letter from the editor Welcome to the June issue of Property Guide. Sometimes when I'm in the office and on the computer for too long, I forget that I'm actually in the Caribbean. Landholders License Changes & Extensions

Presently, the Non-Belongers Land Holding Regulation Act requires any Non-Belonger desirous of purchasing property to first obtain a Non-Belongers Landholding License (NBLHL). A NBLHL usually attaches specific conditions and/or restrictions to the use of the property. What are the consequences of not completing the required development within the prescribed time? What happens should the property owner decide to make design changes to a property after obtaining a NBLHL? There are two scenarios which may exist at the time a NBLHL is granted to the property owner: where the land owned is undeveloped or where an existing structure is already in place on the land. In the case of undeveloped land, when applying for a License, the potential Licensee is required to set out the intended use and the nature and extent of the structure to be constructed on the property. For example the number of bed, bathrooms and any ancillary structure such as a swimming pool.The approval of the License is issued on the condition that the landowner completes the development in accordance with this intended use and the plan as outlined. The Town and Country Planning Authority, as part of their approval process prior to the commencement of construction activity, is required to ensure that any development plan submitted for approval accords with the development required by the License. The Licensee will be required to carry out the development within a specified timeframe, usually three years. Under the Non-Belonger
Land Holding Regulation Act, a failure to do so within the required time could attract a penalty, which in practice varies from upwards of five percent to a maximum of forty percent of the purchase price of the property. Officers of the Ministry of Natural Resources & Labour may conduct periodic site visits to verify the status of the development of the land and that the conditions of the License are being adhered to. Extension of Time In the event that a development will not be completed before the time allowed by the License, a land owner may make an application in writing to the Ministry of Natural Resources & Labour for an extension of time. Provided the application is made within a reasonable timeframe before the time under the License expires, subject to other requirements, an extension of time, up to one year, may be granted. Design Changes Where a Licensee desires to make structural changes to the building design or to an existing structure beyond what the License prescribes,
permission must first be obtained through an amendment to the original License. An application for an amendment to a License must be made in writing to the Ministry of Natural Resources & Labour. The application must set out the nature of the intended changes in design or use of the property. It is important to note, a License restricts a Non-belonger proprietor from selling, altering or varying the property without first obtaining permission to do so. In the event that a landholder wants to sell his/her property, they must notify the Ministry of Natural Resources & Labour of their intent. Any existing breaches of the License may be identified and associated penalties could apply at this stage. Potential Non-Belonger landowners need to know how to obtain a NBLHL and should also seek guidance on the nature of the applicability of the terms which are likely to be contained in the License. Additionally, professional, legal assistance can serve as an invaluable guide in order to avoid penalties for breaches of the NBLHL whenever a landowner intends to make changes beyond what is provided for in the License. Take the concept of modern resort living of Mooney Bay Estate.Take the tranquility of the North Sound and the romantic feel of your own private cove, complete with watersports, beaches and hike trails.Take the resort brought to life, and since Property Guide's March feature on the estate, refit the interiors to create a feeling of a self-contained island luxury. Redesigning the interior of Mooney Bay was a decisive move to bring the resort up to the highest standards in the BVI. And the undertaking needed the right person with the right eye. Meet Monti Samuel, project manager for Doug Riegels' Mosaka Ventures. She was charged with the redesign of the resort that fits the shape of modern vacationing for the Caribbean. Practically, Mooney Bay can sleep twelve people comfortably with a master suite and five other private units. Mooney Bay Estate is to be manned by a small staff, and Monti and the team have been concentrating on revitalizing the magnificent, 30 year old dwelling. “We wanted to concentrate on the fundamentals of the exterior first—notably the gardens and dock before moving onto the interior layout. Monti’s mission was to try and stay true to the BVI by having as much work done locally or through local suppliers; all the cabinetry and woodwork was done on-island by local construction company AGS, furnishings were selected in conjunction with Arawak on Tortola, upholstery work was handled locally on Virgin Gorda through Jarrett-George Interiors, and industriously, a lot of work was done in-house by their own staff, including the current project to make
all their own vanity and kitchen countertops using stained concrete and aggregate. “My vision for Mooney is simplicity, earthy, wholesome and natural,” said Monti. “To bring the inside out—all our dining and living areas are in the open air—with rough-hewn solid wood tables and the original bamboo seating refinished, all surrounding the natural stone deck pool or gazing across the ocean vista, the gardens with their resident iguanas and teeming mangroves. The kitchen is open and exposed on almost all sides with wooden louvers and screens, lending itself to being in the open while still being enclosed from the elements. We want our guests to enjoy all of the resort and nothing is to be hidden away.” The bathrooms kept all their original terra cotta

Mooney Bay hopes to furnish the rooms with sensitivity, using bamboo-derived linens and towels, to offering eco-friendly products as their amenities, and same for products available for sale to guests, such as clothing, writing utensils and bags. Looking at the development so far, Doug and Monti have to agree. “We are well aware that no resort can be fully ecologically integrated, but every little step we take makes a difference to our world.” PG

It looked like a great team that the homeowners had assembled: the architect; the general contractor; landscape, pool and interior designers; and a small army of consultants from lighting to home automation and video distribution specialists. The meeting was seemingly long, but even if only one thing was achieved that day, it would run its course throughout the project. The homeowner made sure that everyone involved knew exactly what he was looking for. In just about a year and a half from now, when the homeowner would turn on a switch, the landscape designer knew that the light colour would be coordinated with the swimming pool lights, and it would all show up on the elegant touch panels that were dispersed in various locations through the house. The waterfall that was specially tuned such that the calming sounds would drown out the sound of the nearby resort was set to come on only when someone was in the room. This amount of automation does not go in every house. Coordination between all parties involved is key. In most cases, the general contractor coordinates all these different traders and consultants. Today, with a myriad of newly developed technologies with the desire to make homes as efficient as possible, this has become a task that requires a lot more than it has in the past. Many contractors find themselves hiring
specialists to assist in achieving the ultimate goal. It’s all got to work. At some of the larger projects, we see construction managers making the liaison between the workforce and the homeowner, sometimes putting themselves in a precarious position of interdependence. Homeowners want more sophistication, and in our trade, we need to be prepared and schooled to not only build the swimming pool, we also need to be there to see it through and provide ongoing services to ensure that these beautiful structures are enjoyable for their owners. If I had just bought a nice Lamborghini, it would be unlikely I would hand the keys to an 18-yearold. So handing over a complex water shape with automated controls, fill features, waterfalls and automatic chemical dosing systems to the available gardener may not be in the best interest of longevity. During that same initial construction meeting, the long-term requirements of the structure or shape should be put on the table by the builders, so that educated decisions can be made by the clients involved. For many a successful project that was completed on time and on budget, the initial meetings were key to setting the expectations and clearly defining the borders of each field of expertise. Once the stage is set, one can feel a dedication develop, a passion if you will, to let everyone’s expert input to create a result that is better than the sum of all. PG

What a dream it would be if all it took were amazing views of the sparkling waters around the BVI to sell a proper ty. As the proper ty market becomes more competitive, homebuyers have raised their expectations on what they want for their money—whether it's a new build or an existing home. The chances are that houses with great interior design will have more appeal and sell faster. The challenge of a seller is to captivate the buyers’ imaginations the minute they enter the property. Buyers will be enticed by walking into a lifestyle—a home that has been thoughtfully decorated to enhance its best features—more than by empty rooms or rooms partially decorated with cheap furniture.When buyers can visualize themselves happily cooking in a well-appointed kitchen, dining on an amazing outdoor terrace or relaxing in a spa-like bathroom, their emotional attachment has already started to form with the property. And if other criteria such as the number of bedrooms and bathrooms or location are met, it will likely lead to a sale. Many homes in the BVI are sold furnished, something not typical in other countries. Given the logistical challenges and the high costs associated with buying and shipping building supplies and furniture from overseas, it makes sense to do it right the first time. Even if you plan to live in your home for a few years before selling, think ahead. With great interior design, you can create a home that you love and still sell it later as move-in ready. Take, for instance, kitchens and bathrooms. Many buyers will make their decision based on how well designed these rooms are. Given that these are the most expensive rooms to renovate, spending a little more upfront can go a long way. Invest in quality 14
products—buy the best you can, whether you’re buying wall or floor tiles, cabinetry, kitchen appliances, lighting or bathroom and kitchen fixtures such as sinks or faucets, you’ll only benefit later. Style is also important. Products should be selected based on their design and durability, not just their price point.
Selling your property doesn’t have to be the only motivator for good interior design. In any home, well planned layouts that allow for a good flow of traffic and furniture of the correct scale and proportions will greatly enhance a room’s usability and appeal. If you don’t have the time or are not design-oriented, working with a

One of the prerequisites was that the interior design matched its high-end rental price tag—from the designer furniture to the door handles to the lighting, every piece was selected with its target user in mind.

The Walkers Building From Concept to Completion Walkers, an international law firm situated in the heart of Road Town, specializes in investment funds, private equity and capital markets; structured finance, restructuring and corporate insolvency and international commercial litigation. In 2005, the firm was expanding from their original base in Road Town’s Mill Mall, and they wanted to relocate to a larger space that reflected the corporate professionalism they deliver. The Barracks, or the Walkers Building as it is now more commonly known, was under construction with architects Roger Downing & Partner (RDP) at the time that Walkers signed a rental agreement for 9,600 sq ft—an area that could accommodate the existing workforce whilst allowing for future expansion. The Design RDP was asked to design the new Walkers Global commercial space. An initial consultation with the client revealed that the firm wanted to create an interior that reflected an international style. The goal was that when inside the office, the visitor and employee could feel that they were in London, New York or Hong Kong. Only on closer inspection of artwork, indoor plants and friendly smiles would they be reminded that they were in the Caribbean.

The client desired a modern design that wouldn’t become dated in several years and still retained a sense of professionalism. RDP answered this criterion by using a contrasting palette. Maple millwork and desktops, a refreshing change from the dark timbers typically used in law offices, along with white, clean walls contrasted with darker floors of black granite in the lobby area and blue carpet within the office spaces. Frosted glazing was utilized to create privacy without compromising natural daylight, and everything was complemented by satin stainless steel detailing. The new interior was designed to resonate with visitors and to improve the productivity within the office: rethinking the workflow and understanding the workforce’s relationships in order to spatially organize the interior to create a more efficient layout. The narrow and long footprint of the building proved appropriate when analyzing the relationships between lawyers and secretaries. The secretaries sit

conveniently adjacent to the lawyers’ offices, all are situated around the perimeter of the building so that each office has its own view. Large transoms at the upper levels of the offices filter daylight into the central corridor that also has large windows at either end. Service areas such as the mailroom and filing room are located on the third floor; whereas, the public spaces—lobby, conference room and kitchenette—can be found on the fourth floor to take advantage of the best views. On the upper floor, the two conference rooms are located opposite each another, adjacent to the reception. The intention is that during social events or internal conferences, the sliding doors can be opened up to create one large space—designed with flexibility in mind. The Collaboration The design process from concept to completion was a collaborative effort between client, project management (BCQS), contractor (Meridian Construction) and designer. Not only did RDP need to meet the client’s design intentions but also needed to come within the desired budget, time allocated and level of quality. Inspirational ideas that were explored at the concept stage were then refined during the design process without removing the initial ideas that first inspired the client and designer. In this particular example, it is rewarding to see the similarities between concept renderings and realized design—this is always RDP's goal and challenge as design professionals. PG

Four Poster Fantasy A four poster bed draped with yards of white mosquito netting beneath a swirling ceiling fan remains one of the romantic, idealized images of Caribbean living. “People like the ambiance and the cosiness of it,” Roy Keegan of Arawak Interiors told me. “The four posters they used to make in the Caribbean were heavy, chunky beds, quite intricately carved and turned, made from mahogany,” Roy said. Modern interpretations of the bed tend to be sleeker, but they retain the same feel. 18

Roy acquires his beds from Bali. “When we first started buying them,” Roy said, “the sizes weren’t standard, and we couldn’t find mattresses that fit them, so we had to get custom mattresses made to fit the bed,” custom bed linens as well, I thought. “I’ve learned from my mistakes,” Roy continued. “Now I order the bed around the mattress size.” In Indonesia, beds have a history of traditional significance. “When a couple got married, the whole village would carve them a bed,” said Roy. These elaborately carved teak beds loomed over the couple with posts on each corner that supported

a detailed wooden topper. Unfortunately, the tradition of carving a ceremonial wedding bed is not as prevalent today as it used to be, but the wedding beds can still be found in Indondesia. “I might find a headboard from an antique one and then custom make a bed around it in reclaimed teak,” Roy said. But the simpler, classic four poster beds are more popular in the BVI. “They’re one of our bestsellers,” Roy said. And it makes sense. They are a perfect representation of the laid-back, Caribbean lifestyle. PG

Green Living Coral Reefs and Construction

In March 2010, the Executive Director of Reef Check, Dr Gregor Hodgson, spent a week in the BVI to obser ve the condition of our coral reefs. During this week, Dr Hodgson visited the offices of OBMI to host a presentation on the impacts of human development on reefs, and the measures which can be implemented to aid their protection and recover y. The audience included construction professionals, realtors, environmental consultants, contractors, proper ty developers and owners, and representatives from the Town and Countr y Planning and Conser vation and Fisheries Depar tments. As early as 1851, Charles Darwin remarked that sedimentation from freshwater discharge could prevent reef growth. By the 1960s, high-profile news stories about oil spills and DDT led researchers to investigate the potential impacts of these chemicals on marine life. In the 1970s, the first international symposium on coral reefs was held, and researchers became interested in the effects of sedimentation and pollution on coral reefs. By the late 1980s, anecdotal reports of coral reef decline were becoming common. Recreational divers, now armed with underwater cameras, were returning from dives remarking, "It doesn’t look as good as it used to." Scientists were noting that there seemed to be a decline in coral cover, especially in the Caribbean. Dr Hodgson founded Reef Check in 1996 as a community-based monitoring protocol designed to measure the health of coral reefs on a global scale. During his presentation, he described how he has watched every coral reef ecosystem he has studied change almost unrecognizably from the way it used to be. He gave an outline of the critical situation in the global state of coral reefs, with outbreaks of coral disease, coral bleaching, fleshy algae and crown-of-thorns starfish posing a genuine danger to reefs. The causes include the usual list of overfishing, pollution, introduced species and global climate change. In the BVI, although more remote offshore reefs are still relatively healthy, the reefs near
the shore are under considerable stress. Reclamation, where aquatic areas are filled to create solid ground, has happened extensively along the shores of Tortola, on reefs, wetlands, mangroves and shallow coastal waters. While land value may rise for these waterfront areas, there’s a significant loss of the ecological value of these habitats, irreversibly affecting the amount of habitat available to marine organisms. Corals are easily stressed by sediments which smother them, preventing light from reaching them. They are unable to withstand sediment cover for longer than a couple days. The discussion after Dr Hodgson’s presentation focused on what can be done to prevent or minimise siltation. Contractors and excavation equipment operators need to be familiar with the simple methods to prevent and control soil runoff. Engineers and architects need to build solutions into their designs and persistently remind clients of the need for these measures. Government agencies need to educate the public and monitor and enforce proper construction methods. It was pointed out that if things are thought through properly, good design and planning can actually save money and lead to a much more attractive solution. It was very encouraging to hear Dr Gregor Hodgson’s positive attitude: despite the fact that a huge amount of harm has been done, reefs have the ability to recover, and with a creative and intelligent “joined-up” approach, we may yet be able to protect the reefs of the BVI from further damage. State of the Market Time to Jump In?

There is no doubt that the BVI property market is experiencing the first signs of economic recovery. With stock markets on both sides of the Atlantic reaching one-year highs in April, potential investors are starting to dust themselves down and preparing to jump back in to the property market. After a slow 2009, Easter saw an upturn in both visits to property websites and actual viewings. It appears that investors sense that the market is stabilizing, and now might be the time to strike a deal before prices, as they always do in property, start to rise again. Two areas of the market in particular appear to be enjoying a surge of increased activity. Firstly, investors,
who are often belongers and familiar with how things get done, are looking for houses that are on prime sites but may be in need of some renovation. The majority of overseas investors shy away from houses that require substantial work. Such investments are attractive to those with the energy, vision and the know-how to take on such development projects as the return can be significant. Secondly, investors are again seriously looking at buying land to develop. So much of the BVI remains unspoilt and undeveloped, opening up lucrative opportunities for buyers and sellers alike. Whilst old estates such as Belmont and Shannon mature, new development estates such as Cooten Bay and Little Bay offer exciting investments for the long-term. Both these developments offer the buyer
healthy-sized lots with stunning views and secluded beaches along with strong covenants to protect their investment. Demand is building, and with prices forecast to soar in the next ten years, there still remains time for the long-term investor to jump in. So it appears that at last we are seeing off this latest recession, and not before too long. As stated in the 2010 Wealth Report Attitudes Survey, property remains the single largest repository of investment in the world today, given the seemingly guaranteed promise of future long-term return. With reputations and egos sorely tested on the stock and money markets in recent years and prices set to rise, shrewd investors are once again turning to property as the place to invest their hard-earned capital to make a good return.
