More shoddy work By Kaizer Nengovhela Motorists using the newly “revamped” D959 road between Louis Trichardt and AFB Makhado passing through Kutama and Sinthumule are appalled at the poor condition of the road after it was rehabilitated at a cost of R8 million. The road has started crumbling, with gaping potholes leaving serious question marks regarding the shoddy work delivered by the contractor. On 7 December 2020, the Limpopo MEC for Public Works, Mr Dickson Masemola, set aside R11.5 million for upgrading the D959 and D3715 roads. The contractor, Makasana Construction, started work in February this year, but just more than three months into this six-month rehabilitation project, construction work ground to a halt in June this year. As motorists’ frustration mounted, the road was “unofficially” opened in August this year. On 14 October this year, Masemola visited the area to promise a further R30 million for revamping the D3715 road. He also visited the D959 road to check on its condition. Masemola was outraged to find that the D959 road’s condition had actually gone from bad to worse after the R8 million revamp, and that it would require further major rehabilitation. This rehabilitated

road had, among other things, developed what is referred to as ‘crocodile skin’, which is cracks in the road around a pothole. These cracks usually indicate signs of a deeper underlying problem, such as water underneath the surface. Residents of the area have raised serious concerns about the shoddy work delivered by Makasana Construction. “Who is now to blame for the poor condition of our newly ‘upgraded’ road?” they want to know. Mr Edward Masala, the deputy chairperson of the Dzanani II Taxi Association, said that tyre punctures had become a common occurrence for taxi drivers on the road. “It is an unbearable situation. The road has the worst potholes. It is difficult to drive along this road and it delays our trips. With the completion of the road, the situation has gotten worse. Potholes and deteriorating road conditions create a serious danger for all road users and affects our business as well,” Masala said, pointing the finger at the government for not implementing plans to reconstruct the road properly. The chairperson of the Sinthumule-Kutama Concern Group, Mr Elijah Liremi, said that the community felt insulted by the poor workmanship in the refurbishment of the D959 road. He said that the road seemed to be covered with soft oil, instead of being properly tarred.

Liremi said that the contractor’s bank accounts should be frozen. Last week, MEC Masemola publicly expressed his dismay about the poor state of the revamped road. “The contractor did shoddy work,” Masemola said, adding that he viewed the poor quality of the road in a serious light and had referred the matter to both the Special Investigating Unit (SIU) and the Directorate for Priority Crime

Investigation (Hawks) to investigate. He said that the contractor would face dire consequences, should investigations find any dishonest dealings regarding the project. As far as this newspaper could determine, Makasana Construction, in a joint venture with another company called Vashumi Construction, received a whopping R43 303 935.40 in 2019 from the Limpopo Department of

What is also not known is whether Makasana Construction and Vashumi Construction are involved in the D3715 project for which Masemola had made a further R30 million available in October this year.

A C-Arm is an imaging scanner intensifier with radiographic capabilities. It is used primarily for fluoroscopic, intraoperative imaging during surgical, orthopaedic, and emergency care. With these new X-ray capabilities, the hospital says they strive to better their theatre for the visiting orthopaedic surgeons and super-specialists. “This will also improve the patient experience by performing more theatre procedures locally,” said the hospital. Testing for Covid-19 to obtain a certificate alone amounts to R850 in South Africa and $60US (about R900) in Zimbabwe. These strict conditions, however, seem to have prompted a lucrative business for bakkie owners in both countries who make good use of this opportunity. As many travellers use the undesignated port of entry along the Limpopo River to avoid these costs, bakkie owners in Musina line up to take them there. Last month, Tshiamiso (not her real name) decided to visit her relatives in Gwanda, Zimbabwe. She is a South African resident who lives in Louis Trichardt. Under normal conditions, she pays R680 at Beitbridge Border Post for the whole journey and arrives at her destination early during the day. “My mother is a Zimbabwean and my father is a South African. I have a South African passport.

Before the outbreak of Covid-19, I regularly travelled to Zimbabwe and back. The cost was very reasonable then, and not as risky as it is now,” said Tshiamiso. She must visit her relatives on a regular basis, but as things stand, she fears she cannot afford it anymore, leaving her caught between a rock and a hard place. “In October I arrived early in Musina and was approached by a bakkie owner who offered to take us to an illegal crossing point 30km west of Beitbridge Border Post. We, along with our groceries, were packed like sardines at the back of the bakkie,” she said. The trip from Musina to the illegal crossing point cost them R250, with an additional cost for luggage. The minimum cost for a bag is R30, depending on the weight. If the bag is too heavy, one is compelled to pay more. Luckily, Tshiamiso only had a small satchel, but she did not feel safe, squeezed in with the other passengers. She feared that they might all get robbed. “As we arrived at the illegal crossing point, there were three other bakkies full of people traveling to Zimbabwe. We off-loaded our bags

and walked across the river to Zimbabwe, where we were met with yet more bakkie owners waiting on that side,” said Tshiamiso. From the illegal crossing point to the Beitbridge-Bulawayo road they paid R250 for transportation and another R250, Tshiamiso was told, to pay police officers, so they do not get arrested for using illegal routes. “On our way we met three men dressed in Zimbabwean police uniforms. We are not sure whether they were real Zimbabwean police officers or not, but we were stopped, money exchanged hands, and no one was arrested,” she said. Tshiamiso used the same route and means to return to South Africa, having to cough up the same amount. The whole journey cost her a total of R1 500, which is still cheaper than going through the legal routine. “This is ridiculous. Both governments should take steps to lift some of these conditions. My religion does not allow me to get tested for or vaccinated against Covid-19. It is considered a taboo. I need to consult my elders before being vaccinated,” said Tshiamiso.

He admits that he has never been one for staying put in one place for too long at a time as he was forced to do along with the rest of us these past months since the outbreak of Covid-19. Nothing makes Dave happier than to breathe in nature’s own fresh scents and to fall asleep underneath the wide-open African skies. Konstitusionele Hof-oorwinning ‘n pluimpie vir plaaslike regsfirma Deur Anton van Zyl Die Konstitusionele Hof het Vrydag uitspraak gelewer in die Venda koningskapsaak - ‘n oorwinning vir die jong prinses Masindi Mphephu en nog ‘n terugslag vir die waarnemende koning en uiters omstrede Toni Mphephu-Ramabulana. Vrydag se oorwinning was egter ook ‘n besonderse pluimpie vir ‘n prokureursfirma van Louis Trichardt wat die saak al vir bykans ‘n dekade namens die prinses veg. Volgens Johann Hammann van Hammann en Moosa prokureurs op Louis Trichardt, het hul paaie in 2012 die eerste keer gekruis met dié van Masindi Mphephu en haar oom, Mbulaheni Charles Mphephu. “Hulle het iemand gesoek om hulle te verteenwoordig, maar hulle het nie die fondse gehad vir lang, uitgerekte hofsake nie,” sê Johann. Wat Johann destyds al besef het, was dat hierdie geen maklike saak sou wees nie. Masindi is die enigste dogter van wyle Tshimangadzo Mphephu, wat onder die naam Dimbanyika

Ten einde koste te bespaar en risiko’s te verminder, is die hof gevra om die saak te skei en eers oor ‘n reeks tegniese aspekte in die saak te beslis; onder meer oor aspekte soos jurisdiksie en wanneer sekere wetgewing van krag is of nie meer toepaslik is nie. Hierdie saak het op 31 Augustus 2015 voor die hof gedien en die aansoek is toegestaan. Die wiele het egter in die agtergrond begin rol om Toni Mphephu-Ramabulana ingehuldig te kry as koning. Masindi se regspan moes die hof nader en ‘n dringende interdik aanvra om die proses te stop. Op 9 September 2016 het regter Khami Makhafola ‘n bevel toegestaan wat die inhuldiging gekeer het. Die saak het eindelik in Desember 2016 voor regter Ephraim Makgoba gedien, maar dit was vroeg reeds duidelik dat hy nie baie simpatiek teenoor Masindi en haar span was nie. Hy was nie oortuig dat al die opsies om die geskil te besleg gevolg is nie en het ook nie geglo dat geslagsdiskriminasie sentraal tot die saak staan nie. Volgens Johann het hulle vroeg in die verhoor reeds besef dat hulle nie veel van ‘n kans gegun word om hul saak te stel nie. Ná regter Makgoba mondelings uitspraak gelewer het op 14 Desember 2016 het Masindi se regspan dadelik begin werk aan ‘n appèl, wat die volgende dag geliasseer is. Hulle moes egter wag tot in Januarie 2018 vir ‘n skriftelike uitspraak. Die pleitstukke is gewysig, geliasseer en die aansoek is in Maart 2018 aangehoor. Regter Makgoba wou egter nie bes gee nie en het Masindi se regspan toestemming geweier om teen die vroeëre uitspraak te appelleer. Dit het hulle genoop om die Appèlhof in Bloemfontein direk te nader. Johann vertel dat die proses om die stukke gereed te kry vir die Appèlhof kompleks en tydsaam was. Die eskalerende regskostes was deurentyd ‘n probleem. Die Regshulpraad het in Desember 2015 ingestem om by te dra, maar met heelwat beperkings. Masindi se span het van twee advokate gebruik gemaak. Die span moes egter op erg-verminderde tariewe werk en heelwat van die uitgawes is nie gedek nie. Johann se firma moes maar instaan vir die kostes. Die hoër howe het hul eie unieke vereistes vir dokumente, wat beteken het die stapels dokumente moes verwerk, verkort en weer in die regte formaat geliasseer word. Die Appèlhofsaak het in Desember 2018 begin, wat volgens Johann een van die hoogtepunte in sy regsloopbaan was. Die volbank van regters was uiters simpatiek teenoor Masindi se saak en het besef hoe ‘n belangrike

stryd die bevordering van gelyke geleenthede vir vroue is. Die wetgewing is in plek om tradisionele gebruike in lyn te bring met die land se konstitusionele waardes, maar dit gebeur nie altyd nie. In April 2019 het die Appèlhof uitspraak gelewer wat as ‘n reuse-oorwinning nie net vir Masindi beskou is nie, maar ook vir vroueregte, veral in tradisionele areas. Die hof het Toni Mphephu-Ramabulana se erkenning as koning van die Vhavenda tersyde gestel en gesê dat die proses om ‘n nuwe leier te bepaal onregmatig was. Die saak is terugverwys na die Hooggeregshof, maar met ‘n voorwaarde dat ‘n ander regter dit moes aanhoor. Die Appèlhof wou egter nie ‘n bevel maak rondom koste nie, wat beteken het Masindi se regspan moes maar steeds rondkrap vir fondse om die saak verder te beveg. Om sake te bemoeilik, het die Appèlhof ‘n skuiwergat gelos deur nie vir Toni van sy waarnemende posisie te stroop nie, wat beteken dat hy steeds betaling ontvang het asof hy die koning was. Johann vertel dat die proses om die saak verhoor te kry toe weer moes begin, en weer het Toni se regspan gesloer. In 2019 het die nasionale en provinsiale Huis van Tradisionele Leiers, in opdrag van die Appèlhof, ‘n verslag uitgebring waarin hulle onder meer bevind dat Toni nie ‘n geskikte troonopvolger is nie, omdat hy die ndumi was. Toni Mphephu-Ramabulana was duidelik ietwat in ‘n hoek vasgeverf deur dié verslag. Sy regspan het toe besluit het om teen die Appèlhof se uitspraak te appelleer en dit na die Konstitusionele Hof te neem. Die enigste probleem was dat dit toe alreeds 15 maande te laat was. Volgens Johann het dit egter die deur oopgemaak vir hulle om sommer hul eie griewe te lug rondom die tekortkominge in die Appèlhof se uitspraak. Hulle het ook ‘n appèl geliasseer en gevra dat die hof onder andere vir Toni moes stroop van sy voordele. Die Konstitusionele Hof het verlede Vrydag uitspraak gegee in die saak, wat ‘n reuse-oorwinning vir Masindi behels het. Die hof het eerstens besluit om Toni se appèl van die hand te wys. Die redes wat aangevoer is hoekom die aansoek so laat ingedien is, was nie vir die hof aanvaarbaar nie. Ten spyte daarvan was die regters ook nie oortuig daarvan dat hul saak baie meriete het nie. Die hof was egter wel bereid om na die kruis-appèl van Masindi te luister. Onder meer is bevind dat die Appèlhof gefouteer het deur Toni toe te laat om as waarnemende koning op te tree en die voordele daarvan te geniet. Die hof het voorts ook bevind dat om Masindi te belas met al die kostes nie billik was nie. Interessant genoeg is ‘n kostebevel vir al drie howe waarin die saak gedien het toegestaan teen die President van die land. Die hof se argument was dat die onregmatige aksie van voormalige President Jacob Zuma aanleiding gegee het tot die geding. Die uitspraak in die land se hoogste hof is ‘n besonderse soet oorwinning vir Johann. Dit het bevestig dat hulle vertroue in Masindi se saak geregverdig was en dat die harde werk van bykans ‘n dekade nie verniet was nie. Die feit dat ‘n kostebevel uiteindelik gemaak is, verlig ook die druk aansienlik op Masindi en hul eie regsfirma. Die saak is egter nog ver van afgehandel. Johann en sy span het reeds begin om ‘n voorverhoor te probeer reël vir die Hooggeregshofsaak. Die Appèlhof en Konstitusionele Hof het gelukkig reeds uitsluitsel gegee oor heelwat van die tegniese punte, wat meebring dat die saak direk na verhoor kan gaan. Hulle plan is ook om die hof te vra om uitspraak te lewer en Masindi as koningin van die Vhavenda aan te wys. Johann het baie lof gehad vir die span wat al vir so lank aan die saak werk. Die span advokate het bestaan uit Alan Dodson (SC), Janice Bleazard en Mmakgomo Maenetje. Hy het ook baie respek vir Masindi Mphephu, wat as jong student opgestaan het vir haar en vroue se regte en te midde van geweldige druk aanhou om te veg vir dit waarin sy glo.

Die uitspraak in die land se hoogste hof is ‘n besonderse soet oorwinning vir Johann Hammann. Dit het bevestig dat hulle vertroue in Masindi se saak geregverdig was en dat die harde werk van bykans ‘n dekade nie verniet was nie. Die feit dat ‘n kostebevel uiteindelik gemaak is, verlig ook die druk aansienlik op Masindi en hul eie regsfirma.

The SPCA Louis Trichardt’s Christmas Craft and Farmers’ Market, as well as their ever-popular Mutt Mile, will take place at the SPCA’s grounds along the Vondeling Road on 27 November. “Now is the time to buy presents for your family and friends, and where better to do this than at the SPCA where you will be helping us take care of the animals at the same time,” said the local SPCA team. Market-goers will find a variety of goods to choose from, including jewellery, shoes, handbags, artwork, plants and gardening supplies, fresh vegetables, bottled produce, Tupperware, as well as wooden toys and trinkets for the little ones. “For the hungry shoppers there will be pancakes, corn dogs, burgers, kebabs, biltong and much more. Indian cuisine and dried fruit and nuts will be available as well,” said the team. “Don’t forget to buy a book or two that has been donated to the SPCA. The Legacy Vet Shop has everything you need for your pets,” they added. The stall holders have also generously donated items from their stalls towards a Christmas hamper with a collective value of R1 500 that will be raffled off. Tickets at R10 can be purchased from the SPCA and the draw will take place at 13:00 on the day. “For our stall holders, there will also be 1st, 2nd and 3rd prizes for the best decorated stall. So, get your creative thinking caps on and put yourself in line for a lovely reward. Details to follow soon,” said the team. Residents are reminded that by supporting the market stalls they are also supporting the animals. Emergency food relief initiative Madagascar is on the receiving end of the world’s bad choices. Madagascar is on the brink of a climate-change famine and the Salaam Foundation has started an initiative called #PopCornQuer and #MoveItForMadagascar to support emergency food relief for Madagascar. Above: We will remember them … On Sunday, 14 November, members of the South African armed forces, military veterans and civilians remembered those who had made the ultimate sacrifice in service of their country as part of Remembrance Day. At 05:00 on Monday, 11 November 1918, a document was signed that brought an end to the First World War. At the 11th hour of the 11th day of the 11th month of that year, the guns fell silent. The war that was supposed to end all wars had come to an end, but not before an estimated nine million people had lost their lives. To pay homage those who had died in the war and subsequent wars, Remembrance Day was also commemorated at the MOTH’s Turbi Hills Shell Hole in Louis Trichardt. Photo supplied.

Van Niekerk handed the shell hole a complimentary copy of her grandfather’s memoirs about the Battle of Delville Wood. As a survivor of this gruesome battle, Private Peter Knox put his memoirs to paper at the age of 79. Sandy wrote a book about it afterwards, titled The Story of Delville Wood. Apart from handing them a copy of the book, Sandy also laid a wreath on behalf of Lt Tim Kleinenberg, the first allied soldier from this area to die at Turbi Hills in North Africa, shot by an Italian sniper. Die Bowling for Soup-span het verlede Donderdag ná afloop van die derde en finale ronde van die Louis Trichardt Rolbalklub se aandliga vir besighede en instansies as algehele wenners uit die stryd getree. Afgeneem by hul wentrofee is (van links na regs) klubpresident Carel Volschenk, met wenners Johan Breytenbach, Kobus Barkhuizen (jnr.), Francois Jonker en TE Smit. Volschenk het al die spanne wat ingeskryf het bedank en gesê die geld is ‘n groot inspuiting vir die klub. Hy het ook vir Raymond Pretorius en Michael Parkin bedank vir die borg van die twee “corner-to-corner” uitdagings en die geld wat hiermee ingesamel is gaan gebruik word om die klub se regskostes teen die Makhado Munisipaliteit te help delg.

Hierdie twee karatekas van die Messina Kofukan Karateklub het albei met medaljes weggestap ná afloop van die Alle Style Karatekompetisie wat op 6 November in Polokwane beslis is. Jong Triegies hou kunsuitstalling Laerskool Louis Trichardt het inwoners uitgenooi om volgende week die skool se kunsuitstalling by te woon. Die uitstalling vind plaas in die skoolsaal op 24 en 25 November vanaf 11:00 tot 14:00 en weer vanaf 16:00 tot 18:30. Toegang is betaalbaar in die vorm van ‘n donasie.

NG Kerk Louis Trichardt 2 se span het verlede week weggestap met ‘n tweede plek in die Louis Trichardt Rolbalklub se aandliga vir besighede en instansies. Die span het bestaan uit (van links na regs) Frans Vermaak, Gideon Mellows, Len Lemmer en Henk Vermaak. Die span het ook die toekenning ontvang as besgeklede span met die beste spangees. “Ons nooi ook almal uit om Saterdae vanaf 13:00 saam met ons te kom speel; die sport is vir almal - oud en jonk. Die jong manne beplan ook ‘n kompetisie, so hou maar die pers dop vir inligting,” het die klubpresident Carel Volschenk gesê.

Louis Trichardt Primary School has invited residents to attend the school’s art exhibition next week. The exhibition will be in the school hall on 24 and 25 November from 11:00 to 14:00 and again from 16:00 to 18:30. Entrance is payable in the form of a donation.

Mijanke Venter was 1ste in die spiesgooi, diskus en verspring, asook 2de in die hoogspring en 3de in die gewigstoot vir meisies o.13. Wian Potgieter spog met ‘n 1ste plek in die verspring, 2de plekke in gewigstoot, hoogspring, 100 m en spiesgooi, en 3de plekke in die diskus en 150m vir seuns o.12. Erich Botha was 1ste in die spiesgooi en 2de in die diskus en 800m vir seuns o.13, terwyl Franco Botha 2de was in die verspring en 3de in die gewigstoot vir seuns o.11. Despite a brilliantly played 100 not out by Louis Trichardt batsman JP Coetzee, his efforts were not enough to secure the home side a victory in their provincial Impala Cricket League clash with the PanSolution Eagles from Polokwane. Louis Trichardt enjoyed the home-ground advantage when batting first at the Louis Trichardt Oval on Sunday, 14 November. The home side’s innings, however, got off to a somewhat shacky start with opener Nimesh Watekar getting dismissed for one run off nine balls, while Amir Bux Saif struggled to 25 runs off 60 balls before getting bowled. AJ Fourie struggled to scrape together 12 runs off 29 balls. Louis Trichardt’s chances, however, started looking a bit better when Coetzee walked to the batting crease, finishing on a not-out score of 100 runs off 112 balls, which included seven fours and five sixes. At the opposite end, Dewald Joubert contributed 17 runs off 15 balls, while Salman Patel hit 15 runs off 46 balls. Among the rest of the tailenders, only Juan-Michael Phillips managed double figures of 10 runs off 10 balls, with the team finishing their innings on a score of 233/9 after 50 overs. Louis Trichardt’s score would have looked far worse, were it not for the 45 extras the Eagles’ bowlers conceded. These included 36 wides. Nonetheless, Eagles’ Pieter Haasbroek had the most success with the ball, taking four wickets for the loss of 59 runs in his 10 overs. Ben Skade

took two wickets for the loss of 38 runs in his 10 overs, while Gerhard van Zyl and Morné Venter each toppled one wicket. Eagles team opener Theo Janse van Rensburg got his team off to an excellent start, hitting a quick 74 runs off 51 balls in an innings that included nine fours and three sixes. Fellow opener Pieter Haasbroek was less fortunate with the bat, contributing only one run after 12 balls. Adolf Swanepoel, however, slowly got the team back on track with 22 runs off 37 balls, after which a couple of “cheap” wickets, those of Charles van de Walt (8 runs off 14 balls) and Sias Willemse (0 runs from six balls), had Louis Trichardt sniffing victory again. This was not to be, with Morné Venter in at number six keeping the scoreboard ticking over with 63 runs (not out) off 67 balls. Chris Mohale added 17 runs off 30 balls, while Hanno van Zyl played carefully for his 18 runs off 77 balls. The batsmen’s contribution was enough to steer the Eagles to victory, scoring the winning runs of 234/6 in the 49th over, thus winning the game by four wickets. The Louis Trichardt bowlers did well to keep their extras to only 31 runs. Pick of the bowlers was Salman Patel, who took three wickets for the loss of 31 runs in his 10 overs. Dewald Joubert took two wickets for the loss of 32 runs in his 10 overs, while AJ Fourie took one wicket. This coming Sunday, 21 November, Louis Trichardt will again enjoy home ground advantage when they come up against the BB Motors Hornbills Cricket Club. This 50 over game will start at 10:00.
