NO ONE COULD FAULT YOU if you’re a prospective homebuyer, and the recent developments in the GTA housing market have you a little concerned. Rapid – in fact, double-digit, price growth; government warnings about overheating and overvaluation; scarce supply of new home supply; and overall market reaction to the recent unveiling of Ontario’s Fair Housing Plan. It all adds up to something we haven’t seen in the GTA for years – uncertainty. However, there are indeed some certainties in this equation. One, the GTA will remain a top destination for newcomers – meaning housing demand is not going to decline any time soon. Two, supply of new lowrise homes, for other complex reasons, is not going to significantly increase any time soon. And that adds up to three – new home inventories, released at prices that are definitely not going to become cheaper, will continue to be snapped up in a heartbeat. The good news (see pages 26 and 30) is that there is some relief, though some of it in the longer term, for those looking for new lowrise homes in the GTA.

is starting to grow after years of being stagnant, as more developers look to build rental housing. But it is not easy. One way to help meet our housing supply shortage and affordability problems in the GTA is to build more rental housing. With housing prices as high as they are, renting has become a popular alternative for the many people priced out of homeownership. Builders are interested in bringing purpose-built rentals to market because of the greater demand and more is being developed. According to a recent CIBC report, more than 5,000 new rental units are currently under construction and another 28,000 units were proposed in late 2016. While there is increased interest, rental housing must be financially worthwhile to develop otherwise units won’t get built. Similar to condominium projects, it’s difficult for developers to build purposebuilt rentals because of the many challenges that need to be overcome. One of the biggest challenges and one that would have a huge negative effect on the development of new rental housing is potential changes to rent control legislation. The government is looking at expanding rent control rules and although this may seem like a good idea, the impact would in fact be detrimental on the viability of constructing the much needed housing. If the province imposes rent restrictions, the financial incentive for developers to build these units

will diminish. Expanded rent control on new rental buildings would not improve our housing issues but instead would push housing prices up as rental supply falls. There are many other challenges that builders need to consider before moving forward with a purposebuilt rental project. For example, there could be more financial risks in building rental housing rather than constructing condominiums. Developers typically sell most condo units before they are actually built which decreases their investment risk. Whereas with rental developments, units can only be rented once the building is complete which increases the uncertainty of being able to rent all units in a timely manner. Developers also face the same planning policy challenges with rental building as they do with condo projects. It is difficult getting height and density approvals, and out-ofdate zoning by-laws and excessive red tape increase approval timelines

and delay construction. All these challenges means it costs developers more to bring projects to market. In order to make rental projects work, developers need to build in established locations where potential tenants want to live. Like condominium developments, many rental projects are being met with NIMBYism or opposition from local residents who are concerned about highrises going up in their neighbourhoods. Purpose built rentals could be one way to address the housing demands across the GTA however in order to happen, these projects need to be financially viable for developers.

prospective homebuyers in Toronto and elsewhere in the GTA, the sky is not falling on your real estate market. It’s just taking a slight pause. Just as the spring weather finally began warming up and when the local housing market should have been enjoying a similar spike in activity, along came something called the Fair Housing Plan. Announced by the Ontario government on April 20, the plan introduced 16 measures to bring stability and affordability to the market, while protecting the investment of homeowners. Within days, you could feel the impact. Those in the resale market say there was an immediate cooling effect, as buyers reacted to the plan by hesitating. Anecdotal evidence suggests home listings that would have been snapped up in days in multiple offer situations, were now sitting idle or removed entirely – at least temporarily. “Homebuyers and sellers both reacted to the recent Ontario government policy announcement aimed at cooling housing markets in and around Toronto,” says Gregory Klump, chief economist, Canadian Real Estate Association. “The number of new listings in April spiked to record levels in the GTA, OakvilleMilton, Hamilton-Burlington and Kitchener-Waterloo, where there had been a severe supply shortage. And with only 10 days to go between the announcement and the end of the month, sales in each of these markets 10 YPNEXTHOME.CA

were down from the previous month. It suggests these housing markets have started to cool. Policy makers will no doubt continue to keep a close eye on the combined effect of federal and provincial measures aimed at cooling housing markets of particular concern, while avoiding further regulatory changes that risk producing collateral damage in communities where the housing market is well balanced or already favours buyers.” The number of newly listed homes jumped 10 per cent in April 2017, led by a 36 per cent increase in the GTA. Housing markets in the Greater Golden Horseshoe also saw similar percentage increases. Not the market was hurting, exactly; the MLS Home Price Index Composite Benchmark Price was up by 31.7 per cent year-over-year in April 2017, according to the Toronto Real Estate Board. Similarly, the average selling price for all home types combined was up 24.5 per cent to $920,791.

What the Fair Housing Plan didn’t immediately address, and what is not likely to change in the short term, is supply and demand among new homes. Ontario is to create a housing advisory group to resolve land-use approvals issues and red tape, which prevent housing from coming onto the market for new-home buyers. What this means for buyers seeking newly built homes, particularly lowrise, is that any new homes brought to market in the GTA will be snapped up immediately. And that means these prices are likely not going down, no matter what happens in the resale category in the short term.

BUILDERS & PROJECTS HONOURED THE GTA’S HOME BUILDING AND LAND

development industry recognized its top builders, projects and marketing initiatives at the 37th annual BILD (Building Industry and Land Development) Awards on April 28. More than 1,200 industry professionals were there to honour achievements in planning, design, sales, marketing and city building across 51 categories. A team of 17 judges from across North America determined the winners from more than 900 submitted entries. A highlight of the evening was the presentation of BILD’s Lifetime Achievement Award to Al Libfeld, principal and co-founder of Tribute Communities. This recognition is the Association’s highest honour and was presented to Libfeld for his contribution to the industry over the past four decades. Taking home the night’s most prestigious awards for Home Builders of the Year, were Tridel for MidHighrise and Mattamy Homes for Lowrise (see page 14.) The coveted People’s Choice Award, determined by members of the public through online voting, was awarded to Tridel for its Aquabella development. Aquabella is a resort destination in the city that will come to life on Toronto’s waterfront. The building is uniquely designed to follow the contours of the lake, boasting vast panoramas from its grand terraces. “People’s Choice is a unique award because it is the public who decide the winner,” says BILD President and CEO Bryan Tuckey. “The projects that competed for this year’s title showcased the best in city building and demonstrated how the industry is providing a wide range of housing options for GTA homebuyers.” 16 YPNEXTHOME.CA

For community building, BILD has two categories for outstanding projects that embody the Province’s smart growth principles: Best New Community (Planned/Under Development) for a project currently planned or under construction; and Best New Community (Built) which recognizes a completed project. Rockport Group won Best New Community (Planned/Under Development) for Weston Common. The development will create a vibrant community hub in Toronto’s Weston neighbourhood, an area that has not seen significant development in 40 years. For its work in Downtown Markham, the Remington Group won the award for Best New Community (Built). Emphasizing sustainability and neighbourhood integration, Remington’s Downtown Markham includes features such as green roofs, pedestrian-only promenades and an innovative storm water management system. Laurier Homes’ Kingswood, a 705-sq.-ft. corner suite featuring a clever layout that optimizes the use of internal space, won Best Innovative Suite Design. The Briarwood by Arista Homes took home the award for Best Innovative Home Design, which recognizes cutting-edge design in lowrise that increase

The Rockport Group won the award for Best Midrise Building design for George Condos + Town, which combines aesthetic appeal, creativity, neighbourhood integration and optimal use of land. For outstanding leadership in Green building, Tridel was named Green Builder of Year, Mid- Highrise and Minto Communities was named Green Builder of the Year, Lowrise. Project of the Year, Tridel’s Aquabella development on Toronto’s waterfront was selected as the Mid- Highrise Project of the Year while Lowrise title went to Geranium and Pemberton Group for the Friday Harbour development on Lake Simcoe.

Ontario’s new home warranty continues to evolve By Howard Bogach

FOR MORE THAN 40 YEARS,

Ontarians have bought new homes with the comfort of knowing that important protections are in place. To build homes, all builders must be registered and demonstrate that they have a number of important competencies. They are also held accountable for their work by providing a mandatory warranty on each and every home they build. The principle behind these regulations is simple: New-home buyers should have a certain level of protection for such a significant investment. Not only are our homes likely the largest purchase we make in our lifetimes, but they are also where we build families and dreams. Since it was first created in 1976, Tarion has evolved and strengthened these protections. In March, the Ontario government announced plans to further evolve both the warranty administration and builder regulation by creating two new Designated Administrative Authorities (DAAs) to separate the building regulator function and the warranty function. While there are structural changes coming, the principle of consumer protection that lies behind the province’s new home warranty remains unchanged. It is also important to stress that these changes will take time. For now, it is business as usual at Tarion. The changes to come are part of a long evolution of consumer protection that began in 1976, when the warranty and builder registration became mandatory. Before then, there was little protection for new-home buyers. There were reports across the province of so-called “builders” accepting deposits from buyers without any intention of actually building the purchaser’s home. With no protection in place, new-home buyers had little recourse when their money was taken and their homes were never built. These schemes hurt consumers, legitimate builders and the reputation of Ontario’s building industry. The need for consumer protection was evident, and so builder registration became mandatory, along with the requirement to provide a warranty on every new home. Tarion – although called by another name – was created to regulate builders, administer the warranty and prosecute those who didn’t follow the rules. Some of our current staff have been with us since those early days. Over the years, the protections and regulations have grown significantly. In fact, Ontarians enjoy some of the strongest protections across the country. Not only have warranty coverage limits increased, but we are the first and only province to cover radon gas remediation and delayed closings. And, we continue to strengthen the warranty. Currently, we are consulting on how to expand deposit protection to better reflect the reality of today’s new-home buying experience. Over the years, Tarion has also made sure builders have been held to increasingly higher standards – most recently requiring them to complete educational competencies prior to registration. THE NEW YEAR is a good time for a

financial health check. And since for most homeowners’ financial wellbeing is directly linked to the cost of your mortgage, re-evaluating your mortgage is key. Before getting a mortgage, look at how much of your income goes towards your payments. When you review these costs, you should consider options that can lower your payments and reduce the amount of interest you have to pay. Here are three ways to access lower interest rates: 1. Get and keep a high credit score Maintaining a higher credit score makes you a more attractive debtor. This will enable you to negotiate a lower interest rate. Most financial institutions consider credit scores in the 800 to 900 range to be favourable. A long history of good credit will give you access to lower rates. Get your free credit score before meeting with an advisor. 2. Use a broker A licensed mortgage broker can give you access to the best mortgage rate possible. A broker can access a pool of both traditional and non-traditional lenders from which they can then offer you the lowest rates possible. Although brokers are paid by the lender, they are also acting for you and are not tied to specific lenders. 3. Consider a variable-rate mortgage The interest on a variable-rate mortgage is often lower than a fixedrate one. This enables you to pay less 20 YPNEXTHOME.CA

interest with your monthly payment. Choosing a variable rate comes with the risk of paying a higher rate at some point. That’s because the rate will change with the prime lending rate set by your lender. There are also ways to reduce the amount of interest you pay over the lifetime of your mortgage. Here are three strategies you can use: 4. Increase your down payment You can put down as little as five per cent to buy a home under $500,000, but when you put down less than 20 per cent you have to get mortgage insurance. A larger down payment also decreases the monthly cost of the principal and interest of your mortgage loan, as well as the total interest over the life of the mortgage. 5. Increase payment frequency When arranging your mortgage, ask your broker to structure it so you can make accelerated biweekly payments. If you do so, the monthly payment is divided by two and the frequency of payments increases

to 26 times a year from 12 times annually. Therefore, you’re paying the equivalent of 13 monthly payments a year and accelerating your payments, you’ll increase the amount that goes towards the principal. 6. Make lump-sum payments Ensure your mortgage allows you to make lump-sum payments. Making an annual lump-sum payment can help you pay off your mortgage years earlier and reduce your interest costs. THE BOTTOM LINE Reducing your mortgage rate and increasing how much you pay towards your principal will help you reduce your overall mortgage costs. It’ll also make your finances healthier because your monthly expenses will shrink and you’ll spend less to pay off your mortgage. Average GTA home price up 25 per cent, to $921K

digits in the Greater Toronto Area, according to April 2017 figures recently released by the Toronto Real Estate Board (TREB). Could this signal a pending shift to a more-balanced housing market? April saw 21,630 new listings on the MLS System, up 33.6 per cent April 2016. New lowrise listings increased by double-digits across all home types, including detached, semidetached and townhouses. New condo listings held steady. Total sales in the region were down 3.2 per cent year-over-year, at 11,630 transactions. TREB attributes the decline to Easter’s April arrival in 2017, versus March in 2016, resulting in fewer working days this year. Historically, most sales are entered into the MLS System on working days, TREB says.

“The fact that we experienced extremely strong growth in new listings in April means that buyers benefitted from considerably more choice in the marketplace,” says TREB President Larry Cerqua. “It is too early to tell whether the increase in new listings was simply due to households reacting to the strong double-digit price growth reported over the past year, or if some of the increase was also a reaction to the Ontario Government’s recently announced Fair Housing Plan.” The MLS Home Price Index (HPI) Composite Benchmark Price was up by 31.7 per cent year-over-year in April 2017. Similarly, the average selling price for all home types combined was up by 24.5 per cent to $920,791. “It was encouraging to see a very strong year-over-year increase in new listings. If new listings growth continues to outpace sales growth moving forward, we will start to see more balanced market conditions. It will likely take a number of months to unwind the substantial pent-up demand that has built over the past two years. Expect annual rates of price growth to remain well-above the rate of inflation as we move through the spring and summer months,” says Jason Mercer, TREB’s director of market analysis.

WITH THE GTA FACING serious supply constraint, Fortress Real Developments has announced the sale of two parcels of land in April, which will soon become home to townhome development. The Towns on Hall project in downtown Richmond Hill received OMB approval in early 2017 for 22 luxury three-storey freehold townhouses and includes an existing heritage home that will be relocated and restored. Meanwhile in north Pickering, the Brock Village project was recently re-imagined as a 59unit townhouse project, where a commercial and residential mixed-use development was originally proposed. The supply of ground-oriented new housing supply has declined to the lowest point since the turn of the century, with just 932 units remaining according to Altus Group Data, a 68-per-cent decline year-over-year, 26 YPNEXTHOME.CA

and a drop from over 17,000 units in 2006. New home builders and developers are desperate for product, and the inquiries on the availability of sites has been frequent throughout the development community. “With over 70 active real estate developments in our portfolio, we were comfortable disposing of a couple of our smaller sites, especially given the generous offers received for the Towns on Hall and Brock Village projects,” says Fortress CEO Jawad Rathore. “We were happy to extract the value created through the approval and assembly or these sites, and offer thanks to our partners and consultants for the realization of our planning objectives.” The lack of a supply is a major contributor to the rapid rise in new home prices in the GTA. Altus Group reported that new lowrise house prices in March topped $1.1 million, a

32-per-cent annual increase. “We have seen first-hand that the appetite for new single-family and townhouses projects is insatiable,” notes Senior Vice-President Ben Myers. “Our Stationwest project in Burlington with Adi Developments, and [the] Woodbridge Park project with Sierra Building Group in Vaughan had massive online registrations, huge opening day line-ups, and unprecedented sales velocity.” “Fortress continues to seek out high-quality real estate assets across Canada, and our development team is able to bring immense value to all the projects in our portfolio,” Rathore remarked earlier this year. “Real estate offers tremendous flexibility, with opportunities to exit a development at several different stages, and as we look forward, we anticipate a very busy 2017 as our portfolio of more than 70 sites matures.”

MY OFFICE IS WHEREVER I happen to

be, in the car, at home or the design office – basically, wherever my phone is. But it’s hard to ignore how many in the work force are following the shifting trend to work part time or full time from home. There are many factors that can help make your home office a productive and beautiful place to work. Today’s wireless technology in the house allows you to work from almost any room, but pick one and make it yours. I always recommend a

home office be set up in a room with a door that closes and locks, rather than the dining room table or in an open concept loft or basement. For business calls and for concentration it’s best to have a door for privacy. If you need to share a space try to make it the guest room or a place that isn’t occupied during the day. The size of the room isn’t as important as how functional it is. Organization is key and the way to stay productive is with proper storage. Having the right place to

put everything can help contain clutter and keep your mind focused on what’s important. You’ll need organization systems for paper and cord/cable management to tame that tangle under your desk. Many office stores carry organizational solutions for computers and supporting tech, but custom built-in cabinetry is the way to go for storage. Every need can be addressed and interpreted into good-looking, yet practical storage. After all, if you’re going to spend eight hours in a space, why not make it functional and beautiful? Your personal style can carry through from the rest of your home to your office or you can create a unique, personal space that makes you happy just to be in it. Good lighting is one of the most important considerations. There’s no such thing as too much lighting, you can always turn something off. If you can, invest in recessed ceiling lights for clear, ambient lighting and good desk lighting for task work. Hire a designer to put together a lighting plan for you if you’re not sure what you need. The second important factor to consider is your chair. Get the most supportive, comfortable seat in the house, because you will be in it a lot. That means no dining chairs! An area carpet and drapery may seem like overkill in an office but both will help dampen sound. You’re still in a functioning household and sound travels both in and out of rooms, so remember fabric helps reduce the noise level. If you’re bringing in an electrician to update your lighting, ask about having some of the room’s wall outlets raised to counter height so you don’t have to crawl under your desk to plug in your computer. If you still work with a lot of paper (like me) you need space to spread stuff out. A computer is one thing

The best way to tame that paper pile is to tackle it and let it go, so get a high-quality paper shredder and don’t forget to use it!

Deciphering legal language Deeds, transfers, mortgages, charges, discharges and undertakings By Jayson Schwarz

FOR THE AVERAGE homebuyer,

there are some legal terms that require translation. The Government of Ontario keeps records of every piece of property in the province. These records are called the “title documents.” The document on file that says who owns the property is called the “transfer,” or “deed.” All of these documents are filed with the government — a process that is called “registering” the document. When a bank lends money and gets a record of this loan on title, the document is called the “mortgage” or the “charge.” When the charge is paid off, a new document is filed with the government office and it is called a “discharge.” If only part of the charge is paid off, a document called a “partial discharge” can be filed. There are many other documents, but these are a good starting point. Usually when a developer/builder starts a new project, he/she will go to a bank or other financial institution and just like you, arrange for a mortgage or charge. The difference, however, is that this can be a huge charge. As an example, the builder/developer may have a $50- or $60-million “blanket” charge applied to enable him/her to create and build the project. The next thing that happens is that the house or condo is built and sold, and it is time for closing. In the Agreement of Purchase and Sale will be a clause that will relate to the discharge of that part of the 34 YPNEXTHOME.CA

blanket charge which affects the property you are buying. The builders’ lawyers (the good ones, in any case) add the clause that the purchaser will accept the promise (undertaking) of the builder’s lawyer to register the partial discharge in a reasonable period of time, but will give on closing two important things: a) a letter (“discharge statement”) from the bank or other financial institution (“mortgagee” or “chargee”) setting out how much money has to be paid to the chargee to obtain the partial discharge; and b) a direction from the builder to the purchaser, telling the purchaser to pay the amount of money needed to obtain the partial discharge directly to the chargee. The clauses I will not accept stop with the purchaser being forced to accept the builder’s or the builder’s lawyer’s undertaking to register a partial discharge, without the other information. Now, I do not believe the builder or the builder’s lawyers who do not include this information would give the promise without meaning it, but what about things out of their control?

For example, if: » the builder goes bankrupt » the builder has a dispute with the bank » some other party seizes the money from the builder » the builder has an internal shareholders dispute and assets are frozen » the lawyer goes to Argentina with the money » the builder goes to Tahiti with the money If we had followed a) and b), none of that would matter. My complaint is that it does not cost the builder anything to give this peace of mind and security to the purchaser. It is just usually the fault of a lawyer trying to prove how good he or she can be. Watch for these tricky clauses and consult a lawyer, because only a lawyer can provide legal advice and care enough to catch these kinds of things.
