Toronto mayor John Tory was preparing to host an unprecedented meeting with federal Minister of Finance Bill Morneau and Ontario Minister of Finance Charles Sousa. On the agenda? One topic: Toronto’s red hot realestate market, and what, if anything, to do about it. In more than just a photo opp, the three leaders have their work cut out for them. At issue is how to wrestle control of Toronto’s runaway price growth and miniscule supply. Indeed, Royal LePage’s latest House Price Survey shows prices in the GTA shot up 20 per cent year-overyear, in the first quarter, to $759,241. Meanwhile, the Canadian Real Estate Association says any new federal or provincial policy measures aimed at cooling demand in Toronto risk destabilizing housing markets elsewhere. But the Bank of Canada recently warned that a correction in Toronto – a risk that could increase if no action is taken – could reverberate in other parts of the country. This situation could be a case of damned if we do, and damned if we don’t.

THE JUST RELEASED new housing
market data for February are both encouraging and discouraging. The data, provided by our official source of new home market intelligence Altus Group, shows record sales for the condominium market, especially in the 905 Region, and it shows an unprecedented scarcity of new housing inventory, particularly for low-rise homes. It also shows that while government is setting the laws for the housing industry to follow, it’s the laws of unintended consequences that are following our market. Provincial land use policies, such as the Growth Plan meant to limit sprawl and encourage urban intensification are well intentioned, but they are helping create our current housing crisis situation. Today, we are seeing frustration, angst and fear among consumers, inflated pricing and undiminished demand for ground related homes. Altus’ data showed that at the end of last month there were only 324 new detached homes available for purchase in builders’ inventories across the entire GTA. A decade ago, there were more than 10,000 homes waiting for buyers. For those who took a high school economics class, you probably remember the unit on supply and demand. New housing scarcity is at an all-time high, and has resulted in higher home prices. Record high prices. Available new, single-detached homes in the GTA averaged $1.47 million last month, and if you factor in additional
lowrise product such as townhomes and semi-detached homes, the average price was $1.08 million. The industry is following provincial intensification policies and we are selling and building fewer ground related homes and more high and midrise ones. Last month more than twice the number of condo apartments were sold than lowrise homes, and majority of them were sold in the 905 area. Altus’ data found that 1,661 of the condo suites were sold in Toronto, while Durham, Peel, Halton and York collective accounted for 1,881 sales. Demand for available condo suites in the GTA continues to be strong and inventory levels dropped again in February, reaching a new low of just 10,342 units.
The significant decline in all types of inventory and record high prices show that the government’s land use policies are having a real impact on people in the GTA. Whether you live (or want to live) in a house, townhouse or a condo apartment; whether you want to live in 905 or 416, there’s no escaping the reality that the market is experiencing a crisis and new policies are desperately needed. Before it’s too late.

What’s in a new-home warranty? By Wayne Karl

WHAT’S IN YOUR new-home warranty? Ideally, that’s a question you’ll never have to answer for real – at least not the hard way, be it filing a complaint or, worse, proceeding to a claim settlement. But, life is sometimes not fair, and despite the best intentions of home builders, things do go wrong. To put it nicely – stuff happens. Indeed, according to Tarion Warranty Corp., nearly every new home built has some form of defect. Such is life when you’re building outside, dealing with the elements and working with natural materials. In most cases, issues get resolved, and builders large and small are getting better at responding to customer concerns. Still, there are unscrupulous – or worse, illegal – builders that try to circumvent everything from relatively minor registration fees to taxes, all under the guise of “saving you money.” But when there’s a problem or issue that needs to be resolved, good luck. That’s why it’s important to ensure your new home builder is registered with Tarion – to provide the peace of mind that Tarion is backing the warranty, as well as to learn what parts of your new home are covered, for how long, and what the steps and procedures are.
Because stuff does, indeed, happen. Typical examples include the following, a Top 10 list of first-year claims: » Paint: inadequate application or coverage 10 YPNEXTHOME.CA
» Doors: improperly installed or finished » Floors: Damaged, cracked or installed with gaps » Drywall: Blemishes on walls, ceilings or corners » Stairs/steps: Inadequately built » Water/moisture: Moisture inside the home » Concrete: Cracking » Baseboards: Improperly installed » Trims: Improperly installed or finished » Cabinets/vanities: Improperly installed or finished You can understand how prevalent such “defects” would be in new homes, and how action is required in many cases. Nine times out of 10, for homes backed by Tarion, they’re resolved without issue. More drastic is another example involving 23 homes by one builder in one development in Ontario, also, thankfully, backed by Tarion: » After the homes were built, the water table shifted, causing differential soil settlements » The problems arose three to five years after construction » 23 homes were monitored and repaired over a period of five years » 10 homes required major repairs – causing the homeowners to be relocated to hotels for an average of 38 days
The cost to Tarion to rectify the matter? More than $5 million. The cost to homeowners? Zero. The benefit of having the peace of mind of a Tarion backed warranty? Priceless. Think that would happen if your home was built by an unregistered or illegal developer? More and more builders, Tarion says, are improving their customer service. And it’s not just the large companies. “The advantage of using a small builder might be that you often get to know the principal,” says Tarion president Howard Bogach. “But large builders are closing the gap. “The large builders that do well are the ones that behave like small builders.” And with real estate and new home prices rising, homebuyers, understandably, expect more. So, what’s in a new-home warranty? In short, your builder is not just building your home, it’s building a relationship.

Here are a few things you should know if you’re unsure whether to go with a bank or a mortgage broker to fund your purchase.

Pros Most Canadians already have an ongoing relationship with a bank, so going to that institution for a mortgage seems like an obvious choice. Banks often provide special deals to existing customers. So, if your chequing account, credit card, investments and mortgage are all with the same bank, you may receive a discount on some or all of your fees. Banks generally provide face time with their specialists, which many borrowers find comforting.
Pros Brokers have established relationships with lenders and are knowledgeable about the market and what special discounts are available. They will shop around for you and ensure you get the lowest possible rate you can qualify for. Whereas banks typically require you to arrange a meeting with a loan officer, mortgage brokers tend to be available through a variety of means, including phone and email. They are easy to communicate with and often provide faster response times. Brokers negotiate with the lenders on your behalf, saving you valuable time and stress.

FOR MANY CANADIANS, their first stop while shopping for a mortgage is their local bank branch. More than half of Canadian homeowners – 56 per cent to be precise – who currently have a mortgage went to a bank, according to the fall 2016 report from Mortgage Professionals Canada. However, consumers should be aware that they have other options. Mortgage brokers – who captured a 33 per cent share of the mortgage market – can prove to be a helpful resource when it comes to comparison shopping for the best mortgage rates. (The remainder of the mortgage market was made up of credit unions at seven per cent, life insurance companies at two per cent, and other sources at two per cent, according to the report.) Cons You can choose only from the bank’s portfolio of products, meaning your options are limited and your chances of getting the lowest rate are diminished. There’s less flexibility offered in terms of qualifying for the loan. If your credit rating is subpar, you may not qualify for a mortgage from one of the big banks. Individuals who are self-employed may also have a hard time qualifying.

Cons Face-to-face availability differs from one broker to the next. So, if this is something that you require, you’ll want to ask if they can meet in person. Because many first-time buyers are unlikely to have an existing relationship with a broker, it may take some time to find one who’s right for you.
The bottom line
When it comes to getting a mortgage, going with a broker – rather than directly to a bank – is the best choice, as it will allow you to get the best possible rate on the market and save you money over the long run.

HOME PRICES in the GTA continued
to climb last month, with the average selling price up 33.2 per cent yearover-year, according to the March figures from the Toronto Real Estate Board (TREB). TREB reports 12,077 residential sales through the MLS System in March, up 17.7 per cent compared to the 10,260 sales reported in March 2016. Annual sales growth was strongest for condominium apartments and detached houses. The number of new listings also increased on a year-over-year basis, at 17,051 – a 15.2-per-cent increase compared to March 2016. The strongest growth in new listings was experienced in the detached market segment. “It has been encouraging to see that policymakers have not implemented any knee-jerk policies regarding the GTA housing market,” says TREB president Larry Cerqua. “Different levels of government are holding consultations with market stakeholders and TREB has participated and will continue to participate in these discussions. Policy makers must remember that it is the interplay between the demand for and supply of listings that influences price growth.” Strong competition between buyers continued to cause high levels of price growth in all major market segments. The MLS Home Price Index (HPI) Composite Benchmark Price was up by 28.6 per cent year-over-year. For the TREB market area as a whole, the average selling price was up by 33.2 per cent, with similar annual rates of growth in the lowrise and condominium apartment segments. “Annual rates of price growth continued to accelerate in March as growth in sales outstripped growth in listings. A substantial period of months in which listings growth is greater than sales growth will be required to bring the GTA housing market back into balance. As policy makers seek to achieve this balance, it is important that an evidence-based approach is followed,” says Jason Mercer, TREB’s director of market analysis.

That has been a tremendous help as a parent.” – Nicola Put a camera in front of eight-year-old Sierra and she will turn on the charm. This charismatic little girl is as playful and active as any other child her age. You’d be surprised to know she’s a current patient at The Hospital for Sick Children (SickKids). Sierra’s illness was detected early at only two days old when she was brought to SickKids to investigate an irregular connection in the bowel. She was sent home, one month later her parents returned to SickKids Emergency with their infant jaundiced and not digesting food properly. Although she was being fed a lot, Sierra had lost weight since being born. It didn’t take long for doctors to determine the cause of Sierra’s deterioration and she was diagnosed with Cystic Fibrosis (CF). CF is a genetic disease that mainly affects the lungs and digestive system. Fortunately for Sierra, it has predominantly affected the digestive system, which is easier

to manage than the lungs. Since her diagnosis, she has taken enzymes at mealtimes to help with digestion and undergoes daily physiotherapy to prevent her lungs from building up with mucus. Since Sierra is very active, her parents have become creative with her physio by incorporating it into her daily activities. For example, 10 minutes bouncing on the trampoline might be followed by five minutes of breathing exercises. This doesn’t hold Sierra back from being active. She does gymnastics, swimming, soccer, art classes and made it to ‘divisionals’ for cross country. Her mom says she can’t sit still. Sierra’s condition has also encouraged her parents and family members to become involved in fundraising activities to support CF research and SickKids. As she grows older, Sierra is becoming more actively involved in her own treatment. Her parents feel lucky to have SickKids in their lives to guide them through their ups and downs.

5 ways... to invest in real estate in Canada By Jayson Schwarz

IF YOU ARE contemplating in buying real estate anywhere in Canada, there are a number of considerations to be entertained as to how you will own that real estate. Will you own it personally, in a partnership or a corporation?
What are some of the different methods of holding property?
1.
Personally. In this scenario, title is placed in your name. This means that any financing is your direct liability, as well as any other things that could possibly go wrong. The positive is that all profits accrue to you personally and you have the advantage of all of the appropriate tax offsets (depreciation, expenses, interest). This is most often used in the purchase of a single residential property for investment purposes.
2.
Partnership: If there is more than one person making a real estate investment, the liability and tax considerations are virtually the same as investing personally. The various partners will hold title in their names. The consideration here is whether the title is held as tenants in common or joint tenants. The easiest explanation 32 YPNEXTHOME.CA
B is this: joint tenants each own 100 per cent of the property and if one dies the other owns the whole thing without tax impact; tenants in common own their proportionate share and on death the portion owned devolves to the deceased’s estate. Usually, families or spouses own as joint tenants. If this is an arm’s length business transaction, ensure you have a partnership agreement signed before closing to avoid issues later. This could be utilized by three or four friends buying a condominium investment.

Limited Partnership (LP): This is an entity created by statute in certain provinces, kind of like a corporation and a partnership combined. In an LP,
the limited partners are liable only to the extent of the amount of money that the limited partner has invested, and a LP must have at least one general partner and at least one limited partner. The general partner is usually a corporation that assumes unlimited liability for the venture. In an LP, the LP agreement can deal with profit and tax benefit distribution in a quite effective manner. LPs are primarily used for commercial ventures.
4.
Joint Venture (JV): A JV is essentially a business arrangement wherein the parties each contribute money, property, skill, efforts, knowledge or other assets to a common undertaking. Usually the JV …continued on page 34

agreement specifically sets forth the relationship, obligations and rewards and is quite often seen in large residential developments between owners, developers and contractors.

Corporation: Probably the most common method of holding real estate, both residential and commercial, is to establish a corporation to hold the property. In this case, the shareholders are afforded 100-per-cent exemption from liability unless they guarantee personally on behalf of the corporation (which defeats the purpose of using a corporation). The corporation can enter into any of the foregoing entities. One thing to remember is that passive corporate income is taxed at a virtual flat 50 per cent. Corporations are the most used method of ownership for any kind of real estate nationwide. There is flexibility with the corporation through the use of shareholders agreements to establish relationships between numerous individuals and other entities with the corporation itself.
THESE ARE A few of the means of holding real estate in Canada and apply through almost all provinces regardless. There are regional differences; for example, Nova Scotia has some different corporate forms versus other provinces. At the same time, we examine the different vehicles used to hold real estate. We need to consider the tax implications and where you and the property reside. In other words, are you resident where the real estate sits, and what does that mean? S116 of the Income Tax Act of Canada states that where a nonresident person disposes of property
D in Canada, the seller must obtain a certificate from the minister, and if there is no certificate and the deal closes and the buyer does not remit the holdback or receive a certificate, the buyer becomes responsible for the tax. This means there is no impediment to buying property in Canada (except some local variations such as PEI) to a non-resident. However, there are significant tax implications on selling, and you should speak to a tax professional to ensure that you are protecting yourself the best you can.
I recommend you speak to a real estate lawyer or chartered accountant with real estate experience to ensure you follow the best method for your purchase. As types of real estate vary, so do the people who purchase, and each should ensure their venture is tailored for them.

WALLPAPER From Han to eternity! By Jane Lockhart
IT’S QUITE POSSIBLE that our love-
hate relationship with wall paper began when paper was invented. In 105 AD, a Han dynasty Chinese court official named, Ts’ai Lun dried a mix of macerated tree bark, hemp, old rags and fishnet to make paper. Until then all printing was on cloth made of pure silk. So, we’re talking a few or more centuries of divisive opinion. Meant to mimic the expensive tapestries hanging on the walls in homes of the very rich during the Renaissance, wallpaper was hung loose or pasted on to add colour and style to a room. The highest quality, hand-painted papers of the time came from China, but there was no end of designs coming from Europe. As patterns come and go and come back again, like those from the 18th and 19th century Europe, history shows us that a good motif can stand the test of time. When it comes to installation, I can’t help but wonder how many divorces over the centuries started as arguments while couples hung wallpaper –never mind trying to take it all down. At least as it comes in and out of fashion, the quality continues to improve. Today’s vinyl-coated wallpaper is easier to hang. attaching paper, rather than soaking it to activate the paste. No more trough-kicking spills! Wallpaper is also more easily strippable than its predecessors. The days of scratching away at walls with a putty knife are done. Simply start in one corner and strip it off in long sheets. Very gratifying. But why wallpaper and not paint? If you have old plaster walls they may have unsightly dents, cracks or uneven surfaces that paint can’t hide. Coat it with wallpaper and most of the imperfections can be hidden. Even if your walls are in good shape, think about the advantages. Wallpaper is a great way to give your room colour, texture and style. While in the past, colour schemes and patterns were very limited, today there is a much wider selection. With photo-technology you can add lots of texture (or faux texture) to your walls. Full sized wall murals can resemble everything from aged barn board to marble tile or even industrial concrete. There are many whimsical choices available like library shelves filled with books, full lush draperies and industrial file cabinets that can cover whole walls. A little whimsy can go a long way and these murals make a great statement as a focal wall. Wallpaper can be a cost-effective option. It’s a durable product and when applied properly it can last for years. Try it on one wall to save money and add a punch of style. When it comes to stamping your personality on a room or living space, don’t be afraid to do what some may view as “unconventional.” Making your walls original and memorable is a great way to explore your creative side when making your home your own!
