FOREWORD Regulation 37 of MARPOL Annex I, as amended by Resolution MEPC 117(52), requires every oil tanker of 150 GT and above and every ship other than an oil tanker of 400 GT and above to carry an oil pollution emergency plan approved by the Administration. For new ships the rule became effective on 4 April 1993. For ships built prior that date it took effect on 4th April 1995.

Regulation 17 of MARPOL Annex II requires every ship of 150 GT and above that is certified to carry noxious liquid substances in bulk to carry on board a pollution emergency plan for noxious liquid substances not later than 1st January 2003. Ships to which both regulations apply may have a combined plan called a Shipboard Marine Pollution Emergency Plan, or SMPEP.

This shipboard marine pollution emergency plan has been developed with the above requirement in mind. The purpose of such a plan is to give the Master guidance on the action to be taken if a spill of oil or noxious liquid substance has occurred or is likely to occur, whether from routine operations or after a major incident such as a collision, fire or explosion. The plan is based on the guidelines issued by IMO Resolution MEPC 54(32), adopted by the IMO Marine Environment Protection Committee on 6 March 1992, and amended by MEPC 86(44) on 13 March 2000 and the SMPEP guidelines in Resolution MEPC 85(44) dated 13 March 2000, as amended by the Resolution MEPC.137(53). The plan is prepared to satisfy the requirements for oil or noxious liquid substances pollution emergency plans and relevant oil or noxious liquid substances pollution reporting procedures that are contained in Articles 3 and 4 respectively, of the International Convention on Oil Pollution Preparedness, Response and Co-operation (OPRC), 1990.

WHENEVER SAFETY CONSIDERATIONS PERMIT, OIL OR NOXIOUS LIQUIDS SPILT ON DECK SHOULD BE PREVENTED FROM FLOWING OVERBOARD.

The plan required by MARPOL, in the regulations referred to in above paragraph, will not fully meet United States regulations applicable to vessels which carry oil in bulk, either as primary or secondary cargo. Under the US Federal Water Pollution Control Act (FWPCA), as amended by the Oil Pollution Act of 1990 (OPA 90), owners or operators of such vessels in US waters must additionally:

Regulation 37 of MARPOL Annex I, as amended by Resolution MEPC 117(52) adopted on 15 October 2004, requires every oil tanker of 150 tons gross tonnage and above, and Regulation 17 of MARPOL Annex II, as amended by Resolution MEPC 118(52) adopted on 15 October 2004 requires every ship of 150 tons gross tonnage and above certified to carry noxious liquid substances in bulk, to have a shipboard emergency plan with four elements:

identify and ensure, through contract or other approved means, the availability of private firefighting, salvage, lightering and clean-up resources;

identify a qualified individual with full authority to implement the response plan, including the activation and funding of contracted clean-up resources;
