Tell us a little about the background of Chancery Legal?

Chancery Legal are a boutique law firm located in the City of Hamilton, the firm was founded by Mark Pettingill who has served as the Attorney General to Bermuda and has played a fundamental role in the shaping of many of Bermuda’s laws and continues to sit as a Judge of the Courts. We adopt a people first approach to our practice, building lasting relationships with our clients, working to tailor our advice and approach to their specific needs at that moment in time. Our Real Estate department is headed up by Will Warnock who originally qualified in England as a solicitor and has many years Real Estate experience covering residential properties (freehold and condos) as well as commercial and fractional ownership property. How has the role of the conveyancer evolved over the years?

In someway the role of a conveyancer has remained largely the same for 100 years, which isn’t surprising seeing as the main Bermuda property legislation is based largely on English property law from 1925 (England still relies heavily on this same law today as well), we are here to work with you to ensure you are getting what you are paying for and to ensure compliance with the relevant local laws, such as the need for a licence for international purchasers to acquire property here.

What has changed is how we do this work, gone are the days using reams of paper in files, corresponding via letter and numerous face to face meetings. As a firm we utilise the technology available to us, email, video calls and WhatsApp to correspond with you faster and in a way that suits your preferences. The good thing is we are still here in the office should you wish to meet face to face, but now the choice is yours.

Can you give an example of how you have benefited a client during a difficult transaction?

Whilst we can’t go into the specifics of any particular client’s matter, it is true that occasionally a property transaction can become more complex or protracted than all involved would wish. Should this happen, our focus is always on taking full stock of the issue, utilising our experience in Real Estate to then communicate both the issue and potential courses of action to you in a clear and understandable manner. Where needed we have a number of attorneys and barristers each with their own skill set who can be called upon in seeking a resolution to the issue. The key is always for you, the client, to fully understand what is happening, why and then be presented with clear routes forward to deal with the same. Fortunately, for the vast majority of property transactions there’s often a path to resolution. This can be as simple as us calling and speaking with all parties involved including the real estate agent and attorney for the other side. Good, clear and succinct communication is almost always a path to resolving a difficult transaction, something we excel at.

What changes do you foresee for the property market in the future?

I believe the property market and conveyancing will be facing the same changes most aspects of our life will be, that is, digitisation and the use of technology. Change is often good and we are committed to moving with the tides of change to provide our clients with a constantly improving service.

As the effects dissipated we saw increasing interest from high-networth individuals and their families in having a primary or secondary residence in Bermuda and this has continued as a result of current global conflicts and geopolitical events. As a self-governing British Overseas Dependent Territory, Bermuda offers stability and tranquillity in a modern and sophisticated environment.

In Order To Purchase Real Estate In Bermuda A Non-Bermudian Needs A License To Acquire Property

The Department of Immigration requires non-Bermudian purchasers to attain a license to acquire the land and property. Your Bermuda Legal Counsel will assist in this process, however an application must be submitted to the Bermuda Government and approved before the purchase can close with this process taking 60 days or more. In addition to the property price purchasers will incur the additional acquisition tax calculated on the purchase price as follows:

12.5% for freehold homes

6.5% for tourism condominium developments (such as Tucker’s Point Club, St. Regis, Azura, Newstead and The Loren), Condominiums that are not within a tourism development cannot currently be sold to non-Bermudians.

6% for Permanent Resident Certificate holders
