Happy autumn and Happy Halloween! This month’s issue has no tricks but very many treats. I finally found my dream apartment in Cane Garden Bay. Every morning I wake up, walk about fifty steps and wade into the warm Atlantic waters for a quick swim before work. Some people need coffee to start their day. I need to submerge. While I've found my perfect rental, Pam Romney of Island Real Estate tries to convince editor Owen Waters that now is the right time to buy. She makes a good argument, so other buyers beware if our own Owen dives into the market. He’s got the inside scoop. Another gentleman with the inside scoop is Roy Keegan of Arawak Interiors, but his scoop is on importing from Indonesia. This month, we tag along for a typical day in Bali with Roy who navigates the city like a pro, on a motorbike, no less. Roy shops for everything from jewelry to building materials for his clients here in the BVI. Our cover feature, North Shore Lookout, sits above Brewers Bay with a view that would be impossible to take for granted. Roy Keegan Shops Indonesia So You Don’t Have To

It’s 7:30am in Bali. Roy Keegan wakes up and has breakfast—an egg and some fruit salad. He skips the rice pudding with grated coconut on top, but gulps down some coffee. “Bali coffee is strong,” he says. “It’ll put hair on your chest.” Equipped with camera and laptop, Roy hops onto his rented motorbike and joins the morning buzz. “Ninety percent of people travel on motorbikes to get around,” Roy tells me. “Whole families—the dad driving, the mom holding a baby on the seat, a young kid in the front holding the handlebars and an older one hanging off the back.” Tucked in his pocket is a list of thirty suppliers he wants to see. He needs to find the perfect “character piece” for a client who has a large, empty wall in Little Bay. With him, he has all the measurements and photos he took before he left Tortola. “Once I get a feel for what the client is looking for, I pursue that avenue. This client had bought an antique carved sideboard from Arawak Interiors, made from old teak, so I knew she liked older pieces.” Once he finds the right supplier, he sends his client images of various suggestions. “A Buddha, carved from teak tree roots, was too dark—she needed a little bit of colour on that wall, as the ceilings are stained quite dark.” She chooses a colourful painted panel on old teak boards. “Once I knew she liked the first panel, I found two more panels to compliment the first one. If I had wanted two identical ones, this supplier would have made them for me, and you wouldn’t be able to tell because he’d use the same old wood and the old techniques.” Both Roy and the client are happy with the three panels he’s chosen. “It’s rewarding being able to find exactly what the client is looking for.” Then, once it arrives in the BVI, Roy will deliver and install it in the house. Roy grabs a quick lunch of Nasi Goreng—a rice dish with bits of vegetables and meat—and visits more suppliers. On his agenda for the afternoon is tile for a wall by the infinity pool at Necker Island. “Necker is Bali-themed, so when Erick Oeseburg from Poolworks was looking to source some tiles for Necker, he showed me a sample of the look he was

going for, and I recognized the stone and finish from a previous visit, but I had never had a reason to check them out.” Roy FedExes the samples to Erick who gets approval from Necker. He then orders the green stone cladding cut to Erick’s specifications. Roy stops for coffee in the afternoon and reevaluates what he’s gotten done and what he still needs to do for the day. I imagine Roy’s days in the BVI are only slightly less active than his days in Bali. “I’ve been doing more special buying,” Roy says. “A lot more requests for stone tiles, wall cladding and other architectural fixtures. Clients visit the showroom and ask about furniture and fixtures before they’ve even broken ground, which gives me loads of time to come up with ideas and samples.” In the evening, he has more coffee and a quick dip in the pool then heads back out on the street. “I might do jewelry or clothing buying in the evening because in the afternoon, it’s pretty hot on the street. This year, I took the family, and they love helping me choose the jewelry and clothing.” At the end of the night, Roy unwinds. “We might have an evening meal with a supplier—Nasi Campur or another rice dish. They like to take you to these out of the way places where they know the cook. They tell me I must be doing well because I’ve gained weight. To them, if you’re looking fat, you’re doing well.” After the evening meal, Roy sits down, goes over all the invoices and prepares to repeat the process tomorrow. PG

The British Virgin Islands House of Assembly has recently passed an amendment to the Non-Belongers Land Holding Regulation Act (Cap 122) (the Principal Act), designed to bolster the regulations governing the acquisition of land by non-belongers.This amendment, the Non-Belongers Land Holding License Regulation (Amendment), Act 2009, is designed to strengthen the rights of belongers while addressing a lacunae in the Principal Act through which non-belongers may acquire and hold land in the BVI without acquiring a license to do so. Prior to the passage of this amendment, nonbelongers and non-belonger companies purchasing land through a bank, in exercise of an interest in the land, such as a power of sale under a mortgage, or auction, were excluded from the necessity of obtaining a Non-Belongers Land Holding License (NBLHL) from the government. This Amendment brings uniformity to the process of acquisition of land by non-belongers. With this amendment, non-belongers desirous of

acquiring properties from commercial banks through foreclosures or auctions will now be required to obtain a NBLHL. This move is designed to give the government greater control over landholdings by nonbelongers while allowing for better and more accurate monitoring and regulation. The measure was also touted as being designed to safeguard and buttress the rights of BVIslanders and their interests in their property. Potential landholders, individuals and bodies corporate are distinguished by reference to whether they are a belonger or non-belonger. Based on this categorization, landholders are accorded different privileges and obligations. As such, there are certain rights enjoyed by belongers in acquiring real estate. The Virgin Islands Constitution Order 2007 (the Constitution) defines a person who belongs to the British Virgin Islands. This includes, among others, any person born in the BVI of a mother or father, who is a British overseas territories citizen (BOTC) by virtue of birth, naturalization or by virtue of descent from a parent born in the BVI, a person who is or was born Jayla Place

in the BVI of a father or mother who belongs to the Virgin Islands, whereas a belonger company would be a company incorporated within the jurisdiction which falls outside the ambit of Section 6 of the NonBelonger Land Holdings Regulation Act which defines non-belonger companies. Some of the rights and privileges enjoyed by belongers include: Land Holding Licence. Whereas non-belongers are required to first obtain a license in order to acquire and hold land in the BVI, belongers enjoy unhindered freedom in acquiring and holding real estate. This extends to undeveloped property. First choice in the purchase of any property for sale in the BVI. Current regulations dictate that potential vendors first advertise the sale of their property for four consecutive weeks in a local newspaper. This is done to give belongers adequate notice of the intended sale of the property and an opportunity to make an offer for the purchase of the property. It is only in the event that no belonger

purchaser consummates an agreement with the vendor that a vendor may proceed to enter an agreement with any non-belonger who desires to purchase the property. In this event, the non-belonger would be required to obtain a NBLHL, where proof of the advertisements must be present as part of the application process. Developmental Commitments. In order to prevent speculation by non-belongers in undeveloped property, licenses are usually issued with attached time-bound developmental commitments. Failure to meet these requirements could attract a pecuniary penalty of up to forty percent of the sale price should a non-belonger proprietor decide to sell the property. Additionally, the vendor would be required to seek the permission of Cabinet. However, belongers face no such hurdle as there are no time-bound requirements for any development of the property nor does the landowner face a penalty in the event of a sale of the undeveloped property. Thus a belonger can acquire

and hold undeveloped property for later development or resale thus benefitting from any capital appreciation that may occur on the property. Taxes. The assessment of Stamp Duty and property taxes is also determined based on the landholder’s status. Belongers enjoy a reduced rate of four percent (4%) for the payment of Stamp Duty versus twelve percent (12%) applicable to non-belongers.The same treatment applies in respect of property taxes where belongers are assessed at a rate of $10 per acre plus $3 for each additional acre of land or any part thereof while non-belongers are taxed at a rate of $50 for the first one-half acre; above one-half acres to one acre $150 plus $50 for each additional acre or part thereof. The property market within the BVI is dynamic and represents an attractive investment option. With the new amendment and the added advantages enjoyed by belongers, property ownership should be considered as a worthwhile investment. PG

Getting advice from a landscape architect before building a dwelling can help property owners plan an additional line of defence against natural hazards as well as compliment the structure of the house. Smith recommends using vines such as the potato and peanut vine, sansevieria and rhoeo or boat lily plant for the same. “These types of plants propagate freely and help keep the soil together. After what felt like a trailblazing experience down the rugged driveway, Maritha Keil and I pull up to North Shore Lookout and its clean, contemporary lines. We walk past a healthy papaya tree, popping with dozens of fruit in various stages of ripeness, before taking a few steps across a Saltillo-tiled corridor. Double doors open to the living room and a staggering view of Brewers Bay.

The canvas-covered sofa and chair, reclaimed teak coffee table and side tables, and brushed metal accent lamps all add to the subtle and soothing feel of the living room, advocating peaceful, uncluttered thought. A large flatscreen TV unobtrusively sits in a corner. On the other side of the couch, an office area with a teak desk, spacious bookshelves and an ergonomic chair spans three large windows that face the hillside. The kitchen, separated from the living area by a counter and a partial wall, dazzles me almost as much as the view. The counters and walls are covered in tiles the colour of chilled blueberries. Solid wood kitchen drawers and cupboards provide ample storage space. Gleaming among the blue and russet backdrop, Viking stainless steel appliances certify this kitchen worthy of a budding chef. The massive side-by-side refrigerator/freezer, stove, oven, microwave, dishwasher, food processor, blender, toaster, coffee maker and cappuccino/espresso machine all carry the Viking logo. On the other side of the living room, through sliding glass doors, a covered, outdoor dining area displays enough seating for ten guests. Shade and a constant breeze guarantee this space as the perfect locale to both start and end the day—I can imagine relishing my morning tea out here as easily as I can picture chilling to music long after the dessert plates have been cleared. This is also the perfect spot for watching the sun set over the Atlantic.

My Winemakers

Seven CourSeS and Fourteen (oopS, Sixteen) GlaSSeS oF Wine Somehow I end up on the VIP boat from Trellis Bay to Guana Island for the July 19th Winemakers Dinner. I quietly sit across from the Deputy Premier and pretend I belong there. I smile when members of the international press snap photos and ask the crew the names of the sandy coves we pass—Long Bay, Josiah’s, Lambert. My smile broadens. I live here. We arrive at Guana with the rain. Dressed in a black and gold kurta, co-chair Ajit George corrals the crowd under tents until covered golf carts haul us up to the top of the hill. Under a small wooden pagoda, Guana’s General Manager Jason Goldberg serves me a glass of Weingut Kirsten’s sparkling Riesling and a small cup of Chef Dwight Hutchinson’s watermelon gazpacho, and the sun returns. The gazpacho, seasoned with kaffir lime leaves, mint, galanga root and salt, surprises me by tasting savoury like soup and not the sweet watermelon juice I expected. Dishes and drinks that please me most are those that shatter my expectations instead of simply living up to them. The hostess from Guana refills my flute of bubbly as a hubcap-sized tortoise shuffles by. I have another gazpacho, sip the last of my wine, and follow a stone path to Jost House for dinner. After listening to the VIPs’ opening remarks, I sit beside Joel Brillert, Special Events Coordinator at Nail Bay. To my delight, the tan, young and fashionable Portuguese winemaking couple Sandra Tavares da Silva and Jorge Serôdio Borges join us at our table. I’m excited because, along with Pio Cesare’s 2004 Barolo, Sandra and Jorge’s 2006 Pintas Character Douro Red from their wine&soul vineyard is one of the wines I’ve been most excited to taste. Joel informs me that two glasses of wine will accompany each of the seven courses. Someone should’ve warned me before I topped up my sparkling at the pagoda. But I promise to rally and sample all the wines, even if I don’t drain every glass. No one can possibly finish fourteen glasses of wine, right? 18

For the first course, Chef Carla Pernambuco plated two juicy, pink shrimp atop a salad of fresh hearts of palm (brought in from Hawaii by Executive Chef Vikram Garg) and a spicy, moist cornbread mini-muffin. I want a dozen more of those muffins. And not just to soak up all the wine. I notice our tablemates Sandra and Jorge don’t empty their glasses. Clearly, they’ve done this before. Clearly, I have not. Chef Alain Ivaldi’s duck foie gras with spicy chutney cherries is accompanied by a wine soup in the next course. After she samples it, Sandra exclaims something in Portuguese to her husband then tries to explain “Pop Rocks” to us without knowing the English word for them. I have a spoonful of the soup and feel the candies ricochet off the roof of my mouth. We keep tasting the soup and giggling. This isn’t exactly what I meant by having my expectations shattered, but I will certainly never forget Pop Rocks soup. The next course, for me, is all about the wine. 2006 Pintas Character Douro Red by wine&soul is up as well as Pio Cesare’s 2004 Barolo, voted Number Six on Wine Spectator’s Top 100 Wines of 2008. I’m certain that Sandra and Jorge’s modest, contemporary wine cannot compete with Pio Cesare’s superstar, but I’m wrong. The Barolo is a wine to savour. The Pintas is a wine to drink. And smile while you’re doing so. And then think about your lovely day of VIP boat rides, deserted beaches, watermelon gazpacho, tortoises, mini-muffins and Pop Rocks and keep smiling until you remember that you still have eight more glasses of wine to taste. Realtors tell me, tell others, “Buy now! Buy now!” “Why?” I challenge Island Real Estate’s Pam Romney, who has been in the business for 30 years and is still going strong. As I sit back in her Road Town office, I ask her to give me her best shot. Convince me. Make me want to buy. “Calculate everything,” advises Pam. “Youth is a blunder, age is a regret.” This is a tricky market for first-time home buyers. “At times like this, with regards to the recession, a lot of people make offers,” says Pam, “but there is no need to play games. We have a real scenario and are prepared to make sacrifices, which is what homeowners do.There has never been a buyer here who walked away,” confirms Pam. “Every investor here has won in property, and very few have regretted the choice, but knuckle down—think about your finances, and be prepared to prioritize.” “If you have to rely on renting your property out for vacation rentals to cover your mortgage—forget it straight away,” says Pam. “There are flippers and keepers, and there are lots of places that will just get you the property stake, but if you cannot factor upkeep and maintenance and a standard, you are out of that game. Look at St Thomas—same area but five times the population.
