letter from the editor Welcome to the May issue of Property Guide. It's the height of spring. I had to hibernate for a spell after BVI Spring Regatta, but now I'm ready to relish the season. The mango tree in front of my apartment is drooping under the weight of fruit that's changed in colour from bright green to dusty rose. On my walk to the bottom of the hill every morning, I pass hibiscus trees brandishing their red and yellow wrinkly flowers and brush up against pink and white oleander blossoms. Many of us live in the BVI for the colours. How different would our vistas be if they were in greyscale? I have a friend, a visual artist, who wants to visit the BVI simply to behold the shades of blue. He thinks all my pictures are Photoshopped. In order to preserve the prismatic beauty of our islands, developers should be conscious of sustainable practices. PG sat down with a few of our associates from different fields to examine the issue of sustainable development in the BVI. Our informal debate barely scratched the surface of the controversial topic, but we were able to begin a lively discussion that I hope will continue over the next few months or even years. Some additional positive practices offered in this issue include designing for longevity, modernising existing structures and updating kitchens with vibrant but useful tools. A burst of colour on the inside evokes the outdoor vistas. And during the springtime, some of those colours are even edible.

Having secured land and the requisite approval from the planning and building authorities, proper ty owners' thoughts turn to the construction of their building. Having conceptualized their ideal structure, they engage the ser vices of an architect to design their building according to their desired specifications. In the planning and execution of any construction project, the preparation of a building plan is among the first steps to be taken, as all new buildings must first be approved by the Building Authority prior to the commencement of any construction activity, and a building plan would form a part of application process. However, having engaged an architect and the design having been completed, who owns the copyright to the design? What are the legal implications should the owners desire to modify the plan? Can the design be reused in the future and by whom? These questions and related issues may not be of foremost consideration in the mind of someone about to carry out a construction project and often arise only after an unfortunate misunderstanding or dispute. Nonetheless, they are issues worthy of consideration so that the required steps may be taken to head off any potential disputes or misunderstandings. The subject matter protected by copyright law is extensive. It does not only include works of an artistic or literary nature; copyright protection also extends to works in other areas such as drawings, including architectural plans, engineering designs and industrial drawings. Design drawings being subject to copyright protection, the determining element as to ownership of the

intellectual property in any such plan would turn on a number of factors, including authorship of the work and the circumstances under which such works are created. In law, the individual who created the protected work is considered the author of the work. As a result of his creation, prima facie, the author maintains ownership of the copyright subject to any agreement to the contrary and certain qualifying criteria. It is not necessarily the case that the individual always owns the protected work, however, as certain exceptions apply to this rule. For example, the copyright of any work created in the course of employment, works made for hire, belongs to the employer as the first legal owner, barring any agreement to the contrary. However, in cases where the work was not created under an employer/employee relationship, but under contract, the legal ownership of the copyright would be determined based on the terms of the contract. In such a scenario, clients hiring design professionals should not only familiarize themselves with their legal rights but ensure that a comprehensive and well drafted contract or engagement letter is done at the initial stage, as any disputes surrounding the later use or modification to a design plan could turn on the terms of the contract or engagement letter. At a minimum, the client should determine or have set out in explicit language in the agreement, the assignment of rights in the work, whether copyright

ownership will be transferred to the client or retained by independent contractor (in this case the architect or engineer), how the design plan may be reused and to what extent a design may be subsequently modified. Modification to a design plan is considered derivative work; the modified design taking its form from an existing version which is subject to copyright protection. If it is desired to modify any design the permission from the copyright holder must first be obtained. However, where a client holds the ultimate right of ownership in any work, he or she would be free to deal with the said work in whichever way they so choose and would not be restricted in issuing any instructions for the modification or variations of the design. A copyright is a personal proprietary right protected by law, infringement of which could result in legal action for damages. Before engaging design professionals, it is advisable that clients become conversant with their rights so that they will be on sound footing in the event that copyright ownership and use of any design should become the subject of dispute. Fun, Funky and Functional Kitchens by Traci O'Dea

I’ve seen and heard horror stories about kitchen renovations—deadlines missed, budgets exceeded. I asked my friend Jean about a kitchen upgrade that I remembered her complaining about on facebook six months ago and was surprised to learn that it had just been completed last week. At one point, she resorted to washing her dishes in the bathroom because of a countertop installation. “Food and the bathroom,” she said, “avoid this combination if at all possible.” Noted. But there are more affordable and less stressful ways to redo an existing kitchen for both aesthetics and utility. Colour is the easiest and most obvious answer to make a quick, dramatic difference, and a new coat of paint can transform any room, but it’s not the only technique to enliven a too-familiar kitchen. I can imagine a set of purple dish towels adding a bright splash to a stainless

steel, dark wood and granite kitchen. Or a set of kitchen knives in tangerine or baby blue. When a tool that serves a purpose is also pretty, I tend to use it more. I’m sure if I had one of those persimmon KitchenAid mixers, I’d be baking every weekend. Another way to improve a kitchen is by making it more efficient. When I asked my sister if she’d encountered any snafus during her recent kitchen rehaul, she said no, but when she had to empty the room for demolition, she was horrified by “realizing how much stuff I had packed into the cabinets.” Jane Keegan from Arawak Interiors has introduced several lines of helpful kitchen products. “We live in a tiny house with hardly any storage,” she said as she pointed out a red rubber and stainless steel trapezoidal cheese grater that folds flat to fit into a drawer. On a nearby shelf, rainbow-coloured nesting bowls also contain a set of measuring cups. Jane cited her history of working on boats


as a reason why she’s conscious of functionality and space limitations. She also mentioned something that I would not have considered—handleability. “When you’re on a boat, you want to have one hand free for holding on,” she said and showed me some brightly hued double bowls for chips and dip and a lime green salad bowl with a handle. A stack of cutting boards, colour-coded for different food types, represent more of Arawak’s design-conscious products. A handled one locks flat for cutting then bends into a scoop shape for easily emptying chopped veggies into a waiting pot. Another one folds into an open triangle with a perforated end for rinsing and draining. They’re attractive and useful, and, because they serve several purposes, they reduce kitchen clutter. Most people renovate their kitchens for beautification or upgraded functionality. These results can be achieved on a small scale without any major inconvenience with the purchase of attractive, multipurpose kitchen tools and accessories. And a minor renovation eliminates the possibility of having to bathe with dirty dishes. PG

Phase One: Concrete Placement

By the time our client showed up on site, he had been awake for hours, making phone calls, directing meetings and making sure that his team members would enjoy the ride on their newly launched venture. At 5:30 AM on a midsummer morning, the site where his new pool was being built was a flurry of activity. Crews rolled out hoses and made the lastminute adjustments to the steel cage that was to be the structural skeleton of this new pool. In the distance, a site manager checked on progress of the barge that had left Tortola about an hour ago.The barge carried four fully loaded trucks of concrete across a relatively choppy Sir Francis Drake Channel.The trucks had been loaded, or batched, at about 2:30 that same morning. Special admixtures, delay set and additives were carefully dosaged to ensure the concrete would stay workable until it was time to unload the truck. The trucks arrived on the island and started their short but arduous voyage through narrow roads to the site.The concrete pumps and compressors were started up, and the cacophony of diesel engines sang their songs as to welcome the first truck to its destination. The lines were cleared and pressurized, and the first concrete reached the hole that was to be a pool. At this time, the pool consisted of a maze of steel rebars of various thicknesses tied together at specific intervals and a myriad of PVC pipes. Both the steel and the pipes

Sustainable Development in the BVI

A Roundtable Discussion

Wikipedia defines sustainable development as “a pattern of resource use that aims to meet human needs while preserving the environment so that these needs can be met not only in the present, but also for future generations.” I sat down with OBMI architect and Green VI co-founder Steve Fox, Shannon Gore from the Conservation and Fisheries Department, Doug Riegels of Mosaka Ventures and PG editor Owen Waters to discuss the practical application of this concept in the BVI. During our roundtable discussion, I learned that sustainable development challenges builders and architects to plan and design in new and creative ways, ways they wouldn’t have otherwise considered if there were no natural restrictions or government-imposed rules. “When OBMI started the masterplan design at Mooney Bay,” Steve Fox said, “we brought in a hydrologist, and it radically changed how we viewed the project. It challenged the preconceptions of the design team. You go in there with ideas of your own, and it sort of throws those out and introduces new ones.” The hydrologist, a specialist who analyses water flow, water management and water resource protection, offered solutions to the potential runoff problem for the proposed development. “That’s what needs to happen,” Shannon Gore enthused, adding that instead of simply attempting to be eco-friendly because it’s a buzzword, working with the natural surroundings will save developers money. “Some developers say, ‘I want this here.’ Regardless of anything. They’re wasting a lot of money on trying to redesign how

Instead, they try to think of some pump that makes it go over the hill and then you have to clean out the drainage area.That costs a lot of money. But it happens.” “When you get the architect and hydrologist together,” Doug Riegels added, “you can actually form some pretty fun stuff. [At Mooney Bay], it all worked

We tied it all together in a very functional manner.” In Mooney Bay, the hydrologist proposed a lagoon at the base of the hillside property, at the site of the current tennis courts, that would keep the sedimentation and runoff from the development from going into the sea. In addition to being functional, the lagoon also became a design feature, complete with its own central island—a possible location for the resort’s spa. “You come out of it with a much more wellrounded approach,” he said then continued, “And you always have to design with the historic flow because

the hill, not the bottom of the hill. Everything is interwoven,” Doug said. “You have your rain; it goes down the ghuts then to the mangroves and ultimately to the reefs.” He then asked the question that is at the crux of the sustainable development debate: “How do you deal with that in a fair and equitable way that is both economically beneficial and environmentally beneficial? It’s expensive, from a developer’s point of view, because the minute you start borrowing money, that interest clock is ticking. There’s that silent urgency.”

He continued, “I think as a general rule of thumb, from a developer’s perspective, there needs to be some rules laid down by the planning department. For example, for the most part, if you know there are coral reefs, I firmly believe for myself that they should remain untouched. They are such a complicated ecosystem. It’s easy transplanting a tree and moving it back and forth, but coral reefs are a very different and delicate matter.” While Doug wishes to work within the limits of the government’s requirements, he added that the current EIA process is not quick, but then said that “any process that’s worthwhile is never going to be quick.” Shannon, on the other hand, doesn’t believe the EIA timeline is long enough. “Most developers take a month or two to complete an EIA.You can’t really understand an area in 60 days, especially if it’s never been touched before. There’s no literature. There’s nothing on it. Considering oceanographic surveys or terrestrial surveys, it takes longer than that. It doesn’t cover temporal processes that may impact the area.” Both agreed that planning regulations need to be more defined. “Something basic,” Shannon said. “If

you just know to explain in your EIA how you’re not going to affect marine waters. It’s pretty simple, but nobody can do that. They can’t figure out mitigation measures.” “It’s a bartering game,” Doug said. “If a developer comes up and give you a straight EIA off the bat, then you’re going to come back and say, ‘This is not bad, but you also need this, this and this.’ There’s no clear path from A to B. You can present a certain project, and there will be different routes open to you. If you want to do something the right way, the routes are so unclear. That’s where the frustration lies.” “[Developers] want to achieve sustainable development,” Shannon said, “but it goes back to the question: How do you achieve that?” She then brought up the fact that the Planning Department currently has planning regulations in draft form. In the meantime, responsible developers who want to conserve resources as well as money benefit from collaborative design brainstorming

sessions, or charettes—like the one with the hydrologist, developer and architects in Mooney Bay—in which experts from different fields offer suggestions for sustainable development. “These are the kind of things that should happen on all developments," Shannon said. "When you go ahead and have everyone involved at the very beginning of the project.” PG

From Start to Finish: Pasea Apartments

BRIEF: The Pasea Apartments were constructed in 1964 so were due for an update. The original owners, based in London, wanted to modernise the spaces, making them more attractive to residents of the BVI. A tight budget, a tight timeline and no original drawings left RDP with some challenging issues to overcome. Our team of in-house architects, engineers and project managers allowed for close coordination with the owner and contractor, Wells Contractors, to provide a spectacular result. PLAN: Two types of apartments were developed: a two bedroom on one level and a three bedroom on two levels. Each bedroom space had maximized views, walk-in closets and en suite bathrooms (one with bathtub).The great room space was combined into one room, and the old balcony was added into the living room.The spaces were designed to maximize cross-ventilation to alleviate the need for AC usage (although it is provided). Eco-friendly materials were used for all the finishes.

KITCHEN: The original galley kitchen was separated by a wall and a slot to pass through food to the dining area. This layout divided the small space even further and made the kitchen hot and disconnected from the rest of the apartment. Original cabinets, mix-matched appliances and out-of-date windows were removed and donated to VISAR (Virgin Islands Search and Rescue), to help fund search and rescue operations, by the client. After the kitchen wall was removed and the ceiling vaulted, the increased perception of space was immediately evident. White and maple custom cabinetry by Wells Woodwork, combined with all the standard modern stainless appliances brought the kitchen into the present. The addition of an island and barstools provided a social connection between the living and cooking areas and made for spectacular views while entertaining or cooking.


The firm presented several photo briefs to the client to help them visualize the proposed result.

BEDROOMS: The original bedrooms had a small balcony and a closet on the view side of the bedroom. Once this space was incorporated into the bedroom, large windows provided views from the bed or desk while still providing some privacy from the outside. The bedroom designs considered that the rooms would be used by a family or a professional, and multiple layouts were drawn to ensure the maximum flexibility for bed and desk installations. These included such things as data points, electrical outlets and cable connections for TV on all the walls. Air conditioning, operable windows and a large ceiling fan provide options for cooling for each occupant. BATHROOMS: Modern faucets and glass shower enclosures provided a new contemporary look and each suite gets a bathtub for those young kids or soaks after a squash game at the nearby sports club. The electrical wiring and fixtures were completely replaced and updated. The existing plumbing connections were reused where possible for cost. Luckily the previous bathrooms typically had connections in locations that worked with the new, updated bathrooms. Light coloured Corian counters coupled with maple woods and coral-like floor and wall tiles were used to achieve a sense of openness. As an architect, it’s very satisfying to complete a project and see a client move into their fresh, new home, with everything bright, clean and crisp. But the real satisfaction is in knowing that the building is designed and built to last. A home should provide shelter, protection and comfort, and should stand up to the elements. Wherever you are in the world, a building should be built to withstand everything that Mother Nature throws at it. This is particularly true here in the Caribbean, where the apparently benign and pleasant climate can be aggressive and harsh when things are left exposed.

The next step is to specify appropriate, high quality materials and to be aware of their needs for long-term maintenance. As with most things in life, you get what you pay for, and the more you’re prepared to spend on an item, the longer it’s likely to last. This applies to most, if not all, building materials and products. The range of choices can be perplexing: stainless steel or bronze door hardware? Aluminium, pvc or hardwood doors and windows? Tile, stone or wooden floors? The options need to be carefully considered, and the potentially higher upfront costs need to be weighed up against the likely reduced long-term maintenance, repair and replacement costs over the life cycle of the building.

All of this is not to imply that the building needs to be built as an indestructible fortress. There’s much to be said for allowing a building to grow old gracefully, to accept and allow natural weathering to take place, to develop its own unique character and to sit in harmony with its natural environment. The Japanese term for this quality is wabisabi—an appreciation of patina and wear, the beauty and imperfection of natural processes. So the best answer may not be high-tech plastic or powder-coated aluminium. Sometimes it’s better to go with good high-quality natural materials which will age beautifully. Choose wisely, and the value of the property will be considerably improved, not to mention its longevity. PG

mind. As we reported in our April issue, one of the more positive attributes of using steel is that it is a product that does not really allow for wastage, as every inch is used or reusable. Add to that 30 years of experience, and the signature of Nautool can be seen on various projects in the BVI, from the airport to the Government administration building as well as many private homes. Certainly the vogue of colonial furniture in the past or postmodern colonial design has been the attributes of teak and mahogany and then their replacement woods, emulated in the same fashion but as is often the case now imported from other regions where the wood can be found and thankfully often recycled. To which stainless, as an implemented structure, is unlikely to become a product that is going to need renewing or have a short shelf life in the tropics. As an alternative substitute or a qualified aesthetic upgrade, it serves as the very essence in the nature of steel as an industrial component, built to last. PG

When given that a property may remain in the same structural state for years without contemplating major changes, it is good to know that a considerable aesthetic and practical development can significantly increase the value of a property. Whilst many will consider a kitchen makeover or paint, very few will consider a staircase refit or railing upgrade. Mike Masters of Nautool considers his work as a single element in overall structural design of buildings. When each client approaches the concept of staircases or railings, like any other design business, it begins with the drawing board and an inspiration morphed with practicality. As we have written before, stainless steel has one of the most enduring qualities for the BVI, given that the foremost variable of damage is actually the weather that we enjoy—sun and wind. WAV files are the original lossless format though they’re too large to be of real use. M4A is effectively Apple's version of MP4, whilst M4P was iTunes' previous copyright-protected version (i.e. it won't play on many MP3 players), and FLAC and Monkey Audio (APE) are two more popular cross-platform lossless formats. Always look at what file formats your portable media or MP3 player can play before buying, and compare to your existing music collection. For example, the iPod won't play WMA, Windows Media Player's default audio format when ripping audio CDs to your computer hard disk (you can change this format to MP3 in WMA’s options). Confused yet?

According to Housing in America: The Next Decade, a new research paper written by John K. McIlwain, the effects of widespread foreclosures and their drain on market values in the US will result in a fundamental change from the long-held notion of homeownership as the ultimate American Dream.

McIlwain suggests that US demographic shifts for the coming years could become major forces in the housing markets of both the US and their second home countries such as the BVI. Aging Baby Boomers (55-64) will continue to work, many will stay in their homes until values recover.This group has lost a very large part of its wealth and ability to invest. Younger Baby Boomers (46-54) also will not be able to sell their homes at what appreciation they intended, and may not move as quickly as in past years.Their ability to purchase second homes will be greatly diminished because of flat incomes and less home equity. And Generation Y, actually larger in number than the baby boomers, has grown up with computer technology.They are less interested in homeownership than previous generations, have smaller incomes, and want walkable, connected communities which are green. McIlwain explains that this disillusionment over homeownership as a way to build wealth could persist for decades to come and to place more emphasis on buying for shelter rather than investment purposes. The shift away from using real estate as a means to build an investment portfolio could be felt throughout the region. He concludes that many will still be able to afford to own vacation homes but the numbers of those 24

We are somewhat fortunate in the BVI that wealth creation is rarely the primary motivator behind buying a home here, although it is considered a relatively secure investment. And our buying audience is broader than just the US. For example, out of 16 waterfront homes sold at Nanny Cay Marina in the past year or two, less than 40% of the buyers are from the US. It’s for this reason that Coldwell Banker BVI actively sought representation from Savills here in the BVI. Savills' network in the UK and Europe,

wealth creation is rarely the primary motivator behind buying a home here after only a few months of our association, has led to a dramatic increase in the level of interest from potential buyers across the Atlantic. Interest generally is definitely up for realistically priced, well designed, well maintained homes. We are fortunate in the BVI because, as mentioned earlier, wealth creation has rarely been the primary decision in ex-pats buying homes.True, most have, and will continue, to do relatively well from their investments. But occasionally in a place as beautiful and unique as the BVI, you can throw economic logic out the window and allow your emotions to have some say in the matter. PG
