uying a brand-new home offers an opportunity to get what you really want. It can be a dream come true and an investment for the future, but don’t forget, it’s also a legal transaction. The term “get it in writing” has never been more important, since it outlines everything your new home will have in it, on it and around it. Otherwise known as the Agreement of Purchase and Sale, the contract spells out the terms between you and your builder. Without it, if there is a misunderstanding or disagreement, it’s impossible to prove what was originally promised. Since buying a new home is much more complicated than a resale transaction, there is no set Agreement of
Purchase and Sale or standard contract. In some provinces, builders may have standard contracts prepared by the local home builders’ association or their new-home warranty program. Builders often prepare their own agreements, so these can vary from one company to another and from province to province. Before you sign a contract, review it carefully with the builder representative, and ask questions to make sure you fully understand what’s in it. Your next step is to then take it to a real estate lawyer and have it reviewed. Once it is signed, it becomes a legal document, so seeking the services of an experienced lawyer is an important step toward ensuring that your dream home becomes a reality.

hen was the last time you cycled in a velodrome? Or swam lengths in an Olympic-sized pool? Or watched your kids bomb around an internationally sanctioned BMX track? For many GTA residents, the answers are likely “never.” But thanks to the Pan Am Games, you will soon have the opportunity (once the flame is extinguished this weekend) to at least explore such activities. To be sure, we all complained about traffic, road closures and HOV nonsense, but there are some tangible reasons to be thankful Toronto hosted the Games. Maybe not now, but in weeks, months and years down the road. From Welland to Mississauga to
Toronto to Midland, countless improvements took place, from modernizing existing facilities to building new ones to upgrading infrastructure. We could argue that it shouldn’t take hosting such an event to spur this development, but much of this investment would not have been made otherwise. Simple pleasures such as walking or cycling to a park or the lake, to just hung out, read, have a picnic, take a nap or play with your kids... Public spaces are essential – they are part of the very fabric that brings people together, to actually build communities. Pan Am facilities, soon to be turned over for public use, will be a lasting legacy for generations to come.

The Pan American Games close this weekend, and then the Parapan Am Games follow in August. Long after the athletic records have been broken and the medals won, the sports venues will live on as legacy facilities to be enjoyed by local residents. Take the velodrome in Milton, for example, completed earlier this year. The site for cycling events during the Games, the Mattamy National Cycling Centre is one of just two internationally-sanctioned velodromes in Canada. After the Games it will be used as a training facility for cyclists, as well as a recreational facility for the community.
After the Games, the Village will be part of the Canary District – a complete community where people will live, work, shop and play
A considerable portion of funding for the $56-million velodrome came from Development Charges, which were paid by new-home buyers in the Town of Milton as part of the price of their new homes. In addition, BILD member Mattamy Homes provided $2 million in a naming rights sponsorship while the company founder and avid cyclist Peter Gilgan donated $7 million to the project through his foundation. One of the most important sites during the Games will be the Athlete’s Village, which will be a home away from home for 10,000 athletes, coaches and officials. Located near the waterfront, in the evolving east side of downtown Toronto, it features numerous buildings and amenities. During the Games, it will be a complete community for athletes to live, train and have fun when not competing. After the Games, the Village will be part of the Canary District – a complete community where people will live, work, shop and play. Developed by BILD member Dundee Kilmer, the Canary District was awarded our Places to Grow Highrise Community of the Year accolade last year – part of BILD’s annual industry awards program recognizing community developments that best exemplify the Province’s smart growth policy objectives. In addition to serving as the Athlete’s Village during the Games, the Canary District development is transforming a brownfield site into a highly walkable, sustainable, welldesigned community that will feature a range of housing and services for people at all stages of life and income levels. Most of the buildings that will house athletes during the Games, were designed and built as the first phase of the Canary District. They will be complimented by a second phase of condominium residences in the near future. The residential component of the development features a mix of smaller, more efficient condominium suites to preserve density. The suites are configured around courtyards, which results in shallower, wider homes to maximize residents’ access to daylight, fresh air, views and to the outdoors. During the Games, the village will feature special dining facilities to feed hungry athletes. After the Games, the Canary District community will feature lively street – level retail and dining options for everyone to enjoy. BILD members raise more than $60,000 for Habitat for Humanity GTA Members of the Building Industry and Land Development Association (BILD) raised more than $60,000 for its community partner Habitat for Humanity GTA through three major events in just one week. Habitat Week included BILD’s annual Race for Humanity, Charity BBQ and Stephen’s Ride for Humanity. All three took place between July 8 and 13 and members came out in droves to support the cause. “We are proud of our community partnership with Habitat for Humanity GTA and since 2003, BILD members have raised more than $825,000 for Habitat and have helped 12 partner families realize their dream of homeownership,” says BILD President and CEO Bryan Tuckey. “BILD members work hard every day to build complete communities across GTA and this is another way we can work together, with our Habitat partners, to make sure that anyone who wants to own a home, can do so.” During the sixth annual Race for Humanity, 23 teams of members competed in the scavenger-hunt fundraiser around the city of Toronto. Teams had to channel their inner-architect to build a structure taller than the shortest team member, score high at balloon archery and win a sumo wrestling match in a public park. The event, presented by the Toronto Star and In2ition Realty, has been recognized with international awards numerous times since its inception. The Race finish line was at BILD headquarters at the 23rd annual BILD barbecue. More than 500 builders, developers, renovators and service professionals attended the fundraising event on BILD’s front lawn and helped to raise money by participating in the silent auction and balloon burst contest. New this year was a dunk tank, sponsored by YPNextHome, and volunteer BILD senior executives and members helped to raise another $540 for Habitat. Finally, yesterday members gathered at the Canadian Tire Motorsport Park in Bowmanville for the fifth annual Stephen’s Ride for Humanity. The four-km outdoor racing track was ideal for cycling enthusiasts who participated in an open ride, followed by a team relay. Team registrations and sponsors were the key to raising funds for Habitat during this event. “BILD’s Habitat Week is a true testament of their dedication and ongoing commitment to Habitat GTA’s mission of providing affordable homeownership to families living in need across the GTA. Our 12-year partnership has created a profound impact and we congratulate all BILD members on the active support this week and each year,” says Ene Underwood, CEO, Habitat for Humanity GTA. When you’re buying your fi rst home, you are sure to be fi lled with many important questions. How much can you afford? How much will it all cost? Where do you really want to live, and can you afford the area? And, finally, what type of home do you want? The answers are very individual: it really depends on your situation – from the amount of your down payment to where you work to whether you have kids to other personal circumstances. For your enjoyment while you live in your home, as well as for future resale potential, proximity to transportation, shopping, schools and other amenities is among the key determinants that affect your property’s appeal, and ultimately its value. After all, those are the qualities potential buyers look for when searching for a home; the more of them your house has when you go to sell, the more it will be attractive to a greater number of people. While experts suggest you take a long-term view when buying a home, it’s also important to not look too far down the road. Let’s be honest, your fi rst home may not be your dream home, and your needs and desires are sure to change throughout the various stages of homeownership. So, while the answers to the above questions are specific to circumstances, there are also some common guidelines you can follow.

How much can you afford? Experts agree it is never a good idea to make yourself house-poor, and it is a very common mistake, particularly of first-time buyers, to buy more home than you can really afford. Meeting with a mortgage broker or your banker will help determine your full financial picture, assessing everything from your credit rating to how much you have saved for a down payment. Experts also suggest you “stress-test” your plan to see how well you could cope with higher mortgage payments brought on by rising interest rates.

How much will it really cost? Another common homebuyer mistake is not being prepared for all the closing costs involved: lawyer fees, land transfer taxes, utilities, insurance, and home inspection and appraisal fees and insurance. All of these costs add up, and ultimately should factor into your overall home-shopping budget.

Where do you want to live? This
question is becoming more important for a number of reasons, though influenced primarily by where you work, how much of a commute you want and whether your transportation options include mass transit or only driving. Indeed, proximity to mass transit is something more and more people are looking for in their new home location. It may not be as simple as choosing to live in the city, suburbs or a small town.

As we progress further from the financial crisis of a few years ago, economic slowdown, stock market and even real estate declines, things are looking brighter for many Canadians. Canada survived the recession; though there are still some challenges, spending is up, stock markets have arguably rebounded and the real estate market has shown longer-term price and sales increases. Many economists predicted real estate price declines, and few expected price increases and such a quick recovery. Homebuyers who were counting on further price declines may have been kicking themselves. How long will this continue, you ask? It’s anyone’s guess. The federal Finance Ministry has, on occasion, given notice it is concerned about a potential overheating of the real estate market. Borrowers must meet the requirements for a five-year, fixed-rate mortgage, even if they plan to choose a shorter term and lower rate. The maximum amortization
period for government-insured mortgages was recently reduced to 25 years from 30. In addition, Canadians can now withdraw in refinancing only 80 per cent of their home’s value, down from 85 per cent, while down payment requirements remain at five per cent for primary homes and 20 per cent for investment properties. Some experts feel these changes may leave some first-time buyers sitting on the sidelines. However, these issues should not be the primary factors to influence your decision to buy. Some considerations to reconcile before making the plunge include: » How much of a house can you afford to purchase? Get pre-approved by your bank before shopping » How much of a house do you want to afford? The answer is not necessarily to purchase the maximum house you qualify to buy, but what you want to afford » What will your payments be, if interest rates rise (and they definitely will) one, two or three per cent? Ensure you can easily afford the increase » First-time buyers of new homes priced at less than $425,000 will be minimally affected by the HST. Generally, there are no real estate commissions for the purchaser of a home. Legal fees are not usually high for a purchase and are minute in the grand scheme of purchasing a home At the end of the day, a home is a long-term investment, so look beyond the next year or two.

Examine how the rooms are placed and consider the layouts that fit best with your lifestyle. If you like the configuration of a more compact home, go for it. Today’s designs are efficient and smart – and getting in on the new home marketplace in a smaller home is better than not getting in at all. » Act now. I am amazed and delighted that mortgage interest rates in Canada are still historically low, but this will not last forever. To put it into perspective, ask your parents or older relatives what rates they paid 20 and 25 years ago. When you start to hear double digits, you’ll understand why current rates offer you incredible possibilities. Think about the fact that housing prices continually rise, so the earlier you purchase a new home, the sooner your investment will start to increase in value. If you’re reading this and think you can’t afford to buy new, I urge you to avoid that assumption. Get pre-approved for a mortgage, keep an open mind about size and shop for value. Be realistic: unless you’ve won the lottery, your first home will not likely be your dream home, but it can set you on the path to realizing that dream in the future. When it comes to buying your first home, a little common sense goes a long way to ensuring that you get the most for your dollars and cents!

Toronto is one of the “hottest” cities in the world among the rich and famous looking to purchase real estate. According to Christie’s International Real Estate, the luxury housing market here saw a staggering 37-per-cent surge in purchases from so called “high-net worth” individuals in 2014. Toronto was tops for growth among desirable urban destinations from more than 80 global markets examined by Christie’s. It was capitulated into the Top 10 “Best of the Best” cities in the world along with Dubai, Hong Kong, London, Los Angeles, Miami, New York, Paris, San Francisco and Sydney. What do you need to know about purchasing property in Toronto? First and foremost, there is no restriction on foreign individuals purchasing property in Canada, unless it affects the national interest. Let’s take a closer look: TAX TREATIES
Depending on your country of residence, there may be an international tax treaty in place with Canada. In this case, there will be provisions governing the effect of income earned on rental and sale proceeds of property in Canada. This translates to withholding tax and other questions, and allows you to avoid double taxation. This also allows you and your advisers to properly plan and structure your transaction. LEGAL STRUCTURES
There are various legal structures available to foreign investors in Canada: » Real Estate Investment Trust – a trust established to consolidate capital for the purpose of real estate investment » Joint Venture – these are advantageous due to flexibility in allowing for varied and non-proportionate sharing of profits » Partnership, Limited Partnership » Corporation » Personal Ownership BEING TAXED IN ONTARIO

Tax treaties between Canada and the UK make Canada an attractive investment prospect for UK developers. Double taxation treaties mean that subject to certain criteria, investors will not be taxed on income gained in one of the contracting states. If tax rates are different in the two countries, you get credit for tax paid, and an adjustment if the tax in your home country is less than where you are earning the income. A company resident in Canada which receives income from interest, royalties, pensions or purchased annuities from UK sources may be able to apply for relief from UK tax and vice versa. With the benefit of double taxation treaties, companies can take advantage of the booming real estate market in Canada.

Price gap between lowrise and highrise continues to widen » by LYDIA MCNUTT The price gap between new lowrise and highrise homes in the GTA has broken a record, again. This, after hitting a 10-year high in April – an indication that demand for lowrise is outstripping supply, according to the Building Industry and Land Development Association (BILD). The price difference between lowrise and highrise in the GTA is now a staggering $343,492. Just one year ago, that gap was over $100,000 less, at $237,301. “As the price of ground-related housing continues to grow at a record pace, it’s becoming increasingly difficult for GTA residents to afford a lowrise home,” says BILD president and CEO Bryan Tuckey. The average price of a lowrise home (detached, semidetached and townhome) reached $783,955 at the end of May – up 16 per cent over May 2014, and an increase from April when the average price was $775,419. Meanwhile, highrise homes saw a slight dip in price month-over-month, averaging $440,463 in May over
$448,760 in April. As Tuckey notes, these prices are reflective of availability. At the end of May, there were 5,198 new lowrise homes available for purchase across the GTA, representing just 20 per cent of total new-home inventory in the region. That’s a lot of condos up for grabs. “The effect of new-home pricing is also trickling down to resale homes, which is something that affects all homebuyers,” Tuckey adds. “As inventory borders on record low level, we need an adequate supply of lowrise homes to ensure healthy levels of housing choice that are necessary to accommodate the needs of our expanding region.”

What will Bank of Canada’s interest rate cut MEAN FOR THE ECONOMY, HOUSING AND YOU? » by ALYSSA RICHARD

On Wednesday, July 15, the Bank of Canada (BoC) announced it would cut the target for the overnight lending rate by 0.25 per cent to 0.50 per cent. This was just the second such rate cut since 2010, with the BoC most recently cutting rates by a 0.25 per cent margin this January. January’s rate cut came as a surprise to many, but this most recent move had been anticipated in the weeks leading up to the announcement. Lower oil prices have led the Canadian economy into a slump, prompting debates over whether we are in a recession. That argument has mostly come down to the definition of the word – a recession is technically defined as two consecutive quarters of negative GDP growth. The BoC was careful not to use the R word in its announcement, but acknowledged the economy is underperforming and an interest rate cut was necessary to “help return the economy to full capacity and inflation sustainably to target.” The rate cut has mixed effects, however. Last month, BoC Governor Stephen Poloz compared January’s rate cut to “life-saving surgery,” noting that the positive benefits outweighed any side effects such as increased levels of consumer debt. Since mortgage rates are closely tied to the BoC’s overnight rate, the housing market will also be affected. In Toronto and Vancouver where prices have been skyrocketing, rate cuts are only making the situation worse, putting ownership further out of reach for first-time homebuyers. Prior to the announcement, it was unclear whether a rate cut would, in fact,
be another cup of coffee for an already overstimulated housing market. But in the hours following the announcement, it became clear that homebuyers were eager to take advantage of lower mortgage rates. Traffic to ratehub.ca surged 300 per cent as Canadians searched for better mortgage deals in the hours following the announcement. Mortgage brokerage Butler Mortgage lowered its five-year variable mortgage rate by 0.10 per cent almost immediately, to 1.88 from 1.99 per cent. The drop translates to $1,320 savings in mortgage payments over a five-year term. TD was the first of the major banks to lower their prime rate, cutting it by 0.10 per cent the day as the BoC announcement. Within a day, many banks had lowered their prime rate by 0.15 to 2.70 per cent. Some remain unconvinced the cut will do enough for the average Canadian to save any money, or stimulate the economy. Others worry the impact on the Toronto and Vancouver housing markets would increase disparity between those hot markets and the rest of the country, where real estate has been relatively stable. So what does BoC’s latest announcement mean for you? If you have a variable rate mortgage, you can expect to save a few dollars a month when your interest rate drops. Interest rates on other variable rate loans (such as lines of credit) are also likely to drop, freeing up some cash. If you’re shopping for a house, your overall affordability will likely increase due to lower mortgage rates, but you may find that higher house prices quickly negate any advantage you might have had. We’ll have the summer to find out what effect the cut has on the housing market and the economy as a whole. The next rate announcement is Sept. 9.

Kylemore Communities opens new corporate offices in style Luxury home builder and land developer Kylemore Communities recently celebrated its move to new corporate offices by hosting an upscale opening party complete with live music, DJ, food, drinks and entertainment. Invited guests included politicians, trades and suppliers, retail tenants, consultants who were thanked by president Patrick O’Hanlon for their loyalty and support over the company’s 18-year history in Markham. Guest of honour, Mayor Frank Scarpitti congratulated O’Hanlon, Cailey Stollery – president of Angus Glen Group of Companies and Angus Glen Golf Club, and the Kylemore team for their contribution to the City of Markham’s vitality and for continuing to raise the bar as creators of award-winning communities.
The new 10,000-sq.-ft. space spans the entire second floor of a building in the company’s commercial plaza – The Shoppes of Angus Glen – at the southwest corner of Major MacKenzie Drive and Kennedy Road. Office interiors reflect the same attention to detail and materials of the highest caliber that Kylemore includes in its $1-million homes and luxury condominiums. In his remarks, Patrick O’Hanlon recalled Kylemore’s history of building in Markham and many other areas, from its base within its flagship Angus Glen Community. He shared his optimism for the years ahead when the lands on the north side of Major MacKenzie are approved for development, York Downs Golf Course transitions to a residential neighbourhood, and Langstaff Gateway masterplanned development gets underway. Kylemore Communities is the recipient of the 2014 Markham Design Excellence Award for Angus Glen Community, which was also awarded the Building Industry and Land Development (BILD) Association’s 2013 Places to Grow Community of the Year Award.

Canadians choose the cottage over city getaway Âť by OLIVIA BOWDEN Canadians may be looking to trade in those plane tickets for a long weekend up north, according to a new survey from ReMax. When given the option, Canadians choose the cottage. The 2015 ReMax Recreational Property Report showed almost 68 per cent of Canadians were in favour of spending their weekend at the cottage or cabin, as opposed to a big-city getaway. Canadians were also willing to make sacrifices to afford their dream recreational property, with 21 per cent responding they would downsize their current home to afford a second one. Recreational property markets across Canada are seeing the benefit of the low Canadian dollar, which is motivating Canadians to keep their spending within the country. Some Canadians are also following
a trend of selling their U.S. recreational properties, which may have increased in value since the 2008 recession. The report highlighted price appreciation in some recreational property markets year-over-year including an increase in sales. Markets such as Muskoka, Whistler, Peterborough and The Kawarthas, Haliburton and Wasaga all saw a rise in median market prices, with Peterborough and The Kawarthas experiencing a 27.9-per-cent increase. The explanation for these increases is a hike in sales in the upper-end of the market, with GTA buyers looking to less developed areas such as Stony Lake and Clear Lake instead of Muskoka. Looking to the east and west coasts of the country, the low price of oil has had some effect on markets where many purchasers are oil industry employees. However, some Newfoundland waterfront properties outside of St. John’s are seeing steady sales giving the market a fair start. According to ReMax, the buying market for recreational properties this season has begun strong and is expected to continue into the summer due to low interest rates and high demand.

A grand day at Angus Glen Golf Club Hundreds turned out to cheer the arrival of the official Pan Am Flame on Saturday, June 27 carried by Cailey Stollery, president of Angus Glen Golf Club, who arrived in a golf cart driven by Olympian Nicole Forrester. City of Markham Mayor Frank Scarpitti, shared his thoughts on the significance of the day and congratulated Angus Glen Golf Club on its selection as Host venue for the 2015 Toronto Pan Am Games. Golf makes its Pan American debut in 2015, prior to re-joining the Olympic program, after a 112-year hiatus, in Rio in 2016. A beaming Cailey Stollery remarked “Angus Glen Golf Club is proud to be playing a role in bringing the world to Toronto, and being part of the excitement that surrounds this world-class event.” Cailey passed the torch to Lindsay Knowlton, three-year member of the Canadian Women’s National Golf Team. Immediately following the Flame’s arrival, Cailey and Mayor Scarpitti were joined by Markham councillors; Patrick O’Hanlon, president Angus Glen Development/Kylemore Communities; Doug Erwin, head superintendent Angus Glen Golf Club; Phil Marcoux, project
Angus Glen Golf Club manager; and members of the Stollery family to Officially cut the ribbon to open the newly renovated South Course, where Pan Am Golf began July 16. Angus Glen Golf Club is the only golf club in Canada to host a national Championship on each of its golf courses (2002 Canadian Open on the South Course and 2007 Canadian Open on the North Course). The Club has also been host to 2001 BMO Women’s open, 2001 Telus Skins Game and the 2014 World Junior Girls Golf Tournament. In 2015, Angus Glen Golf Club celebrates its 20th Anniversary; completion of the $6 million renovations on the south course, hosting Pan Am Games and the opening of its new Nike Pro-Shop – the first of its kind in Canada.

Moving into a new space can be a fantastic experience, as you can start your design dream from scratch! That being said, it is sometimes difficult not to have a space that truly reflects who you are and your personality. Additionally, with the cost of moving into and purchasing a new home or condo, it may be difficult to completely outfit your entire home. Since the average person spends 25 years sleeping throughout their life, the master bedroom is where you will spend the most time in your new home. When you love your bedroom, you will sleep more peacefully, and generally be happier. Therefore, the master bedroom should be where you invest your first dollars in your new home. When decorating your new digs, start with the colour. All builders have different rules pertaining to the paint they use in the house before handing it over. If given the
opportunity, have the painters paint with the colour and paint you would like to keep. If you are forced to choose between several shades of “builder beige” prior to moving in, make sure painting the bedroom takes priority. To choose a colour, first decide what type of feeling you want the room to have. If you want to be dramatic, pick a bold, deep colour. If you are looking for a “peaceful getaway,” pick a calming blue or green. Next is the bed. It is so very important to invest in a good mattress. A continuously restless sleep can lead to

so many negative detrimental side effects. Once this has been taken care of, is it time to tend to the bedding. Everyone has different needs when they are sleeping, some people like to be cool and others are always cold. Make sure you purchase sheets, duvets and comforters that will keep you comfortable while you sleep. Now it is time for style. Depending on the budget, the bedding can be purchased or custom made from materials specifically picked to complement the paint and feeling of the room. This also gives a new homeowner a chance to

purchase fabric for the window treatments. Window treatments are another place that needs special treatment, especially in a new space. A good deep sleep often depends a dark room. Lack of light will send a signal to the brain to shut off and go to sleep. You can achieve this by using blackout blinds or shutters and then layering these with coordinating fabric that complements both the bedding and the wall colour in a style that suits the feel of the room. To finish off the new space, add artwork and accessories. This is where you will have an opportunity to inject personality into your new space. Look at accessories as the vehicle to really convey the feeling of the space. No matter what theme you are going for, accessories will carrying this feeling and create continuity throughout the space.
