Damages to a Building The non fulfilment of obligations by builders or their agents requires determining and specifying what their obligations are. Such obligations of course are clearly obvious and also regulated; however, there are some grey areas where it is not clear whom the responsibility lies with. Starting from the date of construction or repairs to a building, any material damages caused to the building by individual builders or building legal entities are liable to the owners and to third parties who may have purchased the building or part of it in proportion. The summary of damages entitled to compensation are as follows: • Damages caused by imperfections or defects to structural elements which directly compromise the resistance and stability of the building. - This refers to material damages caused by imperfections or defects that affect the foundation, the pillars, the beams, the wrought iron, the load-

bearing walls and other structural elements that directly compromise the stability of the building. • Non-fulfilment of the habitability requirements - These are the material damages caused to the building by imperfections or defects of the construction materials or installations which result in the non-fulfilment of the habitability requirements under art. 3.1 c) LOE. In contrast to what occurs with the damages caused by structural defects, habitability is not solely related to the building itself, it is also related to any fixed installations, equipment and urbanisation elements assigned to the building. • Damages caused by imperfections or defects in the execution of the finalisation elements or finishing of the building work - This refers to the material damages caused to the building by imperfections or defects in the execution of the work which affect the finishing elements or the finishing of the building work.

Beware the Is it not an excellent tool that enables you to find and contact long lost friends and family anywhere in the world? Facebook is certainly achieving this. The twist is that it also gives you the means to have a large number of friends “that you do not really know” to offer them for sale some of your unwanted, used possessions as they could be useful to others who cannot afford the new item. Unfortunately, there are always those who spoilt it for everyone else, Facebook was not intended to be used as a “car boot sale” ground for would be tax evaders, nor was it intended to be used to advertise unregistered businesses. There are now far too many of these so called “social” and “networking” sites such as “Directory of Services”, “Cars under €500 Costa del Sol”, “Eat and Drink around Duquesa, Sabinillas and Surrounding Areas”, etc. They all attempt to offer the opportunity for businesses to advertise including those that are not registered for tax purposes and call it “Networking”. The net result of this is that now the Spanish Tax Agency is intensifying their search for advertisers using networking and social sites. 12

Inspectors are searching the internet for any information that will uncover tax dodgers, including data about their family ties and other contacts while looking for undeclared business activities. The Tax Agency Director in Chief, Santiago Menéndez made the following further announcement: - “It is extremely important to be intensive in our use of new technology and to be able to use support from computer auditing experts during our controls, in order to access the internal workings and the information contained within computers, which is not shared with the Tax Agency” (See el País 20/2/2015). The agency now has a dedicated group of workers who analyze websites, blogs and other online platforms in search of clues. Some of their most popular targets are home rental and car sales. It is also a known fact that some tax employees search gossip magazines for signs of undeclared wealth in the photographs of featured celebrities. The idea of having myself, my Facebook friends, family and acquaintances looked into just because I have joined a networking page it certainly does not appeal. My suggestion is that if you have a reasonable business going make sure you remove it from any networking sites and enjoy your sleep at night.

If you do not have a registered business stop trying it on because they will catch up and, contrary to prior policies, Hacienda and the Social Security are now exchanging information with the result that you can get caught for IVA as well as Social Security contributions with hefty fines.

The recipe by the Chef at COCOMO Cocktail Bar & Restaurant

Beetroot & feta cheese tarts with tahini-dressed leaves Ingredients • 4 beetroots (about 750g), roughly the same size, scrubbed and trimmed but not peeled • 3 garlic cloves, unpeeled • 4 tbsp olive oil, plus 2 tsp • 2 tsp coriander seeds & 2 tsp cumin seeds • 3 onions, peeled, halved and finely sliced • 320g pack rolled all-butter puff pastry • 1 tbsp harissa

2 tsp sherry vinegar 1 egg, beaten 1 tsp nigella seeds 100g block vegetarian feta cheese, crumbled For the dressed leaves 2 tbsp extra virgin olive oil 2 tbsp tahini juice 1 lemon 1 tbsp clear honey 3 red chicory, sliced 100g bag watercress

Preparation method 1.Heat oven to 200C/180C fan/gas 6. Rub the beetroots and garlic cloves with 2 tsp olive oil. Wrap in a double layer of foil, adding 3tbsp water into the package. Place in an ovenproof dish and bake for 2 hrs or until soft and tender. When the beetroot is cool enough to handle, gently rub off the skins. Set aside, saving the garlic cloves. 2.Heat a small frying pan and dry toast the coriander seeds until you can smell the aroma, then grind using a pestle and mortar. Toast the cumin seeds, leave them whole and mix in with the coriander. 3.Heat 3 tbsp olive oil in a frying pan, add the onions, toasted spices and cook gently for 30 mins or until the onions are soft and golden season to taste. 4.Unroll the pastry and cut out 4 large circles using a 12cm cookie cutter (or use a small sharp knife to score round a bowl or plate). Place the pastry circles on a baking sheet, lined with baking paper or grease proof paper. Gently score a 1cm

border around each and prick the centre area with a fork. Bake in the oven for 10-15 mins. Meanwhile, mix the harissa, vinegar and remaining 1 tbsp olive oil in a small bowl and thinly slice the beetroot. Remove the pastry bases from the oven and carefully press down the middle areas with the back of a spoon to flatten. 5.Squeeze the garlic cloves out of their skins and stir into the onions. Spread this mixture evenly into the tarts, now layer on the beetroot slices in a circular pattern, slightly overlapping them. Brush the harissa mix onto the beetroot, now brush the egg on the border and sprinkle with the nigella seeds. Bake in the oven for a further 12-15 mins until the pastry is cooked and golden. 6.To make the salad, whisk together the extra virgin olive oil, tahini, lemon juice, honey, seasoning and 1 tbsp water. Toss the chicory and watercress in the dressing. Remove the tart from the oven, scatter over the feta and serve alongside the dressed leaves

The heat inducing properties have a cumulative effect and over time are believed to alleviate pain when used in transdermal treatments for arthritis, nerve disorders (neuralgia), shingles, severe burns and even cluster headaches. The flu So what happened this year? Mismatched H3N2 flu viruses continue to predominate across the country, hitting older people hard. So what’s on

the menu? Mad cow, foot and mouth, swine flu, bird flu, just what is left to eat? So what is still available to safely put in your mouth? Every time you pick up a newspaper or switch on the television lately, the first thing you hear is that another pigeon, swan, duck or other poor unfortunate bird is feeling a bit under the weather. There is nothing the worlds press like more than a really big scare story and talk of a pandemic sends them into raptures. So in search of the truth, I decided to consult the internet and as is the internet’s want, it was full of rubbish. One piece of information I did manage to glean from the world wide w**k however, is, and I quote that “Avian influenza viruses usually do not infect humans and that only 100 cases have been confirmed since 1997; these cases are thought to have resulted from direct contact with infected poultry and that no known cases have resulted from sustained direct human to human transmission.” You have to ask yourself therefore, just what were those people doing to those birds? Now I like a bit

of chicken as much as the next man, but you can go too far. It was not so many years ago that human kind was going to be wiped out by “mad cow disease” and mass hysteria put a stop to me being able to have a gnaw on a decent bone for a couple of years. The only bright spot in all this recent bird flu nonsense is that a poorly swan was found in France, and now the French are running around like headless chickens (no pun intended) trying to convince the rest of the world that pate de Foie Gras is no more poisonous than usual. Call me a heartless gloater if you like, but during the aforementioned “mad cow disease” scare back in Britain, didn’t the French call for a worldwide ban on the sale of British beef? Which ultimately lead to the compromise being reached, that all beef on the bone and indeed the sale of bones themselves being stopped for an indefinite

period; thus depriving us of a good bone for a while. Casting my mind even further back, there was a massive scare about eggs a few years ago and we were all going to die from Salmonella poisoning; when the then health minister Edwina Curry put it about that most eggs were contaminated with the bacteria. The British government implemented a huge program to vaccinate somewhere in the region of 20 million chickens against Salmonella and although this looks like trying to calm those bird flu scares a bit; it can only be good news, after all, there can be no greater pleasure then dipping your little soldier. It does seem that almost all meat has come in for some kind of health scare at some time or another and if you were to listen to all the horror stories, you might think about becoming a vegetarian; on the plus side of this radical thinking is the fact that very nearly all vegetarians are built like a racing

snake, but that is only because they are too weak to make it to the butchers. If that is not enough to convince you that way lies madness, then just look at the patron saint of vegetarians, Linda McCartney. Now being married to Paul McCartney, you would have thought that she would have needed extra red meat to stop any uncontrollable urges to tear his throat out with her own teeth. And as that lady is no longer with us, it would appear that living on a diet of apples and Tofu is not all it’s cracked up to be; I don’t like to speak ill of the dead, but at the very least, her untimely demise spared a whole new generation the “Linda McCartney meat substitute sausage”. So I will leave you with a couple of words of consolation; if you fancy a nibble on a nice plump bird, don’t let anybody talk you out of it, no one ever came to any harm by gnawing on a bone, and there can be no substitute for a real meat sausage.
