods also offer convenient shopping destinations — such as Vaughan Mills — boasting a host of major retailers and top name brands. Commuting is made easy with Hwys. 27, 400, 427 and 407 all just minutes away. Doing the math
Choosing between fixed and variable rate mortgages » by calum ross Year over year, perhaps the most contested issue in the mortgage market is the age-old decision of choosing between a fixed and variable rate mortgage. Hundreds of

thousands of dollars of personal financial research dollars have been poured into making the case and giving the final decisive pearl of wisdom to consumers. Here is some wisdom that will work in any set of market conditions, and perhaps most importantly, will help you determine the best choice for your own personal risk tolerance and financial circumstances. Anyone who suggests you should go with either a fixed or variable rate mortgage without knowing your long term goals, the longer term picture of your cash flow and your own individual risk tolerance, is a financial professional you should be very wary of. I have more than seven years of post-secondary education, I have worked directly in the global treasury operations of one of Canada’s big five banks, and I can assure you – anyone who pretends to know what is going to happen with long term interest rates is either delusional or has a grossly exaggerated opinion of themselves. At any given time, Canada’s capital markets represent about three per cent or less of global capital markets and our economy is heavily reliant on exports to our key trading partners. For Canadian mortgage consumers, no matter how closely we watch our own economy, we will always be subject to changes in our capital markets (debt and equity markets) as a result of shocks to the global system and particularly shocks to our key trading partner – the United States of America. What this means to the fixed versus variable decision is this: at any given time, there is a set spread between the difference in the discounted five-year fixed rate (the most popular long-term mortgage product) and the discounted variable rate product. This spread can increase or decrease in response to movements in the overnight lending rate set by the Bank of Canada and the Government of Canada bond market. This difference in rate represents the premium that mortgage consumers have to pay for the peace of mind that a longer term fixed mortgage offers. Conversely, the difference in savings for going variable represents the reward for taking on the extra risk of not locking in your rate and protecting yourself against future potential rate movements. In reality, the only thing a longer term fixed mortgage gives you is a guarantee against your rate and subsequently your payment moving for a longer period. In fact, it is essentially an insurance premium against interest rate risk, and like all insurance premiums, they change and are more or less valuable to different market participants.
28 New home guide GTA | january 11 - 25, 2014
The difference between this longer term fixed rate and the variable rates, rise and fall in different market conditions. Traditionally, the difference between short and long-term rates is highest when inflation is high – at some of these points in time, the difference was more than two per cent. When inflation is extraordinarily low, the difference in these two rates has been as low as less than 0.5 per cent. Regardless of the difference in the two rates, the relative cost-benefit analysis really comes down to your own tolerance for risk and how much you ultimately pay (cost) for that piece of mind, or stand to gain (save) from taking the extra risk. Only you can ultimately gauge that decision, but if you want to do the math, it is fairly simple – just multiply the mortgage balance you have or were considering taking between the difference in the fixed versus variable. For example – if you have a $100,000 mortgage and the difference between a competitive fixed rate mortgage and a variable rate mortgage is one per cent, then the additional premium per year for that peace of mind is $1,000 or $100,0000 x (the difference in interest rates). If this cost seems reasonable, you are likely psychologically suited for a longer term fixed mortgage. If it seems expensive, you are more likely a candidate for a variable rate mortgage. One final caveat: there is no amount of financial gain that ever warrants putting yourself under financial duress. When it comes to mortgage or financial decisions, the wise consumer does not take on more risk than they can financially handle. The implication – if you can’t afford an upswing in rates then going variable is not a sound decision in any economy.

Mortgage interest rates, still at historical lows and expected to remain so well into this year and maybe 2015, represent a window of opportunity for those looking to buy a home. The mortgage industry is ultra-competitive, lenders often introduce new products and otherwise there are plenty of options for borrowers. If you could lock in at a low rate over 10 years, for example, that gives you the comfort of knowing what your mortgage payments will be over that period, while over that time you can also take advantage of any pre-payment and lump-sum payment options to pay down your mortgage. Another appeal of this scenario is that, as we often point out, experts advise you take a long-term view of your home purchase. For example, there has been some talk recently about cooling prices and softening sales. But even if that were to happen in your market and housing type, ask yourself: in 10 years, is a home you buy today likely to be worth more or less? If you need an answer to this question, just take a look back at prices 10 years ago. Of course, there are no guarantees, but if you’re in the homebuying mode anyway, today’s low rate environment makes a pretty compelling reason to act sooner than later to take advantage of these opportunities. Low rates notwithstanding, the banks, financial firms, brokers and other experts still advise homebuyers to practice smart borrowing – everything from putting down a larger down payment to taking advantage of pre-payment options and even “stress-testing” your mortgage at a higher rate to ensure your finances can accommodate rate fluctuations or other unforeseen circumstances. The mortgage market is a complex beast, and as a prospective homebuyer, these are not lessons you’re going to learn overnight – nor do you likely want to. You’re focused on saving a down payment, getting your finances in order, searching

New Year’s Resolutions » by henry choo chong

My New Year’s Resolution is to get rich; get in shape; help the less privileged; buy low and sell high; quit smoking; travel more; win the lottery! How many times have we heard these words uttered? As you sit at the dining-room table with pen to paper, sipping coffee with the fireplace crackling in the background, pause for a moment before making that New Year’s resolution list and glance at the crumpled, faded list from last year. How many of your resolutions were actually accomplished? If you are like lots of other Canadians, then not many. The new year is the time for us to put 2013 behind us and reboot for another year. It’s a great starting point to forget the old and embrace the new. It’s a time to pause and look at what has been accomplished and what still needs to be done.
The new year is the time for us to put 2013 behind us and reboot for another year. It’s a great starting point to forget the old and embrace the new. No one is successful without goals and objectives that can be measured. Although, my accounting and tax background do not give me the expertise to help you lose weight or quit smoking, the approach to financial resolutions may not be much different. The old adage, “Life is what you make of it,” applies to accounting, sports, business and family goals alike.
» Set realistic resolutions. “I want to look like I did as a teenager” is unlikely. » Don’t just say, do. Resolutions can’t be accomplished without action and following through. Stop talking about joining a health club, and do it. Regardless of what some so-called experts say, you can’t lose weight by sitting in front of your computer (although the eyes and fingers may get a good workout). » Having a plan and its execution, is as important as the resolution itself. Without a plan, there will be no success. “This year, I would like to save for a home.” This is a great resolution, however how will you achieve this? How much will you need? Where will the savings come from? How and where will you obtain financing? Step one is to create a cash-flow budget. Identify how you can increase income and where you can cut expenses. » Set long-term goals, but make them achievable objectives that can be measured periodically. For example: a: If you would like to lose 20 lbs. this year, set a weightloss goal of three pounds per month. b: If you would like to start an RRSP, contribute $X by the end of the year. This will be achieved by setting up an automatic payment plan with your financial institution. Pre-authorize monthly RRSP contributions. Goals cannot be reached, unless you reach for them!

At 2,521 sq. ft., this 36-ft.-wide home has it all, including a spacious living/dining room, brightly lit kitchen with a breakfast bar and extensive pantry, a spacious master bedroom with his and her walk-in closet, a luxurious ensuite that boasts a cathedral ceiling and three additional bedrooms that either have an ensuite bathroom or a conveniently located Jack-and-Jill bathroom. Kylemore’s annual holiday party
collects hundreds of toys for York Region families Spreading cheer at this time of year is a long-standing tradition of Kylemore Communities. At the company’s
Annual Holiday Party held to thank suppliers, trades, staff, consultants and friends, a Toy & Gift Drive resulted in literally hundreds of generous donations from guests who attended the festivities at The School Fine Dining in Markham. Russell Foy, a volunteer and member of the Unionville Alliance Church (UAC) arrived to collect the toys and thanked Kylemore’s President Patrick O’Hanlon and the many contributors for helping to make a significant difference in the lives of area families. Foy expressed his appreciation on behalf of the organizers of the 2013 Christmas Food and Toy Drive. “UAC would like to thank everyone for your donations. We will use all donations to serve 175 families in the local community and each family will receive a food hamper including a turkey and presents for all family members.” Kylemore Communities is committed to lending a hand to charities and non-profit organizations in areas in which it builds. Throughout the year, the company hosts events that reflect this spirit. In the past six years, the Annual Kylemore Kares Charity Golf Tournament has raised over $600,000 for charity. Speaking about the Holiday Season, Patrick O’Hanlon commented, “It is really heartwarming to see the number of toy and gift donations grow each year. Our industry friends are very generous and we are grateful for their contributions.” Since 1997, Kylemore has been developing and building prestigious Angus Glen Community in Markham. In 2013, this desirable neighbourhood of almost 1,100 homes won the Building Industry and Land Development (BILD) Association’s Places to Grow Lowrise Community of the Year Award.

The importance of the
Pre-Closing Inspection » by jayson schwarz
Jayson Schwarz
LL.M. is a Toronto real estate lawyer and senior partner in the law firm Schwarz Law LLP. If you have a topic in mind, mail, deliver or fax letters to the magazine or to the firm, email (info@schwarzlaw.ca) and give us your questions, concerns, critiques and quandaries.
In this issue, we are going to address a small but incredibly important part of the process of buying that new home, the Pre-Closing Inspection. As most of you know, included in the adjustments on the purchase of a new home or condo (but not a conversion or retrofit project) is the cost of your Tarion (formerly the Ontario New Home Warranty Program) enrolment. Among the things you are covered for are defects in the completion of your new home. Most of the Agreements of Purchase and Sale make the deficiency list prepared as part of your final inspection the only basis for repairs, subject to the major items such as foundation cracks. What does this all mean? When it is time to do the Pre-Closing Inspection, know that if you don’t list it, you may not be able to compel the builder to fix it. Therefore, it is critical you list everything! Here is a minimum list of what I believe will help you in making sure you are covered:
01 Insist on having enough time to do the inspection and allow yourself enough time with no need to be anywhere else; 02 Write everything down yourself... don’t let the builder’s representative take charge; 03 Don’t rush! Don’t let the builder’s representative push you, insist at moving at you own speed; 04 Write or mark down everything, no matter how small or seemingly insignificant; 05 Don’t accept promises of repair during inspection – if something is not right, mark it down; 06 Try every light, socket, tap, drain, toilet, door, lock, window, appliance, everything that could be defective now or go wrong later; 07 Watch for stains on carpet, scratches on wood floors, cracks in paint or drywall and areas where they forgot a second coat of paint; 08 Look for water stains or spots on concrete basement floors or walls, and if you see them insist on knowing why and where they came from; 09 Don’t forget the exterior – roof, drains, bricks, mouldings. Is there sod, is the grading complete and is your driveway in? Write it all down! 10 Condominiums: go check out the common areas – lobbies, garbage rooms, parking areas, lockers, pools, tennis courts and health clubs. Remember, you own part of the common area, and if parts are incomplete, wrong or defective, put them on the list! Remember that this inspection is, in all probability, the only chance you have to deal with deficiencies, so make sure you check carefully. Some readers ask about what happens if the builder rushes them or something happened so they did not get the opportunity to finish. The answer is to immediately do a complete list and send it to the builder and to Tarion in order that the record is on file. There is probably more and I do not suggest that this list is complete. I hope it helps in making you realize how important it is to do a thorough job on the Pre-Closing Inspection. Perhaps the most difficult part of writing these articles relates not to the actual writing, but thinking of a topic to address. Visit schwarzlaw.ca or email your questions, concerns, critiques and quandaries to info@schwarzlaw.ca. I will try to deal with them in print or electronic form.

Better days ahead
for most provincial economies in 2014 Over the past few years, we have seen a two-tiered economy in Canada, in which resource-rich Saskatchewan, Alberta and Newfoundland and Labrador outperformed the rest of the country. Led by Alberta,
most provinces can expect stronger economic growth in 2014, according to the Conference Board of Canada’s Provincial Outlook for Autumn 2013. “While many provinces have struggled in the past few years, Saskatchewan, Alberta, and Newfoundland and Labrador thrived as their primary resources were in high demand and fuelled solid economic growth,” says MarieChristine Bernard, associate director, provincial forecast. “However, the prospect of a stronger U.S. economy will now help boost exports and improve the outlook for other provinces over the next two years.” Despite the damage caused by the severe floods in June, Alberta’s economy has grown at a fast pace in 2013 and economic conditions are extremely favourable heading into 2014. Buoyed by investment in the oil sands and a very strong labour market, Alberta’s real gross domestic product (GDP) is forecast to expand by a robust 3.4 per cent in 2014. Strong gains in the primary sector, a rebound in construction, and improved job creation will help lift British Columbia’s real GDP by 2.7 per cent in 2014. Following an estimated four per cent gain in 2013, Saskatchewan’s booming economy can expect to cool next year. Weaker prices will hold back potash production increases and lower the province’s economic growth to 2.3 per cent in 2014, in line with Canada’s growth. Manitoba’s economy will expand by two per cent in 2014, fuelled by better performances in the province’s goods and services industries, along with strong job growth and gains in personal disposable income. Newfoundland and Labrador’s real GDP growth will slow from a nation-leading six per cent in 2013 to 1.8 per cent in 2014. A much smaller increase in oil production and the completion of construction work on Vale’s Long Harbour project will limit economic growth in the province. The economic outlook for Central Canada and some of the Atlantic provinces is set to improve in 2014. Stronger growth in the U.S. economy will help improve export volumes and the manufacturing sectors in many regions.
62 New home guide GTA | january 11 - 25, 2014
A partial recovery in exports and strong growth in the commercial and financial services will help boost Ontario’s economy. The province’s economic performance is expected to be more in line with the national average in 2014, with real GDP forecast to grow by 2.2 per cent. Mining activity in New Brunswick is expected to pick up as new metal mines come into production in 2014-15, providing a boost to the province’s economy. Overall, real GDP growth in the province is expected to be 1.6 per cent in 2014. With the new Deep Panuke offshore natural gas field set to begin production and better growth prospects in the forestry and manufacturing sectors, Nova Scotia’s economy is forecast to grow by 2.8 per cent in 2014. Prince Edward Island had some of the strongest economic growth among all the provinces in 2013. However, a decline in private investment and ongoing fiscal restraint by the provincial government, will limit growth to just 1.3 per cent in 2014.

Toronto market performance calms concerns of major correction: BMO Economics Housing Report
Canada’s largest housing market – accounting for 19 per cent of national sales – continues to defy concerns of a correction, according to a recent report from BMO Economics. The report titled Canadian Housing Update: Tale of Four Cities, examines the state of the housing markets in Canada’s four largest cities: Vancouver, Calgary, Montreal and Toronto. “Across Greater Toronto, sales are up 20 per cent year over year in the three months to October, and stand nine per cent above past decade norms,” says Sal Guatieri, senior economist, BMO Capital Markets. “While preliminary figures show sales slowed in November, markets are generally balanced; but sellers rule and bidding wars prevail in certain pockets. Benchmark prices have picked up to an above four per cent pace, and, at over six-times median family income, remain lofty.” The report shows that after plunging last year, new condo sales have firmed but remain well below the past decade norm. “Condos are an affordable alternative to the detached market for the more than 80,000 international migrants moving to the region each year and the growing number of young people leaving their parents’ basement,” says Guatieri. “While low rental vacancy rates have kept resale condo prices near record highs and rents on an upward course, prices of
new condos have weakened modestly in the face of a record number of units under construction – close to 60,000.” According to the report, investors who have purchased roughly half of new condos in recent years could get antsy if rents flatten out or prices soften further. However, most of the new units coming on stream should be absorbed by robust population growth. Guatieri says the looming supply of condos, high valuations of detached homes, elevated levels of household debt and expected higher interest rates should slow overall price increases in 2014, even as new immigrants and echo boomers provide support. “We expect Toronto house prices to stabilize in 2014, and to remain at risk of declining moderately when interest rates normalize.” Andrew Auerbach, senior vice-president, Greater Toronto Area, BMO Bank of Montreal, recommends that those looking to buy in the pricey GTA market should take measures to ensure affordability can be maintained over the long term. “In light of the potential for higher interest rates in the near future, it’s crucial that those looking to buy a home – particularly first-time buyers – stress-test their mortgage against a higher rate to ensure they can afford what they sign up for should conditions change,” says Auerbach.

Rosehaven Homes and Averton Homes join forces to bring better new home selection to
Mount Albert Homebuyers in the charming hamlet of Mount Albert are delighted to discover that their choice of new home designs has gotten even better.
With more than 70 years of home building experience between them, Averton Homes and Rosehaven Homes are now combining their talents and track records in the creation of Victoria Highlands. This family-oriented community calls to mind the character of Old Ontario while being just a half hour GO train ride from downtown Toronto. Averton Homes has built more than 400 homes in the Mount Albert area. Victoria Highlands has two separate sales centres open, with Rosehaven offering homes on the community’s 50-ft. lots, while Averton builds on all the 33-, 40- and 65-ft. lots. “We share Averton’s vision of everything that Victoria Highlands can be,” says, Marco Guglietti founder and President of Rosehaven Homes. “Mount Albert offers an ideal location for new-home buyers, and we’re happy to be bringing Rosehaven’s signature quality here for the first time.” “The demand for homes and the potential development in the area is incredible,” says Peter D’Ambrosio, president of Averton Homes. “We thought homebuyers would be best served with a wider choice of homes, and quicker closings, so we invited Rosehaven to join us in building Victoria Highlands.” Situated at Ninth Line and Mount Albert Road in East Gwillimbury, Victoria Highland is less than 20 minutes from Newmarket, Stouffville and Markham. The quaint and historic village of Mount Albert itself is home to shops, services and a variety of restaurants. With the two builders offering designs ranging in size from 1,800 to 4,200 sq. ft., the community offers something for everyone, from first-time buyers to growing families to empty-nesters who enjoy having grandchildren come to visit. With prices beginning from the mid-$400,000s to more than $700,000, Victoria Highlands represents outstanding value with

homes offering a long list of luxury upgrades that are standard. Floorplans are highlighted by features, such as gourmet kitchens and spa-inspired ensuites. Contemporary interiors are designed for the modern family’s lifestyle and feature appointments such as nine-ft. main floor ceilings, quality designed kitchen and bathroom cabinetry, imported ceramics and much more. With sustainability in mind, all the homes are also being built with Green design features for increased comfort and energy savings. Rosehaven Homes quickly established itself as leaders and award winners in the new home industry. Since its inception more than 20 years ago, the company’s portfolio has grown to include more than 4,500 homes, all across southern Ontario and the GTA. Current projects include Lyon’s Creek in Niagara, Gibson Heights in Thorold, Tiffany Hill in Ancaster, King Country Estates in Nobleton, Kleinburg Heritage Estates in Kleinburg, Woodland Trails and The Randall Residences in Oakville, and The Neighbourhoods of Mount Pleasant in Brampton. Since 1958, the Averton Group of Companies has completed more than 100 residential projects and created more than 10,000 homes and condominiums across North America, winning multiple awards for quality and design. Averton is one of the leading residential real estate development companies in Canada with offices in the Ontario, Alberta and British Columbia markets. They design, build and market single- and multi-family housing that meets diverse living needs, and develop master-planned communities that stand the test of time. Prospective purchasers are invited to visit both sales centres. The Averton Homes sales centre is at Hwy. 48 and Mount Albert Road (19103 Hwy. 48). Trend watch
2014 » by Yanic Simard
Photography by Brandon Barre
It’s already 2014, and time to take fresh inspiration from the new trends the year will bring. Although it never pays to cling to trends too closely, they can be a great source of ideas that will add a little life when you find your space suffering from the wintertime blahs. Here’s my suggestion of five furniture trends to watch, that you can count on sticking around longer than a year. Miniature vs Oversized Small space aficionados know that “condo-sized” furniture is no new invention. I’ve often said “go big or go home!” – or maybe “go big and go home!” – but lately people are also going the opposite route, and choosing a size extra small. Rather than compromising on versions of favourite furnishings shrunk slightly to fit into a compact floor plan, choose statement pieces - big or small - that will bring full satisfaction.
92 New home guide GTA | january 11 - 25, 2014
How to do it » For the ultimate seating plan, fit in the largest sofa you can (for when one or two people are lounging comfortably) and add European-sized compact seats as side chairs to fit in the maximum number of guests during get-togethers. » Miniature chairs in particular are a trend - even beyond the usual 18-in. seat. Petite accent chairs (child sized or even smaller) are charming conversation pieces nestled up to a coffee table, and can be used as occasional side tables when you need to rest a book or beverage. Rugs Over the past few seasons, we’ve really seen the return of the area rug, and now the magic carpet has officially landed. In a condo space with hard floors, area rugs of all shapes and sizes are an excellent way to bring warmth, colour, and a feeling of home, even in the most modernist schemes – they look excellent paired with traditional furnishings or contrasted against sleek minimal forms. The timeless Persian rug especially brings a heritage appeal, although contemporary rugs come in endless patterns and prints to suit any taste. How to do it » For a living area, choose a rug large enough to tuck under furniture legs. Add a runner (a skinny rectangle) in a kitchen or hallway, or a large rug to any room for the feeling of carpeting (leaving approximately a 12-in. border around the room). » The inky tones in classic traditional rugs are neutral enough to blend into most schemes. For an already neutral space, consider this an opportunity to add some colour – you can roll the rug away or move it to a new room between seasons for a little change up.
Tufting Button-tufting is a style invented for practical reasons: the buttons which hold a fabric to its backing (on a chair, headboard – anything upholstered) help keep stuffing in place by creating square or diamond shaped pockets. The traditional look has lasted through centuries, and for 2014 it will be popular for modern settings as well. The geometric forms created by tufting can enrich the look of even the most streamlined sofa, and can be achieved without buttons for a more subtle quilted effect. How to do it » A tufted leather sofa is a must-have investment piece, for a look that speaks to luxury but is also practical – the material will hold up to wear and be easy to maintain. Visit Zilli home to see their current selections. » Quilting isn’t just for pieces you sit on. It can also dress a cabinet front for a private club appeal – check out the Brick 69 storage unit available via Quasi Modo. Origami People have been developing a fascination with facets, and this love of all things angular is leading to a rise in the ancient art of Origami as an inspiration for complex bent forms in various areas of design. Like with tufting, the angles break up a material for visual interest and allow light to catch the item in different ways, adding the subtle drama that contemporary spaces were missing in years past. How to do it » Table bases are an easily overlooked detail that can benefit from a more fun form. I recently found this chunky golden nugget of a side table to make a simple statement in a client’s home – order yours from boutiques like L’Atelier.
Photographs courtesy of Elte
» Origami also makes for great art, brought to a large scale and in new materials, like the simple but intriguing Fold sculpture I recently spied at Avenue Road Plastic For the most future-forward look, it’s hard to beat the appeal of plastic. With people once again celebrating colour, the vivid tones of translucent materials like acrylic and polycarbonate will be the ultimate source of a hue infusion. Semi-transparent materials work best grouped together (so their colours overlap and intermingle) or near a light source that will shine through and spread the colour love around. How to do it » For a quick addition, a few floating shelves (such as the Shellfish series by Kartell, available through Elte) can brighten up a wall – you might not even want to bother finding anything to put on them. » To really make a synthetic statement, try a transparent coffee table or nightstand. A piece like this visually floats to keep an airy look while adding a shock of colour that defines a furniture grouping.

Follow these steps to see if you’ll qualify for a mortgage on your dream home
01 02 03
Calculate the combined monthly before-tax income of you and your spouse. Divide by three. This figure is the monthly payment you can afford to make on your home. Take the total price of the home and subtract the amount of money you expect to make as a down payment. This is the money you will have to borrow.
04
Refer to the chart on the opposite page. Look down the left column and locate the interest rate you expect to pay. Line this up with the amortization period of your choice. (Most firsttime buyers take the 25-year amortization.)
05
06 07
Add to this your estimated monthly heating costs and monthly property taxes. If this figure is equal to or less than one-third of your gross monthly income (calculated in Step 2), you’ll qualify for a mortgage on your dream home.
Multiply this figure by the amount you need to borrow. Divide by 1,000. » Bear in mind that this is a rough estimate. If you have several other large loans already, you may qualify for less. Also, banks and trust companies vary in their policies. The best way to know what you can afford is to go to the lending institution of your choice andget pre-qualified.
