Inflation in Spain has started to rise in both January and February which affects the pockets of all residents. Electricity costs went up alarmingly in January, and we explain in an article why this happened. Apart from the rise in electricity costs, the increased cost of fuel has also affected the inflation figures. The Spanish Minister for Industry is telling everyone that the inflation figures are a temporary blip, and as the year progresses inflation will came back to the target amount. Whether this happens remains to be seen. On the tourist front, every statistic from 2016 and forecasts for 2017 are on the up and up. The number of passengers that came to Almería airport in 2016 was well on the way to reach the Día de la Vieja record number of 2007 and is certain to increase this year. In the News Unfair Mortgage Clauses In an article last month, we dealt with interest payments for mortgages where the bank or lender inserted a clause that stipulated a minimum interest rate. Many of these clauses known as “cláusulas suelos” (“floor rates”), depending on the bank, have been ruled “abusive”. The Spanish Supreme Court has now ratified the decision of the EU tribunal that the “start date” is from when the mortgage was signed, and this follows a Spanish government directive that states individual clients who are affected should register a claim with their bank or lender. This was from January 23rd and there is a period of 90 days from a client making a claim during which a refund has to be agreed. There is no fee or cost to the client. If the mortgage owner is not content with the offer from the bank, they can still go to court if they wish to. When the Spanish Supreme Court announced their decision they also put forward the proposal that legal staff and funds would be provided to form special tribunals, to stop a log jam in the existing courts. Banks are studying the possibilities of reducing the total amount of the mortgage, putting the money into a pension fund, or other financial devices, instead of cash refunds. Banks have to notify the “CNMV”, the Spanish Commission for Marketing and Trading, how they are dealing with these claims. Banks now have to comply with the Spanish Supreme Court ruling.

Floor Rates in Practice Various banks have now published information as to how they will deal with the “floor rate” refunds. Cajamar Caja Rural state that they have set aside 200 million Euros for claims backdated to before May 2013 when they stopped inserting these clauses in their mortgages. Banco Popular has earmarked 229 million but say every claim will be examined individually, and a response made within the 90 days specified in the government guidelines. Banco Sabadell still claims that their floor rates are transparent and not “abusive” but have set aside 500 million pending “possible” claims”. Caixabank state they will make refunds “in most cases” and 130 staff are dealing with claims. They have allocated 625 million Euros. Bankia invited applicants to go to their branches from February 3rd and promised a

“quick and easy” process. They stated that going to court might cost them 100 million Euros, and they wished to avoid this. They have earmarked 200 million for claimants and will offer cash refunds or a reduction in total mortgage amounts. On February 7th they stated that they had already dealt with 1,100 claims out of the potential total of 60,000. Banco Mare Nostrum (BMN) state that refunds or other proposals will be made quickly, with minimum problems for claimants. Banco Santander state that they never put floor rates in their mortgages, so no claims are applicable. The BBVA bank who had appealed the decision that refunds have to be made from when the mortgages were signed, will now have to comply with the recent Supreme Court ruling against them.

Floor Rates & the Taxman The Spanish tax authority ‘Hacienda’ have announced how refunds from the floor rates will be dealt with. Any person receiving a refund in 2017 will have to specify this on their ‘renta’ (income tax declaration) due by the end of June 2018. The Spanish tax man can go back four years regarding undeclared income, so any amounts paid back for 2013-2016 must be declared as well. This will be set against the allowances made for the purchase of a main home in each previous tax return. Any refunds made for years before 2013 appear to be tax free. This only applies to cash refunds, and if a person has “payment in kind” such as a reduction in the cost of their mortgage, or money put in a pension fund, or any other refund other than cash, this does not have to be declared, and no adjustment in income tax or liability will apply.

Another Broken Promise The train pressure group in Almería, “La Mesa del Tren”, are up in arms regarding a broken promise from the train company ‘RENFE’. It had been promised that by February the ‘Talgo’ trains to Madrid would be adapted for wheelchair users. This appears to have been put back to the summer. There are no anchor points for wheelchairs at present, so persons who are physically challenged have to struggle into a normal seat. To use toilet facilities they have to ask train staff for their help.

January was the worst month with the highest cost since 2013. The very cold weather, the lack of rain and wind, and other factors, were responsible for the high cost. The way electricity is produced and charged to customer in Spain is also a very different system to other countries. We explain how this all works out in an article.

It has to be remembered that US cities are usually built on a grid system with filters for right hand turning traffic. As an alternative to turning left, if you make three right hand turns at the end of the next block you can then go straight across the junction where you might have turned left.

Almería Province Tourists Numbers 2016 was the best year ever for tourism in the province with 1.3 million people staying in hotels and hostals, an 11% rise. The nights stayed was also a record at 5.5 million. These increases are the best of any province in Andalucía and closely rival Granada province where tourists flock to see the Alhambra Palace, and Seville that pulled in 6.1 million nights stay. The number of Spanish nationals coming to Almería province went up by 4%, but the number of foreign tourists went up 33%. The airport saw an identical rise in foreign arrivals of 33%. The average daily amount spent went up 1 Euros 40 céntimos to 53 Euros, and the score for satisfaction from surveys was 8.4 out of 10.

Don’t Turn Left The delivery company ‘UPS’ has developed their own software maps of New York and other large cities in the US and provide computer generated routes where their vehicles only turn left as a last resort. Turning right habitually is stated to save 10 million gallons of fuel per year and cut down delivery times. Jack Levis, one of their senior managers, states that “left turning traffic” habitually has to cross the flow of oncoming traffic which is more dangerous and causes a slight delay, with vehicle engines just idling. The US National Highway Agency has said that turning left at a junction is one of the leading “critical pre-crash events” when a collision is inevitable, and leads to 22% of crashes compared to 1.2% for right hand turns. They claim that 61% of all crashes whilst turning or crossing an intersection happen on left hand turns, and only 3% whilst turning right. Left turns are stated to be three times more likely to kill a pedestrian. Jack Lewis says that Google maps have no concept of turning left or

Between a Rock & a Hard Place Faced with ‘Brexit’, the Spanish Government have turned their eyes to Gibraltar. Without actually saying that Gibraltar would revert to being Spanish owned, a whole battery of “integration” proposals is being advocated with “joint sovereignty”. Alfonso Dastis, the Spanish Minister for the Exterior, proposes that major improvements could be made in infrastructure, an access to the Spanish electricity market, transport, and finance. The airport would be modernised and made part of the Spanish Aviation Authority with the promise of a greatly increased numbers of tourists. The Spanish proposals are that the 33,000 inhabitants of Gibraltar would still be British citizens, but some sort of dual nationality would be put in place for any inhabitants who wished to do this. Another proposal is that following a merger of Spain and Gibraltar it would be accepted as part of the

In the News ‘Schengen’ area, with no customs controls and free movement back and forth between Spanish people and Gibraltarians. 10,000 people travel from Spain to Gibraltar every day to work. There would also be a joint customs agreement that would stop the high traffic in illegal cigarettes. If a document was signed, Gibraltar would then benefit from a joint defence policy, immigration, and asylum laws. Apart from many other benefits that Spain is proposing! Fabian Picardo, the Chief Minister of Gibraltar, states that 96% of inhabitants voted against ‘Brexit’, and there are now many worrying concerns, particularly if Britain came out of the EU single market. Spain lost the ownership of Gibraltar to Britain in 1713, and the border was completely closed by General Franco in 1969. It was thirteen years before the border was re-opened.

BMW Presentation For the 7th year running, BMW Motorcycles and German company, Bike Promotions, have been organizing events in Mojácar from January to March. Mojácar has been chosen as one of the three official BMW presentations, with the two others in the US and Asia. New models are on display and a large number of specialist European media cover the event. One of the innovations this year is an electric scooter with a range of 200kms. Amateur and professional riders participate in various events, and there are four day guided tours of the area for enthusiasts, with various circuits. The Servigroup Marina Playa Hotel at Marina de la Torre hosts the events.

The death has been announced of the internationally famous Belgian cyclist, Serge Baguet, who was well known in Mojácar. When he retired from professional cycling he became the sports director of the Doltcini Flanders Baguet Continental Cycling Team and operated from the Doltcini cycling shop he set up in Mojácar. He brought hundreds of professionals and amateurs cyclists here each year, and in 2012 he set up the “Clásica de Mojácar-Sierra Nevada” circuit. In 2014, having firmly put the town on the map for all cycling lovers and professionals, he was awarded a Golden Indalo in recognition of his work as an ambassador of European cycling in Mojácar. In 2016, the amount of money or value of a property (or a business) that any person inherited in a will had to be below 175,000 Euros. If it was 175,001 the whole amount was subject to tax. All this has now changed since the start of 2017, and the punitive rates of tax have been substantially reduced. The amount that is now subject to nil tax has been raised to 250,000 Euros. If the inheritance is between 250,000 - 350,000 the first 200,000 is tax free. In addition, if the inheritance includes a property that is a family home, and the portion left to an inheritor is less than 123,000 this is tax free. From 123,000 -242,000 there is a 95% relief from tax. Under the old system, inheritors of a property were unable to sell it for ten years. This has now been reduced to three years. There is pressure, (and it looks like it will happen), that the 95% will be raised to 99% (the same as in Madrid) over the next two years. If a married couple or a “pareja de hecho” (a non-married couple registered as such at their town hall) jointly own a property, and one person dies, the inheritance is only 50% of the property value. If this 50% is split between children or other direct relatives, and comes into the appropriate bands, the tax payable will now be nil or minimal.

Minor Accidents

His resignation from UM 10 has been accepted by his former colleagues, paving the way for his new role as independent member of the town council. Isabel Pantoja The famous Spanish singer, Isabel Pantoja, gave her last concert in Huércal-Overa in 2014 before she voluntary surrendered herself to a 24 month prison term for money laundering and a fine of 1.15 million Euros. This related to her boyfriend, Julián Muñoz, the former mayor of Marbella, and she was caught up in the corruption scandal ‘Caso Malaya’ in 2007. She was released from prison on licence in March 2016. Her first concert since she was released took part in Madrid recently, in front of 10,000 fans. Born in Seville in 1956, she has been one of Spain’s “heartthrobs” for decades.

“Dreambeach 2017” at ‘Fitur’ Along with Antonio Fernández Liria, the mayor of Cuevas, the organizers of the “Dreambeach” music festivals made a presentation at the international tourist fair ‘Fitur’ in Madrid. They announced that the Australian band, ‘Pendulum’, would be making a return to their 2017 music festival. The organizers promised that the music and technical expertise would be of the highest order this year, and be a paradise for the “dreamers”. The mayor of Cuevas stated that the festival that attracted thousands of people is not only a musical experience, but the people also came for the weather, gastronomy, and magnificent beaches.

The umbrella insurance company agency ‘Unespa’ has published figures relating to claims made for minor damage to motor vehicles in Almería province in 2016. This figure totalled 34,000, slightly up from 2015. The most minor accidents in the province take place on Mondays. On other days of the working week accidents are less, with the least number at weekends. Holiday periods have less minor accidents, purely because there are fewer vehicles on the road in urban areas, where the vast majority of minor Another Twist & Turn accidents take place. In the News purchase of the land where the 21 storey, 411 room hotel is built, in return for the payment of 2.3 million Euros that is given as the original purchase price. The Junta hope that a definitive decision that allows them to take over the land will be made soon. This court case is merely one of a multitude that has been fought out since work on the hotel was stopped by a judge in Almería ten years ago. A Junta spokesperson stated that the court hearing was not related to the proposed demolition, but was regarding the land becoming the ownership of the Junta. In March and September last year, there were two meetings between the Junta de Andalucía and the Spanish state lawyers who are jointly being involved in the demolition and the return of the land to the previous state. (Anyone who has seen the hotel can appreciate that the last proposal is going to be very complicated). The hotel is built on 21 “shelves” where the hillside was cut back. The developers, Azata del Sol, point out that there are 65,000 m3 of reinforced concrete supporting the structure. Other court cases are still unresolved regarding the legality of the building licence granted by Carboneras town hall, the designation of the land (and surrounding areas) as being zoned, or not, for construction. Carboneras residents are still hoping that the hotel can be finished and opened. Interviews to appoint staff were being made when the development was halted, and it was hoped that total indirect and indirect employment would give work to 500 inhabitants. This looks fairly unlikely, but Carboneras town hall still maintain their building licence is legal. If the hotel is demolished the developers will make a claim for 71 million Euros which they state is the value of the building. An estimate for the cost of demolition is 7 million Euros.

El Algarrobico and the Ecologists

Carboneras, Salvador Hernández, states that in their opinion there is no completely firm ruling that the building licence is invalid, nor the classifications of adjoining land. He claims that a court judgement from the Andalucía High Court in 2014 supports the town hall. Work was halted in 2006 by order of a judge in Almería. Salvador Hernández states that instead of continually mounting court actions against the town hall, ‘Greenpeace’ should be concentrating on the Junta de Andalucía and the Spanish State, that are the entities that are now involved in the main court cases. An Award from the King Francisco Martínez-Consentino, the President of the Consentino group of companies, was recently presented with one of Spain’s highest awards for innovation and “internationalization”. At a ceremony in Madrid, the Spanish King Felipe VI bestowed the 2016 ‘National Prize for Design and Innovation’ on the Grupo Consentino international company, with headquarters in Cantoria. King Felipe stated that the innovative research and development had transformed the market place and made the company world leaders in their field. Queen Sofia and the present Queen Letizia were also at the ceremony. Started in 1987, the awards are considered to be the most prestigious awards for industry.

Apart from other court cases still to be definitively decided, the ecology group ‘Greenpeace’ is mounting another court case against Carboneras town hall and the present and past mayors. This relates to the famous 21 storey, 411 bedroom, hotel El Algarrobico. They are asking a court to rule that the building licence given by Carboneras town hall and their classification of adjoining land beside the hotel is completely illegal, and the town hall is in breach Albox “Express” Licences of rulings from other courts. Higher Inflation

Work has started in Almería city near to the Torrecárdenas hospital where ‘Bogaris Retail’ is building the largest commercial centre to date. The 150,000 m2 development, with an investment of 150 million Euros, should be open in 2019 and give direct and indirect employment to 3,000 people. Major companies that have signed up for stores that deal with clothes and textiles, which take up 65% of the available space, include Berska, Massimo Dutti, Primark, Pull & Bear, Springfield, Kiabi, Zara, and Stradivarius. Sprinter & JD Sport will offer sports related items and Primor, the perfume company, will have a store. Leroy Merlin and Media Markt have signed up, along with Mercadona. Cineápolis will open a 12 screen cinema, and a “Food Court” with a large number of restaurants is planned. 60,000m2 is for urban development in the form of subsidized housing (the equivalent of council houses) and 120,000 dwellings for private purchasers.

The Spanish government and the Bank of Spain are perturbed that inflation in the first quarter of 2017 looks likely to be 3%, compared to 1.6% at the end of 2016 after starting off at minus 1%. If the 3% turns out to be factual this is the highest percentage since October 2012. Increases in the cost of fuel and electricity are the main reasons for the rise, and the increase in the minimum wage has also had an effect. Pensions have only gone up in 2017 by 0.25%, which has been the annual rise in the last four years. This means that the buying power of pensioners will be reduced even further. Pepe Álvarez, the Secretary General of the UGT union, says that the buying power of pensioners has dropped 20% in the last ten years, and this is scandalous. The Spanish Minister for the Economy has stated that in the first quarter of every year there is a much higher demand for electricity, and the target of 2% inflation will probably be met in the coming months.

Switch it Off! Last month, the American orchestral conductor, William Christie, was at the National Auditorio (concert hall) in Madrid conducting a performance of Handel’s oratorio ‘The Messiah’. He was with the orchestra and choir Les Arts Florissant who specialize in performing music of this period. William Christie stopped the performance when a mobile telephone started to ring and was not answered. The Madrid audience, who had paid from 35-140 Euros admission, clapped and shouted insults at the owner of the phone. In the concert programme it stated that any electronic device had to be turned off, and there was an announcement before the concert. In New York five years ago, an orchestra performing the last movement of Gustav Mahler’s 9th symphony

Too Much Money The leader of the PP political party in Albox, Pérez Quiles, is complaining that 8,700 Euros has been paid to the son-in-law of the present mayor for a video relating to Albox. He states that the “video” is mostly a series of still photographs obtained from the internet, and any school pupil could have done the same thing as a project. He claims that a professional company estimate that the cost should have been no more than 300 Euros. A year ago, another video was shot by a professional which was exhibited at the annual ‘Fitur’ tourist fair in Madrid, and cost 1,200 Euros. Pérez Quiles states that the company, ‘Alcaina’, owned by the relative of the mayor has been paid a total of 1.7 million Euros for various projects that he considers are exorbitant as regards the cost, or never carried out.

In the News A Concrete Decision After years of proposals and counter proposals, the amount paid to telephone and internet providers using mobile phones in the EU, known as “roaming charges”, has been scrapped. The new regulations will come into force on June 15th, but further reductions will be progressively introduced finishing in 2022. Andrus Ansip who is Deputy Director of the EU Commission for Telecommunications has described the agreement as “the last piece of the puzzle”. Every two years, a study will be made to determine that the new regulations are working how they should. The cost of a voice call in any EU state will be reduced from 0.05 Euros (5 céntimos) per minute down to 0.032 (3.2 céntimos). Text messages will be charged at a maximum of 0.01 Euros (1 céntimo) per message. For internet use, the maximum charge will be 7.7 Euros per Gigabyte in June, falling to 6 Euros in January 2018, 4.5 Euros in January 2019, and 3.5 Euros in January 2020. The final reductions will be 3 Euros in 2021 and 2.5 Euros in 2022. It is considered that new technology will allow these charges to be reduced. Phone companies have to offer the same prices as in any EU state where a person is living, or on holiday, despite whether they are in alternative EU states for a limited period. This abolition of roaming charges has been on the cards for ten years, although various operators have voluntarily reduced their tariffs in this period. The Spanish ‘DGT’ traffic authorities state that the cause of pedestrian deaths on Spanish roads is probably a 50/50 shared responsibility between drivers and pedestrians. Drivers who are ignoring the speed limits are much more likely to cause death and injury than if they respect the limits. A pedestrian hit by a vehicle travelling at 30km/h may suffer light or more serious injuries, but a resultant death is extremely rare. At 65km/h, 15% of pedestrians are likely to suffer serious injuries, and 85% will be killed. Drivers have to stop for pedestrians at a zebra crossing (in theory the pedestrian has to have one foot on the crossing), but Spanish pedestrians quite often set off crossing roads quickly. Pedestrians killed are usually in the age range 65-80, with more women killed than men. This is put down to defects in vision or hearing, lack of judgement or agility. The DGT want pedestrians involved in accidents to be penalized if they are considered to be “over the limit” of alcohol, but there is no set limit for persons on foot. In a traffic accident involving pedestrians they will be given an alcohol or drug test to see if they are partly to blame. Jaywalking is technically illegal in Spain but rarely results in a fine. Crossing a road where there are light controlled pedestrian crossings can result in a fine of 200 Euros if the lights are on red.

This is necessary because ‘SACYR’, who were given the contract in 2015, have been unable to start work, mostly because ‘ADIF’, the rail company, did not own all the land. ‘SACY’ recently withdrew from carrying out the work that should have now been finished. A modification of their quote for doing the work (that was extremely low) is being negotiated. Gabriel Amat claims that the next link from Cuevas to Vera, where there will be a station, will be completed by summer 2020. If this is factual a contract for the construction will have to be signed soon. He also claims that the five missing links in Murcia province that will finish at Pulpí will be completed. Critics say that this is just wishful thinking! The ‘PSOE’ party are insisting that the 500 million Euros that was supposed to have been spent in Almería province in the last five years, and has never materialized, must be forthcoming in 2017. Gabriel Amat states that 2017 is not a good year for any major investment as the Spanish deficit that Brussels are concerned with, does not allow this to happen! At present, only 25% of all the sections from Murcia to Almería city are finished.

The EU and the ‘AVE’ The EU Co-ordinator for the “Mediterranean Corridor” ‘AVE’ (High speed train) has weighed into the debate about what is happening in Spain. The Mediterranean Corridor is the combined passenger and freight line from (as far as Spain is concerned) the border with France, down to Algeciras. From Almería city it goes to Granada inland, then to Antequera in Málaga province, and then to San Roque/ Algeciras. Laurens Jan Brinkhorst, the Dutch EU Commissioner responsible for the projects, is extremely critical of the lack of progress. Apart from the missing links in the Murcia city to Almería city sections, he complains that plans for the Almería to Granada section were approved in 2009, apart from an environmental assessment, and since then have merely been put in a drawer. He is accusing the Spanish Government of being “disinterested”. Money earmarked from the EU budget in the period up to 2020 was supposed to have allowed for the implementation of this section, but is now not part of the budget. This means it will have to come from the 2020-2030

budgets, and he considers that at present it looks unlikely if any real progress for the completion will have been made by 2030.

ITV’ Tests In 2016 in Almería province, 318,000 vehicles went for their ‘ITV’ (MOT) tests at the nine centres in the province. This was 20,000 more than in 2015. 76,000 vehicles were found to have a total of 167,000 serious faults that had to be repaired before a re-test could be done. The vehicle in question can then only be driven to or from a garage and the ITV centre. Unroadworthy vehicles have to be collected by a recovery vehicle from the test centre and taken to a garage. If the vehicle is re-tested within 60 days there is no further charge, but after this time period a new fee has to be paid. 272,000 had minor defects and in many cases (usually if a garage has taken the vehicle to be tested) these faults can be corrected by the garage without a re-test. Including re-tests, the total number of inspections amounted to 400,000. 22% of serious faults related to lights, 21% to the suspensions, 17% for brakes, and 15% for exhaust problems or unacceptable levels of emissions. The fine for having no ITV in place is 200 Euros, but if a vehicle has failed a test with serious faults and is still being driven, the fine is 500 Euros. 33,000 vehicles were tested at Vera, 22,000 at Albox, 13,500 at Vélez-Rubio and the highest number of 68,000 at the Zamarula centre in Huércal de Almería. Illegal Electricity Hook-Ups Not True! The pressure group ‘Veraplayazul’ have strongly criticised Vera town hall for claims they made at the ‘Fitur’ international tourist fair in Madrid that takes place every January. In press presentation and publicity, the Vera tourist board stated that their 7kms of beaches merited the “blue flags” awarded every year. Veraplazul say that this is a lie and erroneous. They point out that there is no guarantee that any of the beaches will qualify for the awards and neither the sea nor the beaches are clean enough. They also state that the blue flag awards take into account beach access, facilities, and infrastructure such as transport, which the Vera beaches lack. The only award last year was one of the “Q for quality” categories that come from a Spanish organization, which only applied to the Las Marinas-Bolaga beach. These are not the blue flag awards that come from the European association. One of the other themes at the tourist exhibition was the repeated use of the word “Veranear” that was intended to denote that Vera was a place to come and stay in the summer (“Verano” in Spanish). The pressure group consider that this totally ignores other tourist attractions such as the Easter and Moors & Christians processions, carnival time, culture, and gastronomy events, which take place all year round and should have been promoted.

186 km/h Over the Speed Limit At one of the advertised mobile radar checks on the access road from the A-7 motorway to Almería airport at Alquián, Guardia Civil Police recently clocked a 32 year old male driver travelling at 276 km/h in a 90km/h limit. The driver was in a Nissan GT-R car and received a fine of 600 Euros and 6 points off their licence. At another court, a prison term of four months was requested, and a ban on holding a driving

Endesa, the electricity supply company, is intensifying its efforts to tackle the illegal use of electricity in Almería province which has risen by 89% in the last two years. They are working closely with other agencies, particularly the police. The biggest fraud relates to illegal hook-ups where people are growing marihuana and have bypassed any meters, or directly connected to street cables. The other problem is the illegal connections by squatters. 5,471 cases of fraud were detected in 2016, and apart from the money that is being lost, many of the illegal operations can result in a fire risk. There is also a failure of equipment such as transformers when a heavy current is being used. In various cases this has resulted in a general power failure. Endesa states that the electricity “lost” in 2016 was equivalent to the total power requirements of Almería city for one month!

Caught On Camera After some initial teething problems, 11 of the fixed radar installations in Almería province can tie up number plates with the records relating to the ‘ITV’ (MOT) tests. In the short time since the computer systems of the ‘DGT’ (traffic authority) and the ITV ones have been successfully interfaced, 30 vehicles have shown deficiencies. 22 of these had not had the ITV tests done in the time period required, and 8 had been tested but found deficient. If a vehicle is found to have minor faults, it has to be repaired and then undergo a further test. If it is not considered road-worthy it has to be taken to a garage by a recovery vehicle for immediate attention. The fine for not having an up to date ITV is 200 Euros, and if the vehicle is being driven when it is should have gone back for another test the fine is 500 Euros. There are no points deducted if an ITV is not in force, because for vehicles owned by companies

In the News there is no single owner-driver in most cases. Taking points off a driver of a company owned vehicle is (rightly) not considered to be fair. The DGT is again hammering home their message that older vehicle have less safety features and can cause more injuries in accidents than modern vehicles. 502,000 vehicles in Almería province, that is 47% of all vehicles, are more than 10 years old.

Donald Trump & Mariano Rajoy On February 7th, as part of President Trump’s contacts with foreign leader, he rang Mariano Rajoy, the Spanish Prime Minister. Not too many topics could be discussed in the 15 minute conversation as they both needed interpreters. Donald Trump does not speak Spanish, and Mariano Rajoy does not speak English. Donald Trump told the Prime Minister how much he liked Barcelona, and the fight against the so-called Islamic state was mentioned. Spain has 450 troops in Iraq to help with security in Bagdad. Mariano Rajoy stated that Spain had a

foot in both Latin America and Europe, and he offered the help of the Spanish Government as an intermediary.

The ‘PSOE’ party have lost 4 million Euros for their reduction in the number of MPs. The ‘Unidos Podemos’ & ‘Ciudadanos’ parties stood for the first time in December 2015 and have received 11 million and 7 million Euros respectively. A reduction in funds means that any political party does not have enough money to pay all the party employees they would like or to spend on party-owned buildings or services.

So Now You Know... The North Pole If you said you wanted to go to the North Pole you would start at the Arctic Ocean, but then you have to define your journey. Magnetic North is where your compass will tell you to go, but it is moving from Canada towards Russia at about 40km a year. The Geographic North is where the axis of the earth meets up with the surface. This place is referred to as being “True North”. The “Geomagnetic” North Pole is where the earth’s magnetic dipole meets the surface, about 11 degrees away from the axis of rotation. The spot furthest away from any coastline is known as the Arctic North. So there are various choices. Saffron The cultivation and the use of saffron go back more than 4,500 years and spans many cultures, civilisations, and continents. It was first documented in a 7th century BC reference to Assyrian botany. About 4,000 years ago it was regularly mentioned in documents as being used to treat up to 90 illnesses. It then became predominantly used as a spice. It is made from the dried stigmas of the saffron crocus originally found in the wild. It has always been one of the most costly substances to produce. Although it has a bitter taste and smells a bit like hay, it then became regularly used as a seasoning, a fragrance, and a dye. Jumpers A jumper is now accepted as being an upper-body outer garment, probably made of wool, for either sex. In the US it is used to describe the item worn by women, not men. The French word “juppe” that “jumper” comes from, was the name for a petticoat, but the same word was used to describe a canvas jacket worn by sailors. In England, the name was given to a short man’s jacket, or a petticoat, or other garment that was used to give extra warmth. Gradually the word was not used to describe a petticoat or a jacket for men and was used to describe a knitted or machine made garment, which was worn over other clothes.

The Bank of England The first Governor of the Bank of England was Sir John Houblon who was a Huguenot descendent and merchant. William Paterson, who was a Scottish entrepreneur, first came up with the idea and was given a Royal Charter in 1694. He decided that the British government needed some funds, and he persuaded 1,200 wealthy friends and acquaintances to raise 1.2 million pounds in just a few weeks. These people all became shareholders and were promised 8% interest. The bank went on to assume more power by issuing currency and managing stocks of gold. It became the main monetary advisor to the government of the day. A Boycott A boycott is the word used to describe a form of protest where dealings with a person or organization are withdrawn. It came from an incident in the 19th century in Ireland. Captain Charles Boycott was an English land agent who worked on the Irish estate belonging to Lord Earne. He was bitterly unpopular and refused to reduce the rent he charged the workers. The Irish Land League decided that the only way to deal with him was to persuade all the workers to start a “go slow” protest. Boycott backed down to a small extent eventually, but this idea became known as “boycotting” and went into the English language. At Sixes and Sevens If we use this phrase to describe a person it means that they are totally disorganized, or in a state of complete confusion. The expression dates back to gambling in mediaeval times. If a person betting on the throw of a single dice chose to bet on a “six”, which was the highest number, he was considered to be very foolish and not giving the bet due thought. No player could bet on a “seven” which didn’t exist, but being at “sevens” was used to describe a person who was so totally confused, or foolhardy, that he had no idea what to do next. The term “sixes and sevens” then became applied to anyone who was very confused.

Major Changes

ast month we explained how Gregorio Serrano, the Director General of the ‘DGT’ (Spanish traffic department), was urgently undertaking a comprehensive review of all the regulations relating to road safety. This came about after the figures for deaths and injuries on the road in 2016 were worse than 2015. A whole range of initiatives has been announced by Juan Ignacio Zoido who is the Spanish Minister of the Interior. These will be presented to the parliamentary Road Safety Commission to become law. The proposals come into three basic headings that are to prevent overtaking on roads where there are repeatedly accidents, provide additional road signs where there are “black spots” and install more fixed radar detectors, and measures to try and ensure that drivers wear seat belts, or use child restraints. These categories for improved safety measures are considered the cornerstone of the new proposals that require urgent action. Another fifteen other proposals have been presented.

These show whether a driver or the passengers are wearing seat belts, using child restraints, or using a mobile phone or other distraction. As these do not measure speed they can be moved to any location. They are selfcontained so require no connection to an electrical point. 147 fatalities in 2016 were to drivers or passengers not using seat belts, and it is considered that the vast majority would have probably been injured but not killed. The ‘DGT’ will mount a campaign on social media sites to hammer home that the use of seat belts saves lives, and they will include stories from accident victims or relatives of drivers who died.

As regards illegal overtaking or overtaking in general (particularly on secondary roads), the proposal is that double yellow lines are painted where there is a high proportion of accidents, and also “noise strips” down the middle of the road. 250 illuminated panels will be installed on the worse roads that will flash a warning signal when the speed limit is being exceeded. 60 new fixed radar cameras that measure speed and can detect whether seat belts are being used will be installed at key points. On roads where there are a disproportionate number of accidents, often due to speeding, the previous head of the ‘DGT’, María Seguí, introduced the publication of the location of mobile radar detectors on the ‘DGT’ website. Each month the stretches of road where these speed checks are carried out are listed for the general public to consult. This is considered to have been a success and Gregorio Serrano is proposing that more traffic police devote time to these advertised speed traps. Another concern is the number of cyclists or pedestrians who are killed, and a review of speed limits in urban areas will be made. A pedestrian or cyclist hit by a car travelling at 30 km/hr will, in most cases, escape with minor injuries, and deaths are extremely rare. The higher the speed the more likelihood that deaths will occur, and serious injuries. Heavy lorries may be prohibited from travelling on some roads on days or peak times when the number of cyclists is at a maximum. Gregorio Serrano stresses that the prime objective of the ‘DGT’ is to improve road safety, not collect fines.

ast month we explained how banks are scrambling to find ways to avoid the cash refunds that they are faced with from the abusive “cláusulas suelo” interest “floor rates”. Last December, the EU Tribunal ruled that mortgage holders should be given a refund of the overpaid interest from the date the mortgage was taken out. Most banks had already earmarked large sums of money they will have to re-pay, but these amounts will not now be enough. Persuading clients to have the refunds used to reduce the total mortgage amount (so clients pay less money each month), or put into a pension fund, are the main routes that the banks are favouring. A Slap in the Face for Spain

L

ast month we reported how a Spanish couple in December 2010, this court ruled that their human had won an EU court case that compels banks rights had not been violated under the Spanish that had the “abusive” high interest rates in their Constitution. This catapulted their plight into the headlines of the national and international media, but unfortunately did nothing to result in any substantial compensation. Not prepared to give up, the couple then took their complaint to Strasburg. A New System Needed?

W

henever the price of electricity zooms up, there are vigorous complaints that the Spanish system of producing and selling electricity, one of the most expensive in Europe, is flawed and unfair. Bills this January went up alarmingly by as much as 27%, the highest amount since 2013, and a lesser amount in February. The electricity companies (Endesa and Iberdrola are the biggest ones) have a variety of ways of producing electricity, the cheapest sources being hydro-electric dams, wind power, solar, and nuclear power. The most expensive sources are power stations that are fuelled by coal or a “combined-cycle” system where the excess heat from burning gas is used to generate steam that then turns turbines.

37% of our electricity bill is from the electricity we use, with 21% IVA (VAT) charged on top. Each evening at 8.15pm the cost for the following day is published, and the easiest way to see this is to go to www.tarifaluzhora.es.This shows the cheapest cost (always the early hours of the morning) and the highest (always in mid to late evening).

With the really cold weather this January, the demand for electricity was at its highest. Unfortunately, rainfall, wind, and sun, were at minimum levels, so available electricity from these cheap sources was only 33%. The more expensive methods of generating electricity had to provide the difference. Combined with this, there were various other causes that made the cost of electricity more expensive. Oil prices have gone up which affects the cost of buying gas, and there is not enough natural gas in Spain to offset the increased cost. Spain has in the past bought electricity from the 58 nuclear power stations in France (there are only seven in Spain) but technical problems and safety concerns have resulted in twenty plants in France being temporarily shut down. Consequently, there is no surplus capacity to sell to Spain. The other reason why our bills fluctuate so much is the way consumers in Spain have their energy requirements calculated, which is very different to other European countries. Every evening, the demand for the following day is estimated taking into account the weather and likely requirements. The available amount of electricity that can be produced from the various sources is then added into this equation. The combination of supply and demand determines how much we pay. This is calculated for each hour of the following day and

12 million domestic consumers, 49% of users, pay the variable rate ‘PVPC’ that stands for “Precio de Venta al Pequeña Consumidor”, that follows the ups and downs, and the new “intelligent” meters track our use every hour. It is possible to pay a fixed price, but consumer organizations state that over the whole year this is more expensive. We pay by the cost of a megawatt hour (Mwh) which is the same as 1,000 electric water heaters with a 1 kilowatt element on for one hour. On January 25th, this cost peaked at 92 Euros per megawatt and the January average was 71 Euros. In April and May last year the average cost was 25 Euros, so a dramatic difference. In other countries, the monthly cost is the “midrange” average and consumers are not charged hourly for every 24hr period. Apart from this, VAT in the UK is only 5%. This makes a big difference in bills compared to Spain. Cynics say that the electricity providers shut down cheaper power sources for “maintenance”, to artificially raise the cost to consumers. There are fierce demands, again, that the whole Spanish system is drastically overhauled.

A Long Calvary

L

a Infanta Cristina de Borbón is the youngest stated there had been a flurry of emails to and sister of the Spanish King Felipe VI and the from the palace. daughter of ex-King Juan Carlos I and Queen Sofia. Iñaki Urdangarin is an ex-basketball player, and the charges related to activities and concessions in the world of sport in the Balearic Islands. The Spanish equivalent of the Crown Prosecution Service and the Spanish ‘Hacienda’ (tax authority) never charged Cristina with any offence, but the right wing anti-corruption group ‘Manos Limpias’ (Clean Hands) had asked for an 8 year prison term in a private prosecution. They are now accused of the attempted extortion of 3 million Euros from her lawyer in return for dropping their charges against Cristina! On February 17th, three judges from the Provincial Court of Palma de Mallorca made known their deliberations which have taken 8 months. They sentenced Iñaki Urdangarin to 6 years and 3 months in prison (the term requested was 19 years), but found his wife not guilty. She has to pay an amount of 265,000 Euros relating to money she received from her husband’s companies via a credit card used for the benefit of her family. In reality, she will be due for a refund, as this is less than half the amount she had to deposit with the court. Manos Limpias has been ordered to pay more than 50% of her court costs. She spent two hard days in court facing questioning and denied any knowledge of her husband’s actions, and steadfastly maintained he was innocent. One of her husband’s associates has been sentenced to 8 years and 6 months in prison, with lesser sentences for other defendants. The scandal spread to the monarchy when it was revealed there had been discussions about Iñaki Urdangarin’s business activities, and palace officials had brought this to the attention of King Juan Carlos. It was

No member of the royal family has ever been accused of serious offences before, and the Spanish monarchy has steadily distanced themselves from any official contact. In 2014, King Felipe withdrew her title of Duchess of Palma after she refused to renounce it, and her part in any activities where representatives of the royal family were taking part was discontinued. Cristina has worked for the LaCaixa bank for 20 years and lately for their Social Foundation Ága Ján. When the scandal emerged, the family moved to Washington, but recently she has been living in Geneva with her four children and working at the Swiss headquarters of the LaCaixa foundation. When her children have finished their school year in Geneva she intends to move to Lisbon where she will work for the foundation in Portugal, without her husband, but not so far away. Whether she will eventually be reintegrated with the Spanish royal family remains to be seen. She considers that she has been unfairly treated by her brother and her father, who she accuses of “abandoning” her. Her father demanded that she renounced her royal title La Infanta and her position as a fairly remote 6th successor to the Spanish throne, which she also refused to do, partly because of her children. She has kept in regular but discreet contact with her only sister and her mother, Queen Sofia, who has consistently stood by her throughout this very long saga.

Euthanasia in Spain

A

parliamentary debate is to take place in Spain regarding a proposal from the ‘Unidos Podemos’ party. This relates to the legalization of euthanasia in cases where a person considers that they are suffering “intolerably” from a terminal illness. Euthanasia is often called “assisted suicide” and is a highly emotive subject.

With the help of a Spanish organization of doctors, “Derecho a Morir Dignamente” (“Right to a Dignified Death”), José Luis won his right in court in 2014 to be given sufficient sedatives that he died on the day that he chose.

The proposal that the law is changed would also alter the Spanish Criminal Code. In cases where a relative or close friend has helped a person to die at their request, and may have provided or administered drugs or other means themselves, they can be prosecuted. In cases where a police investigation has concluded this was the case, it is fairly unusual that any prosecution takes place. Community News PAWS-PATAS

Then and Now

At our latest ‘First Wednesday’ event, Karen Polansky (PAWSPATAS President) and Janet Franklin (Re-homing Coordinator) spoke about their very early experiences of dealing with sick and abandoned animals and how PAWS-PATAS came to exist. People may think the situation with unwanted animals is bad now, but back in the late 1980s it was far worse – feral animals roamed the streets, the beach and the campo, spreading disease and causing nuisance on a very wide scale. A group of concerned local people and tourists got together and decided something had to be done. After some lobbying, the Ayuntamiento of Vera donated some land where (mainly) dogs could be taken in, receive medical treatment, be cared for and found new homes. From these very humble beginnings, the volunteers built its first shelter until the time came for the land to be taken back by the Ayuntamiento and a new shelter had to be found. Throughout the years, the involvement of Dutch colleagues (notably Renée Fortuin, Rita Rebel and Belinda Meuldijk) became vital. They raised money for a new shelter and undertook to rehome in Holland the dogs that could not be rehomed locally.

The shelter now operated between Los Gallardos and Turre has grown substantially over the years – as has the number of animals looked after (from 25 originally to numbers in the hundreds now). Across all the years, the hard work and support of the public has kept the organisation going – they work tirelessly at the shelter and in the shops, donate money, find other supporters, and keep the show on the road

behind the scenes, too. And the connections built up with re-homing organisations in Holland and the UK have gone from strength to strength. Without their help, PAWSPATAS would not be able to continue. Karen thanked all those who had helped over the years and ended by looking forward to the next phase in the organisation’s development – about which, more later .....

What’s On Águilas Carnival The 3rd and final procession is from 6pm on Saturday, March 4th. This is followed by the closing ceremony and fireworks at midnight. On Friday, March 10th at 9pm there is a carnival Drag Queen competition at the auditorio.

Guy Braunstein & The Hispanian Symphony Orchestra perform a classical concert entitled “Berlin to Almería” on Saturday, March 4th at 9pm, Auditorio Maestro Padilla, Almería city. Guy Braunstein is an internationally famous Israeli violinist and conductor who plays a violin made in 1679. Works performed are Beethoven’s Egmont Overture, and Piano Concerto No 4 with soloist Ambrosio Valero, and Mendelsohn’s Romantic Symphony. Tickets are 18 & 20 Euros in advance, or 22 & 25 Euros at the door. ABBA, The Golden Experience spectacular show seen by more than 500,000 spectators comes to Teatro Cervantes, Almería city, on Saturday, May 13th at 9.30pm. They perform Mozart’s piano & violin Sonata K-377, Saint Saenz Havanaise opus 83, Dvorak’s Romance opus 11, and Johannes Brahm’s Sonata no.2 opus 100. Tickets are 15 Euros. The Torrevieja Symphony Orchestra are in concert at the Águilas auditorio on Friday, March 17th at 9pm. They are performing

Roquetas de Mar “Priscilla: Reina del Desierto El Musical” (Priscilla: Queen of the Desert) is the musical version of the film of the same name, and comes to Roquetas auditorio on

April 6th-9th. Performance times are 8.30pm on April 6th, 10pm on April 7th & 8th, and 5pm on April 9th. It is the adventure of three drag artists travelling in a minibus in Australia. This musical won the “Best musical of 2015” in Madrid, and has been seen by 400,000 spectators. Tickets are 30, 46, & 50 Euros. Concert Tribute Concert for Harvey Defriend, the great supporter of music and musicians, who died last month. A group of musicians whom he loved are getting together to perform a "Concert for Harvey" at 8pm on 5 March no tickets are needed but donations will be collected for the Red Cross, for which Harvey worked tirelessly until hours before his death. Theatre PAWS/PATAS event. Two Pieces from the “Talking Heads” collection by Alan Bennett are being performed at El Bistro restaurant Pueblo Laguna on March 2nd at 7pm. Vera Ayuntamiento and we have been kindly offered the new Vera Auditorium near the bus station to hold the concert. The musicians booked so far are all of a professional standard and include opera, musical theatre, comedy, pop, Cajun plus the Cantante choir with whom Harvey sang. This will be an important event in tribute to a treasured ex-pat.


What’s On Exhibitions “El Gran Encierro” (The great confinement) is an exhibition of works by Emilio Pérez who originated in Madrid but now lives in Almería. He is a celebrated artist, painter, engraver, and sculptor. He specializes in engraving and printing and is the master engraver to the Junta de Andalucía. The exhibition can be seen at the Almería museum until March 26th. Until June 15th next year the museum is open from 9am to 8.30pm, Tuesdays to Saturdays, and 9am to 3.30pm on Sundays. Entrance is free to any EU member, or 1 Euro 50 céntimos for non-EU visitors. Thomas Neukirch has an exhibition of his paintings at Mojácar’s ‘La Fuente’ gallery until 4th March. Born in Germany, he first took up residence in Andalucía as an independent artist in Mojácar and is currently based in Cariatiz. At the closure on March 4th at 6p.m, there will be a "cultural festival", which will include the Mojácar Sansonora Choir, the poetess Beatriz Torres and the philosopher Jose Antonio del Moral. The exhibition hours are Tuesday to Friday from 9am to 1pm and Saturdays and Sundays 10am to 1pm.

All donations of clothes and bric-a-brac are welcomed as they are sold in aid of the charity which provides support to the elderly in the Almanzora area, and all help provided is free of charge. Money raised helps us to run the Information Centre in Avenida Lepanto in Albox, where you can hire equipment or obtain free advice. The Clever Blonde

When his dog died Pete asked the Scientologist Minister if he would conduct a funeral service for his dear dog. The Minister replied, "We can't have funeral services for dogs in the church of Scientology, but the Baptists might do something for your dog." The man said "Thank you Minister, do you think 5,000 dollars would be enough to donate for the service?" The Minister replied, "Oh dear me, why didn't you say the dog was a Scientologist"

There was a blonde who just got sick and tired of all the blonde jokes. One evening, she went home and memorized all the state capitals. Back in the office the next day, some guy started telling a dumb blonde joke. She interrupted him with a shrill announcement, "I've had it up to here with these blonde jokes. I want you to know that this blonde went home last night and did something probably none of you could do. I memorized all the state capitals." One of the guys said, "I don't believe you. What is the capital of Nevada?" "N," she answered.

Old School Friend I called an old school friend and asked what he was doing now. He replied that he was currently working on aqua-thermal treatment on ceramics, aluminium and steel, under a constrained environment. I was impressed......On further enquiry, I learnt that he was washing dishes, with hot water, under his wife's supervision.

A Drunk’s Prayer A drunk was staggering home with a bottle of booze in his back pocket when he slipped and fell heavily. Struggling to his feet he felt something wet running down his leg. “Please God,” he prayed, “Let it be blood”.

Jail The Baby A woman gets on a bus with her baby. The bus driver says, "That's the ugliest baby that I've ever seen. Ugh!" The woman goes to the rear of the bus and sits down, fuming. She says to a man next to her, "The driver just insulted me!" The man says, "You go right up there and tell him off – go ahead, I'll hold your monkey for you."

A friend of mine got sent to jail and completely lost his temper as soon as he got there. Thirty seconds later, he punched another guy, that guy went down, and a huge fight broke out. There was a lot of blood, a lot of swearing, and the whole time my buddy was just swinging wildly and shouting absolute nonsense. We don't play Monopoly together anymore.

The Clothes The Gun A man walks into the bar waving his gun around yelling, "I have a 45 calibre Colt 1911 with a seven round magazine plus one in the chamber, and I want to know who's been sleeping with my wife!" A voice from the back of the room called out, "You're gonna need more ammo!"

My sister asked me to take off her clothes. So I took off her shirt. Then she said, “Take off my skirt.” So I took off her skirt. “Take off my shoes.” I took off her shoes. “Now take off my bra and panties.” So I took them off. Then she looked at me and said, “Pete, I don’t want to catch you wearing my things ever again.”

Jogging Today I came home from work, out of breath and sweaty. My wife asked me what happened, to which I replied, "I saved 2 Euros by jogging behind the bus instead of riding on it." Instead of looking pleased, my wife looked annoyed. "Bloody moron," she said, "If you had jogged behind a taxi you could have saved 20 Euros!"

Meat A guy walks into a bar and sees three pieces of meat hanging from the ceiling. The guy asks, “What’s this about?” The bartender replies, “Well, if you can jump up and slap the meat, you get free drinks for the rest of the night. If you miss, you pay for everyone’s drinks for the next hour. You wanna do it?” The guy replies, “Nah, the steaks are too high.”

A father shows up at his daughter’s home and finds his son-in-law angrily packing his bags. “What’s wrong?” he asks. “I sent a text to my wife that I was coming home today from my golfing trip. And what did I find when I walked through the door? Her making out with Joe Murphy! I’m leaving!” “Now, calm down,” says his father-in-law. “There must be a simple explanation. I’ll find out what happened.” Moments later he reappears. “I told you there was a simple explanation, and there is,” he says. “She never got your text.”

Two Boats There was a preacher who fell in the ocean and he couldn't swim. When a boat came by, the captain yelled, "Do you need help, sir?" The preacher calmly said, "No, God will save me." A little later, another boat came by and a fisherman asked, "Hey, do you need help?" The preacher replied again, "No, God will save me." Eventually the preacher drowned and went to heaven. The preacher asked God, "Why didn't you save me?" God replied, "Fool, I sent you two boats”.

The Old Boyfriend A Woman Shoots Her Husband A police officer jumps into his squad car responding to an emergency call, goes to theaddress, and then calls the station. “I have an interesting case here,” he says. “A woman shot her husband for stepping on the floor she just mopped.” “Have you arrested her?” asks the sergeant. “No! Not yet. The floor’s still wet.”

My wife and I were sitting at a table at her high school reunion, and she kept staring at a drunken man swigging his drink as he sat alone at a nearby table. I asked her, "Do you know him?" "Yes", she sighed, "He's my old boyfriend. I understand he took to drinking right after we split up those many years ago, and I hear he hasn't been sober since." "My God!" I said, "Who would think a person could go on celebrating that long?" And then the fight started.
