he Bank of Canada’s most recent rate announcement – holding its interest rate target at 0.75 per cent – is the continuation of good news for prospective homebuyers and those otherwise in the market for a new mortgage. There are many excellent mortgage products available from banks and brokers that will suit your individual needs, and could well be lower than posted bank rates, which are currently hovering around three per cent for a variable rate. With a pre-approval in hand, you’re protected if rates rise; if they go down, you’ll likely get an even lower rate. A pre-approval can be a win-win situation for shoppers, since it means you don’t
have to wait to get financing approval on a home when you put in an offer. Th is is an especially good tool to have when markets are hot. Removing the “conditional on financing” clause could mean your offer is accepted fi rst since you already have your financing in place. So when will rates rise? It’s anyone’s guess, but most experts agree there could be some movement later this year. (BoC’s next rate announcement is July 15.) However, we can’t assume that will be the case, and you shouldn’t wait too long to get pre-approved for a mortgage. It can take a few days. Many lenders offer online pre-approvals to make the process faster and easier. Take advantage while you still can.

n slightly less than two weeks, Toronto’s already stressed transit and highway systems will be tested like never before, when the 2015 Pan Am Games take place from July 10 to 26. If you haven’t been paying attention to the advice from organizers and City officials about how you might want to alter your commuting method or work schedule, you could learn a lesson the hard way. About 10,000 athletes and coaches, 20,000 volunteers and who knows how many fans will travel to and from, within and around Toronto and surrounding areas. No one knows for sure, perhaps, but if we think it’s going to be commuting business as usual, we’re likely going to be dead wrong. To say the least, it will be a good test of our systems – and patience.
Fortunately, longer term, Toronto’s aging transit system will get an important boost from the federal government’s decision to fund Mayor John Tory’s SmartTrack plan, to the tune of $2.6 billion. Roughly a third of the total cost, that’s $2.6 billion you and I won’t have to find a way to fork over to fund a transit upgrade that is so desperately needed. Far more than just how we commute, transit is an increasingly essential part of how we plan and build our cities, and where and how we live, work and play. Construction of SmartTrack and other initiatives, however, will take far longer than two weeks to complete. So, take a deep breath and enjoy the Games. The fun is just beginning.

Cycle Warriors raise $250,000 for Enbridge Ride to Conquer Cancer TREASURE HILL PRESIDENT FORGES HIS OWN PATH TO HELP THE PRINCESS MARGARET CANCER FOUNDATION Four years ago, Nicholas Fidei, president of Treasure Hill, participated in his first Ride to Conquer Cancer and raised $20,000. On June 14, 2015, he was proud to hand the Princess Margaret Cancer Foundation a cheque for $250,000. Quite a difference a couple of years makes. An avid cyclist for many years, Fidei decided three years ago that he didn’t simply want to write a cheque and leave it at that. “I love cycling and have a passion for this cause because everyone is touched by Cancer.” Two years ago, he formed his own team, Cycle Warriors, and over their first two years, Cycle Warriors raised an impressive total of $120,000. Fidei was happy with their results, but decided to take things to the next gear, so to speak. He was determined to acquire fewer sponsors, but at a higher dollar amount – $5,000 per sponsorship. “Instead of chasing hundreds of people around for a little, I wanted to maximize my efforts. I knew that getting this kind of sponsorship wouldn’t be easy, so I needed to add a perk of some sort,” he says. Through his own organization, The Nicholas Fidei Foundation, Fidei approached the owner of Active Green + Ross and Peel Chrysler, who donated a Fiat 500 for this cause. “I was able to offer ‘the chance to win a Fiat 500’ to an exclusive number of corporate sponsors, and it worked extremely well.” The Fiat 500 was given away at the finish line at the post-event celebration, where the team, friends and family enjoyed a catered event under a tent. celebrated the impressive effort and shared many hugs and congratulations. As a result of this initiative, Fidei’s Foundation raised $150,000 well before the event. The rest of his team of 24 cyclists raised $100,000, which brought the Cycle Warriors’ 2015 total funds raised to an impressive $250,000. “This year, our goal was only $100,000,” he says. “We far exceeded that. In every complete community, there are special places where people play. Whether it’s a trail system to cycle on, parks where children run and climb or recreation centres that allow a range of activities for all ages – these spaces are major hubs and often the heart of their communities. Let’s take a look at places where people play and explain that many come as a result of newly-built communities. There is a common misconception that new parks, trails and recreation centres are paid for by current residents through their property taxes. However, in most cases across the GTA, that’s just not true. They are often funded through Development Charges and other government fees, paid by new-home buyers when they purchase a new home. Development Charges are a tax imposed by local municipalities, as well as GO Transit and education boards, and are paid for by new-home buyers to help offset capital costs of growthrelated municipal services like roads,

sewers and parks. BILD advocates for fair and reasonable government fees and charges and increased transparency and accountability around how the funds are collected and applied. The building and land development industry also designs and builds, and in some cases pays for play spaces for people to enjoy in the communities that are constructing. For example, Daniels Corporation’s City of the Arts project on Toronto’s waterfront will feature new arts and cultural spaces for businesses and non-profit organizations, as well as new shops, restaurants, a new pedestrian promenade and park that will provide a public gathering space for markets, festivals and more. Committing space and dollars to recreational projects is not confined to the city core. In the western GTA, the Town of Milton is now home to the new Mattamy National Cycling Centre, and it’s one of two internationally-sanctioned timber tracks in Canada. The track will first be used as a venue during the Toronto 2015 Pan Am Games and then open for public use. The capital costs for the facility were primarily funded through development charges, federal grants and private donations, including a $2 million donation by Mattamy Homes. Specifically, about 25 per cent of the $56-million project budget came from Development Charges generated by new-home buyers, Mattamy Homes and other local developers and builders.

Toronto’s transit expansion plans received an important boost recently with the federal government committing to fund Major John Tory’s SmartTrack plan to the tune of $2.6 billion. Ottawa’s contribution amounts to about one-third of the cost for SmartTrack transit, a regional express rail surface line intended to provide relief for the overcrowded Yonge-University-Spadina subway line, and connect Toronto to major employment centres in Mississauga and Markham. The funding is to come from the new Public Transit Fund, the federal government’s largest dedicated, permanent infrastructure program, announced in the Economic Action Plan 2015. WHAT EXACTLY IS SMARTTRACK?

Express Rail (RER) surface subway, providing service from the Airport Corporate Centre in the west, southeast to Union Station and northeast to Markham in the east. It will have 22 new station stops and five interchanges with the TTC. I recently purchased a rental investment property. Fortunately, the home was rented quickly. However, last summer because of several days of heavy rainfall, the roof leaked terribly and our ceilings were partially water damaged. I had to reshingle and replace almost half of the entire roof and repair the ceiling and floors. It also cost me more than $1,200 for a new fridge and stove. I have an individual who prepares my income taxes who has advised me that these are capital items and I could not deduct them for my income taxes. I find that ridiculous to be out of pocket that amount of money and I cannot deduct it.

. Real estate rental deductions are always contentious, and Canada Revenue Agency frowns on expenditures that should be capitalized as opposed to being expensed immediately. As an accountant who deals with real estate investors on a regular basis, I can tell you your concern is not isolated. The Income Tax Act does provide guidance with regards to capital items and current expenses. Capital expenditures – Generally, these are expenditures that will provide benefits and a useful life for several years – such as appliances, air conditioners and dishwashers. The Income Tax Act provides for Capital Cost Allowance (CCA) deduction for capital expenditures that can be expended over the useful life of the asset. Deductible Expenses – Generally, these expenditures may be deducted in the year they are incurred. They would include all expenditures directly related to the property such as property taxes, insurance, utilities, mortgage interest, advertising cost, legal cost, accounting fees, and repairs and maintenance. It would appear your repairs were performed to maintain the property to its original condition and would therefore be considered a current expense. However, the fridge and stove must be capitalized. Investors should always have a good accountant who deals with real estate investments on a regular basis to ensure the right advice is given.

. Congrats on joining the ranks of entrepreneurs. Many individuals talk about starting their own business but are reluctant to do so for various reasons. The primary obstacle is finances, followed by lack of knowledge about where to start. Individuals who are strictly T4d – that is, employed full- or part-time – were to file their year’s personal tax return on or before April 30 of the following year. Self-employed (including non-incorporated businesses) taxpayers and their spouse had to June 15 to file their tax return for the previous year. However, any income taxes owing would have to be remitted on or before April 30 of the filing year. Therefore, you should have your tax returns prepared before the end of April to avoid any interest penalties.

Not all lawyers are created equal. If you needed a heart surgeon, you certainly would not go to see a podiatrist. By the same token, lawyers generally have expertise in one area greater than another. Do not believe that the granting of a law degree instantly bestows knowledge of all laws on the head of a lawyer. The fi rst thing you need to do to find a lawyer is the same thing you ought to be doing to find a home – research! Where do you look? Start with media and look in magazines (editor’s note – you already have your issue of New Home Guide, so you’re off to a good start!), newspapers, listen to radio, watch real estate television. Generally speaking, the lawyers who appear in public, speaking or writing about real estate, are thought to be experts in the area. Go to seminars and listen to the speakers. Generally, if a lawyer is taking the time to participate in a seminar, he/she knows what he/she is talking about and is happy to take on new clients that come out of those seminars. Next, go online and check out the websites of different real estate lawyers. Look to see whether they give good, informative advice; whether they give you pricing; and whether they make you feel comfortable. Call the Law Society of Upper Canada, Lawyer Referral Service. Th is service keeps lists of lawyers and refers requesting members of the public to lawyers who practice in the area requested. Th is just gets you someone in the area. You really need to check them out when referred. Speak to friends who have used a lawyer for the type of service you require and ensure they did the job professionally, courteously and for the price quoted.

Who is making the referral? Is the referral coming from a real estate agent, a mortgage broker or a bank? Th is is not necessarily bad, but you have to be careful. Quite often, lawyers develop relationships with various groups over the years and receive referrals because they do a great job. On the other hand, ensure that your lawyer is independent and will represent your interests even if it puts him/her into an adversarial position with one of those parties. Th is is quite important, so make sure you are comfortable with this issue before you hire someone. Now to bring this back to the original idea, what you need to understand is that there are general law practitioners just like there are family doctors. What this means is that a lawyer may have a wide-ranging practice composed of many areas. The smart lawyer who falls into this category knows that if there is a serious issue that arises outside of their expertise they should bring in a specialist, just like your family doctor would. The bad lawyers try to do it all. The general practitioner can probably handle your real estate deal just fine, but make sure he/she understands any complicated offers and that he/she reviews them carefully, pointing out any problems. Ensure that he/she knows what can be negotiated and what cannot, or you may lose your deal. Remember, your lawyer is a very important part of the process, so take your time and find the right one.

It’s a fact that new homes and condos are not perfect. The home building process is the work of craftsmanship, where many tradespeople collaborate to bring your new home to life. This is why it isn’t uncommon for a new home to have some imperfections. While an imperfection in a new home is no cause for concern, a defect in construction is something your builder should repair. All new homes in Ontario come with a warranty that lasts seven years from the date of the first possession, guaranteed by Tarion. The warranty was created to ensure homeowners receive a new home that is constructed in a workmanlike manner, is free from defects in material, is fit for habitation and is constructed in accordance with the Ontario Building Code. Let’s have a look at the most common issues that homeowners are concerned about, and whether they are considered defects that fall within the new home warranty coverage. FLOORING
One of the most common concerns raised by homeowners is issues with flooring. Homeowners mention uneven finishes, visible gaps between boards, scratches, crowning or cupping (creating an uneven floor). Hardwood floor problems can arise from defects in material or poor installation. Often, however, deficiencies can be traced back to moisture content. Builders can avoid such problems by acclimatizing the wood and ensuring that the subfloor is not wet before installation. Homeowners also need to do their part to ensure that hardwood flooring problems do not arise because of 52 NEW HOME GUIDE GTA | JUNE 27 - JULY 25, 2015
excessive or insufficient humidity levels in the home. Maintaining a proper interior climate is essential to the health of your hardwood floor. If your new home includes hardwood flooring, I encourage you to speak to your builder and visit Tarion’s website to view our videos on how to control the moisture levels in your home. If you notice any flooring deficiencies or damage during your Pre-Delivery Inspection (also known as the PDI), note them in the PDI Form. If deficiencies become apparent later, contact your builder as soon as possible. It is also a good idea to keep photographic records with date and time stamps if you start to see damage on your floors after you move into your new home. INTERIOR FINISHING
New-home owners commonly complain about paint – streaks and brush marks, poor quality paint, poor workmanship and drips and splatters. Generally, paint is covered under the one-year warranty. Where paint finish is specified, exposed surfaces are to be properly painted. Doors are another common issue with new-home owners. The most common complaints include doors that are inadequately installed, sticking or improperly finished. Defects in doors and improper installations are covered under the one-year warranty. MANAGING INTERIOR CLIMATE CONTROL
Controlling a home’s moisture level is an essential part of keeping your new home healthy. Today’s energy-efficient homes are built tightly to seal out the cold weather in winter and keep in the air conditioning in summer. However, lack of proper ventilation or humidity control by the homeowner can lead to damage that would not be covered by the statutory warranty. The good news is that as a homeowner, you can follow some simple steps to keep your interior climate healthy. At your PDI, it is a good idea to ask your builder how to maintain proper moisture levels in your home. As a general rule, the healthy range is 30 to 50 per cent. Mortgage affordability in Toronto: 1985 VERSUS TODAY » by ALYSSA RICHARD

It seems house prices in Canada’s hottest markets will never stop rising, raising the question of mortgage affordability. Consider that the average house price nationwide has risen from $331,000 in 2010 to almost $449,000 today, and the difference is even more pronounced in Toronto. Record-low mortgage rates have led to intense competition for homes, and bidding wars have become commonplace – especially for the city’s limited supply of detached houses – that the average sale price in Toronto is now more than $635,000. This is a stark contrast from 30 years ago. In 1985, house prices were significantly lower, while mortgage rates were in the double digits. Interest rates have fallen steadily since then, but it still seems homes are less affordable today than they were in that era. That’s partly because rising house prices have outpaced income growth. But monthly carrying costs, driven by interest rates, are also a factor. We decided to do some digging to figure out exactly how much mortgage affordability has changed in Toronto over the last 30 years. Let’s start by comparing earnings. While the average family income in 1985 was $31,965,

today’s household brings in average of $74,366. At the same time, however, the average mortgage amount has increased well over five times, from $87,275 to $508,745. Over the same period, mortgage rates have plummeted to record lows. While posted rates of 4.79 per cent are common today, five-year fixed rates as low as 2.48 per cent are attainable. Posted rates from 30 years ago averaging 13.25 per cent seem like a cruel joke by comparison. But even with such low rates, the total cost of carrying a home as a per cent of income is still much higher now than it was in 1985. Factoring in utilities and property taxes, monthly carrying costs (including monthly mortgage payments) are up 170 per cent – from an average of 48.16 per cent of total household income in 1985 to 57.91 per cent today. Of course, these numbers represent the Toronto housing market as a whole. When we take a closer look at the affordability of detached houses and condos, we see two stories. A recent RBC Economics study shows that for a standard two-storey house sold in Q4 2014, 65.6 per cent of gross household income went into mortgage, property tax and heating costs. Compare that with an average of 54.3 per cent since 1985. A standard condominium sold at the same time cost an average of 33.9 per cent of household income to carry, compared at an average of 31.2 per cent since 1985. Predictably, the detached housing market is where the real gap in mortgage affordability lies. For Toronto’s condo owners, the cost of ownership has remained relatively steady.

Canadians expect to pay $60K in mortgage interest It’s a scary question many homeowners are afraid to answer: how much will your mortgage interest total over the lifetime of your mortgage? Well, wonder no more – a recent poll from BMO Bank of Montreal has the answer: $60,000. But that’s the average for Canada overall. Some will pay more, some less. › While the average amount Canadians expect to pay in mortgage interest is $57,938, the figure rises to its highest in Canada for residents in BC at $95,891. Homeowners in Atlantic Canada expect to pay the least, at $35,454 › Canadians expect an increase in interest rates over the next five years (60 per cent), with 48 per cent expecting a small increase and 12 per cent a large increase › Most Canadian mortgage holders (67 per cent) currently hold a fixed rate mortgage, sheltering them against any potential upswings “It’s quite telling of the extended low-rate environment that a sizeable percentage of respondents do not expect interest rates to go up in the next five years,” says Sal Guatieri, senior economist, BMO Capital Markets. “Hopefully, many have not been lulled into thinking that rates will never go up, as they could be tempted into taking on too much debt.” It’s not surprising that British Columbians are paying the most mortgage interest, as house prices in that province are the highest in the country, he says. The average was $623,000 in April, compared with $437,000 nationwide and $456,000 in Ontario. “In any interest rate environment, it’s important that Canadians stress-test their mortgage against a higher rate to ensure they can afford it over the long term,” says Martin Nel, vice-president of personal lending and investment products, BMO Bank of Montreal. 58 NEW HOME GUIDE GTA | JUNE 27 - JULY 25, 2015
AVERAGE AGE OF MORTGAGE FREEDOM INCHES HIGHER
On average, Canadians expect to become mortgage-free by the age of 59 – up from 58 in the last two years. One-third (31 per cent) expect still to be making mortgage payments on their 65th birthday. “Considering a shorter amortization of 25 years or less can help Canadians save thousands of dollars in interest rate costs over the life of the mortgage; this improves long-term affordability, while ensuring Canadians pay down their mortgage faster and begin building equity in their home sooner,” says Nel. TIPS TO BECOME MORTGAGE-FREE FASTER
Think carefully about fixed versus variable: While variable rate mortgages have been a winning strategy over the long term, fixed rate mortgages (currently near historic lows) come with the peace of mind of being insulated against rate increases. Stress-test your mortgage: Gauging the stability of your mortgage by stress testing it against a higher interest rate can help establish a plan to ensure long term affordability. » Raising a cabinet off the ground by a few inches (usually three
to four) is important for giving your feet space to tuck into when working at the counter, but this “kick” space under the cabinet can then be a wasted opportunity for storage. Upgrading to a toe-kick drawer takes this empty space and turns it into a shallow compartment perfect for storing baking sheets, pans, or other relatively flat items. » Other items perfect for storing in a toe-kick drawer: paperwork you need to save but not access often (such as appliance instructions and warranties), a folding stepladder, seasonal dishware, a bathroom scale, art supplies or hidden valuables. » Toe-kick spaces are also an excellent place to store pet food dishes: between meal times the food is stored away to curb overeating, and then simply rolls back out (in a perfect low-tothe-ground position) with minimal effort. Adding legs (or decorative panels that simulate legs) to the base of your lower cabinets creates the look of a more traditional furniture style, for an overall “transitional” effect that feels contemporary but not minimalist. » To enhance this effect, try painting the backs of the toe-kicks a darker shade first, so that the inset recedes and appears much deeper. Across the GTA, it’s been a challenging few years for homebuyers in the face of skyrocketing prices, scarce listings, bidding wars and buyers’ fear of competing with phantom offers. As of July 1, 2015, homebuyers and their agents will find the offer process more transparent than ever, as Bill 55, the Stronger Protection for Ontario Consumers Act, takes effect. Brokerages acting on behalf of sellers will be required to keep a copy of all written offers and each counter offer/ sign-back for at least one year. The successful offer must still be kept for six years. As before, the seller’s broker can make buyers’ brokers aware only of written offers validated with the buyers’ signatures.
The GTA housing market has been so hot for so many years that bidding wars and multiple offers continue to make headlines while the market shows no sign of slowing. After committing months, and in some cases years, to the home hunt and repeatedly losing to the highest bidder, buyers are justifiably frustrated. Understandably, they may wonder how many competitive offers the seller’s agent actually received and how competitive they truly were. “The Ontario government wanted to increase consumer confidence in the bidding process by improving transparency, and that is good for consumers,” says Joseph Richer, registrar, the Real Estate Council of Ontario (RECO), responsible for regulating real estate professionals in the province, and administering and enforcing the Real Estate and Business Brokers Act, 2002 on behalf of the Ontario government. Richer notes that over the past few years there have been only a few complaints to RECO about phantom offers. “The new legislation provides a paper trail that will give consumers additional confidence that the information they are receiving is correct and provides RECO with additional tools to investigate complaints.” ...continued on pg 80

“This is a good starting point and certainly better than what we had before, because it proves there were valid offers, but to really benefit the homebuyer in a multiple-offer situation, prices and conditions also need to be disclosed at the time of the offer, much like an auction,” says Jamie Johnston, owner, broker of record, ReMax Condos Plus, Toronto. The dollar-value of the various bids still remains confidential, but as of July 1, each offer summary must include the buyer’s name/signature, seller’s name and contact information, the time/date the offer was made, the time/date the offer was received, the date of the presentation of the offer, and more. While the buying agents have never seen and still won’t see the hard numbers on the offers, they can and do look at the selling prices of comparable neighbourhood homes to accurately determine a range.

“Most of our buyers are educated and knowledgeable – in fact, they know the prices as well or better than the agents, and are clear on what a particular home is worth to their families,” says Sandra Pate, broker, Royal LePage/Johnston & Daniel Division, who has been representing buyers and sellers in the GTA for 34 years. “Bill 55 sets out hard and fast rules as well as consequences, and as a salesperson, I now know exactly what [documentation] I have to keep and for how long.” As of July 1, 2015, consumers and real estate professionals who placed an offer on a property can contact RECO to determine how many valid offers (written and signed) were received. RECO will contact the listing brokerage to confirm the number of offers received and may ask for supporting documentation for each offer. RECO will disclose only the number of offers received, but will not offer any details. What are the consequences for non-compliance? A brokerage that fails to meet the new requirements can be prosecuted under the Provincial Offences Act, and if convicted, could face a maximum fine of $50,000 and/or a prison term of up to two years. Corporations could face fines of up to $250,000.
