I HAVE NEVER BEEN MORE GLUED to a television set as I was on September 6, 2017. My heart was in my throat as a category 5 Hurricane Irma with an eye 400 miles wide chugged a destructive path toward my beloved Virgin Islands. I was frozen on my couch, totally removed from the beautiful Caribbean and knowing that some of the people and places I loved most were going to come under siege very soon. I’ve never felt more helpless. Anyone having to deal with one hurricane – let alone two so powerful – would be distraught, to say the least. But what has surfaced after facing Mother Nature’s wrath has been nothing short of extraordinary. The people of the British Virgin Islands wasted no time in reclaiming their lives. They’ve gathered their collective will and with a joyful spirit began rebuilding. Turning a natural disaster into an opportunity to come back stronger than ever, this issue features inspiring stories about how the BVI is bouncing back. It’s important to not only rebuild but to improve the homes and structures of the islands, so we’re offering a special feature on doors and windows and information on how an architect can make the rebuilding process easier. This issue also kicks off a critical series of pieces on legal matters. The Harneys Series addresses many legal issues our readers may be facing in a posthurricane world, as well as touching on important property-related topics, trade licensing, yacht ownership and more. We’ve also included some beautiful pieces on what’s next for some of the favorite resorts of the BVI, how to both get your sweat on and relax, and how you can have even more fun on the water. The trees and vegetation have become green and are flourishing again. Residents have pulled together to rebuild homes and businesses. The yachting community is grateful to see this beloved sailing destination returning to normal. Resorts have taken the opportunity to update and renew their properties, and are gladly welcoming guests once again. This is the Caribbean way. When faced with adversity so great, many would crumble beneath the sheer weight of what needed to be done. But the people of the BVI know what it means to live in such a special place. The only option was to brush themselves off and get their hands dirty, revealing once again the beauty of their island paradise. I’m honored to serve as guest editor for this issue and am incredibly inspired by the recovery efforts you will read about. Even though I’m no longer a full time island resident, a piece of my heart will always live in the Caribbean. Enjoy the issue, #bvistrong

THERE WAS A NOTABLE decrease in the number of property transactions taking place after the hurricanes last year and it was clear that many prospective buyers put their plans on hold to assess the progression of the recovery. Since the beginning of 2018, we have seen a significant increase in interest from prospective buyers and in the number of property transactions taking place. The majority of property transactions at the moment relate to hurricane-damaged properties that are being sold to buyers with the capital available to repair them. This is a positive sign as it is in nobody’s interest for damaged properties to be left to deteriorate. An increased number of interested buyers should not come as too much of a surprise. The fundamental attractiveness of the BVI remains strong for many reasons, including that the BVI: • is a place of great natural beauty • benefits from a stable political and economic environment • utilises the US Dollar as its currency Damaged property will not appeal to everyone (and for those people there are plenty of properties available for sale which withstood the hurricanes, or have since been repaired) but they do have appeal, because: • some buyers want to build their own home but are put off by the time it can take to design and construct their home from scratch. Even in the case of a property with severe damage, at the very least the foundations, cistern and some of the structure are likely to remain intact, meaning a buyer is able to undertake their project with a good head start • excavations and foundations are often some of the most expensive elements of a construction project in

Where these initial elements have already been completed, buyers may be able to undertake their project more economically than if they were starting from a blank slate • there is a good supply of properties available with motivated sellers in many cases Part of the attraction of buying damaged property lies in its

affordability, not least because of the opportunity for a stamp duty saving. Stamp duty on transfers of property in the BVI is calculated on the higher of the purchase price and market value of the property and is payable at completion. There is currently no form of capital gains or other tax attributable to any increase in property value over time which means there is an opportunity for tax savings on acquiring a lower value,
damaged property and undertaking the necessary repairs, compared with acquiring a higher value, undamaged property. Many properties currently on the market have been damaged to varying degrees and are being sold on an “as-is” basis. But what does the phrase “as-is” actually mean in practice? How does it differ from a regular sale transaction and are there any pitfalls to look out for? A sale on an “as-is” basis essentially means that the seller is selling and the buyer is buying the property in the condition in which it currently is and the buyer accepts the property in that condition. A seller may be selling at a loss or at a price that is below the expected sale price immediately prior to the damage. The buyer should not therefore have any expectation that the property will be repaired by the

seller prior to completion or that the seller will offer warranties as to the state of repair or condition of the property. This may seem a little daunting but this is not so different from the position on a regular sale. Property acquisitions are generally subject to the Latin maxim caveat emptor or “let the buyer beware”. This is the principle that buyers are responsible for undertaking their own due diligence and making sure that the item that is being acquired (whether a property or other asset) is of the required quality and is fit for the purpose for which it will be put. Prudent buyers will therefore undertake due diligence before committing themselves to acquiring a property. This due diligence will ideally take place before agreeing on terms with the seller, though the parties could enter into a sale and purchase agreement and make the sale conditional on due diligence being undertaken to the buyer’s satisfaction. At the very least, a buyer should

undertake a structural survey to determine whether the remaining structure is sound, or whether it will need to be demolished. Caution should be exercised in relation to property that has been subjected to flooding, in case of problems arising from erosion and ground stability. Buyers would also be well advised to obtain estimates from at least two contractors so that they understand the costs and timescales associated with rebuilding. It may be some months between exchanging the sale and purchase agreement and completion taking place, particularly if the buyer has to get a loan or if a non-belonger buyer has to secure the grant of a non-belongers land holding licence. With that in mind, there are certain practical steps that a buyer and seller should consider taking between exchange and completion to protect the property, which is in the interests of both parties: • Securing the property – with the next hurricane season just around the corner, the property should be

made weathertight so that it does not sustain further damage from any adverse weather • Flood prevention – irrespective of whether there is another hurricane this year, there is always the risk of heavy downpours and efforts should be made to clear drainage ditches to reduce the risk of flooding • Removal of debris – efforts should be taken to remove significant debris from the curtilage of the property so that it does not add to the risk of missiles in the event of another hurricane There are undoubtedly opportunities in the BVI property market but now, as always, buyers should do their research, undertake due diligence and engage professional help to guide them through the process. ■

For the lucky few of us that get to enjoy this visitor’s paradise all year long, it’s inspiring and encouraging to see the hillsides green again and buildings and homes being rebuilt. However, the question we are often asked by our clients is: “Is the BVI ready for tourists?” The answer is a resounding “YES!” Here are a few reasons now is the perfect time to book a vacation in the BVI.
Where to stay Short-term rental homes remain one of the most popular ways to experience in the BVI. Vacation villas are in high demand and although some continue to repair storm damage, there are still plenty of incredible luxury villas to choose from. Both Tortola and Virgin Gorda boast an impressive portfolio of beautiful beachfront or mountainside villas, with enough variety to accommodate large gatherings or cozy romantic getaways for two.
What to do These islands appeal to water babies of all abilities and interests. The diving is unsurpassed, the beaches are pristine and it’s one of the world’s most celebrated sailing destinations. The yachting community has almost fully recovered but there is still plenty to do without getting wet. The BVI National Parks Trust has done an incredible job of clearing the hiking paths and nature trails around the BVI. Sage Mountain National Park provides a maze of hikes and trails throughout the BVI’s rainforest and the famous Baths on Virgin Gorda are untouched and continue to draw tourists from around the world to marvel at these natural wonders.

IT’S NO SURPRISE that over the course of my career I’ve been asked many times, “why should I hire an architect?” After all, a draftsman can complete the construction documents more easily. withstands impacts and hurricaneforce winds. This impact-resistant series is tested at an independent laboratory and certified to comply with Florida State Building Code Regulations. After Hurricane Andrew in 1992, Florida changed and implemented new construction codes to minimize property damage due to hurricanes and atmospheric events.
Testing and Certification As a window and door manufacturer, they must send the product to an independent laboratory and hand in the construction specifications and material details in order to certify the products. At the lab, the personnel will put the product to the test, putting it thru positive and negative wind pressures of up to 170 mph, throwing projectiles at different points at about 34 mph. The units are cycled at pressures that start at 115 mph until achieved pressures over 180 mph. After that, the laboratory sends the results to Air Master Engineer Consultants and they address all the necessary information to the Florida Building Commission for final evaluation and validation. According to experts, the glass used in this series with the impact resistant certification is a laminated glass that forms a “sandwich� of two glass sheets, available in different thickness grades; very similar to the material of the windshield of the cars or the windows of the airplanes. The glass in these products does not allow projectiles, water or wind to pass through it even under the pressure of a severe impact. In the case that the glass does receive a severe impact, it could splinter, but does not break. It’s not only the glass component that makes a window or door resistant to impact and hurricanes, but the entire system. This includes

the aluminum gauge, glass, structural silicone, and a professional installation following all the product specifications, taking into account the types of screws, number of screws, installation surface and experience of the personnel.
Post-Hurricane Rebuilding After Hurricanes Irma and Maria, the majority of the damages on Puerto Rico were due to poorly installed windows and doors. In order for these products to withstand water and wind, they must be properly installed according to the technical data sheet of each of the products. Windows and doors fulfill essential functional and aesthetic roles. Before choosing these products for your property, it is very important

Leverick Bay, Virgin Gorda Leverick Bay Resort and Marina took a direct hit from Hurricane Irma and suffered extensive damage. Roofs and buildings were ripped apart, and the beach bar and retail shops were destroyed. Water and debris filled the entire property, taking a toll on nearly every part of the resort. Just days after the storms, Leverick Bay staff began arriving to help clear debris and assist with cleanup of the property. Construction

Anegada B each Club, Anegada The BVI’s largest island, Anegada was hit nearly directly by Hurricane Irma. Incurring $3 million in damage, Anegada Beach Club has worked hard to recover their unique place as a top resort on the island. The gift shop, restaurant and hotel fared the best and suffered 25% damage. The luxury tents on the beach – a top draw for vacationers – were completely destroyed. Since the hurricanes, Anegada Beach Club has rebuilt and upgraded all facilities. The eternally popular luxury beachfront tent accommodations offer an incredible view for guests to enjoy the sea breeze and the sound of the waves in a truly unique way. In addition to having completely refurbished beach accommodations, the resort has hired 20% more staff and is purchasing Anegada Beach Club’s blissful tents have been rebuilt stronger than ever

Cooper Island B each Club, Cooper Island Compared to other outer-island resorts, Cooper Island Beach Club (CIBC) fared well. When Hurricane Irma swept over the BVI, CIBC was closed for their annual maintenance work, so all but two staff were off island and hurricane preparations had been completed well in advance. All buildings that had been renovated after 2009 remained structurally sound, and CIBC credits this to Smith-Arneborg Architects for their solid designs and ES Construction’s excellent build quality.

Both docks were destroyed and storm surge drowned the restaurant, bar, kitchen and beach pavilion. The roof of the power-control roof was completely torn off and the storm caused catastrophic damage to inverters, batteries and generator. Miraculously, only 42 of the resort’s 288 solar panels were damaged. Local teams from ES Construction and renewable energy experts aTec BVI assisted with recovery efforts right away and all critical systems were completed in March 2018, allowing CIBC to reopen for guests on April 1st. The power control room now has a solid concrete roof. Boardwalks have been moved further up the beachfront to counteract the inevitable effects of climate change and rising seas.

A sustainable and eco-friendly resort (the property is 85% solarpowered), CIBC offers a laid-back luxe feel. While the beach is missing some foliage, the kitchen garden will soon be better than ever. The resort produces its own drinking water and the on-site microbrewery offers a full range of draft beers. “Our sustainability is our best feature, and everything is locallysourced or homemade wherever possible to reduce imports and support local farmers, fishermen and producers,” said Samantha Baker, CIBC Resort Manager. Guests get a unique experience, even when self-sufficiency isn’t an option. A new and expanded rum bar features the largest selection of rums in the BVI and the Sea Grape

Stress can cause us to overeat and in turn, eating items that aren’t nourishing can put our bodies in a “survival mode” and cause us to store more fat. That being said, eating our favorite foods can actually relieve some stress, but moderation is key. Choosing healthy meals and snacking on nuts and seeds can replenish much-need vitamins and nutrients to help the body heal.
