Welcome to the December − January issue of Property Guide Last year was my first Christmas in the BVI, and it gave me yet another reason to love living here. Highlights from last year’s holidays were Christmas on Main Street, the sand sculpture contest in Cane Garden Bay and an impromptu Hanukkah feast in Shannon on Christmas Eve, then, on Christmas Day, a Secret Santa gift exchange in Road Town followed by a beach day at Josiah’s then Christmas dinner on the tugboat Lakota with the Paull-Rowlettes in Nanny Cay. Though I was away from family, I felt (almost) as loved and spoiled as I have in years past. A perfect place for BVI residents and visitors to spoil themselves this holiday season is at The Sugar Mill Hotel and Restaurant in Apple Bay. Owen visited The Sugar Mill and discovered why it was voted by concierge.com as “One of the Twelve Most Romantic Dining Rooms in the World.” I also felt spoiled touring the various properties for sale on the Islands as I imagined what I would do if I owned them. The new lots available at Little Bay emphasize peaceful privacy. Virgin Gorda’s ultra-exclusive Oil Nut Bay focuses on nature and family. Surfshore Villa above Trunk Bay emulates the concept of compact luxury, a concept I can relate to in my studio apartment. Speaking of my lodgings, I have found the first problem with my studio—it’s furnished! This wasn’t an issue at all until I completely fell in love with the furniture featured in this month’s magazine. Both Arawak Interiors and House of Wonders sell furniture made from retired wooden boats. I love the idea of furnishing my apartment with recycled, reused wood. Arawak Interiors’ new designs are made from painted Balinese fishing boats. The old wood with worn paint epitomizes the concept of Caribbean shabby chic. House of Wonders’ fashions their furniture from boats made from African hardwoods. I imagine mixing the two types of furniture among my apartment’s crisp white walls, pine cathedral ceilings and terra cotta tile floors. I have done a lot of imagining lately, possibly because the holidays spark daydreaming, but the holidays are also a time when dreams come true. Steve Fox from OBM International explains how an architect can help property owners make their dream homes into realities by taking advantage of the architect’s expertise. Off ThE GRID? IT'S NOT ThAT SIMPLE A country better suited to contemporary visions of sustainable energy and renewable resources than the BVI is hard to imagine. Smart people, such as Sir Richard Branson, David Johnson and others have all put their voices and their wallets to further the cause of sustainability and environmental responsibility, yet viable projects seem few and far between. Any fantasies concerning a country running on sunbeams and sea breezes have faded in the face of economic strictures and technical reality, not to mention political entropy. Still, the idea of free and infinitely available energy is as seductive as lifetime free beer. But how viable is it really? One of the first issues we confronted was that of regulation. What does the BVI permit in terms of alternative energy generation? According to Jacco Bos, Managing Director of Alternative Energy Systems of Road Town, “the regulations prohibit independent people generating their own power unless, of course, you have no grid power available to you.” Most households and businesses have their own backup diesel generators that are tied to the grid and can sense when the national power supply falters and can automatically kick in to provide power until such time as the government-supplied energy is available again. These systems, however, are not permitted to supply primary power to the household, nor can they supply power back into the grid. Domestic systems with the capability of putting power back into the grid “is where the big opportunity really is for the Caribbean,” Bos said. “If you had a thousand houses all with a onekilowatt solar array, it's a megawatt of power. One of the reasons solar is being promoted in North America and Canada is that it offsets peak demand. If peak

“A lot of the houses we are decorating embrace the contemporary style, but they’re missing the Caribbean charm. It's nice to throw in a rustic piece to add a little character to the room."

“There’s a place called the Malacca Straits which is a hot pirate area where some of these boats come from. So your furniture could be made from old pirate ships,” Roy mischievously adds.

On his last trip to Bali, Roy Keegan came across a restaurant filled with funky painted furniture— everything from the dining chairs to the art on the walls to the hostess stand. The pieces, he learned, were made from former Balinese fishing boats. He’d remembered seeing a similar piece outside a storefront on one of his prior trips. “It can take me a few days to relocate something from a previous trip over the last 12 years. A lot of the side roads have no names and no numbering system. It's a great feeling, like finding a needle in a haystack when you eventually find the supplier you are looking for. After talking to the supplier, we came up with some custom pieces for our Cooper Island project. I cant wait to see these in place when the restaurant opens for the season." PG

“On every trip I take to Bali, I find something new and completely different,” Roy says. One accent piece could be enough to brighten an entire room.

“Cooper Island’s got it right,” Roy comments as we look at more photos from the restaurant in Bali. “I’m getting them barstools and custom dining tables. They’re doing a mix of modern and old.”

Too Cool for The Pool?

We live in a tropical climate, and I’m sure few people feel sorry for us when we talk about how chilly the weather gets around the winter holidays, but for those living in hilltop properties, it’s time to unpack the blankets and duvets and exchange shorts and t-shirts for jeans and sweaters. Wind speeds can reach up to 20 knots during this time of year, and on the hillsides, the average wind speed is 5 to 10 knots higher than it is in town or at sea level.

Many homeowners have swimming pools that they find are too cold to enjoy during the winter months, but that does not have to be the case.When speaking with Erick Oeseburg from Poolworks about how to efficiently heat a pool during the colder season, I first ask about dark-bottomed pools. “A darkbottomed pool can make a five- to six-degree difference in temperature,” Erick says. “But the wind factor here will cool off a pool more than anything.” Erick recommends heating pools that are located on properties that are above 700 feet in altitude. Solar covers are always an option for heating a pool during the winter months, but Erick reminds me that most people don’t want to cover their pools. “One of the reasons you have your pool is for the aesthetic value, so why would you want to cover it?” Additionally, a solar cover must be removed and stored each time someone wants to use the pool which makes the idea of a “quick dip in the pool” less appealing. Instead of a solar cover, another option is using solar panels that are especially efficient during the winter months when there is plenty of sun.The main factor for homeowners to consider when choosing solar panels is that the amount of panel area increases as the

volume of water and desired temperature increases. A company such as AES can advise homeowners how to best outift their homes with solar panels. A pool should add to the beauty of a property’s outdoor scenery and also provide a place for homeowners and guests to relax and socialize year round. Solar panels work for heating a pool, but they are not always the most attractive additions to a property. A standard air source heat pump is often the most practical option for heating a pool during the cooler season, especially since most homeowners only have to use it for a few months of the year. Electric air source heat pumps work by extracting the heat from sunwarmed air then using a compressor to increase the temperature and transferring it to the water of the pool. This type of pump is more efficient than a standard resistance heater, using about 1/3 to ¼ of the amount of electricity, according to Wikipedia. Also, an air source heat pump is typically small enough to conceal in a bench or cupboard, so there is nothing to detract from property owners’ lovely backyard views. A warm pool can be one of the best ways to ward off the winter blues and also a great way to liven up holiday entertaining. A closet full of soft, thick towels and fuzzy robes nearby will make the transition out of the pool even more comforting. PG

Construction on a Caribbean island may sound exotic, but it can be a difficult process. Construction Managers (CM) face a number of unique challenges. Issues the CM must confront include site logistics, infrastructure, labour, materials, shipping and local regulations and support. In addition, each island may have its own unique challenges not mentioned here but nevertheless requiring an experienced CM’s focused consideration. Site Logistics Depending upon the island, construction sites may vary from rocky terrain to sandy coral shelf. Typically, roads to the site are either nonexistent or poorly built, so transporting materials to the site will become a major task. Almost all materials will have to come in via shipping container. This may require an upgrade of the roads to the site or the construction of a dock in order to land the barges. This process needs to be planned and tracked carefully because you cannot go down to the local supply store and get the materials you find you are missing. Infrastructure Most projects need to have their own water, power and sewage plants capable of providing fresh water (typically by reverse osmosis), power (typically by diesel generator) and handling wastewater (typically by wastewater plants). These plants will form the basis of the facilities operations and need to be planned carefully not only for initial construction location and sizing, but for ongoing operations once the project is up and running. When renovating existing properties, we often find the plants require massive repairs. These projects

require the same planning and eye to the future as do new construction projects. Labour Large construction projects in the Caribbean often rely on a multinational labour force. Although we utilize to the maximum local trade contractors, many locations may simply not have available the sufficient labour. Bringing in large numbers of off-island labour may not be allowed or may be strictly regulated by the local government, and it is therefore critical that the work rules and regulations are understood. Plans need to be made for where to house and feed the labour. These cost and planning issues must be considered. The labour productivity rate of a multinational labour force must be evaluated and considered in developing the project timeline. Materials While many of the materials will come from international locations, all construction projects need to have concrete materials, and in the Caribbean this may mean setting up and operating an onsite batch plant. Due to the ongoing shortage in cement, even if there is a

good concrete company on the island, the plant’s capacities must be carefully analyzed to ensure that the project's needs will be met. Local Regulations and Project Support Local regulations and project support will play a large role in the development of your facility, and it will assist with permits and other regulatory hurdles. In the Virgin Islands, there is a detailed procedure for reviewing developments. To ensure the project will be a success, the developer needs to become familiar with the local regulations and understand the processes during the due diligence period. But Wait … There’s More These are just some of the hurdles to overcome when planning and constructing a project in the islands. Of course, there are perks: warm sunshine, tropical trade winds, turquoise waters, gorgeous views and a laid-back way of life that’s hard not to love. Surfshore Villa by Traci O'Dea

As I enter through the gate of Surfshore Villa, I’m first struck by the bright colours. The shades used in the house’s exteriors and interiors seem plucked from the blooming hillside garden—plumbago purple, oleander pink, bougainvillea red, allamanda yellow and papaya-stalk green. The open, tiled courtyard between the parking area and the house is flanked, to the right, by a cobalt blue tiled pool and hardwood deck and, to the left, a covered outdoor grilling area. Beyond the pool and deck is the view overlooking the very private Trunk Bay beach, Guana Island, Great Camanoe, Virgin Gorda and the Dogs.

from the house-spanning deck, I watch shorebirds soar below and listen to the waves drumming against the beach. The wet, black granite boulders of Rogue’s Bay Point seem to be outlined in fluctuating white froth against the mouthwash-blue sea. One railing of the deck is actually a bench, and, along with several synthetic rattan chairs, serves as seating for the long, teak dining table. I’m impressed with architect Matthew Collins’ multi-functional use of space. The deck also includes an outdoor living area with two large oval loungers and a coffee table, a perfect place to while away a Sunday afternoon. Sliding glass doors connect the outdoor lounging area to the indoor living room and open kitchen. Once inside, I realize this is the first time since I’ve moved to the BVI where I’ve clearly seen Frank Lloyd Wright’s influence in the architecture, furnishings and finishes of a home. The earthiness and low, horizontal lines remind me of Wright’s interiors, and the compactness and utility are similar to Wright’s Usonian home designs. Every space and furnishing is functional and thoughtfully located: solid andiroba bookcases and cabinets built in to the far wall of the living room serve as a desk area; a slender closet beneath the stairs utilizes a space that’s typically overlooked; the sleek lines of the Miele oven and espresso machine look like modern art set in to the solid maple cabinets. The stairway, which winds between the kitchen and living room, leads up to the second-floor bedrooms while saloon doors at the end of the living room lead to the master bedroom and bath. The master bedroom is bright and airy with a corner breeze and sliding glass doors that open up to the deck and its vista of sand, sea, sky, island hillsides and rocky outcroppings. A perfect place to wake up and stretch before starting the day. When I step into the master bathroom, I notice more echoes of Frank Lloyd Wright in the narrow, wide tiles on the main wall, the pebbled flooring in the shower and the crosshatch framework around the screened-in, extra-deep bathtub. With its jaw-dropping corner views, the elegant white bathtub is another example of the compact luxury of the house’s design that also maximizes the beauty of the natural landscape. Outside the bathroom is a small private deck.

Back through the saloon doors, over the Italian porcelain-tiled floors and up the stairs to the second floor, I appreciate the beauty of the pre-finished Cumaru. The stairs open up to the second-floor sitting area and a large balcony. Again, the views impress, and I wish I had a zipline to the yawning beach below. The upstairs bathroom has double sinks and a red-tiled shower with small, painted glass accent tiles reminiscent of Chinese bamboo brush paintings. Each full-sized upstairs bedroom has the same whitewashed tongue and groove, pickled pine ceilings as the rest of the house. The final bedroom is nestled on the other side of the courtyard in the guest house. The guest house maintains the theme of the rest of the residence with bright colours mixed with earth tones, porcelain-tiled floors and double sliding doors to the deck. The bathroom has a solid pine vanity, porcelain sink and a tiled shower that shares the view across the Channel. Outside, the pool impresses. The criss-cross pattern is repeated both in the pool and the courtyard tiling. Two bright orange loungers add another splash of colour to the scene. A few steps down from the courtyard, a small path leads out of the foliage to several large boulders and yet another spot from which to imbibe the landscape. I can imagine spreading a blanket and having a picnic atop the hill overlooking the splendour below. When I spoke with architect Matthew Collins from Caribbean Architecture Limited about Surfshore Villa which he built in 2008, he told me that Trunk Bay was the perfect location because of its easy access to Road Town and the rest of the island. Also, he said, “The views to the northeast are fantastic, and since the lot faces northeast, it catches the breeze and is cool and shady in the afternoons. The beach is virgin and unspoiled and is a short walk away.” Matthew was the first to build in Trunk Bay’s new covenanted development, where restrictions are in place “to prevent unsuitable building or activities” including height restrictions so the houses seems to blend into the hillside. He adds, “The services are all underground, so there are no unsightly poles or hanging wires.” The community’s desire for a certain standard of building fits with Matthew’s firm’s philosophy of “modern, very clean, contemporary” design. But Surfshore Villa does more than just meet the covenant’s standards. It has been also been outfitted with the best appliances, materials and furnishings to provide a luxurious living experience. THE QUIET CONSCIENCE OF WOOD by Owen Waters

To me, wooden planks, as well as the trunks from which they are fashioned, have always had a deeper mystery of strength and quiet confidence.The morphing of style is a part of Caribbean culture and history, and it is revealed in furniture. Early colonists, wanting to replicate European styles, used mahogany in the Caribbean to create furniture, albeit the pieces tended to be more rugged in appearance than their dainty European counterparts. Once they were transported back to Europe, a mass export of mahogany began. Now we’re importing wood from another source—Tanzania. Century-old dhows, hardwood-built Indian Ocean sailing vessels with wood cured from years of a life on the sea and under the sun. They are then refashioned by European designers influenced by living in the Mediterranean, Africa and the Caribbean. House of Wonders is the name of the importers bringing these boats, in the shape of furniture and accent pieces, to our shores. The pieces almost look as though the wood grew into the shapes. The smooth exterior of hand-carved pieces creates an immediate sense of depth. This is exactly what the wood is though, steeped in history and already well travelled before it starts a new journey in a home on the BVI. The dhows in Tanzania are handpicked by a team of scouts, individual project managers, who break down the derelict boats and bring them to workshops for the artisans, the fundis. The former owners of the boat are rewarded in funds that transfer to newer boats to keep them in employment or creating new sources of business. Most of those businesses are family orientated and passed from generation to generation. Such is the old way of things.

Residents of the BVI recognize Little Bay as the up and coming premier neighbourhood on the Islands. Recently, new sections of land have been released for sale in the beachside cove. These developments will work together to create a luxury community. The theme of the new community at Little Bay is forward-thinking, conscientious construction in a quiet, private, beachfront setting situated in one of the most ideal locations on Tortola.

The idea behind construction at Little Bay is “green luxury.” Large trees provide shade, including some of the tallest coconut palm trees on Tortola. In addition to the vegetation that’s native to the hillside, Little Bay has a nursery full of fruit-bearing trees—banana, soursop, papaya, lime—as well as flowering plants, trees and shrubs that are used for landscaping the property. Inspect the drawings carefully and imagine yourself inhabiting the house. Do the spaces work for their intended purposes? Does the flow and circulation work? Do you like the way it looks? Are the different finishes, doors and windows and built-ins what you wanted? Construction Documents, Bidding and Negotiation Once the direction is established and the design is understood and approved, the architect works with the structural and civil engineers, and the mechanical, electrical and plumbing engineers, to coordinate their input. On smaller projects, the architect is often required to do the layouts of the electrical and plumbing systems. The architect and their


consultants thus develop dimensioned technical drawings suitable for construction. Once the construction drawings are complete and the Building Permit has been approved, the architect can help you interview and hire the general contractor and negotiate a contract. On Site Once the project is on site, the architect should visit the construction site on a regular basis, to ensure work is on schedule, the drawings are being followed correctly, and the standard of workmanship is up to par. He or she can also certify payments and may mediate minor conflicts between you and the contractor. As the construction takes shape, the architect can manage changes that might arise. Even minor details like adding or moving a window mean amending drawings, readjusting your budget and creating a “change order” to keep control of costs. Ensure there is an appropriate paper trail and that you have final approval on any potential cost changes before the work is done. When the work is finished and the utilities are turned on, walk through the structure with the architect and prepare a final “punch list” of workmanship corrections and nonfunctioning items for the xontractor. The warranty period (usually one

year) begins once all these details are corrected and the final payment is made. Results Too often in the BVI, we see unattractive buildings which don’t work well: steep stairs, awkward unusable areas, wasteful spaces, an absence of natural light and ventilation, severe and unnecessary cuts in the hillside. These are usually the consequences of a lack of thought and design consideration, which often result from limited fees, compressed time frames, or from simply not having the knowledge and experience to avoid these errors. The value of hiring an architect should be apparent in the results. Well-designed buildings are efficient, sit comfortably on the site, and are well oriented for views, breezes and shading. And although beauty is in the eye of the beholder, the building should be a well-proportioned and wellorganised reflection of the owner’s tastes. You may have a reasonable concept of what you’re aiming for when you start the design process, but with a good architect on your side, your ideas will be developed, improved and executed with style while saving you time and money. When Jeff and Jinx took over the Mill in the early 80s, they were both involved in writing up to 50 articles for several periodicals including Travel and Leisure as well as radio shows and art commissions. They were invited by the Caribbean hotel Commerce Association to judge a contest based on their expertise. The owner of the Sugar Mill at the time was looking for a couple to manage the property with first refusal to take over the property when the time came. “What I could tell you about the 70s Caribbean…” laughs Jeff as we tuck in to our Old English cheddar burgers with homemade scotch bonnet sauce. “Our biggest investment was for computers, the first on the islands and at $13,000 for a 64k computer. That’s a lot of money now and one whole lot of money then. At least we could send our articles off by doing them only once, giving us more

time for the hotel and phone calls to the overseas world. We booked with St Thomas exchange through Cable and Wireless, which took 45 patient minutes to get the call out.” My cell phone hasn’t rung once since our meeting. Bliss, I think. To put it delicately and to add humor, Jeff and Jinx recall how the former owner was very frugal about renting space. “An old workshop was converted into the honeymoon suite with yellow automobile paint. We referred to it as the termite suite and knew it had to change. We had our fingers crossed for any honeymooners spending their nights there! That room is now the Plantation House which we built over in the fashion we would want our guests to enjoy a honeymoon on the island.” It has taken twenty years to completely renovate, rebuild and refurbish every inch of the five-acre historical site. These days, honeymoons and small weddings are treasured at

the Sugar Mill. “They are always very intimate,” smiles Jinx, “and guests turn into friends that return to visit with other friends they have met here.” I can see why. The historical mill is still in place; it was the 1989 hurricane Hugo that prompted the revamp, leaving only the mill, kitchen and a few rooms intact. General Manager then and now, Patrick put a patiently waited call to the Morgans, then overseas, to get ready in six weeks for their opening that year. The returning guests chipped in as well. Some of those guests come back every year. Everything came together when local father and son architectural team Roger and Thor Downing were commissioned to design the expansion of the hotel. A practical approach that changed the face and interior of the property began on the Morgans’ behalf. Stronger, modern and aesthetically appropriate renovations maintained harmony with the island and the foundations of the Sugar Mill. These days, the Mill runs its season at 87 percent occupancy and its

As we tour the rooms with the staff, I am charmed by the detailing of each room. As I stand back to get out of the way of our photographer, I am approached by one of the housekeepers who greets me with the warmest welcome and is inquisitive to know where I am from and how I came to visit the shores. I tell her it’s a story nearly ten tears old as I live and work on the island. She beams and welcomes me anyway, telling me that as I live amongst the people, I have been blessed to stay longer than a week or two. I agree cordially and begin examining the rooms again, each with a uniformed etiquette of West Indian pastels and rattan furniture. View is important and every room can not only hear the sea, but see it and listen to the chatter of the palms and grapefruit trees in the trade winds. Rooms are distinctive by their names and in simplicity separated into the pool studios, deluxe studios and apartments of the Villa, Cottage and Plantation. It is standard to have wifi, microwave,

While Oil Nut Bay boasts more luxury amenities and features than a homeowner could wish for, ONB goes beyond local regulations and requirements to guarantee a low-density, sustainable community. The Process of Owning a Property

THE LEGALITIES The conveyance of a property (i.e. the transfer of title) at times can be a daunting and complex procedure for the uninitiated. It is therefore helpful to have an understanding of the legal processes involved.The conveyance of a property is best carried out by a legal representative whose responsibility it is to ensure that the client receives the necessary guidance as to their rights and obligations. After arriving at an agreement in principle, each party must contact their respective legal advisor and inform them of their intention to purchase/sell the property. Preliminary activities such as title searches and survey reports are conducted by the attorney to verify ownership of the property, to determine whether any encumbrances exist and to ensure that there are no legal impediments preventing a transfer of title. The purchaser’s attorney usually prepares an Offer Letter to the vendor’s attorney containing the proposed terms on which the property is to be purchased. Once agreement has been reached on the terms of the offer, a written contract (the “Sale Agreement”) must be prepared to give effect to the agreement. After the Sale Agreement has been finalized, it is signed and witnessed by both parties, and the deposit and further payment made by the purchaser.The amount of the deposit can vary from 5%-10% of the purchase price and is usually agreed between the parties. Any special requirements, such as the need to obtain a Non-Belonger Land Holding License (NBLHL) or obtaining mortgage financing are addressed at this initial stage. Should the purchaser require a NBLHL, completion of the sale would be subject to obtaining the license. Prospective purchasers are best advised

to discuss this with their attorney beforehand, as the processing of a NBLHL can take upwards of three months. Additionally, it is advisable that purchasers who intend to seek mortgage financing, begin to make the necessary arrangements to obtain financing to complete the transaction. After each party has signed off on the Sale Agreement, the executed Agreement is then forwarded to the Inland Revenue Department for the assessment and payment of Stamp Duty. Stamp Duty is assessed on the higher of the valuation amount or the purchase price. A valuation report, which would reflect the market value of the property, is therefore required. This would be submitted together with the Sale Agreement. The applicable Stamp Duty rates are four percent (4%) for Belonger purchasers and twelve percent (12%) for to Non-belongers. The Sale Agreement would stipulate how the outstanding balance of the purchase price is to be paid—the time frame within which this is to be done and the apportionment of the associated closing costs. The purchaser will be required to provide a Letter of Commitment from a financial institution. In cases where the purchaser has obtained a mortgage for the purchase of the property, a charge would be registered against the property in favour of the bank in order to protect

the bank’s interest in the property. This would be done by the bank prior to the disbursement of the mortgage proceeds. After payment of the relevant duties, the Sale Agreement, together with the Instrument of Transfer, is submitted to the Land Registry Department for the registration of the transfer to be effected. Proof of the purchaser’s capacity to hold the land must also be submitted. Evidence of this can take the form of a copy of the applicant’s Belonger Card or British Virgin Islands Passport or the registered Non-Belonger Land Holding License. It is a required that NBLHL be first registered with the Land Registry although it may be submitted together with the transfer documents. After the registration of the transfer by the Land Registry, an endorsed copy of the Transfer Instrument is returned to the Transferee as evidence of the transfer. The applicant can also obtain a certified copy of the Land Register after transfer. At this stage, the purchaser becomes the new legal owner and takes legal possession of the property. Buying a property is an important decision. Having an understanding of the processes and the guidance of a competent legal advisor to assist you through the process is imperative to ensure mitigation of potential legal hurdles. PG
