Three Investments in Building the Firm of the Future Amanda O’Rourke, CPA

As I mentioned in the last issue of The Washington CPA magazine, we must work together to evolve the CPA credential to remain relevant for the next 100+ years. Fortunately, none of us are alone in this endeavor. Our firm has been working with local consultant Heather Wellman (www.vennlogicllc.com) on our evolution to become a “Firm of the Future,” a firm that embraces new opportunities to grow and expand beyond how we’ve always operated and served our clients. Heather facilitates our annual planning retreat and the theme for 2020 is INVEST. Here are three tips on how investing can help us all build the firm of the future:

Each year we spend significant time and energy on revamping the annual review process to remain relevant. In 2018 we implemented 360° evaluations so all staff can provide formal feedback to senior leadership. For 2020 our entire team has individualized goals on how we can each contribute to the firm of the future. What do these individualized goals look like? Here are three of our favorites:

4 Ways to Prevent Work Burnout at Your Company Trevor Everitt Helping your employees avoid work burnout isn’t just good for morale; it’s also good for your organization’s bottom line. Overwork or stress leading to physical and mental exhaustion can produce disengaged workers who will start looking for other jobs. And staff turnover can come with a high price: It takes time and money to find, hire and train new employees – especially when a company has earned a reputation as a tough place to work. How pervasive is work burnout? Very. In a Robert Half survey, 96% of managers said their team members are experiencing some level of burnout. Unmanageable workloads, constant interruptions and unfavorable work-life balance are clearly taking a toll. Here are some tips to help you prevent or counter employee exhaustion and exasperation.

Reassess Roles Make sure your employees are in positions that suit their strengths and interests, and provide them with clearly defined roles and expectations. Taking these steps will help ensure workers don’t become frustrated laboring at tasks they’re not well-suited for. Also be sure to communicate with your team on a regular basis and keep members in the loop when priorities change. Including employees in the planning process allows them to become invested in a project’s success, and by soliciting their expertise, you are reinforcing their value to the organization.

Be Realistic Take a step back and ask yourself some questions. Are your employees tackling doable workloads? Does everyone have all the resources and information they need to handle their projects? One fast path to burnout is to consistently dole out overly ambitious or unclear assignments that even the most skilled professional would have trouble completing.

Employees who like their jobs consistently cite work-life balance as one of the most valuable aspects of their organization’s culture. Respecting the obligations and interests that occupy workers outside of the office helps prevent burnout at work. Where possible, consider offering alternative working arrangements, such as telecommuting or flextime, to help your employees juggle personal and professional responsibilities. Remind both remote and on-site employees to take care of themselves. Unrelenting stress doesn’t exactly fuel happiness or efficiency. Encourage your team to take periodic breaks to go for a walk or simply step outside for some fresh air. Perhaps most importantly, serve as a role model. Manage your time effectively so your employees see that you take your commitment to work-life balance seriously. Don’t encourage your direct reports to leave at 5:30 p.m. only to stay

late yourself. Also, don’t make your team members feel tethered to their jobs by sending late-night or weekend emails. When it comes to vacations, manage schedules so employees can truly enjoy their time off without feeling guilty for unduly burdening colleagues.

Recognize Hard Work Feeling appreciated and well-compensated can make challenging workloads easier to take. Put simply, a competitive salary is critical for keeping employees happy. And in today’s employment market, your ability to retain talent is tied closely to the salary, benefits and perks you provide. Is it time for you to raise salaries? Also, remember that frequently saying “thank you” can go a long way toward preventing burnout. Offering appreciation can be as simple as a mention at a staff meeting or as involved as a nomination of your team for internal and external awards. If they do something well, take notice. If you implement ideas submitted by your employees, give them credit. Penalty Abatement Opportunities After Chai v. Commissioner Jed M. Silversmith, JD In 2017, the U.S. Court of Appeals for the Second Circuit issued a decision that significantly affected IRS procedures for the assessment of penalties against individuals and other taxpayers. The IRS is now required to possess contemporaneous evidence that a revenue agent’s supervisor approved a penalty before it was assessed. The Tax Court has expanded this rule over the past two years, so it now has significant teeth.

Assessment Approval Required As part of the 1998 IRS Restructuring and Reform Act, Congress enacted Internal Revenue Code (IRC) Section 6751(b)(1), which states the following: No penalty under this title shall be assessed unless the initial determination of such assessment is personally approved (in writing) by the immediate supervisor of the individual making such determination or such higher level official as the Secretary may designate.1

The provision applies to penalties imposed against individuals and other taxpayers, including accuracy and fraud penalties. It also applies to the responsible person penalty imposed in employment tax and other trust fund cases. The supervisory signature requirement does not apply to penalties that are automatically calculated, like the failure to pay and failure to make estimated tax penalties. Although enacted in 1998, no court had interpreted this statute or the supervisor signature requirement until 2017. In Chai v. Commissioner,2 the Second Circuit analyzed Section 6751(b) in the context of an appeal from an adverse

decision in the Tax Court. In that case, the Tax Court had sustained the deficiencies and the accuracy penalties. On appeal, the taxpayer argued that the IRS had not established that a supervisor had approved the penalty. The IRS argued that the accuracy penalty was mechanically computed, but the court of appeals rejected this argument. The court also noted that when Congress enacted the 1998 legislation, it intended to require a supervisor to approve penalties at an early stage of the audit. Congress was concerned that revenue agents might attempt to use the threat of a penalty as leverage to negotiate other audit adjustments. The court of appeals also focused on another provision of the 1998 act. Section 7491 states: Notwithstanding any other provision of this title, the Secretary shall have the burden of production in any court proceeding with respect to the liability of any individual for any penalty, addition to tax, or additional amount imposed by this title.

The court of appeals determined that these statutes meant IRS Counsel needed to introduce a signed penalty authorization in the Tax Court proceeding. If it

CPAs who have clients who have been assessed penalties should familiarize themselves with this situation, as there may be an avenue for inexpensive relief for their clients.

failed to produce this document, the Tax Court could not sustain the penalty. In short, documentation of the supervisory approval was part of IRS’s burden of proof. The court found that the statute required there be a written document for when a notice of deficiency was to be sent (i.e., the 90-day letter).3 The Chai decision was significant, but it only applied to the Second Circuit, which includes Connecticut, New York, and Vermont. Since no other court of appeals had weighed in on this issue, taxpayers in the other 47 states, the District of Columbia, and U.S. territories were not bound by the decision. However, in 2017, the Tax Court issued a regular decision on this issue. A regular decision is one that is handed down by the full Tax Court, and with this one it adopted the Second Circuit’s decision and stated that it would apply to all decisions moving forward.4 The Tax Court’s regular decision on the matter immediately affected dozens, if not hundreds, of pending cases. IRS Counsel began filing motions to reopen the record for matters that had proceeded to trial to simply introduce the one document showing that a supervisor had authorized

imposition of the penalty. In some cases, taxpayers have been able to raise the issue and successfully knock out penalty determinations (usually negligence penalties) based solely on the failure of the IRS supervisor to grant approval. In April 2019, the Tax Court raised the bar for the IRS even higher. In Clay v. Commissioner, the taxpayer argued that the term “initial determination of the penalty” meant “the first time an IRS official introduced the penalty into the conversation.” In this case, the taxpayer argued that the penalties were first discussed when the IRS sent the revenue agent’s report (RAR). The Tax Court agreed, and held that an IRS supervisor needed to approve the penalty before the RAR was mailed to the taxpayer.

Since these rules are applied retroactively, relief may be obtainable for taxpayers against whom penalties were assessed years ago. Taxpayers who do not have their audit file can generally get it by

submitting a Freedom of Information Act request. The audit file will contain the supervisor’s written authorization for a penalty (if it was obtained). After reviewing the audit file, taxpayers may be able to obtain quick and easy relief. Specifically, taxpayers who have unpaid tax assessments may be able to file a Form 843, Claim for Refund and Request for Abatement, and argue that the penalties are invalid. Taxpayers who already paid the penalties may be able to claim a refund if the tax was paid in the past two years (or the return was filed in the past three years). Taxpayers nearing the end of the limitations period may want to file protective refund claims to preserve their ability to recover any improperly assessed penalties. It is worth noting that there has been no analysis on the interplay between Section 6751 and the responsible person penalty. However, Section 6751 plainly applies to all penalties against individuals (i.e., all penalties in Chapter 68) other than those that are automatically calculated. The responsible person penalty

is set forth in Chapter 68 and is not a penalty that is automatically calculated. If you have clients who have paid or owe penalties, you should familiarize yourself with the potential impact of these decisions.

8 Fast-Growing Service Areas for CPAs Savvy CPA firms are taking advantage of opportunities to expand their services and quickly deliver more value. International reporting, cannabis guidance, environmental management, and sports and entertainment taxation are among the areas CPAs are enjoying early success in servicing.

Cybersecurity

Some CPAs are finding they’ve hit the so-called jackpot providing services in the challenging marijuana industry. Before diving in, CPAs must be careful navigating the hodgepodge of state laws that regulate a substance considered illegal by the federal government. CPAs need to make sure they are well experienced with Internal Revenue Code 280E concerning taxation of illegal income. As a result, CPAs servicing the cannabis industry need to assist cannabis businesses in setting up a chart of accounts to ensure transactions are properly allocated for tax and reporting purposes and avoid audits. Another roadblock is that although the federal government has given banks the okay to work with businesses in the cannabis industry, many banks are reluctant to agree until the federal ban is lifted. CPAs who can successfully work with financial institutions to obtain deposit accounts for those in the cannabis business will have the edge. Alternatively, they must be able to teach clients how to keep accurate records and run their cannabis business using only cash. CPAs should also consider establish­ing a network of other service providers in the cannabis industry, because their guidance can be invaluable in gaining traction in this new industry.

Cybersecurity is a hot ticket especially since it has become a business requirement across all industries. CPAs are pursuing cyberse­curity services to help clients improve data protection and boost controls for important business processes. Because CPAs already understand internal controls, systems man­agement and risks, it can be a natural segue into offering cybersecurity services. Forensic accountants are particularly adept at analyzing, interpreting, summarizing and communicating complex matters. However, it may not be time to dive in yet. Not all CPAs are prepared to offer cybersecurity services just because they possess certain skills. Those offering cybersecurity services need to come armed with a strong high-tech understanding of software development, access controls, data privacy, multiple secu­rity domains, emerging technologies and system vulnerabilities.

The U.S. continues to follow Generally Accepted Accounting Principles (GAAP) for financial reporting which some CPAs feel are outdated standards. Although the U.S. is making a shift from GAAP to In­ternational Financial Reporting Standards (IFRS), the move must speed up as many companies are doing more business internationally. CPAs are training themselves in IFRS so they can keep up with the demand this area is beginning to experience. In addition, as international tax laws, expatriate rules and treaties are becoming increasingly confusing to comply with and hard to understand, CPAs who position themselves as experts in this area are positioning their firms as an early and essential business partner to savvy business leaders who want to take advantage of the opportunities world capital markets offer.

Blockchains are a continuing series of records constructed to transmit data. Blockchain-led solutions are giving CPAs a chance to expand their business valuation and financial planning services. CPAs are also offering a new service advising business owners on the cost benefit of entering blockchain. On another level, there will be a demand for CPAs having a detailed understanding of how blockchains work, bringing their expertise together to create blockchain regulations.

Robotics As organizations increasingly utilize arti­ficial intelligence, CPAs can offer robotic services focusing on simplifying life for clients. CPAs who are expanding in this area are going all out to know everything about a business so they can advise their clients on and develop robots needed to automate basic processes. Although robots are great at finding solutions, they don’t yet have the capability to find the problem. That’s where the CPA’s skills come in to identify problems, set goals and utilize resources for those rethinking traditional methods. CPAs who are successful in positioning their firms as experts in robotics are being pursued by clients not only for their expertise but also for the human involvement they offer.

Virtualization Many CPAs are already providing outsourced accounting and bookkeeping services to their clients. Now virtual CFOs are becoming popular. A virtual CFO analyzes real-time business data to optimize a company’s finan­cial performance, manage risk, develop tax strategies and more. They may offer onetime services such as advising on business plans or corporate strategy. Virtual CFO services are also marketed to small businesses that are looking for expertise to scale their operations but are concerned about the costs of hiring a full-time CFO. CPAs finding success in this area are filling the void between accounting and meeting the needs of the C-suite.

The Environment The specialty field of environmental accounting has not yet matured and offers CPAs an opportunity to get in on the growing green movement. Improving the management of environmental costs is good for the world. CPAs offering services in this area use their skills to find ways for organizations to reduce environmental costs and create revenue streams. Companies are also implementing an Environmental Management System (EMS) which gives them more credibility. CPAs can be involved in the planning, reviewing and reporting on a new EMS or improving an existing one.

Sports and Entertainment With the complexity of U.S., state and inter­national tax codes, athletes and entertainers are increasingly seeking experienced CPAs to protect their net worth, ensure their financial security and explain to them why their 18k gold-trimmed Rolls Royce isn’t a business expense. CPAs offering services to the sports and entertainment industry are becoming an important resource for assuring tax compliance, business structure guidance and estate planning. Technology changes daily, cannabis is continuing to be legalized, financial report­ing standards are evolving, environmental initiatives are increasing, and tax laws are getting more complex. Astute CPAs will improve their skills to take advantage of the opportunities available.

Now Accepting Scholarship Applications Monette Anderson Scholarship applications for the Washington CPA Foundation’s next award year went live on September 6, and I was surprised to note that we had scholarship applications in progress that same day! If you’re new around here or were hiding in a cave last spring to escape tax season, the Foundation awarded over half a million dollars in scholarships for this academic year to 83 students. With 20 applications started less than a month into the application period (which ends February 17, 2020) it seems that word has perhaps, finally, gotten out. Educators are referring more students, and many colleges have begun forwarding our scholarship emails to all declared accounting majors. As many of our scholarship winners are now leading their Beta Alpha Psi clubs, WSCPA has received generous invitations to attend meet the firms and other student events, which give us even more opportunities to encourage students to apply. Our big change last year of awarding $8,000 scholarships to master’s degree students was hugely popular, and will be a continued effort this year as tuition costs continue to rise nationally. We know the fifth-year requirement can be a barrier in access to the profession for many students and hope this scholarship helps create the most qualified candidates by encouraging students to go for a master’s degree over a fifth year.

Foundation Grants At the Foundation Reception in May, where Foundation Circle Contributors and Scholarship Reviewers had the opportunity to meet the year’s scholarship winners, we played an interactive trivia game to increase awareness of the program work being done by the Foundation and CPAPAC. We were surprised that many students and even Foundation contributors were unaware of the diversity grants being awarded by the Foundation. This year marked our third year awarding up to $20,000 in grants to organizations that work within their communities to increase the pipeline of diverse students to the accounting profession. • W  e supported two continuing initiatives from Western Washington University and South Puget Sound Community College with promising results. We’ll be sharing those stats as they become available within the next year. • W  e also provided a grant to a first-time applicant this year. Degrees of Change is working on an internship program to support students in Pierce County, with the intent to create homegrown leaders. This past summer they added three new accounting internships to their program. As a result, they have had more interest from business majors in their wraparound internship programming, which includes one day a week of bringing all the interns in the program together for soft skills and leadership development training. We hope to support Degrees of Change to increase their relationships with local firms as they work toward their goal of offering more accounting internships by summer 2020.

CPE Rule Changes Effective January 1, 2020 Ashley Kittrell There are some new rules in town. At the Public Rules Hearing held on July 26, 2019, the State Board of Accountancy approved several continuing professional education rules. Many of the changes clarify or align more closely with the Uniform Accountancy Act (UAA) and go into effect January 1, 2020. You can review the changes in the Board Rule Making section on the Board website at acb.wa.gov.

Nano Learning

A definition for nano learning has been added to WAC 4-30-010. Nano learning is a stand-alone continuing professional education (CPE) course that is a minimum of ten minutes (0.2 CPE credit hours) consisting of electronic self-study with a stated learning objective and a minimum of two final assessment questions. The total number of nano learning credits allowed in any three-year CPE reporting period is 12 hours.

Have you ever needed to clarify a standard or re-learn a concept that only took a few minutes? The new rule allows you to count up to 12 hours of nano learning every reporting period. Qualifying courses must be at least 10 minutes long and include a twoquestion quiz at the end.

A CPA must complete a minimum of 20 hours of CPE in each year of the three-year reporting cycle. Board service, first time instructor developer, or authorship of published materials will not count towards the 20 hour minimum. For the next few renewal cycles an overlap between the CPE rules in effect before December 31, 2019 and after January 1, 2020 may exist.

Consider it a friendly check-in every year on a multi-year project. Every calendar year, CPAs will have to complete at least 20 hours of CPE (excluding certain activities, see next rule for more information). Limitations on non-technical subject CPE increase to 60 hours per CPE reporting period. Examples of non-technical subjects include leadership, personal development skills, and practice development.

Some of the most important skills accounting professionals need to stay current don’t include advanced computing or technical skills but rather soft skills like communications and leadership. Now you can earn up to 60 hours of non-technical CPE each reporting cycle.

CPE Reciprocity

CPE reciprocity will be allowed for Washington licensees who are residents of other states. Nonresident licensees shall demonstrate compliance with the CPE renewal requirements of the state of their principal place of business. If their state has no CPE requirements for renewal, the nonresident licensee must comply with all CPE requirements for Washington.

Extension Requests

CPE extension requests are no longer limited to cases of individual hardship. Any individual who fails to complete the required CPE by the end of their CPE reporting period can request an extension prior to their expiration date. An individual is only allowed one CPE extension in any two consecutive CPE reporting periods (six year period). Extension requests will be accepted from January 1 through June 30 of the renewal cycle. The self-reported deficiency (or prelapsed reinstatement) process has been eliminated.

Did the dog eat your CPE? Under the new rule, you can request an extension regardless of circumstances, but you are only allowed to do so once every six years, or once every two consecutive reporting periods.

Seventy-seven percent of Generation Z say having a Millennial manager is their preference over Generation X or Baby Boomers; this is an increase from 67 percent in 2017. The workplace entrance of Generation Z will only increase the complexity of managing and working across generations, especially considering that more than 75 percent of workers identify "managing multigenerational teams" and "different work expectations across generations" as challenges.

Twenty-eight percent of young employees are frequently or constantly feeling burned out at work, a 7 percent increase over older generations. More specifically, seven in 10 Millennials experience at least some burnout at work.

More than 90 percent of Generation Z prefer to have a human element to their teams, either working solely with innovative co-workers or with coworkers and new technologies.

Seventy-six percent of Generation Z professionals feel that the skills necessary in today's workforce are different from the skills necessary in the past.

Organizations must prioritize generational training to ensure the generational gap at work doesn't continue to expand and result in poor communication, collaboration, engagement, and more.

Helping Generation Z strike the appropriate harmony between work and life will be critical. In fact, burnt-out employees are 63 percent more likely to call out sick and three times as likely to quit. Even though Generation Z is the first fully digital generation, they want human elements at work. In fact, 72 percent of Generation Z want to communicate face-to-face at work. And the top two most important factors for Generation Z at work are "supportive leadership" and "positive relationships at work." For Generation Z, technology is a must, but it's not enough. Serve up the technology they expect while delivering the human element they crave.

For the generation that is younger than Google, they approach problem-solving and knowledge-sharing much differently than previous generations. Forty-three percent of Generation Z learners prefer a fully self-directed and independent approach to learning. Microlearning platforms, like 21mill.com, are the ideal way to train Generation Z. Generation Z's top platform to learn more about a company is YouTube, followed by Instagram, Facebook, Snapchat, LinkedIn, Twitter, and then Glassdoor.

Sixty percent of Generation Z want multiple check-ins from their manager during the week; of those, 40 percent want the interaction with their boss to be daily or several times each day.

Generation Z's job search approach is a lot different from Millennials', who prefer to use employment websites such as Indeed and Monster followed by specific company employment websites. YouTube is a must for organizations wanting to build a strong employer brand in the eye of Generation Z talent.

More frequent and better feedback can improve retention. Two-thirds of Generation Z (versus less than half of Millennials) say they need feedback from their supervisor at least every few weeks in order to stay at their job.

Sixty-three percent of Generation Z feel it is most important to work with people with diverse education and skill levels; an additional 20 percent think that having people of different cultures (ethnicities or origins) is the most important element to a team.

Feedback delivered to Generation Z should be prompt (as close to the behavior as possible is ideal), swift (one sentence or an emoji will suffice), and tracked (using a service like 15Five can help with this).

Not only does diversity and inclusion drive company performance and enhance innovation, but it is also instrumental in the recruitment and retention of next-generation talent. Seventy-seven percent of Generation Z said that a company's level of diversity affects their decision to work there. And 69 percent of Millennials employed at a diverse organization said they would stay with their employer beyond five years, compared with 27 percent not employed at a diverse organization.

Scholarship Recipient’s Journey to Become a CPA Before Martha Ramirez, CPA, Tax Senior at Moss Adams in Yakima, discovered the accounting profession, she was working as a program coordinator for Washington State University Extension Program, where she provided nutrition education to under-served youth and parents.

“The program provided education to low income families on how to eat better, how to be healthy, not just physically, but also emotionally. It was a very good program and I really enjoyed the complexities that came with running it, managing 15 different schools and over 5,000 K-5 students in Yakima,” said Martha, who had been taking the first two years of her college degree one class at a time, studying education. Frustrated with not understanding enough about her own taxes, Martha decided to enroll in a Liberty Tax course and soon found that she enjoyed the process of preparing tax returns. For two tax seasons, Martha worked part-time at Liberty Tax, working with clients who desperately needed to get refunds. “Helping them get a refund and also prepare and plan for the upcoming year was really rewarding. I was helping them do something that they could not figure out on their own,” said Martha. The experience was so fulfilling that she decided to quit her full-time job and transferred from Yakima Valley College to Central Washington University to pursue an accounting degree. In spring 2015, Martha was awarded a scholarship from the Washington CPA Foundation, and she graduated in December 2015.

“When I received the scholarship, I also became a student member of the WSCPA,” recalls Martha. “I took advantage of various networking events that the WSCPA hosted, even taking CPE before I had my CPA license. Through conversations at one of these events, I met representatives from Clark Nuber, a firm whose culture really resonated with me. Eventually, I was hired on there.”

Martha moved to Western Washington with her family and began to sit for the CPA exam. She completed all parts by September 2016. Last year, Martha returned to Yakima with her family, and she feels as if she has returned home. “My parents and I immigrated to the US, to Yakima, from Mexico when I was about four or five. I’m the first to graduate and get a bachelor's degree in my family. And now I’m the first to become a CPA. After about three and a half years of being on the west side, we realized we missed our life in Yakima. Now, we're home again.” Reflecting on receiving a scholarship from the Washington CPA Foundation, Martha said, “I don't know where I would be had I not received the scholarship. At the time, my husband and I were making a lot of sacrifices in order to help me pay for my studies out of pocket. This scholarship was something that I really needed to finish up my last year. It made it possible for me to graduate.

“As I progress through my career, I want to be able to give back in the same way that others were so generous towards me. Not only has the WSCPA supported somebody who is now part of the profession, but you've also supported somebody who in the future is committed to give back as well.” Martha is currently a member of the WSCPA Yakima Chapter Board, and holds committee positions with Habitat for Humanity of Yakima County and New Leaders Yakima County. A member of Yakima Rotaract, she looks forward to getting more involved in the future through mentorship and community service. In preparing for the next stage of her career and life, Martha shared the words that inspire her to push forward when she faces challenges. “I try to remember what Marianne Williamson wrote in her poem, Our Deepest Fear, ‘Our deepest fear is not that we're inadequate. / Our deepest fear is that we are powerful beyond measure. / It is our light, not our darkness / That most frightens us.’ “These words have helped me when I feel fear or doubt creeping in and telling me that I should sit down and accept whatever path happens to be in front of me. It encourages me to push my boundaries, to do more, to be more, because…why not? Why shouldn’t I? Why shouldn’t you? “It started in that moment that I jumped head first into a career in public accounting, and has helped me through various stages of my life. That poem just reassures me that I can and should strive to achieve my dreams, whatever they may be.”
