GET NOTICED!!!!

Monthly

ADVERTISE IN LIFESTYLE MONTHLY MAGAZINE AND REACH OUT TO OUR LOYAL READERS You can look at November in a bleak way- thinking that it’s the first of many dark and cold months, or you can enjoy the start of the countdown to Christmas as we do. Here at Lifestyle Monthly the fairy lights are already up as we bask in late Autumn. Having just recovered from Fashion Week in Liverpool, we’re looking forward to the party season getting underway and are already choosing our outfits. Having seen so many fabulous frocks on the catwalk we are spoilt for choice. Check out our pictures from Fashion Week, the event was an amazing success and wouldn’t be so without the wonderful designers and retailers who got involved. It was an event to rival New York or London fashion week - in fact The Mirror said we were leagues ahead of London! We’re already beginning to plan next year’s! I would like to thank all our beautiful models who looked spectacular, the make up artists and hair stylists, the great team at Lifestyle Monthly and in particular, our co-ordinators, Jenny, Leila and Sian. Our brilliant columnist, Rick Vaughn did an amazing job promoting the event and stole the show at the closing party. So much so, that we have booked him to host the Liverpool Lifestyle Awards in the spring. And we can’t wait to see him as our cover guy on the Christmas issue next month. But back to this sensational issue of Lifestyle Monthly. Throw on the duvet, put another log on the fire and snuggle down with your favourite free regional magazine. We have an exclusive interview with Kerry Katona who we saw on the runway at Fashion Week and we also chat to celebrity psychic Derek Acorah. Our stylist Jade Ainsworth brings you the latest looks from the high street and I’ve been on a luxury mini break with the husband and kids, proving that you don’t need to choose family orientated accommodation to have a great time. Talking of the kids, I recently attended a meeting when the kids were off school and I had no way of cancelling this meeting. So we arranged to meet in a coffee shop. The kids were sat a few tables away with hot chocolate and colouring books and didn’t disturb us at all. In fact you wouldn’t have thought they were even with me. The next day I got an email saying how unprofessional I was bringing them with me. It made me cross. Angelina Jolie takes her kids on the set of her movies, Myleen Klass takes her daughter along to interviews, is it so wrong? Lifestyle Monthly magazine is my baby but I have others as well to look after and my life, like yours, is a balance between work and family. Flexibility must come into play. I would love to hear your views on this. Email me at editor@lifestylemonthly.co.uk Anyway there’s so much to organise. Christmas is round the corner and there’s shopping to be done! If you’re out and about look out for our taxis- we have four of them- driving around the region. Stay safe, have fun and warm up with the hottest magazine for Merseyside! Amanda Moss Editor

Liverbird Art Schools from across Anfield have united to celebrate the countdown to the 100th birthday of Liverpool’s iconic Liverbird in 2011 with an ‘Art Attack’ style project at The Isla Gladstone Conservatory. Liverpool artist, Faith Bebbington, along with children’s TV presenter, Lizi Botham who has worked on BBC 1’s SMart programme, assembled the artwork for the event last month. School children from Anfield Infants and Juniors and Pinehurst Primary School helped create a giant Liverbird in the shape of a new contemporary design of the bird, which was assembled from recycled materials collected by the Artist Faith Bebbington has worked on a number of art projects within the city including the ‘Multi Faith Snowflakes’ for the Liverpool Capital of Culture shop. She said: “I’m honoured to work on the Liverbird art project to commemorate one of Liverpool’s most iconic symbols. It is fantastic to be working alongside local schools on the project. The children not only learned the importance of the historic Liverbird, but also learned the art of conservation by making art out of recycled materials.” The art project follows the successful commissioning of the ceramic Liverbirds for Liverpool’s Lord Mayor’s Charity Appeal. Liverpool’s Lord Mayor, Councillor Hazel Williams, launched her charity appeal for the year with a limited edition of 100 of the Liverbirds. Demand was so great that the run will now be extended. The ceramic Liverbird is also proving a success with celebrities, with stars including Pamela Anderson, Les Dennis and Sheree Murphy penning their signatures on the ceramic to help raise funds for the Liverpool Unites charity, which helps communities on Merseyside improve the lives of underprivileged children and young people.

Rick Vaughn hosts new cult TV show! Radio City 96.7 fm’s hottest presenter can now be seen in his own TV show, “Round at Rick’s”. The show made its debut appearance online last month with an exclusive interview with Scouting for Girls. Lifestyle Monthly was honoured to be invited to the exclusive recording at Rick’s stunning city centre penthouse apartment. It is the first of many celebrity interviews round at the superstar DJ’s house. Scouting for Girls made the trip up to Liverpool especially for Rick, saying, “We have a lot of time for Rick, he was the first DJ from the start, before we’d even released a single, who got behind us and supported us. We’ve just come up for the day for this.” The BRIT nominated band, who formed in school, have just released their second album and their new single, “Don’t Want To Leave You” is storming through the charts. Roy Stride said, Our big plan is to sell enough records to enable us to go back to the studio and make another album. We just want to play amazing gigs, we don’t want to go back to gigging in pubs. “Music is our lives. I can write a song in ten minutes but it won’t be very good. “She’s So Lovely” took four years. Our inspiration is to try and uplift people and make people happy with out music. You can’t go wrong writing about falling in and out of love and sex.” The interview can be seen online at www.radiocity.co.uk. Warch out

Celebrity Interview

FOLLOWING HER SENSATIONAL APPEARANCE ON THE CATWALK AT FASHION WEEK IN LIVERPOOL, LIFESTYLE MONTHLY CAUGHT UP WITH KERRY KATONA.... IN AN EXCLUSIVE INTERVIEW

How are you feeling right now? I feel on top of the world and I’ve never felt better. I’m thirty and in my thirty years of living I have never felt better. I’m at my strongest right now and totally in love with life. How hard is it juggling your kids with work? It is hard but very fun and rewarding – luckily I don’t have a 9-5 job so I get to spend a lot of time with my children and I want to make growing up fun for them and give them the things and opps I never had. What is the favourite part of your job? The freebies are great and also I get to meet amazing people and try my hand at a lot of different things. I love meeting my fans and when they acknowledge what I’ve done and knowing my life can change other peoples when they learn from my mistakes and being able to relate to me. You are looking fantastic – any beauty secrets you can share with us? Mesotherapy which is amazing! I was approached by the Bodyline clinic for skin tightening treatments as exercise just wasn’t shifting some of the stubborn areas of skin around my stomach. It’s a great treatment if you balance it with a healthy diet and exercise. I also really enjoy working out and it’s a great way to un-wind and also clear my head. I went to GI Jane Bootcamp earlier this year which really kicked off my love of fitness and taught me how to look after myself. Another beauty secret it Clarins – but I love it and the Nivea creams which are good too. I’ve also started wearing these amazing high waisted leggings and pants called Peachy Pinks. They literally slim you down all over and reduce cellulite in 21 days! The best thing is I wear them under all my clothes even jeans and people have no idea – they also lift your thighs and buttocks which is good and give you a brilliant shape. There you go! What are you working on right now? I’m working on enjoying life and being a good mum – I’ve come a long way and taking each day as it comes is really important to me.

Do you read about yourself in the media? Yeah I’ve got to so I know I can give my side back – which makes me laugh as I will read something about myself and will say it’s a load of crap but I will turn the page and read about Cheryl or Victoria and believe it. What is the most absurd thing anyone has written about you? People always write inaccurate things. What is the best piece of advice you can give to your children? Take each day as it comes and do what makes you happy be a leader and not a follower and to be positive. I read recently you would adopt – are you seriously thinking about this? I think adoption is great if you are able to give a child a home but I’m very content with my four who keep me more than busy! It’s always a bit crazy but we have a lot of fun together and I love chilling out with my kids and watching films at home and enjoying their company. You are a role model for a lot of young women, how does that make you feel? I feel very proud to be a role model it makes me want to stay on the straight and narrow – I’m not perfect and I do make mistakes but I also learn from them. I’ve had a big learning curve. Would you consider moving back up north again? No I like going up there every now and again – the reports saying I’m missing up north are not right and I’m settling in really well. I’m loving Surrey. What do you miss about the north west? The drinks are a bit cheaper and it’s a different way of life but I really love it down south and my kids are so happy – I will always be a northerner at heart and love it. But I am a better person down here. What’s the nicest present anyone has ever brought you? It was a poem and a picture frame from my best friends Gaz and Karen it meant so much to me – it wasn’t about the price of the present it was the words and I will never forget it. My 30th Party was a present too and it was amazing.

Celebrity Interview

What’s the silliest thing you have ever done? Silliest thing – there are so many silly things I’ve done but I like to laugh - probably getting men’s names tattoed on me apart from my sons name – I will never get a man’s name tattoed on me again. Can you cook? I can cook – and I’m learning to get better. I’m not the best in the world but my favourite things to cook is beans on toast haha or maybe a nice spaghetti bolognese. What’s your favourite dish? My favourite dish is definitely my manager’s prawns pil pil – I think it’s about time I went round to her house and had it again it’s amazing! She taught me to cook it in Spain. How do you relax? Probably in my pj’s watching a black and white film – It’s A Wonderful Life is my favourite and it always makes me feel good. I also love Gone With The Wind. Describe your style of clothes? I wear what I feel like when I wake up it depends what I feel like – I dress depending on what mood I’m in. My favourite outfit to wear is my pj’s and I like to be comfortable – I dress for comfort. I like sexy, tomboy, comfy – I’m not really a girlie girl but I can be if I want to be. Where do you like to shop? Glamboutique is amazing and it’s so affordable which I think is really important as the latest look changes all the time and you can pick up a whole outfit at Glam without spending a lot which is great. I also like the fact that they stock a mixture of high street labels as well as graduate and independent designers as well. The high street is also great I love New Look, Topshop and River Island. One of my favourite designers at the moment is Giles Deacon – I can’t believe I got to sit in the front row of his show at London Fashion Week!

What annoys you? Rudeness and arrogance I can’t stand it! What makes you laugh? My kids make me laugh – our Max when he’s laughing gets me every time! They have such different personalities, we laugh a lot in our house. If it was your last day on earth what would you do? If it was my last day on earth I would tell my kids how much I love them and that’s it – that’s all I would want to do –just let them know how much I appreciate them. It doesn’t bear thinking about. What do you think of Liverpool Fashion Week? I love Liverpool and the people so can’t wait! I used to live in Liverpool back in the Atomic Kitten days and I have family in Liverpool too so it’s going to be great. It will be good to walk on the catwalk as well as it’s something I’ve never done and knowing some of my friends and family will be there will make it even better. What is the last thing you think of when you go to bed at night? Falling asleep and having a good rest. Would you ever re-marry? I’m taking one day at a time at the moment. What projects are you currently working on? It’s a really exciting time at the moment and I’m looking forward to the future. Wait and see! Tell us a secret about you? I think everyone knows everything about me – I can’t tell you as it wouldn’t be a secret then.

LIVERPOOL FASHION W

Taking place at Bambooo in Duke Street this event has proved bigger than ever. Over 3000 people attended during the week which saw high street brands mixed with high end couture, independent designers and vintage. Kerry Katona opened Fashion Week which included twenty five catwalk shows and a boutique fair of jewellery, hats, make up, hair extensions, beauty and a nail bar by lead sponsor Thornton Hall Hotel and Spa. The event, which took place over 5 days, was featured on ITV's Daybreak, Granada Reports and several national newspapers including The Mirror who compared us to London Fashion Week and said, "Liverpool is leagues ahead." Actor and entertainer Reece Lighting compered the week week with Radio City's rick Vaughn giving the closing night a big send off. To say the event was brilliant is an understatement, we are really proud of ourselves for putting Liverpool on the fashion map. Thanks to Leila Dutton, Jenny Spike, Sian Cooke, Lauren (tbc) for co-ordinating each show and to all our brilliant dressers, models and stage management including Dominic and Phil Phinegan for bringing it all together. A fantastic team, well done.

November Beauty by Sian Faulkner

Autumn makeup colours reflect the cooler season and the expectation that winter is around the corner. Most autumn makeup brightens the complexion and uses warm tones to add color to the face. Here are 5 tips on how to select the perfect autumn make-up for this season... 1. Add foundation back into your makeup routine. If you stopped using foundation during the summer, begin using a lightweight foundation and powder over. I'd recommend using Chanel's Pro Lumiere Foundation (£31.00) as it create a flawless matte finish and is very lightweight yet gives a great coverage. 2. Use chocolate hues on the eye, try Mac's Satin Taupe (£11). Either lightly sweep over lids for a daytime look or for a more dramatic look really build the colour into the socket line. Brows and lashes should utilise dark brown colours also. 3. Tone down the blush. Steer away from the pink shades that you used during the summer months. Instead, put darker shades on your cheeks. You can also skip the blush altogether and just have a more dramatic eye and bold lip colour. 4. Put long lasting color on your lips. Find a lipstick in a darker autumn shade that will last you all day without fading. Mattes should replace the glosses used over the summer. This season red is most definitely a popular choice for the lips. Mac's Lady Danger (£12.50) is a great choice for those who aren't as brave as it has orange tones so it's not as intense. For those who like to wear bold colours, berry shades like Mac's Cunning (£12.50) are perfect for this season. 5. If you don't tend to wear a lot of make-up then go neutral. You can never go wrong using neutral colors during the fall season. Beiges and nudes are always in style. If you would like to contact me for any tips and advice or would like me to demonstrate how to do a particular look in a future issue of Lifestyle Monthly, then email me at info@sianfaulknermakeup.co.uk or alternatively get in touch via my Facebook Fan Page (Sian Faulkner Makeup Artist)

Well folks fashion week went with a BANG! and what a month it has been , I've had loads going on this month especially on the social scene. I was invited to the celebrity night of the opening of Viva Brazil and it was absolutely fantastic, everything about the night was amazing from the food, the cocktails and the

Brazilian

dancers outside. They even had little children all dancing they were so cute! I joined some very close friends - Adele and Alan to celebrate their wedding where the

reception was held in the Bubble Rooms in Woolton village and everything about the day i could only describe as perfect. They had my favourite candles burning from Joe Malone and we had my all time favourite cocktails Mudslides!!!!! So congratulations guys and thank you for a lovely day. I have been going to the Sakura, its Japanese restaurant in Exchange Flags quite a bit this month and the food and the surroundings is absolutely gorgeous! Anybody who has not been i really think you should give it a try, and make sure you take a trip the loo to see the fish tank! I also attended the Ladies Luncheon in Gusto at the Albert Dock in aid of Woodlands Hospice that Carolyn Hughes organised, and what a lovely

afternoon it was and we raised over £2000 for the hospice which was amazing. A good friend of mine, Eden Vernett Showers is taking part in an exciting talent competition :- Open Mic UK 2010. This is an exciting national talent competition which searches the uk for its best singers, singer/songwriters, rappers and vocalists of all genres who perform either covers or original material. The competition will commence on the 7th November at The Linear Hotel in Liverpool where a live regional head to head will take place competing for a place in the national final in the O2 arena in London to have the chance to grab a break though recording contract.

Whilst i was selecting all the outfits for fashion week i came across some fantastic bargains! Miss selfridge had some really great pieces for the winter. I bought a lovely fur cape for a bargain of a price as welll as some chunky knits! River Island have also got some great bits in at the minute, they have finally got the boots in which i gave a sneak preview of in my July Issue, so i went and grabbed a pair myself last week and everybody has commented on them. There is so much choice around at the moment, everything is all about layering this season. Leopard prints and furs are a must as well as capes are wraps. Primark have this tunic £15, faux fur trapper hat £6, fur mittens £4 and socks £2

My model agency has only been open 2 weeks now and i really cannot believe the response i have had, so many gorgeous models are getting in touch with me each day looking for representation and i have carefully picked a handful of my favourite girls so watch this space as i plan to make Front Cover Models a huge success.

Not only are we a model agency we also provide a photography service for model portfolios, family photo shoots, which can also include your pets as well as attending wedding days or family functions. If you would like any more information please contact us on 0845 475 9998.

I went to the opening of the new Hed Kandi store in Liverpool One and thought it was gorgeous, its so young and trendy and we came away with loads of goodies. Everything down to the little silver and pink bags are so bling bling. They have some fabulous jewellery and makeup. I got a gorgeous fur jacket and gilet.

I also came across this lovely cape available from Elegance for £159. Call 0844 557 5507 for stockists.

My gadget of the month is the ipad which i bought for my other half! it was going to be for a Christmas present but I'm terrible at keeping surprises so had to give it to him as soon as i got home.

“Hey, Jude” or should I say food?

review by Luke Trevaskis

ere in Liverpool we owe much of our £1.3 billion tourist economy to The Beatles, and have long capitalised on the fame of the Fab Four. One very welcome and stylish addition is the world’s first Beatle-themed hotel, The Hard Days Night, with its adjoining restaurant, Blakes. Taking its name from the celebrated pop artist Sir Peter Blake, who designed the famous Sgt Pepper album cover, this is no gimmicky tourist trap –Blakes subtly blends memorabilia with tasteful décor, clean lines and sophisticated food.

H

then my guest opted for the roast breast of Whitchurch chicken (£20.50) which was moist with a prawn mousse stuffing, and I chose the roasted chump of lamb with dauphinoise potato (£24.95) which was cooked to perfection – both were generous portions that we struggled to finish. We couldn’t resist dessert though, so chose the vanilla crème brulée and millionaire’s shortbread (£6), and the cherry trio consisting of a charlotte, cheesecake and refreshing cherry iced lolly (£6). Overall it was a thoroughly enjoyable evening, and the staff were especially attentive and friendly. It was a little quiet mid-week so I shall be definitely going back a little nearer the weekend next time to catch more of a buzzing atmosphere.

My guest and I start the evening in the hotel’s Bar Four by sampling some signature cocktails, including ‘Love Is All You Need’ and “Honey Can’t Buy Me Love”, prepared by our friendly mixologist Adam.

41 North John Street Liverpool L2 6RR 0151 236 1964

We make our way to the restaurant where the walls are adorned with Beatles’ portraits, plus a striking display of sixty images of the people featured in the artwork itself – all initially chosen by John, Paul, George and Ringo. Blakes has a contemporary, airy feel, (dark wood, ivory walls and eye-catching chandeliers) with the emphasis on traditional Best of British food, beautifully cooked and presented. We start with the West Coast scallops (£9.95) and the fresh loch duart salmon dauphinoise (£6.95),

The Wirral Kaleidoscope

The busy Wirral is the place to be. A peninsula with a very special touch and feel. Unique and extravagant but still down to earth. In our monthly Kaleidoscope feature we try to introduce you to local businesses and people who are helping to make this county so special.

COMPILED BY INA SCHMIDT

A GROUNDBREAKING new fitness clinic designed to prepare skiers for their winter holidays has launched at Thornton Hall Hotel & Spa The innovative clinic – unique in Merseyside – will be run by qualified osteopath, ski instructor and sports therapist Angus Wood, who specialises in preparing the body for the rigours of an alpine holiday and minimising the risk of injury. Angus will be using a hi-tech piece of gym equipment in his sessions called The Skiers Edge, which replicates the lateral movement that skiers make when executing a turn. Skiers can sign up a few weeks or months before they go away and have a bespoke training and nutritional plan developed to suit their ability and fitness level. Angus, who holds a degree in Osteopathy, is qualified with an International Ski Teacher Diploma – the British Association of Snowsport Instructors (BASI) highest award – and has taught across the globe, most recently in the French Alps resorts of Chamonix, Les Arcs and Les Gets. He said: “The programme is perfect for all levels – from beginners who are trying it for the first time up to regular skiers. “Alpine sports are so demanding on the body and use a lot of muscles and joints that people may not be used to. Through injury, fatigue or pain, many people waste days of their holiday simply by not preparing as if they would for a marathon for example.

Robinson & Neal wins “National Retailer Award for 2010/2011.” A 111 year-old Merseyside family business has scooped a national award for its excellence. Robinson & Neal, which sells decorating materials and offers an individual advice and product-sourcing service, has been awarded the national Retailer of the Year Award for 2010/2011 by the Home Decoration Retailers’ Association. With branches in Birkenhead, Liverpool, Chester and Bangor, Robinson & Neal won the accolade because it “ticks all the boxes required to make the customer feel special”, say the judges. They complimented the company on its exceptionally helpful and friendly staff, its personal service, its expert technical advice and its willingness to track down specific products for its customers. The company also has a reputation for ‘discovering’ the best new products and bringing them to the northwest – in the 1940s they introduced Dulux to a luxury-starved post-war public and in the 1980’s they were the first to champion the now universallyacclaimed Farrow & Ball range. Their latest import to the northwest market is the Paint & Paper Library range which already has an enthusiastic following in the south among designers and architects, and which Managing Director Richard Neal and his codirector wife Julia describe as “absolutely brilliant”.

“This clinic can develop your skiing before you travel, getting the body used to the movements it makes whilst on the slopes. It offers biomechanical analysis, treatment and rehabilitation of old injuries hampering skiing ability, and hones your technique and fitness.”

At the award ceremony in Birmingham, Richard said: “We feel greatly honoured, and really appreciate this recognition. We are a family business and we take enormous and individual care of our customers. It is why we are in business. We believe that in retail, as in trade, it’s the detail that counts.”

Angus’s clinic consists of an evaluation of the skier’s technique and posture, discussing each individual’s goals relating to skiing, technique and fitness. This is followed by a treatment programme suited to the skier’s specific requirements. Roy Burkey, leisure club manager, said: “To secure this clinic – the only one of its kind in the region – is a real coup for Thornton Hall, and we are very pleased to be getting Angus on board. The combination of this state-of-theart equipment and Angus’s expertise in both skiing and sports therapy will give people a real boost before their alpine adventure. “A lot of people who use our Health Club are keen skiers, and many have said this is the kind of cutting edge programme they have been waiting for.” The clinic can also be used for general cardio workouts or to help condition for other sports such as tennis, football and rugby. Angus added: “Skiing can be an amazing hobby, but to ski the full variety of terrain and conditions – especially bumps, powder and ice – you need to unlock your potential. “Osteopathy can really help diagnose musculoskeletal problems that can affect this potential. Once corrected this will also help to minimise the chance of a ski-related injury, through poor posture or muscular imbalances.” For more information and bookings contact the leisure club on 0151 353 0116.

Unfortunately due to my workload organising Fashion Week in Liverpool, I have been forced to take a two week break from Elite. This decision has been tinged with guilt and annoyance. I feel guilty for not keeping up my regime and I am annoyed with myself because I know that I have no self discipline and cannot afford to undo all the good work that Lewis and Kane has done with me over the last months. Why do the shops have to be stuffed with delicious temptations? Why don’t I have any willpower? My train of thought is that I am training so I will burn it off. This is not the way I should be thinking, for every bit of unhealthiness that I pour into my body undoes all the good work that I do. For the past couple of weeks my workouts have got less strenuous. Kane has noticed my high stress levels combined with lack

of sleep and knows it would be unadviseable to push me too hard. Despite this I have still come away from my sessions creaking and aching. I really enjoyed the boxing session, even though my shoulders and arms were paralysed for about 48 hours after the event. We have done lunges with weights and stretching with a heavy ball and I always feel so revived afterwards. I think the two week break will be good though. I have learnt that to exercise efficiently you need mental and physical agility. If I cannot give it 100% then I don’t want to do it. When I return to Kane, Fashion Week will be over and I can devote more time to my training. I will have 6 weeks to really push myself to tone up for the Christmas parties. I am making a promise to myself to do some exercises at home, mainly lunges and ab planks. While I am on a personal training break my husband has stepped in and starts his first session tomorrow. I have told Kane not to go easy on him. Ha ha, I will have the hot bath with essential oils ready to numb those aching limbs. Until next month, stay healthy

ASK THE EXPERT Selling your products via an Agent or Distributor: what you need to know

If you are a manufacturer or supplier of products, for instance, furniture, jewellery or fashion clothing, then you will need to consider the best way of getting these products to market. If you have an established sales force comprising employees then your needs will most likely be catered for. However, if you are looking for alternatives to this traditional model then you may consider appointing a commercial agent or distributor. The obvious advantages of these models are that you are able to enter a market with little outlay or concern about legal regulation; effectively the distributor or agent will bear the cost of getting the product to customers.

Appointing an Agent An agent is appointed to negotiate and conclude contracts with customers on a principal’s behalf. He is paid commission on the sales he makes, usually on a percentage basis. As a self employed intermediary he will have a great deal of autonomy and will most likely act for a number of principals, often selling similar products. For instance, an agent might sell fashion ranges for a number of different designers. If you are looking to appoint an agent then it is a good idea to consider their track record, who they already act for and the time commitment they are prepared to give to your product. If they already sell for a rival you will need to evaluate whether they are likely to give your product a fair amount of coverage when they go into a call; equally if the agent has a number of different ranges there will be a question mark over whether they will have sufficient time to man your trade stand at exhibitions and get out on the road to see customers. Prior to appointing an agent you must ensure you are familiar with the Commercial Agents (Council Directive) Regulations 1993, legislation that governs relations with the agent and provides an entitlement to compensation when the appointment comes to an end.

In one recent agency case a husband and wife team received compensation of around £250,000 at the end of their appointment with the UK distributor for Pandora jewellery, the popular charm bracelet retailer. The agency had only been going for a few years and the agents were enjoying yearly commission income of around £100,000. So when appointing an agent you must make provision for when the agreement comes to an end because it could be expensive. Having said that it will only be expensive if the agent has been successful.

Appointing a Distributor Under a distribution agreement, the supplier or manufacturer actually sells his products to the distributor, who then sells the products on to his customers, adding a margin for costs and profit. A distributor will be motivated to sell the stock he purchases from the supplier, since he takes on greater risk of failing to sell. Other features of appointing a distributor are: A supplier will not generally be liable for any liability incurred as a result of the distributor's activities and there will be no costly compensation payment at the end of the appointment. The supplier will not need to monitor accounts with a number of customers, but only with the distributor. The appointment of a distributor will avoid the need for an established place of business within the territory, which will massively reduce the supplier's administrative costs and tax burden. When appointing a distributor you really need them to perform; particularly if they have exclusive rights to a territory. Once again, before appointing a distributor you should check their track record, the depth of their operation and the infrastructure they can call upon when selling. It really is a key decision and appointing the wrong distributor or failing to control them can cause longstanding damage to your product in the market. A well drafted contract can meet these concerns head on. EAD Solicitors are on hand to provide specialist advice on agency and distribution agreements.
