“Daar

Dit was toe ook so gewees.

“Nee kyk, haar geheue is ongelooflik.

Harde werk is JeanneMari se lewensfiloso fie.

Foto verskaf.

BUSINESS talk Louis Trichardt to soon boast with own performing arts academy By Anton van Zyl

A full-time academy in the performing arts is about to open its doors in Louis Trichardt. This will provide an opportunity for local students to learn more and equip themselves for a career in fields such as acting, producing and even choreography. The Matambwaashu Performing Arts Academy (MAPAA) is situated in the centre of town, at 16 Songozwi Street (opposite Midas). The fully accredited academy is the brainchild of Muhanganei Suzan Matumba. “Acting is magical; it changes your look and attitude, you can be anyone,” says Matumba. She should know, as she has come a long way in the industry since her first “appearance” on stage while she was still a bright-eyed pupil at Tshikwarani Primary school in Madombidzha. After school she went to Johannesburg where she performed in commercials and in TV shows such as Muvhango, Generations and Broken Vows. She also performed in live theatre productions where she rubbed shoulders at the Market Theatre with legends such as Mbongeni Ngema. During her time at the SABC she was used as a SABC news reader and she is widely regarded as one of the most significant voice-over artists by many of the production houses around Johannesburg. Matumba explains that she worked in the industry for many years, but city life became very stressful. While she lived there, she finished her teaching studies at Wits University and received the award as best drama student. After that she

spent some time in China, teaching children English. The Vhembe District, however, called her back and she decided to pursue a dream and open her own academy. “At MAPAA we want to nurture high-quality artistic work. We also aim to inspire dreams and, at the same time, support cultural understanding,” said Matumba. The slogan of the academy is “Tano la vhutsila hanu”, which loosely translates into “A platform to showcase your talent.” The academy offers one-year full-time courses as well as part-time courses. The lecturers are experienced people from a wide variety of fields and include award-winning actress and presenter Vele Manenje. Manenje was introduced last year as the new presenter of one of the country’s most popular television shows, OPW (Our Perfect Wedding). The other presenters are former Phalaphala FM presenter Lady J and Swankie Mafoko, a well-known actress, radio presenter and journalist. Apart from classes in acting, writing and directing, MAPAA also offers courses in composing, choreography and dancing. The music instructor is Mukondi Makhwara, a trumpet player, drummer, composer, arranger and teacher. Makhwara holds a music degree with pedagogy from the University of the Witwatersrand, with vast teaching, travel and tourism experience. The first classes start on 8 April, but prospective students must first go for auditions. These will be held on Saturday, 30 April. For more information and for bookings, MAPAA can be contacted at 082 859 9864 or 063 674 2130 or (015) 516 0403.

Department warns people not paying minimum wage By Phathutshedzo Luvhengo

The Department of Labour in Limpopo has warned employers, more specifically farmers, to comply with the conditions of the National Minimum Wage Act which came into effect on 1 January this year. This warning comes after it recently emerged that some farmers in the Vhembe area were still not complying with the Act and continued to pay their labourers an amount below the required minimum wage. Regarding this non-compliance, the Department of Labour’s spokesperson, Ms Lerato Makomene, warned offenders that they faced dire consequences. She told Limpopo Mirror that the legal consequences for non-compliance were that the department would refer the matter to the Commission for Conciliation, Mediation and Arbitration (CCMA). “If not resolved, the matter can end up with the labour court whereby, in most cases, the judge grants an order in favour of the employee,” she said. Section 71 of the amended Basic Conditions of Employment Act (BCEA) provides for penalties for non-compliance. “The hourly rate for farm workers is R18. By complying with the legislation, employers in the sector will avoid penalties, prosecution and remain in good standing with the department,” said Makomene. An employer who is not paying the minimum wage will face prosecution in terms of the new law. “Prosecution in terms of the new law takes the route

of the CCMA, which is faster than the Labour Court, and employers will be prosecuted after 14 days of being issued a compliance order,” she said. Transgressors who are not paying their employees the minimum wage since the law came into effect will be forced to pay twice the value of the underpayment or twice the employee’s monthly wage. A repeat offender will be forced to pay thrice the value of the underpayment or thrice the employee’s monthly wage. To curb this problem and to ensure that employers are complying with the national minimum wage, the National Department of Labour developed a system that will give workers the opportunity to report non-complying employers. President Cyril Ramaphosa is expected to launch the system, called Impimpi Alive, on Workers Day in Durban. It will enable workers to send an anonymous SMS to the department, after which an inspector will be dispatched within 48 hours. While addressing 400 stakeholders from Labour Unions earlier this month at the second CCMA annual labour conference at Birchwood Hotel, Thembinkosi Mkalipi, the chief director responsible for labour relations in the department, said through the system, names of recalcitrant companies would be published. Mkalipi told stakeholders that if employers knew that there was a high risk of being caught, they would comply. The National Minimum Wage Act, however, does make provision for an

employer or employer’s company acting on behalf of his members to apply for an exemption from paying the national minimum wage. This can only happen if an employer can prove that he or she cannot afford paying the minimum wage. Section 15 of the Act stipulates that an exemption period can, however, not exceed one year. The process for an application should be lodged through the national minimum wage online system on https://nmw.labour.gov.za/. For businesses, the system requires a statement of financial performance, which is an income statement for a three-year period. It also requires a statement of financial position. For private households, the system requires a statement of financial performance that is a one-year income statement. It also requires employees’ working hours and wage information, proof of consultation with every representative trade union or the affected workers if there is no union. Mr Frits Ahrens, chairman of the Louis Trichardt Farmers’ Union, said on Tuesday that farmers should not get caught out breaking the law. “It is going to be an expensive exercise for those farmers who break the law. You have other options, like applying for exemption or negotiating reduced working hours, otherwise pay your employees what the law says,” said Ahrens. He invited farmers to contact the office of the Soutpansberg District Agricultural Union for more information about the National Minimum Wage Act.

Four arrested on charges of fraud at Musina testing station Crime

The Hawks in Limpopo arrested four officials at a vehicle testing station in Musina on Tuesday on allegations that they had fraudulently issued roadworthy certificates for vehicles that they had never physically tested. “The arrests followed months of investigation by members of the Hawks, the Road Traffic Management Corporation’s National Traffic Anti-Corruption Unit and the Special Investigating Unit,” said Hawks spokesperson Captain Matimba Maluleke in a media statement. The four, three vehicle examiners and a cashier, were arrested at the Thusalushaka Testing Station and will be facing charges of fraud and corruption. “It is alleged that the officials colluded in using the identity particulars of a 60-year-old man to generate roadworthy certificates for scores of

vehicles that were never brought to the testing station for examination. Investigations, however, showed that the man was not even aware that his particulars were being used in this manner,” said Maluleke. During the arrests, documents and computers were seized during the raid at the testing station. “A similar raid was conducted at the same testing station in December last year where two officials were arrested. They were released on bail and are expected to make another court appearance on 29 April,” said Maluleke. At the time of our going to press it was not known if the four officials arrested on Tuesday had appeared in the Musina Magistrate’s Court. “Vehicle roadworthiness is one of the major contributors to road crashes and fatalities in South Africa. The raid will assist in reducing this threat in the forthcoming Easter period,” said Maluleke.

Volgens me.

beskadigde plaasheinings.

Foto’s verskaf.

Me. Foto verskaf.

Rubbish fast consuming once-beautiful Musina By Andries van Zyl

Residents of Musina are complaining more and more that this once-beautiful border town is turning into a giant rubbish dump. “People drive and dump their rubbish where they want to,” remarked one irate resident. Nowhere is this more obvious then at the municipal dumping site just outside of the town on the Harper/Campbell road. For weeks now, rubbish has started to pile up along the road leading up to the rubbish dump and the area adjacent to the rubbish dump. To say the least, the place is an awful, stinking mess. “Then you have to deal with the flies … who knows what diseases will spread from here,” remarked another dumping-site user. Mr Wilson Dzebu, spokesperson for the Musina Municipality said, however, that they were aware of the problem. “The site that is depicted in the photographs is part of the old dumping area and it is being used temporarily as the contractors finish laying the pioneer layer of the new cell that the municipality will be relocating to,” said Dzebu. He confirmed that the municipality has a valid license to operate the facility, issued by the Limpopo Department of Economic Development, Environment

Above, below and right: Mountains of rubbish have started to pile up next to the Harper/ Campbell road en route to Musina’s municipal dumping site over the past few weeks. The pending environmental crisis has left residents outraged. The Musina Municipality indicated, however, that they are moving as quickly as possible to address the problem. Photos supplied.

and Tourism on 14 December 2016. Dzebu explained that people were dumping their rubbish next to the road as the temporary site was not fenced. “Some drivers did not follow directions from the security guards regarding where to dump their waste, which ended up blocking the temporary road and near Harper Road, as depicted in the pictures,” said Dzebu. What action will the municipality therefore take to address this growing environmental crisis? “The municipality has ensured that the landfill management contractor pushes all the waste that is blocking the road, as well as the one that is off site, back to the temporary site. The security at the site has also been strengthened to ensure that cars coming from either side of the road are directed properly to where they are supposed to dump until relocation to the new cell is finalised,” said Dzebu. The security has also been an issue, with some users of the dumping site, especially women, saying that they felt unsafe when visiting the site. If all goes according to plan, the situation at the municipal dumping site is expected to return to normal within the next week or so when the new cell is completed. “It is expected that relocation will take place any day now, with the latest date being 31 March 2019,” said Dzebu.

No quick pay-out expected in Venda pension saga By Anton van Zyl

The Venda Pension Fund saga is heading for the high courts and the thousands of pensioners who have pinned their hopes on some sort of compensation may have to wait a few more years. In the latest development, the Minister of Finance filed a motion in the Gauteng North High Court indicating that he would apply for the Public Protector’s instruction for remedial action to be set aside. The Public Protector (PP), Busisiwe Mkhwe-

bane, recently criticised government institutions for not implementing remedial actions stipulated in reports. She mentioned the Vhembe Concerned Pensioners case as an example that “demonstrates the gravity of the problem” faced by her office. In 2011, her predecessor, Adv Thuli Madonsela, investigated the complaints by pensioners that the National Treasury and the Government Employees Pension Fund (GPEF) had acted improperly when privatising the Venda Pension Fund. Madonsela found, among other things, that the complainants had suffered prejudice as they were influenced

to privatise their pension benefits but were not properly informed about the consequences of the privatisation. Following Madonsela’s finding, a task team was formed to investigate the claims and verify the information of the claimants. Not much seemed to have happened after this and the issue gathered dust on the desks of various officials. The matter eventually ended up on the desk of the new PP, Advocate Busisiwe Mkhwebane. In her “Special Report” she directed Lungisa Fuzile, the director general of finance, to submit an action plan on remedial action to be taken. Mkhwebane’s report tried to address certain fears expressed, among others that payment of compensation in this matter would open up a floodgate of claims by former state employees. “The remedial action in [the 2011 report] was designed to address maladministration that is demonstrably unfair and unreasonable in the specific set of circumstances of this matter,” it said. The special report said only genuine, credible complainants identified in the report would have any chance of approval. The consolidated list of complainants estimated the number at approximately 7 000, many of whom are “penniless, relying on old-age grants, while a number had already passed on”. In December 2017, Treasury said it was working together with the GPAA to address the remedial action. The GPAA embarked on a process of reviewing available data, saying that this was necessary to ensure that the project would be implemented accurately. Treasury also enlisted the services of an actuary in an attempt to establish a reliable database of potential beneficiaries of the proposed remedial action. Early in August 2018, Treasury announced that the actuarial firm appointed to verify potential beneficiaries had handed over its final report. “National Treasury is currently reviewing the report to develop recommendations on the next best course of action. Once this is done, Treasury is obliged to submit its recommendations and the report by the actuarial firm to the Public Protector and Speaker

of the National Assembly.” Treasury said it would provide an update on the matter before the end of August 2018. This date came and went, without more light being shed on the issue. The pensioners, in the meantime, grouped together and formed the Venda Concerned Pensioners Group (VCPG). Collectively they represent a claimed 16 300 former members of the Venda Pension Fund. The VCPG mandated Erwee Attorneys from Musina to fight on their behalf. “Erwee is working with Senior Counsel Advocate Jaap Cilliers, a well-known advocate who helped over 60 000 Transnet pension beneficiaries get their pensions. We are very confident that government will pay this time,” said Mr Tshimangadzo Tshiololi, the chairperson of the group last year. Tshiololi said that they were left with no other option but to approach the Constitutional Court to force the government to implement the remedial actions proposed by the PP. “The majority of Venda pensioners are living in abject poverty, depending on social grants. It really hurts to see people dying as paupers, having served the government for a period of 30 to 40 years,” he said. In February this year, the PP openly criticized the National Treasury for not acting on the recommendations. This apparently led to the motion’s being filed, indicating that the High Court will be asked to either discharge the remedial action or have the PP’s report reviewed and set aside. In the application, the Finance Minister also asks the court to extend the 180-day period imposed by the Promotion of Administrative Justice Act (PAJA) for it to act. Erwee Attorneys responded last week by saying that they would approach the court to obtain the necessary approval to be seen as a collective, so that a class action could be instituted. The VCPG will also apply to be considered a respondent in the case, so that the Minister of Finance’s review application can be opposed. Erwee Attorneys will be making use of two very experienced legal representatives, namely advocates Jaap Cilliers and Leon Kellerman.

residents struggling to reach their homes. This problem persists as the current graders of the municipality are already overbooked and cannot reach all the villages in the municipality. Cllr Munyai said that he was aware of the backlog in the grading of roads and that the municipality had set aside funds to procure two new graders.

“The municipality is in the process of procuring two new graders,” said the mayor of Makhado Local Municipality, Cllr Samuel Munyai. Oud-inwoner me. Petro was in 1999 ‘n eiendomsagent vir Coxwell, Steyn, Vise & Naudé.
