t few years, we’ve grown accustomed to a used truck ts, derived in no small part from the heady days of 2006 uck sales reached record proportions, with Class 8 production topping 320,000 units built and sold in one year alone. Yet all that new iron meant a lot of older iron got traded in. And when the global economy collapsed in a lot more iron got added to the Used-truck prices 2008, pile as trucking companies large and are on the rise as small went under. Now things are changing, which is stock decreases both good and bad news for the usedtruck market. On the one hand, a far more cautious approach to acquiring iron convinced many hitherto new-truck-only buyers to start shopping for used equipment in earnest. That’s helped push up used-truck sales and prices. The downside is with new-truck production rates reaching abysmal lows in recent years (for Class 8s, 95,000 in 2009 and barely 110,000 in 2010), there’s a rapidly growing dearth of used trucks to be had at any price and it’s only going to grow worse this year. Steve Tam, vice president-commercial vehicle sector with ACT Research Co., told me recently that the average price for used Class 8 units sold is now up 35% since the early part of the third quarter in 2009; however, the volume of used Class 8 sales is slowing as the supply of desired models gets snapped up. Surely, that’s good news for sellers, but for buyers it means slim pickings for a while. AT

Proposed HOS rule meets swift criticism

R

eaction was swift to the hoursof-service (HOS) regulations proposed by the Dept. of Transportation’s (DOT) Federal Motor Carrier Safety Administration just before the holidays. Released publicly on Dec. 23, 2010, the proposal would retain the existing 34-hour “restart” provision that DOT said allows drivers to “restart the clock” on their weekly 60 or 70 hours by taking at least 34 consecutive hours off-duty. Under the new proposal, the restart period would have to include two consecutive off-duty periods from midnight to 6 a.m. The proposed rule would also require truckers “to complete all driving within a 14-hour workday, and to complete all on-duty work-related activities within 13 hours to allow for at least a one-hour break.” It did not specifically state whether drive time would be cut to 10 hours per day or stay at the current 11. Bill Graves, president & CEO of American Trucking Assns. (ATA), said the proposal was “overly complex, chock-full of unnecessary restrictions on professional truck drivers and, at its core, would substantially reduce trucking’s productivity.” According to ATA, the proposal would reduce the maximum daily driving time to 10 hours, reduce the maximum daily working time window by an additional hour, and abolish the 34-hour restart as it exists today, despite what the press release from DOT said. “When viewed against trucking’s sterling safety record,” said Graves, “it’s plain that the Obama Administra-

DOT has not decided on drive time. tion’s willingness to break something that’s not broken likely has everything to do with politics and little or nothing to do with safety or driver health.” In its response, the Owner-Operator Independent Drivers Assn. (OOIDA) declined to take a formal stance at this point, instead renewing its call for flexibility in a driver’s workday. “To say the least, federal hours-ofservice regulations are consequential to the lives and livelihood of our nation’s truck drivers,” said Todd Spencer, OOIDA executive vice president. OOIDA has maintained that changes to the regulation need to comprise all aspects of a workday, including loading and unloading times, split sleeper berth for team operations, and the ability to interrupt a 14-hour day for needed rest periods. “We want the motoring public to know that it’s not just about how long a truck driver spends behind the wheel that affects the safety of everyone on the highways,” said Spencer. “Many truck drivers spend between 30-40 hours per week waiting at loading docks. Everyone involved in transportation, from shippers to receivers, has a responsibility for its role in keeping highways safe.”

Alternative to trailer skirts

A

n aerodynamic system with components that mount under the trailer offer an alternative to side-mounted skirts and can improve fuel economy by up to 11%, according to developer SmartTruck. The basic component of the UT-6 is fitted ahead of a trailer’s axles, changing the airflow to reduce drag and improve baseline fuel efficiency by 8.5%, the company said. Additional components mounted around the wheels can further reduce drag to deliver the improvement seen in test runs. The company said the system is made of polyethylene plastic and mounted with galvanized hardware and fasteners to resist weather and chemical damage. A full UT-6 system adds about 350 lbs. to a dry van trailer, and installation is said to take about three hours. Tire dealers always lo d to the first real snowfall of the season, when all of the trucks with marginal tires get stuck or have a harder time dealing with unplowed surfaces. According to the Federal government, the minimum tread depth on commercial vehicles is 4/32 of an inch on steer tires and 2/32 of an inch on all other positions. Contrary to what some believe, the regulation specifically states that a vehicle will not pass inspection if the tread depth is below the legal limits “when measured at any point on a major tread groove.” That means one thin spot or one wear bar that is worn evenly with the tread is enough to receive a citation. But insufficient tread depth has additional consequences. Studies have shown that as the tire wears down toward that 4/32 mark, the stopping distance required on wet surfaces steadily increases. Once the depth passes 2/32, the additional room that may be necessary to stop 80,000 lbs. may be the difference between a routine stop and a rear-end collision. It’s definitely a double-edged sword. On the one hand, the fleet feels the need to squeeze out every mile-per-thirty-second of tread depth it can get, but on the other hand, tires with marginal or “illegal” tread depth can also be a smoking gun in the event of an accident.

Retreadability is also affected by the amount of tread depth that remains on the tire prior to retreading. In the case of a new tire that will ultimately become a “virgin” casing, I’ve seen hundreds of casings rejected because the tire was run down to the 2/32 limit. It really is the perfect example of being penny-wise and dollar-foolish because the cost-per-mile difference between a new tire and a retread is widening with every price increase. If truckers want to preserve casings and control tire costs, they must work with their retread vendor to ensure that the pull-point protects the integrity of the casing. It’s also important to note that fuel-efficient tires and retreads typically have more shallow tread depths, so there is less rolling resistance. This means the fleet may have to balance the gains in fuel mileage against the potential loss of miles-per-thirty-second. While there have been some rumors regarding the decreased stopping ability of these new fuel-efficient compounds, there is no data to support the fact that low rolling resistance tires and retreads stop better or worse than their standard counterparts. Finally, fleets must recognize that tread depth can be impacted when dual tires are not matched. It’s hard to justify two new tires when only one is needed, but a mismatched set of duals creates a number of problems. First, the larger tire carries more weight, which makes it more susceptible to an overload situation and causes it to wear faster. And second, the smaller tire ends up skipping on the pavement to keep up with the larger tire, so it typically develops an irregular treadwear pattern. The general rule is to ensure that the tread depth between dual tires does not vary by more than 4/32 of an inch. AT

Over at Fontaine Trailer Co., more of the company’s flatbed customers are asking for equipment that delivers “weight savings and load securement that address the rules under CSA,” says Hank Prochazka, vice president of sales. Prochazka described the new Revolution series of trailers with unitized construction. “This construction technique reduced the overall weight of the trailer by 1,000 lbs., increasing the amount of payload it can carry. It also increased the strength of the trailer, creating better tracking and reducing tire wear by 45% [through] a more aerodynamic underside with a low drag coefficient.” And there’s more good news: Technology Maintenance Council testing determined overall fuel savings to be 3%, he said. “In the load securement area,” Prochazka continued, “we added routed single-piece side rails; friction stir welding on the deck [that] provides greater floor strength and lighter deck weight; and an integrated load securement system with module connectors that slide exactly where they provide the best position to safely secure a load.” The wiring harness of the flatbed and drop deck Revolution trailers is set underneath the center to protect the lighting system from weather or tire spray. The Fontaine Revolution Hybrid combo forged from steel and aluminum carries as much as 54,000 lbs. concentrated load in as little at 4 ft. With fewer than half the number of parts used to build a standard trailer, the allaluminum trailer series weighs in at just 8,960 lbs. East Manufacturing Corp. features its East MMX Flatbed, which is equipped with an extra-strength main beam made by joining dual T-beams at their axis. This maintains the same ground clearance no matter the load and allows clearance for lift axles as well. It can handle loads up to 72,000 lbs. concentrated in 4 ft. on a 48-ft. trailer, and up to 145,000 lbs. distributed over multiple axles. The trailer is built of aluminum alloy, which weighs 56% less than high tensile strength steel, the company said.

Its East BST, or Beast flatbed, is rated to handle loads up to 50,000 lbs. concentrated in 4 ft. on a 48 ft. trailer; up to 60,000 lbs. spread over tandem axles. With selected options added, the Beast can handle concentrated loads like steel coil. East also carries drop platforms. Utility Trailer Manufacturing’s 4000A flatbed has been re-engineered and built of aluminum and steel for lighter weight. The 4000A model has a plasma cut onepiece main beam web, but the company has added a “hatshaped” top flange to which the adjacent aluminum floor planks are attached. The pipe spools, which are welded by robots, surpass DOT specs for load securement points, the company notes. The workhorse all-steel flatbed 4000S series has the same plasma cut main beam web. All Utility flatbeds have a beam capacity up to 80,000 lbs. when evenly distributed; up to 60,000 lbs. concentrated over 10 ft.; and up to 57,000 lbs. single coil capacity centered. To meet customer specs, extras like additional floor nailing strips, sliding suspensions, and special reinforcement packages are offered. Wabash National Corp. has an array of trailers in its Combo Eagle flatbed series ranging from standard to heavy-duty and even extreme-duty models. Extreme-duty trailers come in various lengths up to 53 ft. and widths of either 96 or 102 in., with aluminum floor, front and rear plates and side rails, plus 5-in. floor sills. The beam rating, based on a 121-in. axle spacing, is 80,000 lbs. in 10 ft.; 73,000 lbs. in 4 ft. Wabash also offers the Transcraft drop deck in lengths of 45, 48 and 53 ft. and widths of 96 or 102 in. Also available are 4-in. steel floor sills and apitong hardwood floors.

ach individual state is responsible for determining the laws that govern workers’ compensation insurance for businesses located within its borders. Those laws, though, can be confusing for many motor carriers that may have employees or leased owner-operators from several different states working for their company. Workers’ compensation laws in many states cover residents even when those residents work in a different state. Some states allow occupational accident insurance under specific strictures. Even some shippers and brokers require workers’ compensation insurance for any

trucking company or trucker hauling their shipments. Like any insurance plan, workers’ compensation insurance and occupational accident insurance policies can be difficult to understand. How much do you need? What is required by law? Do you even need the insurance? Workers’ compensation insurance provides payments to injured workers without regard to who was at fault in the accident. It also provides for time lost from work and for medical and rehabilitation services. Death benefits to surviving spouses and dependents are also included. Because this is essentially a pure, nofault form of insurance, workers—in theory—give up their right to sue if they accept statutory benefits. In reality, however, the level of benefits is often contested and there are other nuances in the law that are frequently litigated.

Each state has different laws governing the amount and duration of lost income benefits, the provision of medical and rehabilitation services, and how the system is administered. Be sure to work with an insurance expert knowledgeable in workers’ compensation for the state in which your trucking company is located. Many companies have employees or lease operators who live in states other than the state where the trucking company is located, and drivers routinely travel in states where they neither live nor where their company is based. Frequently, which state takes jurisdiction in the event of a claim is disputed. Is it where the motor carrier is based, where the employee resides, or where the accident occurred? Depending upon the facts of each accident, arguments can be made supporting any of the venues. Because benefits vary from state to state, injured drivers and their employers can often find themselves at odds in such disputes. More often than not, claims are adjudicated

espite what headlines and talking heads still blare about high unemployment, the busted housing market and tootight credit, there is much positive news truckers can relish in at the beginning of 2011. For starters, William Strauss, senior economist and economic adviser to the Federal Reserve Bank of Chicago, told attendees at a conference held in the fall by trucking forecasting firm FTR Associates that the “U.S. economy is solid and growing slowly, which is great but not exciting.” “The current economic downturn resulted in a 4% drop in the U.S. economy,” Strauss pointed out. “That’s a far deeper drop than what occurred in the recessions of the 1970s and ’80s [3%] but not as bad as the Great Depression [which amounted to a 26% cliff dive].”

WHERE’S THE BOUNCE? “We have not seen the normal ‘bounce-back’ yet from the socalled Great Recession of 2008-09,” he continued. “In the 1980s, the bounce-back resulted in 6% economic growth. Instead, we’re seeing smaller growth numbers. We started in Q1 around 3% … that is trending out to 2.4% GDP in 2010 and 2.9% GDP in 2011.” Strauss stressed that “the key to this recovery is manufacturing. In fact, this is the first-ever recovery led by growth in manufacturing, not in consumer spending.” He said U.S. industrial output dropped 17.6% during the recession (which officially ended in June ’09) but has grown 9.3% over the last 13 months—and in so doing has recovered 48% of its decline. Industrial production, though, will slow to

4.1%, Strauss added. “Some 60% of economic growth in 2010 came almost solely from a change in inventories as companies replenished very low stock. That inventory growth is now tapering off.” Strauss said he expects improvement in perhaps the biggest newsmaker holding back confidence in the recovery—unemployment. He said it should wind up at 8.5% for 2010 and fall to 7 to 7.5% by the end of 2012. Touching on some of the other topics that make for grim headlines, Strauss said banks have a “very high cash reserve right now, but are still not lending and that’s a problem. And the consumer savings rate has increased from 1 to 6%. That’s good in the long term, but bad in the short term as it reduces immediate spending that can grow the economy more quickly. Remember, two-thirds of economic growth relies on consumer spending.” However, it’s not just the banks and the great American economic engine of consumerism that are being tightfisted and so visibly contributing to reining in the recovery. The top management of U.S. business concerns should put some of the blame for the economy’s slow return to normalcy squarely on their own shoulders. Transportation economist Noel Perry, FTR Associates senior consultant and principal of Transport Fundamentals, points out another conundrum holding back this recovery. “Economic cycles are much shorter than in the past. That makes business decisions much more challenging. We’re looking [nowadays] at short, deep cycles, so the window for recovery is shortening from five years in the past to more like two years.” There should be opportunities aplenty for trucking this year, given the rosy outlook afforded by the

nonprofit Institute for Supply Management (ISM). ISM’s latest “Semiannual Economic Forecast” forecasts that both the manufacturing and nonmanufacturing segments of the economy will keep the recovery going by continuing to grow this year.

MANUFACTURING BOON Especially cheering for freight haulers should be ISM’s finding that “the manufacturing sector continues to outpace the nonmanufacturing sector and has greater expectations for growth in terms of revenue.” ISM says its overall forecast “projects optimism” about the economy. “The manufacturing sector, overall, is positive about prospects in 2011, with revenues expected to increase in 16 of 18 industries; while the nonmanufacturing sector appears slightly less positive about the year ahead, with 12 of 18 industries expecting higher revenues.” A key metric for trucking to note is that ISM reports that “business investment, a major driver in the U.S. economy, will increase substantially in the manufacturing sector, while investment in the nonmanufacturing sector will increase at a lower level.” Indeed, per the study, capital expenditures by the manufacturing segment are expected to rise by 14.5%. On the services side, capital expenditures are pegged at “growing moderately” by 3.7%. Freight trends appear consistent with ISM’s optimistic outlook on the year ahead. For example, the most recent Freight Flow report by Jon Langenfeld, senior transportation analyst with investment firm Robert W. Baird & Co., shows Baird’s domestic freight index topped 5.9% year-over-year in October. That compares very favorably to 4.3% for September and the 4.8% registered for the third quarter of 2010 vs. Q3

cover story ’09. “Looking into 2011, we expect more modest overall demand trends consistent with expectations for lowsingle-digit GDP growth, but expect industrial-related end markets to outperform retail,” according to Langenfeld.

FREIGHT RECOVERY Already, FTR’s Perry points out, the “strength of the goods side of the economy has made this a strong freight recovery.” He says analysis by FTR shows that while the average quarterly GDP growth in the recovery through 2010’s Q3 was just below 3%, truck tonnage in that period hit 7%. According to Transport Capital Partners LLC (TCP), its latest “Business Expectation Survey” found that 66% of the surveyed carriers expect volumes to increase over the next year. “[In December ’09], about the same share of carriers expected volumes to increase, but a peak of almost 90% was hit in the second quarter of 2010,” says Richard Mikes, TCP partner. He notes further that “the hopefulness which characterized the spring [of 2010] has waned in recent quarters as economic growth has slowed.” Nevertheless, with over threefourths of the surveyed carriers expecting rate increases in the next year, optimism remains high. “TCP’s surveys from the last two years indicate that carriers have become more confident that volumes and rates will increase during the next year, despite the modest drop in the last two quarters [of 2010],” points out Lana Batts, managing partner for TCP. Jason Siedl, an economist with investment bank Dahlman Rose & Co., reports shipping is recovering, but only truckload carriers are benefiting from the capacity shortage, pointing out “LTL carriers are not quite there yet.” How individual carriers will fare

equipment, etc., by manufacturers will grow faster [than consumer spending] because businesses’ balance sheets are in far better shape than those of American households.” Brady stresses that without consumers fully in the game, “this will not be a broad-based recovery. The economy, though, will grow in 2011, but at a sluggish to moderate pace, and truck freight will mirror that performance except in certain, more

ello Pistoresi & Son Inc., a Washington State-based fleet of 18 power units hauling both refrigerated and dry van trailers for food and grocery stores, sees many positives heading into 2011. “Business is getting better,” says Dino Pistoresi, president & CEO. “A lot of companies have gone out of business and that has put a lot of freight out there for those of us remaining.” The company, which also contracts with about 20 owner-operators, has had no trouble yet getting drivers, he notes, in spite of the upturn. “We have a very good retention program, and we work hard to keep things as personal as possible here,” he says. “As a result, people tend to stay with us until retirement.” Pistoresi says the company is also ready for CSA. “I feel good about CSA,” he notes. “We are ready to go. In fact, we just went through a DOT audit and it was the best we’ve had in years. I wish they would just leave hours of service alone, though. We are really dialed into the new limits now and things are working well.” The fleet may be small, but it is committed to using technology to maintain a competitive advantage and to help assure regulatory compliance. “Things have been pretty tough over the last years,” Pistoresi says, “but we did not cut [our GPS/communications systems] out of the trucks.” —WENDY LEAVITT

RATES TO RISE Dahlman Rose’s Siedl expects truckload rates will continue to rise, but cautions that “everyone—carriers and shippers—is worried about the impact of [FMCSA’s] CSA.” FTR’s Perry says the biggest issue facing fleets going into 2011 and beyond is the “constricted pipeline” for driver supply. “The forecast is for a shortage of 150,000 drivers within two years,” says Perry. But he says to “expect a bigger driver shortage when hours-of-service [HOS] rules change [this year].” On the other hand, lack of drivers will force freight rates to go up. Perry figures that rate hikes on average of 10% or even 12%—before fuel surcharges—will be “possible as fleets deal with challenges [including] a driver shortage, the cost of regulatory compliance, and the hefty price tag for new equipment.” Those high regulatory compliance and equipment costs will also impact individual owner-operators and small fleets. As a result, their historic swing capacity cannot be counted on to be there when larger fleets need it as the recovery’s pace quickens. Perry sees “government intervention clouding the economic picture significantly” for all fleets. “Companies are not spending capital on fixed investments as it typically takes 10 years to recoup, which is too long [a period for them to accept given current market conditions].”

Shipments to stores will slow as retailers have now replenished inventories. only orderly element [in this year’s] freight forecast.” Despite a driver shortage promising to be massive and the costs and uncertainty that result from new government regulations, the picture most experts paint of a slow but steadily growing recovery will mean many fleets will at some point have to add equipment capacity. But when fleets are ready to buy trucks—new or used—they will find the marketplace has changed dramatically, thanks to the Great Recession. “There’s a used-truck shortage coming and we think supply is going to be tight for three or four years,” advises Steve Clough, president of Arrow Truck Sales. Supply and demand is the big issue in the usedtruck market,” he said. “Right now, there’s almost no supply of 200,000to 300,000-mi. trucks in large numbers. There’s not even an oversupply

of 400,000-mi. trucks—and those are what fleet retail buyers are looking for. Basically, this means the ‘usedtruck option’ for fleets trying to put off buying new equipment may not be there much longer—if it’s still there at all,” he adds. Eric Starks, president of FTR, is cautious about fleets buying new trucks. His firm’s preliminary data released in December shows November Class 8 truck net orders totaled 26,005 units, a 38% increase over October. More significantly, that’s the highest monthly order level since May 2006. “That truckers are willing to start ordering equipment is certainly a good sign,” says Starks. “What we are not seeing are the smaller and medium-size fleets participating at the levels we would normally expect during a recovery,” he continues. “Until we see this group jumping back into the market, we will continue to be optimistic, but with a degree of caution.” Although prepared from a wide range of sources, the outlook presented here singularly positions 2011 as a year for slow yet steady growth overall for motor carriers. It will especially be a good, if not killer, year for larger, well-heeled fleets and those smaller ones that rode out the recession, thanks to extremely savvy management. AT Fuel will still be a concern, but experts believe truckers will see some price stability.

FUEL-PRICE STABILITY While the cost of fuel will keep tearing at every budget, it seems that truckers will not suffer from price volatility this year. “Oil prices will rise over the long term, back near $100/barrel by the end of 2011,” predicts Dahlman Rose’s Siedl. “That being said, oil prices—and thus diesel fuel costs—should be moderate and stable for the year. single-truck operation to ng just a little more 20 years l cMahon Transport Group has used some good, old-fashioned American ingenuity to find success. The Lockport, IL, petroleum hauler now runs 20 tractors hauling 20 Heil and LBT tankers to meet its needs in and around the Chicago area. But back in 1990, McMahon, founded by James L. McMahon with his son John, was a far cry from the 50-person operation it is today. That simple operation, which began with a single Peterbilt tractor, added its first true employee three years later along with a brand-new truck, and has never looked back. Today, McMahon hauls “pretty much” any fuel, including gasoline, biofuels, diesel, jet fuel, racing fuel and kerosene. The company, which purchased 10 new tractors last year— six Peterbilts and four Macks—is the exclusive hauler for Texor Petroleum and holds contracts with many more companies. Delivery sites include gas stations, O’Hare International and Midway International Airports, and City of Chicago facilities. McMahon runs two shifts each day, moving about 6 million gallons of fuel a week. Each tractor runs about 100,000 mi. a year to customers in the Greater Chicagoland

area along with some in Northwest Indiana. McMahon feels the company’s real success comes from the decision to embrace technology. Each truck is equipped with a Symbol handheld computer and Zebra printer so drivers can remain in contact with dispatchers. The printer allows for printed delivery orders to be sent to the driver, eliminating human error and/or miscommunication. But handhelds were just the start of the company’s success with technology. Way back in 1999, John McMahon believed the company needed a computerized dispatch system.

IN SEARCH OF A SOLUTION

“Eleven years ago I knew I needed something,” John McMahon says. “There was nothing out there, so I hired a company to build it.” Since then, that first system has gone through three subsequent incarnations to become a web-based program called Digital Fuel Solutions. “After I saw what this [program] did for us, I sold it to others in the Chicago area, and now I think it’s in four different states,” says John McMahon. The system is fairly simple, yet quite complex. It taps into the in-

ventory levels of customers and pulls that information into the company’s database. After a few computer calculations, the system determines when the next delivery is needed and schedules that delivery. Dispatchers used to spend three hours a day doing the same work, John McMahon says. It also allows distributors to view gallons and manifest numbers for every delivery; to stop deliveries to delinquent accounts with a simple click; and to generate reports. Gas station owners benefit as well by being able to see their delivery status on the web; to retrieve necessary reports; or to place an order online. The system handles payroll, billing, and load generation and despite having more than 500 gas stations on the system, does not require any human interaction. The system can handle the tasks that previously required four employees, helping McMahon Transport save $3,800 a week. “I knew that I would never have a life if I didn’t have a system that could do my job for me,” jokes John McMahon. And that system has helped McMahon Transport Group thrive where others have failed.
