Pop-up NPOs score big at Lotto, while others battle responsible for the construction and related work. “I’m sure you are aware … that our NPO is not at liberty to disclose personal information of other companies and or individuals without their concern (sic),” he said. The 2015 changes in the Lotteries Act, however, state that organisations receiving grants from the NLC, when procuring goods or services, must “follow a transparent and competitive process as set out in the Treasury Regulations.” Ramulifho denied that they are bound by this transparency clause.
By Anton van Zyl Inactive and non-compliant non-profit organisations (NPOs) are raking in millions in Lottery grants, while applications from some long-established, cash-strapped organisations are being declined, or they receive a fraction of what they had asked for.
In the latest of a series of strange grant approvals, a relatively unknown NPO registered in Thohoyandou, Denzhe Primary Care, received R20 million from the NLC to build a drug rehabilitation centre in Gauteng. The R20 million paid to Denzhe Primary Care raised several questions. The NPO was inactive for years and was then suddenly resurrected to act as a facilitator for a multi-million-rand project. Both the National Lotteries Commission (NLC) and the NPO refused to make available specific details about the project, such as who the contractors and consulting engineers are.
But who is checking? The problem with con-compliant NPOs’ receiving funding is not new. In November last year, the Zoutpansberger reported on two cases where such NPOs received funding. Vhembe Health & Fitness Centre received R8 million from the NLC for what could only be described as “dietary training courses”. When asked to provide more details about the project, the NPO could not do so, alleging that all documentation had been lost when the chairperson’s laptop and cell phone were stolen. Vhembe Health & Fitness Centre also acted as a conduit for another local NPO, Tshedza Arts, Culture & Sports Development. This NPO received R4,25 million from the NLC for a heritage festival. The NPO was not willing to divulge information on how the money was spent, citing a confidentiality agreement in place between the organisation and the NLC, which prohibits them from speaking to the press. Both Vhembe Health & Fitness Centre and Tshedza Arts, Culture & Sports Development did not file the necessary documents and reports at the DSD, which means that these documents are not publicly available. The NLC, according to their COO, made it clear on more than one occasion that the law does not force them to check compliance and non-compliant NPOs will thus be funded.
Finding Denzhe Denzhe Primary Care was registered as an NPO in 2012 with the Department of Social Development (DSD). According to its founding documents, the chairperson was a Mr T Tshikalange. At the time the treasurer was H Ndou and K Maanda was listed as the secretary. The NPO’s objective was apparently to deal with the prevention of and education about HIV/Aids. Efforts to track down the NPO were extremely difficult. A visit to the registered address at Ndumalelo Centre, Mandala Village, produced little evidence of any activities. The centre is occupied by NJ Munyamela Electrical and no-one has any knowledge of Denzhe Primary Care. All NPOs in South Africa are governed by the NPO Act, which prescribes how these organisations should conduct their business. To obtain an NPO number, organisations must file founding documents such as a constitution and the names of the office bearers. The NPO must also submit audited financial statements and a narrative report. The NPO Act further prescribes that such documents must be filed annually, within nine months after the end of the financial year. Inquiries from the Department of Social Development revealed that Denzhe Primary Care is non-compliant. No documents had been filed since 2012. The NPO’s office bearers had not filed any report stating that there had been any change in status or that new office bearers had been elected.
To the NLC for answers The NLC was approached for more information about the grant and the recipients. It was pointed out that the NPO is non-compliant in terms of the Act. The NLC was specifically asked about the founding documents and asked to provide the annual financial statements of the NPO. These documents, by law, should be in the public domain and available to whoever requests them. Mr Phillemon Letwaba, chief operations officer (COO) of the NLC, responded by denying that the Lotteries Commission has the responsibility to check whether an NPO is compliant or not. “We do not check whether the NPO has filed returns with Social Development, because it is not one of the requirements in terms of the (Lotteries) Act,” he

said. Letwaba insisted that Denzhe had met all the funding requirements as set out in the regulations, but he refused to send the documents, stating that these contained confidential information. As far as the R20-million project is concerned, Letwaba said it was pro-active funding allocated for a drug rehabilitation centre. Pro-active funding is somewhat controversial, because it gives the NLC the discretion to identify projects and fast-track certain applications for funding. The legislation changed in 2015 to allow this and such requests can emanate from three sources: the Minister of Trade and Industry, the Lotteries Board or the commission itself. “The introduction of pro-active funding has enabled us to assist in areas with limited access to resources,” the NLC said in a statement earlier this year. Letwaba said that the drug rehabilitation project was one that the NLC was very proud of. The Gauteng rehabilitation centre is one of three such projects funded by the NLC, the other two being in Mpumalanga and in Kimberley. After being pressured to supply contact details for the project organisers, Letwaba provided the contact details of the new chairperson of Denzhe, Mr Lesley Ramulifho.

more than 24 000 victims of sexual assault, domestic violence and child abuse, and empowered approximately another 400 000 people regarding their rights and responsibilities. In previous years, the TVEP received much-needed support from the NLC and these funds helped them to provide services. Since 2013, however, the funds have dried up. A manager at TVEP, Masikhwa Tshilidzi, said that the organisation had applied for R5 million in funding from the NLC in 2016. When it was eventually considered, only a little more than R200 000 was approved and this money had to be used to buy a vehicle. Tshilidzi said that the TVEP had had meetings with the NLC’s provincial head in Polokwane in an effort to address the problems. It was then stated that applications from Vhembe were of a poor standard and that the NPOs might need assistance in this regard. It was even suggested that the TVEP assist other NPOs in submitting applications.
A national problem
One person who is taking the battle for the seemingly neglected NPOs to the NLC is Ms Lisa Vetten. Vetten is a senior researcher and political analyst for the Tshwaranang Legal Advocacy Centre. They are fighting to get the NLC to reconsider funding the organisations. “Our care work project assisted six NGOs,” said Vetten. “There were another seven who approached us for assistance, but then backed off as they were scared that the NLC might not fund them if they sent legal letters requesting the NLC’s decision on their applications. Another three organisations had simply given up trying. These organisations all have track records in child-abuse and -protection services, mental health, domestic violence and community support. Most were from Gauteng, but some also came from KZN and the Eastern Cape.” Vetten added that the organisations they were working with were NGOs of long standing. “Their And the NPO Directorate? problems have related to waiting two years to receive a response to their applications, being given The NPO Act states that the director of the NPO about 10% - 20% of what they requested, and Directorate should act against organisations that constantly being given the run-around,” she said. are not fulfilling their obligations. Mudau said that, in most cases, the NPOs aparea are currently facing severe crises. During the past 16 years, the TVEP has assisted only get R110 000,” he said.
Ramulifho, a lawyer by profession, responded to questions about the project and said that Denzhe Primary Care had been a dormant organisation when they had taken it over in 2017. “The NPO’s main focus is on primary health care,” he said. Ramulifho explained that their aim was to alleviate the problem of drug abuse. When Ramulifho was questioned on why no reports had been submitted to the Department of Social Development (DSD), he stated that “the NPO was dormant and as such there was nothing to submit.” His response was somewhat puzzling, as the Lotteries Act is very prescriptive and requires charities to prove that it “has adequate measures and procedures (in place) for the proper application of sound economic and effective management.” The NLC must verify that NPOs keep proper accounting records. For this reason, the regulations require NPOs to submit two years’ financial statements when applying for funding. If Denzhe Primary Care was dormant up to 2017, as Ramulifho stated, it would be difficult to prove that sound financial management systems were in place. Efforts to trace down the NPO were extremely difficult.

Rowers blaas kluis by bekende besigheid in middedorp op Deur Isabel Venter

Quranic Verse And Allah has extracted you from the wombs of your mothers not knowing a thing, and He made for you hearing and vision and intellect that perhaps you would be grateful. Qur’an 16:78 Explanation of the verse This verse of the Qur’an calls our attention to God’s favour upon us in the basic abilities that he has given to the human being. He granted us the faculties of hearing and seeing. In the busy lives that we lead, how often do we take these priceless gifts for granted? People spend so much of energy in trying to acquire materialistic goals which distract them from how awesome God has made them. How invaluable is the ability to see and hear is only truly recognised by the blind and deaf, however the Qur’an encourages us to take out some time to reflect upon these amazing abilities God has given to the human being which truly reflects God’s miracle of creation, and celebrate his kindness and mercy upon us by showing gratitude to him in the way we chose to live our lives. PRASA re-introduces passenger rail service Railway News
verdere oortredings sal pleeg.
Main Line Passenger Services, the long-distance passenger rail service of PRASA (Passenger Rail Agency of South Africa), has announced the re-introduction of the train service between Johannesburg and Musina (via Polokwane), effective 28 February. According to PRASA, this service was withdrawn in 2014 as a result of the rationalisation of train services; however, due to popular demand, Main Line Passenger Services decided to reinstate the service. The train will cater for Polokwane, Louis Trichardt, Musina and Zimbabwean customers crossing the border. “Shosholoza Meyl was inundated with requests from customers, pleading for the return of the service. Management evaluated the request thoroughly and reached a decision to reinstate the service. This comes in light of supporting the PRASA corporate plan to transport our customers at an affordable cost. All this can be experienced from as little as R100 for Economy (Sitter) Class and R160 for Tourist (sleeper) Class,” said Mr Mthuthuzeli
Swartz, acting PRASA rail CEO, in a press release. This journey between Johannesburg and Polo kwane takes eight hours and the journey to Musina, 10 hours from departure. PRASA said security would be available on board to ensure all customers enjoy a pleasant and safe experience. The train will have a dining car that provides meals, tea or coffee and refreshments at an affordable price. The train stops at intermediate stations such as Germiston, Pretoria, Hammanskraal, Bela Bela, Naboomspruit, Mokopane, Polokwane, Soekmekaar, Louis Trichardt and Mopani. The Shosholoza Meyl train will depart from Johannesburg on 28 February at 17:15 to arrive in Polokwane on Thursday at 01:15. It will depart back to Johannesburg at 22:35 the same morning. On 2 March, the train will again depart from Johannesburg at 17:15 to arrive in Musina on 3 March at 08:45, from where it will again depart back to Johannesburg at 15:25. These trips will take place on a weekly basis. Customers can book their accommodation by phoning 011 773 6566, 012 315 2090, 015 299 6205 or by visiting your nearest station.

Legal Aid South Africa derives its mandate from Section 35 of the South African Constitution. In terms of this section, every person who is arrested, detained or accused has a right to a fair trial, which includes the right to have a legal practitioner OL assigned SCHO by the State and at State expense. Legal Aid South Africa’s role is to provide legal aid to those who cannot afford their own legal representation. This includes poor people and vulnerable groups such as women, children and the rural poor. Legal Aid SA applies a ‘means test’ to see whether you qualify in terms of what you earn. For example, employed individuals must earn less than R5 500 per month after tax has been taken off to qualify for legal aid. In cases where a person lives with other people for more than four nights per week, and these other people share in the cost of food and other costs, then Legal Aid South Africa will look at the total household income. They will only give legal aid to households that earn less than R6 000 per month and, again, they will only look at the amount that the household receives after tax has been taken off. Legal Aid South Africa also takes into account what a person owns. If a person owns a house, then the total value of the house and all that owner’s belongings must not be worth more than R500 000. A person must also only have the one house, and he or she must live in it. If a person does not own a house, then the total value of all a person’s belongings (for example, their car, furniture, clothes and other personal effects) must not be worth more than R100 000. People dependent on state grants and the elderly can also benefit from Legal Aid South Africa. When you receive a SASSA grant, that money will not be taken into account when considering a person’s income for purposes of qualification. A person will, however, need to show official documents that prove they receive a state grant or pension and will need to take the Means Test. Regarding children, they automatically qualify for legal aid in criminal cases and do not have to take the Means Test. If it is a civil case, the family of the child will need to take and pass the Means Test. (Sources: Law Society of South Africa and Legal Aid South Africa websites).
Information worth knowing about Legal Aid South Africa * Legal Aid South Africa’s services is available to anyone who lives in South Africa (not only South African citizens) if the case is criminal and involves children. Legal aid is also available to asylum seekers applying or intending to apply for asylum under Chapters 3 and 4 of the Refugees Act 130 of 1998. In civil cases, legal aid is not available to non-citizens. * If a person qualifies for legal aid, and Legal Aid South Africa have agreed to represent him or her, that person will not have to pay for anything. In fact, Legal Aid South Africa’s lawyers may not ask or be paid any money when they assist a person with a case. If this does happen, the lawyer must be reported by calling the Ethics Hotline at 0800 153 728. * Although a person does not pay for legal aid, should he or she win a civil case, Legal Aid South Africa will deduct the money that the court grants to pay for costs and benefits, before they pay the money owed to that person. * Legal Aid South Africa tries to help as many people who cannot afford help as possible. From time to time, opportunities arise for them to take on legal work that has the potential to change positively the lives of a far larger number of people than just the person that we provide legal assistance to. These cases fall under our Impact Litigation Programme (http://www.legal-aid. co.za/?p=929). * Where a Justice Centre Executive (JCE) refuses the applicant legal aid, TO VO ND such applicant can appeal to the Regional Operations Executive (ROE). If the EL ROE confirms the refusal, then the appeal can go to the National Operations IN G Executive (NOE). There are no further internal appeals against refusals of legal aid, save for the procedures set out in Section 22 of the Legal Aid SA Act 39 of 2014 * Legal aid is provided for application for leave to appeal to the Trial Court and application/petition for leave to apply to a higher court if leave to appeal was refused. Legal aid is also provided if leave to appeal was granted or if the REFUSE DUMP accused has automatic rights of appeal. Second or further appeal is granted, subject to whether or not there are merits for such an appeal. If you qualify, then get in touch by contacting Legal Aid South Africa at 0800 110 110 or by visiting their website at www.legal-aid.co.za. (Sources: Law Society of South Africa and Legal Aid South Africa websites).

FOUNDED IN 2007, THE WORLD SCHOLAR’S Cup brings together over 20,000 students in 50 countries every year. Our goal: to inspire in young people of all backgrounds a love of learning, a confidence in new skills, and a sense of global citizenship. In collaboration with Mitchell House, the World Scholar’s Cup is pleased to invite you to our next local round in Limpopo, to be held on 28 February - 1 March, 2018. Teams of students will participate in four events: Team Debate, Collaborative Writing, Scholar’s Challenge, and Scholar’s Bowl. Topics of exploration, from human relationships to the history of diplomacy will be drawn from this year’s World Scholar’s Cup theme, An Entangled World. Scholars will have the chance to qualify for the 2018 Global Round of their choice in Kuala Lumpur, Barcelona, or Melborne, and, in due course, for the Tournament of Champions at Yale University in the United States. We cannot wait to welcome you and your students to our global community of future scholars and leaders.

Johannes 14:6 is ‘n wonderlike vers. - 079 516 8303

Gemeenskap pak met nuwe ywer CANSA Relay For Life reëlings aan Liefdadigheid
‘n Spesiale oomblik tydens enige CANSA Relay for Life is die Luminaria-geleentheid. In December last year, pastors from various denominations and representatives from Musina Municipality converged on the N1 road to pray against the high number of road accidents during the festive season.
Their prayers were heard as it was confirmed by the local traffic authority that no fatal accidents occurred in the Musina municipal area during the festive season. Last Saturday, the congregants, law enforcement officers and councillors converged again to thank the Lord for answering their prayers. They came

together in the spot where the legendary late Bafana Bafana and Orlando Pirates soccer star, Lesley “Slow Poison” Manyathela, lost his life in a car accident on 9 August 2003. The spot is approximately 28km out on the N1 North between the Baobab Toll Gate and the Sasol Garage. One of the organizers of the event, Pastor Joseph Salani, said it was important to go back to the spot and thank the Lord for sparing many lives during the festive season. “The Bible tells us that our Lord is a good listener, who only needs people who are dedicated in prayer. We had no doubt that our prayers will be heard, because we serve a living God. This is a testimony that our God cares for those who ask and pray unceasingly. We will continue to ask Him to protect everyone on our roads because He is the one who gave us life.” The manager responsible for traffic at Musina Municipality, Mr Ailwei Mutele, said it was important to seek divine intervention to stop accidents on the roads. “There are other things that we as human beings cannot accomplish without intervention by the Lord. As law-enforcement officers, we are doing our best to make sure that everyone is safe on our roads, but we need assistance from God to achieve our set road safety goals.” Mutele thanked the pastors, congregants, stakeholders and government departments that took part in the thanksgiving prayer session. He warned that his team of traffic officers would be out in full force to maintain law and order on all the roads around Musina. “We warn all traffic offenders that there will be no mercy for those who violate the rules of the road. We want to make sure that everyone is safe on our roads.”
