Next year looks stable, if somewhat challenged, all things considered
I
t’s certainly been an interesting year, 2013. At press time, the U.S. economic recovery is gathering steam – boding well for the Ontario economy, especially – Canadian interest rates remain at historic lows but are expected to inch up over the coming year, and the housing market continues to hold its own. RBC Economics Research, meanwhile, says homeownership affordability became increasingly challenged in some markets in the third quarter of this year, and Canada Mortgage and Housing Corp. forecasts that 2014 will be stable. And, importantly, Canada’s economic fundamentals remain strong and supportive of housing demand. Indeed, against the backdrop of what’s going on elsewhere in the world, and prognostications for steep declines in the housing market, Canada’s performance in 2013 is worth celebrating. With smart fiscal policy and prudent lending practices – and awareness of key market fundamentals by Canadian homebuyers – here’s to more of the same in 2014.

Up-to-date zoning by-laws needed for Ontario’s changing growth

Places to Grow legislation was a game changer for how the GTA builds its cities and towns. The 2006 growth plan lays out the province’s vision to manage and promote growth in the Greater Golden Horseshoe until 2031. It is an important time for this discussion. We’re in the midst of an 80day consultation with Ontario’s Municipal Affairs and Housing Minister Linda Jeffrey about what changes should be made to the land-use planning and appeals system. The minister wants input on what can be improved from the public. Zoning bylaws should be part of that discussion, and here’s why. To accommodate the 100,000 people and 50,000 jobs that come to the GTA every year, the province encourages intensification, or the construction of new mid- and high-rise homes. That’s often more easily encouraged than done: while high-density construction is underway all over the GTA, most municipalities do not update their zoning bylaws to permit the construction of all forms of development. Without proper zoning, this can cause months or years of delays in construction. What some of you may not know is that our industry is one of the most regulated in the province. Every new development introduced into a community undergoes a rigorous, multi-stage government approval process that can last up to 10 years. And who pays the price of long waits and added costs? Newhome buyers. I’m afraid that NIMBYism is a big factor in preventing zoning changes. NIMBY stands for “not in my backyard,” a term that describes those opposed to new development in their neighbourhood. NIMBYists often complain about a potential increase in noise or traffic, new people joining the community or just a general fear of change. We need to plan for change, not fear. While the province mandates that municipalities’ official plans are reviewed every five years and are expected to be updated, there’s no such mandate for zoning bylaws. And it’s difficult to set course for that new vision of building complete communities when many zoning bylaws around the GTA date back to the 1980s and 1990s, with some even from the 1950s. 14 NEW HOME GUIDE GTA | DEC 7, 2013 - JAN 11, 2014
It’s not a situation that can be remedied easily, but our cities and towns can pre-zone lands where intensification meets the vision of the provincial plan. As a result, new development and construction avoids a long holding pattern: a builder doesn’t have to go through several development applications, or apply for a zoning bylaw application which can be a very political process.

investment you ever make. Think about that... Why, you ask? The answer is that in my 35 years of practicing law, I have seen young couples spend more time researching a new telephone than a new home! The most important advice I can give, and if you take anything from this article, it is this: research everything ahead of time, such as prospective builders, areas, amenities, property taxes, lawyers, your financial ability, zoning, bylaws and neighbours. And don’t allow yourself to be pressured by anyone. WHAT CAN YOU AFFORD?
Review your available cash for deposit and annual income to pay a mortgage and expenses. Once you have done that, speak to the mortgage specialists at the bank you deal with and speak to a reputable mortgage broker. Companies such as the Mortgage Centre in Mississauga and Mortgage Providers in Toronto have the experience and integrity to get you the best deal. Find out how much money you can borrow and how much of a deposit you’ll need to put down. This will allow you to focus on homes you can afford. Get a pre-approval in writing so you have something to rely on, because especially today, it is critical that you do not get caught up in the rush of buying a house that is beyond your budget.

Condo living provides a carefree lifestyle – someone else cuts the grass and shovels the snow – but you pay additional monthly common expenses and sometimes others determine how the amenities, if not your unit itself, can be used. Freehold provides the freedom to do what you want, but maintenance and upkeep fall on your shoulders. The choices are boundless. Once you determine what kind of home you want, you need to decide new or resale. If new, the offers are long and filled with clauses that could cost you money or result in long delays. Be sure to see an experienced real estate lawyer familiar with these kinds of agreements before it is final and no longer conditional. Research the builder and go to other sites the company has done and ask people about quality and after-sales service. FIND THE RIGHT LAWYER

Do you have a will? If you do, is it up to date and does it represent your current situation and state of affairs? A will prevents sibling disputes, clarifies who will look after children, keeps the government out of your affairs, allows for an orderly disposition of everything from possessions to your realty, stocks and bonds, and will help guide your funeral arrangements. You will also need insurance for the home. This is the right time to look at life and disability insurance, to determine if you should be insuring your mortgage in case something happens to the major wage-earner. As you can see, there is a lot to consider when buying your first home. Being prepared will help you enjoy the experience and find that dream home.

Recipient agencies are Blue Door Shelters, Yellow Brick House and Sandgate Women’s Shelter. Patti Bell, executive director of Blue Door Shelters, and Lorris Herenda, executive director of Yellow Brick House, received their donations at the Neighbourhoods of Cardinal Point Sales Centre, where Geranium Homes is now selling the sixth Phase of this master-planned ravine community in Stouffville. “This gift is quite unexpected, and we are grateful to Geranium Homes and Pace for this practical and timely donation,” says Bell. “Thanks to you, many clients of our three Blue Door Shelters will receive a new pair of red mittens providing them warmth this winter.” Says Herenda, “At Yellow Brick House, the women and children that flee violent homes, often do not have any possessions. As the cold winter months approach, we turn to our community for support. Celebrating 10 homes in 10 years: BILD MEMBERS RAISE $20,000 FOR HABITAT FOR HUMANITY TORONTO

THE BUILDING INDUSTRY AND LAND Development Association’s (BILD) fifth annual Party for Humanity raised more than $20,000 for Habitat for Humanity Toronto as the industry celebrated helping 10 Habitat families into 10 homes in 10 years. The event was attended by more than 400 industry professionals, who arrived at Muzik nightclub at Exhibition Place in Toronto, dressed according to the theme: jeans, jackets and jewels. Fundraising efforts were aided by a silent auction and raffle. Those who entered the raffle were given gold, red and green beaded necklaces. “This event has been a tremendous success every year, and this year was special because we’ve helped build 10 homes in 10 years with Habitat for Humanity Toronto. THE HOLIDAYS ARE A WONDERFUL OPPORTUNITY TO SEE OLD friends, enjoy time with family, celebrate the events of the year past and dream about the year approaching. But it’s also hectic – with shopping, wrapping, travelling, entertaining and cleaning up after it all. The worst thing that can happen is to wish it all away, thinking you’ll be happy when it’s all over. It’s a lot of work, but the little things that help keep you organized – and sane – will put the pleasure and joy back in this time of year.
QUICK TIPS ON ORGANIZING YOUR HOME
›› C reate a gift-wrapping zone. Save time and make wrapping presents a pleasure by transforming a spare room (or part of a room) into a gift-wrapping centre for the holidays. Set up a table or use a rolling cart to put out your supplies (gift wrap, scissors, tape, pen, cards, bows) and keep everything you need in one place. Create the right atmosphere by adding some festive music, a scented candle and a cup of hot chocolate to get you into the holiday spirit. ›› S tore items near their point of use. Save steps and precious time by storing things close to where you use them. For example, save yourself a trip up the stairs to the linen closet by keeping your tablecloths in a drawer, cupboard or chest in the dining room. It makes entertaining a breeze! ›› R epurpose your gift-wrap tubes. Use your empty gift-wrap tubes to store mini-lights. Put a slit in each side of the tube. Insert the plug at one end and wrap the cord all the way around the tube, tucking the bottom of the light strand in the slit at the other end. Store the tubes in a garment bag hanging from a hook on the wall, or the ceiling in the basement or garage. ›› R un errands efficiently. Keep a collapsible crate in the trunk of your car for easily transporting items to a dinner party or for things to return like library books or store-bought items you want to take back. It folds out of the way quickly when not in use. ›› G et unplugged to create more time over the holidays. Do you feel like there’s so much to do and so little time? Challenge yourself to unplug the TV for one full week and notice how much more you can do in all the free time you’ll have.

›› L et go of the excess – you don’t have to keep decorations forever! When you are unpacking your holiday decorations, consider letting go of the items you no longer enjoy looking at. Our tastes change and styles come and go. There’s no rule that says you have to keep every decoration forever – especially that tacky plastic flower arrangement your ex-mother-in-law gave you 20 years ago! Give some away to charity, or if you have family or friends who have recently moved into their own place, ask if they’d like to have them until they accumulate their own collection.

›› G ift certificate? What gift certificate? Gift certificates are easy to give and great to receive, but are often lost and forgotten until they expire. Whether it is buyer’s remorse or dissatisfaction with an item after we’ve brought it home, we all have things to return to the stores at some point – especially after the holidays. A problem arises when these “to be returned” items accumulate in every part of our home and we forget we have them. Most store return policies allow only seven to 14 days for a full refund. To recoup money and reclaim space, designate a small area (preferably near the exit you use most) to place things that are on their way out. A box or basket may be helpful if you have several items. Tape the receipts to the purchases and schedule a time in your planner to take them back before it is too late. ›› P ay yourself first. Block time now to give yourself a break later. Choose a day (or at least half a day) during the holidays to do what’s fun for you. You can spend it skating, relaxing at the spa, or taking in a movie. The important thing is that you feel renewed and refreshed because you gave the gift of pleasure and relaxation to yourself. QUICK TIPS ON ORGANIZING YOUR HOME OFFICE
›› S end greetings without grief. Do you love sending holiday greetings but don’t enjoy wasting time addressing the envelopes? Easily create address labels on your computer for your cards using MS Word. For a special touch, use a font that resembles handwriting (such as Lucinda Calligraphy). Save the document and you can pull it up every year, make any changes and print it on adhesive mailing label sheets. Better yet, send electronic greetings and you’ll reduce clutter while saving time, money and the environment. QUICK TIPS ON ORGANIZING YOUR LIFE
›› A void holiday overload. Limit social engagements to only those you truly want to attend. Book some downtime between social events so you don’t feel overextended. Schedule only 75 per cent of your day to allow for traffic delays, long line-ups and other unexpected occurrences.

The buying process –

THROUGHOUT THE COURSE OF THE YEAR, WE’VE
explored various aspects of the new home buying experience. We’ve looked at choosing a home in the community that’s right for you, your experience in the sales office and what you should look for in the features, finishes and amenities available both inside your home and within your community. When purchasing a new home – whether lowrise or condo – homebuilders are involved well before you choose that new home, through to the end of the Tarion New Home Warranty period. Let’s assume that you’ve selected a home you love with all the bells and whistles you need. You’ve been pre-approved for your mortgage, retained a lawyer and signed the necessary paperwork. Now what? Your next major milestone will be when you select your interior finishes. The colour selection appointment allows you to choose from among standard and optional upgrade features and finishes that suit your personal taste and lifestyle. Next would be the steps that lead to occupancy, in the case of a condo – or the closing date, in the case of a lowrise home. This begins with ensuring that all required deposits have been paid and you are ready to finalize the deal, whether it’s your cash or with a mortgage. These tasks are usually done in consultation with your lawyer. Around this time, you can expect your builder to contact you to set the date for your Pre-Delivery Inspection (PDI). This official inspection is your chance to take a close look at all the workings of your home, to ensure that everything is the way it should be. Typically, you should receive your Homeowner Manual at the inspection. The PDI is also your opportunity to ask the builder’s representative about the care and maintenance requirements of your new home. The PDI is the review of your home’s interior (both condo and lowrise) and exterior (in the instance of lowrise only). Condo exteriors and amenities are dealt with in the Performance Audit. The PDI is also your opportunity to ask the builder’s representative about the care and maintenance requirements of your new home. and extras have been installed, this is also your chance to make note of any superficial damage to finishes – an important step before you move in. For example, if you find a scratch on your countertop or in the hardwood flooring, now is the time to make note of it. Tarion will cover you for warrantable deficiencies, and the onus is on you to list even the smallest details during your PDI, in order to confirm what’s covered. Some may think that this is the end of your experience with your builder, but that’s definitely not the case. HOW HOME EQUITY CAN BE A KEY PART OF YOUR AND
your family’s financial future by PETER KINCH DOES REAL ESTATE PLAY A ROLE IN CANADIANS’
financial plan and/or should it play a more important role? As we grapple with ongoing concerns about taking on more debt, there are a few other realities that cannot be ignored: 1. Canadians are sitting on an unprecedented amount of home equity 2. A lthough many may be “house rich,” they have growing concerns about their financial future and that of their children. Can your home equity be part of the solution? Let me share the story of a client of mine – we’ll call him Dave. Dave is in his early 40s with a house and young family, works in a great industry with a well paying job, but like many Canadians he has concerns over long-term job security along with his long-term pension needs. He has allocated some savings to his RSP and other investments, but has decided that buying one or two rental properties would be a great way to supplement his current pension. Of course, a big question was affordability. Since Dave lives in a suburb of Vancouver, a greater concern was the inability to find a positive cash-flowing investment property, given the high cost of housing where he lives. I suggested that he review his family budget. We looked at how much money he could afford to invest on a monthly basis over and above what the family was currently spending. His answer was between $300 and $400. How can anyone afford to buy a property with only $300 or $400 a month?, you may ask. Let’s consider the following: Let’s assume we chose a conservative long-term investment vehicle – a bond, GIC, mutual fund, stock investment – whichever you prefer. It would likely look something like this over a 20-year period: ›› $300 cash (out of pocket/part of your family budget), every month for the next 20 years ›› Total cash out of pocket invested over 20 years = $72,000 ›› Value of the $72,000 invested over 20 years = Depends on the average annual rate of return, but if you were lucky enough to earn an annual average of eight per cent, you would have between roughly $164,000 and $178,000 to add to your pension
Remember, these calculations were based on the fact that: a. Dave feels the need to supplement his current pension with an investment, and b. He is willing to invest at least $300 a month for the next 20 years out of the family budget Now let’s take a different approach to looking at real estate as an alternative option. Dave, his wife and I sat down and analyzed the following: ›› Dave currently has a home valued at $600,000 ›› T he mortgage is $290,000 ›› Dave will qualify to refinance the home to 80 per cent of its value = $480,000 ›› Potential new mortgage – existing mortgage = potential accessible equity. In Dave’s case, this is $190,000 ›› I don’t want Dave or his wife to feel that they are over-leveraged, so we’ll only use $100,000 of the accessible equity ›› We set up a new mortgage/line of credit on their home based on 65 per cent of their house value, an amount both Dave and his wife are comfortable with ›› T his structure provides Dave with $100,000 of “investable capital” from his home equity ›› Dave can use the $90,000 as a down payment on a $400,000 rental property and keep $10,000 from the LOC to place in a contingency fund You may be saying that this is going to cost a lot more than $300 a month. Just the interest alone on the down payment of $100,000 is more than $300 a month. The answer to this is Yes and No. When buying an investment property, the down payment is typically considered the main expense. However, Dave and I analyzed the true out-of-pocket expense of making this purchase. The first thing you have to realize is the fact that real estate, unlike many other investments, has the potential to create revenue. The amount of monthly rent you can get for a $400,000 purchase will vary greatly depending on the city, so we’ll try to be conservative with the numbers we use. Remember, Dave was willing to invest between $300 and $400 per month additional money out of the family budget. So let’s break this investment down to see what the true monthly cost is. Let’s assume a monthly rental income of $2,000 (which is very possible in many parts of Canada) ›› We would access $100,000 from a line of credit on the principal residence ›› We would take $10,000 of that and set it aside in a “contingency fund.” This is equal to roughly five month’s rent. ›› We would have a new first mortgage on the rental property for $310,000 Monthly Expenses: ›› Interest on the line of credit taken out on the home = $334 (based on rate of four per cent) ›› Interest on new first mortgage on rental property = $1,390 (based on a five-year rate @ 3.5 per cent with a 30-year amortization) ›› P roperty taxes = $140 ›› P roperty insurance = $100 ›› P roperty management (eight per cent of rent) = $160 ›› C ondo/strata fees (if applicable) = $200 $2,324 Assuming Dave’s first purchase had the above scenario, he would find himself subsidizing this rental property by about $324 a month. Conventional thinking would say that Dave is “losing” $324 a month on this investment – but I would like to challenge that thought process. Again, assuming the above scenario, the only amount of money that would actually be coming out of Dave’s family budget in order to make this investment purchase part of his long-term financial goal is $324 a month. Remember, the key here is to realize that even though Dave and his family are making a down payment of $90,000 to buy this property, the only actual money that is being spent out of their family budget is the difference between his total monthly expenses and the amount of revenue the property is generating every month. Based on the above assumptions, the purchase of a $400,000 investment property that has a shortfall of less than $400 a month, fits into Dave’s investment, long-term planning and budget criteria. It may seem counter-intuitive to suggest that an investment that loses money every month is a good thing, but let’s take a closer look: ›› Assuming that the property has to be subsidized by $300 a month every month for the next 20 years. ›› $300 x 12 months x 20 years = $72,000. This is the same amount of total invested money that we discussed in our earlier example. Now, let’s see what the end result could be if Dave keeps this property for the next 20 years and pays off the mortgage: ›› I’m going to be very conservative and suggest that the value of his property is the exact same in 20 years = $400,000 62 NEW HOME GUIDE GTA | DEC 7, 2013 - JAN 11, 2014

›› Dave and his wife would have a $400,000 asset ›› Let’s assume that the rent stays the same in 20 years (that’s not realistic, so we’ll keep the expenses the same for argument’s sake) ›› Rental income = $2,000 ›› Non-mortgage expenses = $1,000 (I’ve allocated some extra to pay off the remaining LOC on the principal residence which was used for the down payment) ›› Net income = $1,000 a month The simple comparison is quite startling: ›› You have an alternative investment of $300 a month at an eight-per-cent annual rate of return over 20 years, which = roughly $178,000 with potentially no cash flow or income OR ›› You have the exact same investment of $300 a month for 20 years in an investment property valued at $400,000, which equals a $400,000 asset with $1,000 per month net revenue Many would-be investors have been scared off from purchasing real estate in major centres such as Vancouver and Toronto out of fear or concern that the investment would have a monthly shortfall. What if we re-labelled the term “negative cash-flow” and instead saw the monthly shortfall as your long term “investment capital”? All you need to do in order to make a sound investment is to determine the maximum amount of “investment capital” that your budget could afford each month and that would act as a filter when shopping for the right property to fit your needs. Keep in mind that in many parts of Canada, a $400,000 investment would actually create a “positive cash flow,” which makes the potential returns virtually infinite. The purpose of this article is not to convince you to buy investment real estate, but to at least think about it. Too many Canadians are passively handing their savings over to investment advisors in hopes that their financial goals will be met. When it comes to wealth management in this country, real estate can and should play a bigger role. Dave and his wife realized this potential and made a choice that will positively impact their financial future.

They loved their home; unfortunately they can no longer maintain it on their own. We can financially and physically help them in their senior years. Can we deduct the money we give them for living expenses? Where and how on our tax return? Ron and Beth, Richmond Hill

The Baby Boomer generation may have to put condo living on hold for several years. Many boomers have the financial responsibility of not just university kids but aging parents too. Our generation (myself included) is blessed with having the people most close to us at home – children and parents. Unfortunately, neither Ottawa nor Ontario provide a deduction for your financial assistance. However, they do provide a “caregiver” tax credit. You may qualify to claim a $4,223 federal tax credit and a similar provincial amount. This will reduce your federal and provincial income taxes by $633 and $210 respectively. You should note, parents must be at least 65 years old and mentally or physically dependant on adult children.

My kids attend pre-school and elementary private institutions. The cost is astronomical but my wife and I believe it is best for our kids. How much of the tuition may I deduct and how? Wong, Markham

Generally, private school tuition is not tax deductible. An attempt was made several years past to deduct private school tuition; however it was politically unpopular and was reversed the following year.

Generally, real estate that is sold for more than its cost may result in a capital gain for the individual. Fifty per cent of the gain must be included in your income tax return in the year of sale. Using your figures and assuming you have other income, such as from employment, we can use a 40-per-cent tax rate. Therefore, the $80,000 capital gain is reported. Forty thousand (50 per cent of the gain) must be included in income. This is taxed at 40 per cent. Your tax obligation on the gain is $16,000 (40,000 x 40 per cent) to Canada Revenue Agency. Consult your accountant/tax advisor before committing to pay any income taxes.

Lowrise sales push October

from October 2012, and highrise sales were up 17 per cent in the same period. Combined, new-home sales rose 32 per cent from October 2012. According to RealNet Canada Inc., BILD’s official source for new-home market intelligence, the pricing index – or the average asking price of available inventory excluding the extremes – for low-rise was among the factors for the jump as it dropped 0.6 per cent from September to October. While October was a strong sales month, the year-to-date figures are still the lowest total in 10 years. The January-to-October sales were down 19 per cent from the 10-month period in 2012, and 26 per cent lower than the 10-year average. The decline is attributed to a significant reduction in land supply for low-rise housing, resulting in near-record low inventories and near-record high pricing. “Constrained land supply has caused land prices to increase dramatically over the past decade,” says BILD president and CEO Bryan Tuckey, explaining the 10-year low in year-to-date sales. Supply of new homes for the January-to-October period (25,491 units) is down 27 per cent from 2012 (35,006). “Builders are being much more careful about how much and when they’re launching high-rise projects,” Tuckey adds. “Restrictive land policies are keeping low-rise supply low. That’s what we’re seeing in these new numbers.” As for the remaining inventory, there were 31,425 units on the market by the end of October, up 2.1 per cent from September. Meanwhile, the RealNet new home price index showed the average cost of a low-rise home in the GTA was $655,237 for October, up 6.3 per cent from October 2012. The cost of a highrise unit stands at $432,825, a 1.5-per-cent drop from 2012. The current price gap between low- and highrise is $222,412, the second-highest on record (the highest came last month: $226,016). “Near record high pricing has pushed the costs of ground-related housing beyond what people can afford to buy in the GTA,” Tuckey says.

IN EARLY NOVEMBER, STAFFORD HOMES proudly launched its sales centre for Elements Townhomes with an official ribbon cutting. Stafford was especially honoured to have Councillor Renrick Ashby and his wife in attendance along with the many consultants and development team. Master of Ceremony Michael Mestyan introduced Gary Goldman, President of Stafford, to say a few words. It was interesting to hear his recollection that there was a history of new home development in Ajax by his family many years ago. Now they are happy to be building again in this great community! Councillor Ashby thanked Stafford for developing such a beautiful project in his community. He presented Stafford with a “Certificate of Welcome” on behalf of the mayor and council of the Town of Ajax. Once the councillor cut the ceremonial ribbon and the photo session had taken place, guests were invited to refreshments and to browse the marketing displays.
